Pretty sure the 16 year old who lives above us is living alone. Is this neglect?

    Posted: 05 Oct 2019 07:03 AM PDT

Single mom and her daughter live above us (in CT). The daughter is a music student and we constantly have to hear her playing guitar or keyboard WITH AN AMP, singing (more like screeching) into a microphone, and producing shitty beats with too much base.

She plays music WAY louder than she needs to to practice. Its louder than our TV much of the time. Her mother usually leaves every night before 8 (if she has been home at all that day) and comes home in the morning to (presumably) shower and then go to work. Mother MIGHT be home 1 or 2 nights per week.

Her daughter obviously takes advantage of this and has friends over. They are so loud some nights that they are clearly drunk. Other nights she will sing into a microphone until midnight. They wake us up all hours of the night on weekends and weekdays. The mother complains to us that her apartment smells like weed "all the time" and blames it on us, since we are below her. Preeeeeetty sure it's her own kid, though, because we don't smoke in or around the house.

So this kid basically lives along with very little supervision. Is this legal? Should we get cops involved? We've been hesitant because we fear retaliation, but can't stand this anymore and need to do something!

[MA] Can I be denied unemployment for refusing a demotion?

    Posted: 05 Oct 2019 03:30 AM PDT

Last week I was laid off, more specifically my employer told me that my position was being eliminated. I was offered to stay on but with a substantial pay and title decrease ($80k / year to $40k.) I refused the offer and just accepted the lay off. Because I wouldn't accept the lower position, will I be unable to receive unemployment benefits?

What Can We Do About Our Neighbors?

    Posted: 05 Oct 2019 04:26 AM PDT

(I'm not sure if this is the right sub for this or not)

Some backstory: Ever since we purchased our home in July, we've had constant issues with the neighbors on the one side of us. They throw their trash in our yard, let their dogs poop in our yard, throw loud parties outside far past city quiet times, etc. We've tried talking to them, but it didn't seem to help. I've had to call the non-emergency number to make noise complaints several times due to their loud parties waking me up between 2-4am and I have to be up at 4:30am for my job.

I've talked to my other neighbor before and she's told me that she routinely makes online complaints about that house to the city and so does many other nearby houses. She also attends city council meetings and brings up this troublesome house. I looked online, and this house has 100+ complaints on them for anything from people living in a tent in their driveway to the trash in their yard.

If they're disturbing the peace for so many households in the neighborhood, whyhas nothing been done about them? They rent the house, they don't own it and it appears that there may be some illicit activity going on it the house, but we don't know for sure and would never be able to prove that.

Is there anything we can do?

In all honesty, my fiance and I never would have purchased our home if we had known about our neighbors. This is our first home, so it's a bit disheartening.

Thank you for any advice and sorry if this is the wrong sub for this.

Letter received from lawyer about an incident over a month ago in Florida.

    Posted: 05 Oct 2019 05:02 AM PDT

I have a "friend" that is technically homeless. Whenever I have certain handyman type work to be done, I bring it to him to help him out. This arrangement is officially over now, but about a month ago, give or take.

A non motorized vehicle was brought to him on a trailer to do some minor work on. This non motorized vehicle is used for my business. After un-strapping the vehicle, former friend attempts to unload it on his own and runs himself over. He did this before I was able to get there to help. No wheels hit him, no axels hit him, he essentially fell backward and it rolled over him and hit a dumpster. No property damage anywhere.

He then took 2 or so days to complete the work, which is normal for him.

A week later, I brought him a second project. At that time he mentioned he had been to the hospital for a broken back. He went several days after the incident. He seemed to be fine, so I said, "I dont really think you have a broken back." His response was, "Neither do I." He accepted the project, and all was well.

At no point I time did he say the cause was from the incident a week prior. He didnt ask for anything at that time, other than a case of beer and an advance on what the new project was going to pay. No big deal.

Yesterday I received 2 letters, one certified and one not, stating that due to the "accident" in early September they needed my auto insurance so they could file a claim for his injuries. 30 days to comply or else.

First of all, if a claim is to be filed I realize it would be the company liability insurance. I can tell the whole thing is filled with lies. First it wasn't an auto accident. Second he can't claim loss of income because, as I found out yesterday, he collects social security and disability.

I feel like I'm being baited to admit guilt, and if there was a case an actual case would have been filed. Should I let this go until they file with the court system? Should I give my insurance company a heads up?

    Fake $100

    Posted: 04 Oct 2019 11:31 PM PDT

I work at a restaurant and we receive cash in the amount of our tips at the end of the night. Long story short I was given a fake $100 after my shift for my tip out. I tried to deposit it at the bank and was flagged as a fake bill. I talked to my employer and they say its on me for accepting the fake $100 as my cash tip out and will not reimburse me. Is there any legal action I can take for being paid with counterfeit money?

Can a parent force me to stay at 20?

    Posted: 05 Oct 2019 08:38 AM PDT

Hey, I'm Spanish and 19. In August, I'm moving to Germany to study. My mother is against that, and since I told her she's been making my life hell, not letting me save up to leave and making me have more expenses so I couldn't go, but I still do some jobs and got many scholarships and help to do it without her help. Now she realised her money plan didn't really work, she wants to hire a lawyer to forbid me to leave the house. I don't have any disabilities. Is that possible??

Ps: Idk why this is on finance and business... It's a mistake

Daughter injured by mentally challenged teen at store

    Posted: 04 Oct 2019 08:33 PM PDT

*Edited to add I live in the state of NY. Hello. First time posting, so please forgive me if something isn't correct.

My daughter and I were standing at a cash register, waiting for our order. A mentally challenged teen boy ran up behind us and punched my daughter in the head. I made sure to get him away from my daughter and get her outside before he could hurt her again. He then started to destroy the store, as we made our way out of there. When we got outside, his caretaker was walking from his vehicle, towards the door. The police came and said they couldn't arrest him because of his mental status and age. Instead, he was taken to a hospital for an evaluation. Immediately after leaving there, I drove my daughter to the hospital, where she was diagnosed with a concussion.

The teen boy is a resident in a state ran home for the mentally disabled. This home has caretakers, that are suppose to supervise them.

My daughter has been suffering everyday with the symptoms from the concussion. Immediately after it happened, she had a CT scan that was normal. She had an MRI a few days ago and the results did come back with something that has me even more worried.

I have contacted a couple attorneys. One more less said it might not get a large enough settlement for him to take it. The other was having me get as much information as I could find out about the teen and home, and now hasn't answered my latest question. I was told there's only 90 days to file a letter of intent, because it's the state. Tomorrow, the 5th, is the 90th day. How could I file this myself? Someone should be held responsible & have to help with medical bills. My daughter now sees a neurologist & it's expensive. Please, any advice is greatly appreciated!

[MA] just signed a lease for rental apt. Turns out metro line is right underneath the building making horrible vibration + apt. is flooded from above and not very usable

    Posted: 05 Oct 2019 05:24 AM PDT

First time renting apt in Boston, MA. Made a 15min visit before, looked quite and good. This is the day of moving in, T is shaking the walls and floors, not just making noise every 5min. Tracks are underground and the nearest station is around 10min walk from the building. During these 15min there was magically no train passing by and nothing was mentioned about it. It was not possible for me to know this before moving in. Lease is 11 months, not a word about train or noise in it. What is the legal way to break the lease?

Bonus: they delayed moving in date 3 days saying that minor plumbing was needed. I thought that was related with shower curtain falling off. At the day of moving in they delayed handing over the keys saying they are still finishing plumbing, and building management company wants me to move in tomorrow. Agent said this might be because of some paint might be drying or something so she recommended to move in as late as I can. So I went there 11PM. It was flooded from above and they knew about it since walls were still soaking wet and there was two industrial dehumidifiers blasting full power making horrible noise. Even the shower curtain frame I was told will be fixed was in the same state. Bathroom, kitchen and big part of the corridor are not usable. Some smoke coming out of the ceiling lamp since it is so wet. Impossible to sleep. I would say it will take like 4 days to make a bathroom usable again and I would breath the fresh paint for who knows how long. some pics here

[Buffalo NY] I feel like I'm being screwed around by a landscaper and want to fire him and get my money back.

    Posted: 05 Oct 2019 07:39 AM PDT

I decided to hire this guy to rip up my lawn, get rid of weeds, and seed it, and take a tree down back on September 6th. It's been a month and he's been over maybe 4 times. Tree is down and half the yard is ripped up at least. He got off to a quick start. Since then...nothing. False promise after false promise of him showing up.

He came highly recommended from a family friend of 20 years, I've known the guy myself from way back when too. I figured things would be smooth. Quite the opposite

I made a couple mistakes when hiring him. I sent him the another quote I had since I didn't know how to describe what I needed done. I know, shouldn't have done it. Should have waited for his price. The quite I got was $2300. Without even looking at it, on the phone, he quoted me that he'll beat it by $500 since I'm a family friend. I figured cool. We scheduled him to come out to look at at 7pm that evening. He didn't show up until 830pm (red flag) and it was dark. So he looked at everything with a flashlight.

He quoted a price of $1900. Signed a contract. Paid him half up front. Problem is, apparently there was a problem with the payment. I forget exactly how this went. He somehow got 2 payments of $950, refunded one back to me. Before refunding it, apparently he paid his bills with the extra, and now had no money so I sent the other half figuring I knew this kid and I'm close friends with his uncle, things will be fine. I don't need the money, I can do without since I trust the work will be done. Just left about $350 for the tree and stump removal.

Well it's not done. Every time I talk to him he has some excuse on why he's not showing up. He promises he'll be there the next day with some crew. Nobody helps him. Even by himself he's been there only 4 times in 30 days.

The last text, he's asking for $200 for some dingo machine so he can finish the work. He starts complaining that the job is more costly than he thought, and his friends that own landscaping companies would have charged $4,000+ and he wishes he saw it in the day time and yadda yadda..

I told him none of that is my fault. He was supposed to be over in the day time but was late and signed a contract for an agreed upon price. I told him I wasn't using the yard so I'm not in a hurry as long as it gets done before it's too cold for grass to grow. But what I meant was, maybe a week or so longer than the original 7 day quote. Not 30 days later and it's still in the condition it was a few days in.

I was out of town for the week and we went back and forth about this, and he assured me he'd be over to finish it with this machine. I get back and still nothing is done. I'm beyond annoyed at this point.

My questions are: can I fire him and get all my money back since he signed a contract to do a certain job and hasn't done it? I feel like he's going to fight it if I do claiming the job SHOULD cost X amount. I'll go to court, I don't care. Would he be entitled to compensation for work done already? And would it be like he did 30% of the quoted $2300. So Id get refunded the difference? Not sure how this works.

    I appreciate the help!

Roofing company failed to protect home during project when thunderstorm came.

    Posted: 05 Oct 2019 06:34 AM PDT

I am in upstate NY. I filed an insurance claim on my roof for wind damage earlier this year. I hired a roofing company to replace our entire roof. During the job, a rainstorm hit and water poured into our home. Damage was caused to 2 levels of our home in the form of drywall/ceiling and hardwood flooring damage.

The roofing company paid for industrial dehumidifiers to run in our home for two days and paid for us to stay at a hotel while that happened. They had a contractor and a flooring company come out to give them a quote to fix the damage they failed to prevent. They have informed me that "everything will be taken care of and not to worry". This process took about 3 weeks.

The help has stopped there. No one will answer my texts or calls now and I'm not sure what to do. The roof was finished in early August and nothing has been repaired yet. I have not paid the roofing company yet for the job, nor have they asked for payment. My new roof has no leaks and is fine as far as I know.

My ceilings are brown and my hardwood floor has water damage. They told me they would fix it but are now ghosting me. I'm not sure what to do next, or even what my legal rights are. Can someone advise me on what to do please?

[Arkansas] Psychiatrist refused to refill my wife's meds, resulting in a seizure.

    Posted: 05 Oct 2019 01:08 PM PDT

My wife has some emotional disorders and was admitted to a mental health facility around 10 months ago. When she was released, she was referred to a local psychiatrist so she could keep up with meds outside of the facility. We'll call her Dr. L.

Over the next few months my wife worked with Dr L. to refine her medications, even going as far as ording a genetics test to see how different medications metabolize in her system. This all resulted in a cocktail of drugs that my wife has been on since about 6 months ago. As a note, about 4-6 weeks ago Dr L. moved from one clinic to another.

About 7 days before running out of these medications, my wife tried to call Dr L. for a refill. A few days later and no word back, so my wife calls again. The receptionist said we needed an appointment, but Dr L. didnt have an opening the rest of that week and was on vacation the next week. We asked what we should do, since we were told my wife should NOT stop these medication suddenly. She said we'd get a call back.

A couple days later and we call back after again, not hearing anything. We re-explain the whole situation, and the receptionist excuses herself to talk to the Dr. She comes back and said "I talked to the doctor, and she said the new office isn't a good setting to see you in, so go back to [clinic Dr L. was originally from] and they can refer you to another psychiatrist."

They are unable to have a psychiatrist see her until after the following week as well. We explain the situation, and they suggest we try contacting the mental health facility she was admitted to at the beginning of the year. They were not able to fill the meds either, and they were only able to refer us. The earliest appointment we could find with ANY psychiatrist was yesterday, 10/04.

By Thursday, 10/03, my wife had been off of her meds for a week and was feeling it. She went to work and a few hours later suffered a seizure. She was rushed to the ER where she stayed until her appointment yesterday (due to complications after arriving), when she was finally able to get the meds refilled.

Every doctor we have seen since being admitted to the ER has said the sudden stopping of the medications caused the seizure, and could have been fatal. This is supposed to be very well known for this class of drug. They also ran several heart and neurological tests as well as CAT scans and xrays to confirm there was no other cause for the seizure.

My question is do we have any legal recourse to recover damages from Dr L. or her old/new place of work? My wife called days before being out of meds, followed up several times, and was essentially forced to go without her medications (which could have been fatal) until she had to go to the ER.

Being sued by my dad’s gold-digging widow

    Posted: 04 Oct 2019 10:12 PM PDT

My dad was wealthy, and an alcoholic. My mother left him when he relapsed the last time and her friend moved in with him. This made little sense because he was very advanced in his addiction and was an extremely unappealing partner. It was obviously about his money. They eloped shortly after. A few years later he died from complications related to his alcoholism. She immediately sent her lawyer (previously my father's lawyer) after my brother and I.

My father was a lawyer himself so I was surprised to find that his affairs were not in order. All of his assets (except his home) went into a trust that apparently goes to his widow. 50% of his home went to his widow, and the other 50% is split between my brother and me. She is living in the house currently.

We started trying to sell the house but she has impeded us at every turn. She refused to put the house on the market after my father passed because she was grieving. When we finally put it up she insisted we list it far higher than the appraised value. She refused to put a sign in the yard. She refused to give the real estate agent a key so they couldn't do showings unless she was there. When they did a brokers tour of the home she was there throwing a party for her friends (she knew about the tour months in advance). She then insisted the real estate agent was out to get her so we had to get a new one that she picked herself and start from scratch. They decided to take the house off the market for 60 days because of lack of interest (it's listed way too high).

I don't need the money so I let all this go assuming that one day we will sell the house and she's just drawing it out. But now she is suing me and my brother for the bills related to the house. She wants us to pay for our 50% of the following: maid service, cable, internet, utilities, water, etc. She has even included the cost of a new roof (house was built 5 years ago), and is trying to include the cost of a dock to increase the value of the house.

Now I understand that I own 25% of the house and so should pay for 25% of the bills related to upkeep while we sell it. However, many of the things she wants me to pay for are obviously much more expensive because she lives there and some are downright outrageous (her maids and cable??) I don't feel that I should have to pay for her living expenses while she purposely blocks the sale of the house.

It's important to note that she cannot be reasoned with verbally and discussion of these things is completely off the table. She dissolves into shrieking, crying, and insults every time I have tried to talk to her.

House is located in Florida. My brother and I live in Texas.

    Would this be considered defamation?

    Posted: 05 Oct 2019 08:03 AM PDT

My sibling (I'll refer to as A) is going through an ugly divorce (with B), and I just heard that B is trying to make a claim that I am part of a militant group to try to damage A's case for custody of the children.

I am an army veteran and have some photos of me in operational uniform (civilian clothes and a beard) with a cache of weapons that we secured from the Taliban. I can only assume these photos are being used for this argument, but the photos are in an album titled "Military Life" that includes other photos of me in army uniform, pictures of my medals, and even pictures of former president Obama from a visit he made during my deployment.

B is well aware of the fact that those pictures were from my time in service, but is still trying to misrepresent those pictures out of context.

Is there anything I can do to turn this around on him? Would I be able to potentially sue him for defamation or something?

Threatened Termination For Discussing Pay [Central Texas]

    Posted: 05 Oct 2019 10:44 AM PDT

    Howdy!

Tl;Dr I asked for a raise and when I told my manager that we had all discussed our pay she threatened to fire me for it. I know that its illegal and a violation of the NLRA but what can I do about it? More info below.

I work at an apartment complex in central Texas. The complex is owned and managed by a company located in Indianapolis. The middle management of this company is abysmal to begin with on how they treat their employees. I'm talking blatant favoritism, threatening firing over simple missteps, and strong-arming employees into resigning for various things that would not warrant firing.

There is an unusually high employee turnover rate here and the company sought to fix that by hiring new people at a higher wage than they were paying current employees. Thing is, they didn't raise our pay to match the new, inexperienced employees that we were responsible for training. We eventually found out about it a few months later and we demanded they match our pay. When we brought it up, they said "we don't know where you heard that information but it's best that you don't discuss pay in the workplace." They ended up agreeing to matching our pay and we continued.

Fast forward a few months and every employee but me has put in their letter of resignation. They have been made offers to stay at a higher pay rate. For their own reasons they will not be taking them.

We have all discussed these offers with each other and they suggested that I demand an offer for myself. By the word of my coworkers, I put forth more effort and am more valuable to the company than anyone else as I have been here longest and am well versed in all tasks as well am responsible for obtaining the most leases for the company.

When I brought all the above paragraph to my manager, she simply homed in on the aspect of us discussing our pay. She stopped me dead and said "You're discussing pay amongst yourselves? This is grounds for termination." I told her that was illegal, and she needs to take my request seriously.

My questions are these: I was just told I am at risk for being fired for talking to coworkers about pay. That is a violation of the NLRA. Given this company's history of disregarding employees interests, how can I protect myself? What can I do to bring this against the company? Is there a way to file a report against them for what they have already done/if they continue with further action?

    Distracted Driving in Driveway? (WA)

    Posted: 05 Oct 2019 08:24 AM PDT

Hey so I recently bought a house on a moderately busy street. Now my driveway is pretty steep, with a neighbors driveway attached perpendicular to the front of the driveway (they have an easement to use the front 10 feet of my driveway to access theirs) but it's my property all the way to the sidewalk (presumably).

So when I am leaving my driveway I flip a U turn in mine/my neighbors drive so that I am facing the street, and can then zoom right out whenever there's an opening.

Sometimes though, I'll use the time I'm waiting to merge onto the street (still entirely within my driveway though) to connect my phone's Bluetooth to the car, shoot a quick text out, pretty much anything I am not allowed to do while actually driving. My question is: is this legal? On my property? If I shift the car into park when I do this, would it change things?

I know Washington is pretty intense about their distracted driving laws so I wanted to get some outside advice before I wind up with a citation for texting in my own driveway. I'm in Clark County if that makes any difference.

    Benficiary Fraud By Our Mom

    Posted: 05 Oct 2019 12:27 PM PDT

My father passed away when I was 9 years old. Me and my older sister who was 16 at the time are still taking time to get over our loss. This was in September of 2005. Our father was in the military and had done a great service apparently. When he died we apparently were receiving life insurance money from social security and the military as well. We didnt really know much about it at the time. Our Mother was the custodian. When our father passed away, our mom was already remarried to another man. We moved in with our mom and step dad. We experienced mental and physical abuse over the years from the both of them...I just found out from my older sister that my step father made sexual advances on her when she turned 18. She didnt tell anyone. Years go by and ive been working since I was 18 and I am now 24. Ive never been able to get a tax refund. I never knew why! Until this year I called the IRS to find out what was up. I have a tax debt from the Beneficiary money that My mother was receiving.. we were receiving thousands of dollars somewhere around 30k-40k a year...I never recall seeing any of it...I never got any college funding when I graduated so I never went to college. Im still in debt. Anybody know what to do? My mom has more letters about receiving money and wont let me and my sister have the documents

Bitten by a dog, that jumped a fence with the owner present. Owner is refusing to take responsibility

    Posted: 05 Oct 2019 10:03 AM PDT

My father was walking his dog on a public road. When he passed a house an angry dog jumped a "dinky looking" (his words, not mine) fence and started attacking my father's dog. Since that dog was a lot bigger than father's he had to restrain his dog and fight off the attacking dog with his hands and feet. He got bit in both places, just flesh wounds, the wounds didn't need stitches or anything like that. Father's dog is fine, she was never involved in the fight.

Since it wasn't the first time he walked past that house with it's dog going nuts barking, the owner accused my father of provoking his dog and refused to pay for my father's new $150 jeans, that are now ruined.

Since the dog owner isn't convinced that 1) it was his fault 2) a pair of jeans costs that much, what should the next steps be?

I work as a sales rep for a furniture store. If our cash is short, are we legally required to pay that back or can our boss dock our pay to replace the missing money? It's about 30-40 short.

Roommate lied about active duty to break lease

    Posted: 05 Oct 2019 02:25 PM PDT

We live in Texas. My roommate decided to join the military 4 months into our 1 year lease. He has not sworn in, he has not gone to basic training, he has not even picked his military job yet. However, one day he comes home saying "I'm leaving in 30 days, sign this paper" so naturally I did NOT sign it. What do I do? He is not even an official member of the armed forces, but he gets to just leave? And by the way, now he's just staying at his moms house until he ACTUALLY goes to basic... 6 months from now! What can I do?

Mom told she has one month to leave

    Posted: 05 Oct 2019 02:24 PM PDT

So my moms landlord just came up and told my mom shes selling all the apartments to the one guy in town. Apparently this guy wants to move his daughter up to out town and wants to let her stay in an apartment. And for some reason, my moms apartment was the one she wanted. Is this legal?? Because it certainly is SOOOO messed up.

She has always paid rent on time and has NEVER had a problem with the landlords.

I have a chronic illness and therefore require hospitalizations if they appear to be serious. Around three years ago, I needed to go to the ER at the hospital close to my college campus. All was well and I was discharged with the Bill's being sent to my insurance.

However, since 2018 I have been called three times about a debt from a bill I never recieved and my insurance company paid it off completely before this when the bill was sent. The problem is the hospital doctors and the ER doctors are from two different companies. The Hospital doctors work were hired by the hospital, while the ER doctors are a third party. According to them I owe this third party doctor over a thousand dollars. I have never been sent a bill from any of these physicians billing departments and I have kept the any of the bills I have received.

This happened last year, when a collection agency called me and I asked to resend the copy of the bill to me. The 1st person I talked to said they can't but the 2nd said okay. I got it and submitted it to my insurance and the 2016 bill was already paid by my insurance in 2016! So the account was closed.

Again I am called by a collection agency about a bill from 2016. And I looked at my past bills and claims and my insurance already paid for the date. My insurance says when I was admitted and when I was billed and if it was processed. All yes from my records. My question is should I call the hospital (I am) and see if they have any more surprise bills and get information about the doctor companies they use and see if they have any other bills? And I am going to tell my insurance if they have any other bills. But I think there is fraud. The statements from my insurance says that it is paid and they also have when the check was written and copies of the check number. It is really stressful and annoying to deal with debt Collectors and it is not good for me especially when my illness is triggered by stress. Should I file a complaint when it comes back that I/my insurance paid the bill and who do I complain to the ER group or hospital?

I have proof of my money orders. And when I mentioned this I was met with "only one person besides me works here". I'm just confused. Is it legal to post something saying I haven't paid rent on my fucking door? Especially when I did? Is this a slander thing? Note, my bf has beef with the office manager. Is he trying to fuck with us?
