They charge my credit card (Capital One) for the renewal fee even though I wasn't a member, so I checked and they have just renewed my membership. I cancel the membership and check back a week later and I am a member again. I got a new card number from Capital One but they said if Spirit has my old number they can still charge me. I am contesting the charge but the person I talked to said he sees this happen with Spirit Airlines "literally all the time". And I just now got back on the Spirit airlines website and sure enough I am a member again, despite having received multiple cancellation confirmations. Edit: I'm in the US. I told Capitol One if they can't deal with this then I will have to cancel my card and get one with a different company. I just don't see how this shit is legal. What can I do? [link] [comments] |

Do i have a legal action here? Or can i just go anyway? We are set to move in a week and she has known about it for 6 months. She used to be deputy mayor and uses her connections to her advantage. Back in March/April, due to COVID lockdown and keeping our kids home from daycare my husband built a kids clubhouse (next to the tree, but not supported by the tree. Could be misconstrued as a treehouse). We got a violation in the mail yesterday that we have 12 days to take it down. Here is what it says we are in violation of. To me, it does not read that we broke any rules. We are waiting for the town to open tomorrow to call, but would love any help possible to help understand my rights. It is currently only notice of violation, not a summons. "Outdoor recreational facilities accessory to single-family dwellings on the same lot shall be permitted and shall be subject to the following requirements. For purposes of this section "outdoor recreational facilities" Shall be defined as including, but not limited to, swimming pools, game or sports courts, and any similar facilities, but shall excludes children's play equipment that occupies less than 200 ft.² of a lot area, tree houses and any facility or activity prohibited by chapter 129 of the township code. When looking at the Apt, two of the upstairs bathrooms needed to be renovated. There are no functional issues with them but they're not nearly as nice as the bathroom downstairs. In our lease, there's an addendum that says "bathroom renovations to be completed by 9/10/2020". Through one delay or another, one bathroom isn't finished, and the other bathroom hasn't been started. I'm wondering what the best next steps are, we really just want the bathrooms done but would it would be good to get some money off rent as well. Massachusetts state. My justification is that we agreed to pay $X per month in rent because we were under the impression that these bathroom renovations would be completed ten days into the lease. All the property has been liquidated, so there is only money in an account. I feel that waiting this extra time is unnecessary, as the amount I might save on final taxes is much less than I would earn in simple and safe investments. Also, I believe that waiting three years to obtain and investigate the final accounting would let my sibling "off the hook" under statutes of limitations on fraud and/or petty theft that might have occurred. My sibling has been less than transparent concerning the handling of the estate, from the sale of property and assets, to the payments of questionable "finder's fees" and the temporary "upkeep" of properties. Is there any way I can obtain information on what is held in the estate presently? Is there any way I can compel the release of my share? Is it possible to get information on what the expenses have been, so far, concerning the estate. Is there any way I would be able to "sell" my share of the estate? I just figure that I don't want to make any of this personal, and I feel that having this over with, and letting him deal with others, be they lawyers or whatnot, will be better for the both of us. Posted: 24 Oct 2020 02:37 PM PDT In 2013 we financed a 2014 Ford Escape. It's now completely paid off. We bought it from a Ford dealership and they sold it as brand new. No disclosure of any accident. We paid an MSRP price. We are now selling it for a newer car and when we're at a Kia dealership asking how much the trade in value is, they ran the Carfax. Carfax indicates there's one accident with airbag deployed. We were confused since we never got into an accident with this car. The Kia dealer looked at the detailed report and apparently the accident occurred before we even bought it, when it was on the way to the Ford dealer. We're appalled at this since it was never disclosed to us at purchase. The car drove with mostly no issues but without a doubt it drops our trade in or sale value. Is there anything we can do to right this other than complain about the dealership to Ford or write a bad review? Is there any way for us to recoup our loss on value of the car? Edit: thanks for all the responses! A key question we have is whether we have passed the SOL, as consumer fraud is 6 years in NJ but I'm unclear on whether the discovery rule applies. The other thing is since it's been so many years, we didn't keep the original full sale contract, we only have a copy of the retail installment contract stating the financing price and cost breakdown, dated the day we bought the car. Edit 2: just looked at the Carfax report again and there was a police report on the crash. I recently moved out of the house my Fiance and I bought in 2019 simply due a relationship break down. Recently he asked me to sign a quit claim deed in order to proceed with the refinancing(Its currently in the mail). He says its required for him to continue. However my grandmother has told me not to sign it, saying that while it will remove my name from the title of the home. It will not remove me from being liable should he fail to pay on time. The house also just came out of forbearance, an option our bank (Navy federal) gave us at the start of this. My question is, is there anything I can do to protect myself should I sign this deed and he falls back on the house payments? Is he even able to refinance after the home has come out of forbearance (with a balance that is over $5k to pay back). I was immediately taken by surprise because some of the times listed for the complaint were from when I was on a business trip. I informed the management office that it could not have been me and they dropped it. However, a little while later, this happened again so I asked them to tell whoever was emailing to knock on my door next time so we could stop the noise immediately if it was coming from my apartment (or confirm it wasn't me). A while later, I got a knock on my door from my downstairs neighbor telling me she was hearing noise from my apartment. I was sitting down eating dinner and watching Netflix on my phone so I know it wasn't me. I gave her my number to make it an easy text to confirm if it was me or not. All was fine until last night. I had a very small number of friends over to play poker and chat. I got a text from my neighbor complaining of noise so I turned off the small speaker I had on the counter. An hour and a half later, she texted me telling me she was still hearing noise and was calling the cops. However, at this point all of us were sitting down with no music on playing a game with each other on our phones and making no noise. I'm worried that if she keeps filing complaints against me despite the noise not coming from me that my apartment complex would have the right to evict me due to the complaints. I'm also worried that me constantly explaining myself and that it's not me to the office reflects poorly on me and could hurt the reference I would have for my next apartment. I have finally accumulated enough funds and courage to start affording my own stuff, and have found someone to room with when I move out. I was so hopeful in being able to escape my emotionally abusive family and leave them in the dust. Unfortunately they found out my plans and made a huge fuss about me "being deceitful" and whatnot, so to prevent me from moving out, they hid my keys and parked a car behind mine to prevent me from just leaving it. They said the only way I would be able to move out is if I signed a contract where I give them my address and promise to remain in contact with them once I've moved out, and to enable tracking on my phone, so that if I ever am to try to cut contact, they come to my location and bring me back home. I told them that they can't do this but they said that because they are my parents and that I have Asperger's, that I need to be monitored and guided for the rest of my life (untrue, even after all their attempts to handicap me). When I was still a baby one of my parents killed the the other and tried to kill me. That parent is in jail with a life with no parole sentence. As part of the sentence that parent was permanently banned from ever contacting me. I was raised by members of my deceased parents family with no communication from my other parent or their family. Now my question: I want to talk to my parent that's in jail because I have questions and things I want to say. I've thought about this for years and it's something I want. My parent in jail has all their mail, calls and visits monitored by the jail. Because there is a no contact order against my parent and also because I was a victim and a child at the time I can't visit (my application to be on the visitor list so I could visit was denied and so was my appeal). I am also not allowed to send someone like a lawyer on my behalf because indirect communication is also banned under the order. I would prefer an in person meeting but even my calls to the prison are not allowed and my mail is not delivered to my parent. I just want one conversation. I don't want the order removed, I know there's no chance of it happening. Does anyone here know a way I could have a one time exception made to the no contact order so I can talk to my parent in jail? So far everything I've tried has been a dead end. Posted: 25 Oct 2020 05:50 AM PDT NJ So we moved into this apartment August 2020. From day one, our downstairs neighbors have played incredibly loud bass heavy music. They would play it for hours during the day and it would shake my floor and walls and I'd have to leave my house to study. They turn up their TV incredibly loud and it wakes my two kids up. They do construction projects well after midnight. We tried talking to them. We tried. The first two times we were able to get them to turn it down. But after those times they'd straight up ignore us if we knocked or said anything about it. Finally we took it to the landlord. She said that we weren't the first tenants to have this complaint. The last tenants moved out over the constant excess noise and that she can't keep losing tenants over it so if they continue after she talks to them then she'll have her lawyer issue a C&D and take steps to evict. She just told us that she wanted us to maintain recordings and a log of the noise. So that's what we've been doing. Last night it was particularly loud and bass heavy, so when I went to take the trash out I recorded that the noise could be heard from outside. I guess they saw that I recorded it. They came upstairs to my unit and knocked on my door at 11:30 to scream at us over it. They kept reinforcing that our complaints had no merit and that everyone's allowed to make noise. They tried arguing with us for a good ten minutes. Now I don't feel like my home is a safe place. They came upstairs to literally argue with me and my husband while my kids were in their room. They actually left their own kid alone in his room to come do this. I'm considering breaking the lease because I know that the last tenants had an issue where these people physically assaulted them. I didnt care too much because i felt in my gut it wasnt going to last due to a variety of reason but the big one being there was no way communication between us would hold for a variety of reasons. It died shortly after because the project we were going to start with failed and as such we kinda drifted apart and while we were keeping our ears open for potential work for the company we though we had heard nothing. Well turns out 3 months ago one member did find a investor who wanted to invest 10k into us and he signed a contract. I was told about this 2 weeks ago and was told "it isn't official yet" and as such I thought it was a idea not a actual contract that had been signed. Then today it turns out were getting the money from the investor who we apparently signed a contract with, 3 months ago. Id actually be grateful if it wasnt for the fact the guy who signed the contract and whos money the account is refusing to let me see the contract or the letter of intent or meet the investor or actually tell me what this prototype is were supposedly working on. Combine that with the description of the terms being (actual quote from the text after several hours of begging him to tell me) "so this guy is going to give us 10k to do with whatever we want and all we have to do is give him a prototype of whatever we make" and I'm a little paranoid. If it turns out that the guy who signed the contract fails or even rips off this investor can i and the other members of the llc be held liable? Foundation collapsed, what are my options? Posted: 25 Oct 2020 11:49 AM PDT This is in Georgia. Story: I hired a company to rebuild the foundation after a collapse in my house a couple years ago. After the recent hurricane, it collapsed again, and the bottom floor was filled with water. The company has a warranty to fix the foundation, which so far they are honoring. That's good, hopefully I can at least have a house I'm not afraid to walk in soon. But my question is around all the other damage. The carpet is a loss, the drywall should probably be replaced, and if I really had my way, the entire downstairs would be gutted to make sure there's no risk of black mold. I checked with my homeowner's insurance, and they count this as "flooding", even though there was no flooding on my property per se, just the failure of a foundation wall. So since I'm nowhere near a flood plain, I don't have flood insurance and that appears to be a no go. I've looked at FEMA disaster relief, and since it was related to a hurricane, that might be an option. This will be the last step in any process, since their paperwork requires I exhaust all other options first. I have not yet had a conversation with the foundation company about if their warranty covers all these damages from their failed work. That's on the agenda, just not a conversation we've had yet. Question(s): Are any other avenues I should be checking as options to be made whole by this? I'm open to hiring an attorney if needed, but I wasn't sure there was a need yet, or anything one could do. I want my future child to end up with my aunt if anything were to happen to me. I have other closet family but I do not want my child to end up with them, like my mother father or grandparents. My aunt lives about an hour away but I would not trust my nearby family with my child. My aunt is financially stable, has two kids, is an amazing parent, is mentally stable, and I trust her. The property is located in California, has been paid off and does not have any outstanding fees due. Backstory: In 1999 a Grant Deed was recorded where a Mother (M), an unmarried woman, granted her three married sons (A, B & C) the real property reserving a life estate unto the grantor. In late 2013, C gets into dispute with M and is taken to jail on 4 felony charges
The case ends in Not Held to Answer - Discharged because M did not want to continue with the case. In early 2017, M was diagnosed with Alzheimer Disease. In early 2018 C took M to a notary, where a new Grant Deed was recorded. In the new Grant Deed the Grantor, M, grants only C and his wife the real property declared as a bona fide gift exempt from the documentary transfer tax. In the new Grant Deed, her last name is not spelled correctly, like it is in the original 1999 Grant Deed. On the document, the notary also states that the person, M, who appears before the notary, "acknowledged to me that they executed the same in their authorized capacity"; this cannot be true since she did not speak English and could not remember members in her family due to Alzheimer Disease. In late 2019, M dies and her death certificate is recorded with the same last name as the 1999 Grant Deed. In Oct 2020, A & B find out about the 2018 Grant Deed. While i know work place etiquette is to not talk about pay, ive always been told it is legal to do and an employer isnt allowed to stop you as per some government law.
