I went in and had a job interview and the owner asked me to do a trial shift on the following Friday. I came in and she asked me to take orders, clean tables, brush the floors, carry stock, clean dishes and polish crockery. She made me work straight for five hours without a break and then she asked me to leave. I texted her asking where did I stand ? Was she going to hire me or did I just work for no reason and she texted me saying "I don't need you and I don't need staff, trials shifts aren't paid and you won't get anything... sorry". The upstairs neighbor recently brought emotional support dogs into the other apartment. He said that he has a note from a professional allowing him to have these animals. I am allergic to animals and moved here specifically because of the no pet policy in the lease. My car was a death trap and i had recently fallen into some money. I bought a 2013 Honda Civic Hybrid that's priced at around $9500. A reliable car that I plan to have throughout my 20's. The deal was taking forever and I had fair credit. One bank agreed to the loan. They said a $4k down payment and they'll accept my loan. I say I can do that- alls is well. The deal is taking forever and the sales guy starts passing my buddy and I weed edible gummies. I got really high. I thought he was being kind at the time because it was taking forever but I'm not so sure anymore. Anyway- its time to sign papers and i was trying to the out of door cost and he wasn't really showing me any numbers that made any sense to me despite my asking for out of door cost. At some point I was told the loan principle would be around $9k which was cool to me even . I was really high and been there for 7 hours and decided to sign. Having a reliable vehicle was important to me so with the marijuana I made an emotional decision that was based off the random number of $9k loan principle. Had to buy a stupid expensive insurance plan cause allstate and geico weren't picking up. (Cancelled it immediately and have found cheaper insurance that I pay in full). I see my credit report and the principle for the loan was around $12,000. I find some peace of paper tucked in my car manual with the price of my car/loan/interest rate (8.9%) and it had an almost $4k "financing fee". So car payment is $132 every 2 weeks. So $12,000 principle loan + $4000 Down +~$3,000 in interest. ________ $19,000 For a $9500 car. If I waited a month I could have bought it cash with taxes and everything so I'm feeling like an idiot right about now. I'm looking into refinancing with capital one. My credit score was in the upper 600's at the time. Not sure if I got swindled or not. I know purchasing a car is expensive. But do these numbers seem right? Like with taxes, title fee, liscense plate fee etc? The first person was foreign and didn't understand me, so I called back a few days later after realizing she didn't disconnect the lines. The second person said they'd disconnected the lines, and I already had my service with a new provider started, so I assumed I'd be okay. Today they charged me $120 and I've been told they can disconnect the lines, but can't issue a refund because the lines were still "connected" even though both devices were actively being services by an entirely different company at this point. The price was $130,000 and we signed a purchase agreement that says so. We have been paying an interim loan. We were also led to believe that we were locked into a price but now they are walking that back. The day our home was delivered to the dealer lot, we got a call that said the home came with an invoice that was $150,000 and we could either agree to the $20,000 increase, or they'd just sell it on their lot for $180,000. We told them we signed a purchase agreement that says $130,000 and they claimed they can't find a purchase agreement and for my SO to send them a picture and stated that if it wasn't signed by an officer of the company that it wasn't valid. We have not seen said invoice. We have been seeking an attorney since the day we were told this but were referred to a different attorney after 2 days of no call back and still have not received a call from the attorney we were referred to. The purchase agreement was signed by their salesman. They have said nothing since my SO sent the purchase agreement to them. But we are worried about them reaching back out with whatever tactic they may try before we get legal advice and we are lost. We're also worried about them trying to sell our house from underneath us. The mortgage company says they have never seen this happen. The dealership already called the mortgage company and now they're (mortgage company) sending over papers with new numbers and we haven't agreed to anything. Posted: 16 Jan 2022 07:56 AM PST Our lease covers Feb 2021 - Feb 2022. We initiated the process to extend our lease another year (Feb 2022 - Feb 2023). Documents were sent mid-December via DocuSign. We signed all fields that DocuSign instructed us to and sent it back. End of December, we got an email saying the envelope was complete and got a digital copy. The copy shows my wife and I signed, and an employee from the management office signed it. Beginning of January, a new lease form was sent to us via DocuSign. I was confused because we got record of the lease being signed. I ignored it initially thinking it was a mistake but we got a reminder email to open and sign. I called the office and they said their system shows no indication that we ever signed an extension, so we needed to sign ASAP. I told them I had a copy of the signed lease extension and forwarded it to them. The office responded back saying they reviewed the document and we didn't sign all necessary pages. They stated that we would have to sign a new lease extension. I reviewed the new file and noticed some discrepancies from their claims and some changes. First and foremost, all fields that DocuSign would require us to fill are exactly the same. The office says all pages must be initialed but DocuSign didn't require that. The end of the lease has a DocuSign signature field and a field to initial that we would sign away our right to join any future class action. This page has a key summary field of all monetary values (rent, deposit, late fees, pet fees, etc.) and serves as the confirmation of agreement. This is where all parties signed on the original lease extension. Second, the new lease form increases a pet deposit and pet fee amount, and has an updated community guideline addendum. When I asked about this change, the employee said they were baffled and stated "I've never see DocuSign change a document before." It's not a significant change, but does mean we'd add $100 to a pet deposit and another $100 to a non-refundable pet fee. They're going to review this with their manager on Tuesday. As far as I'm concerned, it appears that I have a valid lease agreement that all parties signed, including the employee delegated by the managing company to handle lease approvals/signatures. I went ahead and grabbed a copy of the DocuSign Certificate of Completion and the History page just in case. Do I have legal standing in claiming that the leasing office signed the December version of the lease extension and must abide by it? Edit: one more thing to note. The DocuSign signatures for the lease aren't in the fields where the tenants and representative sign, but instead get placed at the bottom of the agreement page. Not sure if that matters. However DocuSign indicates that this is a Signature and are not Initials. Plus the page says "You are legally bound by this document. Please read it carefully. The date of delivery is set. When the date comes, the order says that it is out for delivery. Then night comes (around 10PM) and it says that it will still arrive today. Then the next day, it says that the package is late. And then, later on, the whole order history disappears from the account without an explanation or automatic refund. I have to contact Amazon to see what has happened and ask for a refund. To me, this does not seem legal. But I'm not a lawyer. Sent home from hospital with punctured organ - eligible for compensation? Posted: 16 Jan 2022 11:10 PM PST Sorry in advance as I am new to posting. Am I eligible for compensation considering I almost died from a botched surgery? I (21f) underwent an emergency surgery for ovarian cyst removal. I opted for the private hospital and paid $900 for the surgery. When I awoke from the surgery I was in severe pain and felt absolutely busting for the toilet. The nurses put me on a pan and after trying for 20 minutes, I gave up. This happened a few more time and then the nurse did a bladder ultrasound and advised that my bladder was empty. They put me on a high flow on fluids advising me I was just super dehydrated. I continued to complain about the severe pain, they put pain relief directly into my drip but nothing was helping. Eventually, they heavily dosed me to the point where I remember just seeing nothing but colours and it felt like I was flying through the walls, absolutely tripping out. When I awoke the next day and I continued to complain to my nurses that I was worried something was wrong with my bladder. I told one nurse that I thought that the catheda may have ripped my insides when being removed, she advised me that I did not have a catheda in during the surgery and dismissed my worries. The nurses continued to pump fluids into me to force me to the toilet. I attempted to go the the toilet a few more times until I actually managed to pass blood, instead of urine. The nurses advised me that it was due to the trauma of the surgery and blood was completely normal and I was sent home. From then on all I remember is struggling to do anything, struggling to get up, to lay down, to stay awake. My stomach was completely swollen, I was surprised at the amount of pain and swelling I was in as I have had ovarian cyst removal twice before this surgery and endured fine before this. The swelling went all the way up to my chest and my partner said I looked very pregnany. I was in too much pain to endure wearing pants or underwear and only wore nightgowns. I spent the day of release and the next day zoning in and out of consciousness. I was unable to keep any food down and would vomit back up what little I ate. My partner called the hospital for advice as I had not passed any wind since the surgery and was still swelling more and more, the hospital advised him that tea would help and left it at that. During all this I was still unable to urinate. I woke the next day with my chest feeling swollen and bruised, I didn't have the strength to actually lift myself out of bed. I called for help but my sister was asleep, after a lot of effort I managed to roll out and go to the toilet, still unable to pee I noticed that my vulva had swollen into a ball. I had a breakdown and cried until my sister woke up and found me. She called me an ambulance. The paramedics tried to give me morphine to help the pain but it was ineffective. When I arrived at the hospital I was given more morphine, but it still did not help. I remember laying there with the doctors confused saying she should not be in this much pain but she can't stand me even touching her. They did a CT scan and could see that my kidneys had shut down and there was fluid pooling in my body. I needed an operation right away but the hospital did not have the specialists needed and I was transferred back to where I had the original operation. I was in surgery for 7 hours and in the ICU all night until midday the following day. My family was beside themselves during this time as they were unable to contact me and the hospital was not answering the phone. They thought that I had passed as I was very close to going septic when I was sent in. I spent 5 days in hospital recovery from the surgery, they were very careful during my recovery this time. I had a catheda in for the majority of my stay, had physico therapy and was on a light fluid diet until I passed wind. The catheda was removed the day of my release and I had to pass the bladder tests 3 times before going home. It's been 4 weeks since the surgery and I am still struggling a lot with the pain. I have missed a lot of work and I really struggle talking about what happened, I think I am truamtised by it. When telling my GP about what happened I was fighting back tears the whole time. At the moment I am only going to work for a few hours and then going home because sitting hurts my stitches too much still. My family is pushing me to sue for compensation, but I am unsure if I am eligible. I understand the surgeons mistake as she advised my due to the size of my cyst my bladder was in the wrong spot, but I feel wronged as I was very insistent with the nurses that something was wrong. Please give me advise regarding this, am I eligible? Would it be wrong for me to make a claim against the hospital? Who is at fault, the surgeon or the nurses who ignored my complaints? Posted: 16 Jan 2022 04:38 PM PST i live four block from a popular business with a drive-through line. they only have room for about 6 cars on their property and any further cars back up in the bike line. since the pandemic started cars have been backing up about an eighth of a mile blocking access to my driveway from 9am to 6pm pretty much every day. this is on a minor arterial street in a major city in the USA that's a fairly popular bike commuting route and has quarter-hourly bus service for context. i hate the extra traffic and constant idling engines that this has brought, and i've tried speaking with the business. the local manager is sympathetic and he tried a few things that allowed more of the cars to wait on their property, but corporate doesn't care and made him change it back after two weeks. attempts to contact corporate have been completely ignored; i've tried the general purpose corporate email, the regional manager, and finally the CEO but never received any response. i've filed a series of complaints with the city, and got a call back from a low level staffer, but it didn't go anywhere. they made them put a couple signboards out and then closed my complaints, but the problem hasn't changed at all. people drive down the center turn lane and bikes are forced into traffic as people get angry and speed down the center turn lane, but the police here basically don't enforce traffic issues anymore and i've never seen them ticket anyone in line, even if the cops are on the block for another issue. do i have any cause for legal action against the business or the city? what kind of lawyer do i even look for to handle this? Neighbors are peeping over my fence Posted: 16 Jan 2022 02:25 PM PST Long story short, my neighbors moved their trampoline so that it sits on the fence connecting our yards. They (my neighbors and their kids) will peep over into my yard for hours during the day. Honestly this wouldn't bother me if it weren't for the fact that while they're peeping over they literally scream at my dogs. In return, my dogs bark non stop for hours. It also bothers me that I have no privacy in my backyard now. I can't relax outside anymore because I'm literally being watched and the kids want to scream and ask a bunch of questions. I also don't feel like it's fair to my dogs to be cooped up inside because my neighbors won't leave them alone. On the camera where pictures of my stepdad setting it up. I know it doesn't sound that bad, but that is where the majority of the clean clothes are kept, and I often get dressed in there. Right where the camera was pointed. He didn't get me on camera but there were video's of my mom changing. I don't feel comfortable in the house especially because when we questioned him he got violent punching holes in walls and slamming my mom in a door. I called the police the next night but they wouldn't do anything other then offer us one night in a hotel and took the camera. I have pictures of holes in walls and videos of him screaming and slamming my mom in a door. My mom now just acts like nothing happened. The tree's trunk is just behind the fence line, and the branches are hanging over onto their property. He told me it's making too much shade, and as a result it's affecting his mother's garden located under it. At first I was being nice and offered to trim some of the branches for him, but he was being pushy and wanted me to hire someone to cut it way back all the way which I don't want to do. After looking into the law on this I told him he can trim it back if he wants but that it's not my responsibility. The tree is very healthy and not dead or about to fall over. About 4 months after our last discussion about it I received a letter in the mail from a lawyer. Here's what it says: Via US. Mail To the residents of (My address) To whom it may concern: Re: Back yard Tree Trim We write this letter on behalf of the residents at (Neighbor's address) or the house behind your residence. As you are aware there is a large tree, and we would like to work with you to have this tree trimmed. We would like to collaborate with you to have ti trimmed. Under Civil Code 833: Trees whose trunks stand wholly on th land of one owner belong exclusively to that owner, even if their roots grow ointo the land of another. Civil Code 834: Trees whose trunks stand partly on the land of two or more conterminous owners belong to them in common. I have attached a picture of the tree for reference. This tree sits on your property, and you own the tree. Unfortunately, under the law we cannot just trim the tree on our own. Overhanging tree branches and encroaching roots may constitute a nuisance. See Lussier V San Lorenzo Valley Water Dist. (1988) 206 CA3d 92, 102 n5 (noting that courts simply provide to adjoining landowners' absolute protection from damage arising from natural encroachment of neighboring trees). Civil Code 3502 provides that any person "injured by a private nuisance may abate it by removing, or, if necessary, destroying the thing which constitutes the nuisance, without committing a breach of the peace, or doing unnecessary injury." Although the case law has long held that adjoining owner has the right to remove those portions of the tree that overhang, or roots that encroach, all the way to the boundary line ( See Grandona v Lovdal (1886) 70 C 161), the obligations of co-owners of boundary trees are that both must act reasonably and not damage the trees to the detrement of an neighbor ( see Booska v Patel 1994). Furthermore, the owner may not go onto the neighbor's land and cut down the tree. Fick v Nilson (1950). With the above in mind, please reach out to my office so we can coordinate a solution to having the trees trimmed back. Please reply to the above letter within 10 days of receipt. If we do not hear from you within 10 days of receipt of this letter then I will have to speak to my clients and discuss escalating this through the proper legal venue. My opinion is that this is a "threatening" attempt to scare me into paying for the trimming. Nothing in his quotes reference my responsibility to trim it. Overhanging branches are his responsibility. Furthermore, the attorney who wrote this is a personal injury attorney in another town about 30 minutes from here. Am I right in thinking this? How should I go about responding to this? Afterward, I noticed I wasn't being considered for work opportunities, but I was just told it was coincidental or they were choosing people at random, but that it had nothing to do with my performance or anything. Later, I was told by one of the leads on the projects that one of the reasons he didn't consider me for opportunities is that he thought some projects would remind me of my harassment and he thought I wouldn't be able to focus because I'd be too emotional. Her mother and father had 5 kids. Two biological and three adopted. The biological kids are in their late 50's/early 60s, the adopted kids are my fiancé 33, a 26 year old girl, and a 14 year old girl. Because the adoption of the 14 year old happened so late in her parents life, my fiancé recalls signing papers agreeing to become legal guardians of her if her parents passed away. The other older siblings signed this agreement as well. The Will and Testament left by her parents simply states to split everything equally between the 5 kids. There's nothing about what to do in regards to the 14 year old but we know the father would have loved to have us raise the 14 year old. None of the other siblings in the family will take her, and they fully support us raising her and will do whatever they can to assist us in this process. There is nobody trying to contest us for legal guardianship. Some specific questions I have: Do we even need to go through the process/forms to become her legal guardians? Or is it possible the process will be simpler because of the signed agreement when the 14 year old was adopted? (we don't know where this form is) We want to become her temporary guardians as soon as possible. We have a cruise vacation in the middle of February that we want to bring her on, and we need to get her schooling sorted. Should we file the GC-110(P) petition for appointment of temporary guardian of the person? Will we get guardianship in time for our vacation? My fiancé is her sibling as I mentioned, but I am not and we aren't married yet (won't be for a while). We both want to become her legal guardians, but would this complicate the process? Some of the questions on the forms are difficult to fill out because they apply to her but not to me, or vice versa. Should we just file to have my fiancé be the sole legal guardian?
