Advice with “not at fault” car insurance claim in Florida while a passenger in LYFT, and the process please

    Posted: 06 Sep 2021 02:24 AM PDT

    Hello,

In winter of 2019, my family and I were on vacation in Florida (were from Canada), and while utilizing a LYFT to travel around Florida, when we were rear ended on the interstate at a very high rate of speed. (For reference https://imgur.com/a/tHiZ0bE)

The driver that hit us was not paying attention and was ticketed and deemed 100% at fault.

We were all shaken up pretty bad, but we were happy to be alive. We didn't bother getting checked out until we were back home in Canada, as we were "okay".

In Canada all medical bills would be covered under our health insurance, so a lawsuit wasn't a concern, not to mention in Canada it's completely different the way things are.

Fast forward a few months after the accident, an Esurance claims adjuster and and adjuster for underinsured motorist claim on behalf of Lyft, emailed us asking to forward medical bills or losses, we tell them we don't have any medical because we live in Canada and it's covered.

100k was paid out to the Lyft driver already, leaving a maximum 200k from Esurance based on the person that hit us insurance policy. We thought we weren't entitled to any compensation, originally.

    My injuries:

I had a partially ripped tendon in my shoulder that required 6 months off work, physiotherapy before and after the surgery, along with many painful Corzine shots to my shoulder, before having surgery tying to avoid surgery. Of course, xrays, MRI… tons of appointments.

This changed my life in so many ways, unbelievable pain, unable to do any activities I enjoyed, unable to shovel snow etc… I could go on… but I'm now fairly back to normal.

It took approximately a year and half for all my medical issues to settle, and I returned to work after 6 months after surgery.

I'm now having major issues getting ahold of my claims adjuster assigned by Esurance, they emailed or called every 2-4 weeks to follow up, but now I have everything complete they are completely ignoring me, I tried calling and emailing several times over the last 2 months with no response…is this a common tactic by them? They already settled with 2 other family members who had not many loses very quickly.

I was wanting to see what type of settlement they would offer me first before considering hiring an attorney, as I'd have to fly to US and would rather not.

From googling it appears shoulder injuries requiring surgery range from 100k to 300k, but other than loss of wages, and pain and suffering, we have no medical bills from it, that was out of pocket… I have no idea what to expect and it very odd Esurance is cutting communication, when I'm ready to hear a settlement.

    My main questions would be:

What type of "settlement range" is considered reasonable based on what I said above?

What are my options for reaching my Esurance claims specialist, can I contact adjuster for underinsured motorist claim on behalf of Lyft and tell them what's happening?

How long after Esurance has all my medical documentation etc, would they consider making a settlement offer, or a reasonable amount of time?

Thanks, any recommendations or advice would be very helpful!

Non Asbestos 60 year old siding mixed with vinyl. (Question)

    Posted: 05 Sep 2021 06:48 PM PDT

Tree hit my house/garage in NJ during Ida. Appears I will get a new roof (1/3 is smashed and there is a hole in the larger side. Back side of bigger section is ok, but 2/3 is damaged.) Question is on the siding. When I bought the house, the front of the house is brown Vinyl siding. The other three sides of the house are white likely non asbestos siding. The side of the garage was this white siding and behind the house. (My ranch has bump outs so about 2/3 of the back was damaged.

What's the protocol here. I assume they will tell me to replace with vinyl (Replacement cost policy) for the side and 2/3 the rear. Then I have brown, new, and still some white all about 1/3 each.

Not sure the brown can be matched, but maybe, prior homeowner did it about 12 years ago.

    Thanks

Can you withdraw a replacement cost claim for a specific item in home contents coverage?

    Posted: 05 Sep 2021 10:56 AM PDT

I've been paid the ACV already so now I'm buying stuff and sending in receipts to get the replacement cost value that is left over. I had been paid $50 for 3 coffee table books in ACV payments and had $200 more available in replacement costs. Not thinking about it I submitted receipts for 3 coffee table books with a total value of about $50 thus I cheated myself out of the extra $200 I could have gotten. Can I withdraw that claim and go out and get 3 books worth $250?

CA - got hit while changing lanes. Whats the best way forward?

    Posted: 05 Sep 2021 07:24 AM PDT

I was going on the freeway. Wanted to merge left so I looked in my side view mirror and the blind spot mirror. Both were empty. Gave the signal and started merging, before I knew it, bang I was hit. I can swear on my life the lane was empty and I'm pretty certain that the other dude merged multiple lanes to take the exit or swerved into me.

Here is the damage to my car

Here is the damage to his car

He suggested we settle between us but kept saying it wasn't his fault or just tell insurance that it was a hit and run.

What should I do? We exchanged license and registration but forgot insurance. The proof of insurance he gave me later was just a screenshot which had the insurance agent name, number, email. The dudes name and the policy type.

Should I ask him for damages or go the insurance route? How much am I potentially looking at in repairs? Based in orange county California.

    P&C Exam Advice (Again)

    Posted: 05 Sep 2021 03:24 PM PDT

I asked last week, but it didn't get too much traction. I'm not a great test taker, and while I've studied a lot, I tend to fluster and am not doing great at these practice exams. I take the exam on Tuesday, does anyone have some advice? This is the Georgia P&C exam.

Quick question: Order of claims - lawnmower threw rock into car.

    Posted: 05 Sep 2021 02:28 PM PDT

Hey all, just have a quick question about order of claims and what to expect. My parents own a property in the country in Missouri. My brother (adult, doesn't live with parents) was mowing grass and hit a rock and flung it into his friends (also an adult, doesn't live with brother or parents) truck. All MO residents. Probably going to have to replace that cab door which means it's probably more than deductible (I assume). Just trying to get an idea for my parents and brother, is this a homeowners insurance issue or an auto insurance issue? My parents have auto, home, and umbrella policies. Not sure about friend.

Car insurance - questions about subrogation/suing

    Posted: 05 Sep 2021 02:17 PM PDT

    Hey y'all, got a question.

(Location: California) Long story short, I was rear ended by an excluded driver a while back. I paid my collision deductible($1000) and got my car repaired($1500 total repair fees). My insurance company said the claim was in subrogation and they made a demand to get my deductible back. But they did not guarantee that my deductible would be reimbursed.

Now for the questions, will my car insurance provider fight to get my money back, or are they only worried about covering their own skin? Also, will I be able to sue the other driver during the subrogation process? My car insurance provider has been beating around the bush and they do not give me clear answers. Wanted to see if there was someone knowledgeable here who can help shed some light.

Insurance adjusters, what makes content deployments so difficult?

    Posted: 05 Sep 2021 01:31 PM PDT

Hello everyone, so a friend of mine shared a content deployment with myself and six other people, and all but one accepted it. The money was great at $950 per day, but I was told not to bother. What's so terrible about content deployments, and how are you all overcoming the difficulties?

At what point in claim process should I request diminished value claim

    Posted: 05 Sep 2021 01:22 PM PDT

So I was rear ended and just last week I took my vehicle to the shop for an estimate on the repairs. I'm still waiting to hear back from the insurance company on the amount, etc. When should I state that I want to submit a diminished value claim? I just want to make sure they're covering all my repairs, rental, etc and don't want them giving me a hard time for the basic stuff I absolutely need addressed. Because I expect the diminished value claim will have them giving me a hard time and I want everything else settled.

What Would Be Cheaper to Insure?

    Posted: 05 Sep 2021 12:36 PM PDT

    2018 Jeep Compass Latitude - 4WD, 2.4L

    Or 2018 Jeep Renegade - 4WD 2.4L

I would be a rider, age 20, no accident history.

Policy holder would be age 59, no accident history

    Am I At Fault?

    Posted: 05 Sep 2021 09:37 AM PDT

About a year ago I was backing out of my friend's driveway and the guy who lives across the street was backing out of his driveway at the same time. (His driveway isn't directly across from my friend's driveway, but north of it by approximately 4-8 feet.)

I didn't see him, likely because he was in my blind spot.

He says he saw me backing, stopped and I hit him.

We called the police but no one was charged and no police report was made. There was no particularly visible damage to either car - I have a single scratch on the bumper of my Chevy Cavalier which has not been repaired - and no one seemed or reported being injured.

Neither car was going fast; he says he was stopped and I was going super slow, carefully checking both ways because, while it's in a quiet residential neighborhood, there's a restaurant at the end of the block and it's not unusual to see pedestrians and people on bikes passing by my friend's house on their way to the restaurant.

I understand that, if he was in fact stopped and I was moving, I would be at fault.

Assuming he is telling the truth and he was stopped, however, I'm wondering if perhaps he is also at fault because he backed over the center line, i.e., the accident occurred on my side of the street we were both backing onto. His home is on the east side of the street and he was backing south and heading north; my friend's house is on the west side of the street and I was backing north in order to head south. In other words, there was no need for him to have backed over the center line and, had he stayed on his side of the center line as I stayed on mine, the cars never would have hit.

I've recently learned that he's currently seeking legal representation because he intends to sue me for personal injuries he alleges he sustained in the accident, so the question of fault is important.

Steps to take when car is flooded from storm (IDA)?

    Posted: 05 Sep 2021 09:34 AM PDT

My friend has liberty mutual insurance, (not comprehensive). The flooding didn't get too high, but the floors were soaked. In desperation, we took to a detailing place (that had great reviews and was open late that day) to get water removed, and they gave us a bill and said insurance might cover the detail bill. At the same time, the detailer told us to have insurance assess the damage. He was concerned maybe the part where the seat is could get rusted and not secure, or maybe something mechanical down the road could arise? The car seems to drive fine, however.

This might sound like a dumb question, but what are the steps to take/should have taken? Is it still worth getting the insurance involved without comprehensive coverage? The Liberty Mutual app was not very intuitive. I'm curious if simply filing a claim through the app would send over someone to assess the damage, or do we need to stay on hold for hours since these are unique circumstances?

    Coverage B home insurance

    Posted: 05 Sep 2021 06:30 AM PDT

Hi, My garage is attached to my house, and I don't have a deck. I do have a fence and a small driveway that can fit two cars side-by-side. I don't have a shed or swimming pool. Do I need much of coverage B? Right now it's 10% of my dwelling coverage.

    RV management business

    Posted: 05 Sep 2021 09:02 AM PDT

I'm working with a few friends to manage their RV listings when they rent them out on platforms like Outdoorsy.com.

While outdoorsy has coverage for the renters, I want to make sure myself and any employees I might hire are covered between rentals. We'll be driving the vehicles for cleaning, pickup, drop off, etc.

    Any recommendations?
