Neighbor wants to build spite road through shared wetland (Idaho) Posted: 29 Aug 2021 08:32 AM PDT I'm hoping you all might have some advice on this. Here's the background: My father owns a 14.5 acre property adjacent to the Boise River in Idaho. The property is surrounded by a wetland/marsh which is a wildlife habitat and also provides a nice view for the home that is situated on the property. Recently, a neighbor who owns an adjacent parcel of land --and a majority of the wetland-- informed my father that he was planning on building a road through the wetland (see link below to image, father's property is on the left and proposed road is in purple), which would basically run through my father's front yard. There is an existing road through my father's property and my father has offered the neighbor an easement. They haven't had any disputes that would make the neighbor feel like the easement wasn't a viable option. However, the neighbor recently offered to buy my father's property on multiple occasions (for less than half of its value), which my father understandably declined. At this point it feels like the road is intended to be leverage to get my father to agree to sell the property for less than its value. Since I am NAL and I don't know about real estate, I can only speculate about how my father might be able to approach this. First, it seems that if the road were to be built it would decrease my father's property value since the peaceful wetland views would be replaced by a dusty road with farm traffic. Since there is an easement available and the new road isn't a more direct route to the neighbor's property, it seems to be that he's building it out of spite rather than necessity. Second, given the various migratory bird species that nest nearby and the ecosystem services provided by the wetland it would seem that building the road would cause detriment to the habitat and erosion from the road and its construction would negatively impact water quality (turbidity, increased nutrients leading to algal blooms, etc.) --however, it's private property so not sure what can be done about that. The neighbor is extremely wealthy and well connected, so I cautioned my father about trying to out lawyer this guy. Unless there is a pretty clear cut case here, I would fully expect the neighbor to drag this through the court until my father gets tired of paying lawyers and gives up. Because I am a bit of an asshole I suggested my father contact all of the various environmental agencies and non-profits to give the neighbor a hard time if he decides to try to move forward with the road. I worked for a large popular chain of grocery stores in California for 16 years, and quit in January 2021. This store has always made contributions to employee's 401k's as long as they meet certain requirements. In preparation to me quitting, I reached out to HR and asked what day I would have to be employed on in order to be eligible for a contribution (Dec 31 of the ending year). I made many life, and work decisions based on the information that if I was still employed through December, I would receive a contribution like I always had. Unfortunately, no contribution was ever made to my 401k, and when I reached out to HR I was informed that they would not be making a contribution to my account because of issues related to the pandemic. I am bummed out and although it's not a large amount of money that would be contributed, it's still money that I earned, and is a part of a benefit package that they use to entice employees. We do not have a contract to work there, and are non union. I am wondering if I have any legal recourse in attempting to collect this contribution that I feel I have earned. We meet in SLC since we live in different states, we always plan for us to be there at least 2 hours early for if something happens on our end so we aren't late and we've never been late since this order was put in place back in May, but we are now getting overly annoyed with him for never being on time pushing our time to get home later and later. I work at dominos. the employees don’t receive the tips Posted: 28 Aug 2021 06:03 PM PDT whenever a customer pays for their order with a card, it prompts them to leave a tip. a lot of them tip but all of it goes into the pockets of the big man. is this legal? if not, is there anything i can do about it? edit: i live in the US, North Carolina edit to clarify some stuff and answer questions: I am a CSR (an inside person), and I receive tips from customers occasionally when I ring up their order. Whenever an employee rings up a customer, they enter their employee numbers and it signs them into their account. If a customer pays with a card, the card reader prompts them to leave a tip. I occasionally get cash from customers, although that is rare. I am not a driver. And for all of you people trying to make sure I am not getting my tips- the whole store is not getting tips from the card reader at the front. All the managers are friendly with employees (apart from the GM, the one supposedly collecting the tips, although i do not know for sure where they go) and we are told that we do not get the tips. Posted: 29 Aug 2021 12:16 PM PDT My husband got a call from his ex SIL last night saying that her two oldest daughters (17 and 14) had taken an uber with their cats and belongings to go stay with their dad (husband's brother). The girls told their mom that they're moving in with their dad because of their mom's boyfriend. Husband's brother had no idea until husband called to tell him. Husband's brother and ex SIL had a bitter divorce and are not on speaking terms. Husband's brother was also not in his daughters' lives for 3 years while he dealt with his own mental/addiction issues. He has recently tried to make amends and repair his relationship with the girls, but still refuses to talk to or see their mom, so it's usually us or husband's mom that must mediate visits as the girls' mom has full custody. After the girls showed up on their dad's doorstep, their mom arrived soon after, cops got involved, and there was some arguing between the girls and their mom until we offered to have the girls stay the night with us. We try to stay on good terms with the girls' mom to facilitate communication with the girls, so she accepted this over letting them stay with their dad on the condition we stay in constant contact with her. This morning, we asked the girls for specifics on what's going on and they said that they are fed up with their mom's boyfriend and he is always yelling at or berating them. They also said he is "creepy and touchy". When we asked for specifics, they said he yells at them about not wearing bras. The oldest has mentioned moving out in the past and the mom's bf threatened "I have lawyers little girl. I will ruin your life so you can't ever go to college." He seems to be the most aggressive and cruel to her. The 14-year-old appears to have the worst problems as she doesn't work like the oldest and is around more. She said he forces hugs on her when she's not wearing a bra even though she asks him to stop. When she brought this up to her mom, she got annoyed and told her that he's just trying to bond with her. She said that he grabs her by the waist to move her out of the way even though there is ample room to go around her. Both girls say they don't feel safe or comfortable in their own home and will stay in their rooms with their ears to the door to make sure they don't hear him outside before they will leave the room. They both want to move in with their dad permanently, and their dad wants to take full custody of them. My husband and I said we need to talk to a lawyer and go about this carefully, but with their dad having been out of the picture for about three years, I'm not sure how much of a chance he has. We left a message with a lawyer and expect a call back tomorrow, but I expect we'll have to have a conversation with the girls' mom before then. We also want to discuss grandparent's rights with the lawyer when we have the chance since husband's mother has been involved with the girls all their lives and takes care of all their major expenses. The girls' mom wanted to pick them up today, but we asked her to let the girls stay with us one more night and we can all talk tomorrow. We don't want to force the girls to go back home with their mom knowing that they're uncomfortable with their mom's bf, but I'm not sure we can keep them against their mom's will if she forces it. I guess what I want to know is, can we tell their mom that we won't let the girls go back home while her boyfriend is in the same house? Or will this cause us more problems when husband's brother/mother pursues custody later? The girls have one more younger sister with special needs who is in the house, so we are also concerned for her safety, but the girls make it sound like he doesn't give her a problem really. Posted: 29 Aug 2021 08:55 AM PDT Pennsylvania: This should be my last post over this. I've since acquired more information. I bought my house in January 2020. My carport has a concrete slab attached to the gravel driveway between my and the neighbors home. The neighbors home was vacant when we moved in, and there were two men working on it to flip and sell it. They had verbally told us we can use the driveway. So we helped maintain it, and only ever used it for entry and leaving our home. About a year later someone buys the house next door. They told us we could use the driveway. We all lived peacefully until there was a 4 day long thunderstorm. Our land and the neighbors land come together almost like a "U" or taco shape, so rain water from each of our land meets right in the middle, and down the driveway. Day 1 of storm, a large crevice formed in the driveway. Neighbor blamed it on our gutter. We closed it off and shoveled some gravel back up and tried to fill in the hole. The next day it storms again and she came back over again, yelling more, that we didn't fix the gutter. Day 3, storm washes it out even more. Now she says we can't use it. We'd even offered previously that we'd buy new gravel before the crevice, but she declined because she said they were putting a garage in, and the trucks will destroy it anyway. * There are no recorded easements because the original owners of these houses were related and agreed to just put one driveway and share it. The driveway has been there over 35 years. We drive up the very bottom of it, then turn a little to drive up the grass. Neighbor doesn't like that we even do that, and she called the cops on us. After we told the cops everything, all they told us to do is "avoid her." Do I have zero rights over this? I don't have money for an attorney, land survey, nothing. I can barely afford to place a parking spot on the street so I can park at my house. There is no-street parking. Our car physically cannot just drive up the bottom of our yard, it is too steep. Grandpa passed 10 years ago, and my Grandma had been home bound for approximately last 5 years due to illnesses. As a consequence, my parents have been entirely responsible for maintenance and upkeep (all utilities, regular lawn care, painting exterior regularly, fixing leaks in roof, pest removal, deck repair, etc.), as well as renovating and improving decaying portions of house (renovated bathroom and kitchen, furnished basement, replaced carpeting with hard wood, installed wood stove for heating in garage, built a patio). Grandma passed and left house between my mom and aunt. They met with attorney to discuss terms about splitting the house. The plan is for my mom to buyout the house from my aunt, and discussions are ongoing regarding payout terms. My mom is very frustrated regarding appraisal due to all the renovations that have been made. Currently what they're considering is a 60/40 split where my mom pays out 40% of the appraised value of the home. The attorney they spoke to recommended this for instances in which one party was responsible for regular maintenance. However, the problem is that the renovations have seriously improved value of the home and now my parents are frustrated due to the fact that they're now double paying for renovations that have been made to the property. My aunt doesn't care if my parents are able to afford the mortgage or not. Is there any mechanism for a 'partial appraisal' of the property? I.e., my parents would be responsible for paying out the cost of the property minus the renovations that have been made? Also, is there any clause regarding the fact that without my parents moving in, the inheritance would have been practically nothing (without my parents taking care of the house and my grandma, the house would've had to have been sold for long term care expenses)? On the rental agreement printed out, it says that I can only use the kitchen for a total of one hour including cleaning. I have no problem with that, however, every time I try to get into the kitchen the landlord tries to cook whatever I buy for me and toss his stuff in it and give it to me. I told him I would like to cook my own meals if he didn't mind. He told me he had to teach me how to cook so he was cooking the stuff I got for me. the 2nd time he took the stuff I had bought for myself and made his own dish and told me to eat it. I didn't eat it, because I didn't want any noodles or veggies he had made and mixed in with the stuff I bought. When I told him I didn't want to eat he gets upset and says I am wasting his food. I tried to eat some of it but just didn't like it. He tells me to take it for lunch when I go to work, but I end up throwing it away knowing ill never eat it (mean, I know). Anytime I bring anything home to cook or eat. he tries to monitor and cook it for me. I tell him that I do not want him to do this as I would like to cook my own meals, but for some reason, the landlord won't listen. He says only buy three days' worth of food. The only thing the lease agreement says is only kitchen use for one hour. I have for the time being snuck a mini-fridge up to my room. I have been able to live off fruits and breakfast cereals. I have also been able to make my own lunches for when I am at work. However, the landlord said he went into my room once and saw that I had a mini-fridge. He, unfortunately, said I can't have a mini-fridge in my room. I gotta figure something out because I can't afford to keep eating out all the time. It is a long lease, unfortunately, so I can't just pick up and leave. Here are some other things that kind of annoy me too. I have caught my landlord peering into my car a few times for some reason. I can't have guests over, but other tenants have guests. He requires me to help him do chores in the morning around the house, but other tenants do not have to do that. They're asking for his passwords. I'm a bit disconcerted by this. Is this legal? Or are there exceptional situations in which it's allowed to solicit employees/applicants' sensitive info like this? He came back and let me off with a warning stating he wouldn't give me any tickets only to check later on the paper he gave me that he indeed ticketed me for delaying traffic. I have worked with ORS and filed many orders to show cause my self and the commissioner over our case won't give him any consequences, other than stayed jail time and judgements (which he doesn't pay). I was hoping for a drivers license suspension or a couple nights in jail so that he would realize it is serious to not pay, and he would wake up and start working. I ran into my lawyer at my son's football game where he compassionately fired me as a client. I told him I am going to loose my car and my house because I can't pay everything despite working full time and going to school full time without getting child support. His reasoning is he has seen this commissioner not do anything in many other cases similar to mine for the parent owed child support and even if ORS were to miraculously take my ex to court the same commissioner would be over the case and allow my ex to have no consequences. He mentioned I should start chapter 13 bankruptcy but never follow through with it? Is this something that makes sense? He also suggested I learn how to be self sufficient and file motions to show cause monthly myself. What do you think? [link] [comments] |
Posted: 29 Aug 2021 07:52 AM PDT I moved into this house three months ago and have a six month lease. The landlord adopted an adult dog (60 lbs) a few months prior to my move in. The previous renter of my room moved out of the room because of the dog barking at him. Before I moved in I met the three dogs that lived in the house and everything was fine. After one month of living in the house the dog owned by my landlord had to go on heartworm treatment and was on a course of prednisone for one month. After being on prednisone for at least a week, I was passing the dog on the stairs and went to pet his head (something I would previously do to him without incident) and he snapped and chased me down the stairs. The landlord observed this and said that his jaws were clamped to my pants, though I did not notice this as I was running away for my life. The landlord said they would keep the dog away from me but has since chased me to my room (on two separate occasions) in a situation where I had to run as fast as I could to beat the dog and close the door behind me. In a separate incident the other renter in the house was attacked and bitten on the upper arm by the same dog. She said I could break the lease and I have been looking very actively looking for somewhere else to live. After being chased back to my room by the dog for the second time, I told the landlord on August 24th that I didn't feel good about paying the full rent when I didn't have free movement throughout the house. I have to text her and her boyfriend to see if the dog is out in the communal areas before leaving my room. After I told her that she got very defensive and we got into a verbal altercation after which she sent me a very long email basically saying I offended her honor as an "honest" person and I had to move out by September 1st. I know she can't force me out but I am worried about her keeping my security deposit. Also I saw written on a post it note attached to a copy of my lease printed out the phrase "cost of reletting." This leads me to believe she might try and charge me for breaking the lease although it is her fault. Is there a way to have her "release" me from the lease? Or acknowledge that I am moving out because of something that is her doing? I don't want this to negatively affect my credit nor my mother's credit as she is a co-signer. (TX)Landscaping crew damaged my car. What course of action should I take? Posted: 29 Aug 2021 09:00 AM PDT Hey Reddit. I had a local landscaping crew come by my house this morning and cut my yard. I just went to get something out of my car and noticed from a distance huge scratches on my hood. They're deep and in total on 3 different sections of the car (hood, fender, quarter-panel). Theres also a rubbed sweat mark on my bumper that looks like either someone rubbed it with their hand or maybe with their leg. The car is also covered in grass. I took a bunch of photos but haven't spoken with the company yet. Im wondering what the best course of action is to take care of this? Should I get a quote from a local bodyshop? Posted: 29 Aug 2021 08:04 AM PDT I live in GA So basically, if my upstair apartment neighbors turn the shower head the right way, it will trickle down to their bathroom floor and then come down from my bathroom ceiling. Management tells me that it should be fine and it will dry up. Which it does, it dries up by the next day. My thing is: I don't want random water droplets falling on me while I am using the restroom/showering. I dont like the smell of the sheet rock being wet/drying. I also dont feel good when I'm in the bathroom after that happens. And the biggest thing is I dont feel comfortable about the whole situation. Former employer sent letters to my current employer Posted: 29 Aug 2021 01:53 PM PDT I left a job in NC after 5 years due to getting a job in another state. A few days after putting in my resignation, I received a phone call from the HR department of the job that I was leaving. They were investigating a matter that they were completely right to investigate. (They received a complaint that there were some inappropriate conduct on my part pertaining to another employee from a 2nd hand source. After hearing my side of the story, they confirmed that everything that I said was true with the other party. Their finding was that there was no inappropriate conduct based off of my story, the other persons story and there being no evidence that there was anything inappropriate) So the investigation was closed and I worked the remainder of my notice and then left for my new job. 5 months into my new employment, two letters were typed and sent to my boss and my bosses boss. The matching letters were put into envelopes and mailed here. The person sending the letters hand wrote the information on the envelopes. The letters stated that I was sexually harassing an employee & I intimidated that employee for months to not come forward. They also state that I stole property from the facility. This is the information that I know: After I left, there was an employee that was constantly talking to other employees about how "The HR department didn't do anything " regarding the situation that they investigated That same employee is from the city in SC that is postmarked on the letter. That same employees handwriting is the handwriting on the outside of the envelope. I was not fired after receiving those letters. There are no "damages" as far as lost wages or anything. I did some cleaning and ran some errands with her. This was all done at her apartment, with no one else present. I had posted an ad on Craigslist, promoting myself as a student worker, that she has reached out to. It became apparent over the two days that she was unstable. She made comments about me and otherwise that made me uncomfortable. I had told her I would work more days, but after the second day, I quit. Several days later she sent me a text saying she had sent me a letter through my Craigslist email to collet a debt. In her ridiculously long letter, she walks through almost every moment I was there. She has fabricated a story that I was a lazy worker who damaged her property. In reality, I genuinely worked really hard for her and did my best . She is threatening to sue me if I don't return $105 of the $140 she paid me over the two days. She is also threatening criminal charges (either theft by deception or financial exploitation of a vulnerable person). She says she might not pursue charges if I return the money (she is very ambiguous with this). Despite the fact that she is lying, She was previously a paralegal and I am worried she may be able to outmaneuver me in small claims court. I would happily pay her the $105 to not have to deal with this anymore, but I also worry it will not end there. She says she must advertise in the newspaper for three weeks before she can send a lawsuit to my parent's address. She doesn't have my personal address. Should I pay her? Should I ignore this? A few days ago i get an email from apple disputes that claims I picked up the items in question. They suggested i pay for the items or return them back to apple warehouse. I don't have anything!!! She couldn't eat anything and we had to give her fluids through a syringe for five days. They told me she was fine the entire time. My daughter nor anyone else knew what was going on other than something was wrong.(Although I'm almost positive the dentist and the entire practice knew the entire time) She couldn't talk because she couldn't open her mouth. So she couldn't tell us much and she didn't know either way. So by day 5, I finally get a dentist (not the one who performed the surgery but worked at the same practice) to figure out what was wrong and turns out her jaw was dislocated. There's alot more to the story, really. But I've spoken to two medical malpractice places online and they turned me down but said I should keep trying. Should I keep trying? Do I have a case? What if I just sent an intent to sue letter to the dentist? How likely is it that the malpractice insurance (if he even has it) would decide to just settle it out of court? I don't know what to do, really. But the whole thing infuriates me and I honestly wish I could take down his entire practive. But I'm not sure if I can even find a lawyer to begin with. Domestic Violence/Mental Illness Posted: 29 Aug 2021 09:57 AM PDT New York. I am in serious need of advice. Maybe personal advice. I'm not sure if anyone here has a background with domestic violence plus mental illness. Here goes. I have severe trauma bonding with my ex who abused me for years. I guess he thought money was the magic bandaid that could fix his violent and extreme behavior. I was broke enough and traumatized enough to accept it. I finally told him no more money- I don't want it ever again. This finally stopped a few months ago. The social media and phone calls- all of it has finally died down. I didn't know how to just make that final clean break - maybe it's because I'm so caring and I worry/put the needs of others before my own, emotionally speaking. I really did love him, defying all logic. I filed for divorce and his neighbor said my contested divorce paperwork was bogus. In the paperwork it went into detail about his abuse. I shouldn't have been talking to him but every time I stop, he finds a way of contacting me- emails, social media accounts… He has been driving me insane since I left him. He gave me the neighbors number and I texted her, asking her what was wrong with my paperwork. She couldn't tell me. I also said that my claims were true, and that I felt sorry for the next woman he got involved with. That he's been physical with me. After this he continues egging me on, telling me he's involved with his neighbor. I ask her, she said not at all. Months later the same neighbor is messaging me now, saying that he got physical with her and that she's pressing charges. OMG. I asked her to please not involve me. I asked her to please not tell people she has ever spoken with me. I'm finally not talking to him and don't want any connection to him or his family- or certainly any of this. I am very upset. My car was hit at my apartment complex, and the person who I believe did it claims she didn’t. Posted: 29 Aug 2021 01:28 PM PDT Hi all, a few days ago I went out to my car to go to work and noticed a dent in my door and a car sitting right next to it. I took plenty of photos and videos, and left a note explaining the situation along with my name and number. The person got back with me saying that she doesn't believe it was her that did it, but we exchanged insurance information and she said she would reach out to her provider. As of this morning, she hadn't heard back and said it wouldn't be her that sends an adjuster as her car didn't sustain any damage. However, I have substantial proof that it was her indeed, and I will link that below. What are my options here? I am in Massachusetts BTW. Proof. The plane of the damage on her door corner matches with where the dent in my car is, and the paint left on my door is a very close match to the color of her car. [link] [comments] |
