Can my HOA stop installation of fiber internet in our neighborhood? Posted: 01 Aug 2021 09:21 AM PDT About two weeks ago I received a postcard in the mail from Metronet, a fiber internet provider, letting me know that they had plans to expand into our area. A few days later some small flags and signs from Metronet appeared along the roads in our neighborhood warning of future construction to install their lines and providing contact information. The day those signs appeared, I received an unsigned email from an address used by our HOA to send announcements to the residents via mailing list. The email claimed that Metronet had not notified the HOA of their intentions to install. The sender stated they had contacted Metronet to request they stop installation, accused Metronet of "bullying" tactics, and encouraged the other residents of our neighborhood to contact Metronet to request the same. I WANT fiber internet in our neighborhood. I work from home full time since the pandemic and will be for the foreseeable future, and having the best possible internet connection is important to me. I replied to the email stating as such, and was told by what I assume was the same person making the original post (since this too was unsigned) that I was "missing the point" because the HOA hadn't approved the project and "that's not how this works". I took a bit of offense to that and asked why the default stance of our HOA was going to be to deny the progress of new infrastructure, and whether previous notification from fiber internet companies would result in HOA approval. This inspired a response signed by our HOA President stating that unless the topic was addressed and approved by vote in our annual meeting, the HOA would not approve it. I spoke to Metronet, and they plan to have service available in October. Our annual meeting is in April. So it sounds like the plan from our HOA is to fight this because they don't intend to call a vote for months. In speaking to Metronet though, they gave the impression that they don't need HOA approval, they get their approvals from the city. Metronet is a reasonably sized provider, and has installed throughout Indianapolis (my city). I feel like they probably know what they're doing. My question: does my HOA have a legal right to stop their installation, and if so do I have any legal recourse to force them to allow it? I feel like the purpose of an HOA is to defend and increase property values, and in 2021 the availability of fiber internet is a factor in the desirability of a property. [link] [comments] |
Posted: 31 Jul 2021 04:59 PM PDT So a company that a few of my friends work at has these fake dollars that are basically monopoly money, (they have the owners faces printed on them) and the company let's you trade them in for prizes and gift cards, think like a school store. You can't trade them for actual money though. Anyway, they've recently starting making people work Saturday, and they are only paying people in those monopoly dollars "because its tax free for the employee". This feels super scummy. Edit for more info: It is a mix of salaried employees and hourly employees. Most of peoples paycheck is their actual pay, but they've instituted a new Saturday working policy and those 8 hours of overtime on Saturday is paid in monopoly money instead of real money. Also the monopoly money is never included in peoples paycheck and people definitely don't report their giftcards as earnings lol. [link] [comments] |
Posted: 01 Aug 2021 08:31 AM PDT I live in CA and am looking to hire a part time nanny for my young, obviously unvaxxed, children (one of whom is a toddler who rips off a mask immediately after we try to put one on for him). One candidate is not vaxxed, and says she is not an anti-vaxxer, but that she has Hashimotos and is worried about side effects. Another candidate is vaxxed but says she has a medical condition that makes it difficult to wear a mask while working all day. These were among our top choices taking everything else into account, but we consulted with an ER doctor friend of ours who called BS on both, and recommended we avoid hiring either of them, basically due to the recent info that has come out regarding the Delta variant. (As a mother herself, she also questioned whether we'd want someone who displays that level of selfishness and judgment to take care of our kids.) She strongly urged us to find a nanny who is both vaxxed and will wear a mask indoors, since our little one can't wear a mask. Am I allowed to discriminate based on those things? I'm thinking no, since they are medical related, but what should I say to them? I don't really want to lie and say, "Thank you but we've found another candidate" because we just made an account and posted an ad on care.com, and I plan to re-post on various neighborhood/social media pages where we found these two candidates… Thanks! When I contacted the timeshare company they said I was on the deed along with two other names (my parents) and since my parents were deceased it was my responsibility. I've been estranged from my parents since 2006 with absolutely no contact. They kicked me out with only the clothes I was wearing when they found out I was gay. I was barely 18 and still in high school. I didn't know my parents had died. I had no other living family and I left Idaho not long after they kicked me out to go to warmer weather. I've lived in California since about a month after I was thrown out. When I looked into my parents deaths I found out my father died first and then my mother later. They were renting and there was no property or money or any will. They bought the timeshare before I was thrown out but I never agreed to be on the deed and I never signed anything. Posted: 01 Aug 2021 07:47 AM PDT Had it stolen the first time, and they said they weren't responsible. Ended up getting a new car, and it was just stolen today. My lease agreement says that they are held harmless unless in cases of breaking the law or negligence on their part. Is it negligence on their part since they have not done anything to secure the property even though this would be at least the third time this has happened on property? Process server went through my mailbox Posted: 01 Aug 2021 04:10 AM PDT I hope this is the right place to ask this, I'm not sure where else to go. Anyway, a process server has been by my house twice this week when I was not home. One of those times, she spoke to a neighbor, so I know that she's trying to serve papers to someone who doesn't live here anymore (although I really don't think that matters either way). I have cameras all over my property, so I saw both times she came by. The first time she was alone, and as she was pulling out, she opened my mailbox, pulled out the mail inside, and looked through it (I assume to see who's name was on it). The second time she came by, she brought (her?) kids with her, and they were all over my porch beating on my front door and screaming "Answer the door now!" and yelling at my dogs (who were inside barking) to "Shut up now!" while mom walked around the front of my property. As they were leaving, she had one of the kids open my mailbox, pull out the mail, and read out the names on the mail to her. Trashy behavior aside, I thought it was illegal to go into someone's mailbox? Or is it just illegal to open someone's mail? I tried to Google it but didn't get a lot of info. I also have a "Private Property, No Trespassing, No Solicitations" sign that is right next to my mailbox that usually gets ignored, but does it apply to process servers, too? She just pulled right up in my driveway like she lived here, and after seeing her go through my mail TWICE, I don't want her back on my property. Thanks and please delete if not relevant to the sub. I thought the move out time was 12 midnight, but the property manager came at noon said move out time is 12 by noon. Here is the message from management: Hello, As we approach move out day we wanted to make sure you are prepared! Move out day is July 31st and you must turn in keys by 12pm to avoid rollover charges. If you are going to drop keys in the drop box after business hours please make sure to leave your name and unit number with the keys. ——— I agreed the roll over charge, but they said even I pay for that, I still have to be out by 5pm. Then they called the police to escorted me out. And the manager specifically told my roommates I'm not allowed to enter the property. I need to get to Washington DC and work in a convention on Aug 3rd, so I need to find a way to get my stuff from the property by early Aug 2nd, so I can hit the road and drive 15hrs from Missouri to DC to get to work. Stopped by every eve since to grab odds and ends. Had a few things left that didn't fit in the car yesterday. I didn't consider it an issue as I paid for the month of July so I wouldn't have to rush. Apparently the landlord decided to go over today and empty out the apartment. He tried to contact me, but my new apt has 2 floors, and I was downstairs, the phone was upstairs and I never heard it. When I went over a little while ago to pick up the last of my stuff, it was gone. He took it upon himself to throw my stuff out since he didn't get a response. So I've a bunch of questions. Am I still the renter of the apt, although I am not sleeping there, through the end of the lease tonight? If so, is my missing stuff something I need to make a police report about? It's about $700 worth of stuff (portable dishwasher, chinese screen, etc) , so I assume this is small claims if he cannot retrieve my items. Is it considered a reasonable request to ask for assigned handicap spaces at your apartment? Would they be required to oblige due to ADA and FHA? A little back ground- I live in an apartment building that all parking is together(buildings like a hotel l not a complex). I've started having an issue with our parking area not having enough handicap spaces that I have to use. Last time I emailed my property manager about it she just advised they are up to code of the required amount of spaces and she isn't sure they will be adding more due to the limited spots they have for everyone in general, a whole other story lol, but stated she'd see. As usual she didn't follow up as requested. I used a mobility scooter 75% of the time coming and going to my car and when there aren't handicap spaces I run into issues with being able to load and unload too. When I'm walking and there are no handicap spaces the walk is extremely far that I can barely do so due to my disability. I don't want to act like a pain with my landlord but it's gotten to the point it can be hard to just go anywhere due to the parking issues we are having. Edit- building is the main building, yes open to public as the leasing office is right there. Last year my divorce was finalized and the judge had added into it that my ex husband was to be awarded a vacation account with Wyndham, and that he had 6 months to pay the fee to have me removed from the account. I called them and got it set up and gave him the proper forms and he told me he had done it, but that was not true and we've gone round and round about it since then. I have received a letter from a debt collector now for over 15,000 because he apparently stopped paying it at some point. During the divorce hearing the judge let me know that his wording in the divorce could not stop a debt collector from coming after me, but would enable me to sue my ex if that happened. My credit is absolutely destroyed and I'm caring for our infant by myself and don't have income at this time (living with my parents and going to college) I guess I just don't know what to do, or if there's anything I can do at this point. Do i sue him now? Do I have to wait until I've already been sued by this company? I was planning on moving out soon and I won't even be able to get an apartment with my credit now. On Friday, I was joking around with my boss and he abruptly reached out and wrapped both of his hands around my neck, squeezed and shook me. He did this as a "joke." His fingers were fully wrapped around my throat and he choked me before releasing me a few seconds later. It was not a light choke — I was not seriously injured, but my neck was sore for over an hour after. This happened early Friday afternoon. I promptly contacted his supervisor who then escalated to HR. Today I called his supervisor for an update and I was informed that he is still with the company, but he has been told not to work on Monday while they make a decision. She says HR is still investigating. The company is closed on weekends so I will not know anything else until at least Monday. I am hoping that he is fired next week, but I am trying to move quickly and prepare myself in case he is not. I do not want to have to quit my job and put myself in financial jeopardy when I did nothing wrong. I also refuse to work in an environment where I do not feel safe as a woman with a male superior who has proven that he is capable of getting physical with employees. Tomorrow I plan to reach out to an attorney that I know and ask if they know any colleagues who can help me assess my options if he isn't fired, but getting set up with one will take time. Basically right now I am wondering what an attorney can do in this situation. Edit 8/1: Thank you everyone for your advice! I just got off the phone with an attorney that I know. She advised me to document any and all interactions that I have regarding the situation on Monday and call her after I get off work with any info that I have. She also advised me to do some research and see if my manager has any past arrests or criminal history, and whether the company has had any past lawsuits filed against them. Basically get as much information as possible. I'm calling her after I talk to HR and she is going to connect me to one of her colleagues who specializes in employment law. She said really it would be better if I had an attorney on the phone with me while talking to HR, but there is not much time to do that since that will be happening tomorrow. I signed my lease early in January and said I would provide a guarantor but my guarantor ended up falling through. The leasing agent told me since i couldn't provide one that I would just have to pay two months rent up front but they instead billed it as security deposit. My lease states "IF YOU EXECUTE THIS LEASE, AND FAIL TO PROVIDE A PARENTAL OR SPONSOR GUARANTOR AS REQUIRED BY THE RENTAL CRITERIA AND THIS LEASE, YOU ARE STILL BOUND BY, AND WILL STILL BE HELD LIABLE FOR, THIS LEASE. LANDLORD SHALL NOT BE OBLIGATED TO PROVIDE RESIDENT ACCESS TO THE LEASED PREMISES UNTIL A SATISFACTORY GUARANTY IS EXECUTED, IF REQUIRED." But it never states in the lease that the "satisfactory guaranty" would be additional security deposit. So am i shit out of luck or can i do anything to keep the original amount of SD. You can check my post history I made to another sub that shows the damages and elaborates more on the situation. Somebody recently wrecked my car and I do delivery work for a restaurant. I am able to get a rental provided from insurance and the other drivers insurance is taking fault. I asked if I could use it to deliver food and while they didn't say no they did mention if I got in to any sort of accident and it's found out I was using it for business won't be covered so I don't want to risk it specially with it being a rental from Enterprise. I have been out of work for 5 months before finding work and I was on the third day. Luckily my employer wants me to still work whenever I'm situated but doesn't need anybody else besides drivers now. Does anybody know if I could bring that up to my insurance company to see if I could get compensated for missed time or would I have to try and roll the dice to see if it can be dealt with in small claims court? Looking over the Mass guidelines for a name change I think they can, but it is worded kind of funny. MGL c.46, § 1D Adoption of surname upon marriage "Each party to a marriage may adopt any surname, including but not limited to the present or birth-given surname of either party, may retain or resume use of a present or birth-given surname, or may adopt any hyphenated combination thereof." To me it seems like you can basically pick whatever you want considering the line "including but not limited to" Does anyone have an idea if my understanding is correct? [link] [comments] |
My MIL's boyfriend passed away, now his family is acting super shady (AL) Posted: 01 Aug 2021 05:19 AM PDT As soon as this man passed away, his family swooped into the house that MIL and boyfriend shared, emptied his safe of all contents (including MIL'S personal paperwork), took every big priced item in the house, and locked her out of the room with the safe and their two storage units outside which has more of her personal belongings in. MIL's boyfriend also set up cameras before he passed around the house, and they've been using his phone to listen in on MIL'S conversations (we know because they have quoted us word-for-word). Lastly, they were only going to give her a few days to move out of the house, pushing her to leave before THEY called police. Boyfriend had said to MIL on multiple occasions that he had her set up after he passed, but boyfriend's brother is claiming they haven't found a will. My MIL is devastated, and we know her boyfriend wouldn't have wanted all this to happen. Besides looking for his will in probate court, what else can we do? The sheriff's department has already given us the go ahead to open everything they locked, but surely the family is stepping all over MIL's rights. What can we do? [link] [comments] |
Why can't I get my mom's death certificate signed? Posted: 01 Aug 2021 09:54 AM PDT My mom died almost two months ago and I am not able to get her death certificate signed. The story is that her attending physician from what I understand is supposed to sign it but he won't. He claimed that he retired shortly before my mother died and because he says he did I can't get her certificate signed. My mother is still in the county morgue and she hasn't had a proper/dignified burial. I am extremely concerned because our mother's body is just lying there and it's really causing a lot of distress to our family. In my opinion, losing a loved one takes enough toll on the family and having to jump through hoops to not give them a proper burial is wrong. At this point I don't know what steps I need to take? [NYC] Business sidewalk/street cleaning ticket Posted: 01 Aug 2021 08:29 AM PDT We received a summons for civil penalties under NYC Adm code 16-118(2)(a) for apparently some trash being scattered within 18 inch curb line into street between 8-9am on one day. Our normal business hours staff employees from 10a-8:30p; do we have any defence against this since the trash could have accumulated after we left and the ticket was written before we arrived the next day?
