    Planet Fitness lied...

    Posted: 02 May 2020 06:27 PM PDT

    Question for you guys.

So I moved out of state but before I left I went into Planet Fitness to cancel my gym membership, signed the paper and everything. I noticed like 3 months later that they had still been debiting my bank account, so I called my bank who said they had my account/routing number and they would block future debits and refund it.

A month later I noticed that they had billed me AGAIN for the 3 months plus a fee. So I called my bank again who said this time they used my debit card and would refund the money and open a fraud dispute, since I cancelled it and did not permit these debits.

Just today I got a notice of legal action from my bank with documents from Planet Fitness saying that I had never cancelled my membership, and said I went to the gym on March 6, 2020 at 12:30pm and sent a picture of me walking in dated on March 6, 2020. Mind you I have been out of state since November and the picture showed me with very short hair and I have had extensions since September 2019, they sent an old pic and are lying about me checking in. I have proof I was at work in a different state that day they claim the picture was taken.

I am pretty positive it'll get figured out with the bank, but my question is how could I let people know publicly about this fraudulent company without getting sued for slander or something. Also, could I sue them for blatantly lying??

    TYIA!

Edit: Thanks for all the responses!! I absolutely have proof of all kinds on my credit card, being at work that day in another state, everything. I didn't get a paper from the girl who did it, who seemed annoyed in the first place. But being that they now blatantly lied and I have evidence of that, their case wouldn't stand either way. They even mailed it to my parents house, which hasn't been my address for 7 months, and my mom was furious haha. I never thought to contact the attourney general and make sure they don't get to keep doing this! Thanks all.

[TN] I was scammed by a buyer on Fiverr and Fiverr refunded the buyer.

    Posted: 03 May 2020 10:15 AM PDT

    Hello everyone,

I'm going to make a long story short. A buyer hired me to write articles for his website. I sent him a rough draft for his approval. He never responded to me. I waited over 24 hours for a response and delivered the work. He waited over a week to file a false accusation of me violating copyright laws.

Without speaking to me about the false accusation, Fiverr refunded the customer. Now the customer is using the article on his website and is most likely profiting from the article. According to numerous sources, this client's website has a high volume of traffic. I am certain he is profiting from my work that he stole thanks to Fiverr.

I have proof the article is 100% original and unique. I tested it in many programs that confirmed the work was completely written by me.

The client is from Italy, but his hosting provider is from the United States. Can I legally force the hosting provider to remove the article? Could I or an attorney subpoena records of traffic from that page to estimate earnings from the article? Can I take legal action against Fiverr for enabling this buyer to steal from me and profit for stolen work?

Family member keeps taking checks from the mail that are for me... What can I do?

    Posted: 03 May 2020 04:51 AM PDT

    Hello.

I live in VA, U.S. As of late, I've been getting a lot of money through the mail. Things like returns from school, tax refunds, and covid stimulus stuff. Well, my dad thinks that it's alright to just go and take checks that are coming for me right from the mailbox and deposit them. Me and him have the same name, so his bank lets him do it. He took a $2000 check recently that came in for me from my college and deposited it, then didn't say anything until months later. How can I deal with this? Do I call the police? Not really sure what to do.

(MA) An off duty officer in his personal vehicle attempted to pull me over, and then told me I would be receiving a ticket in the mail at the next light. Is this even legal?

    Posted: 03 May 2020 09:48 AM PDT

So here is a basic synopsis of what happened... "On may 2nd around 12pm, I was on my way back home from an appointment. I proceeded to go through the first rotary, and got in the far right lane which is a right turn only lane to the on-ramp, and as I'm turning onto it, an unmarked Black Ford F150 Platinum driven by Trooper ***, Badge number ****, proceeds to punch the acceleration from the rotary to the on-ramp, getting about 2 to 3 inches away from my rear bumper, and lays on the horn and gets visibly upset from what I can see in my rearview mirror. I proceeded to yell to him out my window "I had the right of way!" which upset him even more, so he decided to try to drive up on the side of my car when there is only one lane there at the stop sign to the highway, screaming at me to pull over and showing me a badge. At this point, I got very nervous and drove off because I thought he was impersonating an officer due to him being completely unprofessional, and he never outright said he was an officer from what I could hear. I was also very nervous considering what just happened in Canada two weeks prior by someone impersonating an officer, and got my phone ready to call the police. By the time I dialed the town police because we were almost in *** at the light at ***'s pizza, he got out of the truck at the light and walked over to mine and said "enjoy your citation" or something along those lines. ***** police told me to call the state police via 911 and report his plate number which I did, and they informed me he was indeed an officer from the other side of the state, and that I would be receiving a ticket in the mail, but they wouldn't tell me why I was being ticketed." This is the craziest situation I have ever been in, I already filed a complaint against the officer in question, which is how I got his name and badge number. Any tips AT ALL would be greatly appreciated

    EDIT- added some forgotten parts

The included story is essentially what I included in the citizens response form as a complaint against the officer in question.

EDIT 3 - I also forgot to add that the sgt I talked to, told me that the officer in question told him a complete different story than what happened, but would not tell me what the officer told him.

Employer Asking Employees to Pay Back Company during COVID Shutdown

    Posted: 03 May 2020 12:15 PM PDT

Hi all, so I was recently laid off from my job in Pennsylvania which has a total of about 15 employees. Before this, my employer sent out a mass email to all of the staff about doing a soft reopen of our stores and other general information. One thing they mentioned was how they expect all the staff members to repay the company for the tax-deducted paychecks we received while the business was shut down... money that the company received through the Paycheck Protection Program. They are planning on deducting $70 from each paycheck when people go back to work starting on May 11th.

Even though I am now laid off and don't have to repay the company, I worry for the other employees who are largely non-native English speakers and a few of them most likely undocumented. I feel that they are largely being taken advantage of and think that this is a highly illegal practice. I'm aware that the courts are pretty much closed right now but is there anything I can do on behalf of these people? I know $70 per paycheck isn't a vast sum of money but it seems very wrong to me to ask your already underpaid employees to pay back a company money that wasn't theirs to begin with.

Can my parents force me to pay medical bills?

    Posted: 03 May 2020 11:00 AM PDT

When I was younger, I had a run-in with the cops. After everything was under control, I was admitted into a mental hospital. The police recommended that my parents put me into the mental hopsitat, and they agreed. After I was in there for about a week, my parents found out that the fees added up to over 8,000 dollars. Now that I'm 18, my parents insist that I pay the cost. Can they do this? I live in Texas, if that helps.

Police told my dad he can't use a public road after a woman called in and said he was stalking her.

    Posted: 02 May 2020 05:39 PM PDT

The police just showed up at our door about 30 minutes ago. I tried calling a lawyer to get advice but none are open at the moment because of the time and the COVID-19.

My father who is 55 years old recently got a girlfriend about 5-6 months ago. He goes to visit her every day and helps her clean her house or just talk with her. I've been with him twice and every day he tells me he is going to go visit her beforehand. I also spoken with her on the phone the other day. I have no doubt that is exactly what he is doing and nothing else.

The police showed up at my door and told my dad that this woman who lives on the road he drives on to get to his girlfriends house is making the following claims which we have no idea who it is of course (nor do we want to):

    1. That he keeps driving by her house. They told us the road, and the road is a public road and also a shortcut to beat 5 red lights that save time and money on gas. They mentioned they have him on camera driving past her house. Tons of people use this road that live in town. This is the same road we used both times to go visit his girlfriend.

    2. That he has been to her work place multiple times. My dad has only been to Walmart, the dollar store and the cigarette store. These are the only stores that are open during this time except a few fast food places. We don't eat fast food, and the only time my dad goes to these stores is for groceries or his cigarettes. I know it's the only time he goes to these stores because he is sick and only goes when he wants to get something, which he tells me before hand so I can give him money or I'm going and he goes with me. I take care of him so that is pretty much why I know everywhere he goes honestly, and that he has an obsessive need to tell me everything he is doing.

To be clear I know 100% my dad isn't stalking anyone or harassing anyone. My dad was outside when they showed up and I only ended up catching part of the conversation to get the jist of the whole thing.

They told my dad the following: That regardless if he was or not doing this, any more complaints he would be arrested. I heard them say this. Which I think is ridiculous and why I want to get a hold of a lawyer. I think this is just intimidation to my father who is a sick old man over this persons delusions (I'm sorry this person feels this way but it's just delusions). They also told my dad he can't drive down that road anymore, and it's a public road. It's a shortcut to multiple places, and in this case a short cut to his girlfriends house and to the dollar store. My dad just said yeah to that and didn't say anything else and they left. Prior he mentioned that he just goes visits his girlfriend.

Are the police allowed to tell my father he can't use a public road? What happens if this woman makes another complaint and they actually arrest him, is there anything I should do or just have a lawyer deal with this? Since apparently she has made a complaint and he only goes to three stores, I'm guessing she works at one of these three stores and these are the only stores in town for groceries. How do we handle that since they are literally big grocery stores? We are a small town, like rural so a person working at a place and then living in a house we drive by is probably common. We have three neighbors that work at stores we go to for example.

Thanks for any advice here, I'm just frustrated over the whole situation.

Edit: We live in Eastern Kentucky

If I reported a crime to city police, and they are miss handling my case, can I re-report it to county/state police?

    Posted: 03 May 2020 08:16 AM PDT

Recently I just found out that the man I'm pressing charges on for rape has family connections with the local police department that I originally pressed charges with. My phones were brought in for data recovery, and information was wiped clean off of them and they said they "couldn't recover any data", they won't even make an arrest even though we have a phone call of him admitting to having sex with me while I was unconscious. I'd hate to believe that the police department is covering it up, but he comes from a very well to do family, and his father has already paid to remove data from the internet about him once, so I don't think it would be too far of a stretch to think he would pay off an officer to mishandle the case. My question is, would it be possible for me to bring this forward to county or state police and re-report the rape at this point?

Is it illegal for a contractor to lie about having insurance?

    Posted: 03 May 2020 10:06 AM PDT

My mother had some painters over doing her walls and potentially doing some epoxy on her countertops.

I overheard the workers talking when they'd thought they were alone.

It seems they are both "under-the-table" and their boss doesn't have insurance, which he clearly told my mother he does. There is a possibility he does not even have a license, as my mother didn't ask to see it (bless her heart).

    Messy Situation

    Posted: 03 May 2020 10:57 AM PDT

It's gonna be a long one and don't really know how to put it into a TL;DR format, so I apologize. Additionally, as the username suggests, this is a throwaway account being used to just seek help.

I am a young adult (18+) who moved across the US to live with my father in Indiana. I moved here at the end of May 2019. My father moved away when I was young and I thought it would be nice to try something new and build a relationship with my dad, step-mom, and two younger half siblings (they are 15 and 13). My parents were totally down with the move and told me to stay with them rent free so I can save up some money.

About 2 months into my new Indiana life, it is discovered by my step-mom that my dad has been having an affair for 6-8 months. The events that have ensued since then sound like they're ripped straight out of a bad Lifetime movie.

Since my dad was caught I have heard countless screaming matches and insults thrown between the two. Unbelievably, I've seen my father bleeding from his forehead after knocking himself out with a baseball bat (yes, I know it sounds silly. He admits to having been so mad he grabbed his autographed Mike Trout baseball bat off the wall and hitting himself with it....). I've heard numerous threats of suicide from my step-mom (at one point she supposedly held a gun to her head - I did not witness this, but believe it).

There have been bruises, holes put in walls, people running off without their phone or any word of where they went. Guns fired in the backyard at pictures of my dad and step-mom, it's seemingly neverending.

My final straw was when my parents called my siblings and I into their room and basically told us "we're going to fight for our 20 year marriage, and if you don't like it, then out some headphones on".

So I have plans to move back to my hometown, and soon. Like, I receive my final paycheck this week and am leaving. I'll be replacing my number and will be telling my parents as I'm walking out the door basically. I'll be giving my siblings a way for us to communicate, and they'll get a fair heads up of my departure.

So my question is this - what can be done for these children? They are so sweet, smart, and funny, and have unfortunately been present for nearly everything (they occasionally went to grandma's when things were suspected to get really bad). I understand the police should have been called on numerous occasions, and it was threatened... Only to have it thrown in my face that I'm trying to get someone kicked out of their own house... They don't understand it was only to get the fighting to stop.

My heart and lack of wanting to "ruin anyone's life" played into not wanting to get outsiders involved, as well as a bit of embarrassment for my parents' behavior. But now, as I'm readying to leave, I have no heart left to give.

Any advice would be greatly, greatly appreciated. Thank you.

High school is refusing to give students their money back for prom and other activities that aren’t happening.

    Posted: 03 May 2020 02:00 PM PDT

Due to covid-19 all school activities are cancelled, as a high school student I don't have a lot of money and would like to be refunded for these things I have no chance of doing. Apparently the venue for prom is refusing to give the deposit back, the venue and school are just going to move the stuff to next years prom to use the deposit. However as a senior I won't be at the prom next year and I feel entitled to my money back.

Contractor won't pay us how much was promised on contract.

    Posted: 03 May 2020 08:55 AM PDT

*This is a little lengthy so there is a TL;DR at the bottom*

Before I get into the issue at hand, I am going to provide some context. My close friend and I are developers who are relatively new to the professional ecosystem. We are extremely eager to get work because we have spent a few months getting certified with a platform known as Salesforce. Essentially, in our minds the only thing between us and a real job is experience.

So fast forward to a few weeks after getting all of our necessary certifications, and we land what we thought was the dream experience-getting gig. A position as contractors under a person who promised to not only get us experience, but also mentor us. He seemed extremely nice and the fact that we were both offered this position was a huge plus, as we work well as a team. About a week later we are approached with our first real gig. I can't get into details but it was essentially working on some .NET code for a startup.

The agreed upon rate was 50 dollars an hour, which is what it said on both of our contracts which we signed, and handed in separately. We were told there was only ten hours in the clients budget, but as we worked on the project, we realized the code base we were given was heavily unorganized and not documented in the slightest. It took us 8 hours to actually get a handle of what everything meant and document some of it ourselves, and I know now that this was a mistake, but me and my friend decided to go overtime just so we had something tangible to hand in. We communicated this with our contractor and he said it was fine, we would just get paid for the overtime when the client had the budget. That's fine I thought, as long as we get the money eventually it isn't a big deal. All in all we both spent 38+ hours when we should have only spent ten. The weird part is we were in constant communication with our contractor and he kept saying it was okay, just fix this one issue and we will be paid eventually.

So cut to when all the changes are finished, the code has been pushed to production. We ask our contractor about the payment. And this is where it get's absurd and where I am almost positive he took advantage of our inexperience. He says, nearly word for word, "I will send you the $500, split it between yourselves however you want". Just to be clear, we were expecting $500, except, we were expecting $500 each, as our contractor has told us the client only has enough money to pay us each for 10 hours of work per month.

He is essentially paying us as one entity, despite us having different contracts that each say 50 dollars an hour, and despite us having entirely separate time sheets to fill out. Is this illegal? Or at the very least extremely misleading? If it is illegal, what should/can be done?

Thank you so much for reading it all the way through and for any help you can provide.

TLDR: Contractor is paying me and my partner as a single entity despite having us sign two separate contracts and giving us two separate time sheets. Has done other things that suggests he is taking advantage of our inexperience as well, such as telling us to continue going way over budget.

Someone from my past is sending me threatening messages.

    Posted: 03 May 2020 09:10 AM PDT

I live in New York State. Harasser lives in California.

About a year ago, someone I was friends with in college started messaging me crazy things over Facebook. We never had a bad falling out, more just the typical drifting apart that people do. Prior to him hitting me up we hadn't spoken in over 5 years.

When he first started messaging me, he was calling me a bitch and a snake, and a bunch of weird things. I tried to see where he was coming from, but didn't get through. After about a week of back and forth I told him to seek help from loved ones and professionals and then blocked him.

He then started messaging me over GroupMe and other platforms, same sort of weird things. This went on for over 8months. During this time I found out he was messaging a lot of my other friends, who he knew in college as well. It was the same sort of harassment.

Eventually, after blocking him in over 30different accounts, he started messaging me crazier shit, including bringing up my girlfriend, who he didn't know or know I was dating. At this point I went to the police, mostly to just have something on record, not really to press charges.

The police told me this is aggravated harassment and to contact them if it continues. I told the person messaging me I went to the police, which is the first time I had responded to him since this all started. He didn't take it seriously and continued to be crazy.

Flash forward about 2 months and the harassment continues. Now it's getting worse, he messaged my girlfriend and brother. I'm getting concerned and go back to the cops. They tell me they have a detective looking into it.

During this time I find out he is doing this to a lot of people from his past. One of those people gives me harassers sister number and I reach out. Sister tells me that harasser is crazy, living in California and will not go get the treatment he needs.

Sister must tell harasser that I reached out and he starts sending me death treats, including sending pictures of my girlfriend and saying he knows where I live. He names place where I live, not exact address thou. He tells me things like he is coming after me to bash my skull in, and I'm dead when he gets his hands on me.

I have called the police following up 3 times in the last 3 weeks and they keep saying they will get back to me, but I haven't heard anything yet.

I want to know the following:

What type of lawyer should I get? I was thinking tort lawyer. Can this situation help his sister force the harasser to get mental help he needs? What can I charge him with? It's tricky since he is in California and I am in New York? Maybe federal crimes? Should I sue him for damages? This has been hard for me and if definitely ducking with my head, as it's over 30messages a day.

Out of date masks... Can I sue?

    Posted: 03 May 2020 01:20 PM PDT

Hi. Posting from a friends account to keep anonymous. I'll be straight to the point, can I sue? I work for a long term care facility, they have been KNOWINGLY providing us expired N95 masks that we're expected to wear for two weeks at a time. We have plenty to be given a new one more frequently. My small crew and myself are the sole caretakers for the isolated COVID-19 patients. Management is wearing masks that are in date, and do not leave their offices in fear of getting COVID-19. These masks contain mold and expired in April of 2010.
They are doing this intentionally. I have photo evidence of the masks expiration date that we have been provided with. STATE: MISSISSIPPI

Dealership cannot/will not present title to car I bought in full. Do not know how to proceed in getting my money back.

    Posted: 02 May 2020 03:46 PM PDT

I purchased a car in full from a dealership in the state of UT, it was my first time so I was a little oblivious on how it works so I went along with the process thinking everything was normal. After everything was said and done, I was about to leave with what they claimed was all the paperwork I needed for the car. My friend who joined me for the transaction asked the dealership multiple times if there was anything else I needed for the car to get plates and take care of the car at the DMV.

They did not gives me tags for the car as I was leaving, and they also did not give me a title. Once I found out I didn't have the title to register my car/get plates I tried contacting the dealership multiple times, to the point where it seemed like they were dodging my calls. I drove there myself to find out what was going on, and they outright told me they did not have the title with them; at the time when they verified that they didn't have the title, it had already been three days later.

I had to do my own research along with help from the DMV to find out that the title was with a lien agency. They failed to inform me of this before and after the news of a lack of title in my possession.

The DMV told me to report the incident to the MVED, and I have. However they told me it will take up to 14 business days for someone to even begin investigating. Really I just want my money back, is this a crazy request? From the research I've tried to do, as far as I can tell, if they don't give you tags they have 48 hours to present a title and from there if they don't you can get your refund in full? I'm afraid they won't work with me unless I get some sort of law enforcement to encourage it.

The dealership has been terrible in the whole transaction, they still will not contact me with the multiple emails I've sent them. Isn't this fraud? What should I try doing to encourage my refund? I put about 300 dollars into the car before I found out about the title, small claims court sounds like a pain to deal with. So just getting my money back for the purchase is ideal.

I have the paperwork for the proof of purchase, however they put the wrong amount on the odometer by about 20k, I'm not sure if that would be an issue but I also reported that to the MVED. This whole issue started about 2 weeks ago and I havnt been able to progress in any action since the 21st of April.

[PA] Essential nursing home worker [24F] being exposed to harsh hours and pay, negligent boss taking money from workers. How do I get out?

    Posted: 03 May 2020 01:19 PM PDT

I've worked at in a personal care nursing home for 4 years now. Note not one day has been late or called in sick since this is a personal care home. My boss being the sole owner of it has no upper management that I can go relay my issues to.

When I started, I was making 9.50 an hour, then 6 months later she bumped me up to 10. And that is where I've stayed ever since. She makes a lot of money and does not have a separate account for paychecks for the workers and her own spending account. It's all in one and she just buys anything she wants and then complains that she might not have enough money to pay us. Last week she just bought a brand new 2020 Escalade during this whole pandemic instead of paying us more for all the extra work we have to do. Us being understaffed with 5 people for 5 shifts. If someone calls off, someone gets screwed because we have no back ups. She refuses to hire anyone, and when someone messes up it's often deflected to me. Forcing me to work in aberrant conditions.

Sometimes after a resident passes away, the family will send us, the workers, a card and a gift as a thank you. This one family in particular raise a couple thousand dollars from their churches and friends and gave it to our boss to give to us as bonuses. But, we never saw any of the money. Consistently depriving us of the gift/bonus and keeping it for herself, she will go through it and take what she wants and try to be slick about it, but the family always asks us if we got the gift so then we know that she had taken it.

Now with this pandemic my hours are really wacky. I'm not sure if it's even allowed for her to have me working like this. So Saturday night into Sunday morning, I work 11pm-7am and with my drive home, I don't get home until 8am. By the time I'm able to fall asleep it's about 9:30 am. And then I sleep until 1:30pm to get up and get ready to come back to work for 3pm-11pm. It's really exhausting on me physically and mentally. I'm an essential worker, but I feel I'm being mistreated, and I want to find a way out.

UK is damage to a prosthetic leg property damage?

    Posted: 03 May 2020 02:11 PM PDT

Hi guys, looking for some advice about an incident I had recently. For context, my job involves spending several months at a time at sea so I've been working during the recent lockdowns. I recently returned to land and after a two week quarantine I was allowed to return home.

On the way there, I encountered a man who noticed my artificial leg and decided to make jokes about it. I was vocal in my response and it escalated to him approaching me and drawing a gun. He took a shot at my (artificial) leg, then realising what he had done, ran off.

Thankfully the damage was superficial and hasn't affected the functionality. I don't think he intended to actually harm my 'biological' body (he was close enough to take very careful aim) but am still feeling like I should report him. I'm just unsure if I should treat this as property damage or as bodily assault. Does anyone know how the law interprets this? Thanks in advance.

Before I get down voted to hell and called an idiot, I was not aware of the current drone laws in nyc. I know ignorance of the law is not a valid excuse and I learned my lesson. I'm going to read up on FAA regulations and stick to flying in authorized zones.

    The flight

After spending a few weeks in self isolation and working from home, I decided to take a walk in the park and test out my new drone. I spent about 25 or so minutes flying my drone around the park taking pictures of the skyline and whatnot, the drone lost connection a few times while flying (it has a return to home feature if this happens). Once I was done and everything was packed away in my bags, I was approached by two NYPD anti-terrorism officers. The officers were polite and asked if I was flying a drone around the park, I said yes and provided my ID and FAA ID before they asked for it. I asked the officers what the problem was and they told me that my drone set off a few anti-terrorism alarms around the hospital ship and the tent hospital. I told the officers that I have no malicious intent and offered to show them the pictures on the drone, they declined the offer.

    The verdict

The officers called for their supervisors and reinforcements, five other officers arrived and talked among themselves for fifteen minutes before coming to a verdict. The lead officers told me that I would need to surrender the drone and Sd card and I would be given a summons. I was handed a pink piece of paper that read "Criminal Court Appearance ticket" at the top, according to the ticket I violated section 10-126 section C. The officers on site told me that I would most likely be given a "small" fine and possible probation for a few months or year over this. Later that day one of the officers sent me a text to pick up my property clerk invoice. Multiple officers on separate occasions told me I would receive my drone back once the case has been settled. I take their claims with a massive grain of salt, I have heard a few horror stories about people attempting to retrieve their property from the NYPD.

    The phone call

One day after the incident, a detective from the police department called me to ask me a few questions about what I was going. He asked me if I had any malicious intent, I obviously said no. After asking a few basic questions, he asked me if I could send over the receipt and flight data via email, I sent both. He also asked for any social media, I don't really use social media so I didn't have anything to give to him.

    What next?

It has been a few days since the incident, I'm kind of bummed out about possibly losing my $2000 drone however, and the thought of tarnishing my spotless record also bothers me. Not sure how I should proceeded, I was told my a few officers that I could see a judge early assuming the courts open within a timely manner. Not sure if the courts will be open within this month (most likely not). Also I looked for my case using the online database provided by the state (iapps.courts.state.ny.us) and my case is not showing up, not sure if I should wait another week or so before checking again.

    Questions:

    1) How serious is the summons will I be arrested and will this appear on my record?

    2) What's the likelihood I will get fined over this? If there is a fine how much is it?

    3) Is it worth hiring a lawyer or should I just plead guilty and see what happens, I don't want to waste the time of a lawyer or public defender over this, they have much more pressing issues at hand.

    4) Can I visit the courts/judge before the date on the ticket and get this over with (assuming courts are open soon)?

    5) Assuming the case gets resolved within the day, will I get my property back the same day or is it another drawn out bureaucratic process to get it back?

    6) Is there a possibility criminal courts will open in NYC around late May early June? I really want to get this over with and get my drone back.

Thank you in advance for any advice or insights, stay safe!

    Inauthentic Item Dispute - $4,000

    Posted: 03 May 2020 08:16 AM PDT

    Hi everyone,

Hoping I can get some assistance on this matter.

I sold an archive clothing piece some odd 90 days ago (yes, $4,000 I know), and the buyer has recently contacted PayPal to inform them that the item is counterfeit (without coming to me). I contacted the buyer, and they have sent me photos of a similar piece that is obviously inauthentic.

Now, I do not have receipts or POP of any kind, although I do have the original tracking receipt. PayPal has already been in touch to request that I accept the return of this item, as they received confirmation of counterfeit goods (signed form from the retail company I can only imagine).

I already know that the buyer will attempt to return the fake item for a full refund, and I am not willing to do that. They live overseas which worries me (legal limits I presume), and I'm unsure as to how else I can battle this situation.

    Thank you for your help!

Crazy HOA President refuses to let me fix my AC

    Posted: 02 May 2020 08:23 PM PDT

Throwaway for privacy. I'm in California.

TLDR: Crazy HOA president refuses to give us a key to allow a repairman to access the roof to fix our broken AC, citing Corona as the reason even though HVAC work is an essential service in our city and the repair would take place on the roof, which is virtually unvisted by residents. She has been unresponsive for about a week to further texts/emails about giving us the key so we can get the AC fixed. What can we do to get the key?

I live in CA, USA in a condo complex with around 14 units. I own my own unit and belong to a HOA. As the days have been getting warmer, I tried to use my AC and realized to my dismay that it was broken.

Access to the AC is on the roof of the building complex, accessible through a ladder to the roof, which is covered by a locked cage. The issue is that our HOA president (who is effectively the entire board as she does whatever she wants) has the only copy of the key to the locked cage that gives access to the roof. She has refused to give us this key, claiming that HVAC repair is not an essential service (this is incorrect - HVAC work is considered essential in our city), that we are putting her life in danger due to Covid, and that we are acting selfishly in trying to let an AC man access the roof.

We tried to give her no-contact options for receiving and returning the key, including sterlizing it before return. We should note that a variety of other workers (gardeners, delivery men dropping off packages, cleaners who clean and sweep the floors, etc) have continued to service and access the communal areas of the property throughout the entire lockdown. These areas include ones that are frequented by residents on a daily basis when compared to the literally inaccessible roof, such as the garage, mail room, trash areas, and shared outdoor porch-deck area.

We argued back and forth a bit via text, and she finally said that we would need to provide proof of insurance by the repair company and also get HOA board approval (a problem for us as she essentially IS the board). However, she left the strong impression that she would continue to resist giving us the key in our final text communication.

We provided proof of insurance and submitted a request for approval to "the Board" about a week ago via email and have not heard anything back.

My question is, what are our next steps to get the key if she continues to deny us access or continues to just ignore our request? Once again, AC/HVAC repair is considered an essential service in our city, and we have informed her of this and texted her screenshots of the government website listing it as such.

We are willing to pay an attorney to see this through assuming a solution is the result. Would we be able to recoup attorney fees from the HOA or HOA president as an individual? Are there any other options that we could explore before going to an attorney/going to court, which I assume will be a longish process, as time is a factor and we would like to fix the AC ASAP before it get even hotter?

    Shot in my prosthetic leg

    Posted: 03 May 2020 02:16 PM PDT

My rental management company added a $20/month admin fee on my lease renewal agreement on top of my rent. Is that standard practice for this to be paid by the renter, and am I legally required to pay that?

    Posted: 03 May 2020 10:51 AM PDT

I've been renting my house for 10 years, and have never had to pay anything in addition to my rent. Can I refuse to pay, and if so, can I be evicted?

(TX) Apartment complex won't fix our plumbing

    Posted: 03 May 2020 12:03 PM PDT

I live in a downstairs apartment and right outside of my porch (literally about 3 feet off of it) is a hole where the rain drains so it doesn't flood.

This hole has been spitting up sewage for a week, to the point where I cannot leave my apartment without stepping in it. If I don't wear disposable shoe covers, it would ruin my shoes.

But that's not even the best part. For as long as this has been going on, our toilets don't work. The apartment manager has been trying to tell us it's our fault because we stuff them with too much paper (We, in fact, use VERY little for this exact reason. One of the toilets even has a bidet)

They keep giving us excuse, like they've called the plumber and they just never show up, which is obviously an excuse. Every time we call and ask them, or complain, they come and suck the water up without fixing the actual problem, then more sewage floods it in a few hours. I know through talking to my neighbors that their toilets don't work either.

What sort of action should I take here? I haven't pooped in 3 days and I feel like a balloon.
