After signing my lease, but before moving in, I was told the last thing that needed to be done for my apartment was to have the tub in the bathroom resurfaced. It was scheduled to be done the day before I moved in, but was delayed. It was rescheduled and delayed several more times before the work was finally done 3 days ago. When speaking with the owner of the complex, she told me the only premeasures I had to take were to remove my pets from the apartment for a day because of the fumes. I already qasnt thrilled i was expected to pay to board my pets for work they didnt schedule properly. Anyways, the afternoon after the work is completed, I get home to find that almost my entire apartment is covered in a layer of white powder that looks like spray paint. I am informed that they had to "grind" off the original surface of the tub before the work. They were supposed to use a special vacuum to suck up the "dust" and vent it out off my 3rd floor balcony. I have no idea if they used that or not, but there are now white flecks of paint? Or just like bits of enamel all over everything I own and wont come off. Right before moving in, I had bought $10k worth of BRAND NEW furniture. I've had it less than two weeks and its covered it white flecks. I still have all the receipts and my first financing payment isnt even due on the pieces till the end of January. My desk, my personal artwork I'm working on, my clothes, my old military uniforms hanging in my closet, all messed up now. All of these things are items I could have protected and covered up if I had been informed on what they were going to do. When the complex was originally telling me what the work would be, they gave me the impression the resurfacing would just be pouring new enamel in the tub and hardening it. Nothing was mentioned about grinding off a surface first. I have already informed my complex and they seem incredibly sympathetic. They have sent a "cleaning crew" out twice to clean my apartment, but that crew is one 60 year old woman the owner of the complex knows personally, not a professional remediation company. All she did was mop the floors and wipe down the counters. Incan walk over Tommy couch and slap the cushions and white powder flies up in a cloud. Needless to say, the "cleanings" have been far from adequate, and nothing has been done about all my damaged furniture. I dont know what to do from here. My apartment has tried to remedy the situation, but not effectively. I have no idea what this powdery substance is all over my apartment and I'm afraid to bring my cats home because they will be exposed to it. My boss is now threatening to fire me for being unable to perform duties in my WordPress development job. Less than a month ago, there was talk of moving me remote, so this is bullshit, I never had any reason to talk to anyone even when I could. I don't have a lot of money to get a lawyer, or even to go into the emergency room. Is there anything I can do to delay him a month, maybe two, until I can figure out what's going on? And we live in a townhome. There's at least 200 homes in the community with a small shared park for the dogs. Today I took my boy to the small park where a lady was inside, I made it to the gate before she starts screaming at me saying my puppy attacked her dog and that I still owed her for vet bills. My puppy has not left my side since I got him at 8weeks old and I can confidently say I have never ever seen this woman or her dogs before in my life. There's at least 6 other pyrs/akbashs that I know of in these townhomes that look exactly like my pup, and if I had to guess it would have had to been one of them. I tried to explain that it didn't happen and that i think she's mistaken about which dog attacked her but she just threw vet papers at me and said she'd sue me if I didn't pay? My puppy has never even been in the park with hers? He didn't attack anybody. Do I need to pay? If I don't pay and she does sue how would that work if it's really just my word against hers? I could really use some advice, I feel bad her dog was attacked but it really wasn't my puppy who did it and I really can't afford to pay other people's bills when we had nothing to do with the situation? Edit- thank you all so much for the input. It really really caught me off guard when this happened and I've never had anyone make threats like this to me before. If it had actually happened I would have been happy to pay, I just didn't want to drain my emergency funds for something that I wasn't involved in whatsoever. I do not use cable and the provider has just the internet for $50. They told me I cannot opt out of the package deal no matter what. However, the move-in checklist states that I have to call this provider and tell them I want the "[apartment complex name] package". Why can't I just call said provider and get whatever package I actually want? We allow kids and dogs to come in to the office so it's not against the rules for her to have been there. I think she's 9? She was left unsupervised for a bit and apparently decided to pull down her pants and underwear and take a scan, which she then printed and left on my desk and floor. I came back into work today and found them, obviously horrified. Boss and HR were notified, the dad of the kid knows and pictures destroyed. I shredded them and didn't show them to anyone not even the dad. Anyone know if that was the right thing to do or if I should be worried? Should I hire a lawyer or forget this whole thing? We had 24/7 access to the entire building so using the kitchen, laundry room, and getting to the garbage bins was never an issue. The new owner (the business was sold about 2 months ago) got overly upset because my girlfriend wasn't awake to allow tech support workers into our room to fix the internet (the building's modem/router is in our closet). Her response was to call the police to have them bang on our door to wake us up. She later texted my girlfriend to let her know she was fired and neither the owner nor the manager has made an attempt to communicate with us since. The cops were here again later today, upstairs talking to the manager. The only things on the 2nd floor is a couple old computer desks and the door to our room, so I'm certain the cops were here because of us. A few hours after that, we find out all the locks were changed except the one that leads directly from the stairs to outside. This means we can't access any other part of the building except our room. We were never told anything about this and we're starting to think the owner/landlord is just trying to retaliate or something. What are our options at this point? Is doing this to us even allowed? Suing paypal in small claims court Posted: 15 Jan 2022 07:18 PM PST I am in Toronto, Ontario, Canada. So basically I sold someone in the USA my Rolex watch and shipped it. I received the (10k) payment through paypal (good and services). Same day that I received the payment my account was limited and asked for id and stuff (even though I have uploaded it before). I called support and they said wait 24-72 hours and it will be solved. When I wake up the next day I see it has been permanently limited. When I called support they would give me no answer. Just say "multiple factors have been considered" and that they cant tell me any of those factors. So now, my money is locked up there for 180 days. Also, to make things even better, the buyer ended up opening a dispute saying my watch is fake (it is not). Nothing has happened with the dispute yet but I am scared I will lose my money as "if applicable" paypal could remove my seller protection and the buyer would get an instant refund. With a limited account and out of an expensive watch. All in the middle of a pandemic. I was thinking of suing them in smalls claims court because I can't think of anything else. I need the money and I am not really sure what to do. I have the tracking code, pics of the receipt, many pics of the watch and everything that comes with it. Also a video of me at the post office with the watch box open putting it in the shipping box and shipping it. All uncut. I took documents everything. Do any of those help? I am a 41 yr old gay man who bought a house last March with my partner and his parents. The property we purchased is backed up to an apartment complex. The apartment complex sits just above our back yard fence and the tenants can see directly in to our yard. We have been having nearly daily issues for 9 months from just one of the tenants. We have been called "Fag" & "Faggot" probably over a thousand times. They say other things like "You aint dead yet faggot?" "Welcome home faggot!" "i thought you guys were going to be burned in a pit"? It starts instantly when I walk in my backyard. These people are in their mid 20s and I swear this is there daily thing. They truly enjoy it. It's to the point that I am uncomfortable going in my own back yard. I feel the hate and it affects my mental health. I ignored it mostly all year but last week I confronted him about it and he just said "Freedom of speech faggot. Freedom of speech." I walked away when I realized I was getting nowhere. I'm an adult...I can handle alot of negativity and I do understand freedom of speech. Are my hands tied? The farmer who works the land tapped my Grandpa relaying a message that the neighbor is asking if it's OK to build a drainage across our parcel. Farmer has no issue with it. In fact he feels this might improve water flow for our land. Grandpa says "yea ok" because he trusts the farmer. There was no direct communication with the neighbor land owner. Just an OK via phone and text to the farmer who works our land. Grandpa trusts the farmer because he's been the hands on steward of the land for years now. Now I think the proper way would have been for the neighbor to at this point send over papers for Grandpa to sign granting this Easement. This never happened. They went ahead and dug the drainage on Grandpa's word via the farmer. Now fast forward 6 months - Grandpa just received a letter from a lawyer asking for the deed owner's notarized signature granting permission for this easement. This document will also retroactively allow for the Easement back to 6 months ago. I'm not a lawyer but the document reads completely one sided. (Maybe it's standard. I have no idea.) The document includes an indemnification section, an interest in realty section that designates the easement as an appurtenance, etc. etc. I don't want Grandpa to sign anything until we get a lawyer to take a look at this. We have no idea what legal / material implications there are. E.G. does this affect the value of the property? I need to help G-pa find a lawyer to review this document. I told my cousin that if our friend (I'll call him Joey) went and left dog feces on the persons door or keyed their car, or some other criminal mischief, that the police would have to have proof that Joey actually did it. My cousin was adamant about letting me know that the police would actually take Joey to jail. I argued that the police can't just say that Joey did it just because he was ordered to stay away from the other person. They have to have proof that he was there and that he did that. It was the only state in the union to follow such practices, dating back to almost a century when the legislation was instilled. When I was 16 (in 2014) was convicted in Union County, NC for 2 felonies on my adult record. From what I understand legislation is being passed to expunge all cases from this outdated law, and they have since changed the law to be more modern, (only certain violent convictions are processed as adults for minors.) So my two questions are: currently in westMoreland county Pennsylvania, these show up on background checks, even though they are over 8 years old. Can these be used against me when applying for jobs? My second question would be how can I be eligible for the automatic expungements in Nc, from out of state? His wife adamantly refused to allow the item to enter their home. So, my mother asked me to keep it at my home temporarily. I agreed on the condition that it leave my property one week after I returned from a vacation. It was left here on 12/18/21. We returned last week. I need to clear out the space to make way for a different item that we are about to purchase. I need this hard drive to go before I can have the other item delivered and installed. I asked him to pick up this super important hard drive by 1/14/22. He doesn't speak to me and has me blocked, so I had to communicate through other family members. I told them that if it isn't picked up by this Thursday, it's getting picked up by the recycling center. He has told the rest of our family that he will sue me if I do that. My parents have Covid right now and can't make the 2 hour drive pick it up for him. Our other sibling works 9-5 daily, and some evenings during the week. He can't pick it up for him. An employee who worked for me part time 3 weeks in December 2020, abandoned his job and stopped replying to our calls and text. We contacted him for an additional 2 months weekly asking him if he was going to work. After 4 months with no response we removed him from payroll. I completely dropped the ball and lost a piece of mail that notified me of him claiming unemployment, the letter being dated 04/2021. I only found this letter today 01/2022 because I was going through a box of papers we were going to throw out. My question here is am I able to contest this or notify EDD that this person should have never been eligible for EDD? Additionally im a bit scared because on this letter it mentions a penalty for employers who don't respond timely: "Fail to respond timely or adequately to requests of the Department for information and are at fault for causing overpayment of benefits (CUIC Section 803(d), 821(c), and 1026.1)." My brother is 16 and I had allowed him to use my PlayStation console around 2 days ago because he doesn't have anything in his room outside of a tv with no cable or anything. I told him explicitly that I do not want his friends anywhere near my PlayStation, that I don't even want them to know that I put it in there. He said ok. I told him this because stuff has gone missing in the house in the past and his friends are known to be around when stuff does disappear. Fast forward to last night, he comes home from god knows where, high, acting confused and came straight to me asking if I took the game system back. This was so sudden and confusing to me because I didn't. I am feeling betrayed beyond belief and my mother was the only thing stopping me from putting this dude through a wall. After interrogating him for an entire hour because he was acting extremely dumbfounded, he said he had 2 of his friends in the house playing the game with him earlier and that he left with them and said their names were Zy'ere and Justin. At this point I am ready to go to their houses to confront someone but my brother being absolutely dumbfounded kept saying that he doesn't know where they lived and they didn't take anything because he was with them the entire time. Now I didn't know where to go from here so my mother and I went to the police station to see what could be done (my mom was convinced that they sold my game for weed money and wanted to see if the police can pick him up since he was high at home while we were in the station.) As I'm filling out the police report many officers are trying to explain to my mother that there's not much they can do because he is 16 and something like this won't stick in a court setting and that we should hold onto the case number to call in when we get more information about his friends since they are potential suspects or if they steal anything else so charges can go into felony territory. We go back home and my brother is trying to explain that he doesn't know why we're pissed and trying to blame him for stuff turning up missing and that it's my fault my PlayStation was stolen because I was home and he wasn't whenever the stealing happened and that if I was not on my computer I would've been able to hear someone break in. Also not likely someone would've broken in and gone straight to his empty room.(no signs of a break in+we have a bark happy dog) Literally impossible unless someone had a house key and stealth maxed out. He was drunk and angry, but has always been a threat to their safety anyways, but he went into their bedroom and started dragging one of them by their legs out of bed because he wanted something that wasn't his. Someone was yelling call the cops, then he began to target them. And he attacked the girl, or literally tackle-shoved them. There was a video recording of it all. So, they wanted to make a report to a cop about what happened. The cop didn't view the video, but they said to keep it for evidence later if they decided to use it in the future. The cop said they can't do anything and that talking bad about the person[attacker] can be seen as bad in the court or that the victims can become the suspects if they were talking badly to the attacker. I'm not sure what that means or if I am explaining it correctly. The cop recommended us getting a OFP, but my roommates don't want to do anything until they move out. So the girl was mimicking his slurred speech, telling him "what is he gonna do," and shouting "shut the f*ck up." I'm wondering if that could make them look bad in court or OFP. Should they just drop it because of her mocking him? We are all scared of the guy, but he comes over even after everything because is the baby daddy of one of the people living there. Thank you. Well my bridesmaid dresses were yellow and when getting the sneak peaks she had used a filter that made them look white. I explained I would like a few true to color ones and that's when she lost her mind. She told me I wasn't happy at all at the wedding so of course I wouldn't like them- that I "dismissed her like a peasant" (all that really happened is she came up to me and asked if she was okay to leave after the cake cutting and I said yes) that we were so mean she left in tears etc. I looked at her negative reviews on her site and in all the responses she said they were also horrible people so I guess that's her norm. She said due to the extensive editing that I wanted I wouldn't have the photos until mid January. It is now mid January and I don't have any of the photos. Now what ? is there anything I can do to get my pictures, a refund, or at the very least be able to leave a bad review without being slandered? Note: My mom signed the contract with her being she paid and now the photographer has refused to communicate with her and will only talk to me (the bride). Neighbors domestic violence and noise complaints Posted: 15 Jan 2022 10:25 PM PST I have this grade A dick of a neighbor that always SCREAMS at his girlfriend in the night. Sometimes during the day but usually at night when he/they have been drinking. I'm not sure how overall violent he is/can be but in general they are verbally fighting every night in a screaming match that's way more from his side. Name calling, threats, the works. At first I was calling the police in fear for her, but now that it's been a year since they started dating (and this has been going on since the beginning of their relationship) I'm also really sick of having to deal with it on a regular basis when I have work/my son has preschool/ etc. The cops always come (because either I call or another neighbor calls) crack a couple jokes with the guy, then turn around and leave. Sold property years ago, not transferred to new owner and now being hit for property taxes. Options? Posted: 15 Jan 2022 10:22 PM PST Around ten years ago I sold an acre of land with a single wide mobile home on it. The sale was done to an investor and closing at his lawyers office. Today I received a bill for property taxes from 2016 until now. At this point they are threatening foreclosure. Obviously I could not care less about the property but it will wreck my credit. Of course I cannot locate any paperwork from the sale. The taxes were paid for several years after the sale. I don't know if he sold it to someone else who quit paying the taxes or what. The property isn't to far away so my game plan at this point is to go to the property and get contact info for the landlord to contact and get it paid. If they are still in business at the same location I'll also be visiting the closing lawyers office. What recourse if any do I have if they don't? If I am being taxed and they didn't file the transfer am I still the legal owner? (i.e. liability for injury?). Other ideas on how to proceed will be greatly appreciated. [link] [comments] |
FL - Apartment complex is ordering all mail returned to sender. Posted: 15 Jan 2022 10:29 AM PST USPS has not been able to deliver to my apartment complex since December due to break ins at the mail area and have been holding our mail for pickup at the post office. Yesterday some people went to pick up their mail and were told that the property manager has ordered all mail addressed to the complex be returned to sender effective in a couple of weeks. Posted: 15 Jan 2022 07:08 PM PST I (22) have 2 younger siblings (13, twins). We have different fathers but theirs has been completely uninvolved (including no child support) since birth. My mother has been unemployed since I was 7 (always chasing the golden goose instead of stable employment). This has led to homelessness multiple times. I moved out to live with a friend's family as soon as I graduated high school, and focused on getting a degree and trying to grow past my childhood. My mother has been clearly cognitively declining for years, most devastatingly in her decision making skills. She has been neglecting their most basic health (they've had lice for years, unwashed and matted hair, no dental hygiene, etc.), and they've been truant for two years, during which time she has neglected to even attempt to put them back in school, going so far as to even lie to me about it for months. My mother ended up getting a place to live via involvement of local resources through CPS and housing vouchers.. She then decided that she no longer wanted to live here, and instead wanted to move across the state. I pleaded with her not to move anyway, since it would be a huge financial burden to move, and she did not have the new apartment/house guaranteed yet. Many people told her it was not a good idea, but she was certain she had "investors" willing to help her start her new business idea - despite having no planning whatsoever (when questioned about her lack of business plans, she responded by saying that I should know better, she picked out a name and drew up a possible logo and everything.) She chose to move anyway without a plan in August of last year. The housing vouchers were not transferred properly, and there has not been stable housing since (sleeping in tents, hotels (where she rapidly blew over $6,000 in tax return money), and now sleeping in the car). The situation of living in the car has made things much worse for the children. When offered a job interview recently at a diner, she decided she "didn't like the look of the place" and instead used the last of her gas money to drive to a different nearby city, where she had no options. She is constantly arguing with my brother because he does not agree with her decisions. I went 2 days without texting, and she has decided to cut me off and that I am not allowed to know anything about them. My sister texts me in secret, and deletes all messages because she is scared my mother will know we talk. My mother has been screaming at my brother all night because he told me about what was happening, and he made one snarky comment about her, as kids do, and under the stress of the situation at that. They are tired of sleeping in a car. They are not being taken care of properly at all. I would do ANYTHING to move them in with me right now, but with my current living situation, it is impossible. I am saving up and applying for jobs to make that different as soon as possible, but my siblings can't wait until then. This is not the same mother I grew up with - she has gotten worse and worse in decision making over the years. I am legitimately concerned for her mental health and would love to get her help, but honestly she has made a number of unfathomable choices with the children and I just want them safe. I intend to call CPS to serve as a stepping stone to get them anywhere better. Being with my mother is breaking them. CPS has been involved previously and has not deemed the situation bad enough to remove the children - I believe they usually look at it from the angle of a poor mother who is financially struggling to provide, but my concerns are that her consistently demonstrated lack of good decision making skills, paired with her negligence (unwashed/brushed hair for years, no schooling, etc.) means that she is simply unfit to parent, and the children need to be removed. The children now are willing to talk to someone and I think are now more scared of staying with my mother than being removed (which I know will change how CPS questions are answered. As a kid, I tended to gloss over some things because the thing I was most scared of was being taken away). My question is - what evidence should I be providing CPS to attempt to get them to take the case more seriously, and from an avenue other than just poverty? Additionally, does the fact that the kids would now possibly prefer to leave hold any weight? My sister wants any options to get out - if CPS comes, can she tell them this, and will it make them more likely to help? [link] [comments] |
