Posted: 24 Dec 2021 08:26 PM PST About six weeks ago my 21 YO son (driver) and two friends were the victims of a road rage incident. They were on the interstate in the far left lane when another vehicle began making attempts to move into my sons lane while beside him forcing him onto the shoulder at 70 mph. This happened three times total when my son finally lost control and hit the concrete divider spinning out. Unsurprisingly pieces of his car went flying and hit the other car causing a minor scrape. My son and friends were all fine thankfully. Officers at the scene cited my son for failure to control which was a 165 dollar fine and 2 points. Of course the other driver made a claim on our insurance. Now six weeks later based on the police report, my sons and his friends statements, and their own investigation out insurance agency has denied the claim finding my son not at fault. I know he has no chance of getting the money he paid for the ticket back but I don't know how long points staton your license in Ohio. Is it worth it to pursue getting them dismissed given the circumstances? [link] [comments] |
Served a minor with fake ID in Canada Posted: 24 Dec 2021 08:55 PM PST I made a stupid mistake today— title says it all. I checked the ID's of a group of 4 people that came into the bar. The thing was that when they came inside I checked their ID and vaccination (for vaccinations a photo of ID is acceptable according to my manager) but then when I checked their ID for drinks later they showed me a photo of their ID again. Later on in the night the parents of one of the people that came in called us and yelled at us saying we served alcohol to his underage kid and his kid fell asleep when he turned the tap faucet on which ended up flooding their basement. The parents said they are going to report me and sue me and the establishment. I'm in Ontario, Canada btw. I need to know how fucked am I legally? And is there any advice I could follow to try and mitigate damages to my record and to me financially. I know I fucked up really bad. He looked the legal drinking age (19yrs) his ID said 1999. Neighbor locks her schizophrenic mom out of house regularly.. Posted: 24 Dec 2021 10:46 PM PST So, my neighbor is the legal guardian of her mother who is schizophrenic among other things and regularly locks her out of the house for hours on end, sometimes throughout the night. I'm not sure what the legality of this situation is or what steps can be made to get the mother out of her daughters "care" and get her the help she needs, but it breaks my heart. It's quite disturbing being woken up to the sound of yelling and the banging on windows and doors when the mother is trying to get back inside. I've told this man time and time again that if I want to have a connection to him/if I want to talk to him, that I would be the one contacting him. Not him contacting me. I've never told him where I've lived. I have never told him anything about myself but he has shown up to places that I've lived previously and he showed up to family members homes. It's gotten to the point of uncomfortable terror for my poor mom as well as myself. He was abusive to my mom and she is as much worried as I am. He has also gotten her phone number and has made threatening remarks to her and has sent messages to me even though I have requested him not to. I just don't know what to do anymore. They told me the car was in great condition and that the engine was working perfectly. A few months later, I discovered they actually covered the check engine light with a sticker or electrical tape from inside the dash. I know because from the passenger seat you can see the check engine light under the tape the angle it's at. The second she grabbed me by my bra strap and was yanking me around knowing I'm pregnant and injured already. I have both on video. I don't want to report the assault tonight due to trying to figure out where I'm going to be taking my daughter for the night but do I have to report it immediately or it won't be valid? Posted: 25 Dec 2021 02:48 AM PST 2 years ago I signed a lease for a 2bed 1bath apartment in a small apartment complex where the owner lived. My boyfriend (at the time, now husband) moved in with me but was not on the lease. I mentioned to the landlord/owner that he would be around often but that I wasn't ready to have him on the lease just yet. About a year went by with my husband living there pretty much full time and the landlord not asking to put him on the lease or even mention him so we never added him. The owner moved and the complex is now ran by a company. We had always had plans on buying a house within a year or two and didn't want to be tied to an updated year lease (currently month to month) and the company never said anything so we never added him to the lease. We eloped this past summer. Now the housing market is crazy and I am bracing for us possibly being here for another year or two as we wait it out a little longer for it to possibly cool down (CA) . We would like to start a family soon and I'm starting to worry if this would cause any problems. Rent is always paid on time and my interactions with the management company has always been great. We would have been here for three years in May. Im wondering if having a baby and not having my husband on the lease cause any problems in the near future? My husband is adamant to just let things be for now as he doesn't want our rent to go up or sign a year long lease. There hasn't been any indication that there would be an issue since we have been here for so long without him on the lease but I'm just worried if anything would change if a baby were to be in the picture? She was attractive and I started a sugar baby relationship with her online only. I know it's strange but it's just a weird fetish that I have. I sent her money and she would send me nude pictures. After a few weeks I decided I wanted to end the relationship because she was a bit too money grubby and wasn't giving me exactly what I wanted. Because we communicated only on Snapchat the pictures can be deleted by her at any time. She had already deleted s video i liked because I didn't pay her on time. Which was part of the reason i wanted to end the relationship. I didn't want the pictures and videos to be deleted so I saved them to my camera roll. She got upset and claimed that she was 17, in high school, and that the images were child pornography. I took screenshots of the conversations we had thar mention her age being 19 and the fact that she mentioned being a law student at a local college. I am nervous she may go to the police. I will be getting a consultation with a lawyer as soon as I possibly can but am honestly freaking out. I work with kids and am not attracted to them whatsoever and would not have done anything if she hadn't lied. I don't want my life to be ruined. What are the odds of my family finding out if she does press chargers? I also used a false name on Snapchat and cashapp because I didn't want my real name associated. Cashapp is linked to my bank account so I'm sure they could find my information if they file a police report. Posted: 25 Dec 2021 02:42 AM PST TL; DR My insurance denied the claim, my unstable neighbor won't file a claim; she's taken advantage of me with her sketchy contractors in the past. I don't want to get screwed again. I'm in Nebraska. I'll try to sum up how we got here. This is the third water leak from my unit that has caused damage to the unit below. This incident and one other were due to corroded pipes, one was due to a fall in the shower where I attempted to catch myself with the shower head. It isn't extensive damage, just some ugly brown spots on her ceiling. Unfortunately the neighbor has health issues and will not consider bleach or Killz to remedy the issue; she wants the affected areas replaced. I'm the past, I had a pretty high deductible and agreed to pay for the damage directly the first two times and both times I regret doing so. I've lived here for a little over 5 years and it has always been understood that the bylaws stated the unit that caused the damage is liable. I now have a lower deductible with State Farm and I am pretty confident I overpaid the sketchy contractor the last time because it's very hard to argue with someone who is, according to her, fully disabled from a car accident which caused brain damage and epilepsy. It's like arguing with a toddler, but in her case she has a friend helping her send emails that read like a charity campaign. Because I have neither the time nor the inclination to get ripped off again, when this most recent issue occurred, I immediately filed a claim. I cannot confirm, but am told, in these situations the insurance company of the unit causing the damage has always paid. Along with most of my neighbors, we believed this to be in the bylaws. State Farm denied my claim because the bylaws do not specify responsibility in these situations. I admit I had taken the word of neighbors who had lived here for decades and did not read the bylaws myself prior to the denial of this claim. Our bylaws are, in fact, silent on the matter. This has since been confirmed by a senior board member. I'm also on the board, we do not advise or mediate these matters. We do not have a management company and these issues are to be handled between neighbors. (Maybe I should check the bylaws on that, too.) Here's where I'm feeling very stuck. My mom is a managing real estate broker. She consulted with a real estate attorney and they said typically the insurance of the upstairs units DO pay. He recommended the neighbor file a claim and let her insurance fight it out with my insurance. The boar made a similar recommendation, as did the claims examiner who denied the claim. Unfortunately, this neighbor refuses to file a claim with her insurance. She said she was advised by her agent not to file a claim and due to her health issues she can't handle the stress. According to the claims examiner at State Farm, either her or her agent sent multiple, potentially threatening emails to him over the matter. My follow-up emails have gone unanswered. The neighbor has sent me a long and detailed email referencing my responsibility per the bylaws, including pictures of the damages, irrelevant details about her health, etc. She said she will get three bids, I can also get one, but she will decide who does the work. This is where things have really gone off the rails before and out of sheer exasperation I have paid more than I felt was fair just to put the thing to bed. Again, my mistake. It was only a few hundred dollars more at the time, but if you give a mouse a cookie... Should/can I compel her to file a claim and let our insurance companies deal with it? Is that the best course of action or should I get my own bids and potentially end up in a deadlock over what is a reasonable cost for the repair, yet again? We got our beer through a local bar that agreed to charge us based on how much beer we drank. They said they would weigh the leftover kegs that were tapped and would charge based on the percent gone. We got an invoice after the wedding and they are trying to charge us per beer poured at a rate that makes the total come to three times what we calculated it should be based on what they said was drank during the wedding. All negotiating prior to the event was done over the phone, zero paperwork was created, competed, or signed by myself or my wife. We told them we wouldn't pay what they invoiced us for as it wasn't the pricing we agreed to and the bar manager immediately cut the price he quoted us by around 10% to "meet us half way", otherwise he would take it to small claims court. I Was Struck by an Uninsured Driver as a Pedestrian Posted: 25 Dec 2021 12:28 AM PST I was crossing the street legally and the driver made a left turn into me. I broke a collar bone and got a concussion. I got an ambulance bill and hospital bill. I was unconscious but the other driver gave his insurance to the police and was later handed to me when I woke up. I got a lawyer and the lawyer let me know the insurance of the driver was expired and unable to cover anything. (Doesn't this mean he lied to a police officer?) It's been almost a year as this happened in February. I was not able to work for 6 months. The lawyer looked for assets to be go after and was unsuccessful. The driver got a defense attorney and is refusing to have the driver sign a document stating he had no coverage at the time of the accident. My lawyer says that at this point in time my best option is to go through small claims court. My question is: Is small claims court my only option? In Los Angeles the maximum I can receive is 10,000 dollars. I have lost wages and hospital bills that exceed that amount. So, a good friend of mine has issues with his employer. My friend is currently studying and works part time as a cart pusher for a grocery store. However, around three or four months ago, they started messing with his pay, paying him too little, postponing it for up to a week (he gets paid weekly), and now they are forcing him to give them his paycheck.
