Posted: 29 Dec 2018 10:19 PM PST My dad got angry at me for being loud, which is reasonable and understandable. However he proceeded to punch me in the face(multiple times) in a fit of anger and I punched him back as a reaction/self defense. I called the cops on him and the cops told me that he was "disciplining" me. This isn't the first time that my dad has assaulted me. My older sister who is 25 told me that my father has also physically assaulted her, and was going to file charges on him but the stature of limitations expired. My dad has bad anger issues and I'm fed up with it. Is there anything that I can do from here? [link] [comments] |
Posted: 30 Dec 2018 11:19 AM PST My boyfriend's sister in law abuses and over medicated her autistic child so I called Child Protective services on her months ago. I was living up there near his family and long story short, when I drove home for the holidays (was just supposed to be a short trip but all hell broke loose and my boyfriend quickly packed everything we owned and followed me down a few days later) He forgot this one painting that has been in the family for over 100 years and my grandfather gave it to me before he died 14 years ago. She and her husband sent me a video saying "this is for calling CPS, bitch." They're both clearly seen in the video and called it a priceless painting. Do I have any ground to sue or press charges? I wanted to see if anyone here might have advice before I go and shell out my savings for a lawyer. This was literally my most prized possession and my heart is in so many pieces because my grandfather gave it to me so long ago. I would give everything I own just to get it back. I'm living in Florida and this is all in Ohio. [link] [comments] |
Posted: 30 Dec 2018 06:57 AM PST One of those party churches moved in up the block from me and they play loud, wall-rattling music every Sat and Sun morning (8:00am ~ 4:00pm) as well as 3-5 nights a week (from 4:30ish ~ 9:00ish). I called the church higher-ups and they essentially told me they don't care about the neighborhood disturbance. I have called my local county sheriff but the church seems to quiet down when the cops show up and then play the music even louder once the cops leave. For the record, I have contacted our landlord who said he will try to speak with our HOA about the matter, but no luck thus far. At this point, I want to simply break my lease and move but I really don't want to be responsible for paying for early termination of the lease. Legal advice for moving or forcing the church to stfu would be greatly appreciated as I am totally out of ideas. PS - I normally wouldn't care about an issue like this but I'm going crazy being woken up by house music bumping through my house at 8am and then all day every damn weekend. TL;DR - Church is unimaginably noisy, can lawyers help? [link] [comments] |
Is evicting our 32 y.o. daughter a violation of tenant rights? Posted: 30 Dec 2018 02:40 AM PST Arkansas. Our daughter is 32 and still lives with us rent free. She only had a year of college left but she did not complete it. We thought this was a temporary break from college, but she never returned. She moved back in with us under the pretense of going back after a year. We've offered to pay for her to go back to school or complete a trade school, junior college, or certification program. She has declined. We've tried life coaches and therapy, psychiatrists, understanding, and tough love. At one point we were planning to sell the house when I had a work transfer out of state, and in that time she stayed with friends, who called us and begged us to take her back because she was such a burden to them but they didn't feel right making her homeless. We initially declined to take her back, but I ended up not being transferred, so we begrudgingly accepted her back (which in hindsight was a critical mistake.) At this point we feel allowing her to continue to live with us is not helping her and enabling damaging behavior patterns. Eight months ago we came to an agreement that she had to be working full time or in school full time if she wanted to continue living here. She claimed she was at a job but when we dropped by to give her her phone she'd left at the house her supervisor informed us she had quit weeks ago. We feel we have to be assertive now and follow through on our agreement that if she doesn't study or work she cannot live here. We would like to sell the house and retire. We've been warned by family friends that she could be considered a tenant or have squatters rights and evicting her may not be as easy as changing the locks, and that we may not even be within our rights to sell our house without her consent. Is this the case? Can we just list it, sell it, and wish her luck? I know we sound like heartless horrible parents. Clearly we've failed her in more ways than one. Our two other children are successful professionals and I don't know what we did wrong with this one, but we do harbor the responsibility. Any advice to do this legally and peacefully much appreciated. TLDR Our 32 year old daughter still lives with us rent free. We'd like to sell the house and retire, and we will not be bringing her with us when we move because she's failed to keep her end of the agreement (being in school or having a job.) Are we violating tenant laws? Thanks Edit: Wanted to add in case it is relevant, this has always been her address of residence and is still the one on her ID, if that matters. [link] [comments] |
Wife's painting used in Hollywood movie without permission or credit given Posted: 30 Dec 2018 10:18 AM PST Dont want to mention any specifics but it was in a recent movie and it was shown for about 4 seconds. They put a filter over part of the scene but its still really apparent it's her painting, if we do an overlay on photoshop it matches 100%. Not sure how to go about contacting people or if theres really anything that can be done. What options does she have if any? Edit: we live in new york Edit: sorry for the confusion, it was a digital painting she posted on her gallery online. [link] [comments] |
Posted: 30 Dec 2018 11:29 AM PST My neighbor shot my dog this morning while he was in our fenced backyard with a BB gun. Can someone help me figure out if I can make a case? We watched it happen from the window of the bedroom and when confronted he admitted to doing it. We had to take our poor 1yo mini dachshund to the emergency vet and had to pay a significant amount to get him looked at. Thankfully he is ok, just really scared. Is there any type of action we can take? We have called the police and they want to file a report but what should we do next? Edit: location is TN [link] [comments] |
17 year old female kicked out of the house. Not sure what to do Posted: 30 Dec 2018 06:11 AM PST So my brothers (m18) girlfriend (f17) was kicked out of her house by her mother yesterday at around 3pm. She kicked her out with any money, phone, or even shoes (its cold here). She walked miles to our house where my brother found her at around 11:30pm. They went to a cvs to buy tampons and crazy enough, the mother was there and she yelled and made a scene in the cvs saying that she cant be with anyone over 18 and shes gonna call the cops. My mom let her spend the night at our place, but we're unsure as what to do next. Any advice is appreciated [link] [comments] |
[RI] People parking illegally turn street into a surprise one way. Posted: 30 Dec 2018 10:15 AM PST Using a throwaway because people familiar with the area will know exactly where I live. This entire thing is happening in Narragansett, Rhode Island (I believe town regulations may be important here). I live in an ocean front community that is very popular for surfers. The streets are all very narrow and can barely accommodate two way traffic as is. There are also reeds and bushes everywhere, so there is poor visibility when pulling out or into the streets. Usually, this is not an issue during the off season because 80% of the residents migrate to Florida. However, when it is nice out, a ton of people come to the area to surf. In true Rhode Island fashion, someone made a public ocean access point... With two parking spots. This is where things get tricky, so I made diagram. The red in the diagram are the 12 or 15 pick up trucks and SUVs that will park on the street even though there are no parking signs. Car 1 turns on to the road heading east and must use the left lane because the right lane is occupied by parked cars. A huge note here is that Car 1 cannot see more than two or three car lengths down the road because of reeds and bushes. At the same time, Car 2 turns onto the road heading West, using their right lane. Car 2 can not see over the parked cars until they're half way through the turn. Now both cars are in the street driving towards each other. Here are my questions: 1) Legally, what should the cars do? On one hand, I believe Car 2 would have the "right of way" because they are in their right lane, however that means Car 1 would have to blindly turn onto a moderately trafficked main road. 2) If they have a collision, who is at fault? 3) Can I, a mere tenant, talk to someone about making these streets one ways with parking spots? Would they listen to me at all? I know that the solution here is to call the non emergency police number when people park illegally. I feel like a monster doing that, though, because parking illegally is pretty much the only option for surfers and the police have been turning a blind eye to it for years. Plus if it's a nice weekend, there will be 100+ cars parked illegally throughout the community. Thank y'all so much for the help! [link] [comments] |
I found child porn in ny uncles browsing history Posted: 30 Dec 2018 06:03 AM PST My uncle is away on vacation and asked me to tend to his dog while he is away. So yesterday after i got done walking his dog and we got back into the house i saw my uncles tablet sitting on the kitchen table. For some resson i had an urge to see if it was unlocked, and sure enough it was. Following that i decided to check his chrome browsing history and that is when i found it, he was searching for child porn. All of the sites had weird URLS and he was googling Tor, he also had a weird app called hook. After sering what he was looking for i decided to check his downloads and photo gallery, there was nothing incriminating in either. My question now is, what are the next steps i neef to take in this matter? Do i call the police? Do i tell my aunt (his wife)? I cant prove that he was looking at CP, just that he was looking for it. I also didn't have the nerve to click on any of his old links. He has always been known to be soemwhat of a pervert making lewd comments to woman and such but i mever thought he would look at child porn. We all live in PA btw. [link] [comments] |
My friend got a misdemeanor while working illegally Posted: 30 Dec 2018 05:55 AM PST My good friend works at a convenience store using a fake green card. It's his first week and accidentally sold alcohol to a minor. The minor was working with the police so he received a misdemeanor and a court date under his false identity. What should he do? Update: I forgot to include some details, he lives in California and is here on a travel visa, the green card was needed for work. The police did not say anything to suggest they knew the green card was fake since they wrote the ticket to the fake name. [link] [comments] |
Parents insist payment is legal Posted: 30 Dec 2018 08:27 AM PST Hi /r/legaladvice, I'm 26, make $25,000/year, currently buying a house with my S.O. My parents own a small business and want to pay me $10,000, then have me return that $10,000 to them to pay off debt. They're issuing me a W2 and insist that this type of payment is legal and people do it all the time, but my finances have been under a lot of scrutiny as part of getting a mortgage so I'm worried that this type of payment is illegal or could raise red flags. I've done a little research on it and my impression is that since I never actually consented to being hired, never performed any work for their company, and since presumably all of the hours I worked that this payment is based off of are falsified, this would qualify as some sort of fraud. I've told them I'm uncomfortable with this and want them to cancel the check and not issue me a W2, but they insist that this is perfectly legal. Am I being reasonable here, is this illegal? Pharmacy told my mum confidential information about myself despite my age being 19 Posted: 30 Dec 2018 12:49 AM PST Hi. I have been taking antidepressants for well over a year now, although I initially told my parents I was taking it I told them I was taking it due to 'panic'. Fast forward to early December and my mum comes home with my prescription with folic acid and vitamin d and also my antidepressants. She gets home and asks me why I'm taking antidepressants to which I ask what do you mean? Apparently the pharmacy had not only told her what they were but also criticised my choice for taking them and lectured my mum about it. I have kept the fact they were antidepressants from my parents because they are asian. I also know that they are not accepting of mental health illnesses as it has such a cultural stigma. I do not want the pharmacy to get shut down as I'm sure that it is a family business and their livelihood but I am also livid that they would divulge confidential information without a care. I would like something that would warn them or perhaps serve as a reminder to never spread personal information without consent. Thank you Edit: My mother is not fluent in English therefore I am 100% sure she did not google or read anything. The pharmacy has known my parents for well over 10 years which maybe why they felt they could do that. I have checked again and again with my mum to see if she's making it up but she is adamant she is not. Edit: Thank you for replying and explaining! [link] [comments] |
Posted: 30 Dec 2018 08:46 AM PST My best friend (23F) will be going through a divorce with her husband (22M) soon and they have an 8 month old son. Last night they got into a fight and he threatened that if she left him, he'd kick her out and take their son, and the court would be on his side because she has nothing and is completely dependent on him. I told her that's just a bull shit threat and courts will rarely rule against the mother unless there's proof of significant abuse or neglect. She already has postpartum anxiety and that made it worse ten-fold. Now I'm trying to ease her nerves. She is in Kentucky. [link] [comments] |
Posted: 30 Dec 2018 11:17 AM PST I'm on mobile so, sorry for formatting. So I just moved to a college town and am starting school extremely soon. I toured an apartment in October that they were still renovating and was promised it would be ready by December. It wasn't, so i had to sign a lease for this apartment I hadn't toured in. Of course I filled out the list with every problem I encountered, but now that i'm unpacking i'm finding more and more wrong with the place. First night there the kitchen was covered in roaches, and I didn't even have any food products in the apt yet. Called the property company first thing and they sent an exterminator over. Exterminators were very sweet and told me the past tenants clearly had an infestation. Fine, whatever I move on. Now it's the 3rd day and I have a migraine and no voice. I thought maybe it was just the type of sick you get when going to someplace new but I kept unpacking. I go into the bathroom (that has always had a funky smell) and am filling the closet with stuff and i notice there's this pocket behind the wall of the tub. I look up and there's this shit on the ceiling. Past reviews of this landlord says they didn't do anything, and the roaches seem to be getting worse day by day. What are my options for breaking a lease, should I even do that? Can I get my deposit and rent back? TLDR; Moved into a shitty apartment three days ago (wasn't made aware of exactly how shitty,) and now I need to know if I can forcefully terminate the lease or if I can make them fix everything wrong with the apartment. Am I entitled to my father’s inheritance? Posted: 30 Dec 2018 07:06 AM PST So, I'm (21M) from Brazil. And on mobile, sorry about formatting. I'm going to tell the short story: So, me and my dad have a broken connection. He abused my family when I was young and I left. He is a powerful man here on my country. So, for some reasons, he ended up receiving a farm his mom had, even though he had no right to do so.She didn't want to left the farm to him, but because he is powerful, after she died he took the farm from her and his brothers. Now, he have a new family, and a daughter who is much younger than me. He is becoming old, and I would like to know if I will ever have the rights to the farm my grandmother wanted me to have it. Do I need to open a lawsuit right now?Everything he have will go to his new wife and daughter? My grandmother left so much things valuable to our family there. My father doesn't have contact with anyone from his family(brothers or cousins, nobody), only the ones to his new family. How does law help me in this case? Does his first family receive something? Thank you and have a nice new year [link] [comments] |

If you lost the tip of your finger at work, what would you do? [OH] Posted: 30 Dec 2018 12:20 PM PST So I work at a hospital, and while working on a bed it collapsed on me and jammed my pinky and ring finger in between some joints in the bed. I ended up loosing the top of my ring finger after getting out from under the bed. Hospital amputated it and now im getting worker comp and therapy at the moment. It was partially my fault because I pulled the copper pin out which made the bed collapse. OSHA came in and cited our property for not having a policy on working on hospital bed equipment or training available. Now knowing it couldve been avoided if I turned the bed on its side or had more help. Should I still speak to a lawyer?. I like where I work so i dont want to ruin the relationship I have with my workplace. [link] [comments] |
Being charged (19m) with reckless driving and other stuff for my friends (19m) injury (NV) Posted: 30 Dec 2018 01:35 PM PST All my friends were in town for the holidays so we all got together to go bowling. We get done bowling end up going into the parking lot and having fun just kids being kids. Running around hitting each other etc for fun obviously. Well one thing lead to another and one of my friends jumped on the hood of my car and we start driving around in the casinos parking lot slowly and he falls down and hits his head and has a seizure. The ambulance was called while we were taking care of him until they came and the ambulance called the police and they ended up arresting me for reckless driving and some other stuff (its a felony). I spent the night in jail and bailed out the next morning. Is there anything I can do other than lawyer up my friend doesn't want to press charges or sue. But the state is charging me not him. He is okay now and out the hospital right now and is back home. We are all 18-19 and I don't want a felony on my record which will ruin my life. When we were all just having fun and two mistakes lead to this. Is there any way I can get the charges dropped or at least reduced or should I just go and speak to an attorney? [link] [comments] |
County says I owe for Medical Assistance. I don’t have medical assistance. Posted: 30 Dec 2018 01:02 PM PST I got a letter from my county benefits office (I'm in PA) that says I owe for medical assistance coverage for the months of June, July, and August of 2018. The total costs is $1415 and change. The letter stated that because I received pay from my employer(where I've been employed for 7 years), I owe them the money cost for those three months. The problem is, I don't have medical assistance. I've never used it. I've had insurance through the marketplace since the year ACA became law. I have been paying medical insurance premiums through a national insurance carrier for years. I've never received EOB for MA. I've never received coverage info, a statement or any list of procedure coverages, nothing. I've received nothing to indicate that I have MA coverage. I'm going to contact my county's assistance office tomorrow. Could I be a victim of fraud here? I'm truly blown away by this. [link] [comments] |
(IL) Our landlord sold the house and we were given about a week and a half notice to be out Posted: 30 Dec 2018 01:44 PM PST As the title says, our landlord sold the house we were renting and the realtor called to say that the new owners wanted to be moved in by what was about a week and a half time. Unfortunately it isn't enough time for us to find a suitable house for our family. We spoke with the realtor who called to ask if we would be out by the 4th, to which we replied no, and said that it'd be nicer to have a month tops. She said it didn't work like that and said she was going to speak with their attorney on the matter. I guess what I'd like to ask is if it is legal under Illinois law for them to give such short notice to be required to vacate the home or if we're able to have more time. We also have no lease with the landlord. Thanks. [link] [comments] |
Posted: 30 Dec 2018 05:42 AM PST About a month I was on the highway and one of the front tires on my car (a new tire, mind you) seemed to explode out of nowhere and I lost control of the car. I tried to turn left to get on the shoulder, but instead the car veered to the right and I crashed into a car that was in the lane over. I called the cops to file a report, the road ranger came, and he ended up telling me he was writing ME a ticket for driving a vehicle with unsafe equipment (to clarify, I had new tires, and no low-pressure alert had come up on my dashboard). I didn't really think I deserved that ticket, but I know better than to argue with cops, and so I grudgingly signed it and took the ticket. My family came to pick me up, and when I showed them the ticket they noticed it didn't have my name on it; it had been made out to the other lady that I had crashed in to (the cop took our ids at the same time). This was about a month ago. A couple of weeks ago I sent the lady the ticket in the mail so that she would know she had received a ticket (albeit accidentally) and so she would have a chance to clear it up. NOW about two days ago I get a call from the cop from that day, and he's saying he's realized that he messed up in a major way, and he wants to meet up with me to give me the ticket that was originally intended for me. Thing is, I'm not super keen on going out of my way to help this cop fix his fuck-up about a ticket that I truly don't believe that I deserved in the first place. Do I need to meet up with him? Do I need to accept the ticket? What are my options? [link] [comments] |
Vehicle shipping company giving me the run around Posted: 30 Dec 2018 07:26 AM PST Paid a deposit to ship my vehicle from ca to sc on December 11th. I'm out of the country until mid January. Every time I have called(and they actually pick up) they say That my vehicle has still not shipped. they have a "quick ship promise that if my vehicle is not picked up within 10 days of the scheduled date they will offer $25 per day in compensation until it is shipped. I have called emailed and texted the manager and have not received any response. I have only spiked to the vehicle relocation specialist that I spoke with initially to ship my vehicle. I really just need my vehicle shipped before I leave for deployment. [link] [comments] |
