[Texas] Baby suffered brain damage during birth, lawyers say hospital is immune to litigation? Posted: Hello, My sister-in-law went into child labor at a hospital in Dallas, TX. The labor was induced and lasted for two days, her handling physician promised she would be there when the birth started, but she did not show up and an attending took over. Throughout the birth, the attending disregarded clear signs of distress (elevated heart rate for both mother and baby), complete dehydration of mother and child to the point that both shriveled and developed an infection, the baby also swallowed amniotic fluid that blocked his lungs, causing him to be unable to breath - this in turn caused asphyxiation and oxygen being cut off from the child. He did not cry, was unresponsive, and only after a few hours in the NICU did he begin crying and become alert. (Legally irrelevant, but infuriating note: The doctor laughed when the baby came out shriveled and unresponsive commenting on how "weird" he looked) The baby has been in NICU for the past couple days receiving neuroprotective treatment to hopefully prevent or mitigate brain damage. The doctor who delivered the baby has not once seen either of the parents. The hospital staff have been avoiding and only informing the parents anything, only after extreme pressure from my brother. Only after my brother filed a formal complaint in the hospital against the doctor and floor staff for their behavior, was there any change. The head of NICU approached my brother to apologize and try to brush off the possibility of brain damage and assured them if there is any it would likely be minor. My brother and sister-in-law are, naturally, furious and wish to litigate against the hospital in general or doctor in specific, however, when they called the Texas bar association for a malpractice lawyer recommendation, they were informed that the "hospital is too valuable and prestigious as such it is immune to litigation" (Exact phrasing). [Michigan] Sister sold used car and the buyer has filed in small claims court. Posted: My sister and brother and law sold a 2011 Ford F-150 a few months ago "as is." The buyer had his cousin come and look the car over and had him do a walkthrough and test drive the car over Facetime (video chat) before deciding to purchase it on the spot. My sister and brother in law said they didn't know of any issues and that it drove great for them. They only owned the vehicle for a month or so before deciding it wasn't the best vehicle for their needs. A few weeks after the sale, the buyer claimed that there was a rough idle and upon taking it to the dealership, there was an issue with one of the cylinders and it would cost roughly $3600 to repair it. The sale of the vehicle was $9500 so that's quite a bit. The buyer asked for some money in compensation and then when I told them that they didn't need to do that, the buyer threatened with them with small claims court and has since filed suit. I kind of figured this guy was trying to swindle them when he sent them a Facebook message saying something along the lines of "consider this your official notice of being served." Last time I checked, Facebook messenger is not an official avenue for legal proceedings. I haven't been able to find anything that shows a seller of a used vehicle being held responsible for anything. They sold the car as is, the buyer neglected to have a mechanic look the car over or even inspect the vehicle in person. Is there anything they need to be worried about or is this guy just trying to scare them into giving him money? My brother in law moved here from Colombia a year and a half ago and doesn't have the best English and my sister knows nothing about cars. Posted: At the end of my M. Ed graduate program, I applied for a teaching position (with support from my publicly funded teacher preparation program in NYC) and was offered a fulltime position in my field. When I went to my college to request their approval for the relevant certification, they told me no because I had missed their deadline. When I said when is the deadline, the Dean would not tell me and said they purposely kept it secret so students would not request it. (I know, this makes no sense to me either.) I was not able to accept the position. What's worse, this blocking by my college flagged me to NYS and meant that I was not eligible for teacher certification until I had met additional requirements (this took me two years). Then came the pandemic and a hiring freeze. I've now lost three years income as a qualified teacher and still owe my college big bucks for a degree that I have completed but never received. [TEXAS] Ordered at GUNPOINT into a strangers car - by a policeman! Posted: Throwaway. This just happened and I am freaking out! I was walking out of a convenience store when a car whipped into the parking lot and pulled into a space at a high rate of speed. They almost hit me! I jumped back onto the curb to avoid getting hit. As I turned back around I saw a police man coming from around the back of the car. He took one look at me and started screaming "GET BACK IN THE CAR! GET BACK IN THE CAR!" I froze because I was so scared. The police man put his hand on his gun and yelled that I needed to get back in the car immediately and he yelled "DO YOU WANT TO GET SHOT? GET IN THE FUCKING CAR NOW!" I have no clue who this car belonged to but I frantically tried to open the door. It was locked so it wouldn't open. The officer kept screaming at me and I didn't know what to do so I started crying my eyes out started hitting the window with my palm. I looked in at the driver and she was crying too and unlocked the door. By now there was another police officer and he was on also yelling so I opened the back passenger door and got it. The driver looked just as scared as I was and I was balling. She was an older woman and we were just scared to death. The second officer ordered the woman out of the car and had her walk backwards while I stared ahead balling. After he cuffed her they ordered me out of the car and made me walk backwards too. A cop grabbed me and slammed me over the hood of the womans car and cranked my wrist into handcuffs. It hurt so much and I cried but they didnt care. He put me into the back of a cop car. I thought I was going to jail. All my stuff was scattered in the parking lot. I sat in the car burning up dying of thirst for at least 20 minutes until a lady cop came and started grilling me about who I was and why I tried to run. I begged and pleaded with her that I had just walked out of the store and I had no idea what was going on. I begged and begged for them to go ask the cashier guy to prove I was not with that woman but nobody would listen. someone found my purse under the womans car where it fell when I dropped it and they gave it to the lady cop. She pulled my ID out and probably saw that I have never even had a speeding ticket. She started the cop car and turned on the air thank God. sorry I am still balling I can barely see and I am shaking so much. Anyway she went inside the gas station and I guess she saw the camera footage because about 10 minutes later the first officer let me go and unhandcuffed me. he called an Ambulance out and they looked at my hand but didn't see any marks even though it feels like it is sprained. They wanted to take me to the hospital because I was having trouble catching my breath but I cannot afford a hospital stay so I said nooooo. The whole time I was in the cop car I could see the first two officers joking and laughing and having a grand old time while I thought I was going to die. I have never so much as stolen a pack of gum or sped or anything. I am only 19 years old and I feel like my heart is about to beat out of my chest and it has been almost 2 hours since I got home. I just cant get the look of that man out of my head. His eyes were bulging and I thought I was going to get shot. They let me go and didn't even apologize. I had to call my brother to come get me because my legs didn't want to work. How can they do that to me and just laugh and make fun of me? I thought he was going to kill me! How do I collect my Judgement? (Utah) Posted: A few years ago I had to sue my landlords (husband and wife) in small claims in order to get back a wrongfully withheld security deposit. Long story short I won in court but I haven't seen a cent since. Fast forward to today and I decided to look into what it would take to collect on this Judgement. Via some online snooping I found out that they both work at a non-profit organization with special needs children. I found the organization on my States business registry and the husband is listed as the owner. How would I go about garnishing wages since he is self employed? Would I serve the writ of garnishment to him and he would garnish from his own paychecks? Do I have to worry about him doing anything fishy to avoid paying the garnishment? Additionally there is a potential problem, I knew him as "Steve" and that is the name on all the court documents, but the name on the business license is "Steven" would the misspelling cause any issues when trying to collect? Edit: I just found out through the court website that the wife is currently being charged with Assault and Domestic Violence in the Presence of a Child and will be arraigned next week. Her name is spelled correctly on the court documents from when I sued, if she is convicted of those charges would she be barred from working with children? Posted: A colleague of mine had been working as a full-time salaried employee with benefits (including health coverage) for a non-profit company in California with 50--100 employees. In mid-March the contract he was being funded by ran out of funds and he was terminated (foreseeable event, knew the contract funds were going to run out for a while, but no other work by the company was offered). Under the 2021 ARPA act, COBRA is supposed to be subsidized at 100% for anyone who had hours reduced to less than 50% or were involuntarily terminated. The company's HR is telling them that "A lack of funding is not considered an involuntary termination." and thus the company does not make COBRA payments. Does this sound correct? Or is it worth them to consult an employment attorney? I'm trying to help them and I can't figure out why this wouldn't be considered a layoff like any company who has a reduction in funds and lets people go. [link] [comments] |

The days before our closing, the seller said they would be out of the house the following weekend after closing. We were fine with that. The day after our closing, the seller said they needed 30 more days. Unfortunately, we had not agreed upon an occupancy date prior. I told the seller if they wanted to stay that long, they'd have to sign a Post Closure Occupancy form stating the expected occupancy date, which would give the seller the 30 days. Posted: Hi guys. Long post incoming. I (19F) was adopted when I was around 3 years old. I... don't know what to do here. I contacted my school's legal department and have an appointment for Monday 1:45pm, but I need some advice (legal advice) in the meantime. My adoptive parents are... well lets just say my adoptive father currently has 5 felonies. My adoptive parents lead to many mental breaks as a child that could have been avoided due to high pressure and stress to be perfect. I have a lot of mental issues that were directly triggered from childhood trauma. Here's the story as to why I want to find out as much as I can to get my adoption reversed. I spoke to my birth mother (40F) last night. We had a long talk about my little sister (who she has full custody of and never had any issues with keeping) and I brought up not knowing who my father is. She told me his full name, on the spot. My adoptive parents always told me about my mother but never about my father and claimed that M (my birth mother) didn't know who it was because she slept around. This was big. I felt like my world was cracking and breaking down, but I kept asking questions. I remembered a file box my adoptive parents gave me with all my information in it, including the adoption paperwork. I opened the file box and grabbed the DCF paperwork and went through it. There plain as day was my fathers name on the paperwork. Strike number one for me, I then asked my mother why she didn't tell me about my little sister til she was 7 (she's now 13). She told my adoptive parents and they responded with "OP doesn't want to meet their little sister," but asked for photos to 'show me' my little sister. I never saw a single one. My adoptive mother told me I had a sister in a parking lot while getting groceries. Lovely conversation. (sarcasm) I started reading the notes taken from my adoptive parents, and cross referenced them with M. Half of the notes they used against her in court she wasn't in the state. Ex: They stated they drove her to the hospital to visit her mother, she was in Illinois at the time (they were in Florida). She showed me proof and dates of this claim. She signed away her parental rights when I was about 2 and left to Illinois shortly after, believing they were better parents than she could have been. She has records of this, but my adoptive parents wrote 'notes' on her behavior all the way through to the end of my adoption. I have the originals of everything on their end. I'm sure I can get the papers from M. Here is the tricky part. I seem to be missing some paperwork from the adoption, and it's the paperwork about stipulations of the open adoption. My adoption is legally an open adoption, I was supposed to have visitation with my maternal grandmother. According to M, this was talked about in court. It seems to line up pretty well since my adoptive parents did allow me visitation until a certain age then suddenly stopped (I believe this was around when my little sister was born). M didn't fight them for me, she trusted and believed they would be better parents for me. She only fought to allow me to visit my grandmother because I was very attached to her. I think the only time I ever cried about a family death was my grandmother. I love that woman, I wanted to visit her all the time but lies told by my adoptive parents prevented this. I only have a few court documents: The Petition for Termination of Parental Rights and Permanent Commitment, and Post-TPR Disposition Review. It seems my parents also lied about my mental health always being "fine" and suddenly getting worse as I got older. Apparently from the moment I went to live with them my mental health deteriorated. Before I was adopted I had no signs of anxiety or depression and once I was adopted I was diagnosed with general anxiety and depression (proven by documentation of mental health before and after adoption). This got worse and worse until I developed PTSD when I was a teen. I eventually got therapy but it was too little too late. They would pretend to follow the therapists instructions for around the house but instead belittled me for not being 'cured' yet. I now don't live with them and have everything paid for except my car insurance and my phone bill. I am switching my phone plan to my friends plan and I am willing to give up to my car to them since it's in their name. I don't care, I just need to get out and get away. I already have my escape plan to leave them and their emotional abuse, I genuinely am afraid of them. How can I go about making sure I can get my adoption reversed? I want no ties with them. P.S. Building next door put up a fence that blocks my bedroom window Posted: I rent an apartment in Chicago, IL. The detached garage for the building next door is directly outside our bedroom window, and recently had a patio/party space installed on the roof. I am not thrilled out people hanging out outside my bedroom window late at night, but I understand there isn't anything that can be done about that. However yesterday they installed a large fence/divider, completely blocking our window (link with pic below). Is there anything I can do here or am I just screwed? Neighbor wants to build a gazebo on the property line. Posted: My neighbor Tom and I have a good relationship, our kids are the same age and they play together all the time. We have each other over on our patios for beers pretty frequently. We also have had no issues taking down trees together or other shared yard interests. Between our houses, there's a small natural woods area. Tom mentioned that he wanted to build a gazebo in the area and asked if I was cool with it and could help out. I'd love to have a gazebo over there and wouldn't have a problem sharing the costs if it's ours to share. The issue is that it would have to straddle the property line and could lead to a mess when one of us moves out. Texas - Group order that hundreds of people have joined may be a scam Posted: I need advice on how to handle this situation. This person on twitter opens group orders for international merchandise. Since it is cheaper to order with multiple people, a lot of people join their group orders where she then sorts and ships to the joiners once the items arrive to her. It was going well and she had lots of proofs. Lately however, she has been away from twitter, hasn't updated in months, and is now starting to ghost her emails. I have given her $140 and I know some people who have given more. She probably has hundreds of joiners. Some orders are even from over a year ago with no updates or emails about EMS payments (EMS means shipping to her which is split amongst the joiners for how many items they have). A lot of the orders are shipped to an international address before it is shipped to her which is what the EMS is. Furthermore, she was also exposed for profiting off EMS payments where she upcharges the amount per joiner. In her first batch she profited 2k. I was just wondering how do I contact the police or authorities about this? I feel like she could be charged for some type of theft or fraud. I have gotten none of my items or emails about EMS payments, my first order was in May 2020. All payments were made through PayPal friends and family unfortunately. Posted: California Our local CVS is under renovations and the pharmacy has moved to a temporary conex in a nearby lot. I have an autoimmune disease so I pick up a lot of medications. Unrelated to that, one of the medications I am on is Adderall XR. I'm working from home until I can get doctors approval to get my COVID vaccine so, I'm in pajamas and Uggs and maybe I look a little kicked today. Anyway, I pulled into the CVS at 9am. I parked near 2 police cruisers in the parking lot. I went in -- got my prescription refills, one of which was the Adderall, and a bottle of water. On my way back to the car i opened the Adderall and ate one as i was getting into the car so it would take effect by the time I got home. While sitting in my parked car in the lot, I buckled my seat belt, texted my boss that I was omw back. When the Police Officer sitting in the cruiser 1 spot over tapped on my window. I rolled it down and said something along the lines of "I was going to put my phone away before I started driving." He laughed and said that's not why he came over to talk to me. He saw me take a prescription pill on my way back to / as I was getting into the car and he said he was just a little concerned in case it was a "controlled substance" and could effect my driving ability. In hindsight i should have told him that it was my personal medical prescriptions and if he wanted to see them he should have gotten a warrant or something. He sounded casual and friendly and I was honest. I told him -- I have ADD and I was just taking an Adderall that i was prescribed to before heading back into work. He stated that Adderall was a controlled substance and asked to see both my ID and the prescription bottle. They matched, i showed him. he put my Adderall into his cruiser, i waited in the car for a second.He told me I was going to get a non moving violation for taking an elicit substance with an intention to drive and i was written a ticket and given my ID back. When i asked for my Adderall (which insurance doesn't cover btw and it costs me $120 a prescription) he told me he was taking it for analysis and i will be contacted by the PD as to when i can pick it up if it passes analysis.He also requested to go through my other medications - mostly steroids', allergy medication, and antibiotics. I refused his request in fear that he may try to take this medication which i need to survive. Do i have any legal ground here? Did he steal my prescription? This was in the parking lot of a CVS, i had the receipts and prescription packaging in hand and as far as I'm aware Adderall does not impair your ability to operate a car. Posted: So I was pulled over to my surprise at the bottom of a downhill portion of a mountain highway pass. I was driving in the slow lane behind a series of semi-trucks who were, at most, going about 60mph in a 65mph speed limit (the semi's were subject to a 55mph speed limit). I'm considered the "grandpa driver" by all my friends, I see speeding as pointless and an unnecessary risk, and generally stay in the slow lane under the speed limit, and at most I might speed to like 70mph in a 65mph speed limit, but that's a rare instance and only when I have to pass someone. I also drive an older pickup truck that I've never gotten above 80mph (once in an empty desert). Not sure it would be possible to get it to go faster than that to be honest. I knew I was going downhill and was watching my speed, mostly so that I didn't creep up too close to the semi in front of me. I stayed well under 65 for the most part, there was once where I reached 68 and then slowed down... The cop pulled me over and stated I was going 86mph. I was taught by my parents that the best option when pulled over is to apologize profusely and act dumb and I might get off with a warning. So that's what I did, though when I first heard him say I was going 86 I did ask him if he was sure it was me he caught on radar and made sure he understood I was behind semi-trucks in the slow lane. I then apologized and tried to act dumb (which I'm regretting now cause that's basically an admission of guilt right?). He said that it was definitely me he caught on radar, and proceeded to give me a ticket for 86mph in a 65 zone. There's zero chance I was going over 70mph at any point during that time. My speedometer is accurate, it always matches within 1-2mph of the speed limit reader signs that flash your speed. There also was like 10 cars in the fast lane speeding by at like 15mph faster than me when he pulled me over... there's just no way this ticket is justified. But I don't have any concrete evidence right? This happened in a county very far away from my residence (6 hour drive away). I don't have time or money to go to court there, I am starting a new job on Monday and would like to fight this, but am not comfortable taking the time off (losing too much money from missed work). What are my options? I read that I can send in a letter saying I plead not guilty and that may work? If it doesn't work though, what do I do if I can't make the court dates? [MASSACHUSETTS] Employer has failed to deliver a promised raise after 10 months Posted: Hello all, I work for a mid size heavy civil construction company in Massachusetts that has been around since ~ 1900. The company is owned by a multinational construction conglomerate based in Spain. The local company was bought out by the Spanish company in 2015 and since then there has been a decent bit of turmoil from the people who have been here a long time. Gripes include normal stuff you would expect, like learning new systems and new company policies, but also the general way that the corporate entity treats the smaller company. I started with the company in 2019 out of college (also co-op'd) here in 2018 for 9 months) and started out as a field engineer, working on a very high pace job that was 24/7, so I worked 7 days a week including one overnight every week at usually 12 hours a day. I was not paid overtime but this is common of salaried positions in construction. The job had a lot of complexities which required a lot of paperwork and back end engineering which I helped out with and was eventually brought back to the main office once construction had wrapped up to work on a $10m claim. Shortly after wrapping up my first project in early 2019, the pandemic hit, and a lot of people were either furloughed or laid off, which led to a lot of people leaving the company via different means. At the same time the company was preparing for a massive bid that would have been over double the value of the local companies largest contract to date. In early June of last year (mid pandemic, had been working from home on the claims for the original job for about 2 months), my senior manager (VP of operations) asked me to step into a new role which is basically the manager of my previous position. This is usually a move made by people after 5-10 years of experience in construction, I had only been out of college for a year, but I had what I thought was a very good relationship with both my senior manager, as well as the multiple managers in between him and myself. It came with a 20% pay raise, a company vehicle, and a gas card. I was also to report to a new jobsite ~45 minutes from home (this is not a big deal, common in construction). The new jobsite included working 1 weekend every month, which wasn't a huge deal after the first job. I got the company vehicle shortly after starting at the new position, but as of today, which was payday (we are paid twice a month, 15th and end), I have not received my raise. I have been promised a 20% raise, with backpay effective to june 2019, so the company owes me approximately $10,000 plus my new rate. I have multiple emails confirming this from my senior manager. He has told me that the hold up is with the corporate entity in spain, that they are concerned about promoting me so early. There are multiple issues with this, including that I have been doing the job for ~10 months, they won't hire someone else to do the job, and they've already made the promotion and promise. I believe that he is telling me the truth, or some slightly altered version of it, and I do not wish to burn the bridges I have here. The most recent communication I have from him was that he thought that they would have applied the raise and backpay today, which was not the case. He has told me this on a number of occasions, but this was the last straw for me. I have received a number of off the cuff suggestions, including quitting, telling them I am considering legal options, telling them I will no longer report to work until I am paid, and finding a new job. Some of these feel very nuclear to me. I do think that having another job offer in hand would help, but I think they may just let me walk and I will never see my $10k. I also think that getting a lawyer will cost more than I will get back but I'm not sure. I'm not sure how best to handle this. Any advice would be greatly appreciated. [Pennsylvania] Insurer and appraiser don't agree on flood zone. What are my options? Posted: I'm buying some property (FHA loan) that, based on the flood maps, looks like it's on the border of a FEMA designated special flood hazard area (SFHA). Homes in SFHAs require expensive flood insurance and the insurer says this home is in such a zone. The appraiser says the home is not in an SFHA so it does not require expensive insurance. Posted: We are under contract for a house that is in need of some renovation/fixing. We negotiated with the Sellers that they would replace the cabinets that were damaged in a small kitchen fire and paint the main floor, and that we would take the house as-is after that. Our due diligence deadline is Mon April 5 and they were supposed to have their work done this last weekend so we could have enough time to get an inspector in there to check everything. We just went through with our inspector who refused to complete the inspection because it is not ready to live in yet and he didn't want us to waste our money on his services until we got this figured out. The house is trashed. There is paint splatter on almost all of the windows, every single appliance, light covering, doorknob, thermostat, ceiling fan, and all over the linoleum in the kitchen and carpet. The tile in the entrance is literally caked in paint, and no protection was put down anywhere so there is paint trailed throughout the house and onto the back porch. Besides, this, they still haven't put up the cabinets they were supposed to last weekend. There are other issues but we'll end there, I'm sure the point has been made. The sellers have been very uncooperative up to this point, but this almost seems malicious. They've mentioned a few times how they received higher offers on the house but they chose ours because it was the least amount of repairs/renovations for them to do. What I suspect is they are purposefully forcing us to withdraw our offer so they can fix everything and accept a much higher offer. (All renovations/repairs are being done by the sellers 40 yr old son who is not professionally trained) The house was obviously not like this when we put our offer down nor when we walked through the few times afterwards, otherwise our offer would have been much much lower. Our due diligence deadline is on Monday and we can't afford for our earnest money to become non-refundable. Posted: 2 years ago, I bought a house from my in laws. The appraised value was 180k, which is what I paid. (She originally paid 100k for the house 17 years ago.) Realistically, she could have gotten 200k out of it on the market at the time, so we put down the 20k difference as a gift of equity. Really, we just spun it that way because it made for the image of a large down payment. Well, afterward, she came at us demanding that we pay her back the 20k. It seems messed up, but she is literally the greediest person iv ever met so I chalked it up to that.. we have made a bunch of $100 payments over the last couple years just to shut her up. Recently, she has found out that the market in our area has gone up quite a bit. A house a block away that is half the size of mine and in not as nice condition sold for 350k last month.. now that she knows I have a few hundred thousand in equity, she has been doubling down on demanding more money more often.. Turns out, she says she hasn't been keeping track of any of the payments and hasn't been keep a ledger.(this woman keeps a ledger of how much her kids owed her for dental visits.. but she didn't keep track of the largest sum of money she's owed?) I sort of knew/think that she's not allowed to demand a gift of equity back.. thats extortion? Tax fraud at best? I don't know. So, I'm having my wife try to get her to write out a ledger saying that we owe her the 20k and how much we have paid her.. What do I do after that? (Context about MIL. Shes not broke.. shes quite well off. She has more than 1M in investments and close to that in savings. I only know this cause she left mail out when we were visiting one day and I glanced at it. Posted: I really hope I can find some legal advice or any advice really pertaining to the scenario above. My local weed dispensary, which Ive been going for many years now, got raided a couple years back (2018) and filed a suit against local sheriff department for damages (2018). The reason I bring this news up is because I believe my local weed dispensary is doing this (one-time recording members smoking and saying a sentence claiming we use this establishment for healing) for the lawsuit being filed. The owner himself was sitting in the room professionally answering questions and etc, which seemed odd to me. He kept reassuring this is to keep the establishment and to keep is as a church more than a dispensary so I can see he wants to be protect under religious law. I just really really hope I don't get into any illegal issues and I have to respond to anything of the sort. I haven't received one thing from this clinic ever since Ive been a member and I really hope this video doesn't require me to do anything. Any advice please? Or am I just overreacting? (FL) Appeal Final Divorce Decree Posted: Final divorce decree entered November 2020 after trial. Spouse files appeal the following month. House was ordered to be sold in final order but ex-spouse refused. Motion to compel filed, hearing today and the judge basically told me tough luck because she filed appeal. No stay is in place. My lawyer objected to hearing the stay as it was not scheduled. Judge agreed to have a separate hearing for the stay at a later date. Final outcome was the divorce orders were flushed down the toilet as the court refuses to enforce orders pending appeal even though there is NOT a stay. I spent 20-30k taking this to trial as she would not agree to anything. Now the money is gone. House is in foreclosure because courts won't enforce the order to sell. Now I have to go on my own because she's drained me of all my money and I can't afford to represent myself in appeals. The judge today deferred attorney fees to the appeals court. I'm just so disgusted and don't know what to do. 2 years of court hearings gone and all it took was 500 dollars and a lawyer willing to file the appeal. What should a poor person do at this point? Represent themselves during the appeal? Today's hearing cost me a foreclosure while she camps in the house until the bank removes her. Really unbelievable this is our court system. My sons father said I can’t see my son because I am not a Jehovah Witness Posted: In 2019 my ex was given temporary custody of our 15 year old son by the State of Florida. My son was caught driving by local law enforcement while in the care of my husband (I know it was irresponsible of him and I am still mad about it to this day!). I reside in Alabama and my son's father is in Florida. During 2019-2020 I was going thru a rough patch, I lost my job, our home foreclosed, and my car broke down. I was not getting along with any of my family and wasn't able to get to the court hearing for dependency in Alabama. I spoke with my sons father and explained my situation, we agreed that our son should live in Florida for one year. It would give me enough time to get financially stable. In return I agreed to drop the child support and back child support (approximately $7,000) he owed me. In 2020 the State of Alabama dismissed the case they had against me for dependency, I also found employment, a new home, and bought a reliable car. After that year I told my ex I was in a much better financial situation, that DHR dismissed my case and our son can return home with me. My ex flat out refused. He told me because I am not a Jehovah witness that our son should not be with me until I become one. My ex will not let our son visit me or my family because of this and he also makes our son put all phone calls on speaker phone and if my ex hears something he does not like he will curse me out and hang up. The police have been out to my ex's home 9 times this past year for domestic violence calls. My son recently told me my ex has been physically and verbally abusing him. He will hit our son with a closed fist in the back of his head while having him kneel in the corner screaming at him. "I am you GOD". My ex has told myself and others that he is one of the 144,000 and is Gods chosen one; everything he does is by the instruction of God. He does have history of drug abuse. Also, Schizophrenia and bipolar disorder runs in his family. I recently found out he has been using crack cocaine and drinks about a case of beer per day. My question is, do I file an emergency modification order in Florida? I filed a report with child services in Florida about 8mo ago and nothing came of it. I also contacted them a few weeks ago and they advised they would need to investigate and hear all sides. What would be the fastest way to remove him from that situation?
