Mothers house flooded in Cape Breton, NS

    Posted: 24 Nov 2021 09:40 AM PST

    Hi Everyone,

My moms house just flooded in NS during the recent storms. Here sump pump lost power and her basement flooded heavily. She has flood coverage but they say it doesnt cover ground water damage.

Any idea how insurance determines what the cause of a flood is?

    Thanks!

FL Total Loss Settlement- Anticipating Trouble w Comps. Advice?

    Posted: 24 Nov 2021 12:48 PM PST

My poor 2000 Miata (with all of 43k original miles) was wrecked by a driver running a red light. I am going through my own insurance and fully expecting a total loss. I can see obvious frame damage and the airbags deployed.

This is gonna be a tricky one to value, and I have a feeling I may get lowballed. Comps are not easy to locate, doubly so recent comps. I can probably find comps in the same state, but certainly nationally. Policy has arbitration if we can't agree, and I am owed ACV/ cost to replace in kind (same year, mileage, condition, etc.). Already know they will use CCC for the valuation.

Which resources would you suggest that would be most helpful and useful to demonstrate comps? I know what I should be getting for the car, but I'm not sure if there are any sites they just dismiss out of hand. I can back myself with actual sales data, assuming there aren't sales data sources they won't accept. Also would like to minimize back and forth as much as possible.

    Any advice appreciated

Neighbor backed into my new car. Please help answer a couple of questions

    Posted: 24 Nov 2021 11:17 AM PST

Background: In Missouri, and my neighbor backed into the front of my new car. She called her insurance (State Farm) and they called me saying my neighbor was at fault. My car is currently at the body shop. The damage was pretty bad for being just backed into (she pulls out of our shared driveway really fast).

I have a couple of questions:

    (1) Is there any benefit in telling my insurance?

    (2) Is it worth it to contact an appraiser for a diminished value claim? The car was purchased in July '21 with an MSRP of around $38K. I can post pictures of the damage if need be, but I think the whole front end and hood will need to be replaced at least. Still waiting on the body shop estimate.

3rd Party Claim With All-State Insurance

    Posted: 24 Nov 2021 10:03 AM PST

When an adjuster for a 3rd party claim says my damage claim exceeds the policy limit for property damages what are my options before filing a lawsuit against the at fault driver/insurance? I was not provided the limit amount and the accident occurred in CA. I have underinsured coverage on my policy.

Corporation vehicle crash, do I need to let my own private insurance know?

    Posted: 24 Nov 2021 09:29 AM PST

I've sorted out the usual with my company and the fleet company who works alongside them, it's completely separate and the insurance is with the company and not me. Do I need to let my own car insurance company know about the work vehicle crash or not? Appreciate anybody who can offer some advice as I haven't found any online.

    Thanks!

Damaged someone’s car while not in my car. What is the best move?

    Posted: 24 Nov 2021 04:59 AM PST

Very weird situation and I don't know what is best to do. I was in an empty parking lot last night and there was a shopping cart right next to my car that I pushed towards all the other shopping carts.

Well that shopping cart curved as it was moving and picked up speed in the sloped parking lot and hit a truck about 100m away. Literally could not have hit it if I tried. The owner was in the truck and I ran over to him and exchanged info, but what do I do?

What covers this where I wasn't in my car when I did the damage? What is the best option?

Does replacement value reflect delays in settlement?

    Posted: 24 Nov 2021 04:34 AM PST

    Two dimensions to this:

    (1) Interest/time value of money due to delay in payment on behalf of insurer non-responsiveness

    (2) Changes in value of replacement costs due to changing costs of goods since time of loss

I have a moving insurance claim worth ~$20k, insurance contract says payment within 30 days of proof of loss, and I just got back the settlement documentation now 4 months later.

    Insurance won’t pay rental anymore

    Posted: 23 Nov 2021 10:50 PM PST

lI am the driver of a leased 3 year old vehicle. I live in Ontario, Canada. I opened a claim with insurance for highway roadkill. Adjuster explained that if I get the car serviced at a body shop of my choice, they will cover up to 1500$ of a rental vehicle during repairs (loss of use coverage). Otherwise I could take my car to one of their preferred shops and they would offer me a courtesy car for as long as repairs take.

I chose to take my car to a certified collision center because that is what BMW told me to do; they use original parts and their work is guaranteed. Insurance agreed (well it's my right anyways) and even negotiated the hourly rate with them. Insurance wastes 2 days to get my car towed to collision center because somehow their tow truck driver first couldn't locate my car in dealership parking lot and then next day because he claims BMW said they had no record of my car (guy went to sales counter instead of repair center). Whatever, nothing i can do about lost time. I rented the replacement vehicle only when I really needed it one week later.

Appraisal done (almost 10k) , estimate produced and repairs approved by insurance. They sent me an email saying it would take 5 days at garage. I trust the process and patiently wait. Fast forward to about 10 days later and my adjuster informs me that the garage did not even start working on my car because they say they were waiting for me to approve the repairs. We are both shocked.

I call the shop and they claim they were waiting for my approval to use after-market parts as they're not allowed to! They never called or verified this with me! I request a copy of estimate and notice that although my insurance policy doesn't include OEM replacement cost, most of the parts ordered are coincidentally OEM parts. Body Shop tells me they cannot put ANY after-market part on a leased vehicle.

I ask them to please go ahead and order the OEM parts and simply bill me difference. I never directly blamed the person handling my file but her attitude is defensive, unprofessional and downright arrogant as she insists the delay isn't "on her side" since she was waiting for me to call them. It doesn't matter to me whose fault it is, I never accused anyone. In the meantime, my adjuster tells me he can't keep covering my rental car even though we haven't reached half of the 1500$ I am entitled to in my policy. He says he only approved 5 days of rental and since the additional delays at body shop are unjustified, he can't extend it. I still don't have my car. He tells me to ask the body shop for a courtesy vehicle since it's their fault; they told me they don't offer that.

I am so confused at why my insurance is refusing to cover the rental. I called my broker who literally said "well it's not the insurance's responsibility to pay for a rental when the body shop YOU picked is delaying the repairs". it sounds almost punitive. i am now burdened with paying my own rental or not having means of transportation, on top of the monthly car payment I make for a car i can't use. this seems absurd as my policy allows up to 1500$ in loss of use benefits. any advice? is this common? anything i can do? thank you

    Car accident advice

    Posted: 23 Nov 2021 10:44 PM PST

I was in a car accident. I didn't admit fault, although I feel like I am at fault here. It was at an extremely big and busy intersection on a divided highway. Because it was in the evening, it was hard to see when it was appropriate to go. I pulled forward a little past the stop sign to gain better visibility. I may have pulled far too forward because a vehicle with the right of way going straight, clipped me.

My entire front bumper is gone and is exposing my radiator.. My hood is dented in.. basically the whole front of my car is damaged.. although, all the doors still open and the car is still drivable.

Am I 100% liable here (probably….. it feels like it)? How do I know if my car is totaled?

Unfortunate luck but someone also rear ended me 2 weeks ago and insurance hasn't even settled that claim yet (0% liability on my part). Is this going to sky rocket my insurance rates?

    Worldwide Phone Insurance

    Posted: 23 Nov 2021 08:46 PM PST

I bought a new iPhone and I'm trying to purchase phone insurance, but the product I'm looking for doesn't seem to exist. I'm hoping someone here might be able to point me in the right direction, or just tell me it's not possible so I can stop searching. I'm an Australian citizen who lives abroad and moves around quite a bit. I'm looking for insurance that will cover my phone globally, theft and loss are most important. Problem is, all plans that are available in Aus/to Australians only cover in-country, or for X days travel per year. All the global plans I find require you to be an American/British/European citizen.

So my question is, is there a phone insurance that an Australian can buy that will cover worldwide? Thanks!
