There was a fence already there when she purchased it, and she was told that her yard goes from the end of her driveway to the edge of her fence, and a foot out from there. There has been an empty lot next door that has been ladled with multiple drug addicts and homeless people the whole time she has been there. It has caused nothing but issues, but she did help maintain part of the land and mow it. Apparently, the original lot owner died and a family member of his inherited it. This person is now trying to do a quick sale of the lot while the prices are up in Florida. He got a survey done, and is now claiming that part of our fence, lanai, and pool is his. A representative from his title company came over to our house with him and did a hugely unprofessional confrontation where they threatened to bull dose down part of our fence and lanai to build their new house on. It is a lot of stress for elderly people in their 70's to be going through. They are going to an attorney today, but what would be the best course of action? These people are getting very aggressive, coming over and yelling and cussing at my family and threatening them. I'm scared they will try to do something to the house when no one is home. I am a realtor who has his FAA Certified Remote Pilot license so that I can fly my drone and take real estate photos for commercial use. I was recently contacted by someone who owns a property literally next door to a listing demanding that I remove his property from my photos because they did not give their permission and it was trespassing. To the best extent of my knowledge, I am under no actual obligation to honor this. My specific questions are these: Their property was never physically approached at all by me personally. My drone may have crossed the airspace above their home briefly to get enough distance to provide a good perspective of my listing property, but property rights do not extend into the air - it's under the FAA's management. I think there is no legal basis for a claim of trespass. Regarding the claim that they did not give permission, I don't believe I need it. Of course, some of the shots from certain angles include their house - it's next door. But it isn't the subject of the photo, it's from 350 feet in the air and probably 200 feet away. Google Earth didn't ask for permission for satellite photos, either. Do I need their permission? To be clear, I'm probably going to honor their wishes, just because I don't think it's worth the potential fight - but I'd like to know for the future. [link] [comments] |
Posted: 07 Jun 2021 10:00 AM PDT Upstate NY The post title is the best TL;DR I could come up with. I know this is a long post, but please read the whole thing if you have time. The details are far more complicated than I can get across in one paragraph and this situation is very quickly approaching disaster status. I rented a dumpster to accommodate the waste that will be generated by some landscaping and construction projects I am about to get started. It arrived on Friday. On Saturday night, the guy across the street from me dragged a bunch of large furniture/assorted smaller items out of his garage and tossed them into my dumpster. There's enough shit to have filled roughly three quarters of the dumpster. My security cameras captured the entire thing; I have saved the footage and backed it up. The neighbor denied the everything when I told him that he's gotta get his shit out of of my dumpster. He became belligerent and threatening when I mentioned the footage, then slammed the door in my face. His "perspective" is that it's not on his property so it isn't his problem. I called the police right after this exchange. The responding officer, while sympathetic to my situation, told me that it's not a law enforcement issue and I'll have to sort it out with my neighbor or take him to civil court. Pickups need to be scheduled in advance to have the dumpster emptied, the first of which will be next Monday. The dumpster company is booked solid for pickups through the middle of next week, so rescheduling is not an option. I have to pay for each pickup as well, so I'd be incurring extra costs even if they could come earlier. I have contractors starting a project on Wednesday morning, and they will fill the dumpster within a couple of hours of getting started if the neighbor's shit is still in there. The dumpster should have been more than large enough to handle the trash that they'd generate between Wednesday and Friday. I legitimately don't have anywhere to stash this guy's crap without interfering with their work, nor do I have an alternative solution for the waste that they'll create. I am also obligated to provide a dumpster and deal with the waste removal per the terms of our contract. If I don't get this figured out by then, I'll have to reschedule with these guys. I know that they're already booked through the summer; I scheduled my job well in advance for just this reason. If I have to reschedule these guys, it will lead to a domino effect - most of the other contractors I have booked will not be able to start their projects till this one is completed. I haven't looked over all of the stuff I've signed and done the math yet, but the money I'd have to eat for canceling/rescheduling these jobs is pretty fucking significant. This is in an unincorporated part of the county with no municipal bulk waste pickup. You have to take it to the dump yourself or hire someone to do so, which explains my neighbor's motivation for "borrowing" my dumpster. I'd be happy to get this guy's shit hauled off and just take him to small claims court to recoup whatever I pay to do so, but I've looked into countless options to make this happen and none of them will be able to get it done within the necessary time frame. My expenses will be significant enough to take this well outside of small claims territory if it doesn't get sorted ASAP. I'd really, really like to avoid having to take this to regular court because of the time and money involved, but I haven't been able to come up with a solution that will mitigate my expenses enough to do so. The only thing I can think of at this point is tossing this guy's trash in his driveway and hoping that it doesn't wind up starting World War 3. That said, I am not particularly concerned about doing irreparable harm to our relationship. As far as I'm concerned, that ship has sailed. I'm really just looking for any suggestions that will lead to this getting squared away before Wednesday morning, so any general advice along those lines would be extremely appreciated. I know I'm supposed to have a specific legal question here, so what kind of consequences might I be looking at if I decide to just toss this asshole's stuff on his driveway/lawn tomorrow? The rent has been paid on time. The lease expired in Feb 2020 and via email we agreed to month to month. After receiving violation notices from our HOA last week, we inspected and discovered a couple there claiming the tenant's roommate, not on the lease, is subletting to them. Subletting and guests are against the lease. These individuals are known criminals, with history of drug dealing and weapons charges! The house and yard are in shambles and while we could not inspect entire home, the garage door is broken open and the garage is full of rotting bags of garbage. The yard has refuse and scrap metal piled up, also against POA. Four cars are parked in driveway and in various states of disrepair. There is a brand new BMW SUV, no plates, also in our driveway. These individuals have a history of evictions including trespassing. The original tenant's phone numbers are disconnected and he will not return emails. This couple have almost 30 civil and criminal court cases in the county index, most pending. They have 5 evictions, including ejectment for trespassing. I did file a police report for trespassing but the police won't do anything. We immediately informed them verbally and via text messages that they are trespassing. Sent a notice of no trespassing certified mail. Sending a quit notice certified tomorrow. They refuse to leave. The female is sending us threatening emails that she knows squatters rights. We know the eviction process but that could take 14-21 days. Plus, the complications of having a missing tenant are very concerning. Should we report him missing to the police? Based on the trespassers' eviction cases, they have been able to go two months after case filed! Further, the tenant is missing and his roommate is no longer living there. Being ghosted by online dealership during buyback process Posted: 07 Jun 2021 07:20 AM PDT Toward the end of April, we purchased a low-mileage vehicle from an online dealership for $27k using their financing (through a major national bank). When the vehicle arrived on May 4th, we noticed that it had major rust issues underneath and damage to the frame. We took it to a mechanic who refused to even work on it because there was so much rust and stated that the vehicle was not safe to drive. So we initiated the "returns" process with the online dealership. We were within the 7-day 250-mile limitation stated in our contract for initiating this process. After some difficulty, we finally got an email from a "Buyback Specialist" who stated that the vehicle would be picked up - and once we sent them a copy of the Bill of Lading, all our down payment money would be refunded and they would retrieve a 10-day payoff quote from our lender and payoff the loan. The vehicle was picked up on May 25th at 7am, and we immediately provided a copy of the Bill of Lading and pictures of the vehicle and odometer. It has now been 8 business days and we have not received any refund ($500 of the down payment was a holding deposit we made using our credit card that would be visible immediately, the remaining $1500 is supposed to come via check) and (what mostly concerns me) the $25k loan is still active. It's first payment was due last Friday - I contacted the bank and they put a note on the account that it was to be returned and paid off - and they informed me that I could pay up to 15 days late without penalty. What do I need to do to get this company moving on the buyback? Every time we call and speak to someone, they have to forward us to someone else and that someone else never answers. All email communication has been ignored. Is there some kind of complaint I can make to some agency that might kick their ass into gear? I am located in MS and the dealership is headquartered in TX. He also asked his dad about the other form, FS-240, long form and that I would need that also. My ex laughed when my son said I needed it and responded by texting him a picture of my FS-240 laying on the kitchen counter of our other son's house, (where he is pet sitting this week). Apparently, my ex-husband carries my FS-240 document around with him for the last 29 years. As far as I know, he has not compromised my identity (I keep track) and my son thinks his dad hasn't gotten over me, although he remarried 2 years ago (living apart due to jobs, she is in Mexico). I'm going down there in a couple of weeks to get my CRBA (FS-545) from my son. He got away with it 29 years ago by telling the judge he turned over everything and that I was the one who lost my paperwork. What recourse do I have if my ex doesn't want to hand my birth document over? I never had a need to replace them as I didn't travel out of the U.S., but now I need it due to Real ID laws and my state's extension expires in October. During the exit interview of a former colleague of mine, she named me as another woman in her workgroup that has experienced sexual harassment, hostile work environment, and gender based discrimination. The company's compliance office promptly interviewed me, and my company immediately escalated it to outside counsel and got their own attorney. I tried to secure my own lawyer (I went on my state's "find a lawyer") and both in my town had a conflict with my company. I submitted intake documentation to find a 3rd lawyer, but they haven't gotten back to me. I want my career protected. I have a timeline of who said what and a few emails. For 2 out of 3 instances of sexual harassment, I have witnesses. As for the gender based discrimination, I don't have good evidence. Another colleague told me there are 14 other women experiencing this in the operations side of things. When I put together my timeline of hostile/sexual harassment, I ended up with 4 pages, and I realized, I don't have to work here and put up with this. He has a baby mamma who he shares custody with through a verbal agreement. Every other week he cares for their shared child. The baby mamma has 2 other kids that are not his, and she pushes those kids off on him every week even though he has no legal or moral obligation to take care of them. Nonetheless, he has obliged for years. Fast forward to 2 days ago, the baby mamma drops off their shared kid and her other 2 kids, suspiciously gives my friend the children's insurance cards and disappears with no communication other than a text that says "take care of our kid". Access to Private Road (Washington State) Posted: 07 Jun 2021 09:29 AM PDT I live at the end of a private road in Washington State (in King County east of Seattle). At the other end of my private road is an intersection, a public road runs perpendicular and directly across the street is another private road (both this street and my street have the same name). At the end of that road are 4 houses. My mailbox is grouped with those across the street in a stand of mailboxes right at the entrance to their private road. I believe that the boxes are right at the edge of the public land as there is pavement about 10 feet up their road that is maintained by the county and the mailboxes are within that 10 feet. The boxes are on the left side of the street which means that I need to drive onto the private road to turn around to get to my mail. I was stopped by one of the residents of that street last week when I was turning around and told that I was on private property and I wasn't welcome there. Even after explaining that the only safe way for me to get my mail was to drive down that road to turn around he told me that I couldn't drive on his road. My question is – Is it legal for me to drive on the private road not owned by me if I am doing so to get my mail? Myself, as well as my three roommates are preparing to leave our apartment at the end of the month as our lease expires; the landlord is horribly negligent and has neglected many of our service requests so we're done here. However at the beginning of the month, we received a bill from CONED saying that we owe $4000+ out of the blue. After speaking with the representative from CONED, she had told us that it was a retroactive charge because they had been refused access to the meters the entire time the building has been open to renters. We have spoken to some of our neighbors and they also received massive retroactive bills this month, however ours is the largest as we were some of the first tenants to move in after the building was finished. The representative told us that the building had been given notice about the lack of meter access as early as March of 2019 and had been given some form of follow up notice in October of 2019. Since we had moved in during March of 2019, we have been diligently paying our CONED bills, none-the-wiser to the ongoing situation with the building. The landlord has been very shady about maintenance, including the continued neglect of our central air system which frequently experiences mechanical problems, mold problems, potential leaks and more, and I am worried that the improper maintenance of the unit could have contributed to our bill, seeing as it is both our only source of A/C and heat. We really have no interest in paying this bill, but with our lease about to expire at the end of the month, we have no real recourse or leverage to get the landlord involved as we are paid up in rent and have nothing to withhold from building management. Typically the trucks that come to pick up are third party contractors. I have been concerned in the past with some of the less legit looking haulers and liability if there is a failure somewhere that results in an accident. The flat cars are loaded in stacks of three by my own company's wheel loader. Typically the trucks they send have three sided trailers that I believe are quite secure. Sometimes they come with flat beds though that need wrapping before they leave. With the flat beds the driver does the wrapping and strapping down. I told him it was ok to add his name on there as long as mine was there as well. When I got home on the day he purchased the new title he only put his name on there. Through our relationship he has constantly threatened the car against me. This weekend I was in a car accident and cannot use my own car under my name. When I got up for work I proceeded to take the functioning car he then said he needed it (even though he has the day off) and said he would call the cops on me. As the title states, I'm trying to figure out if I can pursue sexual assault charges for what was an ongoing situation in 2019. I (female) was dating a guy from 2017 to 2019 and we were eventually sexually active in that relationship. Initially everything was fine until eventually it became questionable. He never threatened me or physically forced me to have sex with him but it was definitely coerced sometimes. He would attempt to initiate and when I would turn him down he would keep touching me or kissing me and begging me until either I had to all but yell at him and push him off of me or I would usually just give in to make things easier. I did try to talk to talk to him about it once when he got angry that I was so short when I had turned him down. I tried to explain that sometimes I didn't feel he got the point and I had to be harsh to get him to understand and he got very upset. He said he couldn't believe I was accusing him of something and how much he was hurt. Of course, I back tracked and tried to make it better and that was the end of that. From the research I've done, it appears that this could qualify as a second-degree forcible sexual offense which is a felony and does not therefor have any statute of limitations but I'm not sure. It occurred inside of a relationship, I never told anyone at the time, and I guarantee you he would say he didn't do anything wrong... I never said anything because honestly it took me close to this long to realize it was wrong and that I wasn't just a bitch for saying no. It's taken a lot of time and conversations with people to realize what I think happened and it has caused a lot of ongoing mental issues since then. I suppose my question is whether anyone knows if I'd have a chance or if it's worth it? I moved to VA shortly after we broke up and since then he has run my reputation into the ground and hardly anyone from home talks to me anymore. Bylaws say no vinyl fence neighbor got a vinyl fence approved, because they agreed to it when they bought the lot. The residents took over the HOA recently and a new provision basically states anything approved by the developer will need to be removed before the title is transferred if the neighbor sells. One neighbor says its illegal you can't make people remove things that were approved by the prior HOA. The new HOA says we can and we will. Who is right? Also if it is illegal like the neighbor states are there any resources to look into other than the obvious of a real estate attorney? [link] [comments] |

[NY] Real Estate - Builder backed out then relisted property for higher price Posted: 07 Jun 2021 09:38 AM PDT New York (Long Island) - In October of 2020, my wife and I signed contracts for a new build on a piece of property on Long Island. The contact we had listed a lot number and no address (the road doesn't exist yet as it's a new development). Building was set to begin March of this year to close by March of 2022. The builder called and told my lawyer that the property could not be obtained because "the property had a lien". I work in an industry that checks property statuses and through my own due diligence, I was unable to find any indication that their was a lien on the property. After my lawyer told the builder this, he switched his story and said that "the property owner has a judgement against him, so you won't be able to find it". Builder has provided no proof of this to my lawyer as of now. Currently my lawyer is looking for said judgment on his own. Fast forward to Yesterday, my wife and I find the exact picture and property listing on MLS, updated on 5/4/2021. Which was just before the time frame that the builder supposedly found all these issues. The only difference is now there is a "house number" and street associated with the listing. However, it's the exact same location we were supposed to be on. So they changed it from "lot 3.1" to an actual house number, which still doesn't even exist. They just used the nearest cross road as a landmark to GPS to. It's obvious the builder is trying to get out of the contract because of the cost, and find a new buyer willing to pay the extended costs for the same land and house. So a few questions: What are my legal options? If I sue, what damages can I claim (minimum I want the builder to pay for my real estate attorney from the transaction, legal fees for this matter and I want him to cover the cost of my rental adjustment on the place I am living now as we had to turn it into a month to month now that he did this)? I live with 2 other people and for a number of reasons I wont get into, we thought it would be best to have me as the only person on the lease. They send me their portion of the rent and I pay on their behalf to the landlord (who prefers to only receive one payment). Historically, they've paid me rent on time-ish and I have records of the payments. A few weeks ago they expressed to me that they wanted to move out but did not outline a timeline. We verbally agreed that we are all responsible for our portion of the rent through the end of the lease, until a replacement is found and starts paying their portion of the rent. While I was away on travels, they both moved out with no notice or communication. They have not paid the previous month or current month's rent. Neither has found a replacement roommate for themselves. One of them is telling me he will pay me at the end of the month while the other is flat out refusing to pay rent. There are 4 months left on our lease. It's clear to me now that it was a mistake not putting them on the lease or having them sign a roommate/sublease agreement. Hindsight is 20/20, of course. It's one of those 'everyone knows everyone' sort of places. Anyway, last year (February 2020) I had a testicular cancer diagnosis and had to have my right nut removed. No one outside my family knows about this and my closest family member is about 150 miles away. I'm also kind of new to the area and haven't been with a girl, so trust me when I say no one knows about this. The only people who would know are medical professionals in my area. Today I had a student walk into my classroom and say "Hey, Mr. XXXXXXX, I heard you had some work done in your nether regions." I was speechless and just kind of responded as if it were a joke, not knowing what he was talking about, sort of laughed it off. Class moved on as per usual once everyone was sat down. This literally happened a couple hours ago and I am obviously not happy. Two weeks ago I went to the local hospital for a check-up, so the timing of all this is suspicious. This definitely seems like a HIPAA violation to me, but I obviously can't prove anything. I thought about asking the student where'd he heard this but that's obviously going to bring more attention to it. Is this worth pursuing in any way? or just one of things I should just let go. Even if the student told me everything and I was able to connect it to a particular employee at the hospital, would anything come of it? I don't know, I'm just super pissed right now. Bought a jumped texas title, what are my options? Posted: 07 Jun 2021 07:12 AM PDT So I made the mistake of recently purchasing a used motorcycle with an unclean title, it was my first vehicle purchase and I diddnt fully understand that the additional slots on the back of the title diddnt mean it could be transferred to me. In any case, neither the name on the title nor the name or address of the person it was initially sold to is the person i bought it from. I did some digging, and bought the carfax, and last I can tell it hasn't been registered or transferred out of the title holders name, the same title holder who's "jumped title" I have. So here's where it gets interesting, the title holder has a very unique name, and I was able to track her down on social media relatively easy. She is very willing to help me get the title transferred, but since the back of it has already been filled out and it's been "sold" I'm not sure the best way to go about it. As far as the law is technically concerned, I believe she should still by law own the bike since it was never transferred. I'm wondering if it's best to have her either file for a replacement title to sign over to me, or have her get a notarized letter to release the bike to my name, or if there's a better solution? Drunk, belligerent, littering neighbors! Helo please! Posted: 07 Jun 2021 11:14 AM PDT We moved into our home in December of 2019. Our nextdoor neighbors on one side of our house have been a constant problem--between their large aggressive dogs who frequently escape, loud drunken parties, screaming at us over the fence, coming into our yard and looking in our windows, lighting fireworks 2 feet from a gas can in the grass directly next to our sheds/property line, fist fights in their front yard, and etc. we are completely over it. Recently they have started throwing cigarette butts into our yard. We have a puppy who will eat anything she can get her paws on, and we also are concerned about fire hazards because our previous neighborhood went up in flames, 6 or so adjacent houses burnt and this was a big part of us pulling the trigger on buying and moving. My question is legally, what can i do about their constant nuisances? Is throwing their cigarettes in our yard illegal aside from littering? Can i call the police when they do it? Talking to them about it is not an option as any previous attempts to talk about issues have lead to them becoming more hostile. We are located in southeast michigan. My new neighbor is a pervert, what should we do? Posted: 07 Jun 2021 11:09 AM PDT My mom and I (21F) were doing some yard work outside and my neighbor, who's a married man with 4 kids 2 houses across from us stands outside by his car. His family wasn't home this particular day otherwise all the kids would be playing outside and the wife would be doing something outside as well. He then starts rubbing his pants. This happens at like 5 pm in daylight. He had his phone in the other hand. We saw him do this and we were shocked and turned the other way. There was a tree blocking his face so we couldn't tell if he was looking at us. Either way we go back to doing our work not facing him but we could still see him doing the same thing from our window reflection. Even my dad was mowing the lawn on the other side and noticed this but the creep still continued. This literally went on for the whole time we were outside almost 2 hours. So the next day we tell our other neighbors and we're all outside my house talking. He was in his car and drives pasts us, looks at us straight with no shame. Half an hour later he comes home and did the same thing again. Stood by his garage facing the street being innappropriate. I feel so uncomfortable and so disgusted. We've never had a neighbor like this and most of us in our block have known each other over 10 years and are all on great terms. We've never met this new family before but the wife seems a nice lady and she's close with the neighbors next door. I'm assuming the wife doesn't know about his behavior because he only does this when his wife and kids are not outside. I'm just sick to my stomach thinking about this creep and afraid he's going to do something else. What should we do in this situation? Should we report it to the cops, do we need to show evidence?
