I have a unisex that leans male name (Logan) so I'm assuming this is just a case of mistaken identity? Though my last name was correct (and it's not a common name) and so was my address. I also have never heard of the person who is suing me. How do I get this fixed? Will I have to go to court and prove I am who I say I am? Can I avoid court altogether? I really can't afford the amount I'm being sued for, and I doubt I could afford a lawyer. Sorry if this is stupid, all I know about law I learned from Judge Judy. We have the slip detailing the transaction. The item is 2 weeks past due on being shipped back to us, at the store they claim they can't see information on the status of the item because it was sent out for resizing, and at the number they provide us no one will comment on the status of the item, and either puts us on unending hold (hung up after 2 hours) or transfers us somewhere completely unrelated, where they can't help us and tell us we need to call the store where it was sent out from. This month our electric bill was exceptionally high, so my other roommate (Let's call her R), told her if she couldn't pay it in full pay her 40 so she can avoid a late fee. Keep in mind I have been paying on time for utilities consistently and my rent has been paid 2 months in advance. Anyway, this morning the roommate texted me blatantly saying I stole 40 dollars from her, because she leaves money in a specific place in the kitchen and it's not there. I told her I had no idea what she was talking about and perhaps she misplaced it and that she should check again. She said that she did and it's gone and I must have stolen it, or a guest of mine. I haven't brought anyone over as a guest in months. She said I was cooking and watched her hide the money, I told her I don't recall any such thing, which I don't. I told her I was out late yesterday and didn't even see her aside to give her tax returns, and she said this happened on Sunday. Mind you this confrontation is happening this morning, three days after her money allegedly went missing. Again, I asserted I had no idea what she was talking about and don't know where she put her money. She said she was going to call the police on me because she's sure I've taken it. She said if she doesn't find it by the end of today "We're going to have a problem". Isn't that a threat? All I retorted is that that the report would be baseless and that that's a heavy accusation to be making over text. I'm a student with a stable paid fellowship and an additional part time job for spending money and got paid last Friday, I have no reason to steal from her. Can she really file a police report for something she literally has no proof of? She then started saying to my other roommate in the group text saying "WATCH YOUR STUFF, WE HAVE A THIEF IN THIS HOUSE!!" I don't even know what to do now, can I file a counter report? What do I do if she plants money and claims I stole it? I honestly believe she didn't even have $40 to give to my other roommate to cover the late fee and is now blaming me when she never had it to begin with, because if this happened Sunday why not bring it up then? For the last 7 years she has been living with us, after we discovered my uncle was stealing her money from her every week and she was unaware of it. During those 7 years, she has become more and more ill, requiring more and more of our families attention. We are relatively poor, dad works 72 hours a week and mum is about to start her 3rd job. The strain she has put on my mum and dads relationship has been substantial and the attention required from my mum is increasing every week, but my mum has continued to do unthinkable things for her (cleaning her piss and shit from the stairs / floor and her bed because she has lost control over her bowels etc)... I admire them for this, and was a big part in helping look after my nan until I moved out april 2017. During 2017 nan kept getting worst, not only shitting and pissing all over their house but she's lying about it to everyone. We could handle those types of lies, but the lies kept getting more and more sinister. When relatives would come visit her she would tell them we don't feed her, don't wash her, don't care for her at all. We could handle that too, because relatives could clearly see otherwise due to the fact shes not fucking dead. Nan had to go to hospital a few weeks ago, where the lies started to become problematic. She told nurses that she is never fed or washed, which they informed Social Services about and now Social Services have told my mum she's under investigation. Most of the lies she has told can be proved wrong and we have witnesses to back that proof up. Here's where the issue comes in, when nan first moved in with us she told us she would help with shopping and electric since mum and dad were already struggling financially and didn't want to add strain to them, at this time she was well enough to make this decision and was for the first 2-3 years, in which time she had full control over her money and kept helping them pay for things. Now though, mum and dad have grown to rely on this financial aid but are always asking her if she minds helping with financial stuff still, to which she answers "No, what do i need money for? You guys get me everything I need!" But, since she is already lying about other things, we fear she may lie to social services about that too, since she has before saying that "She doesn't get any money" since she has started to lose her memory/mind. What are the chances of this becoming a problem? How can I help safeguard my mother from these lies? TL;DR Grandmother moved in with us 7 years ago and agreed to help financially support the house, has since slowly become senile and started lying about her not being fed / washed even though she is fed and washed every single day. I let it slide for a time but I told him one year ago that he had to get it done because I'm looking into buying again. I am a Veteran and I need my name off the existing house in order to get my VA Home Loan benefit back. Well 12 months has gone by and it's been excuse after excuse the whole past year. From talking with him I don't think he can refinance because of bad credit and lack of finances. My question is that since he's in violation of our divorce agreement what am I legally able to do in order to get my name off the house? Can I force him to sell if he can't refinance in an appropriate amount of time (2-3 months)? Can I myself refinance it solely into my name and charge him rent or something to stay there (investment property type situation)? We only talk once every few months and only about refinancing the house. He and I aren't on bad terms but at this point I'm done asking. Should I get in touch with a lawyer? Posted: 24 Jan 2018 07:54 AM PST To expand on the title, maybe a week and a half ago I was asleep and a guy came to the door saying something about our neighbors having a tree taken down and asked if he might be able to take the truck around our backyard if they need to and I thinking he meant pickup truck or something, and being half asleep said yeah whatever and went back to bed, and I mentioned it to my mom later that night. A few days later when I my mom got home from work noticed that there were a ton of ruts and bald spots in our lawn, a mounting bracket for wires pulled from the house, a crushed mature shrub, and broken in ground sprinkler heads. I saw the tree guys again just a few moments ago and relayed this, and we got into it a little, and he was claiming they never touched the wires (Even though my neighbor saw them doing exactly that) and he started to get agitated and then just left. My main question is, that although I am NOT the legal property owner and I technically have no sort of ownership over the house and/or property, does my initial verbal ok to bring a "truck" around back which turned out to be large heavy machinery negate the damage that was done? For what it's worth my Mom (the legal property owner) said she would have never allowed it in the first place, but they never asked her or confirmed that they were coming back they just came back when no one was around and did it. Brief history: Brother is Canadian, met this American girl online (AG), she came up here and lived as his place in Canada for a few months. AG got pregnant but towards the end of the pregnancy had extended or was about to extend her stay and had to go back, my bro stayed behind. He went up there for the birth of their daughter (i'll call her Zoe) and lived there for a couple weeks after which all 3 of them came back to my brother's place, they've been living there since. Zoe is now ~8 months old. AG hasn't had any job throughout this whole period, my brother has been providing for her all this time. Same since the baby came around, plus, our family have been helping them get everything they need for Zoe. Now AG's time is up again, her visa expiring by the end of the month. It's not going so well between them and my Bro basically does all the work, from waking at night to take care of Zoe, to feeding her first thing in the morning, and that's just on top of having been the sole provider of income. I don't have the details on how the her visa works exactly but he told her he wouldn't be vouching for her or renewing her visa and that she had to leave and Zoe would be staying with him. Idk how they planned to make it work going forward but he wasn't excluding her from Zoe's life forever, just that, for now, her visa was up and she had to go and they agreed on that. Somebody was set to come pick AG up this weekend for the drive back to the US. Tonight while my brother was asleep she left with Zoe and a bunch of her things. Brother is currently with the police and they're trying to locate her and Zoe, they warned the border agents etc and apparently also trying to locate her phone. This is happening as we speak, I just talked with him before typing this out and he was with the police. They have been texting and AG even responded to a text from the police. Her stance is that she is the mother and that's it. Onto the needed advice; there's two scenarios: 1. Police catches them before they make it across and there would be criminal accusations for kidnapping which I believe would heavily influence an eventual custody decision. 2. She makes it back to the states and we have to initiate some form of custody battle. Looking for advice on anything we should be doing or not doing. How do you even initiate this custody claim being Canadian and them being in the US? What kind and how should we go about picking a lawyer? They brought the kids to my house. Now my oldest sister and I both work full time. I have a place to live with spare bedrooms but last night they wouldn't place my siblings in my care because almost 3 years ago I got a Dui. Nothing before or after that though. I'm a young woman who moved into an apartment about a year ago. My upstairs neighbor was a man in his early 30s who had lived there for a while and had some pretty serious mental health issues. Long story short, my neighbor developed an obsession, there were some very scary incidents including one involving a weapon where I really thought my life was in danger, lots of police involvement, involuntary psych hold (him, not me), and some other insanity before I broke my lease and jumped at the chance to move out of state when my company offered the opportunity. It was a nightmare. I paid all required penalties for early termination and confirmed that my account was settled. I'm not currently worried about my safety, but I am staying vigilant and doing what I can to maintain my privacy, so I'm really only asking for advice on the following situation. I just got a letter in the mail from my landlord demanding that I pay for several thousand dollars in damages. Not to my old apartment, but to my crazy former neighbor's apartment. I thought it had to be a mistake, and I left on good terms, so I called the landlord to see what was up. The landlord's logic is that even though crazy neighbor caused the damages in his own apartment, I provoked him to, and since he isn't competent to handle finances, I'm responsible for paying. I took full responsibility, paid the ladies deductible and was contacted by her insurance company for a collection on their damages to be paid for her vehicle. All in all, about 3 grand. I worked it out where I could pay a lump sum up front and then pay the rest out in payments monthly, no interest. That was 2015, and I've almost all but completely paid for the insurance companies damages. Today I got a letter from a totally different collection company basically saying they want me to pay up for an at fault wreck I was in. The details were from that exact same day in 2015 and they were asking for the exact same amount that was originally being paid on. Is this someone else just trying to cash in on a gullible person? Likewise, I am required to stay an additional 15 minutes after clocking out, to ensure that the building is clear and the alarms are set. Our time clock is in a secured area. I did the math, and given my hourly wage ($15) / 2 (half hour before, half hour after) = $7.5 x 12 (number of days a month I open and close) = $90 a month of time working I'm not getting paid. If I say yes it always comes up as 'we didn't see anything pertaining to this conviction.' And is often dismissed. I should also say 90% of the time I don't get hired. Driving school refuses to stop practicing with my car. [MA] Posted: 23 Jan 2018 04:26 PM PST Local driving school practices parallel parking around my sedan almost daily, started about 2+ years ago. We have kindly asked the teacher drivers and staff via phone call to tell their drivers to stop practicing at my address. Our reason being, new drivers can easily make mistakes while putting our personal property at risk. 3 weeks ago, a brand new 17y/o driver totaled my car's rear (not during a lesson). It's likely she attended the driving school, but it was her own fault. My car was parked at this time while I was inside; it got absolutely destroyed. 2 days later, I found them practicing on my busted car - asked them to stop. Then it happened on my brand new one today. Went to driving school, asked them to please stop (at least the 5th time we've asked) and was basically met with "sorry can't help, we can't tell the drivers where to avoid". Is there anything we can do legally? I do not feel it's reasonable my car is risked around new drivers like this, it's honestly getting ridiculous and stressful. I appreciate all your help. Edit: to be clear, the young girl who totaled my car was not driving with the school at the time. I tried to explain what was going on, and tried showing her my laundry basket, which had some men's clothes in it too, but she refused to listen. She also took out her cell phone and took a picture of me. At that point I was incredibly annoyed and tried leaving, but she started to hit me. Two men had come in by this point and she started yelling at them that I was a creep trying to steal laundry. They basically threatened me with violence if I didn't leave right then, so I did. I tried complaining to the apartment management today, but they were dismissive and evasive. I went down to the laundry room tonight after work, hoping that my clothes were still there. Instead, I found several flyers posted throughout the laundry room with a picture of my face and a warning that I'm a "thief" and a "pervert" who steals women's underwear from the laundry room. I'm thoroughly embarrassed to show my face around the apartment complex. At this point my number one concern is to get my gf's clothes back before she returns on Thursday. The flyer says the clothes are safe (specifically, it says the woman "rescued" them from being stolen). The flyer also includes an email address for the rightful owner to contact to make arrangements to pick up the clothes. Friend has a permanent restraining order against the ex and there are ROs in place for the kids until they are 18 yo (oldest is 16). The school notified the parent/friend because the RO is on file and confirmed that they did not share any information. The ex supposedly lives out of state with their family and friend is disturbed about this sudden and random interest by the family member after 9 years of no contact and is concerned that the ex and/or the family is either in state or our of state attempting to make contact. Looking for advice regarding whether or not friend should reach out to this relative or what proactive/best steps (if any) friend should take to prevent any contact of ex/ex's family with the kids (reach out to police? reach out to family member? not make any contact?) and whether or not this is a violation of the RO? I recently quit a job with no notice in Pennsylvania and haven't gotten my last paycheck yet. From what I can tell for PA, my final check is due by what would have been my standard pay day. However, my employer is refusing to give it to me and has said the reason is based on me violating my contract by quitting without notice. It has only been a few days since it should have been given to me, but wanted to get the ball rolling fighting this. I don't believe a clause stating that I had to provide a notice was anywhere in the contract and am going to double check, just need to find the contract in my house. I have already submitted the Wage Complaint Form located Here. First question is, can this PA state law stating that I should have been provided my last paycheck on my standard payday be overridden due to a clause in an employment contract I have signed? Second question, anything else I can do to help speed up the process of getting paid what I am owed? edit: Found my handbook I signed. The day of settlement, my realtor put me in touch (through email) with the woman who runs my HOA. I asked her some general questions about living here and about how to make my HOA payments. She said I wouldn't be able to make payments until I was in the system. She told me that once I was in the system, I'd get information in the mail about how to make payments. A month later (late October) I still hadn't heard anything so I reached out to her again. She said I still wasn't in the system because they were still processing paperwork, and again told me I'd get information in the mail once I was in the system. At the end of December I got a letter from a law firm representing the company who handles payments for my HOA. They said they were trying to collect late unpaid HOA dues as well as a $4,000 lien against my house from the previous owners. My house was a foreclosure. I bought it from the bank. During the buying process/before settlement, I got title insurance and had a title search done. It came up clean. I explained this, and forwarded the email chain of me inquiring about how to make payments to the law firm. The lady who runs my HOA told me they were going to remove the late fees and I could just pay the unpaid HOA fees to the lawyers. She told me they would send me an updated itemized bill with the late fees removed and information about who to send payment to. I got the bill today. The late fees (about $14) were removed but there are about $400 in legal fees attached. $200 something for December legal fees and $180 something for January legal fees. They have the email chain that dates back to the day of settlement that shows I've been trying to pay these dues since day 1, which is why they removed the late fees. I live in Kansas city and there was a clear violation of the law. Some punkass neighbor decided he wanted my parking spot so he called a tow company to impound my car. The leasing office took their side at first until I was able to prove 1) I was lawfully paying for the parking spot in my rental agreement 2) The city ordinance states that you can't tow a car from a private lot if there's no posted signage. The property owners were insistent that I was just incompetent and missing the signs until I took my camera out and did a sweep of the entire complex and parking lot -- no signs had ever been posted at this lot. and 3) I had the sticker anyway, it was just slightly obscured by some snow on the rear windshield. This caused me a lot of trouble today as I'm dealing with a rather bad pneumonia and was meant to be admitted to the hospital. Further, I highly suspect the individual who had me towed has also been responsible for several acts of vandalism on my car such as kicking in my license plate, spitting/vomitting on my passenger door, letting air out of my tires, etc. I ended up installing a dash cam a few days ago, so once I get the car back I'm going to be interested in what I find. Posted: 23 Jan 2018 08:29 PM PST Starting around this point my landlord drops in on a twitch stream of mine. She is probably drunk when she threatens to harm me and nearly breaks the door down. Earlier I had placed a dresser in front of the door because she keeps coming into my rented room (no lock on the door). It is just us two that live at home. Although Illinois has laws against recordings as a breach of privacy, she breached my privacy by attempting to break into my room without any notice. I did not intend on recording her at all. I didn't know what else to do but laugh but I was intimidated. What are my options now that she plans to kick me out? The only signed agreement is a check that includes two months rent, and it also states that in the memo. She endorsed the check, and I have scans from my bank of that endorsement. There was no official lease. I am paid-up for more than another month at this time. EDIT neither party has tampered with or broken another's property but this harassment is getting out of hand. My parents both helped me move things in on Jan 1 and have met her twice. I am 23 years old and I work from home. It is not possible for me to relocate at this moment. [link] [comments] |
[Fl] House broken in to, dogs stolen. Posted: 24 Jan 2018 08:06 AM PST My home was broken in to and my dogs were stolen yesterday. My dogs are at the end of their lives (14 & 15 years old, golden retriever and bulldog, respectively) and are ill looking but not being neglected. I have been having people harrass me recently, calling animal control multiple times. I have had many dealings with animal control, they agree that there is no need to intervene. I recently found a facebook group calling for people to attack my family, steal my dogs, kill me. They have doxxed my address. The post on FB has been since deleted. I have a few screen caps but the worst is missing. Police are dragging their feet without the other screen caps. Can i get FB to restore the post? Need help, need advice. Thanks. [link] [comments] |
