    I was rear ended last week. Me (2010 Lexus RX450h, approx. 100k miles), I was hit by a 2016 Jeep Patriot. I was stopped and on my brakes and he (from my perception) was going nearly 35 mph and didn't pay attention to the fact that I had stopped because someone a few cars ahead was making a turn.

    At this point, I have got rear ended with me driving and my mom driving both within the last two years- I drive very little as I have the luxury of taking the bus to work. So, I do not particularly want this car or any car anymore (I do know that what I want does not really matter in the logistics of this). An adjuster looked at my car and appraised $2,600 in damage. Obviously, the lift gate, rear bumper and atleast a portion of the exhaust needs replaced... The adjuster did not notice the exhaust. Who knows what the unibody looks like, it still needs to get torn down. Do you fellow reddit-ers think this is totaled or they will want to fix it? Based on the damage.

    I am concerned with the brakes being damaged from him pushing my car while I was on the brakes, I did drive the car down the street before it got towed away to see if I noticed any big red flags, it made some noises that it did not make before and pulled HARD to the left, it was hard to steer in general but it definitely was pulling pretty hard to the left. Although, there were no lights on the dash board.

    Incontestability Period (PA)

    I've tried to find my answer online, but i'm not finding one. If a life insurance policy is purchased through an employer, and years later, you increase the amount of coverage (on the same policy). Does the incontestability period count down from the original date you signed up for the policy or the date that you increased the value of your policy(i.e. is it considered a brand new policy)?

    Can I be held personally liable for damaging a rental van a company rented out and asked me to drive and drop something off?

    This is based in San Diego. Lemon Company signed and rented a rental van (from a production company not Avis or dollar or those places). In the contract it says that anyone that drives the van is considered an employee of Lemon Company and covered under the insurance policy they submitted to cover the rental period. My name Or signature is nowhere on the contract

    Lemon company instructed me to drop off electronics at a house. I did it but damaged the side of the truck in the process with scratches. They sent me an email before I dropped it off and at the bottom of the email it says don't drive On the roof (where you do normal drop offs) because it's not wide enough. I however did not check the full email and did not see that part as I was in a rush to drop it off for them They decided not to go through the insurance policy they submitted to cover the rental van and paid out of pocket. They now are threatening to sue me personally unless I pay them back fully for the damages ($7,428) through a demand letter. They say they loaned me the car and I am liable for it because they sent me an email instructing me not to drive onto the roof and I ignored it and decided to willingly and negligently damage the van. I am not their full time or part time employee. I was helping out on a gaming event and they asked me to drive it. I read the contract between them and the rental company before I drove it where it says any driver(myself) is considered their employee and covered by their insurance policy to make sure I was covered by insurance. Am I able to use CA Civil Code Section 2338 as a defense if I am sued?

    " Unless required by or under the authority of law to employ that particular agent, a principal is responsible to third persons for the negligence of his agent in the transaction of the business of the agency, including wrongful acts committed by such agent in and as a part of the transaction of such business, and for his willful omission"

    Tree removal co. damaged my car- damage is more than blue book value of car but mostly cosmetic (hopefully). I can't afford a new car what do I now?

    I own a 15y/o car, nice model- very good condition. Neighbors had tree cut down by pro company, LSS their tree branch knocked a branch off of our tree onto my car roof. I got one estimate; repair will be more than blue-book, possibly twice blue-book value if frame is damaged. What happens now- I can't afford another car, don't want a different car. What happens in this situation?

    Looking to get into Claims, No degree.

    Hello, I'd like to get some opinions on whether or not I'm going to be wasting my time trying to become a claims adjustor with no degree or prior Insurance or financial experience.

    The majority of my work experience is operating CNC machinery. I have a few years of retail from 6 years ago, I've been in steel fabrication since.

    I want to pursue a more rewarding career, did a bit of research and being a claims adjuster sounds like something I would enjoy doing.

    So, am I being unrealistic thinking I can enter this field with no degree or prior experience is anything close to similar out side a retail?

    concerned about something a loved one's family member is doing with their insurance claim, need advice.

    Okay, so long story... and it's touchy so please bear with me and understand the claim hasn't been filed yet, and I am trying to get good advice to try to stop this behavior....

    My girlfriend has a 20-year old sister who has a serious issue with underage drinking and driving. There have been past instances where something happened before the one I will tell you about today, but I was not in the picture for these occurrences. So a quick rundown of the past leading to the question you'll see:

    In November, the girl (my girlfriends sister) was involved in a not-at-fault accident that put her car out of commission for two months, pending repairs. Her mother accepted liability of a rental provided by the at-fault parties insurance company. During the procurement of the vehicle, she did not list the 20-year old daughter as a driver, and listed herself as the sole operator of the rental. Fast forward a month.

    Last night, 20-year old goes to a house party in another city. She gets reasonably drunk and at 1:30 AM proceeds to drive home, 40 minutes from her mothers house and an hour from the location of the party. At about 10 minutes from home, she over-corrects the vehicle and crashes it into a median/ditch. She calls her mother, who proceeds to go get her. At some point, the cops do find her and check on the situation. The town this occurred in is small and doesn't have what I would call.... An A-Team law enforcement squad. They somehow miss that she is likely intoxicated and she avoids citations, because her mother showed up right in the middle of their encounter and gets involved.

    The car, the rental she was not supposed to technically be driving, now has sustained front-end damage and is non-operable. They tow the vehicle back to the apartment and then take her home to her mothers house where she spends the night. Today, her mother reviews the papers for the insurance and realizes that the 20-year old was not authorized to be driving the vehicle, drastically changing the liability.

    Now mom wants to tow the vehicle back to her house and falsely claim she was driving the vehicle at the time of the wreck. There's obviously a felony involved in this, depending on the extent of the claim and the municipality it takes place in. I cautioned them to not even try, because the police made contact with the driver... As a result, even if they didn't issue a citation or an arrest, there is more than likely a record of police contact with the driver, and quite possibly an incident report. Something I am more than sure the insurance company can come to possess by just looking up the vehicles license plate with police agencies in the area.

    I've cautioned them against doing this, and told them that they need to take fault instead of bailing out this loser for the 9 millionth time. They are persisting to move forward with an attempt at fraud... Which alarms me. I let my girlfriend know if she got involved, I was done because I would not associate with someone who defrauds an insurance agency to cover a drunk driving minor with unauthorized access to the car. I'd rather be single than associated. So far she has stayed out...

    But I don't feel good about this or knowing about it. This is both a criminal act of deceit, while other drives play by the rules... And its perpetual enabling of someone with a repeat offense mindset... Someone whose going to end up killing someone worth far more than her. What should I do? What recourse do I have if I don't know the liable agencies to report suspicion of fraud to? Who should I call?

    DOI complaint now what?

    I am a liability adjuster and have been notified a claimant filed a DOI complaint against a claim that I worked on. The complaint is due to a recision of a total loss offer due to limits excess. If it is found justified, does it go against my license? And how does that affect my ability to get other jobs and different companies?

    I just heard that in California, auto insurance covers the repairs needed if wrong fuel is put in the fuel tank. Regardless of who does it and under no fault.

    There is a long standing radio talk show that I listen to. A caller called in and said this happened to him. He put the wrong fuel in and didn't think insurance had anything to do with it. The mechanic suggested he call so he did. He found out that they did cover it and insurance paid $12,500 to repair his vehicle.

    I couldn't find anything online to confirm this. Any experience?

    Insurance saying that rehab stays are up for the year but will b available next year?

    So my friend is wondering when this will take effect as it is almost the new year. I seriously doubt he's willing to go through the trouble of asking himself but he rly needs to get into detox. So when they say he's used up all his insurance for rehab for the year do they mean until Jan 1st?

    Two Car Insurance Policies On The Same Vechile?

    Hello,

    Sorry if this is a repost, but I have a simple question. Can I you have two insurance policies on the same vechile? I ask becuase my realtive is going to let me use their vechile so long as I pay to be on the insurance. They use Geico but I would like to use USAA becuase they will give me a much cheaper price. I am not the registration / title of this vechile, and it is located in Clark County, Nevada. Also, would the owner (my realtive) have to be on my insurance policy?

    Insurance policy on roommates for rent not paid due to hardship?

    I had a roommate get seriously injured this past year and he had to move back in with his folks for a while. He was able to pay rent for the first 2 months, and we were lucky enough to find a friend who needed a sublet for the rest of the time. Both of our names are on the lease.

    The situation made me wonder if there's a type of "roommate insurance" policy I could get to protect myself in case a future situation arises - to cover their part of the rent should they not be able to pay due to hardship.

    I've never heard of anything like this, But I figured if something like this exists, y'all would be the ones who would know. Google was tough because the only results were for renters insurance, which I have and obviously doesn't cover this kind of thing. Thanks for reading!

    Auto Insurance Tire Replacements

    I recently hit a pothole big enough that it bent 2 of the rims on my car. One of the tires needed replacement and my appraisal states that this Delinte brand tire cost $170 "per simpletire.com" also states "no other listing found no betterment applied as new" not sure what that means. But as I looked up the tire, on the website, its one of the cheaper options at $70. Is this something I should contact the appraisal agent or is it the right of my insurance company to choose whatever tire they seem fit even its the cheapest option?

    My agent also told me in person that he would buy a nice tire similar in price to what i had before.

    Hit and run. Don’t want to raise insurance due to me being a teenager

    On Friday in my school parking lot my truck was hit by another car and the other car did not leave a note and on Monday I will be able to get camera footage from the parking lot of who hit me but let's say I don't find the person who hit me my deductible is already through the roof. I don't want to spend the $3000 to get my truck fixed out of pocket is there anyway I can have the insurance pay for it without raising my insurance price every month? is there anything I can do to help alleviate this and if it helps I have AAA.

    Audi involved in Felony H&R - time to move on?

    I was involved in a felony Hit and Run last night. The side airbags deployed along with some airbags in the seat by the B-pillar. The brunt of the damage seems to be directly in the passenger side door. The car is a 2015 Audi A4 Premium with 33,000 miles on it. With $20,000 collision coverage with Metromile and GAP coverage by CarMax. I owe around 20-something grand on it since it's financed.

    So my question is, do you think my(or the average) insurance provider, will pay to get it fixed or is it likely too much to repair? I'd like to know so if it is a loss, I can get started early getting another car from CarMax ASAP.

    If it is fixable, how long do you think it'll take?

    Suppose there is an insurance for retailer-issued gift card(e.g. Starbuck,Stop & shop, Popeyes, etc) that refund you 60% of gift card value if the store go bankrupt in 2 years, while costing 8% of the gift card value.(price varies for different retailer) Will you buy it? why or why not?

    How to get my twins accident off my record?

    Hi all, so im currently shopping around for car insurance quotes and im running into a problem, my twin sisters car accident keeps showing up as if it was mine. Geico refuses to give me a letter of experience when i called and asked (that was the insurance my twin was under when she got in that accident) so that i can give it to other insurance companies to prove that is not my accident so i can get a more accurate quote.

    Geico has been shitty as hell with the way they are treating me. They know its not my accident, they know its showing up as mine with other companies, and they refuse to do anything about it. How do i know they know its not my accident? Because i got a quote with them and lo and behold they were able to take that accident off because they could see it was not my accident but my twins accident. Sorry for the rant, but this has been frustrating

    Homeowners Insurance Liability Advice

    I live in Chicago and a few months ago I did a renovation in the Laundry Room/Bathroom of my condo. In the process, I needed to buy a second drainage hose which I attached to the existing drainage hose on my washing machine so that it could reach the drain. The connection seemed to work fine for the initial load of laundry, but during subsequent usage, the hoses detached and caused flooding into my neighbors unit below. We spoke to our neighbor and both reached out to homeowners insurance agents to resolve the claim. Our insurance company determined that we were not liable because they considered the incident an accident and not a result of negligence. They told us that our neighbor's insurance would need to cover the claim and that they would cover the deductible as part of our policy. The extent of the damage to our neighbor's unit is roughly $7,500 of which their insurance company is only willing to cover $2,500. Our neighbors have asked us to make up the difference.

    I do feel that we are at fault for the damage as we didn't sufficiently secure the hose, but I need some advice on how to proceed with both of our insurance companies. I was under the impression that our neighbor's insurance company would file a claim against ours to cover part of the damage, but it appears they've simply agreed to reimburse our neighbor at a rate much lower than the extent of the actual damage. I would appreciate any advice anyone could provide.

    Difference between eye exam and contact lens exam for "fit and follow up"

    Hello,

    So I was charged with contact lens exam for "fit and follow up" when all I needed was eye glass. I didn't really notice different charge between eye exam and contact lens exam until I was charged and my eye doctor did not even recommend or suggest anything about contact lens (because I told them I needed new glass).

    I do remember, though, that when optician technician asked me whether I wanted to try contact lens or not, I did say yes, but it was not apparent at all in written or no one really reminded me of potential charges on it.

    At the end of this visit, I did order glass and that was fine, but I am not happy for the extra charges of this contact lens.

    So my questions are

    1) Will the eye doctor indeed examine my eyes for contact lens?

    2) What can I do in this circumstance? (dispute or anything?)

    Question about PLPD insurance in Michigan?

    Hi,

    I have never had insurance in my life so I really don't know much about it. My parents had me on their insurance for the longest and when they finally took me off it I just been driving without insurance. My girlfriend recently bought a new car and took PLPD insurance coverage from Progressive. My girlfriend was having a bad morning when things weren't going her way and said today was going to be a bad, surely enough it did go that way. Some elderly lady hit her car as she was turning into a gas station. My girlfriend thinks PLPD insurance will cover her car if it's not her fault and proven. I read online but couldn't find much information about it. I asked a friend and he told me basically our insurance won't cover any damage to our car even if it's not our fault with the type of coverage we have, is that true? If you're not at fault and it is determined by the police and your insurance company that the other driver is at fault that my insurance company still will not cover any damage to her vehicle?

    Auto theft questions

    Sorry about the poor penmanship, have never been a strong writer

    This week I became the victim of auto theft, having had my travel trailer stolen from a secured storage lot.

    The authorities contacted me after an RV dealership realized that the trailer that they had bought(my trailer) from an individual, had changed the VIN number.

    I've been unable to personally see the trailer because it was sold in a town 2 hrs from where I live and an still waiting to hear from the police with instruction of what happens next.

    So obviously the rv is recoverable but I will never know what my trailer has been through, so I feel like the trailer is now "damaged goods" in the way that it'll never have that brand new feeling that it was when I bought it this past summer. It was my once in a lifetime big ticket trailer purchase and I will probably never be able to buy another.

    And I believe all of our camping supplies which we have amassed after camping for 20 years have gone missing too.

    My wife and I are both very uncomfortable with taking the trailer back. Was it slept in by the thieves? Were they doing crack in it? Having sex in it? We will never know.

    Me question is- what can we expect with the insurance company going forward? Are they going to insist that we have to take it back and have no say in what happens?

    The rv dealership that bought my trailer said that they have emptied all of the contents(kitchen goods etc) from the trailer, which also makes me uncomfortable. And I'm not even sure if it's all there, and I may never remember what has gone missing.

    Any insight from within the industry would be appreciated

    Eligible to contribute to HSA if only covered by HDHP for two weeks?

    I am currently on an HDHP and am enrolled in an HSA where I have contributed the individual maximum for 2019.

    I'm planning on changing jobs in mid-January 2020, and the new job only offers an HMO for health insurance.

    My question is this - because I am covered by the HDHP for the first two weeks of 2020, am I eligible to also contribute the maximum to an HSA during that time?

    Car insurance cost...

    I don't know if this is a good place to discuss this or not, but I need to ask for advice. I'm a fairly new driver, I've been driving for almost a year. Before I got my license I had almost no experience since I didn't go out driving a lot except for with the auto school. Now I drive almost every day and I've obviously improved, but not without my mishaps. I've been at fault for 2 accidents (one major and one minor). I just got my insurance statement in for Plymouth Rock for next year and it's about doubled from my original insurance cost going up over $6000 (I'm estimating paying $500+ a month).

    I can't afford that at all, my parents aren't paying for my insurance or anything, I'm completely responsible for all my car expenses for the most part. I have no idea where to go or what to do, because even though I know if I don't get into any more accidents it'll eventually go down, but I can't afford that expense at this point in time. I'm planning on changing companies but is there anything else I can do for now? (Also in my state it's illegal to not have auto insurance so I can't do that)

    [OH] Auto insurance & a teenager with divorced parents

    This may be a question for legal advice, but I thought I would try here first.

    My step-daughter recently got her learner's permit. My husband and I are good with our insurance company on our side of things.

    Her biological mother has limited visitation. My husband has full legal custody. Her biomom can't make any decisions for my step-daughter and doesn't provide any financial support. (It's absolutely not worth the hell that would rain down upon us if we tried to collect any financial support, regardless of the court order.)

    Biomom has been ticketed at least twice for no insurance and has not had it on at least one other occasion. She will get a ticket, then buy state minimum coverage for 6 months and then not renew. It's pretty safe to assume that she doesn't have any coverage now.

    What happens if my step daughter is driving her Mom's car on her visitation time and gets into an accident? Mom likely doesn't have insurance and is definitely judgement proof. Does our insurance cover her? Are we going to be liable for damages to another person or property if something happens in Mom's car on Mom's time?
