I would say maybe 15 minutes into the walk through the police entered the home with guns pulled on us, including my 8 year old son. We were handcuffed and taken to the front yard only to be told that someone called about a break in. All it took was the real estate lady to explain to them that we are just doing a walkthrough of the house. We were released and the cops went to another persons home so we assumed at the time that it was the resident across the street who called the cops. We are considering getting an attorney to subpoena the police reports on this address as proof that the neighbor made a false police call on us on and caused significant emotional trauma on us and our kid. They had a safe and I was not going to be home for 3 months. I expressed to them that they were to hold on to the ring and when I request for it back they were to return it. My husband was a part of this arrangement as well and everyone agreed. Fast forward to January 2021, I find out that my grandmother has placed the ring in her will to be given to my son. I requested the ring back, but she refuses. I, my mother and my husband have petitioned my grandfather to assist in returning my ring. He also refuses, tells me that I 'gave' my grandmother the ring. I recorded this conversation just in case things go south later down the road. (TX is a single party state, meaning only one person has to know they are being recorded in a conversation). This is where things get complicated...I had been making monthly payments for a personal loan that my grandparents had backed. (They had given my ex and myself $63k and the deal was $1000/month and pay it off in 63 months.) My remaining half of the loan is currently at $16,750, paying $500/month and the loan was current as of January 2021. February 2021, Grandfather calls me to ask where his $500 payment was? I kindly told him that I was no longer going to be paying him since he and my grandmother have effectively stolen my ring. He says, 'That is between you and her. This loan is between you and I.' However, the loan document that I signed says that in the event that they die, I am to continue paying the estate. I repeated that since my ring wasn't given back to me and I had not given them permission to do whatever they wanted with the ring, they had stolen it from me I wasn't going to pay. He quickly tells me that he will see me in court. I said, 'okay' and he hangs up the phone on me. (I recorded this conversation as well). The ring was last appraised in 2016 for $24,087 and the remaining balance of loan is $16750, leaving them owing me a balance of $7337. I sent them an email expressing my claim along with a certified letter. 1. Can I go after them criminally here in the state of TX? 2. The cap is $20k for small claims court, can I sue them or do a counterclaim of $24,087 with the idea that $16,750 would be paid out for the current balance and still receive the $7337? 3. Outside of what I have already done, what other recourse do I have? After all this, I will no longer be having contact with my grandparents. Posted: 11 Feb 2021 06:05 AM PST Yesterday, when I went to the clinic to get my dose, I was told there was a hold on my account and needed to see my counselor. Apparently, my DT from last week came back positive for opiate & fentanyl. This is 100% impossible and my counselor said there's a new lab tech, and that it's possible they switched my label with someone elses. He also said this wouldn't be the first time Its happened. He even had a patient in mind that it could have been switched with, because we tested around the same time and their screen came back negative while he was expecting it to be positive. He told me I can pay $40 to have the sample investigated further, to see exactly what percent and substance was in the urine; but I informed him I didn't want to pay that for someone else's results. If I were to do that, I would have a new test done and also pay to have that sample reviewed, to cross reference both results. I also asked if he could cross reference the results of everyone who took a test the same time as me, and he told me he would do that, as well as speak to his supervisor about how to go about fixing this. He does believe the results were wrong, and seems to be working on my side, but he's also being slightly nonchalant about it. Where as I'm freaking out, this is a huge mistake for someone to make, and I do not want my record to reflect someone else's results. After meeting with my counselor yesterday he put me down for another drug test that day, which I went to do but was informed the lady left early, I then told my counselor this and he said I could take it this morning. But I received an email from him earlier, starting supervisors would not be in today due to bad weather, and they are only doing dosing today, meaning I can't do the drug test today either. I'm not sure how to go about this situation, I feel my hands are tied but I'm extremely upset and feel they should be taking this a bit more seriously than they are. Any advice would be much appreciated and I'll answer any questions about what I may have left out. Also, my counselor does believe these aren't my results, because I even quit smoking marijuana almost 2 weeks ago and have had no illicit substances(aside from thc) in any previous drug screens. I've kept my counselors informed about what's going on with me and work with them, I'm very dedicated to my sobriety. I asked him if the positive screen had thc in it as well, thinking that would be a dead giveaway if it didn't, but unfortunately it did. Students received a directive that only one package is allowed to be delivered on-campus a week, the reasoning being that the mail-office will be too crowded in relation to Covid. Naturally, this is hard for students since, 1) Students can't control if a shipper breaks up one order into multiple packages, 2) Some students have multiple necessary items they need shipped in one week (such as pet food and a textbook), 3) Since it is still the beginning of the semester students need multiple textbooks and other school supplies that are delivered via mail 4) It is a pandemic so naturally people are ordering more than usual 5) The school has directed all students to self-sequester on campus so nobody can leave campus to buy things/pick up mail from post office or other location. If students break this order they receive an email that states: "Dear student: We are writing because you have not been following the campus COVID guidelines limiting you to one package delivered to campus per week. Please immediately reduce your package delivery to one per week. Your continued non-compliance with this guideline will result in suspension of your ability to receive packages shipped to campus. Any mail or packages addressed to you will be returned to sender. Thank you, Residential Service Desk Staff" I am just wondering how this is possibly legal, (if it is at all)? I know mail laws are pretty strict and I just don't understand how somebody can return a package (that is delivered) to sender. Especially when there are other solutions UMass could use such as designating a specific day for students to receive all the packages they ordered. It was overwhelming helpful in a uncertain time. I'm sorry if I didn't respond to everyone's messages as it was a bit overwhelming and I had alot to figure out After my post I made an appointment to speak with the director and my boss about my options. From what I gathered they assumed because it was a requirement for the role I understood what I was walking into and willing to pick up the language at my skill set. They assumed I was vetted by HR and HR assumed since they wanted to hire me and my skill set must of been okay. They did not provide a spanish test as normal procedure for the interview. It was a huge miscommunication. Upon replaying my conversation in my head of the interview I remember they did ask about my Spanish skills and I was honest in that I understood a little for retail purposes ( my last job) but no where near fluent. In the end they were honest and could offer no recourse or help to assist me in learning Spanish. I posed every possibility, from a $10 a month language subscription service to a $30 tutor. They advised they would give me my probation and "see how it goes". I delved into learning Spanish for about a week before I stopped. The honest answer is I just didn't want my job to take over my life. The last job I left was salary and it felt like no matter what I was always working. At the end I was miserable and burnt out. That's after coming from 10 yrs of retail where I missed most holidays, family functions, and never had weekends off. I just feel like I'm missing out on life. I've learned what's important to me in order to live a healthy life and said I would never put myself in that position again. I understand it may only be a couple of hours on top of work but I want defined boundaries as to when it's time to work and when leisure time is. I realize this will make salary positions obsolete for me and may seem whiny to some, but ultimately it's what I need to be happy. Good news is I landed a teaching job in which I am simply waiting for my confirmation to start. So things ended as well as they could. I have yet to work directly with a spanish speaking client as I have been mostly training and shadowing. Posted: 11 Feb 2021 10:32 AM PST My mother in law has been receiving a non-standard chemotherapy regimen for 18 years since she was diagnosed with stage 4 metastatic breast cancer. Her cancer has been kept in remission for all these years. Her primary oncologist who designed this treatment retired and referred her to a colleague last year. Since changing doctors, her side effects have worsened and she has new adverse effects such as extreme weight loss, constant nausea and daily vomiting, and what appears to be early signs of liver failure. It turns out that my MIL noticed that her chemotherapy drug (that she has been on for 18 years) was changed without her knowledge. When she asked the nurse about this, she was told it was just a generic form. After further questioning, it was revealed that it was an entirely new drug. The new symptoms coincided with the change in this medication. After some concern was raised, the physician basically told my MIL to take a hike and find a new oncologist. I worry that it could be some form of elder abuse because I do not believe her concerns were fairly addressed and taken seriously. Is the changing of a chemo medication without explanation or a new consent legal? For any physicians who may be reading, her original drug was Trastuzumab-dkst and she was changed to Kadcyla and Trastuzumab combined. [MO] Bought a house, we listed the oven as not working, seller said it was functional Posted: 11 Feb 2021 09:14 AM PST We bought a house in December, during the inspection we noticed the gas oven wasn't staying lit, and would immediately shut off. We wrote that down in the inspection, but the seller said it was functional and to read the manual. We closed on the house and noticed the oven still wasn't staying lit, same issue as during the inspection. Since then we've had 3 people look at our oven, a gas line tech from our gas company, and two repairmen. They all came to the conclusion that it was broken/not fully functional. The two repairmen both said the knob controlling the oven on the front of the range was the issue. It was loose and hard to turn, and the stem was cracked length wise and being held together by a hose clamp. The repairman told us the knob isn't available anymore, and no longer in production, and we would have to replace the entire range/oven. We got a $2,900 replacement credit from our home warranty, but a like model replacement range/oven costs ~6k. So we contacted our real estate agent to ask her if we could get the difference in cost from the sellers, since this was an issue we listed in our inspection, and the seller said was fixed. We were told to write a letter to the sellers with the above information and to ask for the cost difference for a like model replacement. We also stated we would go to small claims court if they refused. The sellers responded saying the manual was left for us to read about how to light the oven correctly, and was fully functional when they sold the house. Although I'll never use it, the fee is mandatory. However, the tennis court is in disrepair. The net is sagged to the ground, large cracks in the court with weeds growing out of them, and there's even a wheelbarrow inside the court. Which looks like it's being stored there. 300 per house, 484 houses is $145,200. Divide that in half for just the tennis court and you get $72,600. I can't fathom what that money is doing because it's not maintaining the tennis court. In 2020, when the lockdowns started around march, she emailed us saying that all events are canceled for the rest of the year. We rescheduled for april 2021, because we all thought it would be over by then right?, and we didn't hear from her since. we decided to contact her about it. she told us she doesn't want to give back the deposit and we can pick a new date. looking at our contact, the gist of it says is that if we cancel for any reason, she keeps the money. but thats not really the case here, imo, since she can't keep our date or reasonably assure any date in the future, and is instead blaming it on the state of california not allowing her to hold events. in other words, it feels like shes canceling on us. if i took her to court, do i have a case? When she did, she left her home (worth roughly 500k) and belongings to be split among my mother, and my aunt. Anyway, when this happened, my aunt, who was the executor of the will, moved into the house and basically locked my mom out. My mother has never been well off, and in general can't do anything herself, and never fought it. She eventually got sick and I had to have her move in with me when I was 20, and have been taking care of her for like 10 years. Taking care of her has taken a serious toll on me over the years and has stolen much of my 20s away from me. So I need to know what is it that I can do to force my aunts hand into selling the house and splitting up some of the money so I can put my mother in some sort of assisted living facility? I haven't spoken to my aunt in like 10 years. One time I did go over there and try and talk to her about all of this, but she basically dismissed what I had to say and we haven't spoken since. I opened a Chase bank account a couple of weeks ago, and up to now, it was only used to receive collect my January salary and to withdraw 20$ in an ATM (to activate the card, which I haven't used anywhere else). I did not give the account details to literally anyone or used it in any other way. This week, I received a deposit of 75 USD from Dave Inc. Googling around I see that it seems to be some sort of loan shark company, to let you out of overdraft fees. Is this correct? Why would I get a deposit in my account if I literally had never heard of this app until now, and I have no interest in getting loans from anyone. Posted: 11 Feb 2021 09:27 AM PST I'm going to try to make this as short as I can but there are months of issues I must explain to get to the current issues so I'm sorry if it's a bit long. I added a TL;DR but if you need more details, please read the full text. My roommate and I move into our first apartment in September 2020. (We live in Pennsylvania.) Our actual landlord/property owner is a guy whom we've never met, have none of his contact info, or even his last name. Who we did meet and deal with is a real estate broker/property manager. He assured us that we'd never need the landlord's info, that everything could be handled through him. My roommate and I thought this to definitely be shady but we really needed the apartment and so we signed the lease and moved in. For the sake of later events, this is an important detail to know from the beginning- The apartment building is a duplex with a front and back apartment. We are the front apartment and have a cellar door attached to our side on outside that leads to a small basement just under our side of the house. We were told by the property manager that we "don't have access to the basement" and "wouldn't ever need to go down there." But NOTHING on the lease states this, (we both saved copies of it.) Fast forward to the colder months of November and December. We notice a considerable temperature difference between the downstairs and upstairs of the apartment. It was always freezing downstairs no matter what we tried. We would turn the heat up and it would make the upstairs extremely hot and the downstairs felt like there was no difference. (Checked for damper switch but there was none and heat does come out of all vents) So, we got draft blockers for the doors, we put plastic over the windows, hung a curtain over the stairs to try to trap heat down there, and got a small space heater. Nothing really worked and we didn't want to reach out to the property manager because we quickly realized he was really shitty to deal with. We had issues with our trash being removed for the first month of us living there (the only utility he pays) and several other small issues that he would be so vague about or give us no update on fixing. So, we just gave up and decided to wear socks, sweaters and blankets downstairs when we were down there. But then on Dec. 27th our water goes out and we assume a pipe froze because of how cold it always is. We call the property manager and he wasn't able to get someone out immediately, so we had to wait until the next day. We were basically kept in the dark about what was going on, like when someone would be coming, what the issue was, if it was fixed yet, etc. Sometime, on the 28th my roommate noticed the water was back on but very low pressure. She relayed this to the property manager who said someone would be there soon. Later he let us know that the repair guy had come and decided we needed a "supplemental heat source" down there, and also that there was a leak and it was repaired. We both did not like the idea of this "supplemental heat source" because we had no info on whether or not it was gas or electric or if we were paying for it. Remember, we were told we "don't have access" to the basement, so now we're paying for it yet aren't able to control it. That just seemed wrong to me but we let it go because we were sick of not getting much help out of this property manager. Then we got our water bill for that time period and it was nearly triple compared to what we'd been paying normally. I was so fed up with everything at this point that I conviced my friend to go into the basement with me and see what the hell was going on down there because again, there is absolutely nothing in the lease about not having access to the basement. I discovered several things, including the fact that there is no insulation between our flooring and the basement, no second door between the cellar door and the basement so cold wind can just go straight under there, and that the heater they installed was gas among some other shady looking shit like a hole in the wall that they had to carve out to get to the kitchen sink pipes and a giant hole in another wall to run a pipe over to our neighbors side of the apartment. Considering all the frustration we'd already been through already with this place and what a mess I saw in the basement, I wasn't about to let us pay an outrageous bill just because we don't like dealing with the property manager. We reached out to him and he and our actual landlord agreed to do a rent credit that we felt was definitely a fair amount. We thought everything nwas finally done with. Our water was out again shortly after that and the we finally got to meet same repair man that fixed it the last two times. We find out he's a friend of the landlord and does not like dealing with the property manager either. He says it is just difficult to get quick responses and details out of him so he gave us his number to call directly for further issues. He also tells us that he definitely thinks things aren't up to code around the apartment, and not just the plumbing. We also learned he has been coming to our place (without us knowing) and turning the gas heater in the basement off and on for us when they (the landlord, the repair man, or the property manager; not exactly sure who) deem it necessary. Finally, we get to now. We get our gas bill for the month and it's nearly $200 when we normally pay around $60-70. We never keep the heat above 65°F and normally have it set at 62°F (because we're broke college kids, don't judge). So we know it has to be this stupid gas heater downstairs. We can tell when it's on because the downstairs is a normal temperature and the hardwood floor in the kitchen becomes warm. So, we know it's been running for awhile, but we also know it probably has to be on because winter is being a little brutal in our side of PA right now. Here's my question. Is it legal that our landlord or property manager is controlling this heater that we are paying for? What can we do about this situation? We can barely afford to pay this gas bill and my roommate and I are just so exhausted and frustrated dealing with issues constantly. We were looking into getting someone to come out and inspect the basement to see if it's even legal/ up to code down there or to get a free consultation with this local apartment lawyer guy. We're just afraid we'll end up out on the street somehow and we do not want that right now. Should I text the property manager and see if there's anything he and our landlord will do about it first? He had been calling regularly and gave his doctors permission to discuss his treatment because he says he's really trying to get better this time and wants to prove it to me so we can work on our relationship. Last night around midnight I suddenly got a text message from him saying "I left the hospital. I'm sorry but I don't want to be with you anymore. I just want to do drugs and to be honest we were never meant to be anyways. I'm selling my phone, the guy who I'm giving it to is actually a really great guy, you should talk to him instead. He is sober." My heart immediately sunk and I tried texting back and calling to no answer. So many red flags went off that this was not my ex texting me but he had sold his phone before so I was incredibly distraught and wanted to figure out what was going on. I got a text back... from the guy who he supposedly sold the phone to. He said he wanted to make sure I was OK. I spoke with him briefly but had to hang up as he described how my ex apparently got picked up by some woman and got in the car and left with her. I was in tears. He texted back trying to comfort me and told me that my ex showed him a picture of me and told me I was beautiful and my ex was a loser I could do better etc. I kept feeling like none of it made sense so I ended the conversation and went to bed completely heartbroken. I called out of work because I could not bring myself to get out of bed. At 11am I received a call from the hospital. His nurse told me he had been discharged about 5 minutes ago, and that he had asked her to call me because his phone was missing from his belongings they had put locked away for him and he would be unable to contact me. My jaw dropped and I asked her if she was certain. I explained what had happened the night before. I was both relieved and disturbed. Then his phone texted me again. Asked how I was doing. I couldn't control my temper and I went off on whoever it was telling them that I knew they were full of shit from the start but I believed them because they had his phone. That I was going to figure it out and have their job. They didn't reply. The phone is still on and still rings. Obviously it was a male member of the medical staff who handled my ex's belongings but I have no idea who. I don't know how much information they know about me. The part that freaks me out the most is that my ex didn't have a fancy phone worth stealing. My ex is an addict. He had a cheap prepaid phone with a shattered screen and probably wouldn't bring more than $1 at one of those phone selling kiosks, $0 on the street. The only reason I can hypothesize is that ex was talking about me while getting checked in or possibly showed someone my picture before they took his phone, and whoever this man was took it explicitly to contact me. I tried to contact a medical malpractice lawyer who deals with that hospital, but honestly I have no idea how much of what they did besides stealing a worthless phone is illegal. I am not mentally stable myself and am fighting my own addiction problems. Their actions had me on the verge of a mental breakdown and thinking of self harm. Luckily the man typed differently than my ex does and I was skeptical, but him having the phone in his possession gave me conflicted thoughts. What, if anything, can be done here? I quit my toxic job and now I owe them my coworker’s salary plus much more Posted: 10 Feb 2021 05:59 PM PST Hi everyone! I will not state my profession as I'm afraid the company may be able to identity me. I'm also afraid of my coworkers getting in trouble. I will also try and change the specific dates and some details to protect my identity. For reference, I'm a white male in the US. I was employed by Company A in June 2019, but did not sign a contract with them until August 2019. Before I signed the contract I was working and training without pay. Besides training I also did work for them. After my training period I signed a 3 year contract. This contract states that I owe the company all of my educational expenses, hotel stays, and all other kinds of costs and expenses in full if I quit or get fired before the 3 years ends. Before I signed the contract my boss stated to me that I would not have to pay back all of the expenses as it would be prorated based on the time worked at Company A. However, this was not stated in the contract and was just a verbal conversation. This conversation was between me, my boss, and my coworker. I reluctantly signed and my coworker signed as a witness. Time goes by and I didn't put much thought into the contract. I was just happy to have a job when a lot of people were losing their jobs. However, a few months in I started to doubt my decision and whether I could continue working there. I would like to mention all the things that have happened and have been said, but I am afraid of getting caught and also getting in trouble myself. I decided to buy a tape recorder and recorded a few hours worth of conversations. These conversations include racial slurs, discriminatory comments, threats to my job and my coworkers jobs, and more. One of the biggest red flags for me was when I was threatened to be fired for my political opinions. I did not give my political opinion, I was just asked a question and my boss didn't like the answer. After that he said someone had to go. He didn't act on it, but it scared me enough to apply for other jobs. I kept on working here because I needed the money and experience to continue to work in this field. I took verbal abuse, threats of being fired, no days off, being available 24/7 for weeks at a time, and often also worked over 24 hours a day. I also had days with no breaks or lunch breaks. I also performed duties outside of my field and what is stated in my contract. I have text messages to prove the length of my days and some of the things that were said to me and my coworkers. I quit back in December, one and a half years into the contract and gave them a month's notice and mentioned I would help as much as possible. After I quit they mentioned I would be a contractor instead of an employee, which means I would no longer be salaried. I didn't get anything in writing and actually did perform about a week's worth of work. I have not been paid yet and don't know if I will be. I received a bill for what I owed and it's the full amount that is not prorated. In this bill they have also included some of my coworkers salaries for the help they provided to me during the first few months I was there. I just wanted to pay Company A what I owed them without any problems, but I feel I am being taken advantaged of. I was not expecting the amount laid out, I was expecting to pay half of what is stated. I've been saving to pay them and never have to talk to them again, but now I don't know what to do. I could pay them what they've stated, ask for a reduction, or some kind of resolution. However, I know how these people are and I really don't see that happening. They have been contacting me to meet and review the bill, but I don't know if this is the best move. Company A is known for treating their employees this way. They are also known for talking all of their previous employees to court. Company A has consumed me and my life for the past year and a half. It has had a negative impact on my health and the relationships with my family and friends and I just want to close this chapter. However, I don't want to be made a fool of and will fight if I have to. No one should go through what I've gone through and I want to make sure this changes. [link] [comments] |
Indiana emancipation and abandonment Posted: 11 Feb 2021 10:17 AM PST My 16 year old cousins dad dropped her off for what was supposed to be the weeke d but did not come back for her for the last 6 months. We got her, her first job, her permit, her first vehicle and she is doing great in school now as flunking everything when she was with him. Now he is trying to make her move back in with him into an RV and leave the state. Is there anything we can do to help her become emancipated or get custody of her since he abandoned her? Custodian of UTMA account refuses to remove name/transfer Posted: 11 Feb 2021 11:26 AM PST My father set up a UTMA in my name with Fidelity many years ago (PA) . Its purpose was to help pay for college. We are currently no contact for the past 7 years. I spoke to fidelity about accessing the account and they say even though I'm over the age of maturity(21, I'm 30) they need the custodian to sign off on a transfer or name removal over the phone. My father refuses to do this and I have had several family members mediate and try to get him to transfer the account to an individual account in my name and my name only. What are my next steps? What type of lawyer should I be talking to? I have heard that since I am past the age of maturity I may be able to contact fidelity directly and TELL THEM to remove my father. Valet took a joyride for 2 plus hours then totaled my vehicle, attorneys don’t want to take case Posted: 10 Feb 2021 01:32 PM PST Ok, Long story short. Was in hotel at 7 pm. Got call at 11:20 from roadside assist that i needed to check on my vehicle. Ran down to lobby and out the door, vehicle was gone and no one there. Ran out to look in the road and vehicle was crashed about a block away. Vehicle is a total loss, valet was driving 70+mph and crashed into concrete barrier. Contacted attorneys and no one would like to take case for a suit due to it being property. I feel there was a ton of neglect and misrepresentation of the services at the hotel and getting another car would be very difficult (was a Tesla model 3 performance) would take another 6-8 weeks to get and financial situation has changed to where financing would not deliver same interest rate. Posted: 11 Feb 2021 12:42 PM PST Hello! I currently live in an apartment complex in South Carolina (I am a renter). Recently, I received a fine from our HOA for $10.00 for having "trash outside the front door" that was dated from the beginning of January. The due date on this was 15 days after the incident, which has already well passed before they even put the letter in the mail. I do not remember leaving any trash outside during this time so I emailed the HOA and asked to see a photo or some kind of documentation of this incident. They emailed me back saying they do not have a photo, however, they were going to change citation to a warning so I did not have to pay any money. However, I have some questions about this in case it ever happens again. In his email to me, the property manager said " According to the HOA Rules and Regulations, they are not required to have photographic evidence of the violation." I read through these rules myself and it does not explicitly say that they aren't required to have a photo, however, it doesn't say that they are either. In the future, can they enforce a fine on us with no kind of evidence or backup to substantiate the claim? This time is was only $10 but there is a whole list of things to be fined for, some of them in the $100's. [link] [comments] |
State of Alabama is trying to get my dad to pay money back he never got Posted: 11 Feb 2021 12:14 PM PST So, during Corona, my dad was able to file unemployment temporarily. The state payed him once, and it was 500 dollars. That was the only payment he ever received and his bank account that he used reflects that. Now, the state is sending him letters stating they overpaid him 3,000 dollars. And since it's the state and my dad doesn't like he, he went ahead and wrote them a check for 3,000 dollars and sent it. The check copy is in his check book and everything. Today he just got ANOTHER letter stating he owes them 1,5xx dollars left, which is an extra 1,000 that came out of nowhere. Nobody knows where the state is getting this money from, and we cannot get in contact with the state at all. We have literal proof about how they're wrong, but they keep insisting. Can we potentially sue the state? What should we do here? In these times we cannot keep just giving the state money that they say we owe even though we don't owe it at all. [link] [comments] |
Buying a home with a lis pendens / public nuisance? Posted: 11 Feb 2021 12:14 PM PST I submitted an offer on a home that returned an active lis pendens, stating the home is a "public nuisance". The sellers agent and title company have contacted me saying I need to contact the city attorney and provide all of my personal info (as the buyer) to have a criminal background check ran on me so that they can remove the lis pendens and sell me the property. My title company and my buyers agents tell me both in their entire careers respectively, they have NEVER heard of such a thing. FedEx damaged my expensive rare guitar Posted: 10 Feb 2021 11:29 PM PST Long story short: My rare lefty Gibson SG had to be sent to from Los Angeles to the Gibson factory in Nashville to evaluate an issue with the finish. Guitar was professionally packed by a guitar store and shipped by FedEx with $3000 of insurance. This store was kind enough to write me a letter to ensure that the guitar was intact and to describe how it was packed. This was sent Dec 18, 2018....just before the Christmas rush. And it arrived in Nashville with a completely severed headstock (solid mahogany) and smashed volume/tone knobs. FedEx has denied my claim 4 times solely based on photos of the outer cardboard box that did not have any obvious damage. Gibson quoted me $3k to repair the guitar. It will essentially be rebuilt. This has been going on for 2 years and FedEx is a black hole. Can I take them to small claims court for this?!?! Thank you! [link] [comments] |
