Just received a communications from a supplier threatening a lien due to non-payment by the contractor. Contractor stiffed the supplier, and the invoices are all in the contractor's business name. Obviously I don't want to pay twice for the same material, but besides negotiating the cost down, I'm not sure what my options are.

Edit: thanks for the replies all. A few supplements: 1) the contractor in question is the GC. 2) the GC had two checks bounce at the supplier prior to them reaching out to us, via phone call and email, about the amount owed/lien warning.

I (23F) secretly married my husband (26M) when I was a teenager partly to help him get his green card. Now that I want a divorce, he is threatening to “out” my secret and get me arrested (USA)

    Posted: 30 Jun 2020 08:04 AM PDT

For the purposes of the post, let's call him "W." First a little backstory:

So when I was 18, I was dating W and I thought he was pretty amazing, nice, I got along with his family etc. His family had come here "illegally" when he was very young from south of the border, but it wasn't a sure thing he would be protected by DACA. We (his family, us two, my parents) decided amongst us that I should marry him so that in time, he would be able to get his green card and have a path to citizenship. I know, not the smartest move, but I was 18 and my dad was best friends with his dad and influenced me a little there too.

I wanna stress that AT THE TIME, I fully expected I would be spending the rest of my life with this man anyway. I was in love, and so I decided to just say fuck it and married him in a small, hush-hush ceremony. I figured what's the harm, maybe years down the road we can have a proper wedding and stuff.

After that, the way he and his family treated me changed entirely. The years since then have been absolutely shit. We have passed the interviews with immigration, we keep up appearances, pretend to live together and love each other but in reality I hate him, and have hated him for a while now. His family has been disrespectful, he has been physically and sexually abusive, and the stress from having to live with this secret has basically ruined me. My mental health was awful and I couldn't even tell a therapist about any of this, as they are mandated reporters and I was scared of being charged with a felony. However, I figured since I gave my word, I would stick through it until he got his green card and just divorce him afterwards. I did not want anyone getting deported because of me.

Well after our latest fight, I have decided I can't keep this up anymore, and am seeking to get a divorce from him, no matter how badly it screws up his life. As of now we needed to go six or so more months, but i have had enough. I told him, and he is saying that he has screenshots of texts from me saying the marriage was a sham, that none of it was real, etc. which I don't doubt are things I have said over our many fights in the past few years. He's saying if I screw him over by going through with a divorce, then he will do his best to screw me over as well by releasing those texts.

My question is, would these actually get me in trouble? I don't plan on telling a divorce lawyer any of this backstory...should I?

In my mind, I had the right intentions with this marriage because I actually loved him and planned on being with him forever. However, I felt afterwards that he and his family had used me, and after that initial year we have both had other partners, and basically lived our lives separately while pretending to be a happily married couple. Does that implicate me?

I'm so confused, afraid, and stressed and I just don't know how to get out of this mess I got myself stuck in. Can anyone here please help?

EDIT: Thank you so much to everyone for their responses, you are all very kind! This has all made me feel much better about the situation

Someone claiming to be my wife scheduled a vasectomy for me. I'm single, and I've not been to that hospital in 4 years.

    Posted: 30 Jun 2020 08:08 AM PDT

So the hospital in question, I had not been to it in roughly 4 years. I had gone to the ER after an accident at training with the national guard in another part of the state.

Today, I received an automated text from their Urology center about an appointment tomorrow afternoon.

I called them, and they told me a woman claiming to be my wife had scheduled it with my name, DoB, and cellphone number. I told them that I am not married and have no interest in a vasectomy, ever. They canceled the appointment.

The last doctor I saw was at a local urgent care that's not in the same Healthcare system as that clinic. They're two separate entities.

Do I need to file a HIPAA complaint? Nobody outside of the Healthcare organization, my chain of command, and Battalion would have known of this ER visit back then. What should I do?

UPDATE: I contacted the Hospital's privacy office and told them what happened. The lady on the other end said that when I went there in 2016, they misspelled my last name to one that's much more common (I get that a lot actually), and she suspects the clerk handling appointments got mixed up. That said she said she'd contact the clinic, have them contact the lady who called them for the appointment, and verify that this was just a clerical error and not fraud.

Fertility Clinic Transferred the Wrong Embryo Into My Wife

    Posted: 29 Jun 2020 02:42 PM PDT

I am 100% in shock and completely livid right now.

My wife and I are going through IVF right now trying to have our first child. My wife has already been through an egg retrieval surgery, we've waited for the fertilization process, the whole nine yards. Well, the embryo transfer just occurred this past Saturday. We supposedly had 1 viable embryo to be transferred and were not expected to have any to freeze (5 poor quality embryos). We just received a call today that the embryologist and the laboratory "made a mistake" and transferred one of the "poor quality" embryos into my wife which was scheduled to be discarded. Our doctor has informed us that in all likelihood, this will either result in no pregnancy OR it will result in a miscarriage and that it is unlikely to result in a successful pregnancy. On top of this, they decided to monitor our embryos for an extra day and ended up freezing the embryo that was supposed to have been transferred, were also able to freeze one more that improved in quality (after they told us they were going to discard the poor quality embryos). However, we were told these two embryos now have a 10% less chance of resulting in successful pregnancies due to being frozen a day late.

Thus far, they have told us they will be "investigating the issue", however have offered us nothing in regards to compensation or support. Our doctor told us she is going to try petitioning to the company to pay for our next cycle, but to be honest, more needs to happen for me to feel comfortable. This is a HUGE mistake in a medical field which has ZERO room for these kinds of errors.

As everyone knows, IVF is an extremely emotionally and financially draining process. We are lucky to have decent insurance that covers a lot of out pocket costs, but it's still expensive regardless. My wife and I are completely heartbroken over this and we're trying to figure out if we should seek legal council for this and what we might expect if we do.

Any advice/recommendations would be greatly appreciated. We live in Massachusetts, USA.

Rental Office says that 300$ of the 750$ "Security Deposit" is not Refundable and goes towards "fees" (haven't signed yet) Is this legal?(Cordele, GA)

    Posted: 30 Jun 2020 09:02 AM PDT

Hello Reddit, Me and My fiance are moving to be closer to my Fiance's family. They have been helping us find potential rental properties to look at and one of them seemed to be a right fit, but this new information about the contract leaves a real bad taste in my mouth and sets off some flags for me.

From what I understood of Security deposits, they are refundable at the end of your lease, or in some cases are used as last month's rent. Money may be deducted from the security deposit if there are damages to the property, or it was left in an untidy state requiring cleaners to be called. And from what I also understand, an itemized receipt for all deducted funds must be presented for the deduction to be legal.

I called the office to ask questions, because we will be leasing for a year and I want to know what I we are agreeing to for such a long period of time. I asked what will be done with the security deposit, if it is last months rent, or if it will be fully refunded upon a clean inspection after we leave. I was told that 300$ of the deposit automatically goes towards "fees" with no real explanation of what those "fees" are besides an offhanded comment about paperwork and "registration"

they are saying the "security deposit" is 750$ and have no listed separation from the security deposit and these "fees".

Can the Rental Company take money out of our deposit for these supposed fees right of the bat before we even move in?

(it's in the title but I will also state it here, this is in Cordele, Georgia.)

[CO] Landlord sent my sensitive information to future roommates

    Posted: 30 Jun 2020 10:47 AM PDT

I took over 6 months of a lease under a sublease agreement. I have 2 roommates who have been there longer.

During my screening process, the landlord shared the detailed results of my background check with the roommates. Landlord also shared screenshots of my emails with them that contain information about my personal finances. They also received a full-color scanned copy of my driver's license via email.

This feels like morally inappropriate stuff to share but I would like to know if there's any legal violation happening here.

    Thanks all

Online slandering from reddit is destroying my personal life and career

    Posted: 30 Jun 2020 01:11 AM PDT

About a year ago I had a boy who was obsessed with me, and when things didn't go the way he wanted with a relationship he blasted me all over Reddit. This included photos of me which are not naked, but not something I am comfortable with on the internet. Along with a written Post of complete slandering lies. This thread of posts got taking off reddit after all my info was released and I was getting harassed none stop. However it was uploaded to another webpage that I am not able to get this content taking down from. It is one of the first searches when you look up my name. Is there any legal action I could take to get this removed as it has been starting to impact my personal life again. I don't have a lot of money as I already tried seeing if I could buy the website or pay to have it removed however that has gone nowhere.

[USA, AR] A law firm is saying that I need to give them an original version of my father's Will to finalize some inheritance issues. But I don't have the original. What can I do?

    Posted: 30 Jun 2020 10:11 AM PDT

I'm in Arkansas. My family gets some annual income through a farm we own and it use to go to my father. But he passed a few months ago. It's stated in his Will that I inherit his shares of the farm money.

However, the firm that handles the farm stuff for us is saying that I need to give them the original Will to verify this, which I don't have. But I do have copies of the Will. They told me the original should have blue ink, if that matters.

If I can't find the original Will what steps can I take next?

    Thanks.

    Single mom in Texas

    Posted: 30 Jun 2020 10:19 AM PDT

I'm going to keep this short and simple. (My daughter's dad is not involved at all) ....We live at home with my parents. I do have some mental health issues I am dealing with (Bipolar depression, anxiety, ADD) and I've already seeked help and working on them.

My mother and I do not get along at all. We constantly headbutt over my daughter. She is very controlling person and likes to remind me how bad of a parent I am among other things dealing with my issues. She is always threatening to take my daughter away from me. She is convinced that if I decided to leave that I would not be taking my daughter with me.. I want to know what kind of rights I have and what rights as a grandmother she has. She is very convinced there is nothing I can do and she would call CPS or take me to court for her.

I watched a drunk girl hit a parked car

    Posted: 30 Jun 2020 07:40 AM PDT

Fun update: I tried to look up the police report to find out more information about the incident. "An accident occurred". No DUI, no arrests. I found out the girl's name, oh and her mother happens to be the county commissioner.

Last night, I was on my way to my boyfriend's place and witnessed a car with loud, rowdy college kids in it getting out of a parallel parking spot and speeding forward hitting another parked car (petal to the metal hard). This white girl gets out and "checks for damage" while freaking out and there's about 4 other people in her car telling her to get back in and go. I started recording her license plate number and she comes back out and talks to me asking if this was my car. I tell her that it wasn't and I don't know who's car this is but she needs to leave her information. One of her friends gets out of the car and drags her back while I start recording and she slaps my phone away. I obviously don't let them leave and she offers to show me her license ID (which I stupidly declined) and she settles with writing her phone number on a mask and leaving it on the car. I recorded all of this. She leaves. I turn around and go back inside my house while I call the cops. I return and see the same car and as I approach the car speeds off. The mask with the phone number is now gone. (I also recorded the car being there, speeding off, and pointed out the number was gone.) I wait for the police and a white cop arrives.

The car comes back again and I point it out to the cop. The girl runs out and I yell at her for 1) hitting a parked car, 2) having her friend drag her to the car stumbling because she was so drunk, 3) REEKING of alcohol and the cop tells me to stop. I step aside while the cop gets her license plate, registration, ID etc. and asks her what happened. The cop is being extremely nice to this girl and commends her for leaving her number. I'm angry at the point because she's intoxicated and the cop isn't breathalyzing her or writing a ticket or even arresting her. He is extremely cordial with her. He comes back to me, watches the videos I have of her stumbling, admitting to hitting the car, driving away after taking the note back, and writes my information down and let's me know I can leave. So I left with the girl standing outside her car and the cop getting into his. I don't know the outcome.

Before I left the scene I left a handwritten note on the hit car. This morning, coming home around 8am it was gone. The hit car was still there. The girl's car wasn't so I assumed she was allowed to drive home drunk. Or maybe her friends did but they were all highly intoxicated. I assumed the girl, her friends, or even the cop took it. I came back to leave notes on the car again. What should I do? I don't feel that the cop handled the situation fairly. I don't have identifying information on the officer or the girl's name only her license plate number. I have a ton of videos of her clear face, slurring her words, having her friend carry back to the car stumbling, and her admitting to hitting the car as well as taking the number she left back off the car.

(Cont) Police will not help me with illegal landlord lockout - Oakland California

    Posted: 30 Jun 2020 10:19 AM PDT

OPD dispatcher said that not an emergency after cutting me off and not even listening to me. I Called non-emergency number for the second time in this whole 2 week ordeal and again, I have been waiting 12 +hours over night for them. We had to nap a few hours in the car but have not been getting any sleep or food so I'm still kind of spaced out and can't think quickly as I need to right now. I tried looking for a number for the Alameda country sheriff's office but that also lead nowhere as there is nothing in the website that says they will even help us. I have been trying so hard to avoid going over there just us two without a 3rd party, since he's such a liar I am really afraid he will make up some bullshit but I'm so tired of sleeping in the car. What should I do?

(TX) My employer moved up my resignation to the same day I emailed them my 2 weeks and work place issues. Now they keep contacting me. (USA)

    Posted: 30 Jun 2020 12:33 PM PDT

Hello, I was recently allowed to work from home because of the pandemic. During this time my job was giving my job duties to someone else, which is fair. When I told them I could come back a few days later the HR Manger ( who is also office manager, financial director and temporary general manager) sent me an email letting me know the girl who took my job duties was displeased by my work and that I had not communicated enough to her ( I have emails showing I had) and would now be "the face" of the company and will permanently take my duties. I could be her assistant. They also stated the directors were "upset" with my pay grade for months but never let me know or have a conversation on how we could remedy that situation.

Because of many reasons I put in my two weeks. I offered to help train the next employee and even write up tutorials for them. The manager was very upset and moved my resignation to the same day they received my email. I picked up my things, they only gave me less than 5 minutes and told me to get out. A week later they are asking for password information. I had not read the email and they sent another one today saying " 2ND Warning, please forward the information to the account that we paid for"

They also never sent my last paycheck. All I want is to be left alone. I did all the professional steps needed to leave the company with good standing. I don't mind emailing them the information (if I still have it, I signed out of all their accounts on my personal devices.) And they also have access to the company email it was signed up with, but I don't want to keep receiving " Warnings" with no context over things they forgot to ask for before they moved up my resignation and gave me no exit interview. Im not sure what my options are or how to even ask for them to please stop.

    Thank you for your time!

    Sold a Car, Nowwants refund.

    Posted: 30 Jun 2020 08:55 AM PDT

Hello first time posting here, and I'll try to keep it short. About 10 days ago I sold a car to a gentleman and his wife. He checked out at the car and he was more than fine with it. By the way the man works at a car dealership. The car was in working conditions, he took it in a test drive and on top of that we went on the car to the bank to get the money out. Now ten days later he's been calling for a refund that the car was not working. When the week before selling it, it was fine I drove it pretty much everywhere. He threaten to go to court. Additional info, the car was insured with our insurance when we told it, the license plate were good had just renew them like 2 months before, and The only thing I did was sign the title and dated it. Employer keeping 75% of my commissions from 8 week period

    Posted: 30 Jun 2020 10:47 AM PDT

    U.S. Colorado

I work as a salesman for a home improvement company. I am the top seller and make great commissions at 13% of total sales.

With the Covid 19 pandemic my small business applied and received the PPP loan from the government. They kept paying me a set amount for each paycheck (which we set from the beginning of the year so I have a kitty if I need) throughout the pandemic.
They never told us what was happening but to not go on unemployment since we received the loan.

Now after this 8 week pay period paid for by the government, my boss said that since they didn't pay us out of commissions for the 8 weeks, they "had to put us on salary" and therefore we will only receive 25% of the total commissions from those 8 weeks. I sold around $175,000. That means they are trying to keep over $15k from me! They did not have this in writing anywhere and just announced it at a sales meeting.

What can I do if anything??

    Thanks in advance.

(CA) Owner/landlord of rental previously did a move-out inspection to document what damages were and were not "normal wear and tear." Owner later hires an outside property manager, who is now charging me for those same damages that were considered normal wear and tear by the owner/landlord.

    Posted: 30 Jun 2020 11:19 AM PDT

Title simplifies the issue a bit, but here's context:

    1. I have rented a house in San Francisco, CA for 3 years.

    2. In May 2019, we changed the lease to a different Master Tenant since a couple people moved out. The owner/landlord and I did a move-out inspection to document damages at that time for refund purposes for the people who moved out. But no deductions were made until this June.

    3. The owner/landlord created an excel table clearly delineating what is and is not "normal wear and tear," which forms the basis for a security deposit refund. Those things that are considered normal wear and tear are therefore not my finanical responsibility.

    4. In April 2020, the owner/landlord hired an outside property manager and we moved out on May 31. However, in our security deposit refund, the property manager is charging us for things that the owner/landlord has previously stated (in email and on an excel document) they consider normal wear and tear.

    5. The property manager is saying that since he didn't have context to this agreement, he was using the baseline status of the property to assess damages. For that reason, we are responsible for what he says is beyond normal wear and tear, and my previous agreement with the owner/landlord is effectively worthless.

Would my emails with the owner/landlord constitute a contract, since there was a proposal and agreement between both parties?

    Charges that I've disputed include:

    • $790 for (5) new window screens

    • $400 for wall repair (spackling/repairing nail holes)

    • Replacing light bulbs throughout the house

Wells Fargo mismanaged my Escrow account and cost me $1,596 which they refuse to accept

    Posted: 30 Jun 2020 09:48 AM PDT

    Location: Florida

situation: My home mortgage is through Wells Fargo. In November of 2019, they incorrectly paid my taxes on the wrong parcel #, meaning that someone else's taxes were paid with my money. In February 2020, I brought this to their attention. They corrected it, paid my correct taxes, and paid the penalty for doing all this late (rightfully so, as it was their mistake).

Here comes the issue...because my taxes were not paid until 2020, I cannot claim my property taxes on my 2019 tax return. This would be fine if I could claim them for 2020 and receive the full benefit, but the max amount you can claim on your property taxes per year is $10,000. My property taxes were $10,300 in 2019 and will be roughly the same in 2020, therefore this does not help me whatsoever.

The simple solution is that Wells Fargo should pay me the $1,596 (calculation done by CPA with supporting documents that have been sent to WF multiple times), but they refuse to do this. It has been 6 months that we have been going back and forth...with hours of phone calls, emails, and letters and they refuse to provide any monetary relief as a result of their mistake and no explanation as to why they cannot do such....only that they "corrected the taxes and paid the penalty for their mistake"

My question is do I have any legal recourse here? I count on them to properly manage my escrow, which they failed at doing in my first year as a homeowner, and they cost me $1,600 in doing such.

    Thank you.

[UPDATE] [FL] I ended up getting an attorney and started to file lawsuit but now I don't trust them and don't know how to move forward.

    Posted: 30 Jun 2020 01:11 PM PDT

    Original Post https://www.reddit.com/r/legaladvice/comments/a36rpk/fl_car_accident_settlement_offer_should_i_get_an/

I feel SUPER uneasy about the situation I'm in and what to do now. It's been draining years of my life.

To recap and continue: Car accident in 2017 at age 24. Nothing broken but had alot of issues and a few still plague me to this day and will continue to like PTSD and not being able to stand for more than 30mins without back pain (use to be 10mins). Currently "finished" with treatment again as I cannot afford to pay anymore and base PIP exhausted.

Because of the stress, I didn't think about getting an attorney immediately, I didn't do much of anything but go to the doctors, tell them my issues, do physical therapy, MRIs for my back, etc, to have them tell me that they could not find much or anything when I had issues still. The doctors I had were not very helpful at all unfortunately... Only 1 was somewhat.

I did the original post at the height of my stress. Insurance offer was low. I got an attorney through my workplace benefits (US Legal). US originally told me that I should get an attorney as a LAST Resort when I first talked to them years ago which is why I didn't get one way before.

But everything started going well. Signed rep contract. Exchanged all details. Went more over items over time. Somewhat agreed on an amount, finally made demand this year..... and insurance won't budge. Attorney believes it's because of what was put in the medical records that they won't move and wants to go forward with a lawsuit but AT THE SAME TIME is recommending me a doctor to go to now because I need a "doctor advocate" who can take account of all my past and current issues if I pay roughly a grand.

I said no to the recommended doctor because that did not seem right to me. I don't know much about the legal system but that seemed very shady and like it would not hold up in a trial. Plus I don't have the money for this. Then I started learning about the "Kiss of Death", where you get recommended a doctor because they have pretty much given up on your case... Trust with attorney is questionable now.

So great news right after this, My doctor & neurosurgeon who I was with both have left their jobs. One was having a kid, the other, idk. So I am SOL and now have to find new ones or take the ones assigned to me, wonderful.

I cave in a bit and ask my attorney for recommended doctors who can use my insurance and he comes back with just one, doesn't say if my insurance covers buts says "Don't tell them I recommended you" but I can put their name down if their documents asks for an attorney. I looked up the doctor and well what do you know, bad news articles, very mixed reviews, shady office building, all of the things that say "I'm being setup". Now my trust is gone.

Unfortunately we have already been moving forward and I was given a service of court document recently.

So I'm at a loss today. What's the right path from here? Do I decline the doc recommendation again and find my own? Or do I find another attorney? Is that even possible at this stage without financial repercussions?

I thank you for your time for reading this, any help pointing me in the right direction is greatly appreciated.

I've been at my building for three years now. I like my landlord and building, but I haven't owned a car in a long time. Last month, I decided to switch units to a nicer, slightly larger corner unit. My landlord permitted this, didn't raise my rent or anything and had me sign a new lease.

Since public transport is not available as easily to me because of COVID, I decided to purchase a car. I haven't had a car the entire time I've lived here. Our building has a small parking lot in the back for tenants. There aren't enough spots for the number of units, so I figured I'd ask to see if a spot was available.

Landlord says there are none available, but that I'm #1 on the waitlist. I bought what is basically a brand new car, and street parking is not exactly where I want to keep it. When I signed my new lease, I noticed that it mentioned parking which I thought was odd because I didn't have a car when I signed it. Specifically:

PARKING: Rent includes the right to park two cars in a tandem parking space in the rear of the Rental Property at a cost of $0.

This is the signed, executed lease. Am I within my right to tell my landlord he needs to figure out a place for me to park? There are no parking spots available, but he's been turning over new units recently so I know he's leasing out parking to people and it seems he's over-leased the amount of parking spaces.

    I'm in Minneapolis, Minnesota.

    Please advise on mortgage problems?

    Posted: 30 Jun 2020 11:26 AM PDT

    Hello,

    location: SoCal

My mother-in-law is having problems with her mortgage company. At the beginning of the year they had suddenly said she was behind in paying ~$10,000 out of nowhere with no notice of her missing payments. We have called them several times about this and all they ever say is that they are investigating WHY she owes the money because they will not tell her why. We have gone through all her statements and she has not missed any payments. In the mean-time they have put a lien on her house and she is unable to refinance or change mortgage companies because of this. They have also repeatedly called her at home and work threatening to take the house because she is "behind" in her payments. This has been going on for SO long my MIL now is thinking maybe the only way to resolve this is to sue? Would this be a good course of action? What type of lawyer should she look for?

Online purchase, didn't get it all

    Posted: 30 Jun 2020 11:10 AM PDT

State of Illinois. I made a purchase from the online company Loot Crate back in November of 2019. This was an 80th batman anniversary box. I paid an extra $80 to have a limited edition jacket added. Short version, after numerous inquires, I finally received my box in May, but not the jacket. They stated they were having logistic issues due to covid. A few communications and the date was shipped to so by the end of last week 06/26/20. No song happened. I emailed them yesterday and didn't receive a reply until this morning. They stated I will not be receiving the jacket as they are now out of stock. They offered a new "welcome box" or $15 off my next box purchase. These come nowhere near the $80 they charged me. I had stated in previous emails prior to this offer I wanted my jacket so I could stop doing business with this company. After I received the offer, I stated neither off was acceptable and the only offers I will agree to is my jacket being shipped immediately or refund of the extra charge for the price of the jacket. I have not received a response yet. Is there any actions that I can take?
