[UPDATE] [NC] Sold them a used car, now they sued me. Posted: 16 Apr 2019 07:05 AM PDT A lot of stress was lifted from our shoulders today, thankfully. This morning we had our court date, and let me tell you it was pretty quick. Got in at 8:32, out by 8:50. The plaintiff presented her case, in which she said that we hadn't disclosed an airbag light that was on the dash, and that the check engine light code we told them about was false information because it actually turned out to be another issue. Said the vehicle had more rust than they originally knew about, and that they hadn't driven it because a mechanic told them it was unsafe to drive. We presented our defense, clearly stating they had the opportunity to have the vehicle checked by a mechanic, but chose to take our word for it; and that we brought all known faults to their attention prior to selling them the vehicle. Anything they found after they took ownership wasn't our issue anymore, they had all chances to make a proper decision prior. We brought up the FTC's Private Sale guide stating that all cars sold from private party to private party are "as-is" unless otherwise stated. We neither expressed nor implied any warranties. Long story short, the Magistrate dismissed the case with prejudice to the Plaintiff because NC is a "Buyer Beware State" and the buyer should have done all in their power to make an informed decision before purchasing the vehicle. They have 10 days to appeal, but I doubt that's gonna happen. Thanks to everyone that commented and gave my wife and I more information on the original post. It sure helped! Posted: 16 Apr 2019 09:15 AM PDT I own a small rental house in Colorado that's been empty for a little over 3 months now while it's being renovated. In the last few months a small string of vandalism have happened in the area so I installed surveillance cameras in the house that record the interior and entrances. About two weeks ago my rental was hit. The damage was pretty extensive and is going to cost me a lot to fix. My cameras caught everything. The vandals were 5 local college kids who's faces were visible. The cameras caught them vandalizing the property and doing other lewd acts there (Defecating and urinating in the house). Along with all of this, two of them decided to have some "fun" and had sex in one of the rooms with a bed. I immediately contacted the police and in less than a week all 5 of them were arrested. Right now I'm getting ready to take legal action against them for the destruction of my property. These last few days though the parents of these kids have been harassing me. According to them I faked the video and am lying about their kids vandalizing my property. Along with this, one of the parents want's to sue me for emotional distress and slander. They also apparently know that I have footage of 2 of them having sex and are threatening me with revenge porn if I don't delete it. What are my option here? I've already released a copy of the film to the police and plan to use it when I sue them as evidence of their crimes. A separation order was put in place between the 2 employees, however the perpetrator has a history of work place violence and pulling a gun in a road rage incident. I don't feel safe. What do I do? Edit: I responded to a post stating "we are the police." While this is a half truth, it's a state run corrections center. All of us our trained (annually) to pass 3 separate firearm tests. Posted: 16 Apr 2019 10:29 AM PDT This is the Hilton Grand Vacations @ Flamingo in Las Vegas. I arrive to my room around 1am last night to find my key won't work. I go to check-in desk and they say the key is registered and active so it might be the door lock is out of battery. They send me back up with a security guard who gets the electronic lock to open, but the security latch is latched from the inside. He has to get tools to open this but they won't work so he has to break down the door. as he's kicking it, a woman appears from inside. She says this is her room, hotel staff let her in, and her husband who has the keys is "out." I sweep my room and it seems nothing is missing, but my laptop, prescription lorazepam (a benzodiazepine which is a restricted substance), some cosmetics, most of my clothes, and some hotel bedsheets are stuffed in my suitcase. There is vomit on the floor of the entryway closet. She has eaten some of my food. Most of makeup and shoes are still where I left them. It's now past 1am, I'm shaken up, and I have male company over so the security guard takes her information and escorts her out and the security guard and strange woman leave. Idk if this is relevant but male company stays over and leaves in the morning. As I am packing up, I notice two pairs of earrings are gone, which seem to be all that's missing. Value is about $300 which I suppose isn't that much in the grand scheme of things, but they were a gift from my now deceased mother. My father is dead and I have no siblings, so that shit meant a fucking lot to me. I came to checkout sobbing and filed a report with the hotel for their insurance to cover my earrings, but no one offered to call police and when I asked they said police would not come out for "something like this" and I could file a report on my own and tell the police that the Hilton has her information if they want it. I am meeting with the hotel manager when he arrives to work at noon. the hotel has provided me breakfast and is offering a refund (I booked through a third party, booking.com, so they said this might be complicated.) Am I entitled to anything more? Are they low-balling me here? They're implying an actual staff member let this woman into my room while I was out, but that they can't tell me if they ultimately find out this is the case for privacy reasons. Isn't that a huge security issue for someone to do that to a guest? Long wait times to get to work through security access points. Posted: 16 Apr 2019 05:11 AM PDT This is Texas. So my job has a lot of security to get into where we are supposed to work. We have to pass through these checkpoints to get to essentially the job site. Asking management and their expectation is that we will be passed these security checkpoints and on job site by the required time which is 6. The issue is it took me 25 min of standing in line today to get passed this checkpoint and into the jobsite. They are also trying to cut costs and reducing the manning of said checkpoints so I only expect the wait times to get worse unless they take some action, which is doubtful. So the question is what is considered unreasonable by law to where they would be required to pay for time spent waiting in the line to basically get into work. Spending more time in a line then my commute to work is kind of ridiculous and I really dont enjoy the idea of spending 40 min of my day unpaid for something I have no control over. This caused his picture to be used on news article discussing how the measles outbreak started by a jewish boy in Israel and showing his picture. A charity even got hold of his picture and used it with the caption "He doesn't know that his parents can't afford food this week" and this was in the city where his parents lived. This happened right now, I left my 18 yr old and 12 yr old son at home, while I ran errands. I came home to find that my hydrocodone pills were missing. My 12 yr old sons friends came over while I was gone. Rummaged through my belongings and took the pills. I called the police and the grandparents of the child who took the pills. The grandmother admitted the son took the pills and was on their way to the hospital because apparently he took 3 of them himself. I usually lock the pills up but was in such a rush, I forgot. Boss told me to pump in a bathroom [WV] Posted: 16 Apr 2019 09:13 AM PDT Let me start off by stating that I work at a bank. I just returned from maternity leave 2 weeks ago. The bank that I work at has a "lactation policy" that allows me to pump for 20 minutes whenever I need to and states that the bank must provide me a space to store my pump and expressed milk. There has not been an issue until today. The room that I usually use is an empty office space. Today a coworker notified me that she was going to use the room for phone calls and that I would not be able to use it. I notified my manager and asked where else I could use. She responded by telling me that I could use the old restroom. The room no longer has a toilet but is now used to store trash containing food throughout the week and still contains a sink. There are no tables to set the pump on and the room smells horrendous. The manager also told me that I could no longer store my pump in the room that I was previously using and must keep it under my desk beside the trash can where it is liable to get kicked or damaged. I contacted HR but have yet to hear back. What other steps can I take or am I out of luck and better of just taking my chances and pumping in the restroom? [link] [comments] |
I won in Small Claims - Have no idea what to do now [NJ] Posted: 16 Apr 2019 09:12 AM PDT I run a very small business - Had a client bounce a check for $2000 - He gave me a sob story, boo hoo - He said he would make payments - Payments never came - He stopped answering phone, email, text, or any communication - I find his social media, he's taking vacations, traveling, enjoying expensive dinners, clothing, etc - He moved out of state - I found him and finally got him served - He never showed for the court date - I won in small claims and have no idea what to do now - The ladies at the information desk were extremely unhelpful and gave me a photocopied pamphlet with missing information. I found out he moved again, back to NJ. I was doing all of this by myself and have pretty much hit a wall. I have called 8 different lawyers/firms and they have all either said "Sorry, It's just not worth our time" or they simply don't return my calls. I have won in small claims, but what can I do now? I've read that I can Garnish Wages, Levy Bank accounts, etc ... but going about how to really do these things is becoming a nightmare. I do not know where exactly he is living now (in NJ). His linkedin info does list what I believe is a current job he holds. I have no idea what forms I can file now or which court to file them in? I would love to get my money. The bench in itself was very dense and heavy, but it also had the weight of my friends sitting on it as well. So yes, that shit hurt. I'm a 5'2" female, 120lb female, so all of that weight directly slammed into my calves was horrifyingly painful. Even while intoxicated, it still hurt very badly and there was immediate bruising. I am now having trouble standing, taking stairs, walking my dog, and even putting pants on is painful. I have pictures/video of the collapsed bench as well as the severe bruising and cuts on both of my legs. How do I go about resolving this with the bar? [link] [comments] |

Also, English is not my first language, I'm on my phone and it's my first post here. Basically I went to buy some groceries at the supermarket that is in font of my house, I was finishing paying and heard a loud crash. Went outside because it sounded like a car crash and I see a plane sitting on top of my house. The plane soon after caught on fire and almost all of the house burned down. It happened about 1 hour. The firefighters extinguished the fire and they found the crew of the small plane. All of whom died in the crash (8). Now Mr and my family don't know what to do in this case. Employer claims to have caught me stealing... Posted: 16 Apr 2019 10:45 AM PDT I work for a small family owned company in California with less than 10 employees doing retail sales. My employer is claiming that I've been consistently stealing from the store. They found some video footage of me taking cash from a lady for something unrelated to the company I work for. I had done some freelance work for her and asked her to meet me at my work to hand me the money. Might have not been the best idea because now my employer is saying he's found more footage of me taking cash from people and pocketing it. I explained to him that this work was done on the side and it's nothing our company offers, but his side of it is that the transaction is still done on company grounds and that we actually can offer the service if specifically requested (I had no knowledge of this during my one year of working here). He's also terminating my employment. He's going to determine the amount stolen based off any discrepancies in the credit card to cash ratio per shift. Basically it'll be based off estimates. So if normally the cc to cash ratio is 70/30, and if he finds a shift where I sold 90/10, then he'll take that difference and put it towards the balance I owe him. He wants to give me my last paycheck because apparently legally he has to, then he wants me to cash it out and give him the full amount back. Then he's going to hold my money for 7 days until he investigates and calculates everything then if there's any remaining money he'll pay me the rest back. He also has been paying me my paychecks through paypal. I did fill out a w2 (after having to request one when he handed me a 1099 when I first started working). Is any of this legal? When there are no customers on lot I'm often forced to clock out and wait until we get a car on lot and then clock back in to do the work. Posted: 16 Apr 2019 11:37 AM PDT After roughly 3 years since I found this felony on my criminal record, it's been resolved as of today! After trying a variety of things, mainly contacting everyone I could on my own (clerk, judges, probation people)who would answer me, I finally broke down and hired a lawyer as my efforts were fruitless. It ended up being a longer fight as they would not accept that someone could put a failure to maintain lane ticket into the system as felony drug possession thus another year of investigative work needed to be done to resolve it as apparently I needed to prove my innocence. They were sure they were right and the actual records just needed to be found. Basically my lawyer had to come up with all the evidence he could find that I was never even charged for the felony that was on the record and the only thing I did get convicted of on the date in the record was the failure to maintain lane ticket. He ended up documenting every time I've ever had contact with the law including contacting the police department that issued my tickets and got together with the judge, DA and Clerk to review everything he collected and compare it with their records. They finally acknowledged that their investigation turned up nothing and with his meticulous reconstruction of every instance where I interacted with the law throughout my life, they agreed to remove the record from GCIC. I have confirmed I'm no longer listed as a felon in the GCIC but I haven't checked outside agencies. I guess I'll deal with them as they come if they have the felony in their databases but the important part is to the Law I'm good again. Thanks for all the advice and stuff, I took it all to heart and did most of the suggestions (if the lawyer didn't work the next stop was ACLU and the media which I wasn't looking forward to). Her family is much wealthier than mine and owns a number of rental properties in CA and said that they will allow me and her to live in one of their homes for convenience (distance to work) and to save money as rent and home prices are so high in this area. At first I didn't want to do that because of being in "soft debt" to her family for allowing us to live at a place rent free, but after looking around at the exorbitant rental costs in the area, I relented and agreed to move in to one of their homes. I did not sign a contract, nor was there a rental agreement of any kind. Her parents simply said that, as long as we are engaged they'll allow me to live there, and won't take rent. My fiance did not have to pay her family rent either. Fast forward to about 1 month ago - our relationship soured and she gave me back the ring - so I moved out all my stuff and am now living elsewhere. I got a text message and phone call from my ex's brother stating that since I am no longer their future family, I am responsible for back rent for the months that I stayed at that home for 9 months, to the tune of $18,000. Since I never agreed in writing to any payment, was never under the expectation to pay, do they have a case to ask for this money? The only indicator that I lived there was that I did have some mail delivered to that home, but I have since changed the delivery address (for most things at least). The name of my grandfather is on the mortgage, but not as the owner of the house, I think he just helped them sign. After my mom and ex parted ways, the house has finally been sold "as is", but now the buyers are threateting legal actions because the eletricity wires are melting, the pool is not like on the images, etc etc. What are the recourses for my grandfather to dismiss this threat? If he really sold the house "as is", does the buyer have any recourse? The buyer didn't pay for an inspector before buying the house. Is this just a bluff? The ex is hiding, so my grandfather is the only one to receive the threatening letter. The ex and the house have been a problems for a long time and we finally tought that it was case closed. I'm thinking that the ex might know the buyer and they teamed up to steal more money from my grandfather. Should we go see a notary? Suddenly, 4 months in, without any discussion, he told me people were coming to look at the apartment (a condo). Originally he said it was "investors looking to buy his portfolio of properties". I quickly realized it was not. I would guess that we have let in around 35 people or more since February. Most have not been investors. Most are people shopping for a home, and they are shocked to find out we live there and plan to stay until October. Many are angry for their time being wasted (fair, but it is always directed at us who absolutely did not sign up for this!) These visits are all Week, and on the weekends. If we aren't available, he expects us to give them the code to our door so they can let themselves in. I have let him do this a couple times but it has gotten out of control. The landlord lives in another state and I have not even met him, nor does he attend any of these "showings". There is always ta realtor with them, but the realtors almost always seem floored by not having been told people are residing there and plan to for 6 more months. I have expressed my unhappiness in a polite and fair way with the landlord after he told me he had three showings this weekend and Monday. Of course, I have to keep my home in museum type shape to show to potential buyers. Apparently, at all times... The landlord has not responded to me since Friday when I told him how we were feeling. He has been told a few times that the shoppers are unaware of our living there. I have even gone so far as to contact the realtor who is apparently scheduling the appointments. She said she would talk to him, because she was under the understanding that our lease had something that would force us to move 90 days after a sale. Our lease does not have this in it, I have had it checked by a realtor and several other people. People are now showing up on our doorstep without anyone telling us at all. This happened twice last week. What are our rights? Are we doomed to deal with this for the next 6 months? Do we have to let people in all the time, if given 24 hours? Is it reasonable to ask for a rent reduction or to be let out of our lease so we can leave the situation? We want to be cooperative, but we pay a LOT of money to live there and we are now trapped there with people in and out every week (even when we aren't home), and forced to keep everything clean and tidy every day of the week. About 8 or so years ago my neighbor began building a barn right on our property line. We had a survey done and it turns out, about a foot of one whole side is inside our line. We let it slide, as we were generally friendly with the neighbor and we weren't really using the space. However, we have since gotten a little less friendly, as she seems to have a flair for petty drama. We are by no means hostile, but we're not friendly. Anyway, we live in Oklahoma, and the laws look like they say we only have two years to challenge the adverse possession and the person has to reside there for 15. Does this mean that we are SOL or does that mean that we still have a chance to stop her from claiming adverse possession in a few years? Calling animal control on my father... Posted: 16 Apr 2019 03:52 AM PDT I'm in Tennessee, USA. My father recently adopted a one year old pitt bull. The dog is sweet, has no aggression issues and is very lovable. He adopted her shortly after his previous dog was put down due to health concerns. Here are my concerns:
So my question for you guys is this: I really want to call animal control and have them investigate, light a fire under him and perhaps even just take the dog. She's not being well cared for. She's abandoned throughout the day and is living in squalor. Would him living on our property (we own it and he does not pay rent though he does pay the electric and water as his camper is hooked into it) make us legally responsible? If I call animal control, would my husband and I be just as at fault? The dog legally belongs to my father, he is the only one on her adoption contract. We have three cats that are well cared for, always up to date on vet visits (they even get 6 month check ups just to be sure they're healthy) and are loved and showered with attention and affection. Would calling animal control risk us losing our cats should they deem the dog to be neglected? Please let me know what you think, I've been going back and forth on this. [link] [comments] |

Last summer one of our friends came home from basic training with the military and didn't have anywhere to stay so we let him crash. A few months go by and he's still living with us and he had changed his address to our address. Both with the military and the sherif for his carry permit. At which time we asked him to start helping with utilities and paying some rent to us. Unfortunately we had a falling out and he no longer lives with us but he still has his checks from the military and all his mail, insurance, etc sent to our address. We have asked him to remove our address from his things but he has yet to do that. I looked up about how to notify the post office that he no longer lives at this address but I'm not sure if with him living here while not on the lease, I can get in trouble for removing sending the mail back with "return to sender".
