She's abusive, yesterday she threatened to have him committed because his tone was rude when she broke into his apartment for a "wellness check" while he was asleep. He has been suicidal, he's traumatized, he's disabled. He can't work, he's on SSI. He's autistic with an executive function disorder, he does need help managing his meds and sometimes with cleaning, but her being in charge is a constant threat to him. I'm more than capable of that, I've been working at a conservators office for six months and I'm starting a course about the scope of duties. My question is, can a voluntarily conserved person revoke conservatorship at will? Can she move to have him involuntarily conserved? Posted: 05 Jul 2020 08:20 AM PDT Ex: I worked 50 hours this week. 10 hours of overtime x 1.5 = 15hours of regular pay. If I regularly work 40 hours then I would only work 25 the next week but would get paid 40 from the 15 hours of "overtime" from the previous week. Could I file a complaint with DoL for making false timekeeping records? Or for incorrectly compensating employees for OT worked? EDIT: There is some confusion. We are getting paid correctly but is suspicious as they don't mark OT pay as OT pay on our itemized wage statements, it is instead compensated for using the method I listed above. One day I showed up for work and my manager told me I no longer work there since "I resigned". I knew they were doing this to basically fire me/lay me off, without being liable for unemployment. So I made sure to go back and forth with the boss, via email, stating I never had intentions of resigning and if they have any proof of me resigning please offer it. Obviously he had none since this was all staged on their end. This all happened about a month ago. Recently, after filing for benefits, I got the interview request from IDES, and on the document it shows that my employer is claiming to having to terminated me to due to "misconduct"! I NEVER have conducted any misconduct and have no clue what the employer is talking about. Its obvious this is another one of his petty attempts. Basically my question is, How should I approach my interview? I want to make sure I present all the facts and details about the case. And make sure IDES understands my employer is a lying sack of sh*t. Also would I be considered to have been terminated or laid off? TLDR; Employer terminated me, however claims that "I resigned". I claimed UI benefits and my employer contested it, claiming that I conducted "misconduct" to IDES. Apartment flooded with sewage, Landlord refuses to take it seriously. Posted: 05 Jul 2020 06:37 AM PDT I live in Brooklyn NY and yesterday morning on the Fourth of July my partner came out of the bathroom asking me to unclog the toilet. I told her I hadn't used the bathroom today and went to check our toilet and it was filled nearly to the brim of brown water. This was incredibly concerning because A) neither of us had even used the bathroom yet and B) about a month ago we had a very similar plumbing issue that resulted in our bathroom flooding with raw sewage after my landlord hired a plumber who didn't own a snake to come fix our apartment. He then hired a regular house cleaning lady instead of a bio hazard waste removal crew to clean our bathroom which resulted in me having to clean up a lot of excess sewage and human waste off the walls and floors of my bathroom. This incident not only flooded our bathroom but resulted in the lobby of our building being flooded as sewage poured out of a light fixture in the ceiling. Clearly a problem with the buildings pipes. So fast forward again to yesterday and we are both having anxiety attacks about this because of the last time we experienced it. I begin trying to call my landlord and my partner begins trying to call our buildings super through our landlords company's "emergency line". My partner got ahold of the super who said it was a holiday and we would have to wait until Monday to get somebody into the apartment as no businesses are open. We told him we had a plumber and a biohazard waste removal crew on the way and that we just needed approval on the cost but he insisted businesses weren't open and wouldn't budge. My partner told him if our building was on fire he wouldn't say it was a holiday and to wait until Monday which prompted him to hang up. At this point the toilet was flooding, the bathroom had a half inch of sewage and it was leaking into our hallway, bedroom, and entrance of our apartment. The ceiling in our lobby was also flooding water like last time. I called my landlord 30+ times and he didn't answer, I sent him a text pleading to pick up as there was an emergency, but no response. The plumber arrived at our apartment but informed us he couldn't snake the drain without removing the toilet as it was a problem with the buildings pipes, not our apartments toilet, and removing the toilet would cause a ton of extra raw sewage to flood out. The cost of him snaking the drain and the cleaning crew coming is upwards of $4,000 on a holiday which we don't have lying around so we couldn't go forward without our landlord signing off. The plumber left and we had to get a hotel room and vacate our apartment after moving everything off the ground in case the flooding continues, and asking our neighbors to refrain from flushing their toilets as this is what seems to be causing the flooding. We talked to the super one more time and asked him to please take care of this as soon as possible the following morning (now) and he said yes it will be handled at 8AM tomorrow, we have him permission to enter o it apartment if we weren't there and went on and tried to enjoy the rest of the evening. My landlord texted me at 10PM saying "Hi". I immedietely responded explaining the situation, explaining the cleaning crew and plumber, and explaining that we want this handled as soon as possible so we can return to our home, he didn't and hasn't responded. This morning my partner called the super again at 9AM asking if this would be handled or if we would have to extend our hotel stay and he said it would be handled but said he would again have a regular cleaning lady come and we insisted it be a biohazard waste removal crew as it is raw sewage and needs proper removal. Landlord still hasn't responded. What can we do about this? I've never taken somebody to court. Do I need a lawyer? I don't know that I can afford that. We are moving out of this apartment at the end of the month and it almost doesn't seem to be worth the trouble but I'm tired of landlords like this getting away with incredible negligence (we also have black mold in our cabinets we notified our landlord of almost 6 months ago and he has yet to replace them, my partner has asthma). Last yaer I installed solar and got a big credit. My refund was $34,000 but I owed 9500 in state taxes, and the state payment deadline was extended due to COVID until July 15. I also financed the solar for free for a year and owe $16000 on July 15. So I owe 25,000 on July 15 and I need my refund to pay these things or I will incur penalties (a sizable one for solar- $2000 if I dont settle up by then). I also have to pay my 2020 quarterly estimates and can't because due to COVID I got hit hard for Q1 and Q2. I filed my taxes on April 8. There is nothing weird about my taxes - no real business expenses, nothing fishy, but frankly I dont even care if they audit me, I just want them to communicate and explain why they are refusing to give me my money. I called the taxpayer advocate twice and left messages. I called my accountant who said they hold returns that claim the solar credit sometimes. In the will, he left basically everything to me. We were essentially each other's only family, he didn't really speak much to his parents at all, and they were strongly disapproving of most of his life choices when he was alive. His family has been contacting me telling me to give them certain things that I'm reluctant to give them as they're outlined specifically in his will AND are very meaningful and important to me, and they're also asking for some of his remains, which he specifically also put in his will and that he told me before death he didn't want any going to them because he didn't want his remains being used in religious rituals (common culturally for him) because he was strongly against religion in general. I told his parents that in the interest of respecting my BF's final wishes, I couldn't give them those things. I did offer a few things that weren't specified that I was just keeping and saving I guess to show our child (I'm pregnant with right now) when she's older. His parents said that I had to give them to them because we weren't married when he died so his wishes in the will mean nothing. We did the will by ourselves and then had it notarized, but there was nothing really complex in the will (our apartment was in both names, no vehicles, no large sums of money, just his stuff), and I'm worried now that it's not as legally binding as it should be. I can't really afford a legal battle, we're young, I'm expecting this baby, and even though he had money in savings, it's not a huge amount that could fight something like that. so my question is fairly simple: is a notarized will final? do the wishes of the living override a will and if so, what's even the point of having one? Help. My employer retaliated against a Covid-19 complaint. Posted: 05 Jul 2020 09:08 AM PDT I'm an employee at a LA County restaurant in a small chain of 6 restaurants between 2 states. Yesterday, I was sent home for addressing several violations of compliance with the local COVID protocol for restaurants. All aspects of the COVID-19 protocol were supposed to be implemented before reopening, included but not limited to training of the protocol and implementation of COVID safety precautions and COVID-based hygiene which is not the case at the business, in conjunction with the lack of leadership to enforce it. We're doing a few things, but they are bare minimum and are not even applied correctly or enforced. Yesterday, I was vilified during a meeting and sent home for refusing to resign, and for continued assertion of lack of safety for me and my coworkers. I've tried everything. I've submitted formal complaints to the local health department as well as contacted local politicians, state politicians, and the city manager's office. Nothing has happened. I feel so vulnerable and now I'm being investigated by our HR department for "behavior unbecoming of our company standard". I'm so desperate that I've reached out to the celebrity chef part owner on Instagram. Again... nothing. I do not know what to do. Please help. I am so scared of getting sick and/or losing my job. Either one could be a death sentence with how long it's taking to get onto unemployment (I'm hearing it's taking over a month and I don't have the savings to survive two rent payments, let alone bills.) Is it legal for a building to be inaccessible to police and EMS? Posted: 05 Jul 2020 09:04 AM PDT I've unfortunately had to call 911 a few times since living in my current building and have noticed something. Police and EMS cannot access the building without a tenant letting them inside. Is that legal? My husband had to push me out to the ambulance in an office chair once. This morning after my neighbor was screaming, abusing someone, and tried to break into my apartment I of course called the police. They called me back and said they couldn't get inside unless I let them in. I'm severely disabled and my neighbor was running around the hallway screaming threats just after attempting to illegally enter my apartment (for the sixth time) I couldn't leave my apartment safely to let them in. So they left. And she's still losing it. They said many people have called for her and they know her by name. Is this legal? Shouldn't emergency services be able to access a building?? Exactly $30 does not seem like it accident (The bill went from $182 to $212 so it's not like the server accidentally hit the wrong key). I wasn't given a receipt and after calling they said they can't find a receipt for it. They are not being helpful in recovering my money. I paid with my Venmo card and I did not have enough to cover this extra $30 so they locked my account. Mom’s taking me to court for 3rd time in 3 years. Help Posted: 04 Jul 2020 09:48 PM PDT I live in Canada, Alberta. My mom and I had a falling out over her disrespecting my husband and I as parents and refusing to listen to us. She threatened me for a year to take me to court, attempted to guilt trip me, accused me of using my kids against her (I literally said I just wasn't putting up with her emotionally abusive behaviour and until she could respect us as parents we'd have nothing to do with her). Got served court papers with 48hrs of my youngest being born. Got a lawyer, avoided court, made a supervised court order visitation with all communication to be done through email. Year and a half of having to put up with her emotional abuse and treat us like garbage while she continued to do her own thing with our kids, always threatened court. I feel I suffer a form of ptsd now whenever I see someone who looks like her I get anxiety, sometimes I freeze up and it takes a lot of strength not to run and behave like I'm fine. 2nd time she served us court papers 1 month after our wedding. Social worker was interested to see it go to court, but mom lawyered up and had an in person meeting. I barely said anything except to clarify something, felt I was positive. Didn't stop her from freaking out on me, calling me a liar, using the kids against her, etc. You know it's bad when both lawyers in the room are telling her to stop her behaviour. For my sanity it was stated in the new court order that my husband would take over all communication through emails. Did not stop her from attacking me, making accusations of me writing the email when it was my husband. Now we have COVID pandemic going on. Our side of the city is said to be a hot spot. I was diagnosed with asthma last year, my eldest (6) has had pneumonia and severe croup, and my youngest (3) is severely allergic to peanuts and known to have random allergic reactions due to really sensitive skin. Husband is a trucker. So, with discussion from my lawyer we began self quarantining, informed my mom that we would resume visits once the pandemic is over. No family or our friends has seen my kids since the start. Today my mom showed up unannounced to serve us our 3rd court papers. Since she is quick to flip her switch I told my kids calmly to go upstairs to play. I will be haunted by seeing them afraid, to see them hide under their beds despite my best to reassure them everything was fine while my mom pounded on our door and say to us to open because she knew we were home. My kids haven't mentioned her at all since we self isolated. They say how they miss my husbands parents, brother and his family, their friends, our friends who they get to see like 3-4 times a year. They miss the dog that lives with my mother over her. I've tried saying if the dog wasn't there, but they would still see grandma would they want to go. I get the answer not really or a half hearted yeah. The reason stated that she's taking us to court says that she believes we are using COVID as an excuse to cancel visits with her and that she has rights to visits and the kids have rights to know her and that side of the family (I've been alienated thanks to her crying to most family about how mean I'm being to her and without asking anything from me they've sided with her, however I have some family that she doesn't talk to and I'm free to talk to and do, my eldest has some cousins on kids messenger). I believe she is also angry over the fact that we did not revisit the court order like discussed, however this is on her because she let her lawyer go, refused to get another one and my lawyer said unless she has a lawyer for a sit in meeting, it wasn't happening. She's refusing to get car seats and has stated that she believes we should be providing them (we've stated wear and tear on our seats is why we don't wish to continue to use ours and she was suppose to make an effort to get her own, she didn't. If she had made some form of effort we would've been willing to work with her and help her) she also wants to add police assistance to the clause. I strongly believe this isn't about the kids. This is about control over us and getting what she wants when she wants and doing what she wants. She has done nothing to show how interested in the kids she is. She doesn't ask how they are, what they are doing, wish them happy birthday or happy holidays, nothing. She just demands more and more time like she's a divorced parent, not a grandparent. He is technically a salaried worker, but he must work 40 hours to get his full pay. If he doesn't meet 40 hours, they take his sick time if it is available, even if a superior tells him to leave. His director approached him once and offered to let him go home early one day, and he of course said yes, and the aftermath of that is how he learned that they take sick time. If he doesnt have sick time, his pay is docked. If he works more than 40 hours, he does not get any extra pay. He regularly gets called in for mandatory meetings on his days off and does not get paid for that time nor is he able to go home early on another day to make up for it. I know that being on Native land, they are exempt from most if not all state labor laws. Is there any case he can make for this issue, on the state or federal level? He cannot go to HR. They never go against upper management. Even if he tries, not only will HR not do anything because of company politics, his director will retaliate and face no accountability because of aforementioned politics. He already treats him like garbage as it is. ETA He is middle management of the building maintenance department, which is responsible for all mechanical and electrical repairs/maintenance. He delegates duties to subordinates and oversees their work, but does hands-on work himself as well and is assigned to lead certain projects on a case to case basis. There are 2 levels of management above him, the director and the big boss, but the big boss is only really there to tell the rest of management what to do. Posted: 05 Jul 2020 08:47 AM PDT I live in Kansas in an apartment complex that flooded on the 27th. Nothing too bad (at least for our unit), mostly just the water creep in most the rooms. A maintenance company has been in several times to put in fans and a dehumidifier. On the 3rd it flooded again. The same group came in and added a couple more fans and another dehumidifier. These have been running 24/7 since the first flooding, and it also throws our AC out of whack, making it run more often than it should. I've turned up the temp, but I can't turn it all the way off because of Kansas summer. This leads to the actual question. I'm a little apprehensive about what the electric bill is going to be like when we get it. Naturally, if it's only an extra few dollars or so, I won't complain. If it happens to come out reasonably more expensive due to all the fans and such, does management have any obligation to cover the extra costs, or should I just suck it up? A field technician who frequently volunteers to take an overnight job (same employer) that goes from one day to the next. I visit numerous job sites for different clients, but am on the company clock the entire time. Regularly working 50-60 hours a week and I feel like this isn't right. And if it is, I feel like it shouldn't be... Here's the set up: 1) "New Work Day" starts at 0500 everday. 2) If I start my shift at noon and worked a 20 hour shift.... I start Monday at 12:00 and end Tuesday at 06:00.... they tell me I get regular time for first 8, then 1.5x for 8-12 and 2x anything after 12- Pretty standard and by the books (yes I get my lunches and breaks etc....). 3)Here's my confusion... My company tells me when the new day starts at 0500, my pay rate changes back to straight time because it is a new day. 4) So even though I'm working a straight 20 hour shift.... despite going into the new work day.... this is my pay structure: 1x-8hrs, 1.5x 8-12hr, 2x 12-17hrs, 1x 17-20hrs. Is that right? In California, Does the pay rate change based on the start of the new day, or based on the duration of my shift when it ends? Meaning even though it's carried into a new day, I'm still working on a 20 hour shift and should be entitled to that continued 2x overtime rate vs a new day at straight time? I've tried calling up discover, and they say that this is something I have to fix with xfinity directly. Do I have a valid complaint against real estate broker? Posted: 05 Jul 2020 08:36 AM PDT I became a real estate agent in Texas two months ago and joined a small broker. In the agreement I signed there is a 85/15 split but the first three sales would be under the "mentorship" program where I would give the broker a 70/30 split for all the extra work they would do to coach me through the deals. I ended up getting my own lead which produced a sale of $910,000. I paid my broker 30% of my commission ($4,000 more than I would have paid). The day the house closed the broker informed me that due to Covid-19, the broker can't maintain the business and they are shutting down in 30 days. Do I have any right (legally or ethically) to ask for the the extra 15% back or some portion of it? I feel I agreed to be pay this extra fee for the long term investment in the company and now they are leaving me. They offered to pay back the $150 initiation fee which seems to support the idea that they did wrong and should pay back fees that I paid with the expectation that I would be with them for an extended period of time to reap those benefits. There might also be evidence showing they didn't fulfill their obligations for certain training requirements in the mentorship program. Do I have any justification here or am I just out of luck? In July 2019, I settled the claims directly with their attorney for a $2,700 cashier's check. They then countered asking for more money by adding a second claimant after we settled, and proceeded to sue me when I would not provide additional settlement money after our agreement was satisfied. My Progressive-provided attorney eventually settled the matter last month (for both of the State Farm customers) for the balance available on my policy alone. The final settlement documents reflect that settlement was satisfied with only my policy balance (and not the $2,700 I sent in 2019). However, State Farm attorneys still have my $2,700 cashier's check and will not return it to me. Since the State Farm attorneys are in possession of $2,700 of my funds that were not utilized as settlement in their case against me, and as this is a cashier's check that was not lost or stolen (and therefore I cannot go through Bank of America to cancel it), how do I get my money back? Should I pursue other remedies, interest, etc? I have proof that the settlement check was received by their attorneys, including delivery records and email confirmation from them, before they proceeded with the suit. [link] [comments] |

She doles out the money to me occasionally when I need to pay for classes or my bills (credit / phone / whatever else). She has said she will give me this money when I graduate college and get a big boy job to her satisfaction. She has said if I am still working retail (i currently am still working) after college she will not give me the money, regardless of where I live. However, she also threatens to not give it to me and even threatens to kick me out if she even feels like I am not fully agreeing / cooperating with her. Go out when she doesnt want me to, disagree with her on the smallest thing, etc... the threats start coming out again. Recently things have come to a boil when she said we should go to a concert in another state. At first I agreed because I was not really thinking too hard about. But after a moments thought, I was like wait thats dumb. I went to her just saying, hey should we really do this, COVID is bad and only getting worse and no masks.... you get what I am saying. I only voiced my concern never said anything about her. I may as well have called her the dumbest bitch. She cussed me out left right and center. So my questions: can she kick me out willy nilly? Emergency Maintenance Not Coming to Apartment Posted: 05 Jul 2020 09:22 AM PDT Hello r/legaladvice Yesterday my boyfriend and I noticed that one of the roof mounted hooks in our room began dripping water. As soon as we noticed this we called the main office (our complex has no 24h emergency number) and asked them to send maintenance and even told them it was an emergency. Hours passed and we received no call or person to our door. The water had stopped to drip for a while but someone still needed to look at it. Around 7PM (approx 6 hours after initial call) water started dripping again and we called them again. The lady on the phone sounded upset like she had told a maintenance person to go and they didn't and told us she'd call them again. Few more hours pass still nobody, we call again and are sent straight to voicemail so we leave one. The water continued dripping all night which brings us to now when we noticed the hook is now protruding down from the roof more revealing the hole it was mounted in with the roof around it looking yellow and wet. We called again, got voicemail, and are now waiting for them to open before we call a 5th time which we will record (in Colorado which is 1 party consent). My question for advice, or questions, would be: With 1 call recording, logs that previous calls went out, and 2 video recordings of the dripping and degrading quality of the hook is that enough evidence to take these people to consider a lawsuit if they try to charge us for the repair? Also, is it legally required for an apartment complex to have a 24 hour number or some way to get emergency maintenance regardless of the time? Edit: To add onto all of this I just remembered we don't even have our lease to reference. We signed the papers back in December but the guy who was supposed to give us our copy died and even though we have requested our lease multiple times we still dont have a copy. [link] [comments] |
How do I know what type of lawyer to hire? Posted: 05 Jul 2020 10:12 AM PDT I have a friend who is currently going through a battle with DCF (department of children and family) after they had money taken from a trust to pay her foster parents regularly when they were supposed to be putting it aside in an account for her. I randomly checked my banking app and saw that there were pending transactions at a hotel chain in 2 different locations for a couple hundred dollars on my CC. I called the one in a smaller town because it was the only one of that chain and told them about the unauthorized charges. I spoke with the manager and she told me that the person had used an ID that matched the credit card. The bank that my CC is pretty small and is closed on Sundays so I cant get in contact with them. I did notice that the hotel in the bigger city had cancelled the transaction on their own with out me needing to call but the small town ones have gone through. What do I do and how do I stop anything worse from happening especially if they have a fake ID in my name? Should I call the hotel back that told me about the ID and see if the person is still checked in (I dont even know if they would give me that information) and call the police? Should I wait until my bank gets back to me tomorrow and I get my money back? [link] [comments] |
