My car was declared totaled over a purely cosmetic problem. I am now being told I can't drive it legally anymore. Is this normal?

    Posted: 10 Aug 2018 01:53 AM PDT

I live in Denmark so it might be normal here. I have asked on r/Denmark but also wanted to get opinions here.

My older 2010 Peugeot 307 (with moderately high mileage, but not super high, I think like 150,000km or so) was hit while parked by a neighbor. A police report was filed and the guy who hit the car's insurance company accepted 100% of the fault.

Right after the incident, I took the car into my mechanic to see if there were any safety issues. He looked it over and said the damage was just cosmetic and it was safe to drive.

Initially since I was in the process of moving and didn't want to be without the car, I put off getting the purely cosmetic repair done. I've driven it a lot, many thousands of km (if I count it up it might be close to 10,000km, much in harsh winter conditions in Lapland), with no problems. When I moved back to where my husband (and the car, we bought it there together) is from in Denmark, he also took it to his mechanic (for a routine oil change) who confirmed that it is safe to drive.

Now that we are settled in, my husband took the car into some random Peugeot associated body shop he found via a google search. The estimate was something like 30,000 DKK. Basically there is a big dent in the side panel and in order to perfectly restore the car the whole panel needs to be replaced. The insurance adjuster present at the assessment declared the car totaled since that is about what it is worth on the open market now and in Denmark the limit of repairs is 65% of the value. Both our insurance and the guilty party's insurance companies have told us that since the car has been declared totaled, it can no longer be driven. I've never heard of this before for damage that was purely cosmetic; I thought cars were only prohibited from roads if they posed a safety risk. We are both shocked about this. Is this normal? Both the bodyshop guy and the insurance adjuster agree with the previous two mechanics that the damage is purely cosmetic. It is not structural, the damage is minor in that it in no way compromises the safety of the car. The only reason it's so expensive is that for a "perfect" repair the whole side panel would need to be replaced because just patching the dent would leave it still visually obvious. My husband has since called a few other body shops who said they think they can do a (visually imperfect) patch job for half the price we were quoted by the insurance agent was not ok with us getting a second opinion at another shop. Despite that, the insurance adjuster says that's just how it is, that if a car is declared totaled for any reason then it is no longer legal to drive it, even if that reason is simply that the price to repair a cosmetic defect is higher than 65% of the car's value (which it is, the estimate is around 30,000kr so the price of the car). So we can't just cancel the claim and walk away or accept a lesser amount of money and pay the rest out of pocket.

They haven't made an offer yet but neither of us want to give up the car no matter what the offer is since we like it and it's performed well. We also don't want to throw out something that is perfectly usable until we have to due to mechanical or safety problems for conservation reasons. Cosmetic problems aren't nice, but they aren't really something to throw a perfectly functional car away over in either of our view. It seems incredibly wasteful and unfair.

Is there some way to keep this car? The guilty party's adjuster told us that there's basically no way to do this, that their policy is that they will put it up for auction to sell to a chop shop and that the highest bidder wins. So we can't just buy it back from them. Is there some government body we can contact to seek advice? Is getting lawyer for something like this advisable?

Someone says they can get insurance to pay for a new roof--is this a scam?

    Posted: 09 Aug 2018 04:10 PM PDT

Someone who works for a roofing company came by my house today and said that they could inspect my roof for storm damage, and if they found any damage they could get the roof replaced and paid for by insurance. The obvious catch is that if it does get replaced, their company would be the ones to do it. They did find storm damage, and said they could get me a new roof for the cost of my insurance deductible (the storm damage isn't surprising at all, the roof is probably 20+ years old).

I've only been owned this house for ~6 months, so it would be immediately obvious to any insurance adjuster that the long term damage was not caused by a storm. Is this a scam of some sort? If it's not, would there be any downside to going through with it, like my insurance premiums increasing? Is there any way that if the insurance didn't cover the entire cost, I would somehow be on the line for the remainder?

    PTSD from car accident?

    Posted: 10 Aug 2018 03:36 AM PDT

Posted this on mental health too. Sorry for the long read.

I'm not sure what do. Recently I had my truck fixed from an accident. I was hit head on by a drunk driver.

I get my truck back and everything is fine for about a month. One night I'm driving home and my front left wheel completely comes off of my truck. Thankfully I was only a half mile from home when it happened. I was fine, no injuries or anything.

I took my truck to the dealership instead of the shop that did the repairs from the accident. They told me that everything had been improperly repaired and explained why the wheel came off. They fixed it, all new parts, everything was redone on both the sides of the suspension.

I know that everything has been fixed. I've had my truck looked at during oil changes and regular maintenance several times over since it was repaired the final time. But I just can't shake this constant fear that I'm going to be driving along on the highway at 70 and the wheel will come off again and my truck is going to roll.

I drive 100 miles a day for work and it this has really been cramping my routine. I can't bring myself to drive over 55 on the highway even in 65 stretches or higher.

I was getting a little bit better but I was heading to the store earlier this afternoon and an SUV in front of me had its wheel and suspension components went flying off and the SUV grinded into the jersey barriers.Tonight I got on the highway and could feel every bump in the road, hear every noise, and immediately had to get off the highway and take an extra 20 minutes taking surface streets. I spend easily two hours a day on the road if not more and the entire time I'm just filled with anxiety.

My tire came off months ago, but I haven't mentally been the same since. Wondering if there's any insurance options from either mine or the shop that did the repairs from the accident after such a long period of time for mental health issues.

Anyway, headed to bed. Thank you to those that took the time to read. Any helpful tips would be appreciated.

TL/DR: Anxiety while driving after botched repair job caused vehicle tire to come off. No physical harm, only mental. Was nearly 6 months ago, but still having mental issues. Any course of action?

Same Car Insurance Company - Spearate Policy from Parents

    Posted: 10 Aug 2018 02:20 AM PDT

    I'll keep it snappy

    My parents and I:

    • Have Geico Auto insurance
    • Have Exact Same Coverage
    • Live at the same address

My parents have their two cars under their own policy

I have my own car under my own policy

The reason I have my own policy is because the monthly payment would be cheaper for me (for some reason) rather than have it with my parents

This means my parents are not listed as drivers under my policy and I'm not listed in their policy.

The guy who sold me my policy (my dad was there with me) told me that if I got in an accident while driving their cars or they get into an accident with my car, we would still be covered even if we aren't in each other's policies. Is this true? I just wanna be 100% we are still covered because I don't wanna deal with the whole "they weren't listed in your policy" exuse if we ever got into an accident.

My mom sometimes drives my car because it saves gas and I sometimes drive my dad's truck for work relatated commutes. I wanna be certain we are covered.

Student Health Insurance not covering lab costs

    Posted: 09 Aug 2018 07:39 PM PDT

Hi everyone, first time poster here and I have UnitedHealthCare Student health insurance. I recently went to the student health center a month back for some fatigue and because I had a new sexual partner. Also had some ED (lol....) so wanted to get that checked out. The visit was fine, the doctor and center claimed my labs would be covered by the student health insurance or at least should get a subsidized costs so they ordered a CBC, CMP, TSH, Thyroxine, Testosterone, and Lipid panel. Per the student health insurance plan, routine labs are covered.

Well I got a bill for the full out of pocket costs for the lab costs and I was very shocked because I thought it would be subsidized but I got a $90 bill. Furthermore when I called UnitedHealthcare, they said on their end the bill should have been $348 not $90 and I am SHOCKED. Now looking back, the $90 bill is not so bad looking anymore... The lady at UnitedHealthcare customer service did not help me after, claiming that any labs ordered by the doctor can be denied if United feels it's not warranted, which is NOT in the plan (as far as I can tell) and now I'm regretting ever going to the doctor.

Do I have any recourse and any idea why there's a discrepancy between $90 and $348? Anyone else have experience with student health insurance and lab costs? Thanks!

Negotiations not going well in a third party car insurance claim

    Posted: 10 Aug 2018 01:36 AM PDT

Please disclose whether you have ever been employed either directly or indirectly by a car insurance company.

I have stumbled upon https://developer.marketcheck.com/index and wrote an application to gather listing data for my car a month prior to the date of loss date of my car. The insurance company hired CCC to do a valuation of my car. They were able to supply a single comparable two weeks after the date of loss of my car.

I have written a program to scrape the database to find every single VIN that was listed. Parsing the data, there were 40+ listings. The database was able to find the CCC comp. However, the data shows that CCC provided the second lowest listing price over the span of two months before and two weeks after the total loss date.

I have since asked the insurance company to run another valuation, it found a second comparable below median value. What is interesting about these listings is that ALL comparables are great matches for the car, as EVERY car that was manufactured at that time were identical with the exception of wheel options and color.

Questions: * The insurance is not budging on their valuation, where do I go from here? * Is it possible that CCC is not operating fairly?

Car Accident - Adjuster Questions on Cell Phone Use

    Posted: 09 Aug 2018 09:48 PM PDT

I was just rearended and I have yet to give my statement to my insurance company. I heard that insurance now frequently asks people "were you using a cell phone?"

Personally I had my phone mounted on my a/c vent, listening to music but not touching it or talking on the phone, and I wasn't looking at it when I was rear ended. I know it should be a simple case but I wanted to be prepared to answer honestly yet not foolishly (for this accident or any other)

Car Accident: Are there any cons for agreeing to a 50/50 split liability?

    Posted: 10 Aug 2018 12:04 AM PDT

I was involved in a minor car accident (another driver reversed into my front bumper at a gas station) and my insurance company was not able to obtain the video footage due to their negligence. Since there are no eye witnesses, the other driver is denying fault and now no video footage for them to review, they offered to split liability 50/50 and the other driver's policy would cover half of my repair expenses. Could agreeing to this negatively affect me in the future? Should I make a fuss because they were not able to obtain the footage? The insurance co claimed this would not directly affect my premiums, but I'm worried how receiving a fault on my record could influence future accidents and/or costs.

swerve behind a car in reverse for free repairs?

    Posted: 09 Aug 2018 11:53 PM PDT

A guy in an alley saw me backing out of a parking space. instead of waiting he just hit the gas and swerved behind my already reversing car. I backed into his car at 4 mph, while he was going 17 mph approximately 5 feet behind my car. I was found to be 100% at fault and all his repairs were free. Does this mean that all you have to do is find a car backing up, hit the gas, swerve close behind it,and if that car hits you, you can go to town by playing insurance for the payout/ repairs?

Hit and run and permissive driver - GA

    Posted: 09 Aug 2018 09:21 AM PDT

Let me preface this with saying that I'm a total loss adjuster with experience in handling simple liability claims but I'm trying to make sure that I'm being logical.

July 17th, got into an accident. Double left turn, other driver sideswiped my driver side quarter panel. Have a dash cam. Filed police report. Sent dash cam footage to officer who then wrote report based on footage and license plate.

Filed a claim with Country Financial against their insured. They had an estimator come out.

They haven't been able to contact their insured since the accident. At first I was told that they have to send out communications to see if their insured would respond. I understand the protocol.

But now after 24 days I'm being told that they still need to contact their insured to see if the driver had permissive use. Uh....ok?

In every claim that I've reviewed or handled, if the other person has footage/unbiased witness and a police report we will usually establish liability adverse to our insured if we've given them ample time to respond.

    What am I missing?

Edit 1: they denied the claim due to non cooperation. Evaluating options.

Edit 2: they just reversed their decision and accepted liability as their insured randomly contacted them today.

health insurance said bariatric surgeron in network, now they've changed their mind

    Posted: 09 Aug 2018 05:47 PM PDT

hey! quick side note - our insurance is compass rose, who manages umr i think? which is part of united healthcare. but the bariatric part is managed by optum. this is a fucking mess. we live in virginia, usa.

My husband has been wanting to have bariatric surgery. In January he, as well as his selected doctor's secretary, called the insurance company to make sure the hospital and doctor are in network. Both he and the doctor's secretary were told yes, both are in network. so my husband has spent the last 8 months jumping through all the hoops that the doctor requires before he will perform the surgery (psych eval, joining a support group, meeting w/ a nutritionist etc). he finished all the hoop jumping and his surgery was scheduled for october.

my husband got a call today from optum stating that both his doctor and hospital are out of network. when you look the doctor up on their provider listing, he is listed as in network, plus on the phone in january they told him and the secretary both were in network. when i called optum and spoke to someone different, they said the doctor was in network but the hospital was out of network. per the doctor's secretary, "UHC has told us that they misquoted your bariatric benefits to our office" and that my husband would have to start over with a different doctor at a different hospital. the doctor's secretary asked a supervisor at optumif the decision could be appealed, and they said no and were not willing to budge.

is there anything that can be done? when I searched, everything was about people who'd already had treatment and were appealing the claim. we don't have a claim yet. we have had to fight with them over every little thing this year. we've already met our deductible and if my husband has to start over, that will put us into next year, so we will have to pay our full deductible again.

Who is at fault if there is no impact between the two drivers but one driver causes another to crash while avoiding impact?

    Posted: 09 Aug 2018 12:51 PM PDT

Sorry for the terrible wording, was not sure how to better explain this.

Just wondering how this stuff plays out. I ride a moto and there are times where it makes more sense to try and dodge one thing (vehicle which impedes my path, original cause of accident) even if it results in a sure crash with a softer vehicle or object afterwards (or at least buys me some time to slow down and lessen the impact). I just wonder if that just results in me being 100% at fault for the accident.

    Just seems like a lose(maybe die)-lose situation.

Commercial auto insurance for Van that will be slept in.

    Posted: 09 Aug 2018 08:40 AM PDT

Hi all, I'm writing to see if it is possible to insure my use case.

I'm a sole proprietor who wants to insure a (new to me) Ford Transit 350 for business/personal use. Business use is approximate 50-80% (don't know for certain yet).

I do environmental surveying, which basically means I go to remote parts of the country and fly drones.

I want to purchase the transit and put a bunk and desk in it - similar to typical vanlife conversions (but not as fancy). This would allow me to sleep in the vehicle when I staked out in the middle of nowhere (which is often because I mostly work in eastern Montana).

When I'm not using it for work, my family and I can use it for camping and road trips.

I've got a clean auto history and have carried personal auto insurance through USAA for more than 20 years. I've talked with USAA and 2 other insurers, and they say they can't insure the vehicle.

Do I have any options? Thx.

Rear ended in a rental car

    Posted: 09 Aug 2018 07:56 PM PDT

I'm back on reddit once more. Merely one week after finally getting my insurance rates fixed, I get rear ended while stopped at a stoplight. Luckily, i kept full coverage due to being in a rental.

Im currently in a 2018 Chevy Malibu rental because my ford fusion has deadly airbags.

The rental needs a new bumper and rear trunk. I have the other driver's name, phone number, insurance and police report. I've already contacted my insurance and i did not utilize the rental company's insurance.

My question is: how much is this "free" rental about to cost me? As a broke college kid and with my history of getting fucked by insurance, i may need to borrow money.

Auto: My car hit a pillar in parking lot. No DMV points even after 8 months?

    Posted: 09 Aug 2018 01:32 PM PDT

My previous insurance paid nearly 3K for fixing my car door. The pillar had no damage. My rates went up. But, I don't see any DMV points for this, and it has been nearly 8 months.

My question is if it is not worthy of a DMV point, should I still report this when moving to a new insurance provider? I am currently looking to see if another insurance provider will do at a lesser premium.

Home owner's insurance premium after claim

    Posted: 09 Aug 2018 01:10 PM PDT

Some damage was done to my siding by a contractor. They did come back a few times (each time after numerous reminders) trying to fix it, but without success. The remedy will be to reside at least part of the house, if not all (since new siding wouldn't match). It seems they are waiting me out and don't want to claim this on their insurance.

I can claim this on my home owner's insurance who would then try to get their money back from the contractor's insurance. That way I won't have to deal with the contractor/contractor's insurance myself, but will have to pay my deductible (unless they get that back from the other insurance).

What worries me the most is if my insurance premium were to increase drastically. My insurance company cannot tell me the likelihood of my premium going up after such a claim or not. They cannot even give me a worst case scenario (% of possible premium increase, if at all). They also cannot tell me if it would ever go down again or if this would forever be held against me.

Does anyone have any experience with home owner insurance claims, what makes premiums increase, does it ever go down again?

The repair would cost about 10K, my deductible is 1K, home assessed value is 155K in case that helps anticipating the insurance company's Math regarding premiums for next year. Any input will be helpful. Thanks!

Front ended in parking lot, exchanged insurance, need advice!

    Posted: 09 Aug 2018 06:40 PM PDT

    Hi all,

While I was parked at a grocery store, my car was hit in the front by an SUV. Long story short, the damage was small but I got their insurance info. They asked me to get a quote and try to handle it outside of insurance companies. I think it will be below 500 dollars in repair but I have yet to get a quote. If I do get a quote, get the money from the driver, fix the car then end up getting charged higher than the quote and the driver refuses to pay the difference, can I file an insurance claim? How should I handle the situation while protecting myself? I want to help the driver out but at the same time not screw myself over.

    Welcoming Opinions On Car Insurance

I'll be making roughly 600-700 monthly where I work. car payment will be approximately $100/200 a month. phone bill is $70. Pretend youre my parents lol, what car insurance do you suggest and are there any tips/tricks to this process? I feel so lost and confused about it all. thank you so much ETA: I'm in North Carolina

How long does it take for insurance case to go into arbitration?

    Posted: 09 Aug 2018 01:57 PM PDT

I was involved in an accident last month. We exchanged information with the other driver. His insurance collected both our stories of what happened and in less than two weeks, I had received a letter from his insurance(USAA) dismissing my claim.

My insurance(Metlife) on the other hand, three weeks after reporting, they still hadn't gotten the other drivers story. They say they had spoken to the insurance but hadn't been able to reach the driver even though a customer assistant said they had called him only once. It's now 5 weeks after the accident, almost 4 weeks since I was dismissed by USAA and my insurance(or I should say adjuster) is still dragging their feet, no progress update whatsoever.

What time period is reasonable to wait? Should I call back in and complain because I'm getting really impatient.

    Advice on salvaging this situation

    Posted: 09 Aug 2018 01:29 PM PDT

    Hi all,

My mother was in a slight accident a few weeks ago--someone took a left turn, didn't go wide enough, and scraped her car. Her car was damaged (slightly, mainly paint, and the evidence is essentially gone because a friend cleaned off the paint--only a barely visible scrape now); their car was fine. Here's the mistake: my mom, being old, stressed, and in a hurry, let them drive away. Now she's being told by her insurance that they filed a claim against her. What steps can we take?

(Also, am I wrong in believing that you should always take insurance info + call police? I feel like this situation is inevitable if you don't.)

    Thanks in advance.

Someone hit my father's parked car while he was still in it

    Posted: 09 Aug 2018 12:37 PM PDT

I got a call this morning from my father saying he's been hit by another vehicle. Apparently he had just finished parking his vehicle on the side of the street when he felt a large impact from behind. A lady ran into his parked vehicle while he was still sitting in it. He complained of neck and shoulders pain and the lady accepted fault and apologized. She told my father her young daughter (who was in the backseat) was trying to get her attention so she turned around to talk to her ..that's when she hit our vehicle.

My concern is that no police report was filed since he was late for work. However, they did exchange information and pictures of the accident site was taken.

Should we contact an attorney? Should we call the lady's insurance and file a claim with them or go through our own insurance?

Other driver drove into the grassy median to overtake a car and then rear ended me. She is claiming I abruptly moved into the lane when she was a few feet away from me but it was 300+ feet when I did. I'm being accused of an improper lane change?

    Posted: 09 Aug 2018 03:49 PM PDT

So there was a construction zone with orange cones in the left lane about a couple hundred feet ahead of us, all cars were in the right lane. We'd been in stop and go (5 mph) traffic for about 20 minutes and it's been like this for weeks on the bypass. A girl 300 or more feet behind me gets into the left lane and a SUV a couple cars ahead of her goes to the left lane to block her and me and two cars near me also go into the lane. She waits a couple seconds and then goes around it with both wheels going through the grassy median. She then rear ends me. I believe she was trying to pass me via the grass but didn't time it right because her right front bumper hit my left rear bumper when we were both in the left lane, so she was already in the grass.

The police officer told me that it isn't illegal for her to cut in front of everyone but clearly she made a bunch of reckless decisions and I shouldn't have tried to block her. She didn't get a citation.

I told this to the adjuster for my insurance as well as the other insurance. I also gave a license plate number of the SUV she went around. They are saying that based on her statement (they didn't contact the potential witness), I abruptly swerved into the left lane a few feet before she got there which is untrue.

How can they say I'm at fault based on hearsay? Shouldn't it default on the person who does the rear ending? My car is totaled. She destroyed the bumper and the metal frame is bent close to the tire.

Is there anything I can do?

Determined at fault for avoiding an accident with one car and hitting another.

    Posted: 09 Aug 2018 03:20 PM PDT

I was in slow traffic (<30mph) lane splitting between the #1 and #2 lanes on the freeway in California. A driver in the #2 lane jumped into the #1 lane with me in between without warning. I avoided hitting him, and ended up hitting another car because of this abrupt change in direction. I was going 30mph before he jumped lanes, and 15mph on impact with the car in front of him. I dont understand how I am at fault. My insurance company basically told me that because I hit the front car, instead of the car that jumped in front of me, I am at fault.

I initially tried to report the incident to the CHP, and was told that there was no ETA on an officer arriving because they were tending to two other major accidents and a brush fire in the area. They told me I could report the incident over the counter at the CHP office which I will be doing today after work.

This is the diagram of what happened.
