It was out of network and my insurance denied the bill for around $2,000. I never received a paper bill and only found out after going through my medical claim records. When I asked the father about this he became hostile, and denied that they ever took the child to the emergency room. Then stated that since my wife and I have full custody we would be paying the bill. I have to wait until Monday when the hospitals records department open back up to find out more information about what the services were for, but in the meantime I am wondering how to go about this. Are we stuck with this bill or is it something we would have to go to court for? INFO The step-child is under my insurance plan that I get from work. I am unaware if the step-child was also covered under the fathers insurance at the time or not. (If he even had insurance at all.) We'd been talking for a few days and finally talked about meeting up for a hookup around midnight. We exchange a couple of nude pics, I asked if she had a way over, she said she does and that she'd be over in an hour. I send my address and apartment gate code but she never showed up and I took it as a flake. This morning I get a text from a different number claiming to be her father, saying that she's actually underage and tried to take her mom's car then wrecked it last night. This number has told me that I'll either have to pay them $1800 or they'll press charges. They won't call me, or offer up any further information other than pressuring me to cashapp them $1800. I told them that I don't have that much money and they want to "set a date" to get payments from me. The girl's Hinge profile is gone, and the number is blaming me for the whole incident saying I "persuaded" her to come over. Multiple details in the texts that he sent me doesn't add up, such as giving me two different ages for his daughter. They also have changed the password. I would ideally like to log on and change my log in email to a personal one but now I can't even do that. What is the legality to this? It came with one of those swing sets that has a slide and a rock climbing wall, but it's about 10 years old and looks it. Next to the swing set is one of those round netted swings, suspended from a tree. Near that is a big hammock between a couple other trees. We don't have kids. We have NO need for these items. Our neighbors do have kids, and the kids are always playing on all three of them. The other day, I heard screaming, and I ran outside, only to see the neighbor kid running back to his house holding his arm. Next thing I know, I get a knock on my door by the mother. She wanted to warn me that one of the rock wall knob things is loose. I told her I would appreciate it if her kids didn't play on the equipment. Her response was that it was all there before we bought the house, her kids have always played on it, and the last neighbors didn't care. Then she told me that I'm "lucky" she doesn't sue me for the condition of the rock wall. She said she will have to talk to her husband because they might need to look into that "option." I am a healthcare worker (physical therapist assistant). My 3 year-old daughter goes to a large Lutheran church sponsored daycare. I received a phone call from our daycare secretary this morning to notify me that the daycare is staying open for the care of the children of "essential workers." These workers are in accordance to our governor's speech yesterday. The secretary asked me if I plan to send my daughter next week. I told her no, as I erred on the side of caution & didn't send her last week & will continue to err on the side of caution until all of this is over. I knew I would be charged for daycare last week due to them being open & it being my decision not to send her. I asked her if we'd be charged for this coming week since we are under a shelter in place order & I didn't feel safe sending my child to daycare. She said yes, I would be charged since I have been deemed an essential worker being in healthcare. What can I do in this situation? I feel that I am being punished for obeying the governors order to shelter in place and not send my child to daycare. Other parents who aren't deemed essential are not being charged during this time. In the midst of all of the Corona stuff, they basically all got laid off. Cirque is saying that nobody will get paid out for their accrued vacation (which is a seperate issue on its own, and IANAL so the wording seems intentionally fucky) However, my main concern has to do with the email that the employer is claiming that to open means to essentially sign and agree to terms. Back in September of 2019, our attorney, who we hired on a contingency basis, starting talking to us about another firm he was showing our case to "for advice". We knew that because he had already shown that he was too busy with other cases, evidenced by blatant neglect, he was gearing up to hand our case off to someone else. Over the next 3 months, as he had over the past year, he showed up to court unprepared, ignored our phonecalls/questions concerning our case, cancelled appointments, and filed subpoenas and motions with the wrong court/judges. Anytime we did manage to talk to him he kept saying we needed to meet with an attorney from this firm to talk about our case. Fast forward to the end of January. We scheduled a meeting with our attorney to find out what progress had been made with the Discovery which was due on March 07, 2020. Unbeknownst to us, he had arranged for an attorney from the other firm to whom he had shown our case to also be there. We sat and listened to this other attorney talk about how great our case was, how much injustice had been done to us, and how if we decided they would take our case they would get things rolling much faster than our present attorney, who finally admitted he didn't have the time or expertise to give our case what it deserved. This other attorney then mentioned someone in the firm who had great expertise with Will Contests but before she would take the case, we would have to agree to paying her one third of what she recovered for us. Really there was no decision for us to make. It was either go with this new attorney or receive nothing. We immediately informed (that day) our present attorney that yes, we will continue on and agreed to pay the fee. Nothing was signed at this point. After weeks of hearing nothing, we finally reached out to the attorney we had met with and he said that the person he had spoken of with all the expertise in this area of law still had not decided that she would take the case, and that her and her husband were on vacation through the end of February. He then said if she didn't take the case, he would put it in the hands of someone who would. Two weeks later, we FINALLY were able to meet with this woman and her husband. They said we had a legitimate claim and that they would get back with us the next day. One week later, the attorney we met with in January who sold us on this whole thing called and said that although we had a great case and they were impressed with us (in regards to how we would conduct ourselves before a jury), they were not going to take the case. He then gave us the name of two attorneys in town who WE could contact, urging us to move quickly during this time that the courts have all but been shut down. We don't know what our recourse is. I asked this attorney who I talked to about the fact that our present attorney who we hired in 2018 was legally still our attorney. He said very quickly, "well, he can withdraw at any time." We are fed up with empty promises and sales pitches from these people. They want a 100% guarantee that this case is a win, and really don't care about justice being done. Any advice? We have refused to leave on the grounds that we have no balance with them and cannot be evicted if there was non payment as the governor has halted evictions. They communicated that they are leaving their apartment and moving back in, that they are struggling and are being asked to leave their own living situation and will be living with us. This communication comes after our over tenant explained that they wanted us to sign an agreement saying we would be out by the 30th and they were leaving NYC to be with family and the landlord wanted their broker to show the apartment ASAP. So we are thoroughly confused as to the 180. This is a small studio apartment that my husband and I share and we feel incredibly uncomfortable with her living with us, however are unsure if she is allowed to become a roommate without our consent, as she is on the lease. We are sending her a message saying we do not agree to a roommate agreement and will call 911 or 311 if she attempts to enter the apartment without our permission. Is this a good idea? What do we do? EDIT: Yes, my post history traces our previous issues. As of today we are completely up to date with rent. We have zero balance with her and have openly communicated that we are taking responsibility for back rent and any late fees and setting up a payment plan until courts open up. The total recovery period with no complications is 6 weeks and my boss knows this. She's been super understanding of everything and she even knows that I had a pretty bad complication that I'm still dealing with. This put my recovery period out an extra 3 or 4 weeks. Today, I noticed something was wrong with my incision (due to the nature of my complication) and that there was a small opening (I'm not gonna go too into details because it's gross but it's pretty bad). I unfortunately only noticed it about 30 minutes before my shift started and I told the Assistant Manager who opened today that I want to go to the ER to get this checked out before I work again so I don't make it worse but if they REALLY needed me, I could come in. Due to COVID-19, our store wants to cut hours and we haven't been busy so I know I'm not really necessary and they'd be perfectly fine without me. She told me that it's fine and I apologised for the short notice. She told me that this time I can get away with it but if it happens again, I'm getting written up. I went out with a friend, we had a couple of drinks, went to meet with two guys who had some weed, and drank some more. I don't want to post all the details unless necessary because I'm worried it'll somehow be found and recognized. But the guys we met up with we didn't know, and it wasn't any kind of romantic or sexual interest. We just wanted to smoke. I blacked out and woke up at home and realized immediately I was raped. I could hear my friend telling her boyfriend that I was raped also. She didn't completely black out, so she was able to fill in the details. Apparently I was plastered drunk and one of the guys forced himself on me. I tried to push him away and said no stop, but he kept on. Then I went unconscious and he continued to rape me. I didn't shower, went to the hospital and got a rape kit. My blood alcohol level was insanely high, I had minor injuries and some tearing inside my vagina, a DNA match was found, and now I'm waiting for trial. I've been told that the main defense will be that they will say I consented, or that there's reasonable doubt because I personally don't remember the night. My friend does, and she was a witness. This going out thing was something I never do. It was my second time in years, because my friend was taking me out that week to get my mind off of my recent divorce. I hadn't smoked weed since I was a teenager and hadn't gone drinking in years. Also, I wasn't wearing anything provocative. I had on a skirt but it wasn't short, and my shirt was a turtle neck. Lastly, I'm not someone to have casual sex. I barely even talked to these guys. Of course I know these things about me but a judge might see it differently. I don't know if my character is exactly proof, and I'm sure they're going to pull the whole "she had drunk sex and regretted it, she doesn't even remember what happened so it's possible she consented." Even if my friend didn't tell me what happened, I know I didnt consent because that's not my personality. Can someone give me some advice on how I can answer these questions in court? Also I'm not at all saying that promiscuous women or party goers can't be raped. Governer Pritzker issued a shelter in place order for the state of Illinois and Mayor Lightfoot said the order would be enforced by the police. I work part-time in grocery while in school and was issued "travel papers" because I am considered essential. However, my wife works in Park Ridge for a small privately owned credentialing business. This business is telling her she must show up for work on Monday, but have not deemed her essential, issued any "travel papers" and threatened her position in the company by email. I have searched the internet but I cannot find any resources about the legal ramifications against businesses, only against individuals. She wants to obey the order but her work does not see it as a valid order. Is there any way to report this business or find out if they are allowed to operate during a shelter in place? Our venue refused to acknowledge the governors mandate and stated they could still hold weddings of up to 100 people. She insisted it wasn't a ban on events over 10 just a recommendation. The caterer also refused to do a refund due to the fact they had purchased the food. We messaged the county health department and the department of health for Virginia and both confirmed it was a ban of more than 10 people. The venue continued with their statement of 100 and that this would be us that canceled the wedding instead of it becoming force majeure. The venue contract has a force majeure clause stating multiple events including "compliance with any regulation, order, or requirement of any governmental body or agency" that "no party will be liable to any other for failure to perform its obligations hereunder if and to the extent that such failure to perform results from causes beyond its control" The caterers contract is very vague and has no force majeure clause. Should we be entitled to get our refund or are we just fucked and out tens of thousands of dollars? 401k refusing to distribute post tax funds to me Posted: 21 Mar 2020 07:02 AM PDT I've been trying to roll over my pre and post tax funds over to my new 401k, however, my current plan will only accept the pre-tax funds since my post tax funds are not Roth funds. The firm that has my old plan sent the funds for the pre and post tax funds to my new 401k, but my new 401k rolled over the pre tax funds and sent the check for the post tax funds back to the old firm. I asked the old firm to just cancel payment on the original check for the post tax portion, and then send me a new check for the post tax portion. They are saying that it's not legal for them to do this and that my only option is to somehow get the plan to accept the check since the old firm already wrote the taxes in a certain way. Looking at the irs guidance , what they are saying looks to be untrue. Is there any way that I can escalate this, or is my option really just to open up another IRA? [link] [comments] |

I should start off by saying that we live within the same town, roughly ~25 min away from each other. My ex-fiancé has decided to take me to court over our child custody agreement. We stopped living together at the end of January and started doing a 4-day on/3-day off setup with alternating weekends. This wasn't ideal as every other week to every 3 weeks, I travel for work. My work trips range from 2-5 days depending on where I am going. We split all of our daughters expenses down the middle (ie. School), minus health insurance as I cover that out of my paychecks. Towards the middle of February, I then proposed the following: 50/50 split with our 5yo. Week on/week off setup. - She'd be dropped off at the other's home by 5pm on Sunday and she would begin and end her school week with one parent. - My ex-fiancé has expressed concern that she is not okay with going a whole week without seeing our child, so we came up with the agreement that if the other wanted to see her on their off week, they could pick her up from school and the primary parent for that week would pick her up by 7pm at the other parent's home. (One important thing to do with this is that she wanted to send our child out of the country with her parents for a few months while "we" got our stuff together with our separate moves). - Expenses still split down the middle. - Alternating holidays. - Flexibility to switch weeks/days if needed. - We have not fully discuss vacation arrangements. I know she is planning to take our daughter out of the country for 3-4 weeks this summer. My ex-fiancé initially proposed standard visitation under Texas Family Code 153: - visitation on 1st, 3rd & 5th weekends + 2 hours on one day a week each week I told her that this arrangement was not fair to our daughter. She'd go from seeing me 14 days a month to 4-6 full days, + 8-10 additional hours. She acknowledged that it wasn't fair to our daughter but it was best for her because she wanted as little to do with me as possible. Last Friday, 3/13, my ex had called me and said that she will agree to the 50/50 arrangement but we need to get it in writing. I said perfect. I began to inquire around for costs to get this done. On Wednesday, 3/18, she had asked me to take her dog for the night because he wasn't letting her and her boyfriend sleep. I declined. She then stated "I'm not asking you, I'm telling you. You're taking the dog." Following an argument on her not knowing how to properly speak to people and demanding things on her time, she mentioned she will be serving me and taking me to court "because I am unreliable and untrustworthy". About 300 feet wide and a half mile long. This, I believe, is unincorporated property. This is a flood plane. We have had flooding problems in the past and has gotten worse every year with global warming. The house sits about 250 feet away from the flood plane. A developer in the neighborhood dug a trench along the plane to protect his side of the flood plane. This is inevitably going to push water to my side and cause further flooding damages. Do I have any legal recourse here? Who would I contact? Should be noted this person is an acquaintance, very friendly and respected neighbor. My brother has this manager (Pizza hut), who on multiple occasions has sent him home early when it gets slow, then turns around a few hours later, gives him a call demanding him to come in again and finish out the shift. This was the 3rd time he's done this, and he terminated my brother for not being able to come back in this last time. This seems like an improper reason to be able to fire someone, as the shifts were planned in advance and then changed, on the fly, twice in one night. He was financially supporting them all of 2019 and she wasn't working. He was working full time. Now she threatened him saying that her parents are claiming her, she took all his money from the savings account saying that it's hers, and she said that he's going to owe $7,000 to the IRS. They've had a rocky marriage but I don't think that's legal and I'm looking to help him out with some advice as to what he can do. Can she really do that? Can her parents really claim her and he has to come up with $7000? How would you prove that it's not true? This is in California EDIT: Just got some new information So the wife and child had been living with her parents but my friend (the husband) was sending them a substantial amount of money to support them while they were there. He expected to be able to claim them on his taxes and had set money aside in a bank account his wife had access to She and him have been living together this year and they had some disputes recently. She left and took their child back to her parents and she took all the money in that account and told him that her parents are claiming her He was going to use the money in that account to pay the taxes but she won't give it back to him.
