Boyfriends ankle monitor is dying, his charger isn’t working and no one from the house arrest company will pick up. What should we do??

    Posted: 28 Aug 2019 06:15 PM PDT

Title explains it all. What is our best course of action to prevent him from going to prison if his monitor dies before they open in the morning? I suggested maybe filming himself sitting at home for proof he didn't go anywhere. He thinks maybe he should call the police and go into the station so that he can be supervised, maybe put in a holding cell overnight so that he has witnesses that he didn't go anywhere.

Time is a factor. What do we do??

Edit: thanks everyone for your feedback. He called, left a voicemail, sent a text, sent a video recording of the monitor and charger not working (he has been on house arrest for 11.5 months we definitely know what it looks like when it's supposed to be charging)((he gets off sep. 14! :)), his supervisor has an iPhone so we even shared his location with them. Everything we could think of.

At 12:29am we got this text back: "Sorry so late.. I have been traveling today and not near a computer or cell coverage. I looked it up and it should have showed you on charge but hasn't. Either it's not connected or charger not working. Still showing low battery. Call the office at 9 and talk to greg about it. I'm sorry."

Crisis averted. Sounds like we'll just stay put until the office opens and then we'll go in to get everything checked, and we'll be sharing his iPhone location with them until then.

I would like to take a moment to address a few frequently asked questions: 1. We are in South Carolina. 2. He is not on probation or parole. He has never in his life been convicted of a crime. He was actually put on house arrest because he acquired too many traffic violations (none of which were DUIs, which in my opinion is absolutely ridiculous). 3. The house arrest company is a privately owned business. There is a man and wife who charge every person they keep on house arrest $60/WEEK. Capitalism ladies and gentlemen.

Thanks again for everything and if anything changes I'll let y'all know if anything changes.

Nurses aides were abusing patients so my sister reported it and is now receiving threats from HR that they will take her license away

    Posted: 29 Aug 2019 09:07 AM PDT

I am writing this on behalf of my sister.

My sister has a bachelors in nursing and has been working as a nurse at a senior care community place in Minnesota for a couple of years.

A month ago she witnessed two of the aids verbally abusing a patient. Many patients have complained to my sister about how these aides treating them. My sister sent an email to the director of the facility, an HR lady and her manager detailing the abuse and who the abusers were.

A few days ago, the HR woman called my sister and yelled at her that she did not report the abuse the correct way. The woman claimed that my sister was supposed to call and not send an email. She had been threatening to take my sisters license away. They have now scheduled a mandatory meeting for every nurse to attend on how to properly report abuse. She also threatened to report my sister to the board and get her license taken away if she does not attend the class.

My sister is perfectly fine with taking the class but she is worried she didn't report correctly. She is also very worried that she will get her license taken away. Is the HR lady right? And can she take my sisters license away?

Any advice is appreciated, thank you!

Edit: So, I have some more information that may need to be given. My sister works 2 pm-10 pm. She came in to work at 2 and heard that the overnight nurses aide (who we will call Barb) left the patients soaking in their pee and did not take care of them. It wasn't until the end of her shift at around 10:00 that she found out more specifics. That same day before my sister left she sent the email to HR, the director and her manager. When the HR lady called her and said she would take away the license she also said that it was my sisters job to investigate. She also said my sister should've put the information into her progress notes instead and not sent that email to the people she sent it to.

The information was also sent through her work email. That email cannot be accessed outside of work.

Hurricane is heading right for me and my landlord refuses to allow me to take steps to protect the property.

    Posted: 29 Aug 2019 04:29 AM PDT

I live in Port Salerno, Florida, in a triplex apartment in the suburbs. I've been renting this apartment for 4 years now. Every year when a hurricane comes, I email my landlord, asking him if I can place some protection on the windows, such as plywood. Every year, he tells me not to place anything over the windows, because he does not want holes drilled into the wall.

I have two young kids and all our belongings in the house. I'm worried about the apartment and my belongings being severely damaged.

If he doesnt attempt to board up the place, insurance wont pay out. I'm also concerned that he will try to sue me, claiming I didnt take steps to protect the property.

What can I do here to cover my ass and protect my family's belongings?

Neighbors cut down my tree (WI)

    Posted: 28 Aug 2019 06:23 PM PDT

We bought our house July of 2018 and the previous owners had put a TON of work into landscaping the back yard. It was absolutely gorgeous and even though we live in a city it felt very private, didn't see into neighbors yards at all.

Shortly after we moved in, our neighbors made a comment that they didn't like a certain tree (a mature sumac tree With gorgeous red flowers) that was on the edge of our property, near their fence (but still our property). They basically tried to tell us we needed to cut it down because they didn't like it but we told them we were actually a big fan of the tree and if they wanted us to trim anything that may technically hang over their property we would but we wouldn't remove the tree.

Throughout this summer they made a few more off handed comments on how we should cut down the tree because it makes the back corner of their yard (behind a shed) too shady. Last week my fiancé let them know he'd trim it back a little bit that his schedule was really busy so he wouldn't be able to get to it for a couple weeks.

Yesterday, without notifying us, they cut down a HUGE portion of the tree, starting from the base (only about two inches above the ground left of the trunk). They also cut down a bunch of other shrubs and branches that were in no way on their property.

You can now see directly through to their property. My fiancé and I are not happy about it and aren't sure how to proceed. We have not yet seen them to discuss this with them but from looking online, it seems as if they may be liable to compensate us for the damage of the tree as what they cut down was on our property. Basically just looking for any advice. Thank you!

Help!! In Vegas at the Excalibur. Caught the maid putting on my wife’s makeup. The hotel is trying to delay delay delay. What do I do?

    Posted: 28 Aug 2019 10:02 PM PDT

We checked into the Excalibur in Las Vegas Nevada at 2:30 in the morning. At 8 I got up and we went to breakfast. We then came back to our room to take a nap. The door was open and the maid was in the bathroom. I walked around the corner and saw her putting on my wife's lip gloss. I tried to call the police but it routed to the front desk and they sent their security to the room where we were ask to fill out reports. They then said to take a nap and that to check with the front desk and they should have it resolved. Which to me is replacing her make up. I didn't want a room comp or anything other than replacing her make up being how it is super unhygienic for someone you don't know to use you personal products. Now I am stuck and they won't answer for it or replace the products that were messed with. We tried to get the ladies name and they refused to give that to us. Please someone tell me how to handle this. Las Vegas Nevada.

Dog-sitting and finding out the neighbors are neglecting the dog

    Posted: 29 Aug 2019 12:19 PM PDT

Hi guys I'm 22 and live in Oahu, HI,

so my family is watching a family friend's pure-breed shitzu and come to find out, she is being neglected/abused. When my stepmom went to pick up the dog she found the kids (who own the dog) choking her and shaking her by the neck. Shes over a year old and she is still not potty trained but since she's lived with us she's already started develop a habit of going outside. Her fur was so matted that groomers and vets wouldn't take her in to cut her hair which eventually my dad was able to do successfully. After my dad was half way through cutting through her fur he found a knot on her tail which turned out to be her tail broken. The kids who own her asked my stepmom for her back but my stepmom texted their mom that she's not comfortable giving her back until their mom is back and she flies back in 2 weeks. I've thought about offering the mom to pay for her the amount that she bought her but if that doesn't happen I was wondering what were my options/advice you guys have.

I asked my parents if they had any photos but they said they didn't take any with the intent of using it as evidence so I don't know how reliable their photos are.

Cops keep making me move legally parked cars (TX)

    Posted: 29 Aug 2019 07:04 AM PDT

Cops have came twice to my house and forced me to move parked cars away from the street across from me. The cars are parked way over 30 feet away from the stop sign in front of them. What can I do? Ive already measured the distance from the stop sign and the location where one of the cars in questions was at and it was way over 30 feet in distance. Thanks!

Edit: Neighbor infront of my house has came up to me to personally complain about us parking on this section of the street. He claimed that it was hard for him to make right or left turns because my cars would be blocking the way which is total bs since there is over 30ft of space between the car and the stop sign. The LEFT side of his house is facing this street, so im pretty sure hes trying to prohibit me from legally parking on the street because it blocks the view of his flowers on the left side of his house. Also, my brother swears that the cop that lives right next door to this picky neighbor is the one coming to our house to make us move the car (cant confirm yet). This is starting to bother me because there are SEVERAL vehicles in our neighborhood parked way closer than 30ft to stop signs ahead of them, yet they still park in those spots on the daily. I feel like im being harrased by this neighbor and his cop friend. I cant even have people repairing my house or friends coming over for coffee just because one guy thinks his flower garden being visible is a right?

[VA] HOA is demanding to inspect the interior of attached garages

    Posted: 29 Aug 2019 06:29 AM PDT

They are citing this section of the Declarations: "During reasonable daylight hours the Declarant or member of the Board of Directors, or any other representative of any of them, shall have the right to enter upon and inspect any Lot for the purpose of ascertaining whether or not the provisions of these restrictions have been or are being complied with, and such persons shall not be deemed guilty of trespass by reason of such entry."

I read "enter upon and inspect any lot" as the ability to walk up to the house, but only on the outside. They are claiming the ability to inspect the interior of the attached garages to make sure people haven't converted to bedrooms or being used for something other than asking a car.

It seems that if that were allowed, it would also allow them to inspect any interior space, because there are also provisions about running businesses. I've done some searching but cannot find any applicable case law, but I'm limited to just Google Scholar.

Any citations or advice would be much appreciated.

Edited to add the definition of "Lot" from the Declarations: "Lot shall mean and refer to any plot of land shown upon any recorded subdivision plat of the Property on which a residential dwelling unit may be built and to each condominium unit on the Property created by recordation in Fairfax County of condominium instruments in accordance with the Virginia Condominium Act."

Neighbors demanding we move fence (IN)

    Posted: 29 Aug 2019 06:13 AM PDT

TL;DR: angry neighbors got survey after we replaced sections of 30-year-old fence, survey says that our fence is 2" on their property. EDITED: that's correct 2 inches, and it's not 2 inches straight back, it's like a pie-shaped sliver.

The extended version: We bought the house 3 years ago, it had been foreclosed on, and empty for a few years. Everything was in disrepair, including a 25-30 year old cedar fence. My neighbors (insert long story here) reported us to the city because a section of fence fell down. We hired a fence guy who replaced the existing sections basically where they already were. (we pulled them in a few inches towards us). They got a survey (I need to find out what kind) and the staked survey shows the back section of the fence is over the line about 2 inches. From what I gather, the property line is actually crooked, and not straight between the properties. I got a letter from their attorney demanding we remove the fence from the property-no threat of lawsuit or anything past that. Since we replaced the fence where it stood, I'm interested to see what they can actually demand of us.

Also, as you can imagine, they hate us. we had offered to go in halves on the fence between their property and ours, they refused, they wanted to put up their own fence, but it would be so close to their house, they would not be able to open their side door.

My boyfriend’s apartment complex keeps running my credit report without my knowledge

    Posted: 29 Aug 2019 02:02 AM PDT

Hey guys, first time poster here. I'll keep it to the point. I've been with my bf for 2.5 years now, known him for over 10. Anyway, I submitted my app to be an add on to their apartment that they've been in for over a year with no issues. They denied over a few menial things on my credit, which I have resolved, but isn't reflected on my credit report yet. However, they have been repeatedly processing my application without my knowledge. I told them I would contact them when everything is cleared off of my credit report. They've made multiple hard inquiries on my credit without my knowledge. They have also sent me documents that state in writing that I'm on the lease, but when I call, they say I'm not. They have also made a change stating that I'm the spouse of my boyfriend's roommate. I feel like they're trying to pull strings to meet some type of quota. Considering they are impeding on my credit, is this worthy of seeking legal action? I'm sorry for my ignorance, I work in the med field and I'm just looking for advice.

My girlfriend is having a rough couple of years.

    Posted: 29 Aug 2019 08:45 AM PDT

So I've been dating my girlfriend for about a year. When we got together she told me that she had been raped 3 years ago. The rape was reported to the police and has since been investigated. The district attorney found enough evidence to support the case against my girlfriend's rapist.

So they have taken all the necessary steps and tried to take the case before a judge. The case has been delayed 3 times over the last year. It was set to go to trial again this September. Today my girlfriend got a call from the victims assistant liason saying that the defendants attorney is attempting to take the trial to federal court now.

My question is this: is this another ploy for the defendant's attorney to delay the trial another few months? Is this their way of hoping that after so long my girlfriend will just give up and say screw it? She's already having a hard enough time as it is with the date of the trial coming up soon. Should she keep pursing this?

Purchase a vehicle from a dealership in PA that is "unsafe for highway use"

    Posted: 29 Aug 2019 05:24 AM PDT

This is my first interaction with the law in any way. I have no idea where to begin so I hope that some one on here may be able to assist me.

I purchased a vehicle on June 24th. It was inspected in May and in my "very apparent" lack of knowledge looked like a decent car. I spent 4,700 plus title transfer, plates, and sales tax. I had no troubles until the exhaust fell on me without warning. My grandfather has a lift in his garage so we put up the car to fix it. That's when we realized the frame was all but there. The rails are soft. The rocker panels have fist sized holes the entire length of them. The trailing arm supports are completely rotted through, and the heat shield and straps are missing on the gas tank. That's only from what we saw just standing under it. My grandfather didnt want to mess with it until I got a second opinion from an inspector.

Once I got it inspected they pretty much said the same thing my grandfather saw plus a rather large list of other problems that would keep it from passing an inspection. They made me sign a waiver stating that I was informed and take liability of the knowledge that the car is unsafe for highway use before I could take it out of thier garage. They then gave me a number for a quality assurance officer for the county I purchased the vehicle from.

After contacting the officer he informed me to take the vehicle to the dealer ship and let him try to make it right by fixing the problems or to refund me. I took the car back and told him what his options were. He said that he would plate the frame for me. I may not know alot but I do know that this would only be cosmetic and wouldnt actually strengthen the structure integrity of the frame. I told him he either had to actually fix the problem or refund me. He said he would do neither. I then informed him that I would have to get the law involved if we didnt come to an understanding. That's when he started to putter around and say that he would rather me not get others involved because it would fall back on the original inspector that had done it in May, and he didnt want to ruin thier reputation. He told me he would talk to the other owner about refunding me and would get back to me that evening. I never heard back from him.

The next morning I got a call from an officer of the vehicle fraud division of the state police in that county. He asked me to drive the car to an auto salvage garage so he could put it up on a lift and check it out himself. After I getting there and him looking at it he informed me that this place and the inspector that they use have been on his "radar" for some time. He told me to take it back to the dealership and make them know that I wanted my money back or I would go to the state police. He also told me not to let them know that I already had because they would be going there regardless and if they didnt refund me they couldnt force him to without going to court.

I did as he said and returned to the dealership and told him what I wanted. He again refused. So I left and called the officer back. After telling him the dealer refused to repay me he said that I would need to go to the magistrate and file a civil complaint and he would gladly testify in my defense. I informed him that I signed the buyers agreement "as is" and I didnt know if i would even have a chance. He told me that this wouldnt be the first time that he has appeared in front of the judge for those exact reasons.

I went to the magistrate and apon arrived explained my situation, because as I said I've never dealt with a situation like this, and the secretary said I wouldnt have a leg to stand on. She told me that she was afraid that I would be spending more money for a lost cause. Now I gave her a very shortened version of my case and didnt mention about the officer but it still worries me that I'd be pumping more money into something that I would lose.

Now I have to write up the civil complaint form. I dont know where to start, if I have to get an attorney, or if I'm even doing the right thing. If anyone has any idea where to start or what actions I should take I would be so grateful for the step in the right direction.

Can a personal injury lawyer hide the amount insurance paid and haggle with you o er how much to give you???

    Posted: 29 Aug 2019 11:44 AM PDT

    (Edit: we are in Utah)

My friend's personal injury lawyer first said he could give him a check for 12k. My friend insisted to see what the insurance companies had actually paid out. The lawyer then upped the offer to 16k, and then 18k and finally up to 24k. My friend has a valid green card, but the lawyer didn't know this — he told my friend this was the best he could do for him since he's an illegal immigrant.

Can a personal injury attorney actually get away with hiding the amount of the insurance payments in order to haggle with their client? Should I be helping my friend find an attorney to sue this shady attorney, or are there magic words that will help him win the percentage he's supposed to get by contract?

Thanks in advance for any wisdom.

    ...some details below...

My friend, a Mexican man with valid green card, was at a freeway off ramp stoplight and was severely injured by a truck that slammed into the car behind him, flipped over that car and landed on my friend's truck. The driver of the truck died, as did the passengers in the first car he struck. The dead driver's insurance only covered 150k, which was almost all paid to the first car, according to what he's been told.

A client paid me late but the late fee was not added. Does the wording on the invoice alone give me ground for pushing it?

    Posted: 29 Aug 2019 07:04 AM PDT

My invoices as a independent contractor state that invoices are due within 28 days of receipt and are subject to a 5% late fee for each day it's late. (in my line of work, invoices are typically paid within 2 weeks so this is never an issue.) I just had a client finally pay me yesterday 8/29 for a 7/29 due invoice. I mentioned the late fee in my last reminder email and when they finally pushed digital payment thru it was not included. Can I inforce it?

    Can someone withhold an inheritance?

    Posted: 29 Aug 2019 07:51 AM PDT

    Location: Missouri, USA

Background: Two years ago my wife's grandpa gave her a gun to use for hunting. He passed away a few weeks ago. And one family member wants the gun.

As stated, my wife was given a hunting rifle by her grandfather. The executor of the trust will not release my in-law's inheritance unless the gun is given back.

Does the executor of a trust/will have the power to withhold inheritance over an item that was given on hearsay?

US citizen working as a consultant for a US company. But staying in Canada for the summer. Am I breaking any Canadian laws?

    Posted: 29 Aug 2019 07:11 AM PDT

I am a US citizen living in New York state, working as a remote consultant for a company based out of Florida. I live on the border between the US and Canada, and I have a summer cottage in the province of Ontario. I drive over almost everyday to work out of the cottage, because it is much nicer to work from there than my house.

The other day Canadian border guards asked me if I conduct business in Canada, I said no. Because I don't conduct business with any Canadian entities, be that people or businesses. I sit at my cottage and work on projects from the Florida company and work with individuals who also work for the Florida company who are based around the United States.

My question, am I technically conducting business in Canada and do I have to tell Canadian border guards that i am conducting business? Because I feel like that will get me involved with the Canadian revenue service.

    [DE] Stealing my own mail

    Posted: 29 Aug 2019 07:35 AM PDT

I have an odd problem. My new apartment building cannot be seen from it's parking lot as it's situated behind a row of town houses. Amazon has started delivering some of my packages to the last town house in the row that is in front of my building (ie they are delivering to number 215 instead of 216, which is me)

    So I have two questions:

    1. Is it legal to just grab the package addressed to me from the porch of 215 when I get home from work?
    2. If it is legal, what should I do if someone sees me do this and calls the police, thinking that I'm stealing someone else's package?

OR, USA. It is now 30 days until the lease ends and they are telling us to give notice, and then we can "cancel" if we like the agreement they draft. I feel like this is illegal, and puts us in a situation where they can sell our apartment to someone else. They are supposed to legally give us 90 days notice of any rent increases. Is there a way to strong arm them into giving us the next 3 months at the price we're paying now, while they draft an agreement?

Friend became disabled for their position, is offered significantly less money for a different position at company. Legal?

    Posted: 29 Aug 2019 08:39 AM PDT

Hello, my friend became deaf enough to the point of not being able to answer phones. The company has been very mean to my friend every day since to try and drive said person away (quit). Now the company is offering an opportunity to move positions but it would be half of what said person is being paid right now.

In the long list of job description it includes "calls" as part of an available goal but doesn't explicitly use the word requirement anywhere. I said not to sign anything yet and to look into the legalities of it because getting a 40-50% deduction in salary is pretty bad. Unfortunately to preserve their identity, I can't name the state but I will say it is in the US and would love to know if there's a federal law protecting my friend or if there's a state law, where would I go to find out?

Thank you so much for your time!

My girlfriend's ex boyfriend, who is a registered sex offender and looks like me, has set our house as his in the registry.

    Posted: 28 Aug 2019 08:55 PM PDT

Today while I was at work the police came and said that our house had been registered as a sex offender household, and the name of the sex offender was my girlfriend's ex. They said they've seen him walking on the street but we have good evidence that he's in Virginia. I look similar to him (tall, buzz cut, facial hair) so we think it was me they saw. The thing is, he's been arrested before for failing to register, twice. Am I right to be worried that they might think I'm him if he fails to checking in with his probation officer? I have two IDs in my wallet but they're both from before I cut my hair(had long hair). Will they think my IDs are fake? Also how can we have our house removed from the registry, because he doesn't live here?

[MN] My mother sprung this residential lease agreement on me this morning. What legal actions should I take?

    Posted: 29 Aug 2019 10:25 AM PDT

I turned 18 years old a few months ago, but my mother never mentioned paying rent while I attend college until today. This morning she decided to find a residential lease agreement off of LawDepot and edit the document for this use case.

According to her, I'm required to sign an agreement by 12:00 PM (CDT) and pay the rent fee or else I need to leave the property. However, correct me if I'm wrong, according to Section 504B.135 of MN state law, she is required to give me a 14 days notice. I tried to show this section to her, but she is saying that I don't need a 14 days notice because I've already been living in the home for the past few months as an 18 year old individual.

Any advice regarding legal actions that I should take would be appreciated.

An Airbnb I recently stayed at had hidden cameras in the bedrooms, my friends and I were recorded having sex. Anything I can do to have the footage deleted?

Some friends and I met up in Southern California to have a little weekend together since we all live in different parts of the country. I brought my girlfriend with me and so did a few of my friends. The weekend went how it went and on our last day there we noticed there were small hidden cameras speckled through the home. After checking the bedrooms we confirmed there were in fact 2-3 cameras in each room all pointed towards the beds. I contacted the hosts and they stated that its their home and legally they can have security cameras in the home. Is there anything we can do to have the footage deleted or something? I understand the need for security cameras in case of damages or stolen items, but being pointed at the bed in all the rooms? It makes me feel really uneasy.
