I have near 1000 acres of land in Oklahoma and on that land there's a 200 acre lake all in our property that we pay taxes on. Our neighbour has been taking a lot of our water and entering our property to take it for agricultural use without our permission. Where do I stand legally here if we do not want them to take or not access our land? Can they do this legally without our permission? What type of lawyer do we need for advise on this? When I started in 2015 he told me I had to get a personal truck because they didn't have company trucks. So I get a truck with a five year contract then three years later 2018 he tells us we have to start driving company trucks and he's taking $500 a month out of our pay in order to use these trucks which he's paying probably less than $200 a month for. I felt I had no choice so I went with it. Now I find out he's been taking north of $700 out a month depending on the time of year and I'm starting to ask myself if it was even legal for him to charge me to drive a company truck in the first place? Unlawful Entry - Problematic Neighbor Stalking my Cat Posted: 23 Nov 2021 09:08 AM PST Hello everyone, I know this is probably going to sound funny, but I feel unsafe and am seriously in need of advice. I live in California and I have a next door neighbor who has major boundary issues. We do not get along, avoid each other like the plague, and I've certainly never given him permission to enter my home. Unfortunately, this freak is obsessed with my cat. On numerous occasions, I have caught my neighbor standing directly at my windows with his face against the glass, trying to see my cat. He even admitted to pushing "toys" under my front door to play with the cat when I'm gone. I have asked him to stop this several times. I've been out of town for two weeks and yesterday I got a call from the teenage girl who is feeding my cat for me: she said that while she was in the kitchen preparing the food, my neighbor opened my front door, walked straight into my apartment, and grabbed my cat. The sitter was afraid and confused by the invasion, but my neighbor apparently told her that he was allowed to come in and visit my cat whenever he wants to. He remained in my apartment for several minutes, carrying my cat and walking around my apartment until the pet sitter was leaving. She immediately called me when she was safely away from him. I first called my landlord and then tried to reach my neighbor numerous times, but he is ignoring me. I am planning to file a police report as soon as I'm home tonight, but I am concerned that the cops will not take this seriously. I do have indoor cameras in my apartment, but unfortunately they are only live feed, so I don't have recordings of the neighbor entering my home (though he already admitted he did this to one of my other neighbors). Before anyone asks - no, he isn't obviously mentally or developmentally disabled. He lives alone, has a long-term girlfriend, and runs his own business. This guy is just bizarre, irrational, and paranoid, and he has told me he has guns in his apartment. I am getting a security camera to place outside of my apartment, but I am incredibly stressed and am terrified he will break into my apartment again. Posted: 22 Nov 2021 02:12 PM PST Title says it all. I was given 60 days notice of my termination today which will be January 21, 2022. I can't just pick up and leave due to the fact I'm on an isolated island, but I got to make ends meet. The non-compete clause is for a 75 mile radius from the location of the clinic. There are only 3 other competitors within that radius, all of which are on this island including the local hospital which is currently hiring. Prior to this notification I had reached out to the hospital and they would take me in a heartbeat since this is such an underserved community from a medical stand point. Should I seek legal advice regarding my potential breach of this non-compete or just pretend it won't have any effect, because I honestly don't think it would realistically hold up given my circumstances and location. She does not take him to his appointments regarding autism and always reschedules the day of because "she's sick" and doesn't believe that he may have autism. I have evidence of this. Earlier this year, she was not watching him while my dad was at work (she is a stay at home mom and my dad works full time) and he went missing. The police was called and footage from neighbors showed that he crossed the street by himself and walked to a lake. She didn't watch him again while my dad was at work and he fell down the stairs and bruised his eye. I have photos of his bruise. This week, my dad separated from her and moved out of their house. My step mom didn't watch my brother and he got burnt. His entire chest was burnt from boiling water and he went to the ER. The ER suggested that they go to a different hospital that was specialized in burns and set an appointment for them. My step mother failed to take him though. I have documentation of these incidents and I want to make a report regarding her neglect. She also has a history of abusing my other sibling (8M) when my father leaves her. Turns out my old company has been sending emails from my email acct (JohnDoe@company.com) and with my email signature, and has not advised my clients that I've left. I worked for the same door and window company for almost 15 years. Had a great relationship with the owner. Never any employment related issues. Started at the company when I was only one of three non-family members. Company had grown to almost 50 full time employees. Company owner (the dad) passed away last winter and one of his sons had been running things. The wife (different marriage from about 5 years ago) and him had a falling out several months ago and she took over. I never really talked to her but she has always come across as ultra-snobby (maybe religious?) and wants to "change the image" of the company. I often wear slayer and megadeath shirts and in August she announced several policy changes, including a uniform and non-smoking (in company vans or on job sites) policy. At the beginning of the month she announced a zero tolerance policy for visible tattoos. This affected 3 people including myself. This meeting was on Monday, I was fired that Friday November 5th for "company policy non-compliance/violation." I applied for UI the following Monday (8th) and received notification last week that my application was denied due to "Company policy violation." Is this legal? Please let me know if you have any other questions. EDIT: Want to clarify that I did conform to the uniform and smoking policy and was fired because of my tattoos. 8+ months pregnant- Fired over Employee Policy Change Posted: 22 Nov 2021 06:04 PM PST TLDR: I'm being fired at the end of my pregnancy and I suspect that it's based on my employer not wanting to pay leave. I don't have solid proof of that, but the timing is very suspicious. Is it worth pursuing legal action or an EEOC complaint? I've been employed at a company full time for 2 years, and long before my employment I have also owned and run a food blog where I make some money, nothing substantial. My employer has always been aware of my blog, and in fact has stated on many occasions that it's one of the reasons he hired me. He has also used my blog as promotional material for some of his own advertising. Also when I was hired, I made my employer aware that I would definitely be having another child some time in the next few years and was looking for a place that would support a paid maternity leave when that happened. Now, I'm 8+ months pregnant, and have always been under the impression and verbal agreement that I would have 3 months paid maternity leave. My boss several times during my pregnancy has mentioned (verbally) that he wants me to get part of my payment through disability, and that he would compensate me under the table for the remaining portion of my salary. I didn't know what this kind of disability was, but assumed he did. I did ask several times if this was illegal, or would have some kind of negative impact on my taxes, stating that I didn't want to do anything that would be illegal here. A few weeks ago, since I hadn't heard anything from him, I asked what was going on and if I needed to be applying for something or if he was taking care of it as my employer. He then discovered that what he thought he could do for disability for me is actually a part of a law that doesn't go into effect until 2024 (meaning that he would be fully on the hook for paying the verbally agreed-upon maternity leave). Immediately after, my work started to undergo heavy scrutiny. I definitely will not say that my work is perfect, I have made some mistakes for sure, but now I'm being treated like I've been doing horrible work the entire 2 years of employment. Today I was told that there will be a new policy and condition of my full time employment that I not have any side businesses outside of my main full time position. If I am not willing to stop work entirely on my blog (which is in an entirely different industry, no conflict in that sense), that I could choose to do part time work at a lower rate, but would not be able to continue full-time, salaried employment. I have also been given a deadline of 24 hours to decide. I am giving birth in less than a month and I find the timing of this sudden and immediate "policy change" very suspicious. Posted: 23 Nov 2021 05:51 AM PST What happened: I'm at an interchange where two lanes converge to another two lanes (with most people wanting to swap from left to right or right to left). There is a red light about 75 feet ahead, bumper to bumper traffic. I was looking behind me to see if it was safe to move from the left lane to the right lane, when I look forward and see that I'm probably going to hit the person in front of me. I slammed on the brakes and tapped them, the front left corner of my bumper hitting the rear right corner of theirs. No damage except minor scuffing. I pulled up beside him and signaled to pull over but he just kinda shook his head and gave me this face. I pulled over into the shoulder and put on my hazards, anticipating him to pull over as well. He didn't, instead he waited at the red light until it turned green and drove off (fast). During the red light he also got out of his car to look at the damage, but did not take a picture or even acknowledge that I was right there. I already called the city police department and told them what happened and inquired if anyone called to report an accident, but they told me that they don't know that information and that I should just submit an NJ state accident report form if I'm that worried. There is a camera at that intersection. Besides filing the report, what else should I do? Of course it seems like it was so minor that he just didn't want to deal with it during his morning commute, but I want to make sure I won't be liable for a hit and run or similar in case he decides to press. Neighbors continually block our driveway while parking on county road Posted: 23 Nov 2021 11:33 AM PST Our neighbor and his friends (who are over all the time) park not in his driveway but on county road which often results in my wife and I being blocked in when we park in our driveway on our own property. To set some context, we live in Oregon in a rural community that is not incorporated (not a city). The road dead ends at the neighbors property almost like a cul-de-sac. We are on the east side of the road, the neighbor in question is too the north of us and we have another neighbor directly across from us who also often has her driveway blocked. She is elderly and rarely leaves her home and I have yet to see her have a problem with this. My wife and I both work full time and have had to ask them to move on multiple occasions to so we can either come or go. I don't know what legal recourse we have in this situation, if any, but if we had an emergency and had to leave quickly this could be seriously dangerous. I have lost revenue from work, my relationship has suffered and as well my mental health is deteriorating, there are weeks on end I havent been able to eat. My husband sold his car privately a little while back. Long story short, we forgot to take the plates off before they drove off with the vehicle. Now we're getting toll bills because they are using the same plates. This isn't the first time we've sold a car privately, but we had a lot going on that day, and it just slipped our minds. We can't get in touch with the person any longer through Facebook where he had it listed, it was an old car so we only sold it for about $2,000. She has over 25 years of experience in the field and is tired of being mistreated by her (former) employer. She and I both quit this year. We are opening our own office and plan to offer the same services. However, she is currently under an non-compete agreement for 3 years. She has agreed not to solicit any of "his" clients. I put his in quotes because they are her clients but I guess maybe technically they're his since he owns the place and payed her commission. However, there have been many clients of hers that have insisted they will be going wherever she goes. So if her clients come to our new business and I take care of them, would that be a breach of contract? Could he take action against me? Additional info: Our office is within 5 miles of her old office. But the non-compete doesn't mention anything about that being part of the agreement. We live in Indiana. I am a resident of Missouri, while my ex-partner is a resident of Kansas. Recently, me and my partner broke up. About 3 months ago, while we were still dating, she gave me a PS5. She said it was a gift, that it "would go in our game room when we moved in together," handed it to me, and I accepted it. I took it home, played it, and was the only one of us to use it within that 3 month period. She even said before we broke up that if we did break up, she would not ask for the PS5 back. Obviously, that isn't the case. I have had full possession of it for the past 3 months since she gifted it to me, but she wants it back. She argues that since she paid for it, and that it was supposed to be, as she puts it, "for us, and our future game room," that it's her property. We never did live together. Fraudulent Child Support Claim Posted: 23 Nov 2021 01:51 PM PST I've received a fraudulent claim for child support from my child's grandparent on my ex's side, listing them as the custodial parent, and me as a non-custodial parent. The child lives with me, and I am awaiting court with their actual parent over custody currently. How is it possible that a lawyer has sent this claim without seeing the child's birth certificate? Is it possible that they could've fraudulently made another? The letter is signed by the Attorney General of Texas. I also suspect that they'd be claiming any possible extra state welfare/tax relief as though the child was living with them. I am wondering if anyone (especially in Kentucky) has ever assumed guardianship of their parent? My mom has a history of benzodiazepine and opiate abuse. It's to the point where she has had several falls and a few car accidents under the influence. Even at her best, her mind isn't as sharp as it has been. She recently had another drug episode, and she has been in the hospital detoxing for a few weeks. A social worker we are acquainted with recommended we - as in her children - could potentially get guardianship of our mom. That way we could keep her from driving, etc. The thing is, because of her not being there for us for decades and lying to us about her addiction, none of her kids really want to have a relationship with her. She was kind of a crappy mom! She has enough money to live on for now, but the addiction is draining her nest egg, and she could very well kill someone if she keeps driving. The doctor told her not to drive, but she is going to drive herself unless someone takes her car away. And if we do that, she will just get a ride to the car dealer and get herself another one... I feel like a terrible person, but being her guardian seems like way more than I want to handle. I live in a different state about a 10-hour drive away, but my siblings who live in her town have both flat said they won't be her guardian. Bringing her to my town would not only upend my life, it would reset her progress and relationships with the doctors she has in that town, and she would have to start from scratch here. I worked for a local cell phone store for two years, which would normally require remuneration if the employment was terminated suddenly and without cause. As the topic mentions, they also did not pay for time worked before shift start, despite expressly stating we had to arrive and be performing opening or other tasks in their employee agreement. When I sought clarification, they stated it was unpaid. Their reasons for stating it was 'Just Cause' were: I failed to meet sales quotas as a full-time employee. Given I worked two afternoon-night shifts and the weekend during a global pandemic, though, I do not believe this was a valid reason as all companies in our area are suffering much lower traffic. They stated I had performed theft, but after reading the definition of the law I do not believe my actions constitute as such. This requires some context: We sold screen protectors with a lifetime replacement guarantee, meaning customers could purchase replacements at a reduced price. This was communicated to the customers, forming a Verbal Contract. However, our suppliers stopped producing screen protectors for older or less popular phones and the company thus failed to uphold its end of the contract with the customer. As the company would no longer perform its duty to supply replacements, and to improve customer relations, I bought screen protectors with my *own* money and replaced them for the customers for the same rates the store would have charged. As no store product was used or moved, and the company could/would no longer provide the screen protectors themselves and thus deprived themselves of sales, I do not believe I did anything wrong. I satisfied the customer's desires at my own monetary risk and in doing so protected the store's reputation. Moreover, the store's previous manager did steal sales from the store by personally purchasing people's phones and reselling them within the booth (as opposed to using the trade-in system). I informed the company of this and, as far as I could tell, they took no action against him, despite this being a far more serious breach of policy for both the store and customers (as it was conceivable a customer's information could be retrieved from a device even after it was factory data reset). Thus the rules were not applied with equal consideration and instead used as a preferential tool. At the very least I believe I have a case for wage theft due to not being paid for time working. I'm not sure if I have a strong enough case against their claims for Just Cause due to the grey area it occupies. No write-up documents were offered or signed by me in regards to their allegations. Wife's Medical Disabilities being neglected in Behavioral/Mental Health Facility Posted: 23 Nov 2021 12:18 PM PST My wife is currently being held at a Behavioral/Mental Health facility in Idaho on a temporary involuntary hold. She has severe and potentially life-threatening neurological disease and is being refused medication and treatment for her medical health and I am witnessing a sharp decline of her physical health. She requested a consult with a neurologist (at the advice of her current neurologist), the facility refused, she asked for a dose of her rescue medication which would help with her symptoms and prevent them from worsening to the point of a life-threatening event (she is prescribed this medication already and they have access to it as I handed it to them myself) and they refused. She is often too weak to leave her bed (severe weakness is a key issue with her illness) other than to make very short phone calls to me pleading for help, where she is forced to stand while doing so, they will not accommodate her disability even as far as getting her a chair to sit in while she uses the phone and they are treating her as if she's faking her illness and/or symptoms and they continue to threaten to keep her in their facility longer if she can't participate which she is physically unable to do, an accurate analogy (in my opinion) would be insisting a person in a wheelchair walk, and/or refusing a diabetic insulin, unfortunately if these examples were the case they may respond appropriately as they would likely have a better understanding of those limitations. Unfortunately it has become apparent this facility is ill-equipped to properly treat her medical health while simultaneously negatively affecting her mental health through threats of extending their "Care" until she somehow forces her body to cooperate with their demands. I personally (over the phone) witnessed my wife asking the staff at the facility what her rights are and clearly stating she is concerned for her safety and their response was shutting a door in her face and ignoring her concerns. I have spent the last two days on the phone with various organizations, filing complaints and trying desperately to get some help for her before her health declines further, but I have been unable to find anyone who can actually do anything about this. Both her and I am being treated as if we are trying to fake this situation in an attempt to free her from the facility, while it is my intention to ensure she is removed from this facility, I can assure you none of this is fake and to add fuel to the fire, her illness took years for her doctors to properly diagnose, as it is so extremely rare and in that process she was also accused of faking her illness until it was properly proven by a neurologist, the facility may not realize this, even though I've told the director and on-staff nurses, but to repeat that treatment is only further degrading her mental state which has made her react in ways that to their apparent "Untrained eyes" only further reaffirms her need to be there, but she is desperately trying to advocate for herself, not something a person who is a threat to themselves would usually do, as am I. I am at my wits-end personally with this and have had literally everyone I've called respond with "I wish I could help but this is <insert organization name here>'s problem", I have began investigating legal representation, however, this may be a much more time sensitive issue that what the court system will allow, also this is tricky given the holiday this week. I've filed complaints with the following places:
She needs immediate help, before this facility causes her further mental and medical anguish, I'm at a total loss at this point as it feels like David Vs. Goliath, but in this case, Goliath is a much bigger, more uncaring machine than the famous tale. We are working on getting her transferred to another facility, where she may face the exact same treatment/discrimination, but we are hoping that will not be the case, however, at this time, the current facility is not cooperating with that request. It feels like the only way right now she can get out of there is if she allows her health to decline to the point they have no choice but to send her to the emergency room, but this is cruel and atrocious treatment of a person with a disability and why should she have to suffer to that point before her concerns are validated or heard? Has anyone been in this situation, how do I get her quick help before this runs her into the ground metaphorically and literally? TL;DR: My physically disabled wife is being mistreated by a mental facility, and her reactions to that treatment as well as her attempts to advocate for herself appear to be working against her. Update: They've finally caved and gave her a dose of her rescue med and she's been seen by an MD that does not appear to have experience with her illness, her vitals were not in good shape, but they have been unable to get a proper expert to evaluate her, either through their own unwillingness/negligence or possibly just simply the holiday coming up, this unfortunately is my own speculation as they won't say why not. I was under the impression the Affordable Care Act allowed children to remain on their parent's policy until they turn 26, and that's all I want to do. I think forcing me to sign away my college status (which in my case would not be truthful) and open a new policy separate of my parents may be a sketchy way of skirting the ACA, but this is a high-profile provider for the U.S military; surely they wouldn't risk doing something like this if it was illegal? To clarify again, I would be the sole policy holder on the new, Young Adult plan they'd like me to enroll in rather than my parent. I'm also worried that signing anything will formally allow them to exclude me from coverage under the parent plan, and I still don't want to lie about graduating college for health care, but it isn't like I'm covered in any way now as it is. I asked about ACA protections up to age 26 but was told several times that there is no way to remain on the parent plan. I have a record of the call, took notes throughout it, and have maintained the agent's name and the case number for our conversation. I really appreciate any advice, and I need my insurance back ASAP; I had to pay $130 out of pocket today for a vital prescription, and I have an important doctor's appointment scheduled, so anything is greatly appreciated. Can I get fired for saying I won't answer any calls outside of work? Posted: 22 Nov 2021 03:45 PM PST Hi just to preface this I am currently located in Missouri and am a hourly employee. I work in disability care full time and the majority of my hours are at night time. However because most employees work normalish hours I receive between 5-15 calls a week. Because I work nights I am often sleeping during these calls which they wake me from. However even when I am awake they add a large amount of stress. So can my boss fire me for saying "I will not be answering any calls on my off hours?" [link] [comments] |

I recently deposited a paycheck ($3500) to my bank from a freelance gig. My bank flagged it as "fraudulent" because it's a greater amount than I normally deposit, which is true, but only by like $1000. Because of this though, they have locked my account. When I asked how to resolve this I was told I was permanently locked out of my account and there's no recovering it. So I have no access to my money. I was also told I wouldn't be able to make payments on my car loan as that account is locked as well. What do I do from here? Is this even legal? Are they allowed to permanently lock my account down and not allow me access to my money? And if I can't pay my car payments to the bank for the loan because they refuse to take my payments, how do I prevent my car from being repoed? [link] [comments] |
