Cousins ex bf is suing me because I reacted violently to a horrible prank he pulled

    Posted: 03 Dec 2019 07:54 PM PST

I am from Oregon. One of my cousins (now ex) bf of a year, who is trying to become a famous YouTube prankster pulled a prank on me where he pretended to abuse my little cousin.

When I came home I heard yelling and the sounds of hitting and crying coming from my cousins room. When I ran up the stairs her bf came out and I asked what the hell was going on. In his words, "that b*tch cheated on me, so she got what she deserved" as I could still hear crying from that room and he was blocking the door from letting me in. I immediately blacked out(my dad used to physically abuse my mom in front of me, he knows this) and punched and kicked and next thing I knew he was on the floor screaming it was just a prank. I went into the room and he had a recording of a girl screaming but no one there. My cousin wasn't even in on the prank, she didn't know it was happening.

I checked if he was ok and his nose was bleeding, and his braces had cut really badly into his lips. I drove him to the ER because he was claiming he couldn't breathe out of his nose. He ended up with a fractured nose, and got stitches in his lip. The ER bill came out to almost $2k and he's telling me I need to pay it. I refused.

My cousin has since broken up with him.

He's now suing me for assaulting and for the hospital bill.

I still have the phone he was using to record the video but no way to access it because neither I or my cousin knows the passcode.

What can I do? Is there a way for the court to demand he unlock his phone? Is it just his word against mine? I have no other proof besides his channel where he's pulled pranks but not to the extent of this.

Does my employer have the right to tell me that I'm not allowed to use food banks - WA

    Posted: 04 Dec 2019 09:44 AM PST

I'm a social worker, and work primarily with homeless teens. It's something I'm passionate about because I fled my mom's sexually abusive boyfriend when I was 13 and have been flying solo ever since, so I can really relate to what it's like being a street kid. I enjoy my job and feel like I'm really good at it. However, I only make about 29k/yr. I have a husband who's a forklift operator, and together we have four children, a cat, and a dog. Our household income is about 40-50% of the median income for Seattle, we live paycheck to paycheck. When crap hits the fan and unexpected expenses come up, we often need to use food banks, and then we normally use things like free clinics and the Salvation Army coat drive. It's not unheard of for me to run into current kids in the program and former clients from work when accessing these services.

My employer overheard some kids (clients) in the office talking about how they saw me with my children at the food bank over the weekend. I brushed it off like, oh yeah they're great folks, our car has been giving us trouble and we needed a little help. No big deal right? I naturally transitioned the conversation into other things that weren't about me.

So my boss pulls me into his office later and starts grilling me about why I'm using the foodbank. Uh, because you pay me 29k/yr? I have a family? My car keeps breaking down and I can't afford to replace it? It was like he was trying to shame me. He was acting like I was gaming the system because I'm a social worker, taking resources because I can, which couldn't be further from reality. He brought up the ethics of seeing clients outside of work and how I needed to be mindful of places I went, saying I shouldn't be going to the foodbanks and resources that we refer clients to--which, spoiler alert, is pretty much all of them in the city. I told him that I was eligible to use them based on my income, that my family depended on them to eat right now, that I wasn't using my employment status to garner any kind of favoritism, and that I went to the foodbanks closest to my house.

He basically told me that I need to stop going to the food bank or I'd be let go.

    Is this legal?

Am I obligated to work with a person whose medical condition puts me at harms way?

    Posted: 04 Dec 2019 05:54 AM PST

I work at a fast food style coffee place. I work the night shift four nights a week, from 3 pm to 11 pm. From 3 pm to 6 pm, there are four people on the clock, then the manager and the extra worker leave. That leaves the two closers, in this case myself and someone I'll call Lisa for the sake of this, alone until 11 pm.

On Thanksgiving, I am doing the dishes in the back room. The store is empty of customers. Lisa, the woman I work with, is in the front cleaning. Suddenly I hear a strange, deep moaning. I silently approach to see what is going on; I have been warned by Lisa herself that she has epileptic seizures and never to touch her doing such seizures or she WILL hurt me. Apparently she has hurt another coworker during such an event.

Anyway, Lisa is on the floor, swinging her legs up and down as she moans. I say nothing. She doesn't see me. I pick up the store phone and immediately dial 911, confiding that she is having a seizure. They send an ambulance and I hide in the back, not wanting to alert her to my presence and scare her. I hear banging as if she is slamming her fist on the walls. I check on her again, peeking round the corner, and she is now standing, staring blankly out of the window. Again, her back is to me and she cannot see me. I say nothing and silently return to the back. I explain to the operator she is standing, and the operator is rightfully confused. "I thought she was having a seizure." I thought so too. I know nothing about seizures.

At this point, as I'm standing in the back, Lisa suddenly appears. She must have remembered I was there. She is walking directly towards me with clenched fists and clenched teeth. Her demeanor is extremely aggressive and it is obvious she is heading towards me to do something violent. My body reacted with fear and I ran out of the back door to get away from her. I did not know what she intended to do and I didn't want to stay to find out.

Now, I'm scared and running outside in the cold parking lot. I hear the back door open behind me as I go out there. She is following me! She sees me at the end of the parking lot and heads DIRECTLY towards me. I had no phone on me except for the store phone, and I was scared to let go of the operator, so I ran to the drive thru. I was alone with not a single person out there to help me. Luckily she did not pursue me into the drive thru. She kept walking down the street until the police found her and took her to the hospital.

I was very shaken up. The paramedics arrived looking for her but found me, scared to death, hiding in the store with the doors locked. They did not want to leave me alone for I was visibly scared.

I'm assured on the phone by my manager that I don't ever have to work with this woman again. I am grateful as I don't want to ever be alone with her again. I come in for my next shift, and guess who is there? Lisa.

I was livid. My manager did not even call me to let me know things had changed. She takes me aside and tells me, "I legally can't take her off nights. Her medical condition means I can't change her schedule. However I put a third girl on the shift with you so you won't be alone. This is until Thursday when I talk to my boss, then I can see what I can do."

I don't want to work with her at all. I'm livid. The whole time I'm working I'm checking behind my back to make sure she's not coming after me or having a seizure. To make matters worse, Lisa tells all the regular customers that she had a seizure. Over and over I have to hear her bring it up, and it really bothered me that night, and it bothers me even more hearing it again. She says, "I scared the poor girl. She thought I was chasing her." No, she was chasing me. She pursued me outside!

She apologized to me. She said she doesn't remember it at all. She said she does not want me to be afraid of her. She did not apologize for pursuing me, as I don't think she sees it that way. She just apologized for scaring me.

When I told my manager I didn't want to work with her at all, she told me there is nothing she can do. I said, "If you can't move her shifts, can you move mine?" She agreed to do that next week, and also offered to move me to work nights at a different store.

I don't think it is fair I have to inconvenience myself and leave my job completely because of some woman's endangerment to my wellbeing. I don't think it is fair that anyone should have to work with her at this point, but especially not me after what happened! I don't think it is fair I have to change my schedule because this woman came after me.

So, my question is, is it legal that they're not taking action and putting me in danger to work with her? Is it actually illegal to move someone's schedule or remove them from working with the public if their medical condition puts themself and others at harm?

Neighbor tells me I will no longer park my car on her side of the road

    Posted: 04 Dec 2019 07:13 AM PST

Hey guys, I'm a first time poster so I apologize if this isn't formatted correctly. This morning I'm walking to my car which is located directly in front of my driveway on the other side of the road. There is a fire hydrant about 16ft behind where I park my car that you have to park a good distance from. The neighbors house in question is a corner house and my car is parked on the side of their house on the road. I do this because of the spaces directly in front of our house are taken by other vehicles of various neighbors(to me, not a problem we share the street. Anyway as I'm getting in my car the neighbor (wife) comes out and yells at me telling me I will no longer be parking my car there. I respond politely with "I'm sorry mam (note these are the first words I have ever spoken to her in my life). I politely inform her me and my brother who parks in the same spot when I'm not there will be moving in two weeks and she wouldn't have to worry about it anymore before Xmas. She says that's not good enough and leaves. I drive to work and it is 10:15 and I'm still pissed.

My worries are that she will do something to my car between now and when I move any advice to legally protect myself would be appreciated. I really don't care about her and would like to just let bygones be bygones but I am afraid if I don't do something now this could end nasty. Thanks ahead of time and happy holidays.

My wife's boss wants her to do extra work for another department without compensation

    Posted: 04 Dec 2019 07:50 AM PST

Another department asked my wife's boss if my wife can help them on a project for 4 hours per week at another location one day each week, and her boss agreed and told her that she has to go.

She's paid hourly (and in a public sector job) and has to log all of her time (obviously), but her boss told her specifically to not log any hours spent working on that project, and that she'll have to make up those four hours by working extra time each week. This also includes the time it'd take her to go to their satellite parking lot to get her car, and the time driving to the other location for this new project – and that's also time that they said they won't compensate her for (and that they won't reimburse her for gas).

The other project hasn't started yet and she'd honestly be happy to help out with it (just frustrated that she has to 'make up the hours' later), but I told her that I think that counts as wage theft. Not a lawyer, hence posting here, but what should we do about this?

    We're in Ohio btw.

Bride's mother paid off and pick up wedding dress without permission.

    Posted: 04 Dec 2019 11:49 AM PST

In Illinois. I'm the maid of honor in a wedding in October. The bride and her mother do not get along. Her mother isn't even invited to the wedding after telling everyone she doesn't approve and some other awful things. After picking out and putting a deposit down on a wedding dress, the bridal store did not call the bride to inform her that her dress was available for pickup. Instead, her mother drove down there, finished paying for the dress (I'm not sure the total amount paid by each person but the dress was around $1,500) and is now holding the dress hostage, locked in a closet in her house.

Does the bride have any legal recourse? The shop essentially sold her dress to someone else. Is it theft by the mother since the bride paid the deposit even though her mother finished paying for it? My first thought is a charge back on the credit card for the deposit since she didn't receive what she paid for, but I'm not an expert here.

My book publisher just sent me my quarterly royalty check for $200. I'm owed over $5k in unpaid royalties that large companies like Amazon (which have NET 60 to NET 120 days) haven't paid, some transactions date back to 2018. Publisher won't pressure the companies, anything I can do?

    Posted: 03 Dec 2019 05:21 PM PST

My last three royalty checks for my books' sales have been under $300, and the amount of unpaid royalties my publisher has not collected from Amazon, Baker Taylor, and other large distributors is continuing to grow. With my current financial situation, that $5k is a huge amount for me to not have received and I'm growing increasingly frustrated.

I've had this conversation with my publisher multiple times but I get the same answer each time: "Yeah, Amazon and some of the big companies can take a bit longer sometimes, nothing we can do about it". I get that they don't want to cause any damage to their relationship with their distributors over one author's royalties. But it's ridiculous to me that they can tell me book distributors have NET 60 to NET 120 days from the transaction date to pay, and then do literally nothing when a distributor like Amazon hasn't paid for books they purchased in December of 2018.

So Amazon can buy several hundred copies of my book, my publisher can run out of copies to sell to other distributors who actually pay on time, and then I have to pay for future print runs by putting myself in debt because Amazon never sent the money for the books they've already sold to the public.

Am I crazy? Is this just something all writers deal with, or is there something I can do to pursue those unpaid royalties?

EDIT: It would seem that my publisher is what's known as a "service publisher", and that the way I've been working with them the past few years is anything but standard for the industry. I can't say I'm blameless, as I was contacted by them while in college, crowdfunding my first book and planning to self-publish. I jumped at a chance to sign with a "real" publisher and did so without consulting anyone with experience in the industry. I've published multiple books with them and now am not sure where to go from here. Oof.

EDIT 2: For those who want me to elaborate on the process here:

    • I pay for a print run as needed - let's say I purchase 1,000 books.
    • Publisher prints the books. I have them send me a portion (let's say 200) to sell myself at events, to friends, thru my website, etc. I get 100% of profits for these sales
    • Publisher stores the remaining 800 in their warehouse, and sells those copies thru their own website, as well as directly to Amazon, Ingram, etc.
    • I pay publisher a yearly warehouse storage fee. If I decide to stop paying that yearly fee and stop storing my books with them, the remaining books are sent to me and the publisher stops selling copies thru their website and directly to the aforementioned distributors (This is what has kept me hooked in the past, because I have no idea how to go about dealing with Amazon or Ingram directly, and didn't want to lose the distributors who buy the bulk of my books)
    • When the warehouse runs out of copies, they contact me to ask if I want to buy another print run.

Abusive soon to be ex husband, facing charges, multiple false CPS calls.

    Posted: 04 Dec 2019 08:56 AM PST

Obligatory mobile user and this is gonna be a long one, but I appreciate any help or advice.

I left my extremely abusive husband back in August, after he beat me in the head while holding our almost 3 year old son. I had a concussion and a hematoma in my head. After he stopped beating me he took our son and put him in the car and left while I was still trying to stand up and catch my balance. I have pictures of the injuries, as well as doctors notes confirming the injuries. After he found out I called the cops, he told them that I punched our son in the chest, supposedly there was a tiny scratch on my sons chest that he claimed i caused (anyone with a toddler knows they always have some kind of boo boo, keep in mind he had just beat me while he was holding our son). Anyways, we both ended up spending a night in jail because that's just how domestic violence situations normally go in NC.

The next morning when I got out of jail I immediately went and filed for a DVPO. I was granted that and temporary custody of our child. If they had really thought I had hit my child, the judge wouldn't have granted me full custody. I got my son back a few hours later-there was no mark on his chest. My ex then went to the domestic violence women's center (they helped me file the 50-B) and screamed at them and punched the door because they told him they couldn't help him. This is all on record with witnesses. 10 days later we went to court to get the 50-B for one year, he got an attitude with the judge and was yelling that I assaulted our son and the judge wasn't buying it. Also, just to mention, CPS had to investigate the abuse allegations, found no evidence of abuse and closed that investigation early.

Fast forward a few weeks, I was involved in a slight car accident. It was so minor that there was hardly any damage to my vehicle other than a few scratches, and I went to work a few hours later. I also had the paramedics check my son just in case and they rubbed him down, checked his movements, and said he was fine. They even complimented me on how well I had him strapped in his car seat. Well, husband called CPS again. Told them I was involved in a major accident and refused medical care for our son. He also told them I was living with a drug dealer (not true). They came out to my house, talked to me about it and then said they would close the investigation. A few days later he made another call that I was on drugs before they could close the investigation. CPS ordered a drug test, i passed. They closed both of those investigations early.

Then on October 8th he tried to call my cell phone. He was arrested for violating the 50 B. He also had his family members messaging me and trying to intimidate me, but I couldn't do anything about that because no clear threats were made. Then he started messaging my family members, same thing. Then, about 3 weeks ago, (right after he found out I was going after child support) he called CPS AGAIN and told them I had a meth lab in my house, that I burned my son with cigarettes, among many other things. 3 cops and 2 CPS workers showed up at my door ready to take my son. They looked around my house, made me take my sons clothes off so they could take pictures, and found absolutely no evidence of anything. And I haven't heard anything from them since.

We have court tomorrow, again. I am facing assault on a minor under 12 from the allegations that he made saying I punched my son in the chest, and simple assault (he also said i hit him). He is facing assault on a female. It's worth mentioning he is currently on probation for literally the same charge I am facing. I am just kind of wondering what to expect, or what I should do? Any advice at all would be appreciated.

Insurance Company refuses to delete my banking information. Is this illegal?

    Posted: 04 Dec 2019 07:26 AM PST

I got a notice of termination from my business insurance agency. In order to pay it on time, I had to go to the online system and pay the bill. (I didn't see the notice until the Saturday before the Monday it was due. I wanted it paid by the time they started business on Monday. I'm not someone who doesn't pay bills on time, I just missed this one.)

The only way I could pay online in time was to save my banking info on their site, which I did. I now want that info off their site. I am not able to delete the information, I can only update it with new banking information. (Putting in bogus info doesn't work -- it just tells me the info is bogus and doesn't update or delete the old info.) There is a number on the site they say to call if you wish to delete your information. I called it.

The first person I spoke with said that information can't be deleted. I asked to be bumped up to someone who could delete the information. The next person I spoke to said that they couldn't delete it, but that they would make a request to another department to remove the info. They didn't know how long it would take to be removed, IF AT ALL. I asked to call that department directly. I was told that department does not have a direct line because they only work internally and not with the public. I asked to speak to someone who could make this happen now and was told there is no one else to speak to.

This 20 minute (yes, this took 20 minutes with all the holds and transferring) call was all very polite. The person I was speaking to told me she understood my concern and she's heard this complaint before. She also gave me the email of their complaint department. I feel like this is illegal -- can they refuse to remove my banking info? This is a large insurance agency that you've probably heard of, not some scammy little company. How do I find the law that says this is in fact, illegal, if it is? I'd like to include that information in my email. Thanks for your help.

[TX] Squatters on the property next to mine are parking boats, cars, and 18 wheelers on my property. When the towing company shows up they always have someone there to run out and claim they own it and the tow compant is SOL

    Posted: 03 Dec 2019 04:11 PM PST

Apparently if the owner is at the vehicle the tow company cant do anything unless its hooked up enough to safely tow away.

I know for a fact they do not own some of the vehicles because they rent them out truck drivers.

    What are my options?

Can a company force me to pay for unsolicited products that were deliberately sent to me?

    Posted: 04 Dec 2019 02:41 AM PST

So every year my children's school in Pennsylvania sends home these holiday picture packets. It contains their school picture printed on paper trains, rulers, lollipops, etc.

They send these out to us without us ever ordering it. Three days after receiving the pictures, we get a letter saying "if you want to keep it, send "x amount of dollars" in the envelope provided. By this point my kids have lost many of them and thrown some of them. It happens every single year.

I do not believe I should pay for something that was given to me when I never asked for it! Can a company demand payment for this or is it a bluff?

Long Island, NY - Hidden Audio Recorder in Sons Backpack

    Posted: 04 Dec 2019 04:04 AM PST

Sorry for formatting, on mobile. My friend had this happen a few days back and asked me to post as he doesn't use Reddit.

So this past Saturday, 11/30, I had my two and half old son over for the day. The past month his mother has been sending him out when I pick him up with a little backpack with some snacks and stuffed animals inside. My mother had been rather suspicious of the backpack thing even though she never shared her suspicion with myself. So during my sons nap, I lay down with him and take a nap myself. When I woke up I had received a text message from my mother with an imagine of a small audio recorder that she had found inside a small flap inside the backpack. About and hour later my sons mother had come to pick him up. After about 2 minutes after she drove away my phone started ringing. I instantly knew what it was about. I ignored the call, as I do with about 95% of phone calls I receive. So about a minute after that she shows up at my front door, ringing the door bell. I answer and she asks if something had fallen out of our sons backpack. I knew what she was looking for but I had played dumb. I told her no, and asked what it was. She called it a black sock since the device was inside this small black sleeve that it must have come with and was connected too. I told her no and she had asked me to look for it. I pretended to look around the couch where the backpack stays during our sons visit and after about a minute of searching I informed her that I didn't find anything and asked again what it was. She said a black sock and I said nothing fell out, that I only took out a snack of his and that was it. She reluctantly accepted my answer and while walking back to her car she tells me "if I find out you have it, its not going to be pretty" or something along those lines. She continued to text me during her drive home how she was gonna get the cops involved etc. I told a friend of mine (the gentlemen posting this for me) and he googled the device and and had informed me how to do a factory reset on it. I reset the device and looked around my room for a usb cable that would fit into the small charger slot of the device. Luckily I had one and connected it to my laptop and looked at what was on the recorder. The audio files matched the days that I had my son on the weekend and listened to the one from that day. There was mostly white noise but you could hear the occasional conversation and interaction with my son. I deleted the files from the device and disconnected it from my laptop. So with her texting me more threats of calling the police and that she would show up within an hour with them I decided to go next door and talk to my neighbor who is a local police officer. He told me that I should go down the the precinct and file a report to have it documented that this device was recording my family and I during my time with my son. So I followed his advice and went down to the precinct and filed a report to have it documented. I also informed my lawyer of the discovery. About 2 hours later a police officer finally showed up upon her request and asked me about the device. I told him straight out that I had it and offered to hand it over to him but he did not want it since my sons mother hadn't showed up yet. About 10 minutes later she finally shows up and the officer comes back into the house asking about the device and asked me if I wanted to give it back. Having deleted the files and already filed a report, I had no issue with giving the device back and handed it over. She informed the cop that I had abused her and had illegal guns, neither of which are true and the officer simply asked about the guns and I told him I only had long rifles and he didn't seem to care much about it. So he returned the device to her and after about 30 minutes they both left and she had texted me "why must you be like this" So I told her that I went to the precinct and filed a report and told my lawyer about what happened. She was concerned if I had pressed charges on her and I did not since the police at the precinct insisted she had the right to send an audio recording device in my sons backpack without my knowledge since it pertained to the kids safety.

That's a long round about way of how things had unfolded and I am basically just curious as to what everyones opinion and advice would be about the situation.

TL;DR = babies mother bugged our sons backpack to spy on me, I informed the police, and gave the device back. What legality does she have to do so, and what is your advice on the matter.

[CA] Friend in college had ALL of her school stuff (laptop, backpack, wallet, homework, etc) stolen, along with the rest of the class, after the professor forced all students to leave their belongings outside and then failed to watch them. Does she have any recourse with the school or professor?

    Posted: 03 Dec 2019 04:16 PM PST

Title is basically the whole story. The professor required everyone to leave everything outside the classroom for a project, and everyone's belongings were stolen. Obviously financial compensation is desired, but there are also concerns with her other classes and the schoolwork that was stolen due to this professors rules. What can she do?

Is an HOA legally obligated to warn us before shutting our water off for periods of 8+ hours?

    Posted: 04 Dec 2019 10:04 AM PST

    I live in southern Arizona.

We do have a landlord but she lives across the country and isn't super involved (she's our grandma), and the HOA is really the ruling body of the neighborhood (a bunch of converted condos) and they're the ones we're dealing with.

The problem: I think this neighborhood is really old, and thus experiences pipe problems and/or needs renovation from time to time. Ever since we moved in a few years ago, they've shut off the water to the entire neighborhood occasionally to do things like "fix an underground leak." They used to provide us a day or more advance notice, which was fine, we had time to run down to the store for some water, we could plan ahead by showering or filling our brita before the work was scheduled to be done. But over time, they've gradually given us less and less prior notice. Yesterday, I woke up to the water being turned off. No prior notice. I opened our front door and found a "notice" taped up there, stating that they'd be fixing a leak starting at 9am and to "plan accordingly." But, my fiance left for work almost exactly at 9am as he always does, and there was no notice there yet, which means they taped it up AFTER the water was shut off. I had to go the entire day without water in my own home. Couldn't shower for work, couldn't use the bathroom or wash my hands or even get water. It was off for at least 7 hours, possibly more, I don't know because I had to leave.

It was on again in the evening. But then today, I woke up to it being shut off again, this time with NO NOTICE at all, not even a last minute 'oh shit we forgot to leave notices' notice left after 9am on the door. No notice. Is this legal? I'm beyond frustrated, I really need to be able to use the faciilities in my own house because I partially work from home, and I have a young niece and nephew coming over today to be babysat. I would have prepared beforehand if I had been given adequate notice, but as it is I have literally zero time to drive to the store to buy a shit ton of water.

Is there some kind of law protecting tenants that I can quote just to scare them into properly notifying us?? I get that work has to be done sometimes, I just want to know ahead of time! Do we need to get our landlord involved or should we just take it up with the HOA?

Custody papers say dad gets them every weekend. Dad has been out of state and sends grandparents to take care of them. Do we have to let them go with the grandparents?

    Posted: 04 Dec 2019 12:22 PM PST

My wife and I have two children. They are my stepchildren and the father and her have been separated for several years. It is apparent to him that fatherhood is a burden and he has relinquished many of his rights with them in order to get his child support minimized.

He is granted custody of them every Friday at 5 PM and then that ends at Monday at 8 PM. For the last 8 weeks however, his parents, their grandparents, have come and picked the two children (age 5 and 7) up instead of the father. When I inquired with where the father was, they told me he was working in another state but "planned to come get them next weekend."

The custody papers do not make mention of who gets custody on his days in lieu of his absence. All I could find was that in the case of his death, they would be allotted his time. He isn't dead, he just doesn't give a shit.

My question is, since the custody papers do not mention his grandparents outside of the issue of his death, do we have to keep giving them up every weekend? And before I am accused of keeping the children away from their grandparents, the grandparents are the ones wanting us not to give them up! They are just as burdened by having to become parents by their own child's negligence. Please help!

How Do I check if I have a restraining order from outside the US (Ex Reportedly Filed a RESTRAINING AGAINST ME )

    Posted: 04 Dec 2019 06:24 AM PST

My ex reportedly filed a restraining order against me after I called 911 on him when he treatened to hit me if I didnt leave because I was pregnant. This all happened in Orange County, CA

He reached out a few weeks later telling me he filed a restraining order against me and that he wants to work things out then later on he started to ask me to buy him $800 worth of sneakers and bags and then started calling me names when I refused, he also ended up threatening me when my sister told him to leave me alone.

How can i check if there is indeed a restraining order against me in the us when im no longer living there.

Also, is it possible to make sure that if anything happens to me he can't appear out of nowhere claiming my son so that he can have my assets too?

Was laid off from my job. I would have to wait 3 months to be able to withdraw my 401k. Would there be a problem if I ask my landlord to give me an eviction notice so I can take a hardship withdraw? Michigan.

    Posted: 04 Dec 2019 12:31 PM PST

I was laid off from my job and am really struggling to pay bills. While I have enough, it's pretty tough. I want to take some money out of my 401k to help things until I get another job. Problem is my former employer still considers me an employee, only 'temporarily' laid off until a 90 day period. To be able to request a hardship withdraw I need an eviction notice. Would it be wrong or otherwise illegal to ask for an eviction notice? Thank you.

Edit: I do not mean asking my landlord for a false eviction notice without reason. I am wondering if I were to be late on rent, if I could request an eviction notice.

Landlord suddenly refusing to allow mail to be sent to my apartment

    Posted: 04 Dec 2019 02:34 AM PST

I've been living in an apartment building for almost a year now. A couple of weeks ago they announced that they would no longer be accepting packages and that residents have to use this ridiculous service called fetch to accept packages (basically they take the package and then re-deliver it...). I'm no longer able to get mail delivered to my own residence and if I try they initially were just giving my packages off to this 3rd party and are now threatening to return all mail to sender immediately, not even allowing packages to be delivered to me directly or to allow a delivery notification so that I can go pick them up myself.

Fetch doesn't work for me as they only have time slots that don't work with my work schedule. So basically I can no longer get packages, at all.

The only thing in the lease is that they are allowed to accept packages on my behalf, but now allowing them to be delivered at all has to be illegal, no?

Wondering what my options are. I live in Portland, OR

Rented car in EU broke down in the middle of the highway, not sure about the next steps.

    Posted: 04 Dec 2019 12:50 PM PST

The car was rented in Austria. It kept having problems as soon as we left the rental, the check sign came on.Later on the car could not go above 70 km/h, but we were on the autobahn where the speed limit was 110 km/h. We also had problems starting the car, previously, it took 5-10 min to start it so we called them but they just told us to bring it to the office to change it. We got back on the highway, where the car started making noises and did an emergency stop, turns out the passenger wheel had broken off and was barely attached to the axels.Of course we started calling the company, and they told us someone would come the next day... while we were stuck on the highway. We kept calling them again to figure out a different solution, but they stopped picking up our calls.Random people kept stopping on the autobahn to help, and they also called the company for us. Their calls were picked up and finally after 2 hours the company came with a new car.

The car also apparently broke some safety regulations, because it did not have a warning triangle. We paid the company insurance and are currently waiting to hear back from them, but do we have any basis for further action? As we see it our lives have been endangered the moment we got into that car.

Any help or pointers will be appreciated, we are not from EU so we don't know how these laws work. Thanks

Being Evicted/Sued for a home I left months ago??

    Posted: 04 Dec 2019 12:39 PM PST

So here's the story. (location: Indiana USA) Me, my mom, brother and his fiance all moved into a house with a one year lease. After the one year, it is automatically a month to month lease. We lived there the entire year and then when me and my mother decided to move out, we both provided the landlord written 30 days notice and promptly moved out all of our things. After that, my brother and his fiance paid rent for months. Brother and his fiance broke up, she moved out (unofficially, she didn't put in notice to the property management or anything) and refused to help him pay the rent. She claims to have paid electric but it was shut off this morning. Also this morning there was an eviction notice on his door which mentioned ALL of our names, including my mother and I, who have been moved out since April. Mother called and the landlord said we are still on the lease and are responsible for rent and damages and they will sue us for them. What I DIDN'T know, is that apparently when the 30 days notice was delivered to the landlord, they refused to take our name off of the lease unless we found replacement applicants. I learned today that they aren't legally allowed to force someone to find new residents, and refuse to take us off the lease.

What I don't understand is that we did everything correct, and I even have proof that I haven't lived there for months. How can they possibly sue my mother and I, for rent for the past two months if we have proof we haven't lived there?

We have : - a copy of the original lease - a copy of our 30 day notice - plenty of mail to move we haven't lived there - pay statements for a storage unit starting in May, when we very first moved out - text messages of me mentioning to friends that I'd moved out.

I am 22 years old and I did nothing wrong. I don't want my brother's fiancé to be the cause of me having an eviction on record for a place I shouldn't even be responsible for.

    Please help.

Landlord refuses to heat my apartment properly

    Posted: 04 Dec 2019 11:40 AM PST

So I just moved in about 2 months ago and have a slumlord from hell.

He refuses to fix anything and its getting very cold here in Wisconsin. The law states that you must have the apartment be able to heat to 67 degrees.

Here's how it works in these apartments. The vents in the living room, and both bedrooms don't work at all. There is a vent in the kitchen that blows very hard but that is it. This so happens to be right next to the thermostat in my living room so it has no issue reaching 67 degrees.

Rest of my apartment is ice cold.

Is this legal? Saw my heat bill today and wanted to cry.

Is it legal to have an employer refuse to let you clock in?

    Posted: 04 Dec 2019 12:06 AM PST

My old job (I quit 5 months ago) had a system where a manager had to clock you in. I would show up and essentially have to harass my managers to clock me in. I have had to work without being clocked in under threat of being fired / written up if I didn't.

I have a deep suspicion that they fucked my hours up when I should have been getting overtime, and that they never adjusted my hours to reflect time worked. I have no way of proving anything except they made me wait 30min to over an hour to clock in. I'm not even sure I could prove that.

Is there a way I could subpoena them for my hours logged/worked ? My paychecks always seemed smaller than I expected even with my withholdings. Would a lawyer be willing to do that?? Is that something I can ask them to help me do?

There is a lot of shady shit there concerning pay and i know my other manager walked out mid shift bc of an error with his paycheck.

Austin TX. Roommate owes me back rent and is vague about when she will pay me back.

    Posted: 04 Dec 2019 06:41 AM PST

Hi everyone, I hope you can help me with this.

I'm located in Austin, TX, and i share a two bedroom apartment with one roommate. My roommate was unable to pay her half of rent back in August. Since then she has been late on rent once and I had to cover her again. She paid me back that time, though. Our lease expires in March, but she keeps changing her story about how and when she will pay me back for August.

I have text messages from her acknowledging her debt and screen shots of the payments in August from the apartment's payment portal. I also have a text message chain dating from August showing her making excuses about not paying me back.

The rent she owes me is $800, which is a significant amount of money for me. I have very little faith in her, and I worry that our lease will end and she will not have paid me back. She also seems to have a lot of other money problems, from what she has told me about her financial situation.

I feel bad that I have to resort to this, but I am thinking about taking her to small claims court. How does the small claims process work? I saw on the court's website that certain personal wages are exempt, but i don't know what that means exactly.

Tl;dr roommate owes me back rent and I'm getting worried about how and when I'll be paid back. Does anyone have advice about small claims court?
