Highway construction behind my house is causing foundational sinkage. Is this a valid claim?

    Posted: 06 Apr 2020 02:53 PM PDT

I know that most policies don't cover foundation sinking however I believe it is the result of the ongoing highway expansion about 20-30 yards directly behind my house. The structure is being rattled and shaken to the point of vibration every time heavy machinery is being used, which is often. This place is 100 years old this year and has sat firmly the entire time until the past few months. Now I have foundation sinkage with what I believe is the culprit taking place behind me.

    Is this a valid incidental?

If there's a chance to get this covered, how can I best prepare and present my case?

    US, Ohio

    Thank you in advance.

How to get out of roofing contract? Roofing company still in litigation with insurance company and it's been over a year.

    Posted: 06 Apr 2020 06:52 PM PDT

We are located in Florida. After the hurricane in late 2018, my parents were referred to a roofing company who did work for relatives and family friends. They were able to get their roof replaced within a month and my parents signed the Assignment of Benefits with the roofer hoping to get the same results. Well, the insurance company deemed that the roof just needed repairs and the roofing company has been in discovery phase of the lawsuit for almost a year now. During this whole process, the roofer left the company and there was all this back and forth and false promises. After a year of no progress and no new roof, my parents don't want to work with this shady company anymore. I was told that we would have to pay for all the lawyer fees if we don't want to do business with them. Are there any options left for my parents to pursue? Any advice appreciated!

Just got my Tundra back after 11k I'm damage from T-Bone and have an issue...

    Posted: 06 Apr 2020 04:10 PM PDT

Hey there, I got hit about 1 month ago and just today took possession of my vehicle again after all the said repairs. The back end of the truck took the majority of the damage but the reputable repair shop (have had work done here before) said that my tires are bad hence why it's shaking violently at anything above 50mph. I think to myself he's over stating this claim.

Hop on the highway and notice that it's shaking badly even above 30mph. My tires, for the sake of honesty, have about 5-10k miles left in them. They are on the end of their life. But I can guarantee you that my truck was not doing any of these things before the accident. What should I do?

The accident occured with me going 60 mph on the two lane hwy and had someone blow a stop sign going 40 and hit me in the back right wheel. The force spun me out numerous times and into the oncoming ditch, without rolling thankfully. So needless to say there was a ton a force here and nobody touched or looked at my front end. Also, I just got new shocks and alaignmemt literally a month before this accident happened.

If you hire a lawyer as a passenger in a car crash, is the driver notified

    Posted: 06 Apr 2020 11:18 PM PDT

I was a passenger in a car crash where there was a parked car in the HOV lane (lets call that car, Car A). Car B saw this car, stopped in time. Car C (the car I was in) was going too fast behind car B to stop in time, hit Car B and slammed into Car A. Driver of Car C gets a reckless endangerment ticket for several hundred dollars. The driver of Car C happens to be a good friend of mine. There seems to be some debate on who was at fault, but I'm a passenger so I'm not sure how that affects me.

Regardless, I got whiplash injuries to my shoulder and neck that persist months later. Based on my PT, I should make a full recovery, but it'll take six months to a year of physical therapy. Car insurance for Car C (my friends car insurance) is covering the medical bills, which would probably total around $3,000 assuming recovery goes as planned. I have some pain in my daily life, but I'm doing my best to make a full recovery. I have a legal benefit through work that provides a discount on lawyers. Online googling here is not very helpful because most lawyers seem to think you should hire a lawyer.

    State: WA

    Two questions

    1. Is it worth it to hire a lawyer in this situation to receive compensation for pain and suffering
    2. Would my friend be notified if I did, or is it settled purely through the insurance company

Received a check from a motorcycle accident?

    Posted: 06 Apr 2020 11:02 PM PDT

Hey I just want to check some things and didn't know where to get answers at 2am. So I was in a motorcycle accident last year March that was my fault. I had comprehensive and collision insurance with Allstate in Florida.

An insurance claims guy came out to assess the damage (wasn't much) but I didn't pay my deductible because I was broke from not working for 6 weeks.

I just opened mail from last year and I see a $500 check made out to my name with an old checking account # and routing #. Is this really a check for my repairs? (Already did it out of my pocket btw)

Out-of-Network Labs Billing $42,000.00 for Bloodwork

    Posted: 06 Apr 2020 01:55 PM PDT

    Hey everyone,

I received an EOB from my insurance company today regarding bloodwork I had done in February. The doctor who took my blood samples sent them to two out-of-network laboratories. These panels tested my cholestorol, testosterone, and other enzymes and hormones.

The total amount that was billed to my insurance is $42,617.68, and it says this is also the amount I owe since the insurance didn't pay anything.

Just wondering if anyone has advice on this. I called my insurance company right away and they are going to look into it and get back to me, but it's stressing me out not knowing who to talk to about this right now.

Is this even legal? The doctor I went to said I was good to go, and here I thought I was paid up this whole time, only to expect that I will get a $42,000 bill in the mail soon.

    Any advice is appreciated.

EDIT: I forgot to add that I am insured in Pennsylvania, and the doctor I saw is in Pennsylvania. I do not know where the out of network labs are.

Do I have a diminished value claim? (NJ)

    Posted: 06 Apr 2020 09:41 PM PDT

A few weeks a go I hit a deer in my 2013 mustang. It was drivable, but it had about $6500 worth of damage to the front end. My car is fixed now (insurance payed minus my deductible) , but I was wondering if I was able to file for diminished value. My car wasn't worth too much before, and I dont plan to sell anytime soon, but I know my car is worth a lot less now. I have geico.

EDIT: I guess I didnt understand 100% what diminished value was. Thanks everyone.

Is it a realistic concern that my homeowners insurance will increase now that I Work From Home due to the pandemic?

    Posted: 06 Apr 2020 09:27 PM PDT

(US)(TX) Based on the title, I am clearly not in the insurance industry, and this may be an "asked and answered: not a real concern" but I wonder if the fact I am spending so much time at home now, but doing tasks for my company, could change my homeowner insurance rates. My work involves sitting on my computer all day, so I am not doing manual labor or assembly, but I am home much more now. Any increased exposure to my insurance company due to this change?

Hit and run by a drunk driver, how do I proceed?

    Posted: 06 Apr 2020 05:34 PM PDT

    Hi reddit,

I was sent here by r/legaladvice. Using a throwaway due to potential legal implications.

Short version of what happened: I was driving on the highway, the cars ahead of me started slowing down and I did the same. I was rear ended from behind pretty hard because the driver didn't stop in time. The other driver then changed lanes and took the next exit, fleeing the scene.

Because I had a dashcam, the police were able to track down the other driver quickly, as he was loading his car on a tow truck. He was drunk at the time so they arrested him for a DUI. The officer called and let me know I could get his insurance information from the police report in a couple of weeks.

It took about a month for me to get the info for the other driver so in the meantime I opened a claim with MY insurance. I paid my deductible and got my car repaired. They said they'll try to recover my deductible.

For medical bills and such, my insurance has repeatedly said I have to work directly with the other insurance company. My question: is that standard operating procedure? r/legaladvice seems to think MY insurance should be working this all out on my behalf.

I've spoken directly with a "bodily injury" adjuster from the other insurance because there was some drama over whether they'd even cover my claim to begin with. They have now "accepted 100% fault" because the other driver has admitted to the accident. That's the last I heard from them.

I have close to 5K in medical bills so far that I've run through my medical insurance (and paid out of pocket due to my high deductible). I've never been in an accident before and I'm young so I don't want to get taken for a ride. I'd appreciate any advice on whether I should keep pushing on my insurance to get involved or deal directly with the other person's insurance company.

EDIT: location was California. Bay Area.

    Auto Insurance Refunds

    Posted: 06 Apr 2020 06:43 PM PDT

I read where at least two insurance companies in the USA are refunding a portion of the premiums due to lower accident rates during the COVID-19 crisis. Geico not one of them, nudge, nudge. Now I'm waiting for ALL of the homeowners and renters insurance companies to have a surcharge because we are staying at home more.

Term Life Playing Me for a Fool?

    Posted: 06 Apr 2020 12:19 PM PDT

Mom just died of covid-19. I'm really struggling, but it's lit a fire under me to plan better. I've applied for term life insurance, but the policy is giving me weird vibes. Please help before I sign? SKIP DOWN TO QUESTIONS IF YOU DON'T NEED BACKGROUND

    • Background info: I'm 35 w/ 3 kids all under 7 y.o. The younger 2 have major health issues, including autism and a heart condition. Wife doesn't work. No family money or help. 400k salary and decent savings, but no house or assets bc just paid off a TON of student loan debt and medical bills. Prob will never own a house bc need to stay liquid for kids' medical bills.
    • Insurance policy: Level term life insurance policy from Protective Life. Policy Genius is the broker. 30-yr term, $1.8 mill face, ~$100/mo. or ~$1100/yr premium. But the policy terms seem really barebones. The only living benefit the policy offers is 60% of the death benefit (which will then be subtracted from the death benefit) if a doctor certifies me terminally ill. No premium waiver. No child coverage (I've been told it's a good idea).

For $1000/yr extra (so a ~$2000/yr premium), the policy can include three riders: a premium waiver (premiums waived for 2 years after 6 mos. of long-term disability), child coverage ($20k per child), and accidental death (extra money if die in an accident). Policy Genius says that the level-term life insurance policies it offers through other carriers would be about the same cost and same terms.

    QUESTIONS

    • Is it worth paying $1000 extra for these three riders to be added?
    • Can anyone recommend insurance carriers that might offer better living benefits and other non-death benefits like premium waiver?
    • Am I making too big a deal over non-death benefits?

    Thank you all.

    Is car insurance necessary nowadays?

    Posted: 06 Apr 2020 06:11 PM PDT

Just thinking aloud here, but there's 3 cars in my household, all of which because of the covid/stay at home, none have been driven (in weeks). Is it necessary to continue paying premiums on all 3 of those cars, I'm thinking just cancel the insurance on 2 of the cars and leave it on the one that we'll use for essential buying (groceries & pharmacies). I'd rather keep that money in pocket for emergencies that might arise like being unemployed. I have full coverage on all 3 cars, perhaps even lower the coverage package on the one car. Just looking for thoughts.

Hospital appears to have changed CPT code after surgery, being billed for preventative surgery that I was originally told by insurance would be covered at 100%

    Posted: 06 Apr 2020 12:01 PM PDT

    Edit: Georgia, USA

Sorry in advance if this is not the right place to post...

Prior to my surgery, I got the CPT code that was sent to the hospital from my physicians office. I called Cigna and got confirmation (3 times, no less!) that this CPT code would cover me at 100%. No deductible, no copay, nothing.

Lo and behold, I received a bill from the hospital claiming I owe them money.

Back and forth between Cigna, hospital and physicians office...

Cigna says that the CPT code that I gave them prior to my surgery (which was given to me by the hospital, and I confirmed with my physician's office was the correct one), was not the CPT code that the hospital ultimately submitted. Whatever code they used (which neither Cigna nor the hospital representative would give me!) was billed as an "illness" rather than as "preventative".

Doctor's office stands firm that the CPT code they originally gave the hospital is the one and only. Again, this is the code that Cigna verified would be covered at 100%

Insurance lady from physician's office called the hospital, and my case "manager" gave her the same runaround about not being able to give her the CPT code they actually used. Wtf???

I did my due diligence in checking the CPT code. My physicians office is claiming that the approved CPT code was the only one they submitted to the hospital.

I hate to be a conspiracy theorist, but it's looking to me like the hospital did some shady billing shit, hoping that I wouldn't think twice about it and just pay the bill.

...where/how do I escalate from here?

MN Auto. Does glass portion of my comp. coverage cover rear window if defroster wires stoped working?

    Posted: 06 Apr 2020 04:57 PM PDT

2011 Ford Escape, discovered over the winter that the defroster wires on the rear window have burned out/stopped working. (The cables that connect to the glass have voltage, so I'm pretty sure it's the wires that are printed on the glass itself that are bad.)

I want to get it replaced. Seems to me that it might be covered since a bad defroster grid could be considered a safety/visibility issue similar to a cracked windshield. Thought I'd run it by y'all here before I call my agent.

State of Minnesota. (If relevent: State Farm, $500 deduct comp/$0 deductible glass.)

Thanks everyone! I'm glad you've made a place to ask questions like this.

    Highest UIM?

    Posted: 06 Apr 2020 03:58 PM PDT

I was considering switching to Progressive for auto insurance but the highest tier UIM they offer is $250k. Ideally I'd like at least $500k or even $1m, I currently have $300k with Allstate. Any clue what carriers would offer that? I don't qualify for USAA.

A Warning on Progressive's Covid-19 Billing Leniency Program.

    Posted: 06 Apr 2020 03:41 PM PDT

this only applies Michigan as other states may have other laws.

Just a heads up for any progressive customers that may be interested in the banner on their website that reads:

"COVID-19 update: We will not cancel or non-renew any active policies due to non-payment through May 15, 2020. If you need assistance, please give us a call."

I called in to inquire about it and the representative informed me of two things:

    1. Any balance that accumulates between April 1st and May 15th will be due in full otherwise your policy will be canceled. Late fees are waived and are not included in said balance.

    2. In order to "delay" paying you will first have to remove automatic billing from your account. Removing automatic billing will also remove a discount from your premium.

For me this second point meant tacking an extra $200 onto my premium in order to delay paying which made it not worth it for me in the long run. However, for someone not currently enrolled in automatic payments this won't be hurdle to deal with.

No deductible reimbursement and auto claim because of “household exclusion” in California

    Posted: 06 Apr 2020 08:31 AM PDT

Hi, so my mom hit my car while I was parked in the driveway back in December. I got the repairs done and paid my deductible which was 500 dollars. I have been told this whole time that I would get reimbursed for the 500. Now that the car has been repairs and subrogation has been finished, I just got a call saying I would not get my deductible back because of "household exclusion. We both live in the same house in California and we both have StateFarm insurance. we are both covered by our own policy.

My main concern is that I've been told by multiple people that I would be getting it back and now I'm told they were all wrong and that I would not. Is this something I should fight? Or are they in the right?

    Thank you for any help!

has COVID-19 affected property insurance claims industry?

    Posted: 06 Apr 2020 09:19 AM PDT

I work for an independent IA firm, and over the past couple weeks, our claims volume has dropped significantly. I'm talking like 95% or more. I expected it to slow down a bit with everything shut down, but with so many people now staying home, I also figured there could be an increase in claims reported. My company has also recently gone through some major changes in management over the last year, and as a result, has kinda messed up our reputation with our biggest client. Last month, our averages and benchmarks were completely screwed, so I'm not 100% sure that the decrease in claims is directly related to COVID-19.

I'm just curious if anyone else in the property corner of the insurance world has noticed such a dramatic decrease in claim volume?

Question about Effective Date of Cancellation

    Posted: 06 Apr 2020 12:03 PM PDT

Hello, I'm switching insurance providers and I'm cancelling my old one today. I'm not very familiar with this because I'm helping out my parents with new insurance. The company that sent me a cancellation form has a section called "Effective Date of Cancellation". I live in Calgary, Alberta.

What I'm guessing is that I put the date of when my policy will end or renew. In this case, it's Apr 20, 2020. So is this correct? Thank you. For the reason of cancellation I just put "Premium is too expensive". Is this fine too? Thanks.

Geico never responded to my accident claim and closed my case. Now what?

    Posted: 06 Apr 2020 11:17 AM PDT

Long short, I got into an accident literally the first day of the year by someone sideswiping me in a parking lot and filed a claim the same day. I got one call about updating some info within 24 hours, then that was it. Not a single call, email, nor follow up until now.

I've emailed them 2-3 times already since then and yet haven't received a call nor email still. I'm about ready to drop them as my insurance due to the lack of support. My car is somewhat "repaired" but I still have all info from the driver that hit me — license, registration, and insurance info — and willing to finish this through to finally fix my car.

Is there any other steps I can take to get this done? Otherwise I'm switching to Metromile considering I won't be driving much as I found work closer to home.

Edit: to add info, I live in CA, specifically from the Bay Area. I was in Sacramento at the time where my girlfriend lives and was visiting for the holidays.

At-Fault Accident due to unknown medical condition (seizure from brain tumor)

    Posted: 06 Apr 2020 11:12 AM PDT

    Hello all!

Five months ago I had a first-time seizure while driving in a parking lot (thankfully) and hit two cars. At the time I just thought I passed out and blew it off from lack of nutrition/sleep. Insurance stated it was at-fault. Upon getting an MRI shortly after (after telling doc about situation), I found out I had a brain tumor on my right temporal lobe (hence seizure). The entire tumor was promptly removed. From pathology/size docs think it was slowly growing for 3-5 years and finally got big enough to cause my temporal lobe to freak out. I've been fine since and not driving per recommendation from doctor to not drive for at least six months. I'm coming up on that six months mark, and I am now wondering "was my accident really at fault", since this was an unknown medical condition? This will determine my insurance rates significantly. I also wonder, if I tell insurance about what really happened, will my rates be higher due to risk even if I wasn't at fault. Are they allowed to discriminate from prior medical conditions that are now under control? Thanks for the input.

EDIT: This is also North Carolina if that is relevant

    Getting funding from insurance

    Posted: 06 Apr 2020 10:31 AM PDT

Maryland- 2 weeks ago the home connected to ours had a fire. We had some soot damage. Our insurance company sent a restoration company out which got approved for contents cleaning. Today they're doing the cleaning which is nice but they want to quote us as needing new mattresses and pillows etc because of smoke. In our opinion the smoke damage wasn't terrible, but there are a few things we could replace. However I would like the full amount of the new items if possible. Right now we don't actually want to get full price ones but could really use the check from insurance. Any tips on how to word it with insurance so they can get the quote from these guys on pricing but just cut a us check and we can choose where to buy the new items?
