Legal Advice I'm being stalked and harassed by a cop

Legal Advice I'm being stalked and harassed by a cop

I'm being stalked and harassed by a cop

    Posted: 01 Jan 2021 10:34 PM PST

I first encountered this police officer during a dispute with my landlord. At the time the officer arrested me for felony criminal threats, the officer lied on the police report. At the first preliminary hearing my lawyer asked for bodycam footage, and other evidence listed on the police report. Because the evidence was fabricated, the DA dropped the charges "dismissed due to lack of evidence." I reported this incident to the chief of police, he sent out the same cop, and two others, to come talk to me. At that meeting he said "I don't care the court dismissed the charges, we believe you're guilty and a criminal."

About 2 years later, I had a customer at my business who came in with a crashed car, he was very clearly inebriated, and he was asking me to cover up the damages. I had to call the cops, once again the same officer showed up, instead of focusing on the drunk driver who had run from the scene of an accident, the officer only cared about the fact that my business was assisting him cover up the accident. We didn't even touch the car, we only called the cops. After handcuffing and detaining me for 2 hours, they figured out I didn't do anything wrong and let me go.

6 months after that, I had a trespasser on my property who assaulted me after being asked to leave multiple times. This forced me to draw my firearm in self defense. After the trespasser left, he called 911; he lied that I had kidnapped him, and told him I'm going to shoot him in the head.

The cops came with a SWAT team and arrested me for various felonies and misdemeanors. The same officer responded. After handcuffing me, and putting me in the back of a squad car, he started asking me irrelevant stupid questions, like "who owns the business," I told him I do. Even though he knows that I own the business from our previous interactions, and past police reports state I own the business. He then asked me if I work at the business, after I told him I own it. He told me California isn't an open carry state, only to then figure out I was on MY private property, inside MY building, in a restricted area, with signs posted. Then he sat in the car googling large capacity magazines, which are illegal in California unless you purchased them legally. Then he started googling "can I kill someone if they don't leave California castle doctrine." All while I'm handcuffed in the back of the car.

2 hours later, he figured out that I was carrying legally, my magazine is legal, and I am indeed the business owner.

But they still arrested me for other felonies and misdemeanors. During this period this cop ridiculed me a lot. He also said he doesn't know what penal codes he's arresting me for. He also said he doesn't care the charges are illegitimate and they won't hold, he said it's not his job.

I had video and audio surveillance of the entire incident, he didn't want to see it.

This cop didn't log all my property into jail, forced me to call him after being bailed out, to get my car keys, which he just had in his pocket. He then served me with a GUN EPO - GVPO, he lied excessively on the GVPO. I had solid proof that everything on the GVPO was demonstrably wrong. I never got to present it because a hearing was never scheduled and the GVPO expired.

When he served me with a GVPO I proved to him that i didn't own all the firearms he was saying. One of the firearms had been returned to the manufacturer and destroyed. He said he doesn't care, and he'll just tell the court I have it regardless. I turned in all my firearms in compliance with the GVPO, but because I didn't turn in that nonexistent firearm, he called my local PD and told them to raid my house. My local PD got a search warrant based on his lies, and raided my house, they couldn't find the gun, because it didn't exist.

2 weeks later, I got a call from the DA that they aren't pressing any charges from the arrest. I also got a letter from the arresting agency, that my arrest was "not an arrest, a detention only."

Last week I saw a car following me, it had fully tinted windows, but I was able to see that driver from the windshield, it was the same cop.

Yesterday the CA DOJ sent me a letter that my firearm privileges have been restored (LEGR).

Today I was in a 7/11 (in a different city) and lo and behold, it's the same cop (out of uniform), I left immediately. He followed me around for a bit. I was heading to work today, as soon as I entered the city that cop works for, two cop cars started following me.

I am genuinely afraid this cop will fabricate evidence again for something. I'm also scared this cop will kill me.

The police department is refusing to address my complaints, they won't take me calls, they won't respond to my voicemails, they wont return my emails. His behavior is not only ignored by the department, but instead sanctioned.

Can I get a restraining order? Can I report the department or the cop to the FBI? What are my options?

Landlord Changed Locks And Won't Give Me A Key

    Posted: 02 Jan 2021 05:54 AM PST

I live in ND. Recently I had a concerned family member call in a welfare check after which the police kicked in my door and took me away for a 72 hour psychiatric hold. Meanwhile, the landlord changed the deadbolt and will not give me a key, and insists that I have to wait an undetermined amount of days for new(different) lock to come in and be installed before I can get a new set of keys. This leaves my residence unsecured while I am away.. Do I have any legal recourse? Is the property management company liable for stolen items? My doorknob doesn't even have a latch anymore, so anyone walking by can just push it open.

    Breaking a Newly Signed Lease

    Posted: 02 Jan 2021 07:29 AM PST

I signed a lease on December 29th. On December 31st, my family officially began moving in. It stormed pretty badly that day and the ENTIRE apartment flooded. Our bedroom, the kitchen, and the living room. Maintenance came twice and said that they have this issue a lot and haven't fixed it. They contacted the property manager who said she'd get someone to clean the carpet. That isn't acceptable to us because that's not even the issue. After the maintenance guy vacuumed up the water, it began seeping back up through the floorboards. The next day, our new neighbor informed us that it floods super bad and that her apartment is always full of water. Do I have recourse to break the lease? We informed them before moving in that we were moving from a place because of black mold and they said nothing (of course they wouldn't) about this.

    ETA: I'm in Louisiana.

My neighbors are destroying the backyard, their dog has bitten members of my family repeatedly, and they now have a pig in town.

    Posted: 01 Jan 2021 02:13 PM PST

This is in WV. We live in town. The neighbors let their kids dig up their yards with shovels. I don't have footage of them doing it but they have about a 12 by 6 foot hole in the middle of the property they rent. The have now dug up most of the fence line and we can no long let our dogs outside. Even if we could they now have a huge pig outside. They also start giant fires 5 feet from the house and throw gasoline on it which has melted the siding of their garage. I have video of that event and a lot of video of their animals on my property harassing my dogs. They really are unbelievably horrible and are now damaging the property we worked 5 years to save and purchase. I own my home and they rent. I've made their landlord aware of what's happening to my property and theirs (their rental property has a ridiculous amount of damage caused by these people) and the only response I get is the pig will be gone ASAP but it's been two weeks. What can I do? We paid a lot of money for our home and got out of a very bad neighborhood only to be terrorized by these people. I'm on disability and have limited income and can't travel much. My SO isn't rich by any means and she's terrified as their dog has bitten her twice while she was walking to her car. It drew blood on both occasions but is a small dog so we didn't make a report. I regret that now. Please help.

Employer threatening me about not giving two weeks notice. But per my contract it says this...am I obligated?

    Posted: 02 Jan 2021 08:49 AM PST

Hello in my contract is says this...

"The Company is excited about you joining and we look forward to a beneficial and productive relationship. Nevertheless, you should be aware that your employment with the Company is for no specific period and constitutes at-will employment. As a result, you are free to resign at any time, for any reason or for no reason. Similarly, the Company is free to conclude its employment relationship with you with or without cause with at least two weeks notice. We request that in the event of a resignation, you give the Company at least two week notice."

Am I legally obligated to give two weeks notice? From what I can see I can leave at any time and it is a "request" I give two weeks notice.

Husband has watched CP. I am going to report him, but first, I have questions.

    Posted: 02 Jan 2021 08:57 AM PST

In case it is relevant, I live in Arkansas.

My husband has been watching child pornography. He knows I know. He has deleted every trace of it on his phone once I discovered it. I have photos of his web browser history, which I took from my phone. My questions are this:

    1. Will he be detained or arrested if they find no evidence on his phone? Will my photos be enough evidence for him to be arrested?

    2. Will my child be taken from me? Our son is four. My child has no been involved in this in any way, I guarantee this. I have been to afraid to speak to anyone about this because I'm afraid my son will be taken from me. But I am reporting this now, because I can't guarantee he will always be safe. Still, I am scared shitless.

    3. What will the process look like once I have reported him? Will he just be put into a database without being detained due to lack of evidence? Will they come to my home and arrest him in front of my baby? I have to maneuver this cautiously, because I have to be sure my son comes out of this with as minimal trauma as possible.

Thank you in advance. I am experiencing severe trauma. I can't eat or sleep. This has been eating me alive since I discovered it. The more time that passes, the more afraid I feel. I just can't stand the thought of losing my baby because of this.

Child Porn Account on Reddit found on accident and reported, could I be charged or get in trouble?

    Posted: 01 Jan 2021 10:40 PM PST

As per title states. I was just browsing some NSFW subreddits. There was an account that was saying some weird things, so i clicked into it out of curiosity. There is no way the photos that were in that account were legal, and i reported as many posts as i can. Having blocked the user, i'm fucking disgusted. But is there any way i could get in trouble?

Is there anything I can do about ex using the legal system to harass me?

    Posted: 02 Jan 2021 06:50 AM PST

The ex and I divorced 12 years ago, in that time he has filed more than ten lawsuits against me. His two siblings have both sued me (and lost), he sued my sister, has made calls to CPS and my employer (had me served at work), and tried to have my husband's drivers license revoked. The youngest of our children will be a legal adult in less than six months and he just filed a complaint to modify custody and child support. I would like to know if there is any legal remedy for the stress and financial burden he's caused with this constant harassment through the court system.

Edited to add: I'm in Nebraska.

Someone in America is trying to sue me in American small claims court (CANADA)

    Posted: 02 Jan 2021 10:56 AM PST

I live in Ontario and someone in America is trying to sue me in a small claims court in America. I have been served and honestly this makes no sense.

I bought something from this guy for $2000 on paypal. I never got it so opened a dispute via paypal. Paypal sided with me. He is suing me for $5000. $2000 for the item I never got + $3000 for lost wages cause he couldn't use paypal.

I don't want to have to hire a lawyer or go to America during a pandemic to fight this when paypal already sided with me. Can I just ignore this until he sues me in Canadian small claims court?

    Custody/Kidnapping PLEASE HELP

    Posted: 02 Jan 2021 09:41 AM PST

Hello and Happy new year to all. This is my first time posting in this group but I could really use some support and advice. Long story short I live in NY and my fiancée shares 50/50 custody of his son with BM with her home being his custodial residence. It is ordered by the judge that My fiancée is to pick up his son from her on Sunday morning at 9 am and for her to pick him up from us on Tuesday 9 am and that neither of the two are allowed to leave NY State without the permission of the other parent. They have had this agreement through the court for close to two years now and usually there is not many issues between them and they sometimes are even flexible with each other with extending days and weekends.

Yesterday, out of nowhere son's mother texts Fiancée that she will be taking the child on a three week road trip to Michigan with Step son to visit her BF's family there. My fiancée was absolutely not okay with this and made it clear through text that he is not giving his permission. Not only is three weeks way too long to be going away by we are in the middle of a pandemic so this is a very reckless thing she has decided to do. BM said she was set on going so fiancée showed up to her house last night at 9 pm to tell her that he doesn't mind watching His son while she is away for three weeks but he is not giving permission for her to take him. She basically told him That she is taking him because She is his mother and closed the door in his face. They supposedly left for the trip early in the morning around 1 am and fiancée has not heard from her or SS since last night. We have no address of where he will be, with whom he will be staying, or even if/when they will be returning.

We are beside our selves with worry and do not know what to do. We spoke to the police department of the town she lived in and basically they really didn't want to bother with this since a court order is a "non binding agreement." They told us that if we show up on Sunday to pick him up from her house and she is not there that we can call an officer and make a report but even then it would be "tough." So please if anyone has advice as to what steps we should take please share below. We are young parents/step parents and do not know how exactly to go about fighting this.

I bought a bed that showed up broken and the store won’t return my calls

    Posted: 02 Jan 2021 01:19 PM PST

Sorry if I'm using the wrong flair I'm new here.

In June I traveled about an hour to a furniture store so I could get a new mattress box spring and bed frame. Due to COVID I was expecting long delivery times and I was right because it finally showed up for delivery at the end Of October. Only problem is they completely forgot to load up my mattress protector, my sheets, pillows and pillowcases, and when they were taking the headboard out of the truck they managed to break both the headboard and the taillight of my car. They got everything that wasn't damaged loaded into my house and told me that someone would be in touch with me and that I can't use my bed without voiding the warranty because they weren't able to put the mattress protector on themselves or set the bed up at all because of the headboard. They also said that the store would pay for the damages on my car and to wait 3-4 days for a reply.

I waited 2 weeks after this incident before I called the store myself to ask what was going on. I was told to wait 3-4 days for a response yet again. 2 weeks later no phone call. Call again and I'm told to wait 3-4 days for a response. It had just become this repetitive cycle of waiting 2 weeks trying to get a response out of them to get my bed delivered and my car fixed only to be met with the same generic and false response every time. I played along with this through the end of December and now I'm fed up.

I'm getting frustrated as the reason I got my new bed in the first place was because of my back problems and my old bed being in shambles. Plus I'd like to get my car fixed. I live in Ohio which is where it was delivered to but the store itself is in West Virginia.

Nobody has even told me if they have placed an order for my replacement headboard and they've so far said nothing about reimbursing me for my taillight either. Please let me know if this is grounds for legal action or if there is something else I should be doing instead.

Landlord-Employer deducting wages without my authorization. What are my rights?

    Posted: 02 Jan 2021 11:12 AM PST

I live in Utah, on a seasonal guest ranch, going on 3 years now. My employer is my landlord. None of the employees, myself included, have ever been asked to pay rent. Recently, I was told I may need to pay rent due to lack of tourism. I said "let me know so we can figure it out." Last paycheck was partial - when employer was asked, responded that she deducted those wages for rent. I did not give written or verbal authorization for her to do this. I believe in Utah this may not be legal (Utah Code 34-28-3; UT Admin. Code 610-3-18). In another turn, I am moving out of here soon - when she found out, told me my place would be inspected for damages that I will need to pay out. I have confirmed with at least 6 current and former employees that they have NEVER been 'inspected', 'told to pay for any damages', nor been asked to pay rent at any time, going back as far as 9 years, including one employee that left in bad standing for stealing money/goods from my employer. I am unsure why I am being targeted - I have been in good standing as an employee, although COVID affected our tourism and thus my labor/wages deeply. What are my rights here?

Taking a former client to court

    Posted: 02 Jan 2021 01:17 AM PST

I have a former client that keeps super dragging his feet about paying, he hasn't paid me in 5 months and goes off on me every time I contact him about getting paid. I was going to take him to court a month ago, but he asked to make payments and I agreed to have him pay me at least $1000 a month and that I would continue charging 8% interest a month. He was supposed to pay me by the end of the month but still hasn't. I was planning to sue him and his equestrian center since all the work I did was for the equestrian center. Can I include his girlfriend in the suit since she bought out the property that all the work was done at a couple months ago. They live together and she owns the property but he is the "owner" of the company but I don't think its a registered company. I've been trying to be understanding with him but he keeps saying he will pay and then doesn't and then goes off on me every time I message him about payment. I just want to get payed. I've taken a couple clients to court before but they were just residential clients and not "businesses".

Neighboring tenant will not stop going through our mailbox.

    Posted: 02 Jan 2021 01:18 PM PST

I thought I could get a lot of good feedback here since this covers two legal areas, laws about mailboxes and landlords legal responsibilities. We live in a house split into 3 units. The front shared porch is where all 3 separate mailboxes are located. Stacked on top of each other, matching what floor each apartment is on. Our mailbox is the middle box. Flip top mailbox. Ours is labeled with our names. The other two tenants aren't. I had to contact our property manager (who is just slightlllyyy less of a deadbeat as far as dealing with having renters than our landlord) last month because the upstairs tenant never removed any mail from his box except for what he wanted. So the box was completely overflowing which lead to mail being put in our box constantly. It took 3 and a half weeks for the landlord/property manager duo to make him remove the mail from the box...which is now laying on the ground shoved under a chair on the shared porch in a garbage bag. He literally did not understand the 3 notices he was given by the property manager that "removing mail from his mailbox" didn't just mean mail addressed to him. During that time period, we installed a security camera with live feed and recording. Which revealed that the upstairs tenant was never locking the door into our shared entry way and the downstairs tenant digging through our mailbox daily and now today, removing two pieces of mail. On camera. I have contacted the property manager and landlord with no response to the mail incident today. Last week I had to contact them after placing a written note on the front door for the second time for the upstairs tenant to please lock the door. The note was ripped down. Today, Ive also requested locking mailboxes to be installed immediately to both the landlord and property manager. Legally where am I at here? I do not know who the mail was addressed to the downstairs tenant took. It's more the principal that I do not want anyone going through the mail I receive. And honestly, that I'm so fed up with these other tenants literally not knowing how to be adults and my landlord and property managers not doing anything about things I feel they are responsible for. Also for reference, because it alters my own judgement of the situation so I feel it is relevant to the story for others. The downstairs tenants smoke crack and are pill addicts and alcoholics. Multiple physical fights between the mother and daughter. The upstairs tenant is sleeping with the underage daughter that lives downstairs that can't keep her hands out of my mailbox and also recently opened one of my packages.

Just found out the apartment I moved into is uninhabitable (no electric) and landlord is not complying with us (Los Angeles, CA)

    Posted: 02 Jan 2021 01:01 PM PST

Long story short, we just leased an apartment on December 22nd, and moved in on December 30th. We tried turning on the electric on our end via Southern California Electric, and they came to our apartment to check it out, and then told us that they aren't able to turn it on. They told us that the landlord has to have the city inspectors come to the apartment to inspect and approve the apartment, because they found that the apartment has illegal wiring. Until then, SCE cannot turn on power for our unit.

We learned that this violates California Code, because we have already signed the lease and the apartment is uninhabitable.

The problem, is that we have 5 days left at our old apartment, and if the new unit is not ready in time, we won't know where we can live in the meantime and we will need alternative housing.

We were back and forth with the landlord, and initially, he had agreed to prorating our rent until the apartment is inhabitable (which we are entitled to under California law).

However, we are also asking for a daily stipend for an Airbnb, if in case we do need to have alternative housing by the 7th. We had told him the daily cost we will need to be compensated for, and the Airbnb we are planning to stay in. The Airbnb is in the same area as our apartment, and has comparable amenities that our apartment has.

The landlord replied back today, and said that they basically refuse to give us the daily stipend for the Airbnb (because they see it as a "vacation") and will provide us with their own housing alternative if the apartment is not ready by the 7th.

However, we do not trust the housing alternative that they will offer us, especially due to the lack of trust and transparency that this company has given us, and we would rather choose our own housing alternative for our safety.

We had offered to compromise on a daily stipend, and are still waiting for a response.

Im just inquiring on options I can take if the landlord still says no to this, as we are under a time constraint with our living situation.

    Thank you!

Friend who drove and damaged my car demanded I go through insurance for him to pay me back or go to court. How do I proceed?

    Posted: 02 Jan 2021 12:42 PM PST

    TN

Background: I had a few drinks (3 cocktails) at a bar my friend was DJing at and didn't want to drive. The DJ had a friend drive because i was drinking and because they needed equipment transported back to their place. I was in the car.

The guy who drove my car and ended up damaging it. One of his friends told me to park the car somewhere else and let them know it was a hit and run and I absolutely did not want to do that. I told him I didn't want to go through insurance because it'll increase my premium and he initially told me he would pay for the damages. I got an estimate from 2 different locations and went with the cheaper route and sent him the estimate ($1300). The other was $2500. He said he was in a financially tight situation and needed some time and I asked him how much time he needed and to pay $1100 and I'll pay for the rest.

He is now saying I have to go through insurance where he'd pay for my deductible ($500) and half the costs if it's over $500 and that if I don't, I can take him to court and waste my money and my time.

I've already told my insurance company of the situation but also told them I prefer not to make a claim. I also found out he doesn't have insurance. These communications were through text. Do I take the loss or how do/can I proceed with small claims?

I was given electro-convulsive therapy against my will. It was also not on my medical record. Also given medication in my food in psychiatric hospital. (British Columbia, Canada)

    Posted: 02 Jan 2021 10:54 AM PST

Hello. Last year I went to the hospital because I wasn't breathing well. The doctor couldn't find anything wrong with my breathing. I told her I may have a rare disease called Urbach-Wiethe. She didn't think I have it because I dont have the typical symptoms. She asked me if I was taking medication as I am bipolar. I told her I was using marijuana. She asked me about my diabetes and if I was taking insulin I told her I wasn't as I was still in the honeymoon period (body still producing some insulin). She put me in the pysch ward. What happened was an orderly came with a wheelchair and told me to sit in it. I said I was fine to walk. They threatened to call security so I complied. The orderly wheeled me to a room that had a nurse, a pyschiatrist and a security guard. They told me to lie on a bed that was next to I believe an ECT machine. I complied. The psychiatrist told me he was going to give me an injection. I said no, why? I will take the pills. The security guard grabbed my arm and strapped my arm to the railing on the bed and the nurse injected me and I went unconscious. I woke up the next day completely paralyzed with a sore jaw. Later in my 26 day stay while still suffering from amnesia from the ECT I asked the nurse who injected me why I was injected and she told me I never was, and she looked at my medical record and said I never was. I also informed my pyschiatrist (different from the one that was at my injection) and he said it never happened. Is this illegal? Also on my first day or two inside the same nurse gave me my dinner which is suspicous because usually patients get their dinner themselves from the dinner cart. I noticided I was drugged because I felt tired and medicated and my tinnitus went from barely noticable to extreme. Is drugging patients food illegal? My honeymoon period also ended in hospital and my blood sugar was high yet they never gave me insulin. Is that illegal? Thankyou for reading and I appreciate any advice.

Ex-Girlfriend Won't Release Me From Rental Lease

    Posted: 02 Jan 2021 10:32 AM PST

Without putting in too many unnecessary details, we currently live in South Carolina and we are on a month-to-month lease. I'm trying to get myself off of this said lease but my ex won't sign the addendum. According to the rental management, she needs to sign in order for me to be taken off. My idea is to keep living there until she signs it. She currently has a new boyfriend who comes over and they both do drugs together (i.e. xanax, LSD, and cannabis). Illicit substances are banned according to our lease agreement. Will reporting him, if she doesn't let me off the lease, effect me in anyway considering I'm still on the lease? Is there anyway I can call the police if he shows up without my approval? Any advice would be greatly appreciate, feel free to ask me any questions. Thank you for your time.

Hit by an Amazon Truck - anything I should do aside from calling insurance on Monday?

    Posted: 02 Jan 2021 12:00 PM PST

I struck an Amazon truck that was taking an illegal turn, damaging my bumper, driver-side door, and possibly car mechanics(?). The headlight is shattered and I cannot open my driver-side door. I'm also worried that the car is driving improperly (alignment, etc.).

The Amazon driver admitted to taking an illegal turn, and an off-duty police officer saw the whole thing take place. She was there when the on-duty police arrived. I have received a case number and been advised to contact insurance. Is there anything else I can do to ensure that I'm compensated by Amazon?

    Edit: I'm in Massachusetts.

North Carolina: What is the process to be named heir of an estate?

    Posted: 02 Jan 2021 05:53 AM PST

My father passed away in November without a will. Before he passed, he made it clear he wanted me to have his house. November's mortgage was paid, but hasn't been paid in December. His water has been shut off (he owed thousands), and soon his electricity. At this point it feels like a big headache, but my basic question is how can I be named heir of his estate (I'm his only living adult daughter)? Can someone explain the exact process to me? I've never dealt with anything like this before. The mortgage company said I have until February before foreclosure if the mortgage isn't paid. They couldn't advise me beyond that. Thanks.

also I do not want to live there, so do I have the option to sell??

Dealership may have ripped me off...

    I'm in Texas

I bought a car at a dealership for $34,000 including tax and fees. The dealership said because I was still waiting for the settlement from the insurance company that I could write a check for the down payment and they would hold it until I let them know to put it through. They also said once I tell them to process the check they would then send me the loan documents. So I wrote a check for $15,000 and confirmed that I was financing $19,000. I drove home in my new car.

Now it's been nearly 2 weeks and I was finally able to log into the finance company portal and I see a principal balance of $23,000 dollars as if I only put down $11,000. I haven't told the dealer to process the check yet and I called the finance company and requested they fax over a copy of the loan contract so I can see a breakdown of the loan and down payment. The dealership is closed for the holiday weekend so I can't talk to them. It's also going to be a couple days before the finance company faxes over the contract. If it turns out the dealer ripped me off or forged documents, what recourse do I have? Could I simply take car back to them and cancel the check or what?
