In August 2021 I made a video about someone and his company for marketing a machine that supposedly generates energy from magnets. Since this is physically impossible I made a basic debunking of the claims made, but I dug deeper in the companies behind the machine and their business practices. Before I even got 200 views on Youtube the subject of the video (he is also the inventor) said that I had 24h to remove my video or he'd file a federal lawsuit against me. I didn't want to remove it, but my wife was worried and I promised her to remove and so I did. He claims my video is defamatory. I think he uses the word "defamatory" more than 5 times. He says that my video has already caused his company financial damages and it could cause irreparable damages in the future. He says: "Your statements are actionable. Your basis in your efforts and publications are pecuniary. Defending a Federal lawsuit cannot possibly be worth your time and money for a couple of hundred views." That part about "actionable statements" are interesting because he really wants to make it "defamatory" - and as I understand it, that is "Defamation Law 101". I wonder if US Federal law works in Europe where I live, probably not. I have sources for everything that was stated in the video. I never claimed anything and I never stated anything that wasn't already reported elsewhere in the media and the rest are obvious facts, Scientific Facts. He wanted me to take him seriously so he named the legal firm that he would hire and wrote this: "I want you to understand that I am law trained and a non-practicing Member of the American Bar Association. Please take my outreach to you seriously" My 1st question is.. could I have left my video up? Can I, as a European be sued for defamation by a US citizen? I did remove the video, but I will upload new one this spring where every single line of the script has a reference… so my second question is: if this company or this person is damaged by my video would it constitute as defamatory- even though everything is the truth and backed by references? Mid 2020, I went and bought a tractor from a small dealer local to me. In the purchase agreement, I put my car up (I own) as collateral in case I default on the loan which I got through the dealers in-house financing. In this contract, it stipulates that I must keep the assets in good working order and must have insurance on the tractor and collateral (my car). Along with the in-house financing, they suggested an insurance company they work with for a good deal, to which I agreed to use, and subsequently started paying for coverage on the tractor. I am allowed to augment insurance coverage through a different agency on the tractor and collateral, so long as I have and maintain insurance coverage. I opted to continue using the insurance company I've been with for my car since it was already covered. January 2021, big winter freeze hits Texas (9°F). I drained the engine of water/ coolant to prevent damage, but a residual pocket of water expanded and cracked the engine. The engine was replaced under insurance in July 2021. I renewed my insurance coverage in June 2021 to carry me through June 2022 since I pay the full yearly amount all at once. Fast forward to December 2021, I receive a demand letter from the tractor dealer saying I must provide FULL coverage on the tractor and collateral before 31 December 2021 or I will be in default of the loan, with repossession of the tractor and car resulting. I have had full coverage on the tractor since purchasing it in 2020, but my car had liability since I own it outright. To meet the terms of the demand letter, I went ahead and added FULL coverage to my car 8 days prior to the Demand letter deadline and provided proof to the dealer. I am now being sued in small claims court for not maintaining insurance coverage and they are seeking to repo the tractor and my car. I've never missed a payment, I've maintained consistent coverage on the asset and collateral, and I met the terms of the demand letter prior to the deadline. I've reviewed the purchase agreement, and NOWHERE does it state that I must maintain FULL coverage on the tractor and car; only that I "must maintain insurance coverage" on the tractor and collateral. Are they breaching their own sales contract or committing fraud if I have documentation of coverage and payment info? Can I counter sue for full ownership of the tractor? [link] [comments] |
Posted: 16 Jan 2022 06:20 AM PST Hello! I was recently arrested at the Bellflower courthouse for Disobeying a Court Order and i really feel like i have a "the most fascinating type" of case. I had originally entered the courthouse to ask for the Sheriff's office that was located below the building. After being redirected i proceeded to film my interaction in the office. (Now for a reminder, the Sheriff's office is within the same building of the courthouse, it is accessed from the front.) I was there to file a complaint and exercise my first amendment right to record the interaction when i was immediately told to put my phone down and stop recording. After being shown a court order signed by the very judge that resided in the courthouse i was threatened with arrest for trespassing. Before being arrested I told them there should be no court order prohibiting me from recording a public agency.. ultimately i was charged with Penal Code 166(a)(4) - Willful disobedience of the terms, as written, of a process or court order or out-of-state court order, lawfully issued by a court, including orders pending trial. I was in a holding cell for two hours, faced a judge and was told i had "no charge" at the time. (This is before i was released and charged with Penal Code 166(a)(4) The judge told me they'd be holding my phone and GoPro camera as evidence and i have a bench warrant for March. (2 months from now.) I am in disbelief because i am well aware that the courthouse is a public building as is the sheriff's station where i had business to conduct. I believe what the judge ordered was wrong and unlawful. She swore an oath to uphold the constitution and this court order completely goes against the first amendment. What can i do here? I 23(f) am in a bit of a problem at the moment, my dad whos almost 60 is trying to sue me for grandparents visitation rights for my son(2) for one weekend a month. My father is extremely toxic and abusive, not anymore physically but he was with me. I dont know what to do, ive been told that if i get a RO first with me and my son on it then he cant file for visitation rights, or it will hinder the lawsuit on his side. Im moving to WA state in a few months as well and id rather use their laws from what ive read. If i move to WA before he can file will he have to file in WA or will it still go through in AZ without me present? And will a RO make a difference? I dont want him to have any visitation rights to my son due to past abuse with me. Hes proven untrustworthy and still set in his abusive ways. Also i have only 1 CPS case on the abuse but nothing came out of it and its from the state of IN. i was 16 and they never came for a follow-up. however i know the case existed at some point because they took pictures, and if anyone asks why i dont have more proof of his physical violence against me, i was manipulated by both parents and i was always too scared to speak up so nothing ever came of it. Details that might be useful pr irrelevant: Kiddo was born out of wedlock Kiddo's dad is a deadbeat with no job which is why im moving to WA away from him with kiddo I still havent filed for full costody of kiddo from kiddos dad Kiddo is 50% native american but not yet associated with any tribe, his dad is native, i am white. My main questions are: What do i do? Will getting a RO before he files help me? Can i still move to WA and would it be beneficial to me to do so? Or will it work against me? Protections for assault victims Posted: 16 Jan 2022 06:54 AM PST I've been taking this past week off to handle a situation where I was assaulted. I'm in Virginia first off and I know there are protections allowing victims of domestic violence or assault to take time off with no repercussions. My job has a 6 absences a year policy. I'm approaching this quickly as the schedule was already out when the assault happened so I've had to callout the past few work days to handle the situation. However I'm wondering if the policy can be applied to time off due to domestic violence or assault. Any input is appreciated. Just please be mindful in how comments are worded due to the sensitivity of this situation. TIA. I have also at this point requested to be taken off the schedule for the next week to handle my situation. I've started intensive therapy and I'm working with a detective as well. This next week is the most intense week but the following I'll be able to return. I have not been at the job long enough for medical leave or anything but the laws I've looked at don't seem to be contingent on how long you've been at a job. Essentially I just need help understanding if my time off due to an assault can be counted towards my 6 days off a year or if it has to be separate as calling out more than 6 days leads to termination which I believe would be considered a repercussion that I'm protected from due to the situation. So, don't wanna get into details but I am in Pennsylvania, USA. The situation was a bit… embarrassing for me and it's something that would make for a funny YouTube video if they choose to upload it. Are they allowed? Do I have to call the station and tell them I don't want it to be shared anywhere? Please help EDIT: also, I want to mention that it was not a crime. Are my parents lying about the length of my pre trial diversion? Posted: 16 Jan 2022 06:17 AM PST Florida Hello I am 14 and I was put on pre trial diversion around late 2020. I was wondering if my parents were lying about the length of my diversion. The first thing that doesn't make sense is that on the papers it said that I can't access the internet until all conditions are met which were write an apology, agree to random tests etc. I was only unable to use the internet for a month. Also another thing is that when I get tested (by hair) my mom puts my name on a bag with some numbers and cuts off a tiny piece of hair, puts it on tape, and then puts in the bag. Also I'm pretty sure hair taped to the side of the bag would be kinda unable to get tested because its stuck to the tape. And then she says that she drops it off at the police station. I don't meet anyone or even have a diversion officer. I have read online that when you get tested by hair you meet your probation officer and then they take a dime sized chunk out of your hair at the place. Also with the hair tests you are supposed to do the hair closest to your scalp, but when my mom cuts it off she does it at the end. Also they have told me that the charges are dismissed and it is getting close to being expunged, but for it to be dismissed and expunged the diversion must be completed. The main reason why my parents would do this is because I have done a decent amount of drugs (weed, xanax, lean, hydros, whippits, dxm, dph, acid) at 14 and they know about the xanax and weed and want me to stay far away from that. For the concerned people in the comments, If I were to find out that they were lying about the tests/length of the diversion the only thing I would do is weed, nothing else. I'm going thru a nasty divorce and have not been doing so well mentally. Several times these past few months I've wanted to go to the ER to admit myself for being suicidal. Real suicidal plan thoughts: crashing into another car or a tree, going to the pharmacy just to buy pills to down, etc. I have not done it for fear I'd lose custody of my children. My parents are available to take care of them if anything were to happen. I'm just afraid of being admitted and then the state taking my kids away for being unfit to take care of them mentally. Is there any possibility that I can break the lease as this premise is too far away from my college? I spoke with the landlord about breaking the lease. The landlord threatened me that if I take any legal action it would create a big problem for me as I am an international student. Buying home but agent didn't send list of repairs by deadline Posted: 16 Jan 2022 06:52 AM PST Hello just wanted to see if anyone had any advice or could at least help us figure out our options in our situation. I created this account just get more info We're buying a home in Ohio. Our agent originally had asked for a 10 day inspection period but the seller changed to 7 and I guess our agent didn't notice. Well we got the inspection done and there were alot of issues we weren't aware of. Some were pretty minor but some could definitely get expensive and/or dangerous. We sent the list of things to our relator that we wanted done or at least some type of credit. He honestly acted like we shouldn't request alot of the issues and multiple times kept asking if we were sure. We explained to him the prices to fix just the issues on our list would cost way more than we could afford and we felt were worth the price of the home. We were willing to back out of the deal. He finally agreed to send the list. But then a day or 2 later he called us informing us he misread the deadline. The seller wasn't willing to negotiate obviously. He said we could either back out and lose our earnest money or go forward with the deal and he would give us 1000$ towards reapirs. I'm in the process of trying to get estimates but from what I've gotten so far it will cost between 3-5k just for the electrical issues (alot are fire hazards and I don't feel comfortable moving into a home with all the issues). And it could possibly be more depending what other issues they run into during the repairs plus the rest of the list we had originally wanted seller to fix. He put us in contact with his broker and she's being alot more helpful but we haven't gotten anything in writing they will cover the repairs. They're supposed to be coming up with a list they will cover though. But she's acting like our only option is to go forward with the deal. We love the home and do want to but only if we know these list of issues are addressed. There's other things in the report we didn't even include that concern us and we already have to deal with. Basically we'd just like to know our options. If we back out and are sued by the seller would our agent be liable? Are they liable for at least the repairs on list we sent? We were suggested the agent from Zillow also idk if that matters. We just don't want to think we don't have any other options and then be stuck with tens of thousands of dollars in repairs when we did.
