Posted: 28 Jan 2022 12:11 PM PST I'm not sure where to start with this, but to put it bluntly, my father's girlfriend and I have never gotten along. When I turned 15, I got my first job, and I worked the shit out of that job. I made over 15k a year there, just working part time. I got a raise and promotion, and started making around 20k the next year, and before I went off to college, I had around 25k in my account. The issue is that the account was opened when I was a minor, therefore, it was a joint account, as she had stated she was the legal guardian to monitor and help manage my account. Before I was set to go to college and was no longer a minor, my father's girlfriend took all of the funds from the account, and put them into another joint account at a financial credit union. It was under her name primarily, then mine, but she never informed me that she was going to open this account. She also happened to have forged my signature to open this account at the credit union, and took all of my college savings from my original 'commercial high school checking/savings' and threw them in this account. On multiple occasions I discussed with both my father and his girlfriend that I was not okay with this, it made me uncomfortable, and that I did not trust her. They proceeded to ignore me, and gave me no access to this savings account at the credit union. I then went to the credit union, requested my account number and to check the balance, and they seem to have emptied the account. I have all of my paystubs to prove the money in the account was provided by me, I have all of the documentation of the forgery of my signature, the transfers that were made without my knowledge, and recordings of phone calls where I begged for my money back, and they denied me any chance of ever seeing that money. What do I do? I can't go to small claims court due to the amount surpassing the maximum according to NYC/state laws. I know I will have to seek out an attorney but what do I file for? Theft? Is there a proper legal term for what they've done? 1st Edit (as I predict there will be more to come): My father's girlfriend HAS done this before. Her own son, who was the oldest 'child', went through the same situation. She set up his first bank account with him (commercial joint- high school checking/savings) after he found work, and as soon as he was to leave for college, she transferred all of his savings to a separate account at this same credit union. Without his knowledge of this new account, he figured he had no way to combat the scenario, as she was actually his birthmother and he was much closer to her than myself. Unfortunately, he later took his own life, the rationale being that he was shit out of luck, no money, bad grades, no friends, and no support. So there is a pattern, but I can't necessarily provide proof other than SS of texts that this has occurred before. Edit 2 (in slight, weak defense of myself): I was a kid. I was being gaslit, manipulated, verbally berated, and bashed at every corner. Anything that I did while living there was because I was threatened or coerced into doing so. As I started prepping for college, I stopped agreeing with them, and for that got kicked out. Please understand that while you type out your response. I was a kid, and didn't know any better, and am still struggling to figure all of this out myself. I posted because I'm still just figuring this adult shit out, and I'm trying to take my life back and to get my money out of their hands. Hospital sent rape kit bill to collectors, can I sue? (Colorado) Posted: 28 Jan 2022 07:46 PM PST Location: Colorado In 2018, I was hounded by debt collectors over a rape kit that occurred in 2016. I did not provide my hospital with my insurance information at that time. It was supposed to be billed to the Division of Criminal justice. It was not and I had a 4 plus month long ordeal sorting it out. A couple of things that happened that may be illegal, please let me know if not:
This experience traumatized me and still haunts me to this day. I experience a wide range of side effects from it. I want to know my options, but I don't know how to even begin. Is this something I can pursue? If so, what type of lawyer do I need to look into? Am I past statue of limitations? I'm gonna do my best to answer any questions, so if I've left something crucial out please let me know! Y'all helped me tremendously 3 years ago when this all happened. Am I Protected from My Husband's Debts? Posted: 28 Jan 2022 04:01 PM PST Unfortunately, my husband has become addicted to risky stock trading and and uses large amounts of margin to invest on the Robinhood app. On multiple occasions, this has resulted in margin calls that he could not afford to pay. I have reluctantly helped bail him out multiple times, and I hoped that he would eventually realize what a terrible idea investing with margin is, but he keeps making the same mistake and losing money. I told him I was no longer willing to bail him out, but he did not respect my boundaries, and has removed money from our joint savings and checking accounts without my permission to cover margin calls (of note, they are joint accounts, but I am the only one who contributes any money to the accounts). I ultimately decided that we need to completely separate our checking and savings accounts since he cannot respect my boundaries. My question is....if he ends up owing a large amount of money due to his risky investing habits, am I protected from debt collectors as long as our assets our separate? We actually do have a signed prenup that states I am not liable for his debts. I don't plan on divorcing him over his addiction, but I want to make sure I'm protected financially. Posted: 28 Jan 2022 01:16 PM PST I live in Wisconsin and have an older woman that lives above me that is out to get us. My roommate is moving out across the country and had 4 friends over as a small going away party. We were doing nothing louder than talking and the time was 8:30pm. Quiet hours for this place is 10:30pm to 7am. Our neighbor called the cops saying we were throwing a "raging party" and were underage drinking, playing loud music, and screaming. All 6 of us (4 people, my roommate, and I) are over the age of 21. None of the above accusations were true and the 2 police officers that came and talked to us left without any issue. Is there any way that our neighbor could get in any trouble for putting in a false call? This was not the first time this has happened, one of the people that lived in the downstairs part of this duplex in the past had the cops called on them for snoring too loud in the morning. We feel this is just unfair and a total waste of time for the police and I don't want something like this to happen again. Is there anything we can do to get her in any form of trouble? Employer telling employee he cannot wear PPE? (Missouri) Posted: 28 Jan 2022 05:56 PM PST My husband came home fuming today because of the following interaction. My BS-meter was off the charts. Apparently he is not allowed to wear any hearing protection at work, even though he works as an automotive technician. That means there are pneumatic tools loud bangs, and just loud industrial noise in general. Now my husband is also a musician on the side, so normally he wears ear protection at work so he won't lose his hearing. Hasn't been a problem until his new job, today his manager informed that he has to stop wearing hearing protection or he is FIRED. He also informed my husband that the reason was he could get hit by a car backing in if he is wearing hearing protection, and that if he DID get hit he (my husband) would be liable since he was wearing hearing protection and he could have heard the car if he wasn't wearing ear protection. Now I worked on a flight line for awhile, and everything my husband's manager said sounds like a manager talking out his backside because he thinks he knows better. If a guy on the flight line got told he couldn't wear hearing protection at any point we would have probably all walked. It was also pretty well assumed that if you got hit by a guy towing an aircraft while you weren't doing something that violated the process then the company would be liable. That being said, I'm not a lawyer so I wanted some opinions on this. Just for the curious folks his go to hearing protection are the Howard and Leight impact sports, they provide active protection and come with built in amplifiers so you can hear things like conversations and beeping. Edit: I guess just to clarify, does the manager have any ground to stand on telling him not to wear ear protection? And is he right about the liability being on my husband if he gets hit by a car? They are currently in foster care since a month ago. They were with my aunt and grandparents for some years but now they are back in the system after my aunt and uncle said they "just can't do it anymore". I have all there things because they wanted me to come get it so it wasn't lost. I also didn't know they were going into foster care until ten hours before it was happening(it was kept a secret by my aunt and uncle). I do have a lawyer and I have an apartment but I'll have to get a bigger one. I know that the law says that I have to be 21 in all but is there not ways around this? My mom is also alive, she was having a mental breakdown that led all of us to have to leave back in 2019. She is really recovered now and she just wants them back with her or me. Won Company Sales Contest Fired Without Receiving Prize - Am I still entitled to the value? Posted: 28 Jan 2022 08:44 AM PST I worked my butt off to win our sales contest/goal where the prize was a vacation and maybe an estimated $1,000 worth of prizes. Any employee who hits this level gets entrance to "the club" and then gets the prizes and trip. The only rules of the contest said I had to be in good standing at the end of the contest, which I was. In the weeks after the contest, they fired me (This wasn't for cause. Even though they gave me a reason it's pretty clear they won't be able to dispute my unemployment claim) and told me I will no longer receive the prize. I'm trying to figure out if it's worth getting an attorney or if I have a claim for wage theft. My feeling is that this was akin to a commission or a bonus, and it should be. I worked my tail off specifically for this prize, put in longer hours, worked through breaks, etc. I would guess it has a retail value of $3k to $5k, and then they fire me? Posted: 28 Jan 2022 08:40 PM PST I am so in shock I just found this out tonight, I live in Canada and don't know what she can do legally, but long story short she was getting sick about a year ago, woke up not being able to breathe a couple times (wasn't covid) and she told him to take her to the hospital and he told her she would be fine and to breathe into a paper bag… she went anyways and she ended up being ok and they said it was anxiety but then she got suspicious and looked on his phone and saw he had googled recently "how to kill your wife". I know he's an idiot for searching that but honestly I never thought him capable of being someone like that. She did confront him about it right after and he said oh it's just google it suggests silly things and my mom didn't know any better so she brushed it off. Luckily he found out that she had told us that she was worried he was poisoning her but she failed to mention the google search at the time because she felt stupid for accusing him of that. I saw a new dentist for a cavity in one of the teeth bridged by the spacer. She recommended that I replace the wire spacers with a more permanent solution, and I agreed that I would like to down the road. While filling the cavity, she removed the spacer and refused to put it back, stating that it was not a good long-term solution. I explained to her that my teeth would shift without the spacer holding the gap apart, and she recommended that I make an appointment with an orthodontist. I never consented to the spacer being removed or signed anything saying I was aware she was going to do so. Can I hold her responsible for the cost of going to an orthodontist? He does it to all the girls there but especially her, like a lot. She tells him to stop constantly and he'll just say it was an accident and he gets away with it. And he's gotten even worse over time. 30 times in one day once. She told her manager, HR, the district manager even knows. And they won't help her, and they won't fire him. They briefly moved him upstairs then went right back to scheduling them together, alone for entire shifts, and it continued. They keep saying he's on his last strike but he keeps doing it without any consequences. What do I do? When I was 17, I told my mother and she believed me, confronted him, and he confessed. She then elected to remain with him. I have cut all ties to my mother and stepfather. But I want justice, I want him to rot in prison where he belongs so that he never hurts anyone ever again. My question is, will this case actually go anywhere, or is it all hearsay? I am in therapy and have PTSD, anxiety, and depression stemming from this abuse, in addition to mental and physical abuse from him. I want my behavioral health treatments and appointments covered as well. I want to take him to court and make him pay for what he's done. Our next step is to attend her court date and contest the ticket, due to the plates being expired and us being unable to re-register the vehicle due to the dealership not providing us nor the owner of the vehicle (my brother in law) the title, nor send the title to the DMV. When she goes to court, should she attempt to represent herself and explain the circumstances and hope the fine get reduced, or should we attempt to find a lawyer to assist us? He lives in a different unit but with the same letter number right next to us. He says he has me on ring taking Amazon packages. I've had Instacart, Walmart and Dood Dash constantly dropping my orders off to different parts of the complex. Of course the driver decides not to take a picture of my order being dropped off at the wrong house. But we do have previous orders shown with a picture being there. He's said he's going to press charges. He's already approached me once, and my husband yesterday. The cops said if he approaches us again to call the cops on him for harassment. I signed and sent it back. it had been over six months and I didn't receive any notice. So, I asked her back in October if there's any update. She answered no. So about a week ago I found out through a mutual friend that the divorce was completed back in September. But I have no notice from the court nor her lawyer. I don't know what my divorce date is. So to see anything about it I had to download and open the file. When I looked at the first two they were different names. It wasn't until I got to the third W2 did I find out which one was mine. I also had to have a friend message him back in September to see if I had any mail there and he said "yeah some stuff from her car company but I just toss it out". Can I take legal action? I live in Pasadena, CA in a rented apartment and I have a shared wall with my neighbor. A few months ago, the landlord hired someone to cut a rectangular hole approximately 36 inches by 70 inches (a standard door size) in the shared wall and installed a thin, sliding door with about a .25 inch gap around the edges. He put a small metal bracket screwed into the door and the wall to lock it into place, though a good shove would easily break down the door. My unit is a 1 bedroom 1 bathroom and I believe my neighbor's is the same. I am assuming he cut the hole in the wall because the units were in violation of some kind of zoning law or something, but I'm not sure. I think my neighbor is a hoarder, and there is constantly bad smells seeping through the door and I have had to deal with cockroach issues there as well on occasion. Additionally, I can hear our neighbor quite clearly and I am assuming he can hear my conversations, music, etc. as well. I've been living with this for several months now but recently realized how ridiculous the w'hole situation is. Do I have any recourse other than just moving out and finding a new place to live? Posted: 28 Jan 2022 10:28 PM PST I just revoked power of attorney held by my brother over two properties my grandfather left me in 2018. We had to go through probate, but they are now in my name legally. When he received the formal notification through certified mail, he started blowing up my phone with calls and texts but I did not pick or read what he had to say. Before all this, he tried to convince me to go social disability and even tried to convince my husband of this as well as after yelling at him over the phone for suggesting something like this. Last year, I told him I would let him move in with his family until they could find a place of their own. The real problem started he started to assume I would sign said property over to him but this went out the window when he refused to let me and my own family move into our mother's house after having a small break down. She died in the second house, and it had been months since I stepped inside it. After this, my brother told the current renters living at this property that I was not moving in. I am a very talented master plumber, and I started with my current company 1 year ago today. As soon as my wife got a positive pregnancy test, my entire perspective on finances and life changed. Previously, I was far more concerned with how much I enjoyed my work than I was about my commission- but I have never been ripped off until now. With a baby on the way, I started looking back through all the numbers for last year. What I found was extremely disappointing. I was killing it all year, putting in more hours and doing significantly higher-ticket jobs than all of my co-workers who had much less experience (only 2 had more credentials and years in the field). But my year-to-date pay was WAY below the range my boss said it would be when he hired me. I hit 73k instead of 100-125k. I made more than this in South Carolina for Christ's sake, 73k is barely livable in this extremely expensive city. The quotes we're getting for child care is 2,300 per month… I'm paid on commission but there is no transparency. The office factors in material cost for every invoice, so there is no possible way for me to know what the actual numbers are. They're basically able to do whatever the hell they want with the numbers and each invoice is inaccessible to me as soon as I roll away from the job site. I'm a dumbass for not keeping an impeccable record, but as soon as I gave my boss an ultimatum and told him I will be writing everything down my monthly revenue magically doubled without a change in my performance in the slightest. My question: am I just completely screwed? How could one investigate my revenue history? Is there any recourse that would be worth the stress with a newborn baby? I know two things: what they say was my monthly revenue is completely wrong; and there is no possible way for me to obtain the records without the intervention of a third party. I quit today and am moving on, but wanted to see if there's any conceivable recourse that would even be worth pursuing after so much elapsed time and numbers.
