[CA]Laid off day after notifying employer that wife is pregnant Posted: 05 Jan 2018 03:45 AM PST I had worked for this employer for nearly 10 years in IT. Wife is 12 weeks pregnant we decided to be proactive and talk to our employers after telling close family so they can hear it from us before the rumor mill. Wednesday this week I sat down with my boss to let him know and discuss how to best plan projects around the time I'll be out in six months. On Thursday I got a meeting request for a "planning meeting" that afternoon, not thinking anything about it given the previous days conversation, until my boss is walking me down to HR. HR informs me my position is no longer needed and that the layoff is not performance based. They offered a small severance and then inform me they'll be hiring a new position in the department and that I'm welcome to apply. This was a non-union job. There were no other layoffs in the company. There have been no talks of restructuring or downsizing in our department. I had a good performance review last quarter, just like every year I had been there. Besides the loss in pay, we used my medical insurance and my wifes employer doesn't offer any, so I'm feeling pretty hung out to dry about the whole thing. Aside from trying to negotiate a better severance package, was this on the up and up? EDIT: Not on the up and up. Per Gavinmac, FMLA notification is a protected action upheld by Wehrley v. American Family Mutual Insurance Co, and after reviewing the case law to confirm that it's a good fit, I am contacting an attorney this morning. EDIT 2: I want thank everyone on r/legaladvice. Reddit never ceases to amaze me. EDIT 3: Shutting up now, will post update once it's over. [link] [comments] |
(NY) Boss threatening to fire me unless I stop using WIC checks Posted: 05 Jan 2018 05:20 AM PST Location is NY and throwaway because this is humiliating. Basically, my boss saw me in the grocery store using WIC checks to pay for part of my groceries & a can of baby formula. He texted me afterwards, to say "It reflects badly on me if my employee is using WIC. It makes it look like I don't pay you enough. I hope you can understand that if I find out you are continuing to use government assistance, I will have to fire you." I responded back apologizing and requested that we talk about it in person (at work) the next day. During that conversation, I explained that the only government assistance I get is WIC which is a benefit of about $75 a month, and that if he was willing to raise my pay $75 a month I would stop using the checks. He refused. He further stated that he was considering cutting off access to the room that I pump in, because he had seen I was buying baby formula. This was previously never an issue - I pump on my regular breaks, in an unused room. I have never requested any sort of accommodation or extra break time for pumping. I told him that I have to supplement a little formula because I can't pump enough for the baby, but that I wish to continue pumping on my own regular breaks. He's still considering it. I know the NY pumping law covers this, at least. Basically, my question is if there is anything I can do if he follows through? I feel like it has to be wrong to fire someone for using a government program that they are qualified for. Where would I report this, and what should I do if I am fired? I am now looking for another job, but I'm afraid of being jobless if it takes a little while to secure something. [link] [comments] |
Posted: 05 Jan 2018 04:06 AM PST Early this morning, my mother calls my phone, and tells me it's okay to come home later today. I was in disbelief, and asked her why she changed her mind. She dodges the question. We make plans for her to come pick me up from the shelter. I know some people may think that it's dumb that I go back to them. I get it, part of me doesn't want to go back either. But...it's a roof over my head. To be honest, I have not enjoyed the homeless shelter very much. It can get smelly, crowded, and annoying. I even witnessed a fight between two women yesterday. So I'm a little happy to be leaving here. I will try to "play the game". I already promised my parents I'd be majoring in what they want. I am also going to speak to my counselor at school on Monday. We'll see how that goes. Today is my 18th birthday too. Not sure if we're celebrating this year. I am pretty tired... Anyway, again, I wanted to thank the people here and at /r/bestoflegaladvice for their advice, kind words, and condolences. [link] [comments] |
Posted: 05 Jan 2018 09:40 AM PST My parents are both above retirement age and have absolutely no savings and very minimal income. My siblings and I have been financially supporting them for years. My parents do not have regular-paying jobs and refuse to receive any kind of money from the government, including Social Security. My siblings and I are at the end of our ropes and can't keep giving them thousands of dollars of our own money every year. Is there any way we can receive Social Security money on their behalf and give it to them without them knowing where the money is coming from? [link] [comments] |
Trying to protect my sister from a Bitcoin scam (MI) Posted: 05 Jan 2018 09:09 AM PST My little sister did a dumb thing. She is 20 years old and found some guy who wanted to be her "sugar daddy" on a website. He gave her 1700 dollars to buy iTunes gift cards for him, and he paid her 400 to do it. He told her he was exchanging the cards for bitcoin. When I started digging into how he paid her and what he knows about her, she told me she GAVE HIM her bank login and password. I had her delete her profile on the sugar daddy website as well as change her bank username and password. Additionally I made her change her password for her email. I am curious if anybody here might be able to illuminate me as to what this guy is doing? Is it illegal to sell gift cards for bitcoin? Is it likely he is sending bitcoin anonymously for nefarious purposes? Is what my sister did illegal? She is in MI but this guy is allegedly in NY. I'm just looking for some guidance as to what she should do next. Thanks!! [link] [comments] |
Posted: 04 Jan 2018 07:09 PM PST [Canada, Ontario] This is kind of weird, but i am completely fed up. The tenant in the unit above me has "accidentally", flooded her apartment 4 times, since i have moved in at the start of November.
I talked to my landlord today and outlined my concerns about this, and how i feel like i cannot keep anything of value in my apartment due to tenant above me, and asked for them to terminate my lease, or kick her out. Apparently neither of those are an option. Pretty much all of my personal affects are gone or ruined. My entire apartment stinks, and i feel exhausted about this. Do i have any legal recourse. I desperately feel that my apartment is going to start growing mold, because of how bad the water damage was the last time. My landlord told me that unless i see mold i am fine, but honestly i am just beyond frustrated. [EDIT] Just talked to tenant above me, apparently she claims that the faucets have randomly turn on before and nobody believes her. Some in this thread mentioned something about pressure in turning on faucets, so i suggested she mention that to the landlord, as a possible cause. Honestly i don't really know what to think anymore. [CA] Friend was arrested for DUI despite passing field exams/breathalyzer Posted: 05 Jan 2018 06:05 AM PST So the other night my friend was driving home and was pulled over by CHP. They asked him to get out of the car and he let them know he had his medical cannabis in the glove compartment as well as his medical card, which is legal. They asked if he was currently under the influence of anything and he said no, which he wasn't. After passing the breathalyzer and field exams, the officer claimed that because his eyes were dilated he had believed he was under the influence and arrested him for DUI. Obviously if he was to take a drug test, he would test positive for cannabis, however that wouldn't prove that he was under the influence while driving. What can he do? I read about getting a lawyer to sue for false arrest but I still don't see how they can prove he wasn't high at the time, but similarly I don't see how the cop can prove he was high. [CA] Got my girlfriend a dirtbike for birthday/Xmas. She crashed into my neighbors car. Posted: 05 Jan 2018 09:24 AM PST First off, I know I'm stupid for letting her try it in the street. It was technically the neighbor's friend's car. Mid 2000s Toyota Camry. Both the neighbor and his friend were super cool at the time, and just glad she was OK, as am I. Her insurance called today and is not covering it (No surprise there). I called the guy to tell him they aren't covering it and that I'd pay out of pocket (I make more than her and have a lot larger savings). He said his insurance already filed it as an uninsured driver claim. What am I looking at here? I plan on calling his insurance company today and seeing what they say, but I assume they're going to pay him out then move to sue her/me/us. I'm aware we are at fault, and feel terribly bad that I got my girlfriend in this position. What can I do to mitigate a lawsuit and prevent the insurance from charging me astronomical fees? Posted: 05 Jan 2018 07:18 AM PST I'm on a month to month lease with my Landlord, and it seems like they're trying everything in their power to get me either kicked out, or force me out. 2 times now they've came down at 5-6am opened my door and proceeded to scream for me to get up. This morning the landlady opened my front door and started screaming/ swearing at me because our heater is on, (it's in the middle of fucking winter and there's next to no heat) She's broken my coffee mug because I was sitting outside talking on the phone, picked it up and smashed it right in front of me, and has just been making life hell in general. Is there anything I can do? I live in BC [link] [comments] |
Posted: 05 Jan 2018 10:34 AM PST Hey LA. Throwaway for obvious reasons. I'm in the US, and I think this is entirely federal law. Story I take Adderall daily for ADHD. The pharmacy called me because they think they gave me too much when I had my last prescription filled about 3 weeks ago. Specifically a 45 day supply instead of 30. I told them I didn't have the bottle on me, as I wasn't at home. They want me to call them back. Home now, I counted my current pills. I'm not sure if they are right or not. It seems like I have a few more than I should at this point in the month, but nowhere near 15 days worth. More like 3-4 days worth, and I skipped a few doses (doctor okay with this) over the holidays, so that could entirely be accounted for there. I'm certain they didn't give me 15 days worth extra. They might have given me 1 or 2 days worth. Basically, I want to tell them to pound sand, or even just not tell them anything, but I feel like that doesn't end well. If they had really given me 15 days worth, I'd be happy to just return them. I don't want to be anywhere near any sort of "possession of unauthorized schedule 2 drugs" sort of accusations with the DEA. Schedule 2 is enough of a PITA w/o a record. But I also don't want to hand over what's rightfully mine. Handing over 15 days worth right now, I'd be out of medication before my next prescription gets filled. However, if I call them and say "you might be right you gave me too much, but not as much as you think you did" honestly seems to be a stupider, deeper rabbit hole than telling them to pound sand. It will just be assumed I'm hiding the extra. Presumably someone is trying to reconcile a schedule 2 inventory discrepancy. Much like I don't want to talk to police even if I have nothing to hide, I don't want to be anywhere near this. Questions
Extra details you can skip if you want FWIW, I don't fuck around with my script. Everything above board.
That said, If you've dealt with a schedule 2 maintenance med, you know it can be a pain in the ass.
Combine all that with insurance billing cycles limiting to one fill every 28-30 days and it can be a serious PITA. Get script, take to pharmacy and if you can't get it filled in full for any of the above reasons in the next day or so, and you're going to start missing doses. edit: a word [link] [comments] |
Employer gave my check to someone else Posted: 05 Jan 2018 09:04 AM PST I don't even know what subreddit to post this on, but I was supposed to get paid yesterday, and one of my managers said they didn't have my check. Today my GM found out that my check was given to somebody else, and the bank had cashed it, even though my name was on the check, NOT that other person's. Is there anything I can do? Posted: 05 Jan 2018 07:39 AM PST He just started dating this girl, they've been together 2 months and they already live together and my daughter lives with them. They are not married. My custody agreement says "Neither party shall cohabitate with a romantic partner to whom they are not married while in the presence of the child(ren)" What can I do about this? If I'm being honest, I dont want my daughter raised by some woman I've never met and don't know. [link] [comments] |
Posted: 05 Jan 2018 07:42 AM PST Here is the text of AB 168:
I work for a large company in California. It is relatively common for people to apply and take jobs elsewhere in the company. Often times, when employees taking new jobs get a promotion as part of the new job, they ask for large salary increases. HR would normally put a stop to a large raise, and most job changes within the company are capped at around ~15%, though its not unheard of to go higher. Outside hires, however, almost always make substantially more than internal hires. In my case specifically, I was hired in at around 80% of the pay band and given a promotion after two years, and got a 7% raise. I know that my current salary is very low in my pay band. After 6 years with the company, I have been contemplating getting a new position and seeking a higher job level. But the raise to get me to the average of the pay band would be something like 35%. Could my employer use my current salary information to make me an offer on a higher level job that I apply for? If I was an outside hire, they would not blink at giving me the average of the pay band, but because I'm internal, I have seen people's current salary used against them. So does this law apply to me? Is my employer not allowed to use what they know I make now when determining what to offer me if I apply for and am selected for a job? [link] [comments] |
Posted: 05 Jan 2018 07:35 AM PST So I am a poor college student living in NJ so this is why this is even an issue. I have exactly $200 in my bank account until next payday in 2 weeks because I pay my own rent and expenses - I don't have parents I can rely on for paying my expenses or borrowing money from. The New brunswick police refuse to release my car unless I pay them in cash first. I had a credit card with me but they will not accept credit card or check. It's the same case with the towing company who want $170 cash only. I forgot my wallet in my car which had my debit card and so in the end, I had to walk 3 miles to get it so I could pay off these people. Is this all legal and dandy? I just can't believe it in 2018 that the police and a major towing company (they handle the town's police impound) refuse to accept anything but cash in NJ. Any advice on what I can do or who I should talk to about this would be much appreciated. [link] [comments] |
[MI] My landlord died, and the daughter doesn't want to follow the lease as landlord. Posted: 05 Jan 2018 08:14 AM PST Back in November, my landlord passed away. The daughter has been forthcoming on the surface, but I'm concerned about her distinct lack of willingness to work with us. She has stated more than once that she "is not" the landlord and "will not" do the things laid out in the lease. At first, we were just sort of blowing it off, pushing through it and doing what we could with what we had. Unfortunately, last week my fiance and I ended our relationship, and don't feel it best to stay in the same house together moving forward. E-mails and info about payments are here. I have a few questions:

Posted: 05 Jan 2018 06:15 AM PST I know this might be a bit early, but I was told on Wednesday morning by my manager that we would receive our paychecks on Thursday like usual. Then, I was told on Thursday by the same manager that I would receive my paycheck on Friday. As of this morning, there are no pending deposits into my account. I need this paycheck, as it is the last one I will be receiving as I look for another job. I don't want to be screwed over, but this is a poorly run company and that could easily happen if you don't berate someone for hours on end to do their job. What steps do I need to take in order to get paid? It's only been 2 days but I would like to nip it in the bud. [link] [comments] |
[GA] Legality of nanny cam in a nursing home/hospice Posted: 05 Jan 2018 10:09 AM PST My FIL is currently in hospice, and has been for some time. He has dementia and parkinsons but has some days of lucidity but there are always periods of the day in which he is somewhat lucid, albeit slightly confused. There have multiple occasions of as needed meds and scheduled meds not being given because of poor excuses. His respiration were too slow (10/min), he was too unresponsive, etc. We know this. He's dying. He still needs his meds, to prevent the tremors and pain. Its hospice, not palliative care. Also, there was a 7 hour period in which a family member sat in the room and not only did a nurse never put her head in the room, he did not get any meds. Two days ago, they lied about giving him a bath. He was wearing the same shirt from the day before, and we collect and wash his clothes. The actual question is, I've set up the Alfred app, which allows live streaming and recording. I've turned off the sound feature and plopped it into a plant. Before I leave today, could someone tell me the legality of this? The only one who will have access to the stream is MIL who is POA Thanks in advance. [link] [comments] |

[MD] Child Custody case - Judge asking parents to submit questions for child Posted: 05 Jan 2018 07:06 AM PST Hi all! So my sister is currently in a legal battle with her son's father, it has been ongoing for about 5 years. (Mother & son live in MD, Dad in PA). There is a custody hearing coming up in February, my sister is seeking sole legal and physical custody. The father wants custody of the child for 6 months of the year. The judge has demanded that she bring her 6-year-old son to this hearing where the judge will speak with him privately in his chambers. He told both parents to prepare questions that the judge will ask my nephew. Is this common practice? Please give advice on what questions my sister should submit and how to prepare the little one for this anxious situation. We are particularly concerned because this judge is extremely dismissive & disrespectful towards my sister and definitely partial to the father. For context here are just some of the examples of the judge's behavior:
We all just want this battle to end; it's so disruptive to my nephew's life and I think it's causing him to hate his father. We're tired of him constantly trying to lower child support payments and being able to drag my sister back and forth to court for the last 5 years. At this point, she is fine with not getting any child support if it means the little one won't have to keep going through this emotional distress. No matter how much we hide it from him, he can pick up on it and for his own reasons hates being around his father and always comes back from visits depressed. Ha, I guess I should have asked for a pie-in-the-sky solution to win this once and for all. Sorry this turned into a vent! But any advice or experience from similar situations would be appreciated! Posted: 05 Jan 2018 09:42 AM PST My mom didn't let me know in enough time for me to try and fix the issue, and this was so unexpected. I just need to know what my options are. Edit: I understand there's not much for me to do. An eviction lasts for how long on your record? Is it seven years like bankruptcy or until the debt is paid off? [link] [comments] |
Posted: 04 Jan 2018 04:30 PM PST My mother works as a nurse for a government run nursing home in Illinois. She applied for FMLA and was approved for one month which ends after this week. She called her job today and asked what her shifts are for next week and was told that they no longer had a position for her and that she would have to reapply for her job. They then told her that there were no positions available which according to their job board isn't true. Is her employer breaking any laws by terminating her position while on FMLA? What legal options do customers of a "Video game" have? (LONG) Posted: 05 Jan 2018 12:02 PM PST Ok so I am going to try and keep this short but I have a situation that affects me and likely many other people for a very large game in which people pay money to play. I would like to know if anyone would know what potential avenues people affected have to take. This is information that took me years and untold numbers of conversations with "support reps" to get enough pieces of the puzzle to figure out what was really happening. So here is the Crux of the situation. I had an account on a particular video game that I had played on and off for years. I was never a particularly serious player, but just because of who I am I recorded Every single hour I played. I likewise took frequent breaks where I would not log in for months at a time and I never kept close track of "suspicious activity" on said account. Again I played this particular game extremely casually so didn't care much about watching history. So an event happened where I had come off one of my recent long hiatus's and recently started to play again, after about 2 weeks of play (Generally a game or two a day at most), I suddenly got kicked out of a game and got an email notifying me my account was permanently banned. To say this caught me off guard would be an understatement as I had never had any disciplinary action taken against me in any game, much less this one for any reason. As I read the email it said I had been flagged for using unauthorized third party tools. I just assumed this was a mistake and at most it might be a few days of going back and forth with customer service to straighten things out as after all I had a recording of every single game I had ever played. I couldn't have been more wrong as the attitude I was met with ranged from indifference to accusatory and finally to openly hostile as I demanded they show proof as I had thousands of hours of proof that what they claimed was utter and complete bunk. The main reason this was a big deal to me was the amount of money invested in the account (mostly from gifts from friends) in the form of things that either had some form of sentimental value or were simply incredibly rare. Some days passed of us going back and forth, mostly me pleading with them to quit quoting me the "We are confident in our system" crap over and over and actually prove their case and them effectively blowing me off. After about a week a deep anger set in, I threatened legal action and that was the end of the conversation. That was a little over 2 years ago. I had full intention of attempting to do something legally, but unfortunately things in my life took an unfortunate turn at that time and I just had bigger fish to fry than fight about a video game that was more sentimental value than anything although there was a very real monetary loss. I had all but forgotten about it until some recent events brought it back to memory and I decided to go fishing again and see if I could possibly get someone more reasonable. Especially since these recent events somewhat reflected a change in past policy. Unfortunately I got the same canned answers and absolute refusal to look at mitigating circumstances or provide even the slightest shred of evidence that I did what they claimed...Then it hit me. As I was reading through the back and forth on the emails, a statement popped out that caught my attention in how they were addressing me. I went back and dug up all the old emails and found that they were using the exact same language. The specific phrase they used over and over and over was "Your account was using this script" not You or your computer or detected on your computer or any thing specific to me directly but the very generic "your account". The switch clicked as I realized what was going on and that is my account was compromised and I never noticed and they never once informed me. So my account gets compromised and apparently used for god knows what during that last period of time while I was not even logging in (Had no internet for 4 months to be exact) and Not once did this company contact me or throw an alert that there may be a problem. While it is well known Standard Procedure in the case of compromised accounts for the customer to be notified and given the opportunity to fix it, this company does no such thing and simply Permanently Terminates your account and then refuses to reimburse you for they money they just took from you for something clearly completely out of your control. I believe there are quite a few things to nail a company for over something like this, but I'm not brushed up enough on my legalese to really know where to start. Now chances are I may never get the chance to personally go after this company as my financial situation just doesn't afford me that ability, but if I can start wrapping my head around what can possibly be done and if them trying to stand behind their ToS protects them against in my mind blatantly defrauding customers, then perhaps one day in the future I can get some personal closure or at least point anyone I find affected by the same thing in the direction of going after this company. Personally I find it reprehensible that a company has practices in place that allows them to just blatantly rip customers off (Especially considering a large number of their customers are kids who don't know better) if that customers account gets compromised and offering absolutely no recourse beyond (Well create a new account and spend more money with us). Location US:NY/GA (though not relevant) TLDR: Account compromised and suspended with no options of recourse. I have mountains of absolute undeniable proof that I was never involved personally in any form of cheating and proof that when it happened I was completely cut off from the internet and had no knowledge of the situation at all. However the company has refused for over 2 years to even review the evidence I have. The only thing I am "guilty" of is not being aware that my account had been compromised during a period of time where I had no internet and the company made zero attempts to notify me or offer any recompense for the monetary loss for circumstances well and truly beyond my control. Also again my goal really isn't to get the account back. I quit this game years ago and have no desire to play again. If i desired to play again I have a secondary account I could easily use. This fight is about principle to me and my belief that it is and or should be absolutely wrong that a company can take something you have a ton of money invested in and deny you access when you can prove no personal wrong doing. Need guidance for Breaking Lease for Alabama Rental Agreement due to mental illness. Posted: 05 Jan 2018 06:22 AM PST I recently entered into an agreement for a duplex apartment by a private landlord. I have had the apartment rented since mid October of 2017 and am looking for a way to break the lease due to unforeseen circumstances. A bit of background for the unforeseen circumstance should fill in the gaps. This would have been an amazing apartment, except during the time of renting it, I was unknowingly going through a psychotic episode that is hereditary to my family. My aunt suffers from a mental illness that still plagues her to this day and during this time, I had my first experience. I have already been in a rental agreement with an apartment complex for years with my fiancee and when this episode happened, I just disappeared. I took clothes and none of my other belongings and changed my phone number because my fiancee and family were trying to reach me and apparently I thought people were out to get me. I ended up renting this apartment and took out three credit cards (which I would never do). The worst part is, I only stayed in the apartment for one weekend and did not move anything into it other than an air mattress and my clothes. The rest of the time was spent sleeping in my car "on the run" in my mind. People were trying to find me but for right reason. Once they were able to locate me, I have been treated and am recovering from the episode and still reeling from the actions taken during the time. With this being said, I have spoken to the landlord about this issue and he is not budging on the rental agreement. He lives at the duplex as well and was more than aware that I was not residing in the apartment during this time. I have a copy of the rental agreement that has many wrong prices for the rental and only mentions the negotiated price once on it. I took all of my belongings out weeks ago and have left the key in the same place I was left the key initially. If anyone knows Alabama rental law or can see if there is any way to break the lease due to a poor contract please help! [link] [comments] |
Posted: 04 Jan 2018 05:44 PM PST This is in Illinois. 4th of July 2017, my best friends husband committed suicide. They have a (now) 3 year old together. Best friend received a court summons(?)(paper telling her she is being taken to court) today that states her mother in law is taking her to court to force visitation. Important info: Grandma has never met the child Father refused to let grandma ever meet the child due to abuse from when father was growing up. Father had texted grandma multiple times before he died that she would never be apart of his child's life. Best friend still has these texts. Where does best friend go from here? She's freaking out at the thought of this woman having access to her child! Tldr: best friend is being taken to court by her deceased husband's abusive mother who is trying to force visitation [link] [comments] |
