    This past weekend has been a whirlwind. There was a few meetings with everyone in my position and we couldn't come up with a group consensus of what action to take.

    So I'll just be taking care of myself and trying to help my coworkers as best as I can. None of us have signed non-compete agreements so I've already taken a position with a different company with better pay. Most of my coworkers are also leaving this company for greener pastures (there are only 11 of us. 10 of us are planning to leave) Additionally, many of our patients and group home owners are seeking different companies with more stability in their care provided. I don't know what the financial fallout will be but it looks like this decision will cost the company far more than they bargained for.

    Thank you for all the advice last week. It felt incredibly empowering to have those few extra details that you all provided.

    Can I sue print shop for selling my intellectual property?

    I ordered 20 prints of my own personal artwork from a local print shop. I got an email saying that my prints were ready, but I couldn't pick them up until a few (4) days later. Maybe I should have sent an email back saying that it would take me a few days to pick them up, but I didn't find that necessary (don't know print etiquette, never had prints made before).

    I checked my email last night and I saw a 2-day old email from the print shop reading:

    "Sorry, I give you 2 days to pick up the print job, After that I think I have your permission to sell the artworks online."

    NOT ONCE DID I GET A TIME FRAME FOR WHEN I COULD PICK UP MY PRINTS.

    I went to the print shop this morning and the owner told me that he has already sold one of the prints online.

    This is my intellectual property, right? Can I take legal action? I was planning on selling these prints of my art but because I didn't pick them up within a time frame I was ENTIRELY unaware of (trust me, I scoured my emails, there was nothing said about a time frame) but now this guy who I trusted to perform this service for me, and who I was intending on paying, is taking my work and making a profit off of it.

    Someone please help I'm so upset :(

    [MD] Can I be forced to pay for private school for my kid?

    My ex and I have a child that has been attending public school up to this year but she has decided that he should attend private school and apparently she has been meeting with the new school administration and even notified his current school that our kid will not be returning next year.

    Our parenting agreement says that we both have legal custody, with the tie-breaker going to her if we fail to reach and agreement after a "good faith attempt at compromise". But she's just informing me after the fact and I've let her know that I don't agree with this move for many reasons (the cost is one, but not the only one).

    Our parenting agreement already took care of the child support amount and I intend to keep paying that. Am I also forced to pay for half the private school cost? There's nothing in the agreement that addresses that particular matter.

    Apartment caught on fire after I reported multiple times their dryer wasnt working correctly.

    I'm a renter of an apartment in Utah. I was having problems with the dryer and asked management to fix it. The first time they didnt show up so I went a 2nd time to report it and that's when they came. The person fixing it after seeing it said he would order a piece to fix the dryer but he never came back. Then at 10pm saturday night the dryer all of a sudden burst into flames filling the entire apartment in smoke and burned our clothes. We called the emergency line after this all happened and when we asked to get the dryer out for safety concerns they told us "we will not take it out until monday and if you take it out yourself you'll face consequences". We told them the smell of smoke was all over the apartment and their response was "I cant do anything about it". Is there anything I can do about this such as suing?

    Court TODAY! Need advice ASAP. [VA]

    Petition for protective order [VA]

    So to preface, the father of my child was just handed a 2 year "sentence" (2 years probation and anger management) I guess you'd say of the first offenders program for strangling me, he had two charges, one being strangulation felony and two being DV charge.

    That was last Tuesday, last night we argued (over text) and his mom also texted me arguing with me, all of this occurred around 2-3 am. Before that I have videos, pictures, texts proving I was home.

    I say that to say, today I was served with a petition for protective order by him, that states "I was there at his house uninvited and threatened bodily harm."

    This is not true. I have proof, and witnesses. He also is petitioning for custody of my child who he hasn't seen since she was 2 months old, and she's 1 years old now.

    I say all of this to say, will he get in trouble for lying when I show my evidence? What are the chances of it being granted if I have proof he lied?

    Mortgage holder made unauthorized improvements to house

    My dad passed away recently in Florida. We are waiting on everything to work through probate. In the meantime, we found out that the mortgage holder (privately backed) took it upon themselves to make improvements at the house, because I think they thought they got the house on death (whoops). They put in new carpet, new bathroom fixtures, painted, some other stuff.

    I guess my question is what are my obligations to them? They're mad now that they've learned I want my dad's house. Why wouldn't I?

    Seller wants groundwater royalties in Texas

    Hi,

    I'm currently attempting to buy a piece of rural undeveloped land. I intend to turn this land into a ranch where I can someday build a home, not planning on anything commercial. The seller has asked for "50% groundwater royalties."

    What does this mean? Does that mean they have rights to the actual water or only profits I make off of the groundwater? If I agree to this and later decide to sell the land, would I have to transfer the original seller's rights? Any help is appreciated.

    Right of way easement

    I have a property in New Hampshire that has a right of way easement over my neighbors land. It is his driveway that I need to access my garage and parking, probably a 50' section of pavement.

    The driveway has been in disrepair and is now at the point of vehicle damage if used.

    The neighbor has given me the run around every tine it has been brought up. I have received several quotes and it's always "his guy" that will look at it.

    I have gone as far as to offer to pay for half.

    What requirements are you held to in maintenance on a right of way, what is the best course prior to hiring an attorney?

    Crazy neighbor... sprinkler and trees

    I'm in Oregon.

    We have a very small backyard... like 6 feet deep. Our neighbor behind us has a normal sized yard 20ish feet deep). They planted a large tree right up against the fence. It is growing over our roof and we need to get it trimmed.

    When it was smaller, we were able to trim it ourselves but now it's too big and my husband can't do it himself. We previously asked if they would have it trimmed when they trimmed their other trees (they have people regularly working in their yard). The guy just walked away. We assumed maybe he didn't hear so we were going to follow up with him. They aren't approachable and I hate confrontation so have been putting it off.

    Well, yesterday, my son was outside in a lounge chair reading a library book. He left it outside while we picked up dinner. We got back to find the neighbor had placed her sprinkler up to the fence and was blasting our tiny backyard. She does this frequently but ive avoided confrontation previously. We just go inside when she turns on the sprinkler. Well, this time we weren't home.

    Luckily, the windows were closed but the library book my son left is soaked. Over the fence, I asked the neighbors who were outside to please turn the sprinkler down or move it away from the fence as it was getting our yard wet including a library book. I thought they didn't realize it was hitting our house. They didn't respond. I though they didn't hear and said "Did you all hear me?" The lady said that she had heard me. That's where it got really strange, she said she wouldn't turn down the sprinkler, it's just water and my kid shouldn't leave stuff outside in our yard. I asked if she could give us a warning so I could make sure our windows were shut and nothing is left out. She said she wouldn't do that. I asked if she could look over the fence herself to check, she said no.

    I told her that wasn't being very neighborly. She told me she was done talking to me. She then started accusing us of cutting out the middle of her trees. I was really confused and then asked her if she was talking about this other tree (she planted another too large tree right against the fence) and the branch that had broken off in February. We had this horrible ice storm. The branch broke off and damaged our little potted pear tree. It's very clear that it broke off... it's all jaggedy.

    She's like no, I don't mean where it broke off, I mean where you cut it. I then said no, it broke off but while we are talking about tree trimming, we want to have the other tree over the roof trimmed though so if you want to have your guy that you trust do it, that would be fine. Otherwise, we will just find an arborist.

    She told me to stay outside talking to myself and went in.

    Legality surrounding buying items from thrift stores, completely revamping them, and reselling?

    Would any big clothing/toy brands be able to pick a bone if their product was used as a base model, washed, cut up, changed, and given a whole new life - just because their product was the baseline?

    I would be charging for my hours and creative expression in revamping the items, and partial profits would go back to the organizations or charities the items came from. I have no intention of abusing their label, in fact I am heavily considering stitching one of my own onto the end-products. It is a very wholesome-intended project, so I don't want to step on corporate toes.

    Update: Two teens had consensual sex-UT

    I didn't get a huge response but I thought I'd update just in case anyone was curious. I instructed my kid to not answer any questions if they were pulled out of school and to say they wanted me present. I advised their partner and their mom to say the same.

    About two weeks after the therapist made the report to DCFS/the police, I was contacted by the police. They had spoken with partner's family who stupidly confirmed it had happened. I never confirmed that sexual contact took place. I said that I was closely supervising my child and that I did not feel like they were in danger of being victimized. He told me that they would go forward with the investigation if I wanted. I told them I didn't think it would be a good use of public resources and that there could be no possible good outcome if the police got involved. He reluctantly said that if that was how I felt, he would close the case.

    It's been a week, and I haven't heard anything since, so I think that nothing more will happen.

    Was presented a Notice to Vacate by my landlord as a required document to move out. We are not terminating early, just simply not renewing our lease and moving out. Can they really force us to sign this as notice I’m moving out? NJ

    I screen shot my lease and sent it over to the property manager to let her know I don't feel comfortable signing this additional document as we're not in breach of lease and are abiding to terms of termination (written notice we're not renewing). Of course my email got forwarded over to their corporate attorney stating I'm refusing to sign the document and am being difficult.

    The document includes a lot more terms and responsibilities than our lease. I've successfully held and terminated leases in various states and have never dealt with this.

    Can they really force me to sign a document their calling Notice to Vacate accepting more responsibilities as I prepare to move out? TIA

    [FL] family’s home ruined by two companies; now contains deadly toxic gas

    Not sure to go about this, but here's the story:

    Family lives in older home in south Florida. They had a leak in their roof and decided to get a new roof. They hire a roofing company who tells them that they should be able to stay in the house while they work. Family decided that it's too noisy and spent the day out and about. Mom and dad come home, say the house smells like fumes, and they stay at a cousin's place.

    They let the house air out, but the smell gets so bad that you can smell it from outside. City official comes and says that he can not legally say whether or not he smells it, but does take note of his findings. The family sends air samples to a lab.

    Roofing company gets aggressive and defensive and claims that the smell is coming from dead birds. Pictures taken, no aforementioned birds on house property.

    Family hires a professional cleaning service to remove the smell. They spray some kind of chemical to mask the smell over several days.

    Air sample 1 comes back from lab. Toxic petroleum comes back positive. Not safe for human residence.

    The family returns to the house, and the toxin is amplified by whatever the cleaning company sprayed. Goes back and forth for weeks with them to no avail. Sends off air sample 2.

    Air sample 2 comes back, toxins are so dense that it is unsafe to even enter the home.

    Now the family, after paying for multiple services to try to fix the problem, has no where else to live by the end of the week, and is facing homelessness.

    Any help, legal advice, etc. is appreciated.

    Newly Hired and Haven’t Filled Out Paperwork

    Hi, sorry In advance if parts of this doesn't make sense, this is my first job and I'm not even sure about things. I have a few concerns, with my newest one being about tax trouble. I don't want to say my exact location in case this some how gets to my employers but I'm within the Brandon/Riverview area of Florida.

    I'm a waitress in a small business restaurant, I interviewed April 15th and started my first shift April 24th. During the interview I was promised 4-5 works days a week, $5.80 per hour plus tips and then $10 for every hour I didn't make enough tips. For clarification this means that if I make less than $8 an hour the restaurant would pay $10 instead of the $5.80. The pay was the biggest reason I took the job because it was the best pay offer I received.

    My first week is over and I have some worries. Instead of the promised four days I only worked three days and was scheduled only two days this week. My manager tried to change the pay I would get, I.e instead of $10 for every hour not tipped I would get $7.50. A store policy is that workers must have fifteen hours of training before the work alone. I only got four hours and was left alone my first two days, I admittedly made some mistakes and my manager threaten to write me up/possibly fire me for "negligence". Now to be clear, there was never a contract signed that I would get the hours and pay promised to me so I'm not sure what I can do in regards to that. My friend said I could seek legal action because I'm not getting what was promised, but again no contract was ever signed.

    Now comes my most recent and biggest concern. I haven't filled out an I-9, W2/W4, or ANY paperwork whatsoever. My management never brought it to my attention and I only just realized I was supposed to fill out this paperwork. I've contacted management about three times about getting the paperwork done but they've just brushed me off.

    This is my first job ever, I've never done taxes. I'm scared that I will get into legal/tax trouble if I do not complete these forms, but I'm not sure what to do since management will not even listen to me about this. There's no HR department so I have no idea who to bring this issue to.

    Can anyone explain the legal trouble I could face if I don't complete these forms? I'm only 18 and still in high school, the last thing I want is to get in trouble. Also, is there anything I can do about not getting the shifts/pay I was promised?

    Condo Association removed Mail Box

    Good day,

    Our Condo Association (in Florida) removed our mailbox. We had the box for years but recently started renting out. So we don't receive mail there. We were asked if we would be willing to remove it for another owner. However we declined because 1.) We wanted it if we were ever to stop renting (we have lived there 6 months out of year in the past) 2.) ONLY 1 person lives there long term out of 60 residents.

    I just noticed that our mail box has been either removed or the numbers changed to reflect another condo. We've also had issues with a board member who's a retired real estate lawyer/prosecutor regarding mundane things. I'm just going to say it... he's a complete dick. We believe he's responsible for this and would have made sure it was in his legal right to remove/modify it.

    The one neighbor who lives there purchased the Mail box 6 years ago specifically for us and we re-reimbursed them.

    So our mail box has been removed/or changed without our consent.

    Can they do this? If it's federal property what right do they have to either remove it or change the numbers on it?

    Child protective services called over 30+ times and never found anything. Yet the mother hits the kids, her brother tried to feed them perks and they know about these and do nothing. Yet still threaten the father regularly. How can a man protect himself and his children under this legal system ?

    Dilico is the child protection sercives in Canada if you are native. They have an aweful track record, sickening how many kids die in thier care with no accountability. And i am well aware of how bad the system is for fathers, that is not new information.

    My question is this. I have two friends with similar situations just at different stages. The mother calls the CPS to report things that never happen , workers show up and get aggressive with the father. Sometimes it will be the cops going nose to nose the second they get out of the cruiser. "I know that you are clearly the problem here!" Buddy is 6/2 and 300 lbs. Everyone trying to be tough picks a fight with him. He has never done anything wrong to his kids. The other side, the mother used to slap/hit her kids in the face until they were old enough to report her. Still nothing happened. Her brother snorts perks in front of the kids, tries to get them to do them regularly while offering to "take care of thier father". "Sir we are aware of the situation and cannot comment on another case." Is this not his case? How is he under investigation all the time never to have anything found and yet laying out the facts on the other side and nothing happens. For 15 years its been like this and now i have another buddy just getting started in a very similar situation.

    How can these guys protect themselves and thier kids from a clearly abusive and manipulative mother? What steps can one take in these kinds of situations?

    My abusive ex murdered his husband and I have evidence that it was premeditated.

    My ex killed his husband. He abused me for years and tried killing me multiple times before I finally got away from him. I helped in the murder trial but the investigator wasn't thorough enough. The trial is over and he has been sentenced with lesser charges than be deserves. There was no proof of premeditation.

    Now it's been over a year since the trial and his cousin has come out to me with guilt that their family forced her to hide evidence that he told her he was going to kill his husband the day before the murder. She also told me that he asked her for a hook up on drugs to drug his husband before murdering him which is what happened. After she came out and told me this and that she wanted to make it right I contacted the investigator and told him everything she said to me. The investigator told me it's too late he's been sentenced and it doesn't matter if new evidence comes to light.

    My concern is that multiple family members coaxed her into hiding this evidence and they kept her away from all of the trial to prevent the evidence from coming out. They all knowingly lied. How can I make this right? I feel they should all be convicted of something including the cousin. Not only could she have prevented a murder but she willingly kept information from the trial to protect the murderer. Who do I contact with this? It was all on messenger so I have screenshots of everything she said to me. Should I try to contact the original prosecutor or someone else? The investigator didn't seem to care that evidence was hidden. Knowing what I know keeps me up at night.

    Neighbor with alz keeps trespassing on my property

    My fiance and I recently bought a house, and one of our neighbors next door is an old woman who definitely has Alzheimer's or severe dementia. She is stuck in a mental state where she thinks we purchased our house from her son or grandson (we did not, we confirmed the previous owner had no relation to her but determined that the same person used to own both properties in the 80s and 90s). We are in the process of moving in and whenever we come over to bring stuff to our new house she comes over to introduce herself to us. The gate in her fence opens to our side yard and she will walk across our front lawn to greet us. We have introduced ourselves about 6 times and she doesn't remember so she continues come over to meet us. Yesterday, she walked around our property to find us when we weren't outside, I saw her walking around our front yard through the window.

    I contacted the police for a wellness check, because she told me she lived alone and they came over to tell me that there's nothing they can do and I have to contact DSS. I contacted DSS non-anonymously and requested an update on her case and haven't heard back from them. I'm assuming there was nothing they could do for her, so I hope at least she has someone coming over to care for her.

    It's become a nusience, as I don't want to keep having the same conversation with her every time we go to our house. We have to avoid her because it's hard to get rid of her and get her to go back once she starts talking, and she will also just stand by her fence and stare at us. I was wondering if there is any legal action or other measures we can take for her to stop harassing us. We live in South Carolina.

    Can my employer voluntarily resign for me?

    I'm in NY if that matters. My employer recently notified me that they will be cutting my pay by 50% due to budgetary constraints,my responsibilities and duties will remain the same. I responded with a formal letter simply stating I cannot accept the changes to my employment. I asked them how they would like to proceed. My employer responded over a week later that in response to me not accepting their offer they are tendering my voluntary resignation effective this next week. I never resigned? Can they voluntarily resign for me? I feel like if they want me gone they should be laying me off? I am just confused. Any help would be appreciated!

    Etsy and fake DMCA counterclaims

    Hey guys! I'm hoping that I might get an idea on how to move forward with this. I'm in Utah, however, I believe that the offending party is a content farm in Vietnam. The situation is online involving Etsy.

    I'm an artist, and I sell my designs on tshirts and mugs online. I have tried watermarks, low quality images, and the like, but no matter what my designs are stolen and reposted to a third party printer by Vietnamese content farms. (Sometimes even with the watermark still on it lol) They are all the same, and they are easily recognizable when you pull up their shops and see all their bootlegged designs.

    That, I can deal with. I typically just file a DMCA claim and move on. The issue I'm now running into, however, is that they have started to file counter claims against me using false information. I know it's fake, because the email never matches the name, when googled the people they claim to be have nothing to do with design or art, and of course, the knowledge that it's my design and they don't have a right to it.

    Etsy has washed their hands of the situation, and said they can repost the content unless I file a court notice to them. Their advice was to "get in touch with the other party" or file a court order.

    Now I'm at a loss as to what to do. I can't file a court notice against a fake person. I can't reach out because the emails are always just throwaways. I don't know if it's worth retaining a lawyer because without a real person to file against it seems like a pointless effort. It seems that Etsy is just allowing this theft and I'm helpless to prevent it.

    At this point, I just need help determining a next step and if this is something I can retain a lawyer for. Taking it one step further, is this something Etsy can be responsible for since they aren't really making an effort to prevent IP infringement.

    Real Estate Agent Demanding Commission for Improvements on Lot

    We signed an exclusive brokerage agreement with a real estate agent (tied to just one neighborhood) when we were looking to purchase a resale home in a neighborhood (State of GA). The agremeent says that she gets a 3% commission which typically comes from the seller (standard GA form F110).

    The agent showed us a few homes, and we made an offer on one that we lost to an all-cash buyer. While we were negotiating that, the remaining inventory in the neighborhood went under contract. The agent encouraged us to look at lots and think about building.

    We looked at lots that she showed us, and liked one. I told her I'd need to do some due dilligence before making an offer on the lot.

    • I said I'd need to speak with a builder or two to ensure that I can build a home on that lot that meets the requirements of the HOA within our budget, and she immediately offered to introduce us to a builder who had built other homes in the area
    • I said I'd need to find an architect, and she made that introduction so I could go meet with them and the builder together to ensure we were all on the same page
    • We found a banker (recommended by the builder) who pre-qualified us for a construction loan

    After I spoke with all of those folks, we made an offer on the lot with a 30-day due diligence period to investigate the above through the agent. Offer (and our brokerage agreement) says that she gets a 3% comission coming out of the seller's proceeds (she also happens to represent the seller). We were good with this and to this point I was very pleased with how helpful our agent had been to make us comfortable buying the lot. I knew that she wouldn't make as much comission, but given she worked in a sales office with the developer of the neighborhood and assumed she was comped otherwise.

    A week after we were under binding agreement to buy the lot (we're still under due diligence), the builder submitted a rough estimate which included a 4% commission on the construction costs of the home due to the agent. I was shocked and called the builder who said that was between me and the agent, as that's just what the agent told him. I called the agent and she's claiming that our Brokerage agreement doesn't specify new vs. existing home, and the 4% was a mistake and they'll honor the 3%.

    I also noticed that she checked the box on the Exclusive Brokerage Agreement saying "the following are types of relationship NOT offered by the broker" [x] Dual Agency... even tho she's representing the seller of the lot and us....

    I am pretty shocked about all of this and told them that whatever I do with this lot is our own business and we only owe them for the property itself. I then got a directly worded formal letter from the agent's Managing Broker claiming that me entering into a contract with a builder without representation is breaking our Brokerage Agreement and that we'd still 'owe them a 3% commission."

    The builder and our loan officer all say that's not what's covered by the standard brokerage agreement form and this is not standard practice (and that we don't need an agent for the builder contract). How much risk am I under that if I proceed, that I'll get sued by the Broker... and how firm of a stance do I have to defend myself without spending a ton of money litigating/arbitrating this? Should I just walk away from it all and come back in 120 days after the expiration of our brokerage agreement (which we really don't want to do as we'd likely lose the lot) to avoid expensive legal issues?

    Renters right in Texas | Landlord violates signed lease before move in

    So I signed a lease about a month ago for a move-in in June. But now the landlord calls and says that they planned to upgrade the apartment that I signed for (The lease is already signed and done). They say only option for me is to pay more for the upgraded apartment or transfer to another unit in the first floor (which I don't want to). I'm kinda pissed because I had everything planned and excited about moving in, but now they just ruined the plan. Should I take legal avenue and sue them, if I can? Not sure about what else I can do.

    Update:
    My girlfriend went and yelled at them in the apartment office! They agreed not to upgrade the apartment and keep as it. #problemsolved. Thank you guys!

    My dads wife/girlfriend is trying to relinquish our rights after his death

    Toronto Canada gyal here! Hello! I really hope this reaches out in time because in three months i may be too late. There is no will to start off. My father passed away on February 14th in fenelon falls. Since then, his wife or girlfriend (i have no idea if legal separation was involved) is currently living in his house. Not sure if they had a prenup either. We have asked to visit and she denies "because of covid" I know the house is not under her name but under my dads. She barely has anything under her name at that property. We only wanted to go to separate ashes and as well as taking some memories with us( that as kids, we should be entitled to.) She told us that theres a paper being sent to me and my brother's about the estate and that letter "could take a year to be processed and sent" but i think that's bullshit. I believe shes trying to hold it off so in time if we don't say anything to the government she will take everything. She doesn't have any good intent. I'm being told in 3 months that my rights as his child can be taken away if i don't step up in court. It apparently takes 6 months after death for those rights to be given up as far as a lawyer has told me. I don't know how to apply to legal aid for help so i hope someone has an Idea.. Stressful situation.
