Found Hidden Camera in AirBnb (Seattle, WA) Posted: 26 Apr 2018 07:34 AM PDT My bf and I are staying at an airbnb in Seattle, we're basically living in the bottom unit (basement) and the hosts are directly above us. Everything seemed fine. Last night I went to use the charging cube and cable they had in the kitchen, for some reason it wasn't charging my phone so I took a closer look at it and saw that it was blinking. We shined a flashlight on the cube and realize it was one of those hidden camera charging cubes. It was in the kitchen but pointed straight at the bathroom, which means it has footage of us undressing (completely naked) and walking into the bathroom to shower. The hosts never informed us about this and we are really uncomfortable with the fact that it has footage of us without our consent. We contacted Airbnb but they are not super helpful and now we are considering calling the police to file a report. Is it legal for us to take the files from the cube (direct USB connection)? update 1: We called the police non emergency line, they won't give us an ETA or when they are coming but we have to wait for them. We only have 2.5 hours left until we have to check out . . . so I guess we will sit tight until then Update 2: the couple left and went somewhere while we waited for the police. The police eventually did show up, made a report, took the camera as evidence, and tried to get a hold of the couple but couldn't. All my messages between myself and the host were wiped from the Airbnb app, I did not screen shot them but have copies of what the host said in my email. We are going to Mt Rainier for the next two days so I will keep you guys posted after. Update 3: Airbnb messages are back and I have full access now, will screen shot and keep safe! Posted: 26 Apr 2018 11:02 AM PDT Edit: Opps, forgot original post. My bad Seeing as the last post I made got popular thought I would come back and give an update. As much as I wish this ended dramatically with SD getting arrested or embarrassed in court i'm sad to say this isn't the case. So after I sent SD the text telling her to stop contacting me she began to blow my phone up with voice mails and texts. I saved them all obviously and forwarded them to my fathers attorney. The day after I made my first post my attorney had a letter sent to SD. Won't post the letter here but i'll paraphrase to the best of my ability while trying to interpret all the legal talk "If you believe your child's claim to my clients estate is legitimate please submit to a DNA test as your earliest convenience. If an independent DNA test confirms your claims of my clients paternity to your child we will see to having him compensated as according to local laws for the requested child support. On the claim of getting a potion of the estate, my client specified in his will that his estate would be left to his children FakeFather21 and Sister. Unless you are able to provide the letter of recognition as you stated in my office on the 22nd we will consider that your child was either disowned or unacknowledged by my client and will proceed as such. If you are unable to provide the claimed letter I advise you seek legal council of your own. On the topic of you continued contact with my clients benefactors I suggest you cease it immediately. They have made it clear that they do not wish to associate with you outside of legal dealings. If you continue to contact them I have recommended they take legal action against you" The best part has to be how he ended it however "If there is the possibility that your claims of my clients paternity to your child are misinformed or fraudulent I suggest you admit to this and cease contact with me and my clients. If you continue these action under false claims not only will you be receiving a bill for my time, I will suggest that my clients take legal action against you." While this was going on my sister tracked down SB's parents and got into contact with them. It turns out that SB has not had contact with her parents in multiple years, but that is not the important part. Apparently this is not the first time she has done this. Apparently she pulled the same stunt with another man when this kid was born 9 years ago and got paid off to leave him alone. I also forwarded this to my attorney So fast forward to this morning when I get a call from my attorney. SB is retracting her statements claiming she "misunderstood" the situation and no longer believes her son is my fathers kid. So yeah, no big dramatic ending sadly but I guess this is over. Thanks for the advice originally. I know some people were asking why I came here when I already had an attorney, and to be honest I see where you guys are coming from. [Update2] NY landlords complaining about heat Posted: 26 Apr 2018 07:35 AM PDT Update to this post about living in an illegal apartment where my landlords were constantly coming in. Based on advice from the lawyer and the thread, I told my landlord I wanted to move out immediately because of these conditions, I would move out by mid January, I would eat the rest of January as a loss, but I wanted the rest of February back and my security deposit back in full. They told me okay. I did not bring up reporting to the town at that point, as I lived under them and felt unsafe in general. With the help of some friends, I got moved out in under a week. I'm much farther from work right now but my current living situation is fantastic. I left the apartment spotless, I took pictures, etc. I met my landlord afterwards to get my money back and this is how it went down: She had a long printed out page of how I was only getting back 50% of February rent and 50% of the security deposit with a long list of "damages" which included "excessive heat" and other things that were already broken when I moved in, which I had text correspondence asking them to fix. This was a shoddy apartment where they paid a friend in beer to build things, that were already falling apart. She asked me to sign that I accepted these damages, and I said no. I took a picture of the document, and I said "I'm not signing this, none of this is accurate or legal. You can't charge me excessive heat when 1) heat is included in the rent and 2) i kept it at BELOW the legal limit because of you." She started freaking out a bit saying "well I have your cash right here right now, if you don't sign this now then it might be weeks before I can get time off again. I took time off just to meet you!! You're inconveniencing me, just sign the document so all this headache can be over." I said "No, I'm not signing anything, have a great day" and left. The next morning I got a text "Under further consideration, we have decided to pay you back in full with your security deposit and February rent. Please meet me by end of day. " I picked a neutral location and she met and paid me. I called the town right after and reported the illegal apartment. I asked them to follow up, but they didn't. I made a second inquiry/report just in case, and notified them that the fire marshal would be interested. I saw they had put the apartment back up for 300$ more than I was paying, however, but it was back down shortly after. Not going to keep pushing the town to respond to me , I think I did all I could in reporting that it was illegal, and it's not my problem anymore. The shareholders of the farm are the father and two sons, with one of the sons (a qualified accountant) being our point of contact. Come time to pay for the work, excuses are made and we receive a part payment. Same story week after week. Eventually we only got paid whenever we phoned them to hound them for a payment. Then even less as they started dodging phone calls. Word travels in our community (small town in New Zealand), and we've found out they've done this to many contractors. After one discussion revealed that they had just been on a cruise ship holiday while they owed to several other small businesses. Another conversation revealed that the father had recently had a sever year stay in prison for fraud with the judge noting that he "indicates he will fight to not pay reparations" We decided we would need to involve debt collectors. So today about lunch time, $0.01 has appeared in our account from them. Large enough to legally still be paying the bill, but small enough to send clear message. We asked the debt collector about it and he said that this is the only time in his career he's seen anybody do that. I'm at loss for what to do. The smartest thing to do would be to accept that we've been swindled and accept the loss. Just move on. But the more emotional side of me wants to act in a way that prevents them from ripping anybody else off in future. TLDR Client doesn't want to pay us, but is still legally paying bills by $0.01. [CA] A Supervisor mis-gendering led to me losing a promotion and wages Posted: 25 Apr 2018 09:15 PM PDT I am in the state of California and I work at a well known corporate security entity and am a fully-transitioned FtM (female-to-male). My records were officially/legally changed (driver's license, social security card, etc) including within my company's system. I go by a male name, male gender-markers, and pronouns. Starting in January 2018, I was offered a promotion to Shift-Supervisor for a client site and accepted it. Unfortunately in my first week of training at this new site, the Supervising Officer began to purposefully mis-gender me even after I told them to stop. They told the other guards that I used to be female, etc. When I first reported it, the Supervisor was told to apologize and cease calling me a female. Yet this didn't happen, and she began to call me female and then make a show of apologizing in front of other co-workers as a way to skirt what HR enforced. When I reported it again as a concern, I was removed from the site and lost my promotion (plus the pay that went with it.) They didn't give me any hours for 2 weeks and it sincerely felt like I was punished to report. The Supervisor is still at that site to this day, by the way, and received no write-ups. After much fighting the decision, I was transferred to a new site as a regular officer and the new Site's Supervisor (Let's call her Supervisor B) once again began to call me a girl and tell the other guards that I am female. Even when the others tried to correct Supervisor B, including myself, she continued, citing her religious beliefs. She has refused to apologize and retaliated for me reporting my concern by writing me up for refusing to work off the clock. This continued for weeks as the main office was telling me that HR was looking into it. I again reported my concerns this week when I was concerned about being ordered to work off the clock. My Operations Manager stripped me of my 40 hours and once again lost a permanent site. Local HR when I pressed for my personnel files after I was told the present Site Supervisor wrote me up for refusing to work off the clock, told me it was against company policy to give me copies of my records. I was told by the same HR rep that I could show some gratitude for them "accommodating" me. Needless to say, I am now without hours again and waiting for regional HR to investigate all because I brought up that I choose to raise a concern about being mis-gendered. Regional HR has admitted that their Site Supervisors are lacking in sensitivity training. Is there anything I can do? My partner has complex chronic migraines with full-body auras and is disabled as a result. I am a graduate student and we both work from home. Since we've lived here, our landlord has twice entered our apartment with no notice or permission. The first time it happened, no one was home, and we though someone had broken in. We let him know it was not ok with us for him to do that. The second time, my partner was home and asleep, and woke up to our landlord trying to fix a window. The window he was trying to fix had been left broken, open, through three blizzards. It's one of three windows we aren't allowed to open because they fall out of the building. Two days ago he called asking to come measure for new windows (awesome) with four hours notice (not awesome). When I said he was welcome to come by the next day, he became verbally hostile toward me. He then comes by the next day, an hour early, while I am in the shower, and gets hostile and verbally aggressive toward my partner. Now for the bigger issue - he has started construction on the apartment above us, after stating explicitly that there would be no construction whatsoever. Our ceilings are shaking, the lights are flickering, dust is falling everywhere. The dog and cat are scared out of their mind. And, and I mentioned before, my partner has complex chronic migraines to the point of disability. Things that trigger extreme pain to the point of losing coherence and consciousness include loud noises and flickering lights. Plus the construction workers are using my driveway and blocking me in after repeatedly being asked not to. Both the construction workers and our landlord have refused to communicate with us about their schedule despite repeated requests. From what I've researched, we have a right to a "quiet and peaceful existence" and the construction is harming a human, which I think qualifies as noise injury. Any advice as to who to contact to help us would be appreciated. Our budget is tight but at this point the landlord and workers won't talk to us, so I don't think we have any choice but to involved authorities of some kind. Thank you in advance. I left the relationship because of a pattern of alcohol fueled episodes resulting in destructive property, nasty harassment via texts when I'd leave to escape those episodes, and lack of them getting help to move to a sober future. I moved forward with getting a protective order this month because there were 2 seperate incidents that violated my red line of what is something I could deal with. I could deal with constantly begging for me to come back. I could deal with angry threatening messages. He broke into my place while I and my brother were away (my brother had left the door unlocked). He then stole my android tablet. After confronting my brother that he didnt steal the tablet i assumed it had to be my ex and confronted him with the help of a third party to get it back. I didnt involve police because I didnt want to ruin his life at the time. A week later having built up some perspective and processing the information more i messaged my ex telling them that i wanted to refrain from all contact going forward. That night large loud knocks were at my door. My brother shouted he was going for his gun. I saw my ex outside the door leaving. I awoke the next morning to a single slashed tire. Affer a doctor's visit (not related) and a mechanic visit i went the next day to file a police report in person. I then also went and filed for a protective order. The hearing is next week. I came home today to being served a counter protective order. In it they allege I would beat them for not performing sexual acts to my proper satisfaction. That i forced them to drink alcohol to the point of passing out. That I'd initiate penetrative sex when they were passed out. None of these are true. There is an audio recording though of me early in the relationship thinking outloud to my ex while I was intoxicated that I thought he was an alcoholic. He claimed I was being mean or something to that effect and that he didnt have an alcohol issue. I then said something dumb like "well when we get home I will pour you a drink." This recording has been the basis of the fiction of me forcing him to drink. I havent heard it personally so I dont know what it really says. I am taking off work today to go talk with some lawyer and get their opinion on all of this and try and get my anxiety and stress down. He has another ex that filed a protectove order against him because that ex had crystal bowls being thrown through their door. He counter sued that individual as well. I don't know much more than that about the case other than that ex chose to leave the country for a job opportunity rather than continue to live in this city. I will call the police department and try and get some incident reports and what not assembled (report from the prior ex filing a protective order.). I don't have any money I live paycheck to paycheck barely meeting my 401k match and paying off student loan bills. So hiring a lawyer isnt something I think I can afford. Something I havent mentioned is we pursued couples counseling late in the relationship after my ex pursued self harm to get my attention one night. Would it be legal to try and get the therapists notes As only one party of the two in that setting? Its 5 a.m. i cant sleep because I am stressed. Ugh. There is so much more but the only hard evidence I have of his abuse is text message conversations that facebook has saved going back months. They are used for a magic trick, and I've had them in there for months. One of my friends took them out, and dared another friend to put them on. It was all in good fun, all done willingly. A key was available if they ever wanted to get out. This was right before class started. Class then started and we took our seats. Our friend still had the cuffs on. He obviously struggled to write and everything, and the teacher came and asked what was on his hands. I handed my friend the key, he took them off, all was dandy. About 10 mins later, our School resource officer came in, and is now saying there are possible legal ramifications for having a "tactical device". I don't know what they gain by getting me in legal trouble, and to be honest I don't believe it at all. I have done some research and found nothing. In Indiana I was pulled over, never told why, and subsequently arrested for having a small amount of cannibis is the car. I was released the next day and have to complete a program and they will drop the charges. When I got home is started to watch my dash cam footage from the stop. At one point the state trooper admits that he pulled me over because I had a dirty car with out of state plates. I have it plain as day on the dash cam footage. Is there anything I can do about this? Should I even try to fight it since the judge allowed me to enter a pretrial diversion program? I'm just frustrated with the whole situation and don't know who I can turn to for help. So Reddit, please help? I am licensed in PA, was driving a rental through Putnam County Indiana when I was pulled by the IN state police. I was doing the speed limit (he actually clocked me 1mph under), driving in the travel lane and using my blinkers any time I made a move. Posted: 25 Apr 2018 09:35 PM PDT This occurred in Ontario, CA. Briefly, my SO was driving through an intersection and had a green light. A police cruiser ran through his red light at the intersection with his lights flashing, however my SO's view of his car was blocked by a city bus. The cruiser struck the driver's side of her car at a high speed, totaling her car and resulting in a trip for her to the emergency department. Fortunately for her, she suffered no serious injuries but did sustain a neck / back muscle strain for which she requires physical therapy sessions. She is also currently without a car, but is expecting a payment from her insurer. Immediately after the accident, the police officer checked on her and apologized, saying "this was 100% my fault". His sergeant also saw her the emergency department to make sure she was okay and said that the officer should have checked to make sure the intersection was clear before running the light. The issue is that she just received the police report, which states that the police officer stopped at the intersection before proceeding at 25 km per hour when he was struck by my SO's car (which reportedly was traveling at 50 km per hour). No independent witnesses are listed in the report. Additionally, the report does not indicate that any persons were injured or taken to a hospital. The report is clearly written in a way that protects the officer involved but indicates that my SO was the one who struck the cruiser. This conflicts with my SO's account, the police officer's statement at the scene, the damage to the vehicles (the cruiser had front-end damage while my SO's car had damage to the driver's side), and likely with the camera footage at the intersection. I will say that the report does not list any persons charged - however, should she seek legal action? Will this impact her driving record and insurance premium rates? Apologies if it's the latter. Right, this is a pretty complicated story and I'm not really sure how to proceed. I live in the UK and work with a guy that's a Jehovah Witness (JW). From my understanding of JWs, they look after each other within their religious community, regardless of location. The colleague was explaining to me the other day that 12 years ago, a JW family in China contacted him for help. The wife was pregnant with her second child and couldn't afford the fine that they'd no doubt incur (and they obviously disapprove of abortion). He told them to move to the UK for a while and he'd help them out until they could move back to China (he didn't explain any of this in detail - it was more of a passing comment). Anyway, the baby is now an 11 year old girl and calls my colleague almost everyday to get help with her English homework and to "talk". How he explained it, the girl supposedly idolises my colleague and so do her parents for helping them. They talk all the time and I'm not sure how inappropriate it gets. I know he's trying to convince her to move back to the UK. So basically, he's grooming her. My colleague loves the attention he gets from the girl and has made comments like "I can't wait until she's 18 so I can have sex with her". Did I mention that he's a 35 year old man?? He's saying this shit about an 11 year old. He's also said "I hope she's single when she's 18 because I'm going to bring her to the UK and marry her". It honestly makes me sick and I've told him that I feel incredibly uncomfortable with how he talks about her. SHE'S 11!!! The worst part is that I'm pretty sure her parents would be happy to marry her off to this guy. I'm not really sure what to do because at this stage it's his word against mine? Also, the fact that she lives in China makes it complicated as well. I've thought about contacting social services but I'm not sure what they could do as I technically have no proof. Any advice? Posted: 26 Apr 2018 09:17 AM PDT Last summer, a bag containing half my possessions was stolen out of the belly of a Greyhound bus I was taking from NYC to Rochester, a 7 hour trip. When putting my bag under, I asked for a checked bag ticket and was told they didn't use them, that bags going to Rochester would be sealed seperately from bags going to Syracuse. When I arrived in Rochester, my bag was gone. I immediately filed a claim with the information I had. I was told my greyhound reps at the station there that this happens all the time, and that the drivers do nothing to stop it. Quote "if it were me, I would check on my bag at every stop." I suspect that while we were stopped at Syracuse, the bus was left open for the full 15-20 minutes, and my bag available for the taking. Now, almost a year later, I'm still fighting with Greyhound customer service. They claim that I'm not eligible for their lost bag compensation (only $250, when I had more than $1000 lost) because I don't have a checked baggage ticket. They claim that tariffs mandate I have a checked baggage ticket, or they cannot recognize my claim. Again, I was never given a ticket. Since then my brother has taken a Greyhound on the same route and was not given a ticket either. It's not standard coming out of Port Authority. I'm wondering now: is there then a tariff that mandates they must give out these tickets, meaning they're in the wrong? Is it BS that they can't recognize my claim without a ticket? Is this something I should be taking to small claims court? If I go to small claims court, would I be able to claim more than $250? I've spent a ton of time on the phone with customer service reps and they seem unwilling/unable to direct me to anyone who will just say "here's money, leave us alone now". From what I gather, the personnel at the jail do not believe he's had the procedure (they allegedly forced him to undress in the dining facility, accused him of lying, etc.). Rice and white bread are staples in the cafeteria, both of which could apparently cause his stomach to rupture. He's now faced with either risking his health or starving. He's currently "on lock down" and had another inmate call me to beg to do something like get him moved to a federal facility. They're also apparently refusing to give him medications that he needs because they "can't find proof that he ever had prescriptions" at the pharmacy he used. He has moderate brain damage which has given him fairly severe anxiety, depression, memory loss, seizures, etc. What do I do here? I'm trying to get in touch with some lawyer he apparently had dealings with, but I'm not having a lot of luck because my dad was/is well below the poverty line and the guy helped him out of charity. Tenants Filing False Complaints Against Us Posted: 26 Apr 2018 08:17 AM PDT I live in an apartment complex in Maryland with 4 apartments per building. I have had the same neighbors for the last 2 years, and have done the same exact routine every day since then. This week I get a letter from management saying they've filed complaints for "Loud bass and excessive thumping at night and early mornings". Ok, I talk to the property manager, I tell her I'll tell my roommate to lay off the guitar/music in his room outside of mid-day. He does that, we're so quiet the next day, you wouldn't even hear a pin drop from the vacuum our silence created. I get an e-mail the very next morning, saying that there was another complaint about "Loud Bass all night". Ok, that's weird because neither of us played any instrument or music at all after the first complaint, and we're also in an area with A LOT of people driving by playing extremely loud music/people who park outside and leave their music on for hours at a time when they go inside. I call up the property manager again, tell her that it must be a mistake because we didn't make any noise at all last night, and in fact, I was asleep by 9, and my roommate was only up studying until about 10, so how could we be playing loud bass at 10:30 onwards? Fast forward 2 days, roommate, mother (Co-signer), and I all get an e-mail asking my mother to call the property manager "regarding an urgent issue with your son's apartment". I'm not stupid, I've complained about people before, 3 LEGITIMATE complaints and you're threatened with eviction. So I'm 99% positive that's what's going to be brought up to her, even though we've complied with the original complaint, and have not made any noise since. Is there anything I can do legally about mass false complaints? For clarity's sake, I was told by the property manager that we got about 7 complaints in 4 days from the same tenants, but obviously they can't specify who, apart from that it was the same people complaining each time. (CA and MI) I think a consignment store is trying to rip me off, what are my options? Posted: 26 Apr 2018 10:17 AM PDT Back in November I sent a few of my designer items to a consignment store that has a large online presence. I have worked with them before on smaller items and didn't have a problem. Also, within the community of people who buy and sell both new and used designer items they have a good reputation. One of the items I sent them was a designer coat and they initially said they would list it for $4,600. This was fine with me because it gave me a nice payout after they took their cut. The first thing that they didn't tell me was that they would be listing the coat on eBay. I was checking their website for a couple weeks before I finally e-mailed and asked when the coat would be there. They replied that there much have been a misunderstanding and that the coat was on their eBay page. There wasn't a misunderstanding, they just never told me, I checked the emails. However, at the end of the day it was fine because the coat was just listed at a buy out price and not a bid. I should also say that I didn't sign any kind of agreement, but their policy is that they get to keep the item for 90 days and then you can request it be returned to you at no charge or for a $25 fee if returned before. After a couple months of the coat not selling we discussed over e-mail lowering the prices of the items I had with them and they lowered the price of the coat to $4,050. Again, this price was still okay because I would still be getting back the money I wanted after their cut. However, I didn't want another price drop because then it would no longer be beneficial to sell for the price. I was well past the 90 days to have the coat returned, so I just watched the eBay listing. I was happy to see that it sold at the $4,050 price and that the eBay auction was over. Strangely, they didn't e-mail me and I had to reach out to them after a while. When things had sold in the past they were usually very prompt with reaching out. Yesterday I got a "sales summary" explaining my cut etc. and much to my horror they are listing that they sold it for $3,600! Now I have e-mailed them twice and have not gotten any response. I have asked why if eBay says it sold at $4,050 that they are claiming it sold for less. In any event, if I have to fight them on this what are my options? What are the laws governing consignments? If they continue to ignore me and just try to send me a check for the much lower amount can anything be done? Moreover, since I am in California and they are in Michigan which laws apply? Thanks! Posted: 26 Apr 2018 11:33 AM PDT Hello /r/Legaladvice, I am a student who was unjustly expelled from an Ivy League university during my senior year in undergraduate school. In as few words as possible, I had a bad breakup with my ex (who attended university in a different state) and to get revenge for grievances held, she said she'd try and get my school to take disciplinary action at this time. Months after we'd broken up and stopped speaking to each other, she started calling my school asking it to take disciplinary action against me for making inappropriate remarks to her, and submitted an 20+ page complaint containing most of the messages I'd sent her in the dialogue we'd had in the weeks after we'd broken up. My school reviewed, received, and investigated all these complaints during my junior year, and decided it wasn't appropriate to raise disciplinary allegations or potentially impose a sanction upon me based on any of the statements I'd made in this 20+ page report. However a year later, my school would then expel me based on a (unwarranted) subsequent review of this same exact report (performed in violation of the institutions own written policies), and without ever having raised disciplinary allegations against me about them. I made rude remarks I should not have in the messages, but I promise you that as the school decided after it initially investigated these materials, I had not done anything that could possibly justify doing this to me. This was also the first time I've ever been accused of doing something malicious in my entire life. I've probably spoken with around a dozen attorneys about my case at this point, and even been fortunate enough to find a partner at a firm in Boston that specializes in cases like these, and was kind enough to spend a few hours evaluating my case and speaking with me on the phone without charge. I've been told that I have substantial enough a chance of winning that I should do anything possible to get the requisite funds to hire an attorney and file a lawsuit, but unfortunately, my family is already facing great financial hardships, and there is no possible way I might be able to gather such funding. I've also been told it'll be impossible to find a pro bono attorney for this type of case. Thus, I am planning to file suit pro se, and attach a "motion for appointment of counsel" with the court complaint, and am currently working on (and near completing) said complaint. I plan on posting said complaint here, and on any other active legal internet forum I find where it seems like I might get responses, but wanted to ask some preliminary questions here first, which is why I'm writing this post. Here are my questions (in bold), and some pertinent information. My first question is if there's any reason I might not want to post a copy of this court complaint online to try and get some feedback on it from strangers, provided all the information contained is true, and that I use pseudonyms, and otherwise remove any information from it which might make myself identifiable to those reading. My second question pertains to a specific aspect of my case. Because my school investigated all the materials in this report during my junior year when it was received and decided not to impose a sanction on me at that time, and then later during my senior year, expelled me based on an unwarranted reconsideration of how I ought to be punished based on these materials, it would seem that my college's decision to impose such a sanction upon me would be in violation of the following protections afforded to employees facing workplace discipline. "Under the labor law concept of workplace/industrial double jeopardy, an employee cannot be disciplined twice for the same act when all of the relevant facts were available to the employer at the time of the first punishment. Where the first punishment has become final (as compared to a temporary/initial step such as a suspension pending the outcome of an investigation), the employee cannot be penalized a second time for the same infraction. Furthermore, even where a collective bargaining agreement does not contain a "just cause" provision and thus is not subject to the principle of double jeopardy, discipline under the contract must still be fair and consistent, and a disciplinary determination may not be arbitrary or capricious." While these laws are obviously not applicable to a private university's disciplinary hearing procedures, is there any way I could present an argument that the court should apply workplace/industrial double jeopardy laws to students' disciplinary hearing procedures at private undergraduate colleges and universities? If there is, how would I go about integrating this into my complaint? For example, would this be an additional cause of action, or is there some other way I'd raise a concern of such nature to the court? Since having my case reviewed by a lawyer who was at least able to determine I have a substantial enough chance of winning that it's in my best interests to pursue filing suit for me, I've pretty much been navigating this process on my own. [SC] Caught with a very small amount marijuana and now police want me to be a confidential informant Posted: 26 Apr 2018 08:46 AM PDT Two days ago I was driving home from buying weed and was pulled over for my brake light being out. I instantly knew that the police officer could smell it so when he asked if anything was in the car I just went ahead and showed him where it was. I had a very small amount, a little more than 2 grams. (I'm located in a VERY illegal state by the way) They told me either I go to jail tonight or I tell them who I bought it from. After 30 minutes of them prying for information they eventually told me that they wanted his phone number off of my phone or else they'd seize it because it was used in a drug transaction. So because of that I was forced to comply and show them the conversation. I've only just met this guy so literally the only thing that was in our conversation was "Can I get 2?" "yes" and "here". They sent me home with a ticket for my brake light and told me that I'd be getting a call in a couple of days and I need to answer and help the drug unit set up a bust as a confidential informant. They said if I did not answer the call then they would issue a warrant for my arrest. My main question is: since they didn't initially charge me with anything that night as far as drug possession goes... can they even 'issue a warrant' at a later date like that? I feel like they are just bluffing to get me to comply. From what I've read, usually they've already charged people who are CIs and just use their cooperation to reduce the charges. I really don't want to be a snitch but I have an absolutely clean record and I don't want to damage it. I'd feel like an absolute piece of shit for setting this guy up just to avoid myself getting in trouble. I know the first thing that's going to be said is 'get a lawyer' but that's not an option.
