Target automatically changes my status to tobacco user and charges me for it. Posted: 14 Sep 2021 08:15 AM PDT Basically the title and I'm wondering how legal this is? I'm a Target employee and have noticed in the past they charged me $30 a month as a tobacco user which I've never been. I guess this is because I have their insurance. I changed it and come to find out it automatically changes back to tobacco user and you have to change it back each year so they've been charging me again!! I find out they'll only back pay during this year period or whatever and nothing previous. Is this legal? Is there really no way for me to get this money back? I'm so tired of wage theft being just something that's okay in this country. Washington state by the way. [link] [comments] |
Posted: 13 Sep 2021 10:24 PM PDT [USA] [NC] I was SA/R worded on Saturday night, woke up Sunday at 2 pm after being drugged with no clothes on. I called 911 and went to the ER, spent the whole day at the ER, and then went to my dad's house. While I was at the hospital they told me that it would take too long for them to find out if I had an std so they recommended I take the treatments. I took Plan B, 4 pills for chlamydia, and got a shot for gonorrhea. The hospital called me to follow up this morning and when I talked to them I asked when the results would be available, at the time they did not have a time frame and said it was still pending but could take days or weeks. I still do not have all the test results, but I logged into my online portal to check at around 9 pm. I freaked out when I saw I tested positive for chlamydia and was having a mental breakdown the only thing I wanted to do was call my best friend and talk to her about it. I messaged her on Snapchat and was trying to ask her or my other best friend if they were free to talk and told them about finding out about chlamydia, and I needed someone to talk to. Well, it turned out to be that I texted a group chat of my two best friends and another friend with who I had a recent sexual encounter. He freaked out and screenshotted everything and was texting and calling me nonstop to the point that my phone was lagging, and he was accusing me of lying about being R worded for attention and that it was a "cover-up" for me to tell him I had chlamydia. He said that he is going to talk to an investigator and get me arrested and charged with up to a year in prison for giving him chlamydia if he had it. He said it was illegal not to tell any sexual partners that you gave them chlamydia and that I now was going to have at least four other women trying to sue me who he had slept with recently. I told him that I had literally just found out and didn't even know what the test results fully meant until I was to see my doctor on Wednesday. Legally what are my options if he decides to try to pursue me for the arrest of me just finding out today I have chlamydia after being R worded? The sexual encounter with my male friend took place weeks before I just got R worded Saturday night. [link] [comments] |
Peace order from Ex/Baby's mother claiming things that never happened. Posted: 14 Sep 2021 09:40 AM PDT Me and my Ex broke up almost 2 months ago. Our son is 4 1/2 months old. Since we've broken up she's made my life more or less a living hell. For reference we're both on the babies birth certificate but she's filing for full custody, while I've filed for 50/50 custody. So she's hell bent on dictating when and if I can see my son, mostly depending on how bitter and jealous she feels that day. I have dozens of texts showing her questioning me nonstop about my relationship status, constantly harassing me about who I'm with or who's around when I have my son and often even when I don't. So for the matter at hand. I was fortunate enough to get my son Friday-Monday as my ex started a new job overnights on the weekend. On Sunday she say's she misses Alex and she wanted to know if she could come spend time with him. I (trying to keep the peace) begrudgingly agree'd that she could come hang out with our son, Even though it was my weekend with him. Sunday evening she barges into my room and asks if "I have anything to tell her". I have no idea what she's talking about, She tells me that she knows I'm talking to X girl that she doesn't like, because one of her friends told her. She reaches out to said girl probing her for information, which gets her nowhere. She accuses me of talking to this girl which I deny(We had talked previously but hadn't in a few weeks). She said she was packing her stuff and leaving and I bid her farewell. She storms off downstairs with our son so I followed after her, she was sitting on my couch. She copped an attitude and said she was trying to spend time with our son, I told her to get the fuck out of MY house because I wasn't being treated like that after I allowed her to come over. She went into my dining area and started grabbing some clothes she had left at my house in a hamper. I approached her and asked for our son, because she wasn't leaving with him. It was my weekend and she could come get him the next day at our agree'd upon time. At no point did I move aggressively towards her, raise a hand, ball a fist. At no point did she try to move past me or back up, nor did I block her or physically restrain her. She looked at me for a couple moments, handed me our son and said "Enjoy this weekend with him it'll be the last time you get him". The next week I get almost no updates as to how my son is doing. Every day I ask to get him is met with an "IDK" or no. Finally Friday I told her if she didn't let me get my son over the weekend I would be filing for emergency custody because I don't know who she's leaving our son with overnight while she works, and there's no excuse why I can't have him. Friday night I get served a peace order, claiming I "threatened her with violence, stalked her, detained her against her will, and text her nonstop". There's no proof to any of this, and I know that she has no physical proof because none of it's true. I assume that burden of proof should fall on her during the trial, of which it'll basically be her word against mine as there's no physical proof. Is there anything else I can do? What exactly is a judge looking for out of the defense at a peace order trial? I have hundreds of potential texts I could print out to present as evidence to her being emotionally manipulative, jealous and bitter as well as her multiple threats to keep my son from me. I also don't want to be that guy that shows up to a trial with 100 pages of texts for the judge to read through. USA, Maryland for reference. [link] [comments] |
Posted: 13 Sep 2021 05:39 PM PDT [US] [FL] Hello everyone, We are an immigrant family from Syria that moved to the US around 5 years ago, we bought a house a while ago and someone called the FBI on us thinking we were terrorists because we're muslims and mom wears a hijab. Anyway, the FBI came checked everything, made sure we're just a normal family trying to live a better life and left. After that by around a year, the FBI made another visit, this time was to ask us if we knew any Iranians that are planning to do harm to the US. We thought that was weird because how would we know? Feeling that we must help the US (our new home) we talked to them and explained that we're just a regular family just like any other American family, my siblings go to school, I got work and college, dad works almost everyday and mom stays at home. They insisted that we talk to them if we hear anything, told them that they don't have to tell us that because we would anyway. But again, how would we hear anything if we don't even go to the mosque or know any arabs/muslims here?. Yesterday they called my dad again and now he's getting frustrated because he does not have any business knowing any stuff that would hurt the national security of the US, and it's just madness that they keep calling him because he's an old man that works almost 7 days a week and doesn't even speak English that well. Is there anything we can do to make them stop calling us? It's too much for dad and he feels targeted for no reason and it's really stressful for him. Thanks in advance!. [link] [comments] |
Posted: 13 Sep 2021 06:13 PM PDT My landlord lists a room available (even though they are all occupied by myself and other the paying tenants) at our house or other ones that he owns in the area, uses a fake picture that is way nicer/upscale than the actual house, and once someone books the room he sends them a list of requirements they have to fill out like renters insurance, security deposit, etc. Somewhere in those requirements he makes them all timed but in a way that it's impossible for anyone to actually fulfill. This is what he told me verbally, so I don't know the specifics of his Airbnb terms. So people show up to our house with bags packed anticipating a stay at our property, and my landlord locks the doors and just waits for them to go away. Apparently he gets a "refund" from Airbnb and the people who booked the place also get some money back. Since I've moved into the house in early August 2021, there have been 4 separate occasions where there are random people at my doorstep who say they have booked an Airbnb and each time I call my landlord and he tells me he has no idea what myself or the Airbnb people are talking about. This happened again recently and when myself and the other tenants asked him to explain what is going on, he told us all of the details. I live in a major U.S. city in Maryland and do not wish to have my safety at risk when I come home and have to negotiate my way past a group of (rightfully upset) strangers. I have reached out to Airbnb about this issue. Do I have any leverage as a tenant in this situation in terms of early termination? Thank you! [link] [comments] |
Posted: 14 Sep 2021 03:40 AM PDT So a coworker of mine went to get a covid test at the hospital and they are instructed that all employees from my company getting tested will have their tests sent to a testing site the company owner also owns. This took away his option for the rapid test and he didn't find out the test results until late the next day, by his manager who was given the results from hr. I'm curious if this is an actual HIPPA violation, which is what it seems to me. My coworker was also not using company insurance since he goes through his wife's insurance, which is much better, but his test was still required to go through the company owners testing facility but because he is an employee of said company. This was also not a case of he was sent during work hours but he went on his own time on a weekend. I am asking from Kentucky. [link] [comments] |
Posted: 14 Sep 2021 10:32 AM PDT Hey folks, Hopefully you can help guide us in next steps. I'm a part of a niche industry operating in California. Recently, someone has filed a bunch of discrimination lawsuits citing ADA laws. He is claiming that my website, along with others, is not ADA compliant because we don't have subtitles on a few of our videos. The videos are hosted on Youtube, so they have subtitles which are computer generated. Everyone I know in our little industry is currently being sued by this same guy. My question is: is there any sort of "reverse class action" we could take against this guy or are we going to have to settle separately? Could we coordinate and perhaps pool our resources to a unified legal defense to save money? The amount of money this would take to defend is a death sentence for our business. We're in the entertainment field, so the majority of us are not raking in the big bucks. Please let me know. [link] [comments] |
Posted: 14 Sep 2021 12:31 PM PDT I'll try to keep the details breezy here, but basically I was driving near my town's local School District building, where they hold board meetings & such. I noticed a decent number of yard signs put up around the building, chastising the board for reinstating a mask mandate district-wide in response to an influx of positive COVID-19 cases. It was pretty spur of the moment, but the signs were an eyesore and I mostly just felt bad for the staff who had to look at them. They were holding a meeting that night (the first since the mandate went in place) so I'm sure that's why they went up. So I parked nearby, and collected all the signs. Well, this morning I was informed by my roommate that a police officer had stopped by looking for me, since whoever placed the signs issued a complaint. Apparently someone was around and got pics of me & my vehicle's plates. Basically, I'm to return the signs (I assume to the police station) or pay a $50 fine. No paperwork was left behind. The officer mentioned that this wasn't the only school district these signs were placed at, and that each location had people secretly guarding the signs for the express purpose of catching anyone like me in the act, and getting them arrested. Honestly, at this point I'm not even sure if the people doing this are parents who belong to this district. Either way, it's pretty frustrating given that I have family in these schools who I absolutely do not want to see get sick. I tossed the signs in my complex's dumpster, but I could still dig around to get them out. So while I do have an easy solution to this, I was curious about a few things: 1) Do I have any legal precedent to refuse to return these signs without significant consequence or fine? 2) If the signs are returned, is it legally expected of me to ensure they are in perfect physical condition? Thanks for any help. [link] [comments] |
Another resident towed our legally parked cars on private property. How do we get our money back? Posted: 14 Sep 2021 11:32 AM PDT We live in a large complex in Oakland, CA. Management gives us a new parking space. Previous person who parked there believes it is still theirs and calls a towing company to tow our cars. Management previously stated tenants are not allowed to call a towing company when another vehicle is in their space. Towing company has a written contract with management which states they can only tow a vehicle if someone from management is present and gives permission to tow. The other resident is not an authorized representative. Resident's signature is on tow autorization slip which also states towing company will not be held responsible for consequences of tow. Management has reach out to the towing company requesting copy of their contract, towing company unresponsive. Towing company violated CA Vehicle Code 22658: (l) (1) (A) A towing company shall not remove or commence the removal of a vehicle from private property without first obtaining the written authorization from the property owner or lessee, including an association of a common interest development, or an employee or agent thereof, who shall be present at the time of removal and verify the alleged violation, except that presence and verification is not required if the person authorizing the tow is the property owner, or the owner's agent who is not a tow operator, of a residential rental property of 15 or fewer units that does not have an onsite owner, owner's agent or employee, and the tenant has verified the violation, requested the tow from that tenant's assigned parking space, and provided a signed request or electronic mail, or has called and provides a signed request or electronic mail within 24 hours, to the property owner or owner's agent, which the owner or agent shall provide to the towing company within 48 hours of authorizing the tow. The signed request or electronic mail shall contain the name and address of the tenant, and the date and time the tenant requested the tow. A towing company shall obtain, within 48 hours of receiving the written authorization to tow, a copy of a tenant request required pursuant to this subparagraph. For the purpose of this subparagraph, a person providing the written authorization who is required to be present on the private property at the time of the tow does not have to be physically present at the specified location of where the vehicle to be removed is located on the private property. All we want is to get our towing fees of $1028 back. Do we proceed to file a claim in small claims court? Who is held liable? Thank you. [link] [comments] |
Posted: 14 Sep 2021 12:55 PM PDT Hello, I live in Northern California and 3 weeks ago, our apartment manger informed the community via letter that we had to remove our bbq's from our patio due to an insurance issue. Everyone is pretty upset about this because we all use our grills regularly. It also clearly states in the lease that we are allowed to have one, and we all think that changing this mid lease should not be allowed. The letter also states that we are allowed to use the communal grill but with covid causing back and forth restrictions, we don't always have access to the grill. Another issue is that we have no where to store our grill other than the communal garage. The apartment manager made it clear to us at move in (and it's also on the lease) that they are not liable for any lost or stolen items from the communal garage. So everyone thinks that if we were to move our expensive grills into the garage it would be open season. We are not sure what to do, because while we don't want to break the rules, we thank that the apartment manger is breaking the lease. We are debating just keeping the grill covered in our patio. But we are unsure of the potential repercussions and if it would be worth it. The wording of the lease specified that charcoal grills are prohibited but that propane and electric grills are allowed [link] [comments] |
Found hidden camera in bedroom I am staying in - Oregon Posted: 14 Sep 2021 01:38 AM PDT So a friend of a friend agreed to host me while I was passing through, but after staying with him for a few days I found a hidden camera trained on the bed (hidden within a clock - found the same one on Amazon). I panicked and got a hotel but took the camera with me. I know I should have left it in the room as evidence but can I still go to the police with this? Is it even illegal here in Oregon? The camera is wifi connected and therefore doesn't have any physical copy of the footage it has recorded, the recordings are probably on my hosts phone in an app that comes with the camera. Would love some advice on what I should do, kinda freaking out! Thanks [link] [comments] |
Previously sold car impounded and now stuck with fees Posted: 14 Sep 2021 11:34 AM PDT Hi! My brother sold his old Volkswagen Golf a few years ago to someone on the street saying they wanted to buy it for a few hundred bucks. Because it needed repairs, he sold it to him for cash and he filled out the DMV papers that said he sold the car. Not thinking, he didn't get the name or address of the person he sold it to and the person who bought it never went in to register the car and pay the fees. The car was recently impounded and he got a ticket and invoice in the mail saying he could owe around 2k in fees waiting for the inevitable auction. He's screwed because the person he sold it to has the registration so my brother can't take the car or do anything. He is legally held responsible for paying the fees as he was the last registered owner prior to the sale but he can't take the car because he can't show registration. We are in California, in case that matters. Are there any other solutions or is this just a hard lesson learned? Thanks! [link] [comments] |

Posted: 14 Sep 2021 11:33 AM PDT I live in South Carolina and I just found out that an ex is still in possession of explicit videos and photos (that I consented to taking) and has been showing them to others (without my consent). I went on a date with a girl I was interested in and apparently he's her roommate and he attempted to show her the videos when they first started talking about her moving in. I made him promise when he took the videos that he would never show them to anyone else, as I had dealt with a "revenge porn" situation when I was 18 and didn't want a repeat. He swore he would never show anyone. I had asked him to delete the videos when we split but according to my date, he has an app on his phone, like a vault that's disguised as a calculator, where he keeps the videos and you can't view stuff unless you know the correct code. She was furious on my behalf that he'd do something like that to me, and I'm furious too. I don't trust him to delete the videos and I'm not in contact with him anymore so I can't even reach out myself and demand that he delete the videos. Please, is there ANYTHING at all that I can do? I put my trust in this man and he betrayed it and I am so scared that he's either showing these videos to other people or that he might have posted them somewhere. My date offered to confront him about it herself and ensure the videos get deleted but what if he has them backed up somewhere? I know I put myself in this situation and believe me, lesson learned but do I have any options here? I'm not the only woman he's done this to; she said he has videos of her friend who he dated too. I just want to stop him from doing this to anyone else. [link] [comments] |
Texas apartment landlord refusing to refund security deposit and charging me extra Posted: 14 Sep 2021 10:38 AM PDT Hello, I moved out an apartment complex in Dec 2020 in Austin, Texas. Seeing as the security I paid wasn't a huge amount (~$200) it skipped my attention to claim it back from the landlord. There were some personal events (sickness in the family, switching jobs, moving to a new city) which contributed to my forgetting this. Anyway, end of July 2021 I receive an itemised bill from the landlord of the order of 1k, asking me to pay up a balance of $800. The items on the bill are mostly to do with cleaning (there's a general maid service clean, a bathtub relaying and some carpet costs). I went over the Texas property code in great detail, as I understand it - a) The landlord must send me an itemised bill within 30 days b) There can no be no deductions for normal wear and tear (and the onus of proving that anything is outside that definition lies with the landlord) c) Some provisions in the lease might supercede these, but my lease has no mention of them being able to use security for cleaning etc. The receivable department called me and I explained my position to them. They argued that - the 30 day rule doesn't apply anymore due to COVID, that they will send me photos and detailed receipts. After a month from this phone call, they sent me ONE photo of a very normal looking carpet titled traffic damage (?) and some receipts. Am I being taken for a ride here? What are my options? Posted: 14 Sep 2021 12:45 PM PDT I was married for 15 years to my EX, we've been divorced 5 months with joint custody of 2 children(son 11, dghtr 8) in Illinois. My EX got a Wild GirlFriend(WGF) during the separation. In June, WGF got drunk, and physically damaged the EX and his house. WGF was arrested and spent one night in jail(don't know the specifics of any crimes charged) The kids were NOT there. In July, EX took WGF, and my two kids to Florida for a vacation. On July 24th, the WGF became very drunk again. First she was just verbally abusive to EX and kids, then violent with EX. My son went out on the balcony yelling for help. Daughter hid under a table. Other families on vacation that my son had met on this vacation, called 911 and got my 2 kids out of the rental. While restraining WGF, EX received deep scratches and bruises to his face, arms and neck. The FL police took her into custody I called my EX immediately and he promised he was breaking up with WGF and "wouldn't put the kids at risk again" and would be more careful in the future. About a month later, I was with my daughter at her therapist when she admitted my EX has her still keeping secrets from me. This last weekend, they were at EX's for the weekend and WGF has returned. He then unfriended me on Facebook but one of his older daughters called me about the new pictures from the weekend with the WGF literally back in the picture. I've thought about:
I'm going to make a decision tomorrow and take action. Thank you for your advice in advance. [link] [comments] |
I had a judgement placed against me for a case that I have no involvement in. Posted: 14 Sep 2021 11:14 AM PDT So I'll keep this brief. In 2014, when I was 17, my family and I moved into a house my parents rented in NYC. They signed the lease, obviously I didn't because I was a minor. I was a known occupant of the house and met the landlord a few times. We moved out of that apartment in April of 2016 after several issues my parents had with the landlord. Basically my parents felt that she was neglecting repairs and didn't pay rent. The landlord sued them for nonpayment and my parents had a judgement placed against them and were ordered to pay her back. I was 18 at the time, attending college and preparing to join the military. I never got involved in the case, never corresponded with the landlord and never spoke to a lawyer or judge. Fast forward to a week ago. I applied to rent a new apartment. I've only rented one other appointment before and this new homeowner seemed a little more involved in his background check than I was used to. Ultimately another tenant caused him issues and I ultimately didn't take the place. Today however, I got a letter from the consumer reporting agency he used informing me that they notified him of a judgement placed against me. The judgement was filed in February 2016, around the time of my parents case. I'm named as a defendant and that old landlord is the plaintiff. The disposition is listed as "Judgement-Possession Only." I tried to find a way to look the case up with the number that they gave me but got no results. I've never been involved in any sort of legal proceeding so I don't really know how this happened and what to do? I assume this is going to keep coming up as I apply for apartments, and I'd really prefer if some dispute my parents got into 6 years ago doesn't impact my chances of finding a place. Can I legally advise my employer not to hire a person I know is a sex offender? Posted: 14 Sep 2021 11:07 AM PDT I work in a college. Lots of teenage girls. We are very short staffed and pretty much hiring any warm body that is willing to work for us. Today I saw a guy come in for an interview with my boss, he was someone I know (we went to school together). This particular guy has served time for rape, child molestation (of his own kids), and using social media to entice underage girls to have sex with him (he's 50). Would it be legal for me to quietly tell my boss what I know? We don't do background checks so it's not likely he'd look the guy up on the local sex offender registry. But this guy is NOT someone I would feel comfortable having working in a place full of young college girls even if they are all legally "of age." Or would it maybe be better if I just dropped a "hint" to the boss that maybe he really ought to do a background check on this person before hiring him, rather than outright telling him what I know? If I don't tell him, I can almost guarantee the guy will get hired, because he has the exact qualifications we are looking for. [link] [comments] |
Downstairs apartment neighbor let's dog pee on 1st floor patio, and the smell is overwhelming. Posted: 14 Sep 2021 09:54 AM PDT My downstairs neighbor let's their dog pee and poop on the patio. I've emailed and called to the leasing office to complain and little has been done. Its so bad that I've been woken up at 3 am of the smell wafting into my bedroom window, my window is directly above the patio. What rights do I have as a paying tenant and this situation? I'm not looking to get anyone in trouble i just want the smell gone so I can enjoy my balcony and not be woken up at 3 am. Edit. I live in Colorado BTW. [link] [comments] |

Posted: 14 Sep 2021 10:08 AM PDT As the title states, a device I use was recalled for potential hazards to the user. I was diagnosed with one of the potential illnesses associated with the recall. How do I locate an attorney to consult with and determine if I have a case. Obviously when I google I get paid ads for firms. I would assume I probably want to work with a large firm with a history of handling cases like this? Edit: I am located in NJ Thanks! [link] [comments] |
I’m going to foster care but what will happened there? Posted: 13 Sep 2021 06:17 PM PDT Please reply fast I'm probably going in an hour or so or tomorrow Age 15/ 16 in 3 months State: Minnesota TL:DR: My moms calling the crisis hotline team to put me in foster care what will happened next? One day I got in trouble for smoking marijuana and she punched me and beat me saying do you want to go to foster care I said no out of fear. Today I told her that I want to go there's a lot of things leading up to my decision, everyone's telling me I should just stay. She's saying she's going to call the crisis hotline and tell them are situation and then either take me to the hospital or have the police take me somewhere. She says it's most likely to go to the hospital. Will they put me on a 72 hour hold? What will happened next? Where will the police take me? How is foster care? What should I prepare for? I don't want to be on a 72 hour hold. Will she be able to tell the case manager and foster parent how to take care of me still? Because she says she will tell them how to and to not let me get a job etc. Thank you [link] [comments] |
