We had a few problems with our HOA in the past, but this is beyond anything I have ever dealt with. About 3 weeks ago there was a fire and our neighbors house was heavily damaged by fire, i am not privy to the details of the fire, but the house was apparently written off. Last week the remains still standing were bulldozed for safety reasons. However most of the actual remains were pilled up. I was expecting them to remove it, but they have not. I don't really know what is going on with it at all. Tonight our HOA came to our house to tell us we are shirking our HOA duties as their lot is a mess. Our HOA president is arguing that both me and the other adjacent neighbor are responsible for the upkeep of any vacant dwellings. This is what they are arguing: "In the event of a unit being unoccupied with no clear owner. It is the responsibility of any adjacent units to perform any required upkeep to ensure the vacant unit is up to the community standards....(insert reference to our bylaws regarding how stuff is supposed to look)". Our HOA more or less wants us to remove all the debris, fix the lawn etc. I have so many issues with this, firstly it is not safe at all. Secondly i don't know who owns the plot now. According to our HOA the original owners took the insurance money and are moving somewhere else. So wouldn't that mean the insurance company owns the land and not us? Here is my story. I am in my late 20's, just got married (4/12/21*), and have two kids (4 and 2) and a very busy job (i.e. 50-70 hours+ a week)! (Backstory) Explanation - Myself and my then fiancé and two kids (aged 3 and almost one) bought our first place (Condo). The condo looked okay from what we saw when we walked through it and inspected it. We noticed a few minor issues but every place we saw had something that was needed... It ended up being a total dump. I have had to replace so many things within this house and it has made my already busy life a living hell. All of the doors had issues that I have had to fix, the sinks, faucets in the bathrooms, kitchen sink issues constantly (fixed now), dishwasher going out, etc. This is why I had the door outside while doing repairs. In the last 2 months, my work schedule heavily complicated being able to communicate with anyone regarding this (Basically 24/7). I have also been pretty busy getting married and planning/going through with getting married... and I guess kids take some work as well. Timeline (In Bold is what the HOA is asserting) 9/2019 - Moved into Condo in a suburb outside of Denver. 2-3/2020 - Fined for leaving a door on our outside porch x3 (totaling ~$400) 3-12/2020 - Notices were sent in the mail (we did not see a single letter of this, the person from the HOA I spoke to acknowledged that at least some of the mail got sent back to them) 3/2021 - HOA sends us to collections and we receive a letter in the mail and I immediately call collections agency 4/2021 I request time to speak with HOA board and am not guaranteed a time ( I am unable to make it to the meeting due to work constraints and was not even guaranteed any time (WTF). 4/2021 I get married and have my honeymoon which I notified both the collections agency and our HOA about. Today - I got served, for an early June court date. Facts from our perspective
After late fees, interest, collections fee, and now lawyer fees, the price will be 2.6k. What can I do about this? Should I just pay this and move on (like literally move the fuck out of this condo)? One of my housemates is a single mom with 2 children ages 3 and 7. I'm not sure if it's relevant but Im not a fan of the kids and absolutely despise their mother. Her kids are loud, they misbehave and She constantly pulls the single mother card when I tell her to be more responsible for them. I brought this up with the landlord and was rudely told to pound sand and to have sympathy for her (because it tAkeS A vILagE to raise children). Up until maybe a week ago, the kids father would take the kids while she's at work but he finally must've gotten tired of her shit because he booked a one way ticket to his home country, which apparently doesn't enforce US court rulings and blocked her on everything. Since then i have had the kids foisted on me 3 times because I'm a video editor and work from home mostly. Each time was without warning and I refused to do anything more than make sure they didn't die. Yesterday I got a call from a label rep I got connected to recently. They want me to direct and edit a music video for a huge artist I cannot name on here and wanted me to come to his house that evening to discuss the project. This is my big break about to happen and will be my first big budget project so I was not about to pass this up for anything. The mother left a few hours before without warning. She said she had to work. I looked on her Instagram story and this bitch was at a bar with her friends. I texted her and warned her I'm leaving and to get her kids. She left me on "read". I said fuck this and dropped the kids off at a fire station on the way to the meeting. I made sure they walked into the lobby (which was occupied by a uniformed firefighter) safely before taking off. My meeting went very well. Apparently since they were "abandoned" they are now in the foster system, she's having trouble getting them back and is threatening to press charges and file a lawsuit against me. Lawyer expects to get paid for online hearing they weren't prepared for, how to handle it? Posted: 09 May 2021 10:56 AM PDT I hired a laywer to help with a restraining order, but while the online hearing was happening, the judge told me my laywer was supposed to send in the evidence not me. I had over 40 exhibits, but online instructions for evidence was to send over email which is limited to 25mb I had videos over 100mb i had to trim videos to 10 seconds, they wouldn't allow any links to DropBox or Google Drive. The attachments were supposed to be labeled, but the court instructions didn't say. My laywer played dumb and never asked the court how they wanted evidence. He later in the hearing acted as if he had microphone issues, but didn't complain about it early in the hearing. We have a retainer agreement for 1k. While the hearing was happening the judge and clerk called my lawyer out for being unprepared. I am dumb for not knowing anything, but i hired my laywer to help with this issue. He took advantage of me and thinks he did anything. How do I go about this? Should I tell him that he shouldn't get paid for being unprepared? Tell him I'll report him to the state bar? I have audio of the delivery guys saying there is two fridges and too much work in Spanish followed by the delivery guy intentionally breaking the water dispenser. Stranger gets in my car and harasses me, refuses to leave Posted: 09 May 2021 05:47 AM PDT I was picking up a curbside order on my way home from work, just waiting in the parking lot when someone knocked on my window holding a food bag. I rolled it down thinking it was my food but it turned out to be a drunk customer who asked if she could get in the car and then did so without waiting for an answer because apparently my car automatically unlocks when in park. She said her boyfriend left her there and she was trying to call him to get him to come back for her and he kept hanging up. I was already tired after my shift and very shocked as to what was happening so I didn't know what to do other than sit there uncomfortably. I was even more shocked with how quickly things turned racist. She called me the n word repeatedly and kept speaking to me in mocking gibberish foreign languages or bad Spanish, even though I'm not hispanic. I tried to get her to leave by asking if she wanted me to walk her back to the restaurant, but she continued with her racist ramblings and started to threaten and insult . She told me to calm down, even pulling my hair and beard to get me to look at her. I was, again, completely shocked that this was happening to me, so i was just quiet and waited it out until her ride came. Now I'm kicking myself for not standing up for myself and wish I could still do something. Do I have any legal recourse here? I know it's not illegal to say racist things, but this lady literally forced herself into my car, verbally abused me, and put hands on me, though I guess I don't how I can prove she did all that. I do not think the person is guilty of the charges being brought against them, questioning it now though, and consider the case to be very easily resolved if the person takes it seriously. I informed them that skipping bail would just make things considerably worse and would also be extremely inconvenient for me. They seemed upset by this answer and have been increasingly distant to communication which is worrying. Next, a homeowner gets out fireworks, aims them out across the lake where I am flying it, and shoots it down. They are unwilling to play ball and I want to recover the cost of the drone against them (few thousand). What kind of cause of action might I have against them? Edit: the fireworks were illegal in Minnesota, and there is also local law about fireworks debris polluting lakes. Each with heavy penalties. There is also speculation about use of federal FAA treatment of drones as "aircraft" and penalties for shooting down an "aircraft". I am not looking for criminal charges. Another land owner had called the police on them that night for other dangerous drunken behavior like shooting fireworks at people. Is my job creating unsafe working conditions? New jersey Posted: 09 May 2021 10:05 AM PDT I work at a dog daycare facility in New Jersey. Over the last two years, upper management has deliberately cut the amount of staff in our department (even though the amount of dogs has doubled) and never hires anyone so they can use that as a reason why we are perpetually understaffed. Daycare is very busy and most days one person is expected to watch 30+ dogs by themselves. Some of these dogs are labeled "aggressive" in certain ways and require shock collars to be in daycare. If the dogs fight (which is like 1 every week) staff is expected to separate the dogs which can be very dangerous. I understand that's part of the job but the way they structure the daycare, overcrowding, and understaffing lead to more dog fights/incidents because its just too many dogs in one group. Multiple employees have been bitten and are told to lie about the bite if they need to go seek medical attention or are shamed out of receiving medical attention. Its common for you to get dirty looks if you ask to file an 'incident report'. One employee was a minor and she got bit due to the negligence of another worker and our employer told her she couldnt get work man's compensation for the injury, she didnt know any better at the time so nothing came of it. Even without the risk to staff, the dogs are a danger to each other in these high numbers and management refuses to improve the situation. Its unnecessary risk and safety issue because there is simple things the company can do to limit the risk: maximum capity in playgroups + more staff etc Even being allowed bathroom breaks is frowned upon, because we have to ask other department workers to stand in for us. There has been multiple times I was denied bathroom breaks because there was "no available" to stand in for me. Every holiday there is about 50-60 dogs for one person to watch. My coworkers and I have told and emailed the managers multiple times requesting additional staff, a maximum capacity to be added to the department because even the most veteran workers feel unsafe trying to manage 50-60 dogs by themselves. I love my job but I feel that my bosses are creating and sustaining unsafe working conditions due to their own refusal to implement max capacity or give us more staff. EDITED @ 210PM EST: I forgot to include that this facility charges clients for additional services in the boarding department (beyond basic walks/feeding) that the staff is not able to actually perform due to staffing. The owners and upper management know that these additional paid services are not being completed but they instruct the employees to "sign off" on them anyway or keep quiet. They dont tell this to clients and still advertise these add-on services and charge clients for it when they are never completed. They also overbook the boarding rooms and dont tell clients we have no rooms, so dogs get put into crates (literal and grooming type crates) when owners are paying full price for the boarding rooms we advertise. Was there any malpractice by my urologist ? Posted: 09 May 2021 06:53 AM PDT I'm very frustrated at the outcome of what had happened. Context: I went to the urologist because I was getting suspicious pain in areas of my testicles which resulted in both of them hardening with lumps. Went to ER they made a immediate referral to the urologist I got a appointment he said I had calcified mass inside both my testicles didn't know what to make of this but he wanted to do blood test and wait another 2 weeks we wait 2 weeks than he says he wants to do another ultrasound and CAT scan of my abdomen. All without address the initial pain I had which i could better handle at the time but as the days went on it got progressively worse and I told my urologist he kept telling me to buy over the counter medication. Finally after a whole month he wanted to do a biopsy because he was unsure from my good blood results and the agitated lymph node if I had cancer. He prescribed medication. Than he wanted 2 weeks to call me back about when to do the biopsy after I asked him to please hurry it up I'm in pain. And with him telling me it's cancer and the amount of pain I'm going through I asked him to remove both of them he refused and continued to do the surgery just to figure out I not have cancer and somehow worsened the pain with the surgery messed up my genitals (they don't hang anymore they are stuck on top). And didn't respond to my calls for help or pain medication while I was suffering in bed. Tl;dr the urologist strung me along for for about 4 months of pain telling me I had cancer, without doing anything about it and did surgery that messed up the appearance of my genitalia and refused my request for full bilateral orchiectomy to instead force a surgery that only made my pain worse. After performing forensics on the device, I found that it had been reset a week after he died, and all files were wiped clean by someone (an ex girlfriend) who briefly had access to the laptop after his death. This ex girlfriend was not the beneficiary or power of attorney. We've extended all our forensic data recovery options, the files are gone. However, we now have proof that the device was reset after he died, along with timestamps, etc. There's no reason to believe the ex-girlfriend was hiding anything pertaining to his death, there was no foul play suspected. Basically, my client thinks she was just being a jerk, so that she would not be able to get the pictures and documents off his device. (Personally, I think there could be more to the story...) Can we sue the will executor for failure to protect the asset before it was released to the beneficiary? I moved out at the end of April 2020, but I've been charged for May and June, and an additional 2 months penalty for moving out. In May 2020, the Massachusetts attorney general issued guidance that fees could not be charged to tenants with extenuating covid related circumstances. Having difficulty googling this one; Long story short, due to obvious reasons I had hit a point of economic disparity that I needed to apply for food benefits, that's right, if you can piece together the title, I am a literal starving artist. I have been a painter for years and typically the money is alright, but I never make more than 10k in a year which seems impossible to live on, but I've set up my life in such a way that it actually works out alright. Until covid hit of course. So I applied for EBT as a painter, or self employed person, essentially, and was denied. My family owns and runs a small antique shop so I let them know what was going on and they agreed to hire me for 20 hours a week both to help financially as well as help me qualify for benefits. So when I reapplied, despite having worked at my families shop for years before, and having been there for about half a year at the time I applied again, they focused entirely on my previous application and mostly only asked questions about my art. After being put through revenue investigations and questioned for days I was eventually accepted on the guise that I agree not to sell my work for a year. This is coming at a time when my work is actually gaining some popularity, I have pieces going onto movie sets, and the movie studio requesting more paintings. I am honestly just a little taken aback that to be able to eat, I had to write a notice saying I wont sell my work for a year. I'm wondering what are the legal implications there? Debt Not Being Repayed Posted: 09 May 2021 01:43 PM PDT TL;DR version: My mother - diagnosed with personality disorder - took advantage of a young immigrant woman and racked up tens of thousands of dollars of debt in her name. The long and complicated version: When I was an infant, my family hired a young immigrant woman, Annie, to take care of me. My mother, Sue, is mentally unwell with a diagnosed personality disorder for which she has refused treatment. My parents divorced when I was very young. It was extremely acrimonious and in the course of the proceedings, my father learned that my mother - who had been charged with maintaining the family finances - had squandered every cent he made such that he was in debt to the IRS for hundreds of thousands. It took him decades to dig out from that hole. Around this time, somehow, Sue convinced Annie to take out a credit card in Annie's name and give it to Sue to use. Sue claimed she would pay it off in full each month and she had some convoluted reason for why she needed Annie to agree to this. At the time, Sue was deeply integral to helping Annie secure a green card (we are located in the US) and I think that Annie agreed out of a mix of gratitude for Sue's help with the green card and fear that Sue might suddenly withdraw her support. This card is not linked to Sue in any way - it's not like she's on there as an authorized user or anything like that. No, when Sue uses the card, she presents herself as being Annie, to the extent that an online background check for Annie would have you believe she resides at Sue's house because that's where all of the statements (for Sue's debt taken out in Annie's name) are sent. But Annie has never been to this house and resides now in California while Sue resides in Vermont. Over the years, Sue has managed to request credit limit increases such that, now, the card has a limit near 50k and is 100% maxed out. Recently, Annie and I have begun to discuss this credit card and its fate. Through tears, she told me that she has been unable to buy a house because of it and that Sue has stopped making regular payments (or at least not reliably on time) on it such that Annie's credit score took so many hits that she no longer even bothers to check her score. Annie cannot simply close the card as it would mean that whatever half-hearted attempts that Sue makes towards paying it off would cease entirely and Annie works a barely over minimum wage job that would never allow her to manage the repayment. My siblings and I considered taking over the repayment but, once we learned how large the debt was, realized that none of us could afford it. Instead, we made an agreement that when Sue passes away, all proceeds from her estate will go first to repaying the debt taken out in Annie's name. The concern now is that Sue seems to be in danger of losing her home (her primary asset) and there's a real worry that there may not be any assets left for us to liquidate for this debt repayment when the day comes. I lie awake thinking about this. I am ashamed that I am related to someone who took such horrific advantage of a vulnerable immigrant and I am panicked beyond belief that Annie, who was a mother to me when my own mother wasn't, may be facing financial ruin. BACKGROUND: For many years now, a neighbor has been illegally running an automotive repair shop from his home. Even though it's against city and county ordinances, he even has a DBA filed with the county, and the business name comes up when searching the appraisal district records for his address. The business name clearly indicates it is an automotive repair shop in a residentially zoned area. I, and several other neighbors, have witnessed h illegally dumping gasoline and used motor oil, as well as allowing it to runoff from vehicles he is working on. Over years, all of us have filed several reports with the county, city police, sheriff, zoning departments, the county's illegal dumping hotline, and and so forth, and these reports even contain photographic evidence. Absolutely no action has ever been taken against him for his illegal home business or his dumping of hazardous waste. Though I have no proof that the local government agencies are doing anything worse than just simply not doing their effing job, I feel like there is something insidious going on. I'm already looking at state and federal agencies to report the neighbor to. I know a fair amount about how and when sovereign immunity is applicable, but cannot find whether the local government's failures to prevent hazardous waste disposal is sufficient to waive it, or if there are any specifically granted waivers for such a thing. I go to a university in Virginia and was just forced to move my car or it would be towed. They are clearing the lots for people to move out but that meant I had to walk about a quarter mile by myself to get back to my dorm. I don't park in handicap parking because it's fun, I have nerve damage in my leg and constantly live in pain as well as fall pretty frequently. A lot of people on campus with physical disabilities have gotten together to try and get things changed because while we love the school, disability access was really an afterthought. Ramps are steep and really far out of the way, walkways have uneven stones (like up to half an inch height difference), and elevators can be broken for days at a time. I say this just to give you some background as to what is going on here. I have fallen down the stairs of my building quite a few times when the elevators broke. I don't want to make a big deal out of nothing but there are students here who are worse off physically than I am and I don't want to let them be pushed around if I could have said anything about it. Define “witness” with a Zoom Court Date Posted: 09 May 2021 12:01 PM PDT Hey Reddit, I have a Zoom date with a Minnesota courthouse next week to legally change my name. Everything is all in order, I have the green light from everyone and it looks like the meeting should go smoothly. However, I am needing a little bit of clarification on the definition of "witnesses" for the Zoom part of the meeting. MN law states I am required to have 2 witnesses at the hearing. My parents have agreed to be mine. I am wondering if they will need to join in on the Zoom meeting through their own links or if they can literally just sit in chairs behind me in the same room and we can share the 1 computer/link. Posted: 09 May 2021 01:12 PM PDT I closed on a new development townhouse on Friday (5/9) that has an attached garage off of a shared driveway (the townhouse is one of 3 units in the building). When I was looking at the place, I asked the seller's agent if they had ever actually gotten a car into the garage as it is a narrow driveway and a fairly sharp turn. The agent told me yes of course. When I went to use the garage for the first time yesterday, getting in to it requires a 3 or 5 point turn, and in doing so the end my car past my back wheels was going over the edge of the driveway into the neighbor's yard. Annoying but do-able. Today when I was pulling out of the garage, the next door neighbor was in his yard and informed me he would be putting up a fence this week that will make it impossible to get any normal sized car into the garage. And he's correct, without the ability to back up far enough, there is not 3 or 5 or 10 point turn that will work. My agent says she thinks the developer should either try and move the wall of the garage out to give more space or try and buy off the neighbor to build his fence further in on his property line. I've contacted the developer but since it is Mother's day I'm not expecting to hear much until tomorrow. But I'm freaking out in the meantime. My question is, what legal recourse do I have if they advertised the townhouse as having a garage, but it is physically impossible to reasonable get a car into said garage? Can I threaten that I want to back out of the sale after closing if they don't somehow fix this? Thank you for any and all advice. Posted: 09 May 2021 01:10 PM PDT I have moved out of my apartment in NJ in mid December 2020 and relocated to another state. I gave my keys to the supervisor and he inspected the apartment room. There was no problem or anything to fix so he said I am good to move out. I also contacted the manager, and she said we are good to move out. She told me to send an email notifying of me moving out and send a letter to management office as well, so I did so. I set up a mail forwarding service to my new address just in case. In January I received a letter from the apartment management office regarding the month's rent. I sent them an email about it and called the manager, but they both did not reply or answer to my calls. I thought it was maybe a faulty in their system, so I brushed off. February came and there was another billing letter. I called and emailed them multiple times, and finally got a reply saying that they will notify my problem to their counsel. I thought the problem was resolved, and went on. This May, however, the letter came once again, with the last 5 months' rent amount. I don't know if I should just ignore this as I have email and text proofs of moving out formally, or should I take actions. If so, what should I do? [NY] - Employer is asking me to repay my insurance premium. Is this legal? Posted: 09 May 2021 09:24 AM PDT I work for a nonprofit in NYC. I was put on "partial furlough" last December as a result of the pandemic. They gave me a letter about this last November to notify me. In the letter, they informed me I would continue to work 3 days a week (21 hours). The letter also states that they would cover the my entire health insurance premium (both my portion and their portion) for the duration of the "partial furlough." It also states that when I return to work full time, I would need to repay the employee portion of the premium on a payment plan. After receiving the letter, I tried to just switch my health insurance completely to something from the NYS marketplace, but my employer said I wasn't allowed to do that. They have now brought me back working full time and have asked me (and several others who got this letter) to repay the premium. The total they say I owe is over $2,000, which is a lot. A few questions - is "partial furlough" a thing? I basically just switched to working part time. Do I need to pay them back? Is it legal the way they structured this? I didn't even really like how they structured it back then (thus me trying to obtain insurance separately), but they didn't give me any other options. If relevant, they never asked me to sign anything relating to this. I was always under the impression that changes to paycheck deductions need to be agreed to in writing. [link] [comments] |
