I have my medical marijuana card for a debilitating illness. My neighbor says they are going to sue me for the smell coming into her apartment. What can I do?

    Posted: 29 Apr 2021 06:29 AM PDT

I live in Massachusetts. Weed is legal here now. In my town alone, there are 4 dispensaries. I have my medical card for a qualifying condition and have had it for 3 years. I used to openly smoke in my condo, and my neighbor called the police frequently. Even when I stopped smoking and went to great efforts to avoid the smell becoming a problem, she complained/screamed at me at my front door and called the police. The police told her they can't do anything.

She is threatening to sue me, saying that she's being forced to inhale smoke from my weed, even though I don't smoke it, I vaporize it (less smell, no actual smoke). I even blow it out the window so it doesn't stink up my apartment. She cornered me today in our courtyard and screamed in my face and harassed me and my partner very aggressively, stating that she's tired of it. I asked her why she didn't address me before now if it's such an issue and she said she's been busy and hasn't seen me. I ended up walking away and ending the confrontation because i wasn't going to let her scream at me. She says I'm the only one who smokes in our whole complex (I find that hard to believe) and is planning to sue me. Will she get anywhere? Is there any way to do something regarding harassment? I'm just trying to live my life and deal with my illness and I don't really know what my rights are here.

EDIT: my grandmother lives with us and owns the condo. Idk If this changes anything

My condo has begun to smell like the condo next door and it is destroying my sanity..

    Posted: 29 Apr 2021 07:08 AM PDT

My husband and I own a condo in a row house type style with our home at the end, with one neighbor to our right. We are in Ohio. Recently we had an issue with the tenants next door smoking indoors and asked the landlord to address it. It helped but we had a couple instances where they continued to smoke inside. The biggest issue is now that the weather has started to warm up, the smell of their place has completely taken over mine. It reeks of stale smoke and neglect and no amount of cleaning, plug in air fresheners or air purifiers have helped. A lot of my time ,energy and money has gone in to trying to "mask" it but it doesn't matter and us moving won't be an option for at least 5 years. I feel that this counts as damage to our property and I would love any insight as to how to handle the situation. I'm unsure if anything that can be done about smell from a legal perspective. Thank you!!

Just got fired for pay discussion.

    Posted: 29 Apr 2021 01:37 PM PDT

Hello there. For context, the position I was just terminated from paid hourly. I was not a supervisor, just a seasonal worker. Today a coworker texted me and mentioned that a new hire will receive a wage $2 higher than ours, for the same job. I decided to shoot a friendly email to workers at three different stores, asking if they wanted to share wages to see if we were being paid the same.

Like an hour or two later, I get a text message from my boss's boss that I'm being fired because the email was "unprofessional" and "unacceptable". She also sent an email out to everyone in the district, telling them that wage discussion is forbidden. I saved all of this. Is what she did illegal? Can I report it to the labor board?

Dog bite at a hotel. Owners fled scene. Sustained 6 stitches. What can I do?

    Posted: 29 Apr 2021 10:39 AM PDT

So my family and I were staying at a motel near the beach (CT). All day long I've heard dogs barking in the room next door. Since it's dog friendly I didn't think much of it. Since this is in there website I figured the motel knows about these dogs and have assessed there behavior.

"Pets are permitted at our more than 1,400 properties across the United States, unless they pose a health or safety risk, or are prohibited by law. Motel 6 has a pet limit of 2 pets per room, with a combined weight of 150 lbs. Also, some state and local municipalities forbid any pets other than service animals. Please note that animals that pose a health or safety risk may not remain onsite. This includes pets that, in our managers' discretion, are too numerous for any one room, cause damage to our property or that of other guests, are too disruptive, are not properly attended, or demonstrate undue aggression."

Around 930 on Monday I went outside to have a cig (I know smoking is bad so if your going to make a comment about it please don't). While outside I heard a click and noticed the owners of the barking dogs entering the hotel. I noticed the male put a leash on one dog while the women was greeting the other. I did not notice her having a leash whatsoever. At this point I looked away because I felt like I was staring at this couple for far too long. (I'm an awkward person). In that second the dog the women had was now on my arm. It bit down and knocked me over. It then bit my knee. My fiance hears me yelling and runs outside. That's when he got in control over the dog right after the dog bit my hand. This whole time the owners stood there and did nothing. Didn't call the dog, didn't try and get ahold of it. They just stood there. When my fiance got ahold of it that's when they retrieved it. They then put the dogs back into the room, grabbed there bags and fled the scene. Cops were called and I was sent by ambulance to the ER. That's when I recieved 6 stitches to my arm.

What the cops told me: since the owners claimed they were homeless I can't sue them. (The motel is 425 a week fyi). The cops also told me that the reason they fled the scene was because they were late for work..... also the owners get the dog back in 10 days without the dog being evaluated.

What the actual fudge. How can these people just let there dog attack someone and just flee the scene? How can a motel put a family next to a room that has two bully breed dogs. The both combined weigh way more than 150lb. Someone has to be at fault for this.

Employer forgot to enroll me in benefits

    Posted: 29 Apr 2021 08:16 AM PDT

I submitted my paperwork to apply for benefits (flex spending accounts) to HR a few months ago during their open enrollment, and they confirmed it was recieved. I never got a card, and called HR. They said I was never enrolled and they have nothing on file. They are trying to see if the benefits provider can enroll me late, but "can't make promises". I don't think anything has been deducted from my paycheck. Still waiting to hear back...

I really need these benefits this year, since my medical expenses will be through the roof. If the benefits company will not enroll me (because of HR's mistake), am I entitled to any compensation? My salary is partially determined by the benefits I am eligible for. (Location: Indiana).

[OK] My father passed 8 years ago, My mother passed two weeks ago, and we've got a weird situation with the will/estate

    Posted: 29 Apr 2021 05:52 AM PDT

Okay - so I'll try to be succinct and only provide relevant info.

We already have an appointment next week with an attorney about this. I am just hoping to be as prepared as possible beforehand since he is scheduled at least a week out.

My sister is 32 and is the executor we presume. I'm 30. We are the only two children of my mother and father.

My mother did have legal guardianship (not adoption) in Oklahoma of two children who are 17 and 14. Their mother (my 1st cousin) was an abusive drug addict and serial fraudster. So my mother was granted guardianship by a court in Oklahoma. My mother was the kid's great Aunt (mother's mother's sister), and the kids biological grandparents live/lived right down the street from my mother's house.

My mother was in the hospital for 3 weeks before she passed away. While there, my sister and I both spent extended periods of time basically living in her hospital room for over a week each. During that time, she was lucid for a couple hours at a time on and off, and when she was awake she wanted to talk about her will and what would happen if she were to die. She seemed pretty convinced she was going to die, and she was right (breast cancer).

Anyways, she told us what drawer her copy of the Will was in at her house, what she believed it said (50/50 split between me and my sister), and she told us that if possible she wanted to change that so that she could provide $50k to each of the kids she has guardianship over solely to be used for education. We obviously plan to honor her wishes even though she wasn't able to update the will before passing.

This is where it starts to get a little weird

While in the hospital she talked a lot about the kids, her family, and what she wanted us to give to all of them from her things. She described that the 17 year old would probably know where a lot of things in her house were because he had a penchant for looking through her stuff, which she disliked.

At one point in talking to him he independently confirmed that he believed the will was in the same drawer my mom had said it was in.

We have searched the house and couldn't find my mom's copy of the will. We were able to contact my mom's lawyer who had created her estate documents and he provided copies, but also confirmed that she had picked up the originals shortly after signing them years ago.

    *rampant speculation*

We think it's very likely that someone stole my mother's will from her house while she was in the hospital. This is supported by other information not given here, but for these purposes assume that they did and we cannot prove it.

We don't believe it was either of the kids and we think their motivation would have been to hope that in the absence of a will, the kids my mom was the guardian of (not adopted) would be granted some piece of her estate.

    So my questions:

    • Would there be any problem with using the copy of the will provided to us by her former attorney via email since we don't currently have 'the original'?
    • If no will existed, what would happen to my mother's estate by default in this scenario? Would the children she was the legal guardian over have a claim?
    • Are documents like this officially filed somewhere when they are prepared (they were created in TX), such that it could be proven that no other document superseded our copy?

Any other useful information welcome, and feel free to ask questions.

Can I change more than my last name after marriage? [MD]

    Posted: 29 Apr 2021 07:25 AM PDT

I did a search of the sub and couldn't find exactly what I was looking for.

I'm getting married this fall and intend to take my spouses last name. However, I would like to (slightly) change my first/ middle name as well. My legal first name is hyphenated, which has been a hassle my whole life. I'd like to drop my middle name, and make the second half of my first name my new middle name. So:

Current name is Magic-Bumble Bee Lastname

And new name would be Magic Bumble Spouseslastname

I understand there's a different process for an adult name change outside of marriage or divorce. Would I need to go through that regular court process, publishing, etc. as opposed to the marriage name change process? From what I've read I'm assuming yes but I can't find anything that specifically states you can only change your last name after marriage without getting a court order.

Follow up question: if I do need to get a court order, do I sign the marriage license with my current legal name or my intended name?

    Thank you!

Condo association is forcing commercial units to fund their improvements

    Posted: 29 Apr 2021 11:33 AM PDT

[WI] I work in a building that is split between a residential side of ~30 residential condos and commercial side of 8 commercial condos (for all intents and purposes, they are separate buildings connected by a hallway). A condo association votes on all expenditures for the building. Each condo owner gets a single vote. You may see where I'm going with this.

Over the past 10 years, the commercial condo side has paid 20% of the buildings condo fees, but received only 3% of the expenditures. The commercial side is in disrepair, while the residential side builds new rooftop patios, repaves their parking lots, etc.

The main problem is the commercial condo side is outvoted in every decision. We're essentially held hostage to the whims of the residential owners and are forced to pay for whatever they vote for. Most recently, they voted to put a new roof on their side of the building, costing the commercial side $2000 per unit (on top of the monthly dues).

We can't vote ourselves out of the association because we don't have the numbers. We can't vote for any of our own expenditures, because we're outvoted by at least 20 votes.

In the last association meeting, we were told to "seek legal counsel" if we are unhappy with our situation. Any recommendations on how to proceed?

Unlicensed Driver Hit Me While Driving Her Husband's Car - Pennsylvania

    Posted: 29 Apr 2021 11:00 AM PDT

Basic Description of Events on 04/28/21:

I was driving straight on a road doing the speed limit (25mph), the other driver pulled out from a stop sign blind (due to several parked cars obstructing her view of me and the road in general as well as my view of her). She hit that gas and went straight into the right front of my 2020 Corolla with her 2020 Kia. I saw her in my peripheral in time to brake but there was not enough space between her and I to prevent the collision or even swerve. I did brake hard enough to not push through the front end of her car or spin her and came to a stop once we connected. My car's automatic braking system didn't even have a chance to engage because she did not entered far enough into the road way in front of me.

I was able to get a few pictures before she seperated her car from mine and proceeded to ask me to not call the police and that we can just settle it ourselves. Luckily a resident next to the alley she pulled out of called the police for us (i will be getting her a thank you card and cookies).

The police arrive, she claims her license is at home and the officer explains we may be able to settle it personally but I request he investigate the accident until I am told otherwise by my insurance. He agrees to investigate.

She does not have a license in PA or MD and is driving her husband's car. She apologized several times for the accident and even offers her prayers for us since this is our only vehicle and it is not safe to drive. The front end of my car is smashed in and the panels all the way to my door are now several inches out of position. Her car is not drivable either. The officer gave her multiple citations. I received none.

We have taken our car to the original dealership who has a collision center and an in house car rental. The collision center is going to document all damages and negotiate the bill with the husband's insurance company / adjuster who has given us a claim number. Same for the car rental.

I am picking up a copy of the police report this afternoon to send to their insurance.

I am also going to see a chiropractor this afternoon to take a look at my lower back. I have seen a specialist in the past for a degrading disc in my lower back and my sciatic is very painful now. I worry this may have affected my disc and I'm very afriad of having long term issues because of this.

    My concerns:

    1) Can the husband's insurance try to claim she is not on the policy and refuse to cover any of the costs?

    2) What do I do if I am injured / my previous issue has been made worse?

    3) If they refuse to cover the damages, how does one go about suing in this situation for the cost of repairs? How much is this going to cost us?

    4) in general, what do we need to do in this situation? Is there anything we need to avoid? Anything we need to be careful of going forward?

Neither my husband or I have ever been in an accident and we do not want to screw this up.

Thank you for any help or advice you can give. It is much needed and appreciated!

Damage to rental car in another state

    Posted: 29 Apr 2021 04:17 AM PDT

Flew from TX to FL for vacation. Rented a car. Valet at hotel busted the rear window. Manager acknowledged their fault. They even agreed to pay for ride share services. Also have that acknowledgment in email. All good so far. Total for rental damage and ride share is ~$700. I have paid the bill to the rental company. It's now more than 6 weeks. Last email to remind them has received no response. What is best course of action?

Accept Class Action Settlement or hire private attorney?

    Posted: 29 Apr 2021 12:15 PM PDT

I have a diesel vehicle that falls under a class action suit. We're offered repairs to the emissions system and a settlement check for around $3,600. I'm getting letters from firms wanting to represent us outside of the class action and seek a separate settlement with claims of 2x to 10x the offered settlement. Should I go outside or just take the settlement and repair offered by the manufacturer per the class action suit? I am located in Texas.

[OH] Apartment complex not honoring promotional free month of rent

    Posted: 29 Apr 2021 08:54 AM PDT

    Hi,

Back in the beginning of March, my apartment complex made a few billing errors, which they corrected, and also offered us a free month of rent.

In the leasing office's e-mail response explaining and correcting the error, they offered us an "additional credit of one month free rent, to be used however we'd like throughout the remainder of our lease". This was to be added as a credit on our rent account (the way we pay rent works almost like a utility payment, where we login and it shows us what our outstanding balance is).

The building's property manager was CC'd on this original e-mail.

This week, when inquiring about using the free month rent for next month, we were told by the leasing office that no such credit existed. The property manager was looped in, and the property manager stated that no such concession existed on our lease.

This is true - the concession was extended to us in an e-mail, which the PM was CC'd on, after the lease was signed.

I guess I'm wondering if they have any obligation to honor this credit, or if that e-mail offering us the credit holds any water at all.

Workers Comp won’t pay bills despite saying they would, medical bills overdue soon

    Posted: 29 Apr 2021 08:22 AM PDT

I'm a shelf-stocker for a large nationwide retail chain in the USA, I work in PA. Back in late January I (M19) inhaled some airborne chemical powder at work and was promptly sent to the hospital by corporate's medical hotline. After the hospital's poison control specialist cleared me, I was hit with two bills (the hospital itself and the emergency doctor's practice) totaling to around $800. I opened a claim with workers comp and they said they would cover it. Now going into May, they still haven't paid and refuse to answer or return my calls, the hospital bill is almost overdue and the er doc practice went overdue a week ago.

What I want to know is should I resort to legal action to force worker comp to pay, and if I should, how? In addition, if the bills get sent to collections can I sue for or otherwise receive compensation for the damage to my credit?

[CA] My apartment complex shut off my water for a day last week for maintenance work with less than 24 hours notice. Today, they did it again without any notice.

    Posted: 29 Apr 2021 10:26 AM PDT

I asked the plumber about it and he said it wasn't an emergency, they were just replacing pipes for the water heater. Any time I have tried to call the maintenance line since I started living here, nobody ever picks up, so it's very difficult to get a hold of anybody.

The only relevant lines I find in my lease are: "We may change or install utility lines or equipment serving the dwelling if the work is done reasonably without substantially increasing your utility costs. We may turn off equipment and interrupt utilities as needed to avoid property damage or to perform work."

Do I have any course of action here? Can they just shut off my water without notice as they please? I just want to know when I should shower...

    Employment Advice Needed

    Posted: 29 Apr 2021 05:17 AM PDT

I have an employee who did not want to work. They quit stating that the would rather be homeless than return to work after we reopened from the pandemic. They packed their things, returned their key, and left the premises.

Later that day they texted me asking for their next work schedule. I asked for an explanation because of what they had said when packing their things and returning their key.

They are now saying it was a mental health issue. I was confused. I tried calling but they would not take my calls or return my letters.

I also did not let them go at that time because their text had confused me. A month later when unemployment called regarding their termination I notified them that they had not been terminated and the they were still on payroll.

Now they are seeking money by means of the fair employment & housing agency.

I am in a position of defending myself and feel overwhelmed and as if I am being taken advantage of.

How can someone claim they were wrongfully terminated if they walked out on their job and refused to speak with management when requested?

    Any serious advice is welcome.

Landlord didn't replace locks and my house was broken into by someone with a key (Houston, TX)

    Posted: 29 Apr 2021 01:50 PM PDT

I've been in this house since September and have had multiple incidents. My security camera caught someone trying to break my doorknob and get it in in December. I have video evidence of someone walking into my house and walking out with a bag I have never seen before.

I told the landlord and he replaced the locks that day, but now I know that the locks weren't replaced between the previous tenant and me. My mail has also been stolen and on Saturday, my car was stolen right off the driveway in BROAD DAYLIGHT.

My neighbors have all tried to keep an eye out for me and have showed me security footage and everything, but my car is long gone (I know this because I called the toll road authority and they told me the route my car went and got billed for).

I (as well as police, family, and neighbors) all feel that these incidents are related and that someone is keeping tabs on me and knows that I live alone. I live in one of the safest areas in all of Houston, so I know that I am being targeted. Probably because of previous parties that have lived in that house.

My legal question is: Do I have ANYTHING that can allow me to break my lease? My landlord is really friendly but obviously doesn't want me to break my lease. I need something that can get me out so I can find somewhere else to live. I've lost mail, my car, and I am afraid of what I could lose next.

Help, I lost everything in a move and my insurance company says they don't cover it.

    Posted: 28 Apr 2021 07:06 PM PDT

    Hello,

I recently moved across the country and hired a moving company. To my disappointment and surprise, that company was a broker who hired another company to do the work. This other company showed up in a Penske truck with one person to move my items. Long story short I got to my destination and the moving company said they were delayed due to weather. This delay turned into one after another until they refused to take our calls, it has been over a month since we last heard from them. The broker claims it is our responsibility to go after the 3rd party company they hired and refuse to take our calls. I filed a home owners insurance claim and statefarm claimed I have to prove my property was stolen and they closed the claim. I don't know what more I can do to get my items or get their value compensated back to me.

    What I have done

Filed a complaint with the fmcsa against both the broker and 3rd party

Filed a home owners insurance claim

Filed a police report in multiple states

Attempted to contact the broker and 3rd party at least weekly since my items were taken (february 16th)

Is there any legal precedent I can follow or steps I can take?

Edit: This happened in Paducah kentucky

[Michigan] Conservator/Guardian issue over my mother with crazy brother. Scared for my home and my family. Please advise! help

    Posted: 29 Apr 2021 01:18 PM PDT

Sorry in advance if this is all over the place or any grammar mistakes. So my mom multiple stokes last year that has left her disabled, she can barely walk and she has aphasia (cannot express speech and is difficult for her understand complex sentences). My twin sister and I (23f) have both lived with our mother before her stoke and now we continue to do so while being her full time caregiver. We are both students and we both lost our job due to covid. Because of my moms condition, this required a guardian to deal with all of her medical issues/ insurance, finances ect. My brother (36m) and his girlfriend (not married but been together 10+ years with kids) persuaded my sister and I to allow his girlfriend to be guardian as she is familiar with disabilities/medical and insurances in which we all agreed to because we thought we could trust them.

Well surprise surprise. Its been a nightmare. To keep things short they have been things incredibly difficult for us. They love to say "we want whats best for mom" but they have been cruel to my sister and I. They insult and berate us in front of my mother and family. They have used our lack of knowledge of legality of things against us and lied to us stating that they could kick us out of our house if we disagreed to do things their way. They have installed cameras all around our house against our wishes. Its more the idea we have lost a say in what happens in our own home and what happens with my mother. They leave us out of any kind of plans or decision making. They have banned my moms sisters and some other family from visiting my mom despite my aunts and mothers having a good relationship before her stroke. (they do this because of their own personal drama) They threaten to call the police if anyone dares to come over and visit. My sister and I take care of our mother without the help of anyone. My brother and his gf rarely come over to allow my sister and I to get out of the house but forbid any of our family to come over to help or just hang out. My sister and I pay all of the bills despite my mom getting social security every month. They use all of my moms income for lawyers and I don't know what else they get angry if we ask to see my moms bank account (which we were ok with but now that we don't need lawyers anymore they still plan on using they money on other things). I have no idea what they plan on spending $1700 a month on if it doesn't go to my moms house.

Now that the background info is out of the way, my big issue now is my brother trying to get conservatorship of my mother. After everything that has happened, my sister and I feel very hesitant to trust my brother. We have suggested co-conservatorship as a precaution instead of giving my brother the soul conservator. But he said he would fight us in court over it. My sister and I cannot afford any kind of lawyers meanwhile my brother has used all of my mom's money for his while me and my sister used all of our money to pay all the bills. Essentially they expect us to take care of our mother with barely any help but at the same time get no say in anything and blindly trust him with everything including our home. I feel like I'm being suffocated. I want what is best for my mom and I would never want her to go back into a nursing home but I'm going crazy with them breathing down my neck. The court hearing for my brothers conservatorship will be on Monday and the whole point of me writing this is to get any suggestions or advice on what I should do or say. I offered co-conservatorship for my mother but he said no. He also said he would fight us in court if we tried to get conservatorship. He is dead set on becoming soul conservator. Would it be a good idea to ask for a court appointed conservator/guardian? My sister and I are also agreeing that it is time to remove guardianship from his gf. We would like to go in court prepared and confidant. Just any advice would be greatly appreciated. Thanks for reading.

aslo, my brother has told me he does care and will never let my mom's sister he her again. My mom hasn't seen her sisters or mom in a year except for video calls. I have secretly stuck my mom out to see them and I did it in secret because they literally scream at me if I mention letting my aunts see my mom.

He filed for conservator months ago and never told us. We just randomly got a summons. We thought we could trust them and we tried to do things their way but it has been so awful.

Can my employer legally take any action if I leave them in the lurch?

    Posted: 29 Apr 2021 10:51 AM PDT

I have worked for a small company in the US for a little over year. There is a president, vice president, and 2 employees other than me. Admittedly my performance in the role has been pretty average, but I am in a very client facing role and some of our clients lean heavily on me. It would not reflect well on the company if I were to leave suddenly.

I have been very unhappy at this work place because they are very interested in my life outside work and things about me that I prefer to keep private. They have also been pressuring me to return to the office despite the fact that I am immunocompromised and just not comfortable doing so yet. Nothing they have done is really bad, but overall it just hasn't felt like the right fit.

I have had another job offer for a role that is permanently remote. I'm able to give my employer 2 weeks notice, and I plan to try doing so, but given past experiences I think they may treat me very poorly in that time. I also reviewed the original information I was given and it states clearly that if I leave the company, regardless of notice given, that my PTO will not be paid out.

If I'm not able to work the full notice period, could there be any legal repercussions?

Being Sued by Credit Card Company

    Posted: 29 Apr 2021 11:56 AM PDT

I have a credit card that I foolishly stopped paying in 2019. I was only working part time and could barely cover my living expenses.

The card company called and sent letters and I just ignored them. Eventually they stopped and I had an "out of sight, out of mind" mentality. Stupid, I know. The card balance dropped off my credit report and was just showing as a closed account.

Well this week I was served court papers. The collections law firm that is representing the card company is suing me for the full balance of $7500. I tried to call them to negotiate, offer a lump settlement or even do a payment plan and they rejected. I was willing to give them $3500 to settle, or even use that as my first payment and do a plan for the rest. They rejected to settle for that amount, and the only way they would let me do a payment plan is if I would agree to have a judgement placed against me. I really don't want to do this because I know how badly this affects your credit for 7-10 years.

I tried to call the card company but they said since it is so old it is out of their hands and everything has to go through the collections firm.

I am not trying to dispute the debt. It is mine and I owe it and I want to do what's right. I just don't want to absolutely destroy my credit beyond repair. Does anyone have any advice on what my next steps should be? Should I continue to try to beg for negotiation without a judgement or just wait until court?

My stepfather is dying of brain cancer. What are some things you wish your clients had taken care of before their spouse’s had passed?

He was diagnosed March 29 and is in hospice now. Fucking sucks. I'm just trying to stay busy and help prepare my mom financially for when he passes so she doesn't have to stress over that. We've never dealt with anything like this before. Any advice is appreciated. Thank you!

[CA] Employer is starting a new Attendance System that punishes Sick Time

    Posted: 29 Apr 2021 01:36 PM PDT

    Hi all,

I work for a Medium Sized-Chain Retailer in California. Corporate recently announced that they're going to start an attendance tracking system where employees receive Write-ups at 3, 5, 7, 10, and finally fired at 12 points.

If an employee is late to their shift they receive 1 point (This is totally fair). If an employee "No-call No-Show's" a shift, it's 3 points (I also think this is fair). If an employee calls out sick they get 3 "free" sick call-outs per year. After using the 3 free ones, it's 2 points per call out. Regardless if you have the accrued Sick/PTO time.

That last one, is the one I think I have a problem with. I brought this up with Corporate already, and I was told that it's legal and within California labor laws. They also stated that multiple retailers throughout California have this type of system.

I was always under the assumption that if you have the available Sick Time/PTO and call out, you cannot have any form of discipline, punishment, or retaliation.

Thanks to anyone who can help out.

Officer marked road as "wet" on speeding ticket, though it was dry and sunny that day

    Posted: 29 Apr 2021 01:35 PM PDT

Last week, I was pulled over for driving 79 in a 55 and given a speeding ticket with a court date. Considering that I am 18 years old and about to go to college, getting a ticket like this is quite detrimental because it could cause my insurance rates to go up quite a bit (which I will be paying myself) as well as a hefty fine that will be difficult to pay. Once I got home, I took a closer look at the ticket and noticed that the officer marked the road as "wet" even though there was no precipitation that day and the sky was clear (I have weather reports that can back this statement). Could this error on the ticket potentially get it dismissed or is that just wishful thinking on my part?

This is the first time I have ever been pulled over and I've always been a 4.0+ student with a good amount of community service on my belt, as well as plenty of work experience considering my age. Aside from how to handle the error on my ticket to my advantage, any tips on how to proceed in court so as to minimize the consequences would be greatly appreciated.
