    I recently moved back to my hometown from a large city. I have a leadership position within my company and work remote full-time, so I decided to move back to my hometown with my wife and buy a house.

    I want to get involved locally and try to help out the residents as much as I can to help the town prosper. There is a collection of buildings on our main street that are owned by a family. I'm told the family doesn't live in the town, let alone even they state--they live in Georgia. This large collection of buildings are being ran into the ground, completely let go, and remove any chance of the town revitalizing our main street, bringing in new businesses there, etc.

    Is there anything the city or residents can do to force the owners to sell the buildings or restore them? Are there any laws that allow some laws similar to eminent domain that would allow the town/residents to reclaim that property if it's hurting the prosperity of the town?

    Unlicensed contractor took $24,000 for materials and ran. He promises to pay money back, but owes far more in court backpay to other clients. What can be done at this point?

    Posting from my mother's POV. New to Reddit posting, just looking for help. All names/company names have been removed.

    "My husband and I bought a home in the North Carolina Mountains in September of 2020. It was during the home inspection that we became aware that the roof was in need of immediate replacement. We had no contractor contacts in North Carolina, so we turned to Angie's List and Home Advisor to help us locate a roofer. We received quotes from five different roofers. The contractor's company had an "A' rating on Angie's List. On the contractor's company Website, we found words very important to us such as "family-owned business, quality, honesty and integrity, craftmanship, roof experts, and reputable business that puts customers first." The contractor came onsite the same day as we requested the quote and had a quote in our hands by nightfall that same day. We were impressed with the quick response. The contractor told us while onsite that he considered our home an "emergency" and would pull supervisors from multiple crews to get our roof on immediately. This tipped the scales in favor of the contractor as we needed quick attention. During the onsite, he said all the right things, and highlighted that it is a family-owned business with complete commitment to customer satisfaction. Our experience could not be farther from that. Please read this post in full and review pictures from our experience. If this post can save you money and the pain that my husband and I have been through, and continue to go through...... then, something good will come from this nightmare. We hired the contractor to remove the existing cedar shake roof and to install a DaVinci Shake Roof on our home in the North Carolina Mountains. The quote total was $42,000. The contractor's wife emailed on 10/6 that costs for custom materials would be required to be paid up front. On 10/16, the contractor requested the amount of $24,620 for materials and we wired that amount to him so that the materials order could be placed. After the contractor had our money, communication became sparse. We requested updates several times due to the fact that the lead time of four weeks for materials (given to us by the contractor) had come and gone. On November 20, the contractor told us most of the materials were in (enough to get started) and on November 22 – 23, the contractor came onto our property and ripped off the cedar shake roof. Debris was left in our yard, no dumpster was delivered as promised. In writing, the contractor stated that the worksite would be cleaned thoroughly at the end of every workday. (Today, 12/15, we had to hire a third party to come in and clean up debris and trash left on Nov 22-23 by the contractor's company.) Workers built a fire on our custom rock walkway and our front yard burning off the moss and charring the rock. At no time was there permission to burn anything on our property. There were beer bottles, beer cans, and chip bags left in our front yard. No port-a-potty was delivered as promised in quote and 50 feet from our front door, we found human feces and napkins. When we arrived at our mountain home for Thanksgiving with our extended family on 11/25, we were absolutely sick about the debris, the trash, and the damage to our property. At this point, we had no idea that there was worse news coming. Week after week, my husband and I experienced new levels of stress and unrest because each promised date for delivery of materials to install our new roof came and passed. The contractor left our roof exposed with only Titanium 25 underlayment and we had LEAKS. We heard a number of excuses from the contractor as to the reason that the new roof install was delayed: "We have some of the materials, but not all...we are still waiting." Our home is a custom log home with 100 year old beams and refurbished hardwood floors taken out of textile mill in Catawba, NC. These materials are irreplaceable. We can't go to Lowe's and buy more. And, week after week we watched water drip from our beams onto our hardwoods with each rain. It was with complete frustration, we called the distributor directly to give them an ear full. After all, we paid for materials on 10/16, it is now 12/8 and we still have no materials. What did we find? The contractor's company requested a quote on 10/16, took our money on 10/16, but NEVER PLACED THE ORDER. Not only did this man and wife take $24,620 from us and not provide materials, they made the decision to rip off our roof and expose our home to damages KNOWING materials were not on order.
    After the distributor confronted the contractor with not placing the order, and contact from our attorney, the contractor wrote an e-mail saying that he knows what he did was wrong and he would pay us back our money. He, since, has missed three dates that he agreed to pay back our money. We have not seen one penny from him or his wife, only his admission of guilt and more broken promises."

    This contractor is unlicensed and currently owes far more money in back pay to other court charges. After research we have found multiple companies he has previously owned and closed after scamming thousands from other clients via BBB complaints in scenarios similar to this one. We reported him to BBB as well, but they claim this complaint is resolved because the contractor told them he is working on it. Is there anything that I can do to help in this process?

    Also, should add: his previous companies are all in his name. This new company, founded May of 2020, is in his wife's name.

    Edit: I wasn't sure what to expect, but I am blown away at the incredible amount of insight. Thank you all for your help. I'm getting on a call with my parents tonight to discuss all the different ideas/avenues they may be under-utilizing thanks to all of you.

    UPDATE: UPS picked up my return package from inside my house, gave me a receipt to confirm, then damaged it and left it outside

    UPS driver's supervisor called me back and said nothing I said sounds truthful. She said I am at fault for not wrapping it properly. I told her I wrapped it as best as I could and I can definitely do better if that's what is being asked of me at this point. I told her, what about the trespassing and blah blah blah. And she went on about how none of this sounds like something her worker would do and that it is my fault I didn't wrap the package properly. He only came back to take the receipt back which is his in the first place and I cannot do anything with it. I told her since she won't help then the next step is to file a police report and she said if what happened is "in my opinion" then I can go ahead and do whatever it is that I want.

    I'm appalled. Dealt with UPS my entire life. The supervisor at my local UPS is a total asshole.

    Husband added me to his high balance credit card before divorce

    My ex and I are planning for a divorce in June if 2021. I received a notification on my credit report that I was added to a credit card account. This is his highest balance credit card, with a balance over $22,000. I've never been an authorized user on this account until now (he is claiming that I have which I can prove that I have not). Could this affect me financially when we divorce? I live in Washington state.

    Update: thank you to everyone who gave advice. I am going to freeze my credit, dispute the change, and contact an attorney. Thanks!

    Neighboring restaurant threatens to sue for serving similar food

    A friend of mine is opening a thai restaurant in the next couple weeks. When she posted her menu, there was almost no thai food. I recently found out it is because there is a Chinese restaurant in the same plaza that is threatening to sue her for serving the same food as them, as the Chinese restaurant claims to serve Chinese, Thai, Korean and Japanese food.

    My friend is being told that if she serves any East Asian food, she will be sued, as there is a business agreement that vendors can't serve the same food in that area.

    I'm not looking to go to bat for her in court or anything, but I just can't see a situation where the Chinese restaurant has a leg to stand on. Hoping r/legaladvice can help me understand what the fuck might be going on. I don't have much more information, so feel free to make assumptions.

    Is it my responsibility to locate missing spouse?

    Over 12 years ago I kicked my husband out and got a 3 year PFA against him. He filed for divorce and I responded immediately. Yet 12 years later I'm no closer to obtaining the divorce. I've had 3 or 4 lawyers over the years and the last two told me I had to locate him to serve him papers. Is this truly the law in PA? It makes no sense to me but I know nothing about the subject. 2 lawyers did search for him but turned up nothing. Before I hire another lawyer what do I need to know and understand? TY.

    Early Termination Fee for Lease I'm not approved on

    Location: Miami, Florida

    So, I put in an application with a guarantor for an apartment

    My application is "approved"

    I'm sent a lease to sign My guarantor is sent a lease to sign

    We both sign under the impression that we are approved

    We get notification two weeks later saying my guarantor was not approved

    At this point property has not signed lease As it states in my portal "lease pending property signature and approval"

    They say I qualify to be a self qualifying applicant instead since my guarantor didn't qualify

    I say okay great and the They take the current lease out of our portals (my guarantor had to make their own portal/log in to sign their lease)

    I just need to provide proof of income at this point for myself they said.

    I provide my proof of income through email Which is bank statements as I'm self employed

    I provide almost a years worth of my bank statements because my income fluctuated a lot during COVID and the recent three statements wouldn't paint a whole picture of my usual income

    They say the files/pictures I sent they cannot read and to resend them They also say if I end up not being approved I can try to get a guarantor through a third party called "leap" Out of caution... because I don't know if my income will be suffice enough or if they will accept/like the fact that I'm self employed .... I put in an application with the third party leap, NOT an agreement just an application to see if I was approved to have them be a POSSIBLE guarantor

    I resend my bank statements to the property as well at this point since the documents I sent they couldn't read

    I was approved with leap for $1499 of rent but no more than that Original rent rate is $1780 so, not enough.

    Again I DID NOT sign an agreement with leap just an application to see what I would get approved for and I waited to sign an agreement with them because you have to pay a fee with Leap and I wanted to make sure that I would get approved with the property along with Leap together and I don't want to pay a fee for nothing

    I again hear nothing from the property but I do get emails every other day from Leap asking to sign the agreement The property I hear nothing back from regarding my income and the bank statements I re sent.

    Do not hear back for weeks from the property so I assume I am not approved with my income and that they aren't working with leap because the rent rate I was given with them was too low to satisfy the rent price listed for the apartment.

    I move on to a different apartment.

    I finally get an email and phone call from the first apartment complex saying I have NEW lease documents waiting in my portal to sign .... key word is NEW

    I tell them that I won't be signing with them and I have already moved onto a different apartment complex because it's been WEEKS and I couldn't get ahold of anybody in the office whenever I called for an update on my application

    The girl says okay and hangs up

    I get an email a week later saying I owe $3200 for breaking a lease (early termination fee) ... HOW? How is there a lease that was broken when the first lease I signed wasn't technically approved for because my guarantor wasn't approved and the property didn't sign and approve it .... otherwise if I'm being held to the terms of the lease without actually being approved for it ... how does that make sense? I also again DID NOT sign the second lease they sent to me. I'm so lost right now. Can they even legally do that? Have it both ways by saying I'm not approved but also ... I owe money for breaking a lease?

    Also I didn't sign an agreement with leap as my guarantor so again .... they can't legally be put on as my guarantor for the new lease or old lease or any lease at all. Plus again, the price they approved me for them to be my guarantor was $1499 not enough to satisfy the $1780 required (also listed on original lease).

    I called them immediately and the front desk person says I'm still legally binded to the first lease and that it doesn't matter that the property didn't sign and approve it? That the first lease is only void once the second one is signed? .... isn't it just an unfinished document until the property signs and approves it? (To my knowledge they still haven't signed the first one and .... why would they if I'm not approved/Guarantor wasn't approved). Again, this lease was signed with my guarantor in the picture (but my guarantor again had their own lease signed on their portal). They took that original lease out of the portal and I was even told before hand when they first called to say my guarantor wasn't approved that they would send me new lease documents/paperwork IF I get approved.

    Why would a property make someone sign a lease they aren't approved for and then still hold them to the terms of the lease????

They started looking for my license, registration, insurance without asking me first. Then tossed my drivers license into my lap when they were done looking. It just felt really odd.

    Reported someone in the fire department for sexual harassment, now they’re suing both of us [NY, USA]

    The incident happened back in October-November of 2019. It was backed up by several witness statements and pictures. I, [F], didn't report it until January and it wasn't even me that reported it. After many months of meetings and them even retaliating with counter claims of sexual harassment, he was kicked out of the department. Now, both myself and the department got served with complaints of slander, libel, and emotional distress.

    I am not exactly sure what I am supposed to do. I contacted some people in the department and they said they turned the summons over to their insurance company and that the department was going to represent me, but this morning I received another copy of the summons in the mail (not certified) and my name was circled where it named the defendants. Am I supposed to provide a separate response in addition to the fire department's response if they said they were representing me?

    Second stimulus check - will my ex-husband receive our child's payment? He owes thousands in back child support. Pennsylvania.

    I fled my home in August of 2019 with one minor (15 years old) child. The oldest child was manipulated into staying behind. After an incident in October where my ex-husband brandished a weapon and made threats against the oldest child, the police were contacted and the oldest child (now 18 years old) moved in with me. I filed for child support in November - something I did not do in the previous year out of fear of retaliation and further emotional and psychological manipulation against my oldest child.

    In retaliation, immediately after I filed for child support, my ex-husband closed our joint bank account after collecting his own paycheck, but cutting me off from receiving my SSDI payment that was to be deposited three days later. I went 25 days with two dependents and no money. My phone and internet were cut off, which made sorting out the SSDI payment all that much harder. This is also the account that was used to file our tax returns and where the first round of stimulus payments were deposited.

    During a phone hearing with a hearing officer for child support in November, my ex stated that he "would rather sit in jail" than pay support, so at the conclusion of the hearing, they attached his wages. He earns significantly more income than I do (50K), and is currently in arrears of $2700 as of December. His income and employment have not been affected by covid. I have not yet received any child support payments, and the last docket information I have from December states "Final order - non-agreement".

    I had to file for food stamps. Due to prolonged psychological abuse and other issues, the 18 year old is currently not fit to work. I have enrolled them in counseling. But for now, I am shouldering the care of two young adults on my disability income. However, from what I've read, it appears that the second round of stimulus payments cannot be seized for back child support. The IRS "Get My Payment" option is currently offline. My concern is that because they are not seizing the stimulus funds for back child support, my ex-spouse will be sent all of the stimulus money in full, including that for the 15 year old who has resided 100% with me since August of 2019. He will not voluntarily release it to us.

    My car is broken. I need that money to get it fixed to get the kids to appointments and other essentials. We do not live in an area with widespread public transportation, and I am immune compromised, so public transport isn't the best option for me right now. We are living on barely nothing. This is grossly unfair. How do I go about getting my portion of the stimulus? Due to the abusive nature of the relationship, I have no contact with my ex-spouse and he is prohibited from entering the property where we live.

    I inherited a human skull. Do I need to...do anything?

    Illinois, USA. A relative passed away, and while cleaning the house, we came across a skull. This is a human skull, from years ago. The relative's grandparents owned an oddities shop, which is where I suspect it came from. It's been in the family for a long time. I just am lost as to if I need to alert anybody about this. I don't plan to sell or get rid of it unless legally obligated.

    ABF destroyed my $13k dental chair and the claims dept says they will compensate $30

    Hello folks,

    My wife has a dental startup practice and bought a used dental chair, light and 2 stools (in awesome condition) for about $13k from another dentist across the country. She chose ABF to package and ship the chair to Texas, but when we finally got it, EVERYTHING was destroyed. The chair frame is bent and won't power up, light is smashed, metal was twisted and parts are missing. It doesn't look like it was dropped only once, so I'm not sure if negligence is involved. Nothing is usable or repairable according to a technician we brought out to look at it.

    I searched online and read that for used goods, the limits of liability are $0.10 per pound. The equipment weighs about 300 lbs. The shipping broker told us to accept the shipment and say that there were damages. That was before we knew anything and when they said they may only liable to pay out $30.

    She did not buy shipping insurance, so that's out of the question. Is it even possible to pursue legal action? Is it worth the trouble or cost?

    Edit: We did pay for the "white glove services" where it was packaged in a crate before put in transit.

    [NY] Neighbors are AWOL and have a massive bamboo forest intruding on our yard.

    Hey everyone, my [18m] dad and stepmom just bought a house (new build) in Sag Harbor Long Island. After moving in recently we realized two things.

    First, that our left-hand neighbors are never home. (No responses to knocked on doors, no cars, no lights, and no landscapers, the house is effectively abandoned).

    Second, that they have a massive bamboo forest in their yard (no bamboo in ours) which hasn't been cut in years, and it is making a B line into our yard where it would likely puncture water pipes and cause massive property damage.

    We have talked with our landscapers and they said that unless our neighbors cut down a lot of the forest, we will be looking at 25,000-30,000 of yard work to put in a trench that prevents the root system from growing and potentially thousands more in continuous prevention down the line.

    We are going to try to contact the neighbors tomorrow through the address listing but:

    1] If they refuse to cut it down do we have any case to sue them for property damage/force them to either hire landscapers to keep the forest in control or pay for the trench or.

    2] If they are completely unresponsive, does this change what we can do at all.

    Legality of reduced salary "due to pandemic"

    I'll keep it short and sweet - company I was with prior to a month ago enacted a 30% pay cut for me since I was a salaried manager when the pandemic hit, and suspended 401k contributions. We also missed an entire either week or two of pay, which they were hoping to make up by years end.

    I left them in September, and got a new job in November. Thankfully no pay cut lol. My question is how can employers just reduce your pay? I get the US has almost no labor protections but that seems crazy... Also they took PPP money and still made us hurt lol.

    Filing Chapter 7 and buying a car

    Hi all. I have a dumb question. My husband and I are filing chapter 7 bankruptcy in February. In the bankruptcy I will be surrendering my car. My husband will be going back to the office shortly so having one car isn't an option for very long.

    We got some Christmas money and I found a $2,000 high mileage but well kept super clean SUV. Would it be shooting myself in the foot if I bought it outright 2 months before filing?

    I've already confirmed with my attorney that I can surrender my car prior to filing and still write that off so I was planning on doing that ASAP since I'm behind on payments and I want to spare myself the humiliation of being hunted down by the repo guy in my neighborhood or at work. I'm already ashamed enough that it came to bankruptcy in the first place.

    Please don't downvote me to oblivion, I'm really nervous asking this. :(

    Was able to get a covid vaccine through my employer, but I'm not sure if I broke the rules.

    TL;DR: I was able to get the first dose of the Covid vaccine through my employer, but I'm starting to regret it. I'm starting to get paranoid that I will get in trouble or broke some type of law.

    I work for a university and have credentials with the associated hospital. I don't work with patients at all and I have been working from home since March.

    The hospital system sent out an e-mail to ask employees if they wanted to receive a covid vaccine. I was able to log in with my employee ID, and took the survey. The survey just asked if I worked with patients with covid, and if I was at increased risk. I said no to both. I have an e-mail confirmation that I took the survey but unfortunately the e-mail doesn't list my responses.

    After taking the survey I assumed I would have to wait until spring to get vaccines, but they ended up e-mailing my inviting me to sign up for a scheduled time. I was able to get a vaccine, but now I'm wondering if my employment situation was so rare that they didn't intend someone like me to get the vaccine.

    Before getting the vaccine I called the number associated with the survey to ask if there was a mistake I got in so quickly. The phone operator asked for me ID and said there was no mistake.

    I'm a little paranoid I'll be reprimanded though my employer in some way. Or I'm worried my employer will get in trouble for giving vaccine doses to hospital workers who don't work with patients. Am I being paranoid?

    Also, as a side note, I feel terrible about getting the vaccine so early. In retrospect I should have waited.

    (AL) Landlord sent me to collections over scuffed floor

    TL;DR - Back in Jan. 2020 my landlord accused me of damaging flooring in the apartment's clubhouse and sent me an invoice for over $4000 for a full floor replacement. I asked for proof of damage/responsibility and she dropped all contact after admitting she didn't have evidence. On 12/29 she sent me to collections for the unpaid balance for the floor repairs.

    Long story - Friends and I were in the apartment's clubhouse and a few days later I received an email stating we had damaged floors. The landlord and I had several email interactions and a few face-to-face meetings about the ordeal, usually with me asking for proof and wanting to know how the scuff she showed me constituted a full floor replacement. I wasn't sure that my party or myself had even caused the damage.

    I eventually figured out that there had been previous floor damage in another part of the room and that they were attempting to get some other resident to pay for *all* of the replacement cost (about $11,000). This really made me concerned that the landlord was just looking for another party to involve to split up the cost.

    Eventually I wrote an email to her saying I wouldn't pay unless she could prove I damaged the floors. She dropped contact for months and I moved out on 12/5. Now I've been notified that I've been sent to collections after she used my entire security deposit to cover a portion of the $4,000 she says I owe.

    She also filed with my renter's insurance and received $1,000 under a 'damage to others' provision. We never received a bill for the remaining amount -- just immediately sent to collections.

    Am I wrong in thinking that the marks she showed me would be normal wear and tear? I'm at a loss at what to do now and concerned about credit damage. Any advice is appreciated.

    Can my employer mandate weekly COVID testing at employees expense? [Baltimore, MD]

    My employer is now mandating weekly COVID testing. The employer is providing self test kits to be used each week, that will be billed to employee's health insurance (which is not supplied by the employer). Those employees who choose not to use the provided kits must get tested on their own every week. Employees who do not have proof a negative test result each monday are not allowed to return to work until one is provided.

    Is this weekly testing allowed by law?

    The workplace is not a healthcare facility and we have no customer interaction. It's a manufacturing facility and warehouse.

    Landlord is dragging their feet on repairing mushrooms growing out our ceiling and a mouse problem, can I threaten to withhold rent a day before we're due to pay it? (MA)

    Hi guys, to make a long story short:

    On Dec 17 my roommate and I noticed some mushrooms growing out our if ceiling, we contacted the property manager, they sent someone out to knock the mushrooms down, and then someone to test them and the air quality to see if they were safe. We haven't heard anything back. We asked them to cut open a piece of the ceiling to make sure its not full of mold/more mushrooms and they're pushing that off as well. (My worry here is that they'll kick us out of the apartment to have to fix this issues, if its caused by a leak from the upstairs bathroom.).

    Two days ago I saw a mouse in the apartment, I emailed the property manager again and she gave me some runaround saying there's no contract set-up with an exterminator for our apartment, so we have to wait until they can set that up, and the soonest someone can come is Jan 12. My roommate and I consider that unacceptable, and not in a timely manner like our lease says things will be fixed.

    I've been reading a decent amount about MA tennant rights and withholding rent, my concern is that we haven't/can't have a health inspector come out before rent is due tomorrow to do an inspection. I thought about saying that'd we'd hire our own exterminator and have it deducted from the rent, but it seems like no exterminator will come out without a contract with the building/management, which I have no control over.

    Can we threaten to withhold rent? Or would it make this whole situation more of a mess? I've been back and forth with management constantly through email, and they are technically working on fixing the issues, but in my roommate's and I opinion it's not in a timely manner.

    My (26F) parents have helped me significantly financially since I turned 18. Now they want it back.

    Like the title says, my well off parents have freely offered to help me with various things over the past several years. These things include

    • paying college tuition

    • taking out student loans for remaining tuition and paying them on my behalf (on both of our credit reports)

    • helping with a down payment on a home (I'm the only one on the title and loan)

    • paying for part of the renovation of my kitchen

    In total, it is quite a large sum of money. All of these things were given on their own free will at the time. In "exchange", I allow my little brother to live with me completely free including paying for groceries and utilities, and my basement serves as storage for what they were paying $1300/month to store.

    I say "exchange" because it was all an unwritten part of the "agreement" of them helping me buy and fix up the house, so I would help out with my brothers college expenses in these ways. Additionally, I have added my name and good credit to several large ticket items so that they could qualify for lower interest rates. One of these items is a rental property that I have seen zero financial return on.

    Recently, we got into an argument over how my responsibilities to them, their house, and my brother continue to grow, all under the pretense of "well we've helped you out so now you owe us." I am not happy with this situation. If I had known that the figurative cost of their gift would be them increasing their presumed power and say over my life, I never would have accepted the help. Of course I am grateful, but I would prefer to cut ties financially with them for the sake of eventually having a decent relationship. At this moment I dont really care about whether or not my brother stays with me, I love him and would be happy to help him regardless.

    The bottom line of my question is - am I legally obligated to repay them any of the money that they have given me over the years if it was given as a gift at the time?

    Questions about calling the police on a neighbours son who robs her in Vancouver BC

    I'm hoping to get some answers here because I've lost quality of life over what's happening here. And I would appreciate if no one responded telling me to move. This is my home, I've lived here longer than anyone else in this house, and I have looked and can't find another place that I can afford. I have no friends or family to help me. I'm stuck. I'm staying.

    We live in a home that's split I to 3 units. The main floor is divided like a duplex with two units and the upstairs is a larger third unit. The unit upstairs is where the landlord lives and on the main floor is my boyfriend and I, and then an older woman next to us. She has a son in his 40s who is not on the lease, but is a homeless addict and comes to stay over quite often. He also robs his mother regularly.

    In August, late at night, my boyfriend and I were sitting around watching a series on Netflix. We were on the very last episode when we started hearing a commotion next door. We had heard the elderly woman and her son fight and get physical in the night a few weeks before, but this was much louder. The walls are thin enough I could hear skin to skin contact as someone hit someone else. I heard furniture moving and what sounded like a body hit the shared wall. We immediately knew this wasn't a normal fight for them and hit pause on the tv. The elderly woman was whimpering/crying each time we heard a hit so my thought was that it was the son hitting the mother. Then she began screaming at the top of her lungs "help me, someone help, please help" over and over so I immediately called 911. She was still screaming for help as I was on the call, but then everything went silent. I genuinely thought he had murdered her. Cops pulled up in swat vans and pounded on her door. After some talking, the cops came over to my door to get my statement. They asked me if I was sure I heard a male voice and asked me if the elderly woman could have been having a psychotic episode and talking to herself. After sticking to my story the landlord heard the commotion and came down, we were able to show the police footage from the landlords security cameras proving a man snuck out of her unit before they arrived. The elderly woman wouldn't tell them what happened or where her son was, so the police left after chalking it up to a robbery.

    Fast forward just a few days. The elderly woman thinks it was the landlord upstairs who called the police and she is PISSED. She screams at him in the yard, calls him names and accuses him of beating his wife (100% false.) He takes her abuse very well at first, but when she accuses him of harming his wife he snaps and yells back at her that her son is the only abusive one in this house (fact.) She screams at him some more and then dumps her garbage all over the yard. At this point the landlord calls the police and they come talk to both of them, but treat it as a landlord/tenant dispute and just tell them to both leave each other alone (despite the landlord minding his business the best he can.) The fighting between them continues and the cops are called by both of them several more times, the elderly woman cries every time the police show up and acts like she's a poor innocent old lady with a mean landlord. The police threaten to take the landlord to jail if they have to come back, so he hides in his unit for the foreseeable future. No yard work is done, no gardening, nothing. Just hides inside.

    Fast forward to the beginning of September and early in the morning the elderly woman's son is out in the driveway. The security cameras no longer point to the elderly woman's parking spot or front door and windows, because she threatened legal action if the landlord didn't remove them. The landlord however is awake and notices the man in the driveway, so takes a video with his iPad. The son takes off his moms license plates and brings them inside. The elderly woman then calls the police and tells them that the landlord has stolen her plates. She sends the landlord a nasty email about it and the landlord gets nervous and sends me the video so that we know what's going on. We offer the landlord support and he calls the police to provide them with what really happened. Once the police know what happened, the landlord decides something needs to be done before the elderly woman or her son do some real damage. He files paperwork to evict her and they wait for their court date in mid October.

    In mid October on the day they go to court, the landlord loses and the elderly woman is not evicted. The landlord doesn't come home right away, but the elderly woman does. Her son shows up and they begin fighting. She tells him that he ruined her life etc. And he starts threatening to bust all the windows in the house. She continues to yell at him and he escalates his threats now to burning the house down. More yelling, now he threatens to straight up just murder her. He decides to leave and I whip out my phone to record him outside since we no longer have security cameras on that side of the home. I manage to record him looking back at me in the window and yelling "want know what it's like to die." I decide I don't want to die in a house fire so I call the non emergency line since he's already gone and tell them about his threats, but that he's gone for now, so that there is an official record of it somewhere if something happens later. The police send out some officers a few hours later to come see my video and talk to the elderly woman. The police tell me to dial 911 if he comes back. Later than night, he comes back and he's madder than before. The house shakes from him slamming the door and it's immediate chaos in the elderly woman's apartment. I dial 911 and then everything goes quiet. I again think she's murdered. The police arrive with canines but he's already gone. They come knock on my door, and tell me that the elderly woman's door was wide open and she isn't there. I let them know that her car is in the driveway and the son doesn't have access to a vehicle. A little while later both fire and ambulance show up, and I'm sure she's fucking murdered, but after some more time passes I see EMS and police walking the elderly woman back through the yard into her unit. She's in her pyjamas and holding her arm like it's injured. She again refuses to tell police where her son is or what he did. They leave.

    Fast forward again to the end of October. The elderly woman is gone for a few days, her car is gone, but I can hear her son and a woman arguing in her unit. What I gather from the arguments they have is that she's a prostitute and he's trying to steal her away from her pimp. He wants her to go on welfare so they can ride off into the sunset together, but she doesn't want to go on welfare and wants to go home. He fills out the paperwork for her and then calls a cab. She cries and doesn't want to go with him. The fight turns physical and when they finally come outside to the cab, the prostitute has blood running all down her face. They get in the cab and leave. Unfortunately they came back late at night to watch Big Bang Theory and smoke crack. The next morning they argue again because he can't find his crack pipe. The elderly woman finally comes home, and kicks them out. Turns out the elderly woman was in the hospital getting surgery on the arm that was damaged when the cops were here last.

    At this point I have called the cops on this guy a total of 3 times, on two different dates. I decided that obviously nothing can be done, so I prepare what I would need in an emergency by the door for quick fleeing and let the elderly woman fight him off on her own. Not my problem anymore. They fight and fight and fight. Sometimes it's physical, sometimes it's not. He robs her, she cries, he leaves, he comes back etc. The landlord has chosen to sell the property and get far away, and I don't blame him. The house hasn't sold yet but I'm hoping this mess hasn't cost me my housing.

    Final fast forward. Current date. The elderly woman finally calls the police on her son herself. He's of course gone by the time police arrive, but she cries to them about how he always robs her and she needs safe housing. The police say they can't do anything if he's not there and she needs to call someone else about housing because that's not what they do. She gets mad at police for not following her demands, police tell her to stop letting him in and keep her doors and windows locked. She fake cries and they leave. Not even an hour goes by, and there's a knock at the door. She opens it and lets her son in. He's robbing her, she's crying. I say fuck it, I'll call the police and hopefully they catch him this time. Police come, he's snuck out the other way, they can't find him. Woman says he wasn't robbing her and asks if the little bitch next door called police. The police ask her why she was on the floor with a piece of furniture toppled over on top of her and she says she fell because of her arm and her son had nothing to do with it. They get mad at her and she yells at them. They leave. The son comes back another hour later. I'm sleeping. I don't call police again. It's morning now and he's currently there.

    So my questions are:

    Is it worth it to call police on him if they never catch him?

    If they do catch him, will he even go to jail since the mom lies for him? What can he be charged with?

    What should I do to protect myself? Can I take out a restraining order like in the movies or do I have to wait until he attacks me specifically? (which probably isn't far off since I called police on him several times now)

    And when the house sells, can the new owners kick her out more easily than the old landlord? I have met potential new owners and they were very kind to me and complimented my unit, but they don't know what's going on with the other tenant. When they find out, will their options be different than the previous owner since they were sold a home with a crackhead problem that they weren't informed about before buying?

    Can I violate an existing custody order if I feel that my ex is unfit and unsafe for my daughter to return to him?

    My ex assaulted my friend in front of our daughter during a custody exchange. To give the story some context, he has a history of alcohol abuse and has been physically violent with me in the past. A couple days before, my daughter (3) told me that him and his gf have been making her do wall sits as punishment. This isn't the first time I've heard concerning behavior from them. My daughter has also told me that they have made her sleep on the kitchen floor without a blanket, and put her in the garage with a "monster" that will eat her if she continues to be bad. In June I called CPS since I was concerned of the change of behavior from my daughter, but they did not find anything concerning.

    I respectfully told him that I did not feel that the way they have been disciplining her is appropriate. He immediately acted defensive and said that she is just 3 and I shouldn't believe everything she says. Then a couple days later, my male friend was with us while my ex was dropping my daughter off to me. My ex physically assaulted my friend, accusing him of sexually assaulting my daughter, and threatened to kill us. He then drove off when we threatened to call the police and appeared to be highly intoxicated.

    After the incident, I immediately called the police and my friend is pressing charges on my ex for assault. The next day, I had police and CPS show up at my house telling me that there are allegations that my friend has been molesting my daughter. I honestly believe that this is just in retaliation based on my exes behavior. There is now a whole investigation going on with CPS of the alleged child abuse.

    I have filed a restraining order against my ex, and for the last couple day I have been afraid for my daughter's safety when with him. I have been trying to get in touch with legal counsel regarding the issue, but everyone is gone for the holidays. I am afraid that I will be getting in trouble for keeping her and violating our custody order. Due to his past alcohol abuse and his reckless behavior the other day, I do not feel he is fit to have her back. Would I get in trouble for keeping her, and jeopardize my custody of her?
