Can you be sued in Arkansas for an injury that happened when you were a child?

    Posted: 09 Feb 2020 06:51 AM PST

Back when I was 10 years old in 1994, I was helping a teacher move a table with some other children and dropped my end on the foot of another student by accident. At the time, I said I was sorry and my family reached out to her family. She had apparently broken a bone in her foot.

I never really heard from the family or girl after that. My mom got a job in another state and we moved about 7 months later.

My mother is now deceased and has been for 10 years. I recently moved back to Arkansas for a job and saw this girl from long ago.

She still lives in town. Apparently she struggled for years after and has had to have a few surgeries on her foot because of how the break healed.

She recently got my contact information from a mutual acquaintance and called to ask me about compensating her for her medical bills.

I looked into it and her parents never sued my mother or asked for compensation. There is some debate on if my mother had offered or not. No way to know now since she is dead.

She hasn't actually sued but heavily implied that may be where she is leaning. I know if she does, I need to get a lawyer.

But I am curious if this would be a viable lawsuit. I was a minor at the time. It was on schools grounds during school time and I had been asked to carry the table by a teacher. No one had reached out for compensation in 26 years. She claims to be permanently disabled.

My previous employer found out where I was working and called my boss to try and get me fired.

    Posted: 08 Feb 2020 06:57 PM PST

He also said he was pressing criminal charges against me. That I was accused of theft, and that they were "watching my career very closely. And that they would bury any company I work for in a pile of lawsuits." Saying they would sue any company I work for. I did not sign a non compete clause.

He is claiming I cannot take my training or knowledge to another company. I was fired for downloading sensitive files, when they were s.o.p.s. I derived from my own training, and just templates I created from google documents. I deleted anything I had in front of him, and then he fired me.

Is this legal? Can he call my employer unsolicited and try and get me fired? Is this not harassment or at least defremation of character?

I live in Portland, Oregon, I work in the cannabis industry.

Is it legal for my employer to schedule me for my days off and continuously mandate me ? I’m at my mental wits end and can’t take it anymore

    Posted: 09 Feb 2020 01:55 AM PST

I work in the healthcare field and live in New York and have worked numerous places and this is the first place I've felt stressed and wanted to quit working at. I work with the developmentally disabled doing personal care and it's a very mentally and physically tiring job.

Ever since I began to work here I never work my scheduled 40 hr week I work upwards of 50-60hrs a week and my work days are 10 hr days so when I get scheduled early or mandated to stay late I'm working 12,14,16 and yes some 18 hr shifts.

Everytime I come into work and look at the schedule my hours have been changed on me numerous times like it'll be different from the day before and I'll come in and find out the next day I'm staying late or coming early or they will straight up tell me I'm mandated to stay and now they have scheduled me on my day scheduled day off to work without asking me so I'm working 5 days this week and automatically 50 hrs and that's not taking into account I know I'll be staying beyond my scheduled hours so probably will end up working 54-58 hrs this week now.

Is this legal ? I'm at my wits end and about to quit. I don't even want to give two weeks if I do because I'm so anxious and stressed.

Written up for asking in front of other employees why I got a bonus and others didn't- does this count as violating the law that wages can be discussed? (Texas)

    Posted: 09 Feb 2020 05:46 AM PST

Long story short I got a bonus and others didn't. I heard a couple coworkers asking my manager about why they didn't make the bonus at the front desk, in front of customers. I zipped over and asked why I got the bonus. My manager pulled me aside later and asked I don't say such things in front of others. Later I was written up along with a couple of trivial reasons that everyone violates like cell phone use. My write up states that I should not discuss money I make as it can cause tension and basically don't do it. I looked thru our employee handbook but didn't see anything saying 'don't talk money'. While talking to a friend he told me it is illegal to write employees up for this and it could be retaliation. I am a csr and was talking to a manager and a couple of other csrs would have overheard me. I'm already seeking another job. I want to know if this is a valid case with the nlrb (sorry if I get the letters mixed up) since my write up specifically says not to discuss money out loud.

Nonconsensual pornography of me was posted on Twitter! Seeking legal advice needed!

    Posted: 09 Feb 2020 04:16 AM PST

If it helps, this situation happened in Denver, CO and i'm in my 20's. A NSFW nonconsensual video of me was taken and posted onto Twitter by someone for monetary/popularity gain. This video was taken of me was filmed and posted to Twitter without consent during a sexual encounter. The video has gained 25k views, 1.5k likes, and 500 retweets on Twitter and is pinned to the top of the guys profile. Twitter won't take it down, probably because I've only reported it on my one account. He has messaged me bragging about how many followers he's gained from the video (around 1,000). This person refuses to take the video down and I'm beginning to feel powerless. This has caused me great distress. Does anyone have any suggestions on where to begin to fix this? If this is even illegal in the state of Colorado? Do I need a lawyer? Should I file a police report? Any general tips on how to get this video removed from twitter as quick as possible? Im desperate for some help guys. Crossing my fingers for some responses. If you made it this far, thanks for reading! 😩🧐👨🏼‍⚖️

I work at a hotel. A guest threatened to call the cops on me if I declined to let him look over my shoulder at my employee computer screen. Is he legally allowed to see my screen?

    Posted: 08 Feb 2020 11:56 PM PST

He has been growing increasingly paranoid over his money. It has gotten to the point he now wants to look over employees shoulders at what the screen shows so he can see his profile. I told him i will print papers that show what he is being charged, that i will print anything he needs, but that he can not look at our screen since my supervisor told me not to let him. Can he sue me for not letting him look at the screen? Can i get in trouble with the law?

Is there any way that i can get my neighbor to stop being a dick over the fence?

    Posted: 08 Feb 2020 07:54 PM PST

So a couple of months ago I got tired of my neighbor poking his head over my fence to complain about something or to just look at me. Like I would be watering flowers or letting my dogs out or something and all of a sudden my dog start Barking and when I look up at what they're barking at, it's my neighbor poking his head over the fence just looking at me. And when I ask him if there's a problem or anything he just says no just looking... this man is like 60ish years old ( so he's old enough to know what he's doing is wrong but not so old to just let him do whatever he wants to do) and has his own yard to look at so I got tired of it and got a fence that's twice as tall and paid the extra money to get the permit for it and everything. And lo and behold I had privacy for about a week, And then I noticed he got a fucking ladder, because he was on top of it poking his head over my fence to just look. I really don't like it and it's really creepy especially since he's about 40 years older than what I am. It's outside so I don't know if it's considered an invasion of privacy but I'm really tired of it.

Summoned for jury duty in Oregon but I am studying abroad for two years

    Posted: 09 Feb 2020 08:32 AM PST

My parents live in City A, where I grew up. Up until 6 months ago, I was living and registered in City B of the same state. I accepted an offer to attend a two-year graduate program in Europe last year. Six months ago, I changed my Post Office address to my parent's home in City A before leaving the country.

A few days ago, my mother tells me that I've been summoned for jury duty in City A. The court dates are next month, well into the semester and it would be absurd to attend. Unfortunately, on the list of exceptions there are none available for studying abroad. Also, the deferment period is for a maximum of one year and I won't graduate for another 18 months.

What's the best course of action?

Stranger repeatedly checking my mom’s mailbox in the middle of the night!

    Posted: 09 Feb 2020 04:20 AM PST

I got my my mom a Ring camera for her new house & since installing it, she has been visited 4 times by the same man who comes to her house to look in her mailbox. It's always in the middle of the night. After the first time, she bought a new box that locked & reported him to the police. However, the police said they can't do anything because he never actually stole anything (mailbox was empty). Anyway, he keeps coming back even though it has been locked on his subsequent visits. Can she do anything to legally stop him? Can this considered trespassing? It's beyond frustrating the police won't do anything. He's attempting to steal someone else's property. I don't get it. She reported it to the USPS inspector as well and that was useless.

    Any tips appreciated.

Edited to add: This man is young (30's). This isn't a case of dementia.

Property sale being blocked by neighbor

    Posted: 09 Feb 2020 12:16 PM PST

    Virginia - USA

I own a commercial office suite in an office park. I contracted a realtor to sell the property. I was just told by the realtor that every time he goes to show the property to potential buyers an adjacent neighbor comes over and bad mouths the property, the owners association, and the area in general.

The man is an 80+ year old retired police office who owns one the neighboring suites. He is a mean and rude man that enjoys confrontation.

I have had two offers for this property in the past two months fall through after this guy approached them.

Is there any legal action I can take against this guy?

Maybe a cease and desist or no contact order?

Can I sue him for monetary damages for sabotaging the potential sale of the property?

Set up a camera to see who’s stealing my mail.

    Posted: 08 Feb 2020 01:59 PM PST

For the past few months my amazon packages have mysteriously been getting stolen or "missing". I order a lot of things online and if let's say four packages arrive, 3 would be here. I purchased a motion activated camera to figure out who's stealing my shit and what do you know, it's the neighbors kid next door.

Before I called the police I figured, might as well let the kid return the stuff and talked to his parents (17 years old should fucking know better) and the parents said that since the packages are on their side of the apartment it's legally theirs and an "honest mistake". Totally ignoring the fact that I have the kid on camera stealing them...

I contacted local police and they said that they didn't want to screw up the kids life blah blah blah and that should be the end of it. On top of the fact that my stuff wasn't returned. Should I take legal action against these people or let it slide, the items stolen are all over $10 each. And this has been going on periodically over a 6 month period.

I'm in Florida if that helps.

I refused to accept a screenshot of a coupon from 2013, and now the perpetrator is posting images of me along with very negative reviews. Is there anything I can do?

    Posted: 09 Feb 2020 11:50 AM PST

To give a bit of background I'm just an 18 year old minimum wage worker, I try to do my job to the best of my ability. A customer attempts to show me a screenshot on their phone of a coupon from 2013 that they found on Google Images. I refuse to accept the coupon as it is a picture of a coupon not an actual coupon.

The customer then chastises for a few mins before calling me a dick then taking a photo of me.

With the customer attempting to use what is the equivalent of a picture of a $20 bill, is there anything I can do to get rid of the images posted of me

Ex wife and new gf battles after ex dies (thank goodness I'm and ex removed from this situation)

    Posted: 09 Feb 2020 08:29 AM PST

This is long, complicated and painful so please bare with me. Manitoba Canada and some details have been purposefully left vague

I lived with D for 10 years until we split up in 2017. There was underlying animosity, but civility and we had to stay in touch to sell our house in 2018 (which we did successfully-ish). At the end of 2018 he posted photos on his Facebook account of his brother and son helping make some changes to a garage on "his new place". I inquired to send my congratulations (the place he was renting before, the owner wanted it demolished and sold to developers). Ex said his son had spent years saving his money and purchased this house and was letting him move in with him. I was skeptical (and couldn't find the listing online but let it go since asking would have brought out arguements, and let's face it, he wasnt my problem anymore!). 6 months later I get a text from phone number with his gf telling me D was in the hospital and it wasn't looking good. I went there that evening to find D in a coma, gf, ex wife and their 3 kids.

Continue the most uncomfortable visit, I leave, ex wife texts the next day to tell me D passed away that night.

D had been diagnosed a year and a bit prior with a untreatable illness and made a big deal to all of us (but not gf because they hadnt met yet) that he was getting his affairs in order, will written and indicated to me that I was still listed as his beneficiary for everything. After he passed, his ex wife and gf claimed they had no knowledge of a will and ex wife was pissed that gf had her name on the death certificate as common law (they had only been living together for 5 months at the time, and turns out it was HER house he moved into at the end of January).

Ex wife was mad that gf was claiming common law and felt their children should be the executors and entitled to anything left in the estate. Ex wife was even more mad that no one contested her claiming common law after living together for less than 6 months. That's her business and I personally don't care. She loved him and wanted to make sure his send off was what he would have wanted.

Back in 2009 D signed me as the beneficiary for a LIRA from his previous business and knowing that I was moving into an apartment offered to store a lot of my stuff until I was able to save up the downpayment for my own house.

Gf has ignored all my emails to request a copy of the death certificate so I can check with my bank about the LIRA and is of course claiming to other friends she doesn't have any of "my" stuff.

I have texts saved on my phone of him confirming beneficiary status and that he's got my stuff stored for me.

I've also got the texts stating it was his son's house (not hers) and all kinds of inconsistencies (part of the reason we split).

The bank won't check the LIRA without a death certificate to know if it's even still available and I can't get one without her approval, which clearly she wont since shes ignoring my messages.

Ex wife had her children apply for a certificate as they are entitled, but she thinks I'm helping hide some huge chunk of assets from the sale of our house that his kids should get (she is also delusional). He died with debt. Any % of 0 is still 0, but she is convinced it's hidden. She is (or is telling everyone she is) planning on going to court to contest gf as executor.

This whole situation is frustrating and I don't know if I have enough of a case to go to a lawyer? I can't really afford one, especially if he cashed out the LIRA and didn't tell me .

I know I'll never get my stuff back, which is also frustrating, but I've come to terms with it.

Being subpoenaed to testify, but I have my divorce hearing the same day.

    Posted: 09 Feb 2020 12:46 AM PST

I was called to set up a time for this dude to deliver a subpoena to me at work (to testify as a witness, apparently I was the only person they have as a witness) and I asked him the date that they need me and low and behold it is the same effing day as my divorce hearing. I informed him and he said he would try to accommodate. My question is, can he subpoena me for a court date that I already have a different court date on? If so, how can I finagle this so that I'm not going to be thrown in jail for contempt of court if I don't make one or the other? Should I hire a lawyer?

(IA) Fired for not using my phone while driving.

    Posted: 09 Feb 2020 08:55 AM PST

I live and work in Iowa, and drive frequently to client sites. I got fired of Friday for not using my work phone while driving for anything other than calls. My boss frequently sends me texts and emails that I don't read or reply to if I'm driving. For one, it's illegal in Iowa, and for two, it's dangerous, so I wouldn't do it regardless. My boss had chastised me multiple times for this, and each time I told him that I won't do it because of the aforementioned reasons. I have audio recording of him stating that me not emailing and texting him even if I'm driving is why I was fired. Do I have any recourse? I know Iowa is an at will state, but can he really fire me for not breaking the law?

Mechanic has had my truck for 3 weeks, will not release it.

    Posted: 09 Feb 2020 10:56 AM PST

A mechanic is holding my truck. Says it needs a program but if I pick it up now, it will not work. Regardless, he wants $650 whether it works or not.

My truck has a starter interrupt from the finance company and a tracking device (my credit is shit). So they can pick it up at any time.

Mechanic had permission to work on the truck. But it's been 3 weeks and it's always tomorrow, tomorrow, tomorrow and then the past week he will not answer the phone.

My truck is being held indoors. Otherwise I'd just go cruise over and get it.

Critical surgery needed, but dependent person (18 y/o) can’t access insurance information due to parent in denial. [OH, USA]

    Posted: 09 Feb 2020 08:58 AM PST

    Location: [OH, USA]

Hi Legaladvice. My wife has a coworker who is 18 years old and still lives with his mom (his dad isn't in the picture). He just confided in my wife that he has brain cancer, which according to his doctor requires surgery as soon as possible for the best prognosis. The coworker previously turned down employer-based coverage during open enrollment, as he is supposedly covered under his mom's insurance (Medicaid) until age 26 anyway. The employer has set times to enroll in their insurance plan, but allows enrollment at any time if extenuating circumstances are present, which is defined as losing prior health insurance coverage.

According to the coworker, the problem with getting the surgery has been that his mom is apparently in complete denial about his condition. As a result, she has refused him access to his insurance information through her plan, which he believes makes him unable to get treatment.

    Several questions for you:

    1. What information does my wife's coworker need to get treated, since he's a dependent on her insurance plan? Does she need to give consent for surgery to happen?
    2. Is he able to somehow renounce the Medicaid coverage through his mom instantly (without bureaucracy), in which case he could join his employer's insurance fast?
    3. Is there a legal way to force his mom to give up the required information to allow him to seek treatment himself? Any help is appreciated!

I have a little more information which may or may not be useful. His mom believes he is fabricating the medical condition for attention, which is why she refuses to help. As a 16-year old, the coworker was admitted to a mental hospital for 2 weeks after a suicide attempt, during which his mom refused to visit him – as I understand it, because she thought it was for attention and not genuine. In addition, I think the coworker is buckling under the pressure of a serious medical condition and a broken home life. As a result, he has fallen into inaction, which from my point of view could cost him his life if this is genuine. We are both watching for replies and ready to clarify if more information is needed.

Fire department is charging us a $1500 for a “false alarm” when it wasn’t.

    Posted: 09 Feb 2020 12:16 PM PST

    Hi,

We live in a condo in Toronto. Last summer we smelt something funny and noticed a plant on our balcony was on fire. To this day we have no idea how it started but the plant was very dry and dead.

It was not a huge fire (a very small plant had caught) but enough that we used the fire extinguisher to put it out as it was the quickest and most efficient option. There was smoke but no damage to the balcony. A neighbour knocked on our door and asked if we were ok, we told everything is fine. The fire alarm went off in the building I'm assuming from the smoke, or someone saw and pulled the alarm.

The fire department came and we waited for them to come while we cleaned the area but nobody ever did. My roommate even went down to the ground floor to let the concierge know since that's the protocol

We got an email from the building manager saying the fire department is fining the condo $1500 for a "false alarm" and we have to pay it. We have evidence it wasn't a false alarm and kept asking to schedule a meeting with him to discuss further and he would say that we would schedule but kept saying he was busy, on vacation, etc.

It's been 7 months since and today our landlord called basically saying the condo will deduct the fine amount from his account and we are to pay him back he is being very understanding and sympathetic of the entire thing and has no fault in this, it's the fire department/condo.

Can they do this? We have email evidence too saying multiple eye witnesses saw the fire/smoke from our balcony and no fire fighters came to our suite to verify. This seems unreal to me considering it wasn't a false alarm, we have multiple pieces of evidence confirming that, no firefighters came to verify that claim. Do we fight this fine with the condo, the fire department? Do we have a case?

    Thanks

Adopted a dog and the original owner is... interesting

    Posted: 09 Feb 2020 10:23 AM PST

I work at a doggy daycare and one of our clients was R owned by S. R is a large working breed and still very much in the puppy phase, so he's very hyper active and rebellious. S constantly complained about him, wanted to re-home him, and even went so far as to say they wish they could have him put down because no one wanted to deal with him. I stepped in and offered to take him. Long story short I have him now and we're bonding and I'm working on his politeness training. S was sort of treating me as a glorified dog sitter and wanted to continue seeing him. On our last visit I had S sign a contract that transfers ownership of the dog over to me. I also was given his vet records, licensing/registration, the original contract from when he was purchased, and his microchip info. I no longer wish to continue these visits because it's only confusing R and S continuously critiques how I'm handling him. My only concern is her getting upset and then trying to take me to court for him or even suing me. With the contract and all the other paperwork I have for him, am I legally his owner now? Edit: I'm in Colorado

Employer is basing my short term disability on "base pay", when I am strict commission only

    Posted: 09 Feb 2020 10:06 AM PST

First post and am on mobile so I apologize for any formatting issues. I am in Ontario, Canada. In the middle of January I broke my ankle and am unable to work. I applied for short term disability, and the 3rd party that handles it said I would be getting 55% of my gross pay which I was fine with. I reach out to the benefits department to clear some things up and they inform me that I am to get $240/week because it's based on my "base pay". I told her I'm straight commission, I don't make a base pay. She responded that every one in my position (I'm in sales) gets a base pay of $22k a year. This is completely incorrect. I work straight commission. The only time I would get anything other than commission is when I do not sell enough to cover the hours that I've worked, then I get what is called a top up. Any money that is paid towards a top up, will come off your next pay cheques once you sell enough. I am hoping someone can clarify this for me? Thanks!

My mom is afraid my grandmother's situation could affect my parent's chances with their adoption

    Posted: 09 Feb 2020 07:36 AM PST

To clarify, my parents have adopted six children with special needs and are in the process of adopting a seventh. My grandma has reached an age where she really can't live on her own in the rural town where she currently resides. She had a close call a month ago and almost died from a severe hematoma because it takes hours to get to the nearest hospital from her house.

My parents have been trying to convince her to move closer to family and better medical services. She's had her driver's license taken away and really can't handle the giant ranch house and orchards she has. Convincing her has been pretty unsuccessful.

My aunt (dad's sister) has power of attorney. My dad's name isn't on anything that we're aware of. My mom is worried that if my grandma gets hurt again Adult Protective Services could be called and that could somehow affect their progress with their current adoption and possibly the conservatorship we (my parents and myself) have for my adult siblings with special needs.

I'd like to ease my mom's mind by telling her it's impossible, but I don't know for sure. I hope this makes sense. I'm happy to answer any clarifying questions. Thank you!

    P.S. We're in California

House flooded, bottom portion destroyed. Landlord refuses to have inspection or fix damages. (B.C. Canada)

    Posted: 09 Feb 2020 08:52 AM PST

Hey all, Will keep it short and sweet, I just need a bit of guidance because hopefully something about this isn't right. On January 31st, we got hit with some of the hardest rainfall recorded to date. Myself, like a lot of other unfortunate homes, couldn't keep all the water outside. The perimeter drains here are old, it's an older house and looks to be of clay tile. Odds are they are collapsed and backed up and the main issue. We informed him after a smaller flooding last year, however nothing was ever done. The water proceeded to back up, and thankfully I was home having cancelled an appointment just previously. Went to let the dog out and noticed the floor downstairs to shoot water out the sides as soon as I stepped on it. Opening up the garage door confirmed that we were flooded. The perimeter drain access is at the back door of the garage.

I obviously called my landlord, and he proceeded to tell me to talk to my neighbour for a subpump, which he did not have. Three hours later and three inches of water he did show up with one, dropped it and left. This is after i had been using a shop vac to try and do whatever I could to save my stuff.

After finally getting the majority of the water out thanks to the shop vac and sub pump combi we were able to finally see the extent of the damage. There's water under the storage under the stairs, in the closets, on the dry wall, the floor is toast. We also have this really strange laundry room that's built on what feels like a pallet floor with plywood. It's hollow underneath and the water had easy access to under the entire floor. The house needs work, it stinks like mould.

I called my landlord to ask what was the plan to fix this, he dropped two packs of floating floor that don't match, and a square of carpet, proceeded to tell me "it's not that bad" and that was the last I've seen or heard from him. He refuses to answer my calls, but will phone tag my roommate (Out of all the roommates, only I live downstairs) and ask what my plan is?

I don't believe this is my responsibility to fix this, and it was all totally preventable had he just looked into drains a year ago when we told him. My roommate has told me he also refuses to get anything inspected or looked at because "it's too much money".

Is there anything I can do to make him make our home habitable again? Sorry, I don't know if all this is the right formatting etc I'm just at a loss here, I love my home.
