Legal Advice Could I Be Sued for a Negative Review?

Could I Be Sued for a Negative Review?

    Posted: 03 Oct 2021 06:12 AM PDT

My old property management company contacted me and told me I would have to pay $10,000 unless I took down a negative review. They frequently delete and repost their business page because of all the negative reviews they get, so this was a new review for their new page. She dug up my 2017 files and said I signed something that said I couldn't post a negative review. I took it down because they are such a headache to deal with, but this seems like a violation of the Consumer Review Fairness Act, which I told her. Should I report them to the FTC/State Attorney General, and can I repost my honest negative review without consequences? ETA: I'm in the USA, in St. Louis, Missouri.

New York - Involved in a car accident. Cop and responsible party are friends.

    Posted: 03 Oct 2021 08:35 AM PDT

I was the only car stopped at a red light making a left-hand turn. The light turned green, and I had a green arrow. I started turning, the car directly across the intersection blew the red and t-boned me.

I saw him pick up his cell phone. He refused to get out of the car or acknowledge me. A few moments later, a police officer arrived. The other guy jumped out of his car, shook the officer's hand, and said, "Thanks for coming, Dave."

The officer took his statement, and didn't say a word to me other than to ask me for my insurance card. He went back to his patrol car, walked over to me, and handed me a summons.

He said, "You're receiving a citation for failure to yield. You can pick up the police report in 3-5 business days at the police station."

When I informed him that I had a green arrow and the other vehicle had, in fact, gone through a red light, he chuckled and said, "The other driver is a Captain on our fire department. He's driven our engine safely through more intersections than you've ever seen. I don't want to hear it."

    I replied, "But I have..."

He put his hand up in my face and said, "You're not getting out of this by lying to me. You can attempt to contest your citation in court. I'll see you there."

I picked up the police report and it says that the opposing driver had a green light as he approached the intersection. As he entered the intersection, I drove into the intersection at a high rate of speed turning left without yielding, impeding the other driver's path and causing the collision. It says that when I questioned I did not dispute the other driver's account of the accident and was issued a summons.

What I was trying to tell the officer was that I have a dashcam that captured the entire accident. I rolled my windows down as soon as it happened so the audio is fairly clear. It shows us both stopped at the intersection, me entering the intersection with a green arrow, the other driver gunning it into the intersection (it doesn't capture the crash as it was from the side), me getting out and attempting to talk to the other driver, audio of the other driver calling the officer Dave, video of me giving the officer my insurance card, and then video of him handing me the summons and refusing to listen to my side.

The other driver has already filled a claim against my insurance. When they called and asked me what happened, I told them the truth and that I have the whole thing on video. They are not paying his claim pending an investigation.

I have court at the end of this month. Should I try to contact the officer ahead of time to see if we can amend the report? I don't want to put a target on my back, and I feel like that's exactly what I'd be doing if I go into court and embarrass the officer by demonstrating that he lied. I am not trying to be nice here, I just really don't want every cop and firefighter in town to hate me. Cops stick together, and I don't want to get pulled over every time I leave my home.

I have not yet filed with the others party's insurance and I have not provided them the video. Only I and my insurance have a copy (I have several in both digital and physical medium).

Can I sue my job for setting me on fire?

    Posted: 03 Oct 2021 08:04 AM PDT

I was cleaning the fryers at my job on Wednesday and it suddenly caught fire with my face taking the brute of the flame. I was coughing and my left eye kept tearing up and my left nostril kept running as well. No one sent me home or asked if I wanted to go to the doctors or anything. The managers seemed to have brushed it off and they won't let me see the video of it happening. I was wondering if I have enough to make a case just based off that. There's been also former employees that had also been caught in the crossfire of fire related accidents at the job.

Bought home in Los Angeles County from seller who was removing the inground pool from the property. To ensure they did the removal correctly, we requested they do the work with all necessary permits and added that into the contract. We just found out the permits were only issued, but were never completed. They are only 11% complete.

To make things even more difficult, we found out the seller just passed away a few months ago. However, his daughter was the one in charge of all construction and remodeling that was done on the home leading up to the sale. She is the one who originally requested the permits from the city.

Since we included permitted work as one of the conditions of the contract, is there anything that can be done? The permits are still open with the city. Is it worth taking legal action in a situation like this?

What are the possible issues we can face if the permits are never completed?

Employer doesn’t tell me where to go, then doesn’t pay me [US] [Indiana]

    Posted: 03 Oct 2021 06:19 AM PDT

I work at a local church that's a member of a massive church and isn't paying me under the table. This is my first legal job, with paperwork and taxes and everything, and I need it to pay for rent and groceries. I'm a singer and get paid per service, and I'm always told less than a week in advance where and when I'm singing. This morning, I show up to the church and only my direct superior is there, and nobody else. Turns out he got the wrong location and we're meant to be at another church. We miss the service, so I email the guy who signs my checks to explain exactly what happened and ask to make sure I'm still getting paid (100 USD), as although I wasn't there, it was because my direct superior misinformed me. That guy says no. By the wording of my contract, I am paid "per performance", and I definitely didn't perform. However, I need that money and there's a pretty clear line of who's responsible for the mistake. What should be my recourse?

Is it legal for a landlord to require a $45 convenience fee to pay rent?

    Posted: 02 Oct 2021 08:08 PM PDT

I signed a lease in February 2021 stating that I would pay a monthly rent of $1465. $1370 is the actual rent, $23 for our trash pickup, and $72 for cable/wifi. I have consistently been charged NO LESS than $1507, sometimes up to $1685 in extra fees they're stacking on and claim it's sewage and a second trash fee. They say there's no way to get around it. After three months of paying via eCheck, the complex I live in (located in Florida) cancelled the eCheck option for me. They claim they cannot reinstate it. Since that's no longer an option, card payment or "recurring check" are my only option, both of which have a convenience fee of $43.80. I have called and asked if they can wave it but they say that's out of their hands. Is it legal for the landlord to make it so that the only ways I can pay rent cost an extra ~$44 on top of the extra fees they're already charging me?

Landlord says my friend is liable to other tenant for leaving shared garage open

    Posted: 03 Oct 2021 06:22 AM PDT

My friend left his shared garage open (allegedly) and another tenant says some personal valuables (ski equipment) were stolen out of the garage while the garage is open. Ll says friend is liable to other tenant for value of lost goods. Nothing in the lease covers this. Any advice?

Neighbor speeds with reckless abandon and drives drunk. What can I do before he kills someone?

    Posted: 02 Oct 2021 04:59 PM PDT

There is a younger man (early 20s) who lives one street away from me. Over the past six months, I have seen him exceed 45mph (in our 25mph neighborhood) approximately two to three times per week (I tend to walk my dog around the time that he leaves and arrives home).

He accelerates to his top speed of 45mph as quickly as his souped up Jeep will go. Recently, I have witnessed him drinking, throwing the empty beer can into the street, and getting into his vehicle before lurching and stopping, lurching and stopping, and then accelerating to top speed out of the neighborhood.

I am a single, young woman. I do not feel comfortable confronting this person, but I genuinely feel like I'm in danger (and my dog is in danger!) when we do our routine walks. It seems like only a matter of time before this person ends up hitting something (or, more importantly, someone). I have tried changing the time that I complete my daily walks so that I avoid him, but I still seem to encounter him on a weekly basis. There are young children in the neighborhood that play on the sidewalk, and I also fear for their safety.

What can I do? Do I call the non emergency police line and report his vehicle? Should I leave a note on his car or his home (he lives with his parents), or is that a total Karen move? I never thought I'd be the person "telling on" someone in the neighborhood, or leaving a note rather than having a calm and frank conversation, but this young man frightens me. Is there anything that could be filed to scare him into obeying the traffic laws? Much appreciated. I am located in Michigan.

(NJ) Obviously fraudulent check written and bank is being difficult.

    Posted: 02 Oct 2021 07:09 PM PDT

Someone wrote a strange looking check with my Father's routing and account numbers to pay a hair salon 700 miles away $87K. There was much less than that in his account. He logged into his bank account, noticed this and reported it to the bank. They (without his asking or consent) did a stop payment on the check, charged him the stop check fee and then fined him some huge amount for overdraft. They locked his account and sent back checks he wrote to pay bills which might mess up his credit rating. For a long time, they wouldn't tell him anything except that it is under investigation. They made he and my mother (who is also on the account) go to a branch, show their IDs and then opened a new account and moved the original funds there. Now they have locked the new account and are making other demands (send this document here, fax photos there). My father has health issues and this has been stressful and a waste of precious time and energy. Is there any course of action outside dealing with the bank?

I loaned somebody $600 years ago, drafted a written document, she never paid me back. Is there anything I can do?

    Posted: 03 Oct 2021 10:44 AM PDT

Back in 2014, I just graduated pharmacy school and started working as a retail pharmacist in Summit County, OH.

There was this pharmacy technician (I'll refer to her as "LUCY" -- not her really name) who I worked with often, and since we were both girls about the same age, we'd chat a lot and became friendly.

Lucy was down on her luck. Her relationship with her mom was bad. Her mom kicked her and her two dogs out of the house. Lucy was renting a little house. She couldn't afford a car so coworkers from the store would give her rides to and from work. I'd occasionally give her a ride as well.

One day, Lucy, acting all stressed out, told me she didn't know what to do -- she didn't have enough to pay rent that month. She asked me if I could loan her some money. I said no -- ask some other people.

A couple of days later, she asked again. Again I said no.

A couple of days later, she asked a third time. I asked her if she exhausted all her other options. She said yes. I drafted a very simple document, stating that I was loaning her $600 and she had to pay me back by a specific date. I wrote a check for $600, but she asked that I write the check to her landlord, another pharmacist that we mutually knew.

We didn't see each other a couple of days. She was a day or two late, so I asked her when she was going to pay me back. "Next paycheck", she promised. Then I left that company and was no longer at that store.

We'd text and email back and forth -- "When will you pay me back?" - "I'm sorry! Soon!".

A year, year and a half later, I drove to that store where we had worked, greeted her. After some small talk, I asked "Do you remember you loaned some money from me?". She nodded. I brought out the document I had drafted and she had signed. I said, "Let's make a plan to get this paid out.". We made a verbal agreement that she would pay back $50 monthly. Of course, she was very agreeable to paying back the loan and promised to remain in contact.

I got one payment of $50 and then she disappeared again. A year or two after that, I drove to that store but she no longer worked there.

I am a pharmacist, not a lawyer or in law enforcement. In my heart, I feel this is THEFT because we had an agreement that she would pay me back. There's even a document she signed (even though it was not notarized). It was clear this money was not a gift or charity, it was a loan. She manipulated me with sob stories and took advantage of the fact that I felt bad for her. I've reached out to her old landlord (the pharmacist), and it sounds like she was a pretty lousy tenant, go figure.

Today, I was going through my contacts and found her number. I decided to send a text "Hello! Is this Lucy ***'s number?". She probably won't respond, but if she does... is there ANYTHING I can do? I don't want to harass her but, I do want my money back. She lied to me, manipulated me, and as far as I'm concerned stole from me.

Any advice from someone with legal or law enforcement expertise would be greatly appreciated. Thanks in advanced!

Father and I are estranged. Because I am a disabled survivor by SSA definition, and receive benefits on my father's record, they informed me that he recently died, but with no details. How can I claim any property he may have left? I don't yet know if he had a will, or how to find out.

    Posted: 03 Oct 2021 03:32 AM PDT

I am in California. The last I knew, my father was in Texas. I don't know the exact county or city. I know his name and his date of birth. I am his only son.

He divorced my mother when I was young, and never initiated any contact with me as an adult.

I had some limited contact with his step-wife at the time maybe 4 years ago, but I don't know if she is still alive, or if they are still together. I have two phone numbers for her. I called both, one went to voicemail, the other had a voicemail that had not been set up.

I think that my father owned some property in TX.

Do I have any claim to that property as his only son?

How should I pursue this? For example, if I need a lawyer, what kind of lawyer should I be looking for, specifically?

Thanks in advance to all who read this.

What is my obligation for a package delivered by mistake

    Posted: 03 Oct 2021 11:22 AM PDT

    State: MD

Almost a week ago a large package was delivered to my address. Carrier is not USPS, but a very well known private delivery company. I promptly called them and gave them details. They said they would pick it up later that day.

A few days later, I called them again, as the package is still on my front step. They confirmed they knew about the issue and said they would be by that day.

Now, a couple days later, it is still on my front step. Was a nice dry week, but soon it will rain and I can not leave it out and also protected from the rain.

At what point can I assume it is abandoned and I'm free to deal with it as I see most convenient for me?

The error is amusing: correct street address but wrong city and state.

Trying to figure out if my mothers probate lawyer is taking advantage of her.

    Posted: 03 Oct 2021 09:52 AM PDT

My Father passed away early august. He had a bank account with about 43 grand in it and a brokerage account with another 6 grand. He also had both cars (himself and my mothers) in his name. all together there value was about 23 grand. than a few small checks and such. None of this was in my mothers name, both have been married for 30 years.

With the cars the total value of the estate comes to 81k. 6k above the limit for summary administration. a quick google search tells me that the cars are supposed to be exempt but the lawyer says otherwise. what am i not understanding?

also she skirts around how much my mother owes her and is near impossible to get on the phone for near $400 an hour.

My landlord has been ignoring me, including urgent maintenance requests. There is now flooding, bugs, and damage in the unit, I cannot use my kitchen, and I would like to take them to court.

    Posted: 02 Oct 2021 08:08 PM PDT

    Location: outside of Fairfax VA.

I began renting my current unit 2 years ago from a previous landlord. He passed away several months after my lease started, and the property was assumed/inherited by one of the larger management companies in town, who I now have a new lease with and have been paying rent to for over a year.

The property is owned by a family who apparently buys dumps, fixes them up, and rents them out. I have never met anyone from the owner family, they appear nowhere on my lease with the management company, and as far as I am concerned they do not exist in this equation.

The management company refuses to maintain the property themselves, saying they have an "agreement" with the owner family that they will perform all maintenance. They... do not. They are the dictionary definition of hillbilly rednecks, do not have email, do not answer their phone, and do not have voicemail. They are impossible to get in touch with, and the management company refuses to give me their contact information/address. There was a plumbing emergency last summer and the owner family sent two of their goons (two extremely dangerous looking men, reeking of pot, covered in tattoos, and not at all shy about sharing their ex-con status - I am a tiny white girl who lives alone and do not at all feel comfortable with that situation again) who completely ruined my carpet, tore up my bathroom cabinet, and left a disgusting mess all over my floor.

My lease states if a maintenance emergency is not dealt with within 14 days I have the right to contract the repair myself. It has been well over two weeks (actually I've told them about this for months, just this last round I was extremely graphic that there was literal poop water flooding in the unit and the kitchen is unusable) and I've emailed them directly with an urgent plea to please do something, communicate at all, something other than completely ignore me - crickets.

I will call a local plumber on Monday and explain the situation and apologize that they have to deal with someone else's incompetence, asking them for an itemized invoice and taking it out of my rent, as my lease states I am allowed to do, so at least hopefully I will have a liveable home sometime next week as soon as someone can come out.

    My question is this:

    1) Am I ok not to pay rent right now? Due on the 1st, I have until the 5th before incurring a penalty. I emailed them last week asking them what they'd like, no response surprise surprise..

    2) I want to take them to court. They are treating me like absolute shit, not communicating at all whatsoever, ignoring me and just taking my rent money which I continue to diligently pay every month for... nothing in return. I have had to eat out for the past nearly a month as I cannot use my kitchen, I have a beautiful garden in my backyard that I spent hundreds of dollars on that is now dead because the whole plumbing system is backed up, and I have had to eat, sleep, work, and live in a small apartment that literally smells like a sewer for over a month, there are mosquitos spawning from the flooding sewer water, and I am beyond done with their negligence and continuing to pay them a passive income to live like this.. It has cost me a ton of extra money I was not planning on spending just to survive around the problems.

I've never taken anyone to court and have no idea where to start, what grounds I have, or how to go about this. Nor do I really have time right now to deal with a whole big legal case. What should I do? How can I find a good lawyer in town to talk to, to start? Will I have to pay them even though I've done nothing wrong in this entire situation?

Sorry for rambling I'm a little overwhelmed with all of this and raging with fury at having to deal with this treatment. Really appreciate any help or advice anyone can offer, this is all new and foreign to me. I think they don't consider it "their" property as they "assumed" it after the previous landlord's death, and they continue to think they have no responsibility to maintain it as our lease clearly says because of the owner family situation. I am absolutely beyond furious and want to pursue this to the fullest extent possible.

California- my boyfriend got hurt at his job.

    Posted: 03 Oct 2021 01:02 PM PDT

Please help. My boyfriend works in a factory and three weeks ago his feet got crushed with a forklift one of his coworkers were using. He tried to notify the incident to his supervisor and the HR person that is there with them but was told that they will make a report. days passed and they didn't say anything to my boyfriend. My boyfriend was left with his feet alternating between numbness and throbbing? And it hurts still. Last week he told his supervisor that he wanted the report and if they didn't do it he was going to talk to the factory's owner. They told him they will make it and If the pain has not gone away in 3 days they would send him to a doctor that the company would choose. Again the week passed and they would just popped up asking him how he was but nothing else was done. Finally today I convinced him to go see a doctor because his feet is not getting better. My boyfriend hasn't done anything else because he doesn't speak much English so is hard for him. In case is relevant he is completely legal in his immigration status. Sorry for my bad English, it's my third language I hope some one can guide us in what to do.

Aunt stole grandmother's money - FL

    Posted: 03 Oct 2021 12:44 PM PDT

    Located in FL, US.

My aunt has been taking care of my grandmother (her mom) for a few years as she chose to. She's been taking lots of trips that she normally couldn't afford (leaving my grandmother alone with her teenager) and buying tons of luxury things and I personally believe neglecting my grandmother as she leaves her alone all day with nothing to do. My grandmother reports my aunt and her husband are mean to her. My grandmother has dementia and they offer her no structure, no in home care, no therapy for the depression she clearly has, and no other support.

Recently I talked my family into checking into the finances as we're looking at putting her into a home. I'd like to note here that this aunt stole my mother's trust fund that she was executor of - $250k became $2k by the time my mom died 3 years later and we literally never got any of the money, rent and stuff was covered by disability and SSI, etc, so I fought my family like hell on them giving sole financial control to my aunt. They don't believe me that my aunt stole my mom's funds, despite me having proof it didn't go to us at all.

Turns out my grandmother went from being quite well off as far as her remaining assets due to a lifetime of saving and investments....to the point we're likely going to have to sell her home that the family still takes care of....and we may not even have enough to put her in a memory care home like we have to for her dementia.

While my family is "trying to get financial control away from" the aunt, I don't personally think that's enough for stealing an amount of money that I don't even know beyond knowing it was "far more than she needed to take care of her".

Best part? The aunt decided to attempt to blame me by saying I used up the credit cards (I haven't had one of my grandma's cards or access to them in over six years), saying she pays for my car and insurance (I have the last three years on my own) and keeping a list of "loans to lostbutnotgone". Any money I've asked for, I was told not to pay back. I don't know the total of what she accused me of but I was told it was "substantial." I sent the PayPal records of being sent less than $1500 across three years to my uncle and told him to compare them.

Sorry to be long-winded. Here's my question: can my aunt be sued for stealing the money, especially if there's evidence of it (which I'm sure there is because their businesses are never doing well)? Would i contact an elder abuse lawyer? An estate lawyer? Would i be able to go after her myself or would it have to be one of her children? I don't know if anyone else would be willing to go in on this with me but I'm sick of her getting away with this and I'm sick to my stomach knowing what she did to my grandmother.

Thank you all in advance for any advice.

For the curious:I ask for money sometimes to cover rent, by the way, as I have chronic illnesses and sometimes miss work. I have no parents and other family members won't help me so I have to ask her. I always offer to pay her back and she always says no.

dealership claiming they need to register the vehicle before i can get the title

    Posted: 03 Oct 2021 12:43 PM PDT

Hey not sure if I can posts this here. But at least I'll try.

My fiancé bought a vehicle recently from a shady dealership in Orlando and the guy who sold it to us said he can do the title and registration for a fee. We paid it and get the vehicle home where my father takes a better look at it and sees it needs a lot more work to get it safe, so my fiancé decides to get the title and sell it (either scrap it or get it safe enough for the next person)

I believe Florida doesn't have a lemon law and dealerships can sell anything "as is". the trouble were having is the guy who sold it to us is saying we need to register the vehicle first before we can get the title.

[Edit] the question I'm asking is, is there anything I can do to get the asshole to do the title without having to get cops or lawyers involved?

Bait and Switch (ish) Moved to New Co-Living Situation (CA)

    Posted: 03 Oct 2021 01:17 AM PDT

I arrived at my new place in a co-living situation to find much of it was not as described. The landlord mentioned it was a very clean and strict place, but I come in to find a trashed bathroom that had not been cleaned in months/years. My bedroom had only been swept but was covered in smears on the walls, dust/dirt on the baseboard window-sill and dead flies everywhere. The tenants were described as working professionals of various ages when I signed the lease. There are senior citizens and none of the tenants work in a professional setting. When I first arrived two tenants were fighting and smoking cigarettes outside of my room. One of the tenants was piloting his drone outside of my room and crashing and RC car into parked cars in the neighborhood. These are not clean, working professionals who are friendly. (Upon moving in, not single tenant has looked me in the eye)

I have had to flush poop/pee from other tenants twice in the four hours I have been here.

I am disgusted with this place. I want to go home.

What are my options? I know most of what I described is hearsay but I have videos/photos of the conditions and text transcripts. I just want my money back and I will pay for the night that I stayed here. The landlord is very uncooperative and instead of helping or addressing my concerns told me I was tired and should get some rest.

Please tell me I have some hope to get out of this shithole.

    Hurt on private property

    Posted: 03 Oct 2021 12:32 PM PDT

A wife beater was running from the cops in his truck, (he won't be charged with evading police because he forgot to put his lights and sirens on but the guy new he was being chased) he drove into out road mistakes it for a main road. We live at the end of the road and have a path into some woods by our driveway, he drove in front of our house and ran down the hill, because of the fact that it just rained and it's a very steep hill he slipped and broke his leg, this leaded to his arrest. My dad thinks he can sue us for falling because we don't have a private property sign out front eve though we live in the middle of a neighborhood and the path is very clearly on our property. Is him suing us a possibility? If it is can we counter sue for trespassing?

    Posted: 03 Oct 2021 11:32 AM PDT

Hi. My son is 28 yrs old and last weekend he suffered a major stroke. He's got a blood clot in his brain and also has an aneurysm on his heart. He's still partially paralyzed from the whole event. This morning, he called me and said the cardiologist was in to see him today and told him they may have to put a pacemaker in his heart.

I got to thinking about it...what if something happens and he's unable to make a decision for himself? Is there a way I can get power of attorney to make decisions for him regarding his care and probably also handle his bills while he's hospitalized?

    Thank you.

    Posted: 03 Oct 2021 01:27 PM PDT

In January of 2020 I signed a 1 year lease with my now ex i moved out in December for 2020 (relationship got physical and I left) i informed the realtor we wouldn't be resigned and that I was moved out and was not changing my mind. Well in February of 2021 I was informed he was still there with my name also on it still he told the realtor I had changed my mind and no one checked in with me he is doing a month to month agreement now I've been in a fight with the realtor to evict him and finally got them to set a date which was August 1st 2021.but he still hasn't left! He throws a sob story of how he doesnt have a place to go and the realtor keeps giving him time I cant get a new house with this one still on going. I've asked to be removed from the lease and the realtor told me he doesnt qualify with out me and there for I can not leave. Any help? What can I do I didn't agree to a month to month but im basically being forced after stating and signing saying the lease was over once the 1 year was over

Parents separating, one parent wants me to stay, one wants me to leave.

I am over the age of 18, I've stayed impartial in the separation however I've taken a side since one parent is being very unreasonable.

    Location: Canada

Both parents own the house, the separation is in the process of getting started. The parent that moved out said they want me to stay in the house. Now, the other parent knowing that I am completely not in their side, will probably want me out soon.

Any suggestions would be amazing. I just need a few more weeks to get everything together and move on with my life. This has been very difficult.

Can my sister move in with me and attend school in my district?

    Posted: 03 Oct 2021 09:02 AM PDT

To make a long story short, my 17 year old sister has been facing some issues at school (in PA). My parents live in a bad school district and can't afford a private school. I, on the other hand, live in a very good school district in VA. My partner and I, though unmarried, make a substantial dual income and own a home together, so we definitely have the ability to take her in and provide for her. My parents, she, and I have discussed the possibility of her moving in with us, especially because she eventually wants to go to college at a VA state school. However, we aren't sure of the legalities of the situation. Can she move in with me and I take guardianship of her, at least to the extent that I can add her to my health insurance and get her in school? If it matters, this would be for her senior year of high school, and she'll turn 18 about two months into the school year. Thanks in advance.
