Posted: 27 Jul 2021 10:25 AM PDT In December 2019 I was driving on a major roadway (speed limit 65). Another vehicle in the lane to the left of me, going much slower than I was, swerved in front of me into my lane. I slammed on my brakes but still hit them. It was their word against mine. They said they'd been in my lane the whole time. My insurance paid theirs, I had to pay my deductible and I was ticketed for following distance. I tried to fight it and lost. My insurance also went up - I had a ten year safe driving discount that I lost. Now in a very weirdly shaped miracle of sorts I went to a new place to get my haircut and the stylist recognized my car (I drive a distinctive car). She was apparently in the lane to the left of me when the accident happened. The other car was in front of her and hit their brakes until they were only going 20MPH and then changed lanes to get in front of me. Her take on it was that they saw they were about to pass the exit they wanted and were in the wrong lane, so they tried to slow down (to not pass the exit) and change lanes fast to make it. She had a dash cam that shows all of this happening. Even crazier, she actually contacted the police back at the time it happened and they had her email the footage. They replied saying they would add it to the accident file and parties would be informed, but obviously I never found out about it and I still ended up with a ticket and all that. She still has the email convo with police and the footage. Obviously I feel vindicated to know I'm not nuts, it really happened the way I thought it did. But more to my question: is it worth trying to do anything now, like trying to get the ticket reversed or fight anything insurance wise? [link] [comments] |

I haven't received any phone calls or emails that they were going to evicted me. I come home from work to find out my room has been locked. I slid my phone underneath the door to found out my whole room has been wiped out. I called the cops & they told me what they did is illegal. I went to the main office to find out what happened and they were telling me it happened because I was in the wrong room ( they are 3 other rooms too, but all of them are empty) They blamed it on the system and that they were sorry & to send them a email on everything they threw out to see if they can fully compensate me. They threw away everything but besides my tv,Xbox, laptop, & my ebike. All my clothes, colognes,mini fridge, my social security card, my wallet that had my ID in it, many bracelets & chains GONE. Now they wanna charge me $200 for a room transfer even though I was never told i was in the wrong room till now. I lost many things that money can't buy. This is unacceptable. Here's what I can prove For reference, here are some pertinent photos of my arm and text screenshots. Here's what I can't prove My question for /r/legaladvice: Do I have any good options here? I am not the litigious type, but I missed out on $7,000 in unemployment during the three months I was out of work, which really hurts. I've only got $1300 in the bank, because I nearly ran out of money without the unemployment. And I ultimately took a job that I wasn't sure about as a result of badly needing money. So that's an unfortunate ripple effect too. My friend works as an employment lawyer, and told me that he feels I probably have a strong case for wrongful termination or disability discrimination. And he's promised to get me in touch with a friend of his who also specializes in employment law, as he obviously can't represent me himself. I'm not interested in lawsuits if they can be avoided. Really, I'd just like to get my unemployment money if at all possible. While I'm quite confident that I was fired illegitimately, and my proof should absolutely be sufficient for anyone on the street, I worry that I don't have ironclad evidence that would hold up in a court of law. I recently tried to move the amount to a hardware wallet; however, the transaction didn't go through but my balance showed zero, and next to my history all my transactions said refunded. I contacted them and they replied with: "Thanks for reaching out. It appears as though your account was showing an incorrect balance which is why this withdrawal did not go through. There was an issue with the original transactions and no bitcoin was credited. We can issue an ACH refund for your original payment. What is your bank account number and routing number?" They are offering an 800 dollar refund for what is valued at 17394.34 at the moment. I find it hard to believe there was ever an issue with the purchases. He has recently been assigned a different parole officer. This guy requires my brother to meet him every 3 weeks in person. The problem is that my brothers job requires him to travel 4-6 weeks at a time. The probation officer refuses to do it virtually and demands they meet in person every 3 weeks. Posted: 27 Jul 2021 03:25 AM PDT Location: Seattle WA I'll give some context upfront as it' a little involved. In general looking for the best way to proceed, but I do have some specific questions as well. My wife was ridding as a passenger in a car on a highway. A presently unidentified assailant sent a rock through the windshield and hit her in the head/shoulder. She was taken to the ER after this. There was severe bruising on her head/shoulder, but there hasn't *yet* been any long term damage discovered physically. She already had prior traumas, and is very mentally disturbed by the incident. I think it will take her years at a minimum to recover fully mentally, if she ever does. The blame is also complicated. There was no assailant identified the night of. However someone was arrested in the same place the next day. In addition to maybe this person being held liable, we are more thinking the city state should be held liable. There have been literally over 200 things thrown at/in cars from the highway in the last 2 months. Several people have already gone to the ER over it. It's a known problem that the city/state keep pointing fingers at the other on, and nothing had been done on it. They have been insisting the other agency is responsible for building fences/guards or something like that, but that hasn't been done. Since then they arrested that one man caught throwing rocks (only because that victim hoofed it out of the car and tackled them. Additionally, there is a *major* homeless camp above/next to the highway where this has happened. They cleaned it out around the same time as they arrested the other attacker. We'd really like to sue for damages... but I'm not sure how to go about it. Some specific questions: What type of lawyer should we be looking for? (Personal Injury I think?) Who should we be suing in this case? Assuming I can get multiple lawyers interested in taking the case, how do I best compare and contrast them to find the right one for us? What sort of payment structure would be ideal in this scenario? Should we be finding a lawyer who will take part of the winnings if we win, or should we just pay someone hourly? If the case is a slam dunk, I could probably afford around 5-10k in legal fees if it would mean a much larger settlement for us. She had been diagnosed a couple of months before with stage IVb endometrial cancer. The following 6 months she endured monthly chemotherapy, hairloss, and a major and life changing surgery. It was our introduction into the world of living with and trying to survive cancer. Since then she has experienced several recurrences, received several successful treatments, and traveled to several of the top hospitals around the country in search of something cutting edge, like the stuff you see on the front page of reddit from time to time about breakthrough therapies. All the time, my wife and I were beginning our lives together. We learned how to be a good husband and wife, she went to school full time to become a nurse, we bought our first home, and we got Millie, our puppy. All the time distracted by the journey of our lives that we were starting was the constant reminder of her persistently returning cancer. We needed to find our breakthrough therapy - one that could allow her to live her life finally free of this horrible disease. We participated in several clinical trials after countless hours of research and consults from physicians and patient advocates all over the country. We found it. She was enrolled in a phase 1 clinical trial of a Wee1 inhibitor drug. This type of drug targets a rare mutation of hers. This is what we've been looking for! We moved across the country and took the chance. We held our breath when they finally reported results after a month of therapy. The drug worked, and it worked very well. it reduced her cancer by 90 percent in just one month. She continued on the trial for several months. We finally started to see the future of our lives together unfold in our minds. We were able to conceive a life with this horrible disease behind us and not talk about the future with an undercurrent of apprehension. After all, we wanted to start a family. Suddenly she was removed from the trial. Phase 1 trials are designed to determine safe dosing, and Becca's was too high. Her platelet count was too low. Can she take a break? She can't make it through the night because we have to use a 60 mL syringe to empty the bile from her stomach several times from a NG tube that comes out of her nose. Shes listening to a loud podcast. It helps to have white noise over the sound of the pump that powers her TPN, or liquid nutrition, and soon I will have to wake her up to drain ascites fluid from her abdominal drain. Her cancer has taken up most of the space in her abdomen and is blocking her intestines. She cannot eat, drink, or even swallow her own spit. She weighs 85 pounds. The palliative care team keeps reminding her that she doesn't need to continue down this road if she doesn't want to, but she wants to fight. After all, she is only 35 years old. Despite the incredible amount of physical and emotional pain she is in, she will not give up. How could you when you KNOW there is a drug that will save her life. Her Oncologist is on board. She will create a treatment plan and safely administer it. The drug companies will not let her have it under compassionate use/expanded access despite "right to try" legislation that was signed in 2018. We don't know what else to do. We have called, sent letters, e-mailed, and pleaded with the drug companies to release the drug to us with no liability. Please, if anyone has any ideas for how to approach this, we have been through the Goldwater Institute, Mytomorrows, Widetrial. Does anyone have experience with this? Previous owners were renting it out, and one of the renters was running an LLC out of the apartment. I still keep getting mail meant for his LLC that I drop back into the mailbox for return to sender. When I google the LLC, I see the address still listed is my apartment. This morning a guy rings my bell and I open the door. It's a process server with a pack of legal documents. He asks me to confirm that this is my address, and he hands me the documents and walks away. I am groggy and confused at this point. I look at the documents and see it is meant for the LLC of the renter. I yell to him to try to get his attention that these aren't meant for me, the guy seems to ignore me and keeps walking. I do not want her to get this baby back, I watched him go through withdrawals when he was 5 months old. He is now thriving with me. He is now almost 19 months and this case continues to drag on. Our next court date is in October for a review, and I've just found out she was arrested for dui drugs this month. What should I do with this information? She is obviously not getting better but because this arrest took place in another county, I'm not sure either court would just know that the other case was happening. I had a client of my day job ask if I could do some metalwork when their other contractors fell through. I did what they asked and they said they were very pleased with the work, but after emailing them with the total bill they want to negotiate it down "since i'm not licensed or insured" and it was most likely illegal for me to do the work in the first place. They know that I do this purely as a hobby and never asked for any of this type of documentation before I started. I've never even heard of a "license" to weld, certification sure but I doubt the state would require an xray of a weld on a handrail. The insurance thing I guess makes sense, I probably should have that if i'm welding on someone's property. Is it worth talking to a lawyer over? The total is about $2000 over 3 weekends of work, which is a significant amount of money for me. KIA won't give me an estimate to claim in Class Action Suit Posted: 27 Jul 2021 10:49 AM PDT This all starts in 2017, when KIA issued a recall (Recall#: SC147) on 2011-2018 KIA Optima engines due to shoddy manufacturing which led customers to experience engine failure and fires after about 100,000 miles (as well as several other models of KIA/Hyundai with the same Theta II 2.4L GDi engine). A class action lawsuit ensued and KIA has settled and agreed to give customers hundreds of millions of dollars in compensation as well as provide replacement engines which come with a lifetime warranty. Now for my side of the story... I currently live outside of Atlanta, GA in the United States. I bought a used 2012 KIA Optima from a small dealership in North Carolina in 2019. The dealer mentioned the lifetime engine warranty (can't find documentation of this) in his sales pitch which leads me to believe my car was inspected by KIA and deemed an engine replacement unnecessary (the dealer also wouldn't legally be able to sell the car at that point if it had an active recall on it.) I'm now two states away from that dealer. Last week the car stalled out on me the highway. I was able to start it back up, but could only drive it at about 10 mph without a terrible metallic knocking and grinding sound coming from the engine. I limped the car straight over to my local mechanic, who told me the engine was done and not to drive it anymore. From there I got it towed to the KIA dealership for $250 and I have an appointment scheduled to have my car serviced on September 16 (I'm obviously not the only one having this issue). I talked to the service manager at KIA yesterday and he told me he won't even be able to look at the car to check if its eligible for a free engine replacement until at least August 9th-14th. Curiously, the last day to submit a claim as part of the class action lawsuit against KIA is August 9th. There in lies my problem. I have no receipts, estimates, or even confirmation of whether I will need to pay for repairs or not. Right now I have a receipt for $250 for the tow, but if I need to replace the engine that could cost up to $6,000 and in the meantime I need to rent a car for $40/day which also comes out of my pocket until KIA deems me worthy of compensating me $33/day according to their policy. I didn't elect to rent a car yet but I probably will need to if I won't have my car back until mid September. I also don't know how to put a monetary value on the inconvenience that all this has caused me or on the depreciation of value on my car, both of which are supposedly also covered under the class action, but I don't see a section for these types of claims on the claim submission form. A loss of faith in the car is also covered and definitely true to me, but again I don't know how to claim that or put a monetary value to it. My rental insurance covers up to $100,000 personal damage and up to $500 pet damage. I chose a low pet coverage because I have one 6 yo cat who is lazy and really just lounges. When filing a claim I chose personal damage because that is what it was. Well when my adjuster was talking to my apartment manager, she told the adjuster that it was all pet damage from my "large dog". I have never owned a dog and I have proof of this. There's no way this damage (mostly deep stains from my roommate always spilling things and not cleaning it up) is from a dog. So my adjuster is trying to get ahold of my apartment manager again to reopen the claim and she is now not responding. I also don't understand why the property manager would only want $500 from my insurance when the whole thing is covered. I don't normally go there but I was very pressed for time and my usual shop couldn't get me in. Last week my check engine light came on. Since my car is under warranty I brought it to the dealer for service. At the dealer the informed me the prior place left the oil cap off, which damaged the O2 sensor and left a hell of a mess. I had them fix it so I can get my car working again. I called the oil change place and they inform me they will not reimburse me for damages because I didn't bring it to them, and at the bottom of the oil change receipt it states something along the lines of failure to return to them voids the warranty and protects them from damages. I feel gross negligence (leaving the oil cap off) kind of makes all this moot, but I'm no lawyer. Can they really just not cover the cost of the repair because I didn't bring the car back to them? She saw the husband choke and beat his wife. Melanie told the cops everything and gave them video from her Ring camera that showed it. The husband got arrested. When the wife got out of the hospital or came back home she came to Melanie's house and assaulted her because Melanie called 911 even after they said not to. She isn't allowed to see her husband now. The neighbor had a bat when she did it. The wife also told Melanie her husband would do worse. The wife was arrested and she got bailed out. She can't go near Melanie but Melanie doesn't want to stay there. She has a broken arm. She wants to break her lease because she can't afford to move without it. Melanie's lease ends March 31, 2022. I was the only employee working for him and to say the least it was a very toxic environment. About a month 1/2 ago he was given "soft funds" from a company he does business with that was suppose to be for "marketing purposes" etc but, he used those funds to pay me upfront 2-3 months instead. Working for this guy has been a complete nightmare and I don't believe how he treated me was normal in any way, he had every quality of a terrible boss but, other issues even on top of that so I was planning on quitting once those funds ran out but, the other week he completely went off the rails and I really had no choice but to quit so now I'm trying to figure out how much I owe this guy back. I messaged him after I quit saying I understand I will need to send some of the funds back and agreed to it, and would do so once I get the funds out of my broker account which takes 5-10 business days but, even after that message his been blowing up my phone relentlessly with threats, name calling, telling me if I don't pay him back all of it right today (which was last Wednesday the day I quit) he's going to press legal charges against me, etc. I'm not to concerned with the threats because I don't believe I've done anything wrong. I agreed that I will need to send some of the funds back and would do so once transferred to my bank account, and once I calculate what is actually owed back to him. [TN] Alamo Renter hit my car, said he purchased insurance, Alamo denying claim Posted: 27 Jul 2021 06:48 AM PDT My car was hit by a driver that was in a Alamo rental car back in early June. The driver refused to provide any info other than the VIN and his name. He said he filed a claim with Alamo. Fast forward two months and I have contacted multiple times and Alamo has denied my claim as he did not purchase the renters insurance and refuses to provide the drivers info. Because I only have a name, what are my options? I just want to get my car fixed. Alamo has told me that the driver had no personal insurance. The car has to have insurance to be on the road. Alamo is citing laws stating they aren't responsible. Please help. There was no police report as it was on private property. [link] [comments] |
