Posted: 06 Apr 2021 05:55 AM PDT So my company sent us an email last year that said if you hit 100% of you goal you get $250. 105%=$500, 110%=$1,000 per quarter as long a few other criteria are also met (no disciplinary action etc.) I got 250 the first quarter, 1k the second and third, and I should've gotten 1k for the 4th which ended 12/31/20. In March we were told they were laying out the Q4 incentives. They pointed to a line in the email that said "manager discretion may apply" and said "bonuses are never guaranteed" While we all called them bonuses, the email called it an incentive and under the FLSA it would fall under the category of a non-discretionary incentive. I gave all this information to HR in the form of dispute resolution and they said they showed it to the "right people" and nothing was going to change. I've gone through every channel the company has and they still won't pay it. This affects several hundred people in our company. I want to take this to class action before they roll out an arbitration agreement. I contacted a few local lawyers and they say they think I have a case but it's not for them. I'm based in Ohio but the company is in every state Edit: let me clarify. There is no verbiage about how the company performs etc. With it being such a large company I was surprised. From what I have learned maybe 4ish levels up in management made the decision and pushed it out without running it by legal then later found out that they shouldn't have but didn't cancel it either. They actually continued to push it and only told us that the incentive program the next year would be different. So I was rudely surprised last night to find out my entire account with Bank of America had been wiped, for a "Debit Hold 04/05". Every last dollar and cent I had was completely gone. After frantically calling the bank I found out it was due to me being served from a law firm in Texas for $98,000 + my $3k tax return, due to owning a company out there (which I would have started when I was 6 years old... 🙃) that was debited from my account. I have never been to Texas, I have no family in Texas, I dont even know where Houston is on a map lol. So thinking that my identity had been stolen I called the cops and filed a police report. They were pretty shitty at handling it as there was not much information surrounding why I had all of that taken out. I waited about an hour or so and the police called my mom to inform her of someone with my exact name (one initial off, our middle name) in Texas, who owned a business by the name mentioned by BOFA, and had started the business on my birthday, Jan. 24th, about 16 years ago. (I am 22) I dont know how at all this happened but after speaking with the law firm they are saying that it was no fault of theirs but BOFA made the mistake. Now here is the kicker, BOFA wont release my funds to me for the next 3 days, even with proof that it was not meant to be debited from my account. I have my stimulus check coming in tomorrow and was told it will be garnished due to the hold on my account, and this also now preventing me from gaining unemployment income, as this has halted the process of my reapplication. Our social security dont match, our middle name is different, shes 44, im 22, she has a different account number, she lives in Texas, I in Georgia, and birthday is 12 days apart. All differences. Yet even with all this information BOFA wont give me back my money. Due to me thinking it was identity fraud I had to freeze all my accounts including my credit and cancelled my credit card. I have no income now for the next 4 days due to NO fault of my own. Bank of America has been no help in regards to this and this is all falling at a horrible time. I am currently with no income at all. I need any and all legal advice. Posted: 06 Apr 2021 12:17 PM PDT Today, I looked on Facebook to a claim that a video of mine of the Supermoon in 2016 was violating the copyright of UMG, which I believe to be Universal Music Group. The beginning of the video has a copyright symbol with my name on it, and as the moon drifts towards the text it fades away to not cover the moon and detract from the video... it appears UMG has cut the portion of the video with my name on it, and used the rest for some form of content - and are now claiming that I'm violating their copyright by having it on my Facebook page. To be clear, this is a video I took in my own backyard with a camera lens I made myself from a modified telescope... and it appears they may have stolen the video from me, and are now claiming I'm the one who violated copyright laws. I've put in a dispute with Facebook, but I'm pretty angry that my video may have been stolen without my permission - especially one that I went out of my way to put a copyright text on. Any advice on what to do would be helpful. Update: I'm in Pennsylvania, USA, sorry for not including earlier. Posted: 06 Apr 2021 03:15 AM PDT I sold my recently deceased Grandmother's 1996 Toyota to a Wisconsin resident through power of attorney. The buyer told me he was buying it for his friend who was in desperate need of a car, so I gave him the title signed and dated but did not make him sign it. I had him sign a bill of sale saying I sold it to him for my grandma, and it said as is, with no warranty. We then brought the car to a shop where supposedly his friend was getting his car towed and would get it from there. Nearly 3 weeks later the guy who bought it from me called me, and he is claiming I must buy the car back from him because it has a small exhaust leak, and the shop will not work on it because they found the catalytic converter was removed at some point. He claims it was illegal to sell the car without it, and is threatening legal action. He also said he has not even signed the title and done registeation yet after almost 3 weeks having the car. I did not disclose that the converter was missing, but I was not aware of it. There wasn't a check engine light on to indicate an emissions issue either. Am I responsible for not knowing that the car had the catalytic converter removed while my grandmother owned it? Does the buyer have any legal grounds to bring me to court over this? Update: went and peeked in the window today since I know where it was sitting and the buyer put over 2000 miles on it since I sold it. Thank you all for your input. Trust says we all three get equal parts with majority rule for discrepancies. Phoned my bro and found out my sis went to probate court without notifying me, lied and told my brother I approved of that move and got him to agree as well. The lawerys said they sent my court paperwork in the mail but my neighbor had told.me he saw my brother in law snooping around my house when I was gone at work on several occasions. Long story short I had a lawyer tell me my paperwork supercedes any probate stuff she has done so I'm not going to be evicted. House sells we divide up and have a trust account we all have access to and all deposits and withdrawals are recorded. Now her lawyers are suing us claiming we miss appropriated fund etc but the jist is that her lawyer is trying to get my brother and I to pay all of the attorney fees she has accumulated so far. We have never used her attorney's services and I informed her lawyer ion several occasions that any legal fees by each member of the family are to be paid by that person and my brother said my sister initially agreed to that. Posted: 05 Apr 2021 09:38 PM PDT TL;DR: Went to a dealership to buy a SUV. Price was $15k over what was advertised and told to me over the phone. I did not buy the SUV. How can I hold the dealership accountable? So, a SUV I have been looking to buy popped up on Autotrader at a dealership about 2 hours away. The price was exactly in my range, which was super weird because it was literally brand new. This car retails for an easy $45k and it was priced at $34k on Autotrader and $37k on the dealership's website. I sent an inquiry on Autotrader and they called me and told me the price ($34k) on the phone, and told me the price expired at the end of the month due to the various deals. This was March 26. On March 27 I called the dealership again and confirmed the price, minus tax, title, and fees. I was told $34k was the price. On March 28 I did the same thing. Called the dealership, confirmed the price minus tax, title, and fees. $34k is the price. I even asked why their website was $3k more. They said that they could do $34k. I made an appointment to go to the dealership (120mi away, so 2+ hrs of driving) to look at it, and brought my brother along (4+ hrs of driving for him) so that they did not screw me over. First of all, walking in I was treated like a bag of money and the salesmen were foaming at the mouth with dollar signs in their eyes. I guess they saw a stupid woman who had no idea what she was doing. Red flag #1. After getting to the dealership, they of course got me with the paperwork on my trade-in asking me to "evaluate" it and started the "What do you want your payments to be for your new SUV?" which was huge red flag #2. They of course brought me outside, before my brother arrived, and started explaining to me all the stuff the SUV had including all the dealer options. I told them they would be removing most of that because I did not want it (locking lug nuts, nitrogen in the tires, paint/fabric protection, dent protection, $600 to tint two windows, etc.) and I was told that it could be negotiated. I was told my trade-in was valued around $5.5k, but "we can probably do $6k since we are low in trade-ins". After having a test drive, the salesman told me that the sport mode on the SUV made it heavier. Literally that it added weight to the car. I might not know an extensive amount about the mechanical workings of a SUV, but I know that isn't possible. After the test drive we took a picture of the window sticker, which had the base price of the car around $41k, the added options (heated front/rear seats, moonroof, premium paint color) added $3k, and the dealer options were $5k. This was now a $50k car when I came in being told it was $34k. We finally get the paperwork brought to us pricing out the car, and of course it is nowhere near $34k. After tax, title, fees, and the dealer options it was well on its way to $55k. I told them I came in to finance $28k on the car (which was the price online, minus my trade in) and that's all I was paying. We finally got them to take almost all of the dealer options off, and including my trade-in the price they gave us was around $41k. My car had magically now been valued at $4.5k. I finally said if they couldn't finance for $28k including taking my trade in I was going home, and they said there was no way they could bring down the price that low. After I had verified it three times on the phone with him and two other salesman. That was Monday, March 29. On Thursday, April 1 I got a phone call from them asking if I was still interested, as it was a new month and they wanted to make a sale. I basically said go fuck yourself and hung up. Afterwards, I checked their website and Autotrader, and the price was back at being more or less accurately represented at $45k on their website and $42k on Autotrader. After posting a bunch of disgruntled reviews, they reached out for me to call so they could "make things right". At this point, I don't want the car from their dealership, and there's no way they'd sell it to me for the price they were advertising anyways. So, again curious, I logged on to their website and Autotrader. And what do you know? The price is back at $34k and $37k respectively. I actually got a Google Voice number and submitted a request for more info again on Autotrader like I originally did, using the throwaway number and a throwaway name and email address. The original salesman called me within 10 minutes and I had the whole phone call recorded of them telling me the car could be negotiated down and sold for $37k as "we don't set the price on Autotrader". After doing some research online, I found this PDF of GA's Auto Advertising and Sales Practices Enforcement Policies, which basically says under the "Price Representation" section that the price advertised has to include the dealer installed options. I will say that on Autotrader and the dealership's website, there was a note that the price did not include dealer options, but apparently that doesn't matter according to the document (" All additional fees must be included in the advertised price. Any advertisement which lists a price "plus" some additional amount will be considered to be deceptive."). At this point I could care less about getting the SUV, as the dealership has infuriated me, and even if they sold it to me for the price they advertised it for, I still wouldn't buy it from them (and no other dealership can honor that price, obviously). What can I do beyond reporting them to the GA Consumer Protective Division? I am not expecting money for damages (cause there aren't any, besides my time wasted) or anything like that. Mistake with marriage certificate and my husband died before it could be fixed Posted: 05 Apr 2021 08:29 PM PDT Hi, My husband passed away on March 26th after suffering a sudden heart attack at work. As his widow, there is a chance that I am eligible for an L&I pension. This is in Washington State. However, the court has no record of our marriage. When we were married, someone had told me to sign my marriage certificate with the name I intended to use moving forward, as they said that when I went to change from my maiden name to my married name, they would want some kind of proof of intent to use that name. So that's what I did because I am stupid. The court sent the marriage documents back saying we needed to fix them, and we did, but the court never received the fixed document, and therefore never solemnized our marriage. I'm assuming that the fixed document got lost in the mail, as this was happening right at the start of COVID and the postal service being a dumpster fire. We were only notified of this in December, but we didn't find out until February because of mail forwarding (during all of this we moved). And then he died before we had a chance to get "re-married." I am still in possession of the original marriage certificate that was sent back to me. It has his original signature and that of our witnesses and officiant, as well as my incorrect signature. Do I have anything to stand on here? Is there any process or precedent to get the marriage declared legal as of the original signing date, posthumously? I have just been informed that they have reported me missing and are being flown out by the RCMP to force me to fly home. Side note I'm originally from Canada and legally an adult(21). I was just curious as to if they had any legal grounds for that or if it's another manipulation technique as they have tried similar things to regain control. I have not been approached by an law enforcement but feel I should to inform them I'm alive but do not want to speak to my family. Everything I've read says that they will send the report to the international countries police thus making it hard for me to believe the RCMP is footing the bill for a flight. I am well aware the likelihood of it actually occurring is slim. But when you have countless members on one side of your family saying both Police Forces and The Consulate are involved it does play into your head. I'm also staying with a group of friends who live here and have had threats against them as well. If it were just me being targeted and possible dealing with the repercussions I wouldn't be thinking into this as much. They showed her badges and left a business card. I own an outdoor landscape company and they told her they were investigating payments made to my company by a client using AMEX gift cards. After looking into it My office did verify that two years ago a client did pay close to $8000 in Amex gift cards for a project we completed for them. I spoke with one of the agents over the phone and they want me to send all the info pertaining to this deal (invoices, receipts, etc). I'm naturally paranoid and want to avoid being a part of an elaborate scam. If it is legit, I am still nervous/hesitant about sharing personal customer information with them. My job requires me to be responsible for my post until I am relieved. A normal shift begins at 7am and ends at 3pm. A person is currently out so today I'm already expecting to cover the next shift until 11pm tonight. However, the person that would relieve me at 11pm has also just called in. We have a callout list to request people come in and work for these situations, but everyone on the list has refused to come in and work the shift. A 16 hour shift is already long for me, I don't think I would be able to stay awake and actually work another 8 hours. Is my manager legally able to require me to work a 24 hour shift? My manager seems to be looking into a solution but the vibe I'm getting from them is that I may just have to stay another 8 hour shift after my planned 16 hour one I tried looking up laws around consecutive time an employer can require an employee to work, but didn't really get much info. It is only partially finished, but it has three/four bedrooms, a separate living area, and it's own kitchen. Me and my husband are preparing to buy our own home. However, at some point, the idea of taking out a loan to finish up the in-laws downstairs and live down there came up. In exchange, they would put us on the will for the house (they are elderly). I'm perfectly fine with this idea, since they will likely need someone to live with them in the next decade anyway. (Plus, they have a pool and other amenities we would be unable to afford otherwise.) However, I'm worried since they would be able to change their will at any point in the future. We hired a surveyor/civil engineer who spent about 10 days and finally placed the stakes to mark our property lines. I took pictures of them when they were placed against a huge boulder etc. as a landmark so if someone moves them down the road we will have a reference point. This afternoon my wife called me to tell me that he could see our neighbor moving the stake that was placed by the surveyor closer to my property, away from his property, and install new fence. She went ahead and confronted him and he says "it must have fallen of by itself" but he doesn't know that I have pictures of the previous location. He in fact moved 3 of the stakes and his new fence is around 10-15 foot into my property. This is not something I am familiar with and I don't know what steps should I be taking next. Injured at work. Life altering injury, should I sue? Posted: 05 Apr 2021 06:40 PM PDT Ok so this happened 3/25 TX US. I work in manufacturing doing carbon fiber. I had been working on this machine about 5 weeks after having been transferred from my previous machine. Anyways so the morning off we had started a new core size I was unfamiliar With that was 3 inches wide compared to the 10 or 6 inch size I was used to. So I finished a roll and got it ready to package, the machine cuts the fabric and then presses down to apply the next sheet of fabric to the new core but I was trained to reach in and make sure the material stuck to the core until it began rotating to make sure it didn't pull off and end up causing multiple hours of down time. Well this was my first cut with the smaller core and I didn't move my right hand fast enough and it rolled with the material.. about 4 rotations in and my forearm snaps and my hand and skin separate. We were understaffed at the time as 3/5 people had been on break and the closest person to me couldn't hear me scream. I eventually kicked an e stop and people came back, helped me out Of machine, got me to a hospital and after 5 surgeries I've been told at best I might be able to make a fist with my right hand. At worst I have a utility to help my left hand. The company so far has set me up with work man's comp and promised me my job when I come back (I don't know how that'll work) I've had many people tell me to lawyer up but I'm not entirely sure if that's the route I should go or if I should ride it out and continue with the company. Neighbors built a fence and company damaged my sprinkler system Posted: 06 Apr 2021 12:20 PM PDT I live in Idaho. My neighbor constructed a fence in January of 2021. They tore down the wooden fence between our properties and had some people come in and put up a vinyl fence. We received no notice of the fence being taken down or the new one being built. We literally looked outside one day and noticed they were doing that. Come last weekend we had some nice days and we're doing yard work. We noticed the digging the company did to construct the fence ruined section of lawn butting up against the fence and a sprinkler head was completely crushed. Also, the gate that was connected to the previous fence is now connected to nothing and barely standing. A strong wind could push it over. Later that same day, we notice that one section of sprinklers isn't working because there is water just pouring out of the ground. Upon inspection, there appears to be cement that was poured for one of the fence posts is right next to the area. I don't see a sprinkler head and it seems like the sprinkler water line was broken. I'm afraid to dig and see myself for fear they will come back and claim we did the damage. I called the fence company and they said the neighbor signed a release that the company is not liable for any sprinkler damage and I need to talk to the neighbor. My insurance, and a few other people I have talked to don't think that is right because how can they sign for responsibility of our property? Not to mention the yard damage and other structural damage to another section of our fence. We were incorporated in NC under the name "VetSec, Inc." We are a 501c3 that helps veterans of the military transition into jobs in the Information Technology and CyberSecurity industries. We've been established since September of 2018. All our funding is through donation - we charge nothing for our services, our members do not pay, we do not profit, the board is all-volunteer and takes no salary. We received a cease-and-desist letter from a firm representing Aarowhead Security, Inc. dba "Vet Sec". They are a security firm (physical security) founded in 1994, in Arizona. They claim we are providing cyber security services (which we do not), and they claim to own three federally registered trademarks and demand we are infringing on their use of the trademarks, in violation of the Lanham Act, and unless we cease use, they plan on filing a federal lawsuit seeking monetary damages, injunctive relief, and file a complaint under ICANN's Uniform Domain Name Dispute Resolution Policy. (We use veteransec.com / .org, they own vetsec.com). Based on my read throughs, we are based in different states, we are in vastly different industries (a non-profit providing mentorship to military), and I don't see how they could prove that there is likely confusion between our companies. I said it could be emailed to me - but why would any lawyer not just look up our corporate address (we have a registered agent) and send any correspondence that way? Posted: 06 Apr 2021 05:31 AM PDT TL;DR: Ex-girlfriend slanders me and my associates on social media with allegations of rape, extortion, and abuse. Damage has already been done. What legal measures can I take? Florida, USA resident here. About a week ago I broke things off with my ex girlfriend, who unfortunately has had an extremely visceral reaction to this. She has spent the past 5 days campaigning to paint me as a physical and sexual abuser, cheater, and drug addict. Her onslaught contains a web of lies that I was fortunately able to disprove. Amongst death threats, she has enlisted her friends who occupy positions in organizing and political spaces to parade my name/ information/ and imagery on multiple platforms labeled as such. This individual has even gone as far as to contact my family members and bait them into interacting with her as if her intentions were amicable, which ended up with her also accusing my mother and 11-year old little brother of harassing her. Till this point, she has concocted a story that claims myself or people around me doxed her private information, harassed her, sexually assaulted individuals, threatened her livelihood and have been predatory to her family. I have gathered evidence disproving every single claim she has made in the form of screenshots, voice recordings, written paraphernalia and such. I even have evidence of her intent to frame me as she unknowingly had a conversation explaining what she'd do in the subsequent weeks with someone that I'm close with. I plan to file a police report so that I could document the death threats, and have also written up a mock draft of the social media post I plan on making to publicly deny and counter the allegations. Sorry for the terrible formatting) So my boyfriend and I are the only ones on the lease. It's a big house and we had an extra room so we let my friend stay with us for a fee. So we were basically subletting that room. There was no written contract or anything to bind him to this apartment. He's never gotten mail here or anything either. A couple weeks after being here brings about 2 U-hauls of trucks full of stuff. I mean just garbage. Like notes from his high school notebooks...he's 30 and will never look at any of that again. I was calm and said I want all of that out of here as soon as possible. Fast forward a few months, he didn't move anything and the basement flooded where it was and most of it is trashed. He's still wouldn't throw anything away. We threw some stuff away because of mold and when he found out he screamed at us. Fast forward a few more months and he's refusing to pay anything and he won't move anything. I tried telling him I was going to remove his stuff myself and put it in storage. He threatened us and tried to call my job and get me fired. He's threatening to call my landlord and tell them I was subletting which there is no paperwork or agreements for. Even screaming he's going to seeing us in court. What can I do in this situation? I thought maybe I can just remove his stuff and call the police if he comes here. I don't know what to do. Posted: 06 Apr 2021 02:02 PM PDT First of all, what in the hell is this? At least where I'm from this is NOT a thing. Situation: I was driving to the dmv, the light turned yellow and I sped up to get through it. The person sitting in the car to my left at the intersection lays on their horn which confused me, anyway. As I'm walking out of the dmv I'm met by two officers who were called. They explained to me that in their town things work like this - "Someone claimed they seen you blow a red light, in woodland park they can sign the ticket and take you to court claiming you did so. It is not us issuing it, it is a citizen." So now I'm going to court to argue, like children, with some unknown person claiming I blew a red light?
