    Is this some dumb delay tactic, or am I about to get fucked here?

    To be clear, she had coverage at the time (which was maintained from start of my employment in 2019 until present) but I don't have documentation of it offhand and apparently my company's HR had a bit of a data oopsie when they switched systems, coincidentally, in March 2020.

    Car hit while parked but at fault party only has minimum property damage coverage

    Long story short: A guy was backing out of his parking spot and managed to side swipe my car while it was parked. Luckily I saw it happen and he admitted fault right away. The tricky part is that he was in a rental car (Hertz) and had purchased insurance through them. I got in touch with ESIS, who is the Third Party Administrator for Hertz claims, and went through the process of getting an estimate for repairs.

    The estimate came out to $5800. However, I was informed by ESIS that the property damage coverage was only $5000 (which is California state minimum). They sent me a release and settlement form to sign for the $5000 and this is where I am currently stuck.

    What are my options here?

    1. Accept the 5k settlement and pay out of pocket for the remainder.
    2. Accept the 5k settlement and go through my insurance for the rest. My deductible is $1,000, so this option is not too appealing.
    3. Take the driver to small claims court for the $800. I don't see this going anywhere. He was driving a rental car to deliver DoorDash. Seems like more effort than it's worth. Would be like squeezing blood out of a turnip.

    Are there any other options that I am missing? I also asked the ESIS claims manager about diminished value on my vehicle and he said they couldn't provide anything for that either. Thank you for your help.

    Insured with a shake roof since Nov 1. Insurance company sent an inspector out and now they are saying I have to replace the roof

    Ok so here's some context-

    House has been insured since Nov 1 with Encompass. They are the only ones who would take us bc of the age of the roof. It's old. It's shake. I had it looked at and the roof company said it was sound and would last the winter. Before we moved in I noticed two wet spots on the ceiling in a bedroom. Had the roof guy come out again to fix the roof, but he said that it was just high winds kicking up in a crazy rainstorm. It's Nebraska, and not uncommon. Roof still looks good.

    I had walls, ceilings and soft flooring redone/replaced prior to moving in as well. As a precaution I had tarp laid over the roof of the leak area to save my ceilings in case of another crazy storm. We had one last night - glad there is a tarp up there.

    Insurance company sent out an inspector. Their report says roof looks good but there is a tarp up there. He didn't ask about it and frankly I forgot about it.

    Underwriter calls my agent and says they are cancelling the policy because the roof is bad unless I pay for a whole new roof out of pocket due to the tarp (I guess?).

    Anyway- I'm paying premium for this roof with a $7500 deductible. Because I'm currently insured and now their inspection says the roof is bad, can I make a claim for the roof?

    I worked in insurance for 20 years and this seems so backward.

    Totaled Car - Insurance Company Using Comparables 250 miles Away [NY]

    Have a vehicle that after over a month going back and forth ended up being totaled. They gave the report and showed one vehicle locally within 40 miles (NYC area), the other two are over 200-250 miles away with significantly lower cost (MD/VA) lowering the average quite a bit. Yet there are more vehicles locally.

    40 miles away - Car 1 - $67k

    250 miles away - Car 2 - $62k

    250 miles away - Car 3 - $63k

    I looked for comparables within my area, there are 2 other vehicles locally that would bring the average up another 2-3k and are within the same distance of the 1st vehicle they cited or closer. To me they just provided one local and then got some far away ones to lower the average and do they honestly expect me to travel that far to purchase a vehicle or should I ask them to cover the transport fees then?

    If they used the 3 available locally (The one they already included) the average between the three would be around 68k rather then the 64.8k they want to pay as the other vehicles are listed 68-69k in my area.

    I sent back that reg 64 says within 25 miles of the insuree, and that these vehicles are the closest and that the others should be dropped and these added in and waiting on a response. They are also subtracting the color from the cars that have free color options whereas mine was a $1000 color option.

    Usually people I see argue that it isn't enough but can't prove it, but here I'm proving I can't realistically buy anything locally based on their numbers.

    Woke up in my house to loud noises and eventual hoards of sirens. Some guy under the influence of a lot of things drove down my street at 3 am unconscious and totaled/damaged quite a few cars (9 total) and a house. Police got him as he was still in the car, out cold.

    Trying to deal with insurances now to get my car fixed. Spoke with his insurance and I have the police report; it is very, very clearly his fault.

    I don't have collision on my insurance so was told I have to go through his. His agent is definitely extremely overwhelmed, so I was told by another rep this could take "3-4 months" before I get an estimate for repairs because they have to confirm with police, other drivers etc.

    She then advised me to go through my insurance, have them foot the bill and then they will deal with his insurance paying my insurance back, and noted they would reimburse whatever deductible I would have. Problem is, I don't have collision insurance and my rep told me I cant do this. She then advised me to call his insurance, confirm they will foot whatever bill I get, get it repaired/pay out of pocket and send them the bill.

    Any help would be greatly appreciated. Don't even care about my car, literally just need something to drive (don't have rental insurance).

    Rear ended for 3rd time in a year

    Hello,

    I was rear ended while sitting at a red light. I'm concerned because this is the third time this year this exact scenario has happened. All three times it was due to an inattentive driver not paying attention and not stopping in time while I was sitting at a red light. All three times I filed a third party claim which was fully paid out thanks to my dashcam and the other driver being honest. The damage has always been very minor

    My concern is at this rate will my premium start going up? I'm honestly paranoid the insurance companies will think I'm some sort of scammer. Also I'm concerned my cars resale value will basically plummet due to there being 3 reported accidents on the cars history

    Sorry if these are stupid questions but I am pretty rattled and am a bit frustrated this has been a repeating incident.

    Any insight would be greatly appreciated

    Edit: I forgot to mention I am in Washington state. And I did file a diminished value claim for all 3 accidents and received about 200$ per claim

    At-fault driver (CA insured in OR)— insurance company took over 3 months to reach out. Is this normal?

    My partner backed into a car while parking. He reported it immediately, no injuries, the people weren't in their car.

    His insurance company (geico) has taken over 3 months to contact him, just with a liability statement. Is this normal or do they have deadlines?

    Do I report accidents that happened before I got an auto insurance policy?

    I hope I'm in the right place, but I got rear-ended last Friday and didn't have any insurance. This week I got a new auto insurance policy, and contacted the other driver's insurance to make a claim. They asked me if I have reported this to my insurance yet, which I haven't.

    Do I need to call my insurance provider and report this despite me not being insured with them when this accident happened? Sorry if this is an obvious answer to some, I'm not educated on this at all.

    Help with car insurance

    Hi, so i guess Im a bad driver. And I have 2 accidents on my insurance from 3 years ago, and recently like 2 months ago I scratched a car in a parking lot (which resulted in another claim). I have 0 points on my license but Im about to get a careless and reckless charge that carries 4 points. My dad is saying if I take the careless and wreckless my insurance will drop me. Is that true?

    Insurance term I'm trying to remember

    There's a term I cannot remember off the top of my head. It's a specific amount of $ paid in excess of the loss that's usually offered in the contract. I've seen it used in freight insurance claims.

    Like a company will claim a loss of $4,000 and the insurance company will pay (by contract) an additional 10% ($400). I can't remember what that $400 is called.

    How does insurance get salvage value? Feel like I'm being scammed.

    Is anyone here knowledgable on how insurance companies get the salvage value? I'm trying to fight my insurance declaring the car a total loss.

    They're getting much higher salvage values from Copart than one can get on the consumer side, about double the value, why is this?

    Also, insurance initially processed my car as the wrong trim level (VIN didn't decode properly for them). Copart did process the correct car the first time. They ran the numbers again and are saying that because of the higher ACV for my vehicle trim (and options) the salvage bid went up. How is this possible? The only difference between the first salvage bid and the second one was the higher ACV. My insurance had the wrong trim, but Copart did not!! Insurance ran the exact same car twice in their system, but just upped the ACV to reflect their previous mistake. Why would the salvage company offer higher for the EXACT SAME CAR they ran a day ago.

    This seems shady. So they're telling me that if they input an ACV of 100k the salvage company (Copart) is just going to magically value the same exact car higher?

    I spoke to Copart and they said values are primarily based on recent action sales of that vehicle, so how could that just change overnight when the insurance company runs it again with a higher ACV?

    I missed their call. I have Geico and the other driver has Erie.

    The accident was on 11/15

    On 12/6 I got a letter from Geico saying they were going to arbitration with Erie.

    Could arbitration happened that quickly? I thought it took months and months…

    So like the title says I signed up for insurance but am uninsured till the 1st of Jan.

    I've been feeling really shitty for about 2 weeks on and off. Abdominal discomfort chest discomfort my left fingers are tingling and my right foot is numb on top.

    My mom wants me to go to urgent care but I don't know if I'm gonna be completely wrecked by bills and maybe I can hold off for 2 more weeks. Also im not in that much pain

    Supplemental critical illness/injury insurance, be ready for the battle (I wasn’t)

    For the first time in my life (I'm 55) I figured it would be a smart idea to enroll through my employer for the critical illness/injury insurance (Voya Financial). Thinking more along the lines of an unforeseen accident causing injury I was definitely blindsided when I was diagnosed a few months back with an 'aggressive cancer'. Long story short, it has been nothing short of an arduous battle dealing with the insurance company in getting any payment. According to their website my condition is cut and dry for payment, but as I'm learning, these companies are all about delay tactics and making the insured jump through many hoops. So I'm saying to anyone filing a claim during an already stressful time of their, be ready, mentally and financially, for the battle. I wasn't ready. I took everything Voya promises in their sales pitch at face value.

    So I'm now planning on returning to work despite my condition. I can't take the stress of waiting for weeks to get nothing but more of their game.

    I regret ever signing up for the illness insurance. I will cancel this joke of insurance and so as I've always done, figure it all out on my own.

    What happens if the at-fault party is killed in the car accident?

    I live in a place where people drive like they have a death wish, and this thought came through my mind today as I nearly T-boned the driver side of a car that ran a red light while I was going 50 mph. Had I not been able to avoid him (for example if there was another car in the lane beside me that prevented me from swerving) and the driver was killed in the accident, would their insurance still be liable if they were deemed at-fault, if that is even a thing?

    Insurance won't cover accident

    On Sunday I hit a car and caused some front bumper damage. The vehicle seemed to only have a few scratches and a dent. Definitely does not need to be replaced. It turns out that the other vehicle was a rental car so I'm not sure how insurance will go through on that end. However, the vehicle I was driving was under my mother's name. I was informed that the incident would not be covered because I'm an excluded member from the policy. How much am I looking to pay? Since it's through a rental company will the I get a high bill? Who should I contact to get things sorted out? I tried contacting my mother's insurance but they were no help and said they'd send me a letter on why they denied coverage. What should I do in this situation?

    Should i be held liable for this accident? I disagree with my claims adjuster

    1. "Right of way at intersections , Yielding and Stopping - (2) A driver intending to turn left across the path of any vehicle approaching from the opposite direction shall not make or attempt to make the left turn unless the turn can be completed in safety.

    In my case, i was turning left, a vehicle coming from the opposite direction was turning right. I had a turning light and she blew through a red, and turned into my left lane instead of her right lane. Kicker is i cant prove that and since i was turning left, insurance is telling me im at fault.

    I disagree because the other vehicle had a dedicated right turn lane and could not proceed straight, and so the traffic law above shouldn't apply because i did not cross any path of travel of her vehicle. That law is intended for vehicles going straight through the intersection from the opposite direction, not ones that have to turn right. Also the turn could easily have been made safely if she stayed in the right hand lane after turning. If she swtiched lane right beforw her turn then she would be breaking my provinces traffic law were a vehicle must be in a turning lane 15 before the turn.

    Max this should be 50-50 for my liability in my opinion. Anyone agree or disagree?

    I'm trying to get quotes on homeowners insurance for a house we're buying, but I'm tripped up by the unrepaired damage question. It's our first house so I'm not experienced with this stuff at all.

    There's a couple of things that can't get fixed before closing, but that we're getting fixed ASAP. If I say there's unrepaired damage I can't get any quotes. Do I just say there isn't any? They're not from an accident or severe weather, just general aging. I can't find any clarification on what that even means. Do they wanna know if the roof is ripped off from a storm or does that mean any kind of repairs needed period? I want to get insurance but I don't want to lie or get in trouble 😐

    Got into an accident what will insurance do?

    Hi, I got into an accident last week(hydroplanned and hit the side walls on the highway) I was the only one involved. Cops came and basically gave me a ticket saying I was speeding. I have Geico as my insurance and while I was filling out the claim, I just noticed that I don't have coverage collision although I thought I did. Its an old car I recently got and by the looks of it she is pretty damaged. The claim process om their app was dumb because it timed out while I was filling out all the necessary stuff and when I went back it wont let me edit anything. I have been calling them but its just a long wait hour and nothing else. My questions are-

    1. If the car is fixable, is my insurance going to help with anything?

    2. How much is my insurance going to go up on top off the $272 premium I already pay?

    3. If my car is totaled for good, will discontinuing my insurance hurt me when I get a new car and try to get an insurance then?

    Is this ACA Subsidy calculator wrong? Please Help

    Hello,

    I am worried because this online ACA subsidy calculator gave me numbers that would be a problem.

    I was looking to see what my ACA subsidy would be if my income fell to certain levels.
    I started using this calculator online because it came up early in a search and seemed to be right at certain incomes.

    It's actually some third party site of insurance agents

    I was alarmed because when I put in $21,000 income it says my subsidy is $735

    But at $19,000 income it says my subsidy would be $526

    I was somewhat relieved when I found the healthcare.gov calculator

    They say at $21,000 income the subsidy is $735 and at $19,000 the subsidy is $744

    That seemed to be what I expected.

    I am a 53 year old single male non smoker - living alone- no dependents

    born 1968 living in NC 28590 (pitt county)

    I suppose the healthcare.gov site is the correct answer but I worry because I don't want a huge bill at the end of the year. I tried calling healthcare.gov but could not get through.

    Is the healthcareinsider calculator wrong? Should I just assume the healthcare.gov is the right answer?

    Maybe I shouldn't worry but the rules to this are changing and hard to understand. I don't want some huge bill at tax time.

    Unsuccessful settlement on car accident by insurance company.

    A friend of mine was involved in an accident. A car hit her car from behind, and she's not at fault. Cop came, but didn't do an accident report. Now comes the trouble: her insurance company was not able to settle the payment for this case, and it went to the inter-company arbitration committee. She has Geico, btw. What can she do at this point? Or, is there ANYTHING she can do? Please help...
