If it's too complicated to ask here, feel free to just tell me to get an attorney. I'm being sued for $73,000 on a vacant house foreclosure. My dad passed away on March 13th of 2020, the day the covid lockdowns began in my city (Pittsburgh, Pennsylvania). To the best of my knowledge, he, my stepmom, and my two younger siblings were living in the home. As for me, I'd moved out of the house and into my apartment back in late 2016. The last time I was at the property (a few days/weeks before my dad's death) someone (assumed my stepmom) peeked out of the curtains, saw me, and pretended they weren't home. I haven't been back since a family friend told me my dad died and my brother told me not to come to the funeral or their house ever again, but I assumed they were still at that address. I saw my stepmom out at the store, her vehicle driving around town, etc. Both of my brothers moved out, but to my knowledge my sister and stepmom were still living there. Yesterday I got civil papers from the sheriff saying that she abandoned the property and hasn't paid mortgage on it since January of 2020. The utilities have been off since February 2021 at the earliest, and I didn't know anything about this until now. My stepmom and I are the only two defendants in this case, but she hasn't been served papers as far as I know and the only people who could help me out here either:
So what do I do next? It says I have 20 days to take action, I don't see anything about a court date, and as this is my first time dealing with the law I don't even know what action I'm supposed to take. Can I wave my right to inheritance like my siblings did? Can I sell it? Paying the default and living there was an option, but that was an option 18 months ago when all this started and no one told me. So I don't want the property. They didn't even do anything cause the cat jumped off on its own once the fireman got up on the roof and started chasing it around. I don't know whose cat it was but it wasn't mine and I didn't call. One of the other neighbors did but I don't know who. Now I get a bill for $4,500 from the department for a "non-emergency rescue call". I called them to ask if they were serious and they said someone has to pay for it and since they don't know whose cat it is or who called that person is me since it was on my roof. Multiple issues with new neighbors Posted: 02 Jul 2021 06:09 AM PDT Already posted a month ago on r/askLE and was told to post on here. Theres an Update so I'll post shortly after. I bought a piece of land in Flint, MI that had been vacant for 10 years, I have only had the property for about 2 months and I've been over there a handful of times. I had several different interactions with Neighbors. Most said they had no idea it was for sale. Some of the neighbors were nice, some were belligerent (one lady chased us down on my property with a camera and asked if the pine trees we were planting were weed plants). The earliest appointment for my survey is October. So, I was on my property a few days ago and I noticed things had changed. My family had built a fort out of sticks and luon and that was destroyed. And I have things of mine that were thrown into the woods or missing, debris was strewn to block paths (the previous owner left a lot of garbage that I have to clean up). I was cutting trees and the neighbors called the police. The police asked me to prove I oened it, and they told me that the neighbors had reported squatters and a teepee (kids fort that was torn down). I have yet to put up no trespassing signs but I will the next time I go there. The officers said they had so many calls that it has made it to the police chief's desk. One of the neighbors that called told the police that I was staring into her yard and I planted trees onto her yard and she ripped them out. Back story there was that I was there a week earlier with my dad planting trees. The neighbor starts yelling at us and we start talking to her about how I bought the property. She calmed down and we asked her to show us the property line and she said it was around a tree...my woods is full of trees. She couldnt clearly give me a border. So we offered to dig the trees back up and move them and she said it was fine and they looked nice. Fast forward: she ripped out about $300 worth of trees without any clear indication of a property line So now my stuff is being destroyed and torn down, and I don't feel safe. I want to file a police report for tresspassing and destruction of property (can I file on behalf of my trees since the woman couldnt indicate a property line?). Should I call the dept and ask for the police chief to speak with him, or call and talk to one of the responding officers? What should I say and what are my options? UPDATE: So I went over with my brother and my father to mow part of the property. I brought no trespassing signs with me. I was going to put them well into the woods so the tree-ripping neighbor would have no right to rip them down or say I was tresspassing. We put the signs up and we heard a gunshot. Same lady that ripped my trees out previously. She yelled at us "whose out there" and I yelled "the owner of the property". She yelled "what do you have in your hands". It was nails and a hammer and no trespassing signs. I yelled back "none of your business". My dad yelled that he was calling the police and we walked away where it was safer and we heard another gunshot. We waited off-site for the police and returned when they showed up. We walked back there and the police walked into her yard and my dad and the rest of us followed to get this solved. The woman that fired the gun said nobody fired a gun. And we said we heard a gun twice and she had a rifle in her hand when we saw her. She said that we had trespassed on her property on multiple occasions and were peeking through the woods at her grandchild. She said we could have been child traffickers, we were squatters from one town over and the local PD never got back to her about the squatters, they said there were potentially Bears nearby, she said "well when someone of the opposite color walk through the woods". This lady tried to make anything stick. At one point we said when we met her previously we told her we owned it, but she said that she didn't know that that was true. Another officer who had been there last time said that he told her last time that we owned it. And she said she didn't know if that was true or not. She also kept asking the cops if they were calling her a liar when they would correct her. The cops told her she handled it wrong. The lady and I exchanged numbers because the cops said I should call her when I'm in the woods on my property. We talked to the officers before we left. I asked one of the officers when is it considered harrassment and he said that the neighbors thought they were right in what they did even though they handled it wrong and they're really stuck in their ways. The officers told us to try and stay away from that side of the property and build a fence once its surveyed. They said I can call an officer to have them on standby whenever I'm on the property. Yesterday I got a call from the PD code enforcement. He says the neighbors feel threatened and I cant be trespassing on their property anymore and peeping into their backyards and it could be a peeping tom situation. I said I haven't been. He said they have every right to feel threatened and he told them to call PD every time I'm back in the woods on MY property. He tried telling me that I couldnt go back into my woods anymore and I asked him what rights I had on the land I owned. He just kept telling me that I was in the wrong and to make sure to tell my dad to stop too. I told him I was having it surveyed and he told me that that was fine, but to stop trespassing. I called to see if the police chief was available to talk to and they said I had to go theough the chain of command to talk to him. They said a lieutenant was available. I spoke with him and tried to sum up but he was basically saying that he didnt know what was true in the situation and hes not familliar with it so I just need to get a survey. I asked about a ppo or restraining order and the lieutenant said that we are neighbors from now on and should try to be neighborly. My dad and I went up to the PD today to get copies of police reports and speak to someone in person. They said they lost power and weren't open again till the 5th and every one was leaving. At what point is this harrassment? The police are taking this neighbor's word as fact because she has called so many times and am being treated as guilty, and everyone is making excuses for this woman firing a gun twice because I'm on my property. That evening I was sent a text (preferred communication method) by my Director who said he spoke with the company CFO and the CFO has approved my pay increase request of 25% considering I was taking on additional responsibilities outside my current role. The only hang-up was it wont be effective until 7/1/21 due to budgeting. Outside of the text from my Director, I never received anything in writing although I had continually pushed for it. Cut to this past month, where I was getting antsy since I never received any formal communication. Mind you I have received pay increases in the past with this organization, and they never send anything formal. Yesterday, on July 1st!.....my Director called and told me that our HR Team indicated that I would not be getting the pay raise, and that the CFO was not in the position to approve the salary increase. They met in 2013 and married in 2014, but their relationship was on again off again. Most recently they were "together" from November 2018 to December 2019 before deciding to call it quits for good. She moved out of his place and into an apartment of her own, and they lived separately from that point on. He filed for divorce in early 2020, but early in the process she had a series of tough life events. Her mother and sister both died and she herself was diagnosed with breast cancer. My husband's father stopped pursuing the divorce to give her time. He offhandedly mentioned at one point that he was waiting a while because it looks bad to divorce her when she's going through a difficult time, but once things got better for her he planned to pursue it because he said he wanted to date again. In summer 2020 he went through some tough times himself, decided life was too stressful and retired to a condo on Florida. He gave my husband his house (and updated the deed etc. accordingly). If it matters, she was never on the deed. Fast forward, he passed away in January of this year. Then in May we got a surprise at the door - divorce papers. She apparently did not know he had died. After she was informed that he had passed, we thought things were settled - but now we've received a letter from a law firm stating that she is suing his for the house. The letter named his dad (deceased), his "estate" and us as the defendants according to the papers. The gist of it seems to be that she is arguing that the house was half hers (because she wasn't on a deed but apparently by Florida law that's how it works, it claims) so he couldn't give it away without her permission, and therefore him giving it to my husband wasn't valid. Then further that since he died, Florida law says she gets the house. As far as we can tell this is a "we plan to sue you" type letter rather than a "we are actively suing you right now and have filed in court" type letter. Is this serious/valid? My manager said that we don't allow any animals, not even service dogs, and I tried to tell her that wasn't legal, but she overruled me. She said we have to turn them away. My question is, can I face legal action if I do as I'm told and turn away a person with a service dog? What is my legal recourse if I allow a person with a service dog to check in and I'm reprimanded or fired? ETA: this occurred during a casual conversation about service dogs in general, and I didn't get any proof. I'm afraid to ask specific questions to record, or get her to put it in writing, because I'm afraid of retaliation of some kind. it would be obvious that any repercussions were because of me, and I'm afraid of losing my job, even if I'm morally and legally in the right. Doctor Drug Tested Me Without My Consent Posted: 02 Jul 2021 10:10 AM PDT I went into a clinic for a check up, they wanted to do a host of blood tests. I don't have insurance, and told them that I did not want any unnecessary tests, as I would have to pay for them out of pocket. My request was to opt out of STD's and diabetes, as there's a near zero percent chance I am at risk for either, but I didn't imagine I would have to ask to opt out of a drug screening test. At no point did they ask, or tell me they were going to do this test. I know what drugs I do (none, test was negative as well), this test doesn't benefit me at all. They also tested me for HIV, despite my request. I now owe 500$ because my doctor must think I'm way more interesting than I actually am. (Ab, Canada) Neighbor poisoned our rain barrel Posted: 02 Jul 2021 10:24 AM PDT Long story short, I've got neighbors from hell. They've been a nightmare since we purchased the house 2 years ago. Petty complains about sprinkler water being blown into their yard, motion light too bright, my trees leaving leaves in their yard, guests parking in front of their house on street, etc. They've been littering and sabotaging our yard, and snow blowing our car in (taking strips of snow down his lawn with a snowblower creating snowbanks on the street to block us in, for being in "his parking" on a public street). I've installed 4 surveillance cameras to monitor this malicious behaviour. We recently discovered the lady next door has been leaning over the fence and putting stuff in our rain barrel. Our lawn, garden, flowers , trees have all died. Our dog drinks from the overflow and has been sick, and my girlfriends 2yr old sister we babysit fulltime has been complaining about rashes and irritated eyes. (She uses the low pressure rain barrel to play in and refill her swimming pool). June 3rd 2021 I discovered something shocking on my video cameras, she was leaning over the fence pouring something into the barrels intake. I checked the backyard camera and a video reveals her attempting to open a white bottle, struggling with a child safety feature. We contacted the RCMP and they did an investigation. They took a water sample and we've still got no results (their lab rejected a sample due to covid). She admitted to the police (not sure if doorstep convo, or on video statement) that she had dumped a bottle if RoundUp Concentrate into our water supply. She was charged with mischief, a misdemeanor in Canada. We've reached out to Environmental Canada, Alberta SPCA, our local Bylaw, and even a couple attorneys for some sort of advice. Environmental sent a peace officer to take soil, water, tree samples for which we are still waiting for samples results. Alberta SPCA, although furious, can only investigate and persue negligent pet owners, not other people. That's a criminal issue. Bylaw was not at all helpful, suggested I consider moving away or file a lawsuit. The attorneys I've consulted with told us it gets a little complicated because the child isnt ours, and her parents would have to file separately. They also said its possible to file for a new 8' fence built between us, resod our lawn, pay for flowers, pain and suffering, vet bills, etc. At a cost of approximately $10,000 Canadian. We've been getting advice from locals about filing in small claims court, as it is more geared up toward being able to do it ourselves with no legal aid. We reached back out to the RCMP and see if any additional charges would be laid (injuring or endangering animals, administering a noxious substance, mischief causing harm to life, destruction of property, etc.) They were pretty straightforward in telling me the court system will fail me, and all the additional charges will be hard to stick in front of a judge and prosecutor. (We need to be able to prove the Roundup in our dogs kidneys is the same Roundup that has been overflowing from our rain barrel into the dogs water bowl). I posted the video and photos on Facebook. My goal here was for some exposure and to put more pressure on the police or justice system to take this matter a bit more seriously and not just sweep it under the rug. While I recieved lots of comments and messages from lots of VERY angry locals, I got a lot of good advice and suggestions listed above. I'm currently residing in Malaysia under a MM2H visa held under my father's name. The visa is valid until I'm 21 years old. I can't go back to Sudan because it's dangerous there and if I leave to escape my family, I would just be shunned by my family back home as well. I've never lived in Sudan so I don't know my way around places, nor would I have a place to stay in or money. My parents don't allow me to leave the house, even to the closest distances. They don't allow me to work or give me any kind of allowance or money. I'm not even allowed to pick the university I'm going to, and dorms are an absolute no. Because of that, I don't have any money, but I do have some Australian friends that are willing to pitch in to help me get out, and to let me stay with them if I can get an Australian visa. I have a Qatari visa but that's also held by my father because he works here. I'm currently visiting him in Qatar and I plan to try and secretly take pdf scans of my Birth Certificate and Qatari visa as extra means of identification since they refuse to let me keep them. What I want to know is if I can be legible for any Australian visas, and if not, what other visas could I apply for? I don't think I can gain refugee status, and I don't think I can afford to take out a loan of any kind but if it's absolutely necessary, I would also like some advice on repaying it. Yesterday, I went to go get this inspection done at a Firestone. I dropped off the car and handed my keys to the manager at this Firestone. About 10 minutes later, their manager ended up calling me to tell me that my car was not on the premises and that I had to call police. During the trial she was asked a lot of questions by the judge, which one being was she pregnant. She said no. (we had been separated for around a year). As we were walking out of the courthouse she tells me that she actually was pregnant from some guy who raped her. I say oh uhh okay. Then we never talk again. Skip to today: she messaged me saying the father of her other child was trying to adopt her daughter, and so she said she consulted her lawyer and she said technically because we were married when the child was conceived that I'm the legal father of this child, and that they want to send me paperwork to give up parental rights. Realtor exposed our personal information via careless emails Posted: 02 Jul 2021 09:59 AM PDT Recently my partner and I attempted to buy a condo (HI) in our first ever real estate purchase. We were using the VA loan and had been recommended a realtor by my family who lives here. They said he was really great and sold them their house, and they were great friends with him. I could go on about his poor real estate decisions, he did such a bad job giving us advice and negotiating that our VA loan agent was furious with him. It was a huge mess. His poor advice is one of the reasons why we backed out. While I'm upset about the advice he gave us, my partner and I are really upset and concerned over how he sent emails to us. My partner's email is lastname.firstname@website.com and it's really not that hard to get right. However, our agent would send emails to firstname.lastname@website.com. The first few times I could see it as an honest mistake and I would alert him as I would get the email and not my partner and see he sent it to the wrong email for my partner. The thing is, this never got corrected, and it became clear that someone else was getting all of our emails when the person from the wrong email address emailed us saying that he had been getting all emails related to the real estate transaction. It was alarming and we asked our agent to be more careful but nothing changed. All emails with personal details and documents were going to this guy and we would always remind him that he's getting the email wrong. Sometimes he would call us super mad that my partner hadn't replied to an email or signed a document yet and we would check and have to inform him that my partner never got the email, then he would check and of course it was sent to the wrong one. Eventually I got extremely upset after finding out that he also put the wrong email into the Docusign. This meant that he was sending links to this random person which allowed them to access a folder full of all the documents related to the deal containing tons of personal info. We were furious. Between this and his bad advice we decided to back out of the deal. Some people have told me that what he did warrants some kind of legal action. We are pretty concerned about our personal info and feel violated. Is there anything we can or should do about this? I am honestly just curious to hear a legal perspective. The impact seriously damaged my friend's SUV and totaled the scooter. When the police arrived it was discovered scooter guy had no license, no insurance, no headlight (it was at night), and wasn't wearing a helmet. He refused all medical treatment. The police wrote a report. Scooter guy skeddadled as soon as he could. Fast forward to yesterday when my friend gets a letter from a local ambulance chaser law firm stating scooter guy is going to sue. My friend is freaking out. To be clear he wasn't served. He continues to do this and it has been on my property for 24+ hours now. What actions can be taken in unincorporated Hillsborough County? Am I within my rights to have it towed at his expense? Edit: who owns the strip of land between the road and sidewalk? Have been struggling to get code enforcement on the phone to confirm. 2nd edit: talked to code enforcement and they say that from the back edge of the sidewalk to the centerline of the road is public right-of-way. Unfortunately, the fence company didn't install the new fence at the original location but shifted it by about 6 inches inside my property. According to the survey, the fence's previous location was exactly on the property boundary line. Also, the metal edging installed flush to the fence (by the former owner of my house) is now moved inside my neighbors' properties. We asked the company to move the fence back to its original location, but they claim it is already in the correct position because of the difference in materials used. Yesterday was my first day working at a fast food chain and my manager had me work with a guy (let's call him J) and have him teach me how to do things. He couldn't speak English and used a translator but he seemed nice enough and things went well for the first few hours. And to preface this, he knows I'm 14 years younger than him since he asked my age when we met. Later on, I told him I was hungry and since I was done with my tasks but still on the clock, he quickly made me some food from the kitchen and told me to eat it at a certain door so the security camera couldn't see and the manager wouldn't be mad that I was eating on the clock (not a health hazard btw employees are allowed to eat in the kitchen, just only on break time). However, at one point we were translating at that one door and when he gave me his phone so I could translate into it, the side of his hand rested on my penis. I thought it might be a mistake so the second time, I tried to turn a bit to the right and sure enough it happened again. Then a third time when he was telling me where to stand, it happened once more. He also asked for my phone number and claimed it was so we could communicate for work purposes. I foolishly gave it and he texted me later asking if I clocked out. Once he found out I was home, he texted me saying that he noticed I did my work with importance and my response was "Thank you, I tried my best." His response was "Yes, I saw it, thank you very much, baby." This shocked me so I said "Baby?" hoping it was a mistake in the translator and he simply confirmed that yes, he was calling me baby. There is maybe 15 feet between my house and their building. They stay open until 11pm 7 nights per week. Every week, their customers throw trash into our yard or leave it on the sidewalk in front of our house. Their staff won't come clean it up or put trash cans out on the sidewalk. This morning, though, I woke up to shaved ice and ice cream thrown onto our siding on the second story. Hence, it dripped down the side of the house (that faces the dessert shop). That she has no say over the stimulus check, and even if I told her I was going to waste it all on a swimming pool of Spaghetti-o's, or straight up just give it to my fiance as a present, she can't withhold it for any reason? Not that I'd do either... Maybe... If you're curious what she has against my fiance, she thinks she is abusive based on a stupid misunderstanding that happened a year ago. It ended up with APS mad at the payee for making false accusations. However easy it would be to just obey her demands, I want to ask, is she even legally allowed to ban my fiance from our calls and withhold money until this happens? Do I not have a right to have whoever I want present during a phone call to my payee, or does she have the right to privacy? My fiance has been my sole witness to this payee's antics and it makes me rather uneasy that she doesn't want her around when she's potentially breaking a law herself... Sorry for the rough writing, it's been a bad day/night with symptoms but I have to try and figure this out, gotta keep trying. Really just hoping for clarification on if she's allowed to have a say over that check at all before I try to confront her again about it. [SC] Terminated from job. Can I keep my bonus? Posted: 02 Jul 2021 01:50 PM PDT Today I was terminated from my job that I had since November 2020. In November I signed a contract and received a signing bonus on the condition that I stay at least one year. If I resigned or was terminated "with cause" (direct line from the employment contract), I would have to pay the bonus back. My boss told me on the phone that my position was being eliminated and the company wasn't doing well. He told me he wasn't sure about the future of our office and they had trim the payroll. I have no written warnings about my performance or conduct. My boss did yell at me once for taking too much time on a task, but it was not documented. Neither was the phone call when he stated my termination was due to a poor business outlook. I spoke with the company accountant and she told me "they aren't sure what to do about your bonus." I replied that my termination was without cause and alluded to the contract I signed and she laughed and said "OK.." in a condescending way. Do I have a good chance of keeping my bonus? Would this termination be considered without cause? Could the company try to dig deep and find some excuse to fire me with cause? [link] [comments] |
Help! United Healthcare issues, possible drug benefit discrimination Posted: 02 Jul 2021 12:30 PM PDT Location: North Carolina, USA I've been enrolled in a United Healthcare group plan through my employer since January 2020. My employer offers a basic plan and a "plus" plan. I chose the plus plan because it had better coverage for my family (but a higher deductible). My employer renewed our plans for 2021 (and never gave the employees an opportunity to make changes, but that is a different story -- smdh), and the new term started June 1st 2021. I've had a prescription since January 2021 that had a copay of $75 (I paid $30 with a coupon). When I went to refill the prescription on June 12, 2021, the pharmacy notified me that the copay was $300 (yes, three hundred)! I immediately called UHC to inquire and they said that the pharmacy was correct -- my prescription now has a $300 copay because my drug benefits changed. I have not been able to pick this prescription up because I cannot afford to pay a $300 copay. When I went to work the next day, I spoke to HR, who said that no changes were made to the health coverage benefits. Long story as short as possible: I've spent hours on the phone with UHC, and with the brokerage who is the middleman between my employer and UHC, and still have NO ANSWERS. UHC is now claiming that I "switched plans", although I did not. I never requested a switch, my employer did not request a switch, the broker claims they did not request a switch, and UHC has no actual paperwork proving that I requested a plan change. My new insurance card is identical to the one I had last year and all of the coverage information listed on my "myUHC" online account is consistent with what I initially signed up for EXCEPT for my prescription drug benefits. But the craziest part: I spoke to a couple of my coworkers who are enrolled in the exact same plan as me to see if they were having any issues. The three of us have compared and confirmed that we are in fact enrolled in the SAME PLAN, and yet, our drug coverages are not consistent (all of the over coverages, like deductible, etc. appear to be consistent). When I do a prescription drug price search in my online portal, the copay for this prescription comes up as $300. When coworker A does the same search on her portal for the exact same drug (same quantity, dosage, etc.), the search says that it's "not covered" at all. Now person B happens to have the exact same prescription as me. She even refilled it on June 22, with no issues -- her copay was still $75 ($30 with the same coupon I use). And yet, when she searches her online portal for the cost, it ALSO lists "not covered"......WHAT THE F**K IS GOING ON HERE The portal listing "not covered" when the drug IS clearly covered is an issue in itself, but the bigger issue I'm having is WHY I'm suddenly being charged $300, when my coworker enrolled in the same plan still has a $75 copay for the same prescription. (Please note: this is NOT an issue with the drug itself, nothing about the drug has changed and the manufacturer has not made any sort of changes that would affect the price). United Healthcare screwed something up here and refuses to admit it or fix it (the broker also screwed some things up with the renewal premium pricing, but that is a different story). Right now, this seems like it could be classified as DRUG BENEFIT DISCRIMINATION. What can I do here? Where should I report this? Am I going to need a lawyer to handle this? What are my rights in this situation? Is there a way to get some sort of compensation for damages, for my time and toll on my mental health (the prescription was a mental health prescription that I have now been without for an entire month)?? My lawyers signed a deal without me Posted: 02 Jul 2021 01:27 PM PDT My lawyers signed and closed a deal without me I told them how that doesn't seem legal considering I didn't sign it give the ok they went ahead and had the hearing with out me after telling me they where going to reschedule now I'm being screwed out of my pay out is this legal? Posted: 02 Jul 2021 06:24 AM PDT I live in New York; and have requested service from a Dishwasher Repairman to fix my dishwasher a little over a month ago. He came to my place total of 2 times. Every time it was a random time, the days he has told us he was coming was never the actual day he came. First time he came he diagnosed the problem wrong and ended up buying the wrong part for the dishwasher. He told us he'll be back in a couple days with a different part but never heard from again. it's been over a week. I left a message on website and their voicemail box is full. My question is can I put a stop on the check I gave him? he asked us to write him a check and he will deposit it once services is done, but I have no confidence he will fix it at this point. He is also charging 450. which I can possibly just buy a new Dishwasher. [link] [comments] |
