Update on yesterday’s post regarding new vehicle that was rear-ended with $16k damage.

    Posted: 17 Jan 2022 09:11 AM PST

After pressing regarding this incident I received this email:

"I am reviewing the claim for the first time today. Somehow we have you in a rental and appear to have started property damage handling by mistake. We have not finalized liability based on the notes so all of this was done in error. I need to speak with you today or I will be forced to terminate your rental. Please call me as soon as you get this email."

When I called State Farm (at fault's insurance) the day after the accident, they set me up in everything and admitted liability. I have no clue how I could be this far in the process with documentation and a claim number to have the threat of rental termination.

I was offered $1,000 for pain and suffering. He's stating that if the vehicle is repaired there is no diminished value. This 2022 vehicle is two weeks off the lot with a significant accident on the title. $1k probably won't even cover the treatment of day of injuries. sigh

Should I plan to sue at-fault under-insured driver?

    Posted: 17 Jan 2022 05:38 PM PST

My car was rear-ended where the other driver is at fault. I live in California where the minimum liability property damage is $5,000 which is exactly what the driver at fault had on his policy. Their insurance company quoted that the repair for the damage on my car would be ~$1800. I took it to a shop recently and they quoted $9,500 which matched to what I researched given frame damage, etc. Sadly, I do not have collision coverage so I'm out of luck for the remaining $4,500 I will have to pay if I accept the $5,000 liability payout the other party will payout.

Looking at my potential options, should I

    1) pursue the at-fault driver and sue to retain the $4,500 first through communication and then through suing if we don't come to an agreement?

    2) do I take the $4,500 hit

    Tesla ACV Dispute (CA)

    Posted: 17 Jan 2022 12:39 PM PST

In October, I was involved in an accident in my 2017 Tesla Model S. Last month, State Farm sent me a total loss offer which is laughable. The comped vehicles they used were single motor (mine is dual), and didn't have nearly the options mine does. I've been going back and forth with them for weeks. The main issue I'm having is regarding the ACV for the Full Self Driving (FSD) option.

I bought my car used from Tesla directly in 2020. The FSD was already added when I bought it so it was included as an option in the price of the car.

The initial total loss offer gave me no compensation for my Full Self Driving. Keep in mind, the FSD upgrade is a software upgrade that is bought on the app and installed via a wifi download. It is my understanding that Actual Cash Value (ACV) takes into consideration the replacement cost minus depreciation of ALL options. Since it's a software upgrade that doesn't depreciate (it actually appreciates as the cost for the upgrade is increasing to $12k this week), I feel I should be compensated for the actual value. After fighting tooth and nail, they finally sent me an offer of $5k for it. Here's a screenshot of their explanation as to why it's so low: FSD explanation

State Farm is refusing to tell me where they got this info, but it is either way outdated or just outright wrong. Tesla hasn't offered "advanced autopilot" as an option for 3 years as it became standard on all vehicles in 2019. Maybe this was the cost of the option 5 years ago, but the current cost is much higher.

My plan is to buy another Tesla to replace this one, but I don't feel I should eat $7,000 to replace the FSD that I already have on my current car.

It seems like State Farm was completely clueless throughout this entire debacle and everybody I talked to just made up whatever fit their narrative. Anybody have experience with this? Any guidance would be greatly appreciated!

Check engine light on 1.5 month after being rear-ended

    Posted: 17 Jan 2022 10:04 PM PST

    Hi all,

I got rearended about 1.5 month ago and I am still working with the other driver's insurance company on the payment. The obvious damage was just cosmetic on the bumper and I plan to just take the money without fixing the car. However, i did experience a few misfires after the rearend collision and the check engine light went on last week. I took it to a shop and it was due to broken engine coils. I replaced all the engine coils and I costed my $1400. I am not sure if this is anyway related to rearend collision and is there any way to find out or get anything from the insurance company?

    thanks.

allstate medical coverage through auto insurance

    Posted: 17 Jan 2022 09:07 PM PST

    Hi all! (repost)

In October I was in a car accident (so this is about car insurance and i'm in texas) and the other person was at fault. They took responsibility and made the claim right away. my car was totaled and I have been seeing a doctor for my back, knees, and hips. Nothing is broken but definitely still in some pain. My question is, I am still seeing the doctor and he wanted to get an MRI just to see why y back is still hurting (pinched nerve etc) and I am nervous about the medical coverage. The woman at the office was telling me that they bill at the end and that's when the negotiations happen. She mentioned that they may deny some claims and that got me really scared because now I'm scared I'll gave to pay some more medical bills. We have been going through Allstate for everything and I am curious as to what I should be asking and what I should look out for. Also if they deny some what should I do?

The car was technically in my mother's name and I think she just took the car off the insurance without a total loss claim. What should I do to prepare?

    Thanks!

Moving out of state, weird issue

    Posted: 17 Jan 2022 08:42 PM PST

I am moving from NJ to FL in about 6 months. My car is currently on my parents insurance, and the title is in my mom's name. I am looking to buy a new car (not right away) after the move. I'm aware that I need to have the car under my own insurance, and in my name, but I'm not sure what order I should do this in. Should my mother transfer the title to me now (6 months pre-move) and I get my own NJ insurance until relocating to Florida Or should I wait until I havre a Florida ID, then have the car transferred over at that point.

Follow up question: I got a "careless driving" ticket (NOT reckless driving) when I was 17. This was 6 years ago. The 2 points are long gone off my license, but will this affect my insurance rates as I shop around? Is this something I even need to report seeing it was so long ago? I have had no accidents or tickets (other than the occasional parking ticket) in those 6 years. Thanks!

My friend wants to file false hit and run claim on me.

    Posted: 17 Jan 2022 08:16 PM PST

Ok so about 2 months ago I was squeeze in a parking spot, so while turning and getting out of the spot I accidentally hit my friends car. I hit his taillight and read bumper. He was at my house at the time, I just was going to the gas station quickly. He told me no worries we'll figure it out tomorrow ( we were both drunk). So he later in the week ends up having to stay at my place for a week or more cause of problems with his girl. He never brought up the car. Just a few days ago he got mad that I wouldn't front him money for something. So he starts texting me saying "hey I got my car quoted, $800. Wanna pay now or go through insurance or want me to report a hit and run?". His car wasn't badly damaged honestly, and he was threatening me that I did a hit and run. ALSO, he doesn't have a driver license or insurance. So basically my question is.. can he even claim a hit and run 2 months after the accident?? Also, will my insurance even cover him if he doesn't have a license or insurance (not sure how it works). He keeps saying "just give me $800 we're good" but he won't provide the proof of quote lol. He does have a video of my jeep and his car where it was obvious I hit him outside my house. But I also have it and the date is in November. Idk what should I do Lnao

Car insurance company ignoring photographic evidence in favor of mistaken police report - advice?

    Posted: 17 Jan 2022 02:02 PM PST

So, last month during a snowstorm, a car came spinning off a highway entrance and landed in the center of the motorway across two lanes, as I was heading toward him at 50 mph. I had no time to brake in icy conditions, and to avoid T-boning the guy, veered off to the right slightly to try and miss the car. I ended up striking the rear left of his car, while causing extensive damage to the front of mine (total loss).

The police come and write a report, we report to our respective insurance companies, then wait for about three weeks. At this point my insurance company gives me a call and tells me they are going to find me at fault for the accident. In disbelief, I ask for the police report, which they send to me.

I find that the report has been written up with mine and the other driver's reports completely reversed, so it comes across as me coming spinning off the entrance and him striking my vehicle. I contact the officer to get the report amended, along with extensive photographs of the incident showing that it couldn't possibly have happened the way in the report, and tell him that what is written in the report is definitely not what I said to him. He simply adds a note to the report saying I am disputing it, and doesn't make any amendment.

Meanwhile, my insurance company is not budging on assigning me at fault, despite seeing the same photographic evidence and my claims adjuster even agreeing with me over the phone that the police report cannot possibly be accurate. They have given me another two days to try to get the officer to amend the report, but then are going to close out the case and pay the other driver for his damages, with me listed at-fault.

I feel that my insurance company is not advocating for me at all to the other driver's company, nor stretching to help me get the police report corrected, even in the face of strong evidence. While I understand the police report carries considerable weight, there is evidence directly contradicting it, and they have made no case as to how the photos can be reconciled with the report. I won't go into full detail, but one key piece is that there are photos showing no damage to the front of his vehicle, yet in the report it says he hit the rear of my vehicle with the front of his?!

Is there anyone who knows my options for either third party arbitration, or for escalating this legally? I really do not want a rate hike based on this, and just want the fault to be assigned fairly.

I am based in MN, where the accident occurred.

EDIT: I may be making the conditions sound worse than they were, for what it's worth they told me I'd be found not at fault in my first phone call with them, before they received the police report. If the issue becomes my driving in the conditions, fine - but right now we can't agree on the role of each vehicle, which I am trying to correct.

How long do at fault accidents stay on your record in california?

    Posted: 17 Jan 2022 06:06 PM PST

I tried getting a quote from metromile, but I did not meet their underwriting eligibility, since I have two at fault accidents. Does anyone know how long exactly, particularly in California it will take for my accidents to removed? I heard 3-5 years, but I also heard it depends on the financial severity of the accident as well as the insurance company itself.

Your response is very much appreciated. Thank you.

Who can I contact if our insurance in noncompliant with new covid regulations?

    Posted: 17 Jan 2022 06:05 PM PST

I have Blue Cross Blue Shield of Texas, and they are noncompliant – from my current understanding – with Covid-19 reimbursements.

    1. Last month, when I called the number on my card, the agent told me that BCBSTX does NOT cover walkin covid-19 costs for symptomatic patients have not met their deductible. However from my phone call with a state-run informational hotline line, they told me due to the CARES act this would not be allowed and they would have to foot the bill as long as its a testing center and not an ER/specialist.
    2. Today (since insurance companies are now requiring over-the-counter to be covered up to $12 per test, up to 8 per person per 30 days), I went to an in-network CVS who said that BCBSTX has not given them electronic authorization to run over-the-counter products. The alternative page on BCBSTX site says over-the-counter, but the form they provide says RX / Prescription. I called the phone line and the representatives hang up after I mentioned "At Home Covid Test"

    TLDR:

    1. BCBSTX says in-person covid tests not covered if you haven't met your deductible
    2. BCBSTX refuses to acknowledge questions about at home covid tests

Who do I even speak to, to report these incidents? Luckily my university runs their own testing, but who do I talk to about the noncompliance of my healthcare provider?

When does insurance decide when a vehicle is a total loss?

    Posted: 17 Jan 2022 05:12 PM PST

6 months after leasing a new car, I hit a deer. The initial estimate is $5,500 and that's without opening my hood and finding internal damage. Estimate and pictures were sent to my insurance. Fast forward 2 months and now I'm finally getting to take my car in to start repairs tomorrow.

My question is, would my insurance have decided whether or not my car is a total loss when the initial estimate and pictures were seen, or will they wait until after the body shop starts taking it apart and seeing what other damages there are?

    Posted: 17 Jan 2022 04:49 PM PST

I was involved in an accident a few months ago and at the time I had a relapse in coverage so my insurance company resolved themselves of all claims. I'm am sure that the accident was not my fault even the officer at the scene of the incident said so themselves. Now their insurance company is coming to me to repay them for the damages. How can I resolve this?

Insured in Ontario, accident in Calgary

    Posted: 17 Jan 2022 07:50 AM PST

i'm a resident of Ontario and in spring I travelled to Calgary and rented a car. I got into an accident in a parking lot where I backed into a car that was backing into the spot next to me. My visa covered the damage on my rental car, but 8 months later I got a letter from the other party's insurance asking for payment for damage on their vehicle since they deemed it my fault. I sent it to my personal insurance (TD) to handle. I guess the confusion is that in Ontario, each party would go through their own insurance but in Alberta, the law is different and their insurance can go after the person at fault. My personal insurance was trying to get me to through my Visa since I got the rental car repaired through them, and my Visa says it would fall under 3rd party liability through my car insurance, since they only cover the rental. I eventually get a letter from TD that says my case is closed, so I thought everything was resolved. I got a letter last Friday from a collection agency saying that they are collecting the payment on behalf of Certa (the other person's insurance). I left a message with my claims advisor, but my policy with TD has been expired since and I have gone with another company. I still do have another policy for my motorcycle with TD though.

I have a feeling they closed my case and did not pay the other insurer. How would I go about this? The claim is around 2500 that the collections agency wants me to pay.

Will my current provider know if I'm shopping for new rates

    Posted: 17 Jan 2022 04:05 PM PST

Quick and easy background - 26yo male, drive a 2015 f150, on parents insurance w/ full coverage still, paying very little for my portion (trucks paid off).

Got a dui a year ago (never had a single ticket before this), the administrative (dmv) side of things is just now coming to and Im prepping to get my SR 22 insurance and booty hole ready for the rate increase but have a few questions. I've completed every other criminal and administrative requirement before they actually became required to stay proactive during the entire process (aside from SR 22 and 30 day suspension), DUI eval, comm. service, victim panel, fines, etc. all complete.

1 - don't want to ruin my parents record but I will cover policy increase when the insurance finds out, should I just go off on my own or hope the combined family history of good driving may save me some $$$? My parents have been supportive while also still never missing a chance to let me know how stupid i am. They say they'll figure it out, but I'd feel awful if their insurance dropped them because of me.

2 - if I start to shop around for insurance now before I need it just to prepare and budget, will our current provider catch wind of it and pull driving records to see why I may be doing so?

3 - do I need anything special with SR22 to drive my wife's separately insured car? (or any other car for that matter, assume no ignition interlock required)

4 - i know people say the premium hike drops after so many years... does this start from the date of the arrest or date of initial SR22 requirement? Realistically I've gone a full year with full driving privileges, haven't gotten any violation in any way since.

basically I want to prepare for what I can expect to spend, but don't want my current insurer to find out immediately if I can help push it off a bit.. I will have to have sr 22 for two years but not starting for another month or two, so don't want to start overpaying before it counts if that makes sense. I know to check w/ progressive as the key target for a policy.. i'm hoping I can get some genuine advice but know the DUI hate will trickle in as well, I've dealt with it for a year.

Changes to insurance without notification? LA/TX

    Posted: 17 Jan 2022 03:30 PM PST

I'm a dependant on my mom's insurance for my expensive medication. This is known, it's been covered by my mom's company (in Louisiana) for years. We both live in Texas, but she works in Louisiana.

Today while at a doctor's appointment, while waiting to be called, the receptionist said that I was not active on the policy.

This is weird because I've had multiple insurance-related instances come up this week, but it hasn't been a problem. I paid out-of-pocket, came home, and learned from my mom that:

    1. Someone changed the insurance policy (in Texas)

    2. Her work HR changed it back?

    3. No one was notified of anything. Neither the change nor the change back.

I know we don't have the full story, but it seems very suspect that we were not notified of anything. She only learned that it was "changed back" while on the phone with HR, after my partner had called to tell her what had happened.

I want to stress that I know we don't have the full story, but I just want to know what could be happening.

    Car Repairs

    Posted: 17 Jan 2022 10:58 AM PST

Background: Curb crash, car needs alignment done, mount bushing torn , possibly suspension damage?

Ive only gotten an estimate at the shop that I was working with for my olbiterated wheel. I already bought the replacement wheel from ebay so thats done and can move forward with the actual repairs. My car has not been looked yet under the hood yet as far as I know, so no parts have been ordered.

My insurance adjuster will not answer, I understand they are busy but its been a week now. I cannot wait 30 days for this repair to start. I will miss weeks worth of work. I need to take it to a mechanic that can take me this week. How do i navigate this problem when my insurance adjuster isn't answering?

I want to follow the step by step process, but it's hurting just knowing my car could be fixed in 3 days. If they don't contact me this week, can i just take it to any shop and get it fixed.

    MRI was denied

    Posted: 17 Jan 2022 11:18 AM PST

    I live in America.

I've been in a lot of pain for a while now. Lower back, I have a disc that slides out. I also have nerve damage.

I've been through PT but the stuff they need me to do to build up my muscles makes my disc come out so they had me stop but nothing to replace it.

    I've been so miserable I can't sleep, I can't sit, I can't stand, I can't walk, I can't run, I cannot do anything without pain.

    I've been very patience.

At one point things were so bad I couldn't stand up straight or even walk correctly.
I started getting deep tissue massages (this was in the beginning when I really didn't know what was going on with me). I just happen to have a friend who did this for a living and when he realized how bad off I was he started on me. started working out and stretching. I recovered about 95% and realize there was something else going on since we couldn't get that last 5%. I signed up and went to PT and thats when I learned about my disc. Doctor did a xray, but it would now seem that the disc isn't the only issue. I was at my PT complaining about how my disc must be out but my PT said it wasn't out.

So I went to back to my doctor explained about how my leg was falling asleep randomly and about the level of pain. He wanted to do a MRI and the MRI was declined because they didn't believe it was medically necessary.

I have no idea what to do and I don't know what long lasting effectives this will have on my body.
I'm already at the point to were if I can receive no help for this level of pain I cannot continue.

I have no idea what to do. Death seems like a better option then living in pain so severe.

I already had to quit my job over this.

[CA] Where do I go from here?

    Posted: 17 Jan 2022 07:12 AM PST

To summarize, I was yielding to oncoming traffic, a car rear ended me while I was stopped. Got out and saw that the person who rear-ended me was rear-ended by another person.

Notes: I am in a rental car and I am leaving CA today. I have video footage after getting out the vehicle. The person that hit me was on video saying "I saw that you were stopped" and "you did nothing wrong". I bought collision damage from Priceline but not Alamo. I also have my own car insurance with collision insurance.

Do I just drop the car off at the rental place and go on with my life? Also, who do I file the claim against? The person that hit me? Or the person that hit them that caused the accident?

Update: I just dropped the car off and gave them the other party's' insurance then went on w my day. They didn't charge me anything.

    got into my first accident...

    Posted: 17 Jan 2022 10:20 AM PST

Hello guys, hoping someone can help me out here, quick throwaway account because I just don't know where else to go. So on December 12th of 2021 the driver I was following apparently missed thier turn and slammed on thier brakes (to the point that they were smoking) despite me following from a reasonable distance and going the speed limit I just didn't have enough time to stop and rear ended them, me being an 18M probably didn't look good to the officer who eat up their story of me speeding into the back of them and how they thought I was distracted. Anyway long story short I receive a ticket for following too closely and the officer says I am at fault. The question I have is that i still have not heard anything from my insurance company, abouslety nothing. I'm pretty concerned about when my rates will increase but they've yet to contact me to even ask about the accident. I don't think I have any type of accident forgiveness on my geico policy so I would think my rates would definitely go up... what could be going on here? Thanks a bunch!

Possibly revelant information: I'm a 18 year old male My vehicle is a 1998 silverado V8 4WD I pay $544.36 a month for geico I live in the state of Georgia
