I report for Bloomberg Law on cases at the Supreme Court, following the cases through orders and oral arguments, all the way to decision days. I also keep track of the justices and what they're up to around Washington, D.C. I've been a reporter with Bloomberg Law for the past seven years, where I've covered hot-button issues like abortion, affirmative action, and LGBT rights. Before that, I worked as an associate at Morrison & Foerster LLP.

We are quickly approaching First Monday, the first Monday in October that annually marks the beginning of the Supreme Court's new term. This Monday, I'll head downtown to the courthouse to report on the first three oral arguments of the term. We expect the Court to issue rulings on protections for LGBT workers, the Second Amendment, and the Trump administration's plans to wind down deferred deportation for "Dreamers."

So what would you like to know? What's up with Justice Ruth Bader Ginsburg? Will she retire anytime soon? How has the explosive confirmation hearing of Justice Brett Kavanaugh affected the Court? Will the newly reconstituted Court overturn Roe v. Wade anytime soon?

    Proof of life: http://blawgo.com/MoZfgVL

This AMA has ended. Sorry I wasn't able to get to all of your questions, but you can always ping me on twitter @KimberlyRobinsn.

The 2019 Term starts next Monday. Keep up the interest in the Court!

Moderator Post: Impeachment-related questions and why they are not appropriate for this sub -aka- Heck no we're not touching that hot potato

    Posted: 03 Oct 2019 01:16 PM PDT

    Hey all,

We get a lot of posts relating to breaking news, and the ongoing impeachment inquiry in the United States is no exception. This is obviously a big story that deals with the law, and we know you have questions. After discussion among the mod team, we have decided that we will not allow impeachment related posts in this sub right now; they will be removed without further explanation.

We are doing this for several reasons. First, impeachment is a political and legislative process that takes place in the court of public opinion and behind closed doors in Congress. While it is a process based on constitutional and statutory law (indeed some parts may be litigated before the House votes or the Senate sits in trial); it will be a quasi-legal procedure where the outcome is as much determined by political considerations as the letter of the law. In short, it will never end up being tried before a court, so it is out of our wheelhouse.

In addition, it's impossible for anyone to provide answers to most questions. Impeachment is a sui generis process and there is very little law on which to base answers. Everything that is happening right now is taking place in a grey area, which our devoted readers will recognize is not unusual. What is very unusual is that it is a grey area nearly devoid of statutory and case law borders. Anyone who claims to know for sure what will happen is lying - it's all wishes, guesses, dowsing, and witchcraft at this point. The discussions in here would be speculative at best and argumentative at worst. /r/Legaladvice is not a forum for arguments about politics; there are plenty of places on Reddit and elsewhere to do that.

The mods agree there are fascinating legal issues here. There will likely be several Supreme Court and Court of Appeals cases that spring from this process like Athena from Zeus' forehead. If and when there is useful and interesting discussion to be had or information to be disseminated, we may open megathreads. For those few impeachment-related legal questions that likely have definite answers* we encourage you to post them in /r/legaladviceofftopic. Even there, however, the moderators will remove all but the most benign and germane.

We value your contributions and input greatly. At present, however, we believe this sub has nothing to offer that isn't provided by other more politically focused forums**. Thank you for understanding this position, and we invite you to comment below with any questions, concerns, or just pics of your pets.

    -The moderators of r/legaladvice.

HOA told postal carrier that my condo is VACANT and now they refuse to deliver my mail.

    Posted: 03 Oct 2019 08:28 AM PDT

I own a condo in a small community with an HOA in Indianapolis, Indiana. The HOA president spoke to my mail carrier and told her my home was vacant. The president also looked around and through windows and "confirmed" it as vacant(verified by my neighbors).

I still own the home and have things in there. It is in preforeclosure but there is no sale date until January. In between time I hope to do small renovations to increase value a little bit and try to pay back what I owe.

I spoke to post office delivery manager and they said that since the mail carrier confirmed with the HOA president that the home is vacant, they can no longer deliver there. They have already sent my mail back as return to sender.

Do I have any recourse? I tried to research and have found similar threads but they were from renters. I'm the actual homeowner.

EDIT: I was able to get the situation taken care of. I was able to speak to the postmaster and he informed me that technically after 2-3 days max IN YOUR MAILBOX they can return mail to sender. Ultimately, I'm able to receive mail again but beware , if your HOA person doesn't like you they could essentially use this lax policy against you to get your mail held.

My Roommate is refusing to move out and my Landlord Says they will Require me to Stay on Lease for another Year if I cannot get her signature. (CA)

    Posted: 03 Oct 2019 10:18 AM PDT

Hi all. My roommate is physically violent and financially abusive. She has stated that she will not sign the required paperwork to end our lease, my other roommate and I have already given our 30 days notice. The landlord is saying that if she does not sign the paperwork we will automatically renew for another year of the lease.

Do I have any recourse here? I am not interested in punishing the roommate, I simply want to leave and not be financially shackled to her for another year.

Invasion of privacy in high school bathrooms

    Posted: 02 Oct 2019 03:24 PM PDT

    Alabama, USA

So due to the growing rates of teenage vaping, my school has really been cracking down on vaping in school and such, it's an immediate 1 day suspension, 50 dollar fine, and court date if you are caught in school. My schools resource officer has been reportedly checking bathrooms every once and a while to catch kids vaping. Today I walked into the bathroom at the same time he did, he was checking in between the cracks of every single stall and when he came across some kid taking a shit, he laughed at him and moved on to the next. I'm beginning to think legal action should be involved because this is so fucking gross. Am I an idiot? Is this not invasion of expected privacy?

Edit: thanks for all the support, just some details to clarify, both I and the Officer are male, and the incident occurred in a male restroom, and the SRO is a sworn city police officer.

[NY] Mother likely murdered and father missing. No idea what to do next.

    Posted: 02 Oct 2019 07:44 PM PDT

The short story of my situation is that my mother was likely killed by my father and he is currently missing. I'm not even sure where to begin on getting everything sorted but here are the few questions I have right now.

    1. What happens financially? I think my parents were in debt but do I have to pay that? I have no idea how much money they had in the bank, but does that need to go towards the debt.
    2. My brother is still in high school. I can take care of him, I'm old enough and I think ok financially for now. I assume I'll be able to take custody but how will that work if my father is not found. I think I've also heard that I may be able to collect social security for him.
    3. Kind of similar to the previous questions but my parents had a house. What can be done with that? I have no idea what it's worth, I know that money is still owed on it. I want to get rid of it, but for the mean time should I continue to pay mortgage on it?
    4. My father had a 401k, if he is not found what can be done with it? In a similar vein my mother had a pension. Will they pay out the pension to my brother or something till he is of age? Or does that vary?
    5. This one I can probably answer myself, but a lot of bills were in my mothers name (phone, car insurance, card, etc.). I assume with a death certificate I can transfer all that stuff? Should I even worry about all of their bills for things that do not matter anymore, like a gym membership for example.

I know I'll need to contact a lawyer for help with some of these questions, I am working on that but am wondering if anyone here had some quick answers to help ease my mind. Im trying to figure out what my next steps would be but it's all really overwhelming right now. Also, if any one has any other advice on things I'm not even thinking of please let me know. Thank you.

Edit: I really want to give a heartfelt thank you to everyone who took the time out of their day to respond to me. I have read everything and even if I did not respond to you directly please know that I appreciate everything that's been said. It's wonderful to see the all of the advice and kind words from complete strangers on the internet. Just to reiterate again, thank you all so much.

Landlord gave me my 30 day notice for wearing my shoes in the house (WA State)

    Posted: 03 Oct 2019 05:31 AM PDT

This is a long story but I'll try and make it as short as possible. I live in a house and rent a room: About a month ago 2 of my married roommates who also rent a room got into a violent abusive screaming match so I called the police as they were beating the shit out of each other. The police either arrested the girl or told her to leave. The landlord said she's not allowed back. I have text proof of that.

Well a month later she just showed up here again. I texted the landlord about the situation confused and she said "she doesn't live here she's just visiting" when she sleeps here eats here showers here and hangs out here every single day. I recently found out that the girl is working for the landlord.

I don't feel comfortable living here for that and a multitude of other reasons so I found a girl to move in with in December and have already signed a new lease. I gave my landlord a 90 day notice, and the next day she left a 30 day eviction notice at my door with the grounds that I wear my shoes in the house, smoke too close to the house, and have my boyfriend over too much (3 times a week)

This is absolutely not legal right? I'm visiting the tenants union later today but I was hoping someone could give me some peace of mind.

[NJ] TIME SENSITIVE on my way to court against landlord, but he just now got back to me!

    Posted: 03 Oct 2019 06:40 AM PDT

I moved out of my apartment in New Jersey on April 30th but have not received my security deposit back. I sued in small claims in NJ, and the court date is tomorrow. I moved out of state and am already on my train--I've purchased round-trip tickets and a hotel for the night. After complete radio silence for months, I just got a text from my landlord about 5 minutes ago asking me if I have Venmo. I'm assuming that means he's now ready to give me my initial deposit back. However, at this point I want my expenses reimbursed, at minimum, and ideally damages because of taking time off work for 2 days, the stress and hassle of chasing him down, and the negative impacts on me from not having that money back. (For what it's worth, I am primarily paycheck-to-paycheck and not getting this money back was extremely difficult.)

Questions: do I respond now, or wait til court? If I respond now, should I just ask for the original security deposit or can I include reimbursement request for my expenses? If he pays me, do I still go to court? How do I cancel it if not? If I don't answer or go to court anyway, do I have any chance of getting damages/reimbursement since he texted me today?

My dad said to get the original security deposit and then if he asks let him know I'm still going to court for damages and reimbursement, because apparently it's hard to get money back even after the court rules in my favor. My mom says don't take the money because once I have it's over and I can't go to court for expense reimbursement and damages, I'd have to file a different thing for that. She isn't sure if I should just ignore him for now, or say I'm already on my way to court and I'll see him there (but nicely obviously). I don't know what to do!

A little bit of background if it's helpful: I followed up with him multiple times through May-July by text, email, and phone, which I've kept copies of, but he never responded. In mid July I asked my old roommate to see if the landlord was still around and if something was going on that might explain this (he was a good landlord, seemed totally normal, and I asked another roommate who moved out about a month earlier than me and he had no trouble getting his security deposit back, so I thought maybe there was something going in his life that prevented him from getting back to me). My roommate confirmed he saw my landlord and told him I was trying to get in touch. My landlord said he was aware, and he'd call me back, but he never did. I was then very suspicious, wondering if he thought he could withhold it because I moved out of state and he thought he could get away with it. So, towards the end of July I sent a registered/certified letter saying that he has to give me my security deposit under NJ law, but it was returned because he never accepted it. I sent one more email saying that I needed him to get back to me. He never responded, so end of August/early September I filed suit in NJ court. Court date was set for tomorrow 10/4.

tl;dr after trying for several months to get my security deposit back, I am suing my former landlord in small claims court and the claim is tomorrow first thing in the morning. I'm on my way now to NJ (I moved out of state) and have paid for travel and taken 2 days off work. My former landlord has literally just texted me asking for my Venmo details. What do I do?

[CA] I got a hefty traffic fine in Los Angeles (I'm Australian), tried and failed several times to pay the ticket online/by phone, and they slapped me with an extra fee for collections. Is there any reasonable way to fight it?

    Posted: 03 Oct 2019 04:16 AM PDT

I was in California earlier this year. I borrowed a friend's car and tried to take an orange light which turned red just as I reached the intersection. I got a $490 fine in the mail.

When I tried to pay it, the system couldn't find my ticket. Calling them to pay just got me through to an endless series of voicemail options. Eventually I got another letter saying that the matter was now in the hands of GC Services collection agency and I was going to be charged an additional $300.

With the exchange rate being what it is, I'm looking at $1,175.05 AUD.

I figure I did mess up with the initial violation, so fair enough, but the fact that I could not pay the ticket online, or on the phone, or in person (being in a different country) makes it feel kinda unfair that I got hit with an extra fee.

Is there any reasonable way I can beat the extra fee?

HOA put a lien on my house for Unpaid Dues (USA-MD)

    Posted: 03 Oct 2019 08:09 AM PDT

I've lived in my house I've owned for 4.5 years, I logged into their portal to set up auto-payment on my HoA dues which are about 103$ a month. Every month my bank account is deducted 103$ + 2 dollar fee for whatever for the last 4.5 years.

About 2 days ago I received a letter from a collections firm that I have an unpaid balance of 660$, and possible put a lien on my house. 200$ of which is legal fees.

From what I can deduce, they raised the HOA rate they charge to 113$ WITHOUT informing me, continue to debit me 105$ (103+2 service charge) from my bank account and charge me 15 late fee on top for the difference of 10 dollars. Each month for about a year and a half.

I received ZERO invoices from them, and zero calls, granted they might have sent a letter... but I might have thrown them out.

I was told in the letter I have 30 days to dispute this.

Obviously, I'm livid and my emotions are keeping me from thinking about this logically. Should I dispute this or just pay them. Do I have ground to stand on that I have been paying my HoA fees every month?

    Edit 1: spelling errors

edit: Let me reiterate that I never saw any mail in regards to a letter, but it is a distinct possibility that I may have thrown something out.

Roommate put lock box on AC unit and turns it up to 78/80 before leaving everyone else at the house

    Posted: 03 Oct 2019 12:01 PM PDT

We are located in florida where its been getting up to 90° everyday The roommate who locked the AC is the person on the lease, he subleased out his other two bedrooms without landlords knowledge. Two women living here have breathing troubles that are exasperated by the heat, one even uses a breathing machine, a young child lives here too. Me personally i take two medications that make me feel like im having a constant hot flash Guy is fully aware of everyones health issues. Im the only one with a written agreement to rent a room in his house although landlord isn't aware of me and my 4 year old son. Guy is doing this to spite the other two roommates and to force them out of the house, even mentioned getting a cat when one of them is highly allergic.

Is locking access to the AC and pruposely leaving it at higher tempratures when he is not here legal? Can any of this be considered "hostile/unhealthy living situation" in court? Advice?

[NY] My sister's husband is a pedophile

    Posted: 03 Oct 2019 10:01 AM PDT

Last night, my brother in law was arrested for soliciting a minor. He's already admitted to it and the police and FBI found a lot of evidence, so this isn't a question of proving innocence or anything like that. My sister's life just ended. They've been married for 3 years, own a house together, and she's 7 months pregnant with his baby. She's going to file for divorce, but:

    1. What can she do to further protect herself from the ramifications of this?

    2. What can she do to protect herself and her child?

    Thanks for your help, reddit.

Me (Male) going into the womens bathroom at my local mall

    Posted: 03 Oct 2019 12:44 AM PDT

TLDR: What is my obligation to obey the gender rules for shopping mall food court bathrooms?

I took my elderly mother out to see a movie at my local mall on Tuesday night. She has trouble walking, standing, has had a few strokes and has balance issues. Typically she uses a wheelchair, but sometimes she has the urgent need to use the bathroom and must get out of the wheelchair.

In some situations when this occurs we are near a family style bathroom, but on this Tuesday night we were in the food court when everything was closing down and she just had to go. I walked her up to the zig-zag tile covered corridor that is the woman's bathroom entrance. I paused before entry and politely asked if anyone was in there. After a moment with no answer, and seeing as how the food court was almost entirely empty of patrons, I wheeled her into the bathroom to a handicapped accessible stall, helped her up out of her chair and to the safety hand rails, then went back outside to wait.

This is when things went a bit off the tracks. Unbeknownst to me a security guard saw me exit the women's bathroom and was monitoring my activity. After a few minutes I heard a yell for help from inside the bathroom where my mother was. I ran inside without hesitation and saw she had stumbled. As I went inside the security guard started after me yelling I could not go into a women's bathroom. As this was my mother in trouble I completely ignored his "command". After I assessed the situation I yelled back that a woman was in distress in here, and the guard yelled back "You must exit the bathroom, you cannot be in there". I wanted to respond with a "oh fuck off", but my better side prevailed with a simple "give me a break" dripping with sarcasm. The guard continued to demand that I seek assistance from someone that is a woman for emergence's inside the woman's bathroom, but I was already headed back out in under 30 seconds.

Once outside the guard could plainly see that I was wheeling an elderly lady out of the women's bathroom. He continued in his attempts to assert blame upon me and bolster his authority. He continued to argue as if I had broken the law. I believe my response was "whatever", but internally I had a real desire to dress down this security guard. In my opinion if some action you take or deny results in any danger to my mother, I really don't give one shit about your "commands" and care not who you are, be you a security guard, a police officer, or Jesus Christ himself (I am an atheist, not that it matters).

So my question is, what are my exact obligations, both in polite society and in the law, to obey the gender designations for bathrooms in a shopping mall food court? I am guessing if someone needs assistance, especially an immediate relative, such as a slip and fall then all those rules go out the window?

    What are your opinions?

    Curious

Leaving a job that I was promised "equity," possible sexual harassment involved

    Posted: 03 Oct 2019 10:17 AM PDT

I work remotely from Pennsylvania for a very small tech startup based in New Jersey. I occasionally work with the CEO in a coworking space. I have worked there 2.5 years and have had manager-level responsibilities since early 2018.

As a side note, I have a chronic illness that is disabling. My life is limited in a lot of ways, and it was difficult for me to figure out a way to work with my illness. This is why I accepted things that I probably would not have accepted if I were healthy and had more options.

In summer of 2017, I was offered "equity" in exchange for part of my wages because the company was suffering financially. When my responsibilities increased, I was not given a raise in take-home pay but in "equity." However I never received any paperwork for this equity. The company has not had the funds to get the valuation or the lawyers to draw up the contracts. I have nothing in writing, just a spreadsheet to show what wages have been earned as equity. I have seen him repay other employees that leave, equal to what their wages would have been. But nobody who has left has been owed even a quarter of what I am owed.

In June, the CEO physically restrained me in an office and tried to kiss me repeatedly. I could not break free. I first responded verbally with confusion, then "no"/"stop," then I finally yelled and he released me. He said he had gotten a flirty feeling from me. I said I didn't intend for him to get that impression, and that I wouldn't get involved with a married man or my boss. He sent me a text later that day that I'm an "amazing person" which made me concerned he had feelings for me. However there were no problems after that.

There is no HR to report this to. The only person above me is the CEO. I documented the incident and started to look for a new job. This isn't the only reason I'm unhappy at work but it was definitely the trigger for me to start looking. I finally have an offer letter and need to give notice very soon.

There is a possibility that my current company will take off, maybe soon, maybe in a few years. There have been a couple of larger companies interested in acquiring us but I'm not sure the likelihood that will happen.

    Questions:

    1. Do I have a leg to stand on to get any equity?
    2. Is the reason that I am leaving relevant from a legal perspective? Does one incident rise to the level of sexual harassment or anything legally relevant?
    3. Would a lawyer cost an arm and a leg to pursue this?

An ex partner has been threatening me with legal action for over a year.

    Posted: 03 Oct 2019 08:30 AM PDT

So over a year ago I broke up with this woman I had dated for about 3 years. She asked me to pay her back an amount of about $4,500. I said I could if she would be willing to work with me since, well I am poor. She refused and kept giving me ultimatum deadlines to by her back by, and when I surprise could not since it's hard to just produce that kind of money out of nowhere for a full time student, she keeps threatening me with legal action, talking about suing, she has an attorney, etc.

Over the summer she just kind of stopped contacting me so I figured she just gave up. This morning she sent me an email saying she had hired an attorney (I thought she already had one as indicated by her previous messages) and was ready to take action. She gave me until October 10th to reply or she would ask for my address (she does not know my current one) so "my attorney can be in contact with you about suing you"

I currently reside in Illinois, she in Pennsylvania if it makes any difference.

My main question is does she have a case here? It's been over year like I said of off and on warnings/threats from her about legal action and I feel like it's honestly approaching harassment. I offered to try and work out payments or something with her but she insisted on the full amount in one payment, which is just impossible. I tried to include all the relevant information I could think of but if you guys have any questions please let me know.

    Thank you

Sister is pregnant in jail, wants to give me baby

    Posted: 02 Oct 2019 06:17 PM PDT

Hello all. My sister is in jail in MO currently and is 7 months pregnant, due in November. She kept telling me they were gonna let her go but today she has fessed up that they are keeping her longer than she thought and there's a good possibility that she will have the baby in jail. She said if that happens she wants to give the baby to me, she's already lost custody of her other children and wants to go back to CO (where they are) to get them back and says that will be easier without another baby. I live in Kentucky if that matters. What steps do I need to take to get the baby when it's time?

Falsely Accused of a home invasion

    Posted: 03 Oct 2019 05:40 AM PDT

Hello. I live in Flint, Michigan, and I was recently accused of a Home invasion, and put into custody of city lockup for three consecutive days, and before my release the charges were dropped down to unlawful entry.

So there I was walking down the street going to my friends house, when all of the sudden two people in a black dodge avenger, a black male, and a female pulled up behind me slowly creeping, so I motioned for then to pull around me as i moved over, they never did, so I turned the corner and they kept following behind me, then proceeded to come up next to me and ask me: "were you the one that broke into our house?" To that, I responded "no. Why would I break into someone elses house when I'm living in a motel right now and my house has no water or power" and the whole time they were on the phone and they kept pestering me so I kept walking forward, they then proceeded to skirt off and whipped around the corner to the right, so I proceeded to go left (which was my original direction of intention) I kept walking for about 500 feet when I was nearly toward my friends house they drove up on me fast this time, this time there were three of them so they jumped out their car and pointed at me and said "it was you" and started running after me so I ran for my life screaming rape (I know I know) and these neighbors of my friend came out of their house and at this point I was hysterical so I asked them if they had a phone i could use to call my mom and 911, by this time they got back in their car and said to us: "we'll be back" they proceeded to invite me inside to shelter cover from the threat that those people made against me. The nice lady let me call my mom to come get me, and she called the cops for me about the threat and accusation those folks made against me. About ten to fifteen minutes later the police arrive at their door. They asked for me, I went out there, the cop said "put your hands behind your back youre under arrest for home invasion" and I started balling my eyes out. I literallt felt like my life was being taken from be before my very eyes. They took me to the city lockup, booked me, and put me away for three days for a crime I did not commit based off word of mouth of false accusations. Mind you, the cop never read my miranda rights to me. What is your best legal advice for this crime I did not commit? I have jury trial on the 17th of this month.

(Kansas) Work requiring group chat app install

    Posted: 03 Oct 2019 06:35 AM PDT

So my little brother (18) got his first job at a regional fast food restaurant making hourly min wage. After chatting with him it appears that they are making him download the app "groupme" so everyone can exchange shifts and managers can post about meetings or ask employees questions. One I saw was "hey so and so, where did you leave the equipment". He isn't allowed to mute the chat because management wants everyone to be able to see when posts are made. He's had to respond various times when he wasn't on shift.

Is this something that they can require? If not would there be legal recourse for backpay?

Pool company drained my pool water onto neighbor's property, flooding their yard.

    Posted: 03 Oct 2019 12:40 PM PDT

Not a little water, but a lot. Luckily it is far enough away from the house. He's pissed, and rightfully so. I've sincerely apologized several times over the past 48 hours but he doesn't want to hear it. He told my other neighbor that if one drop gets into his basement he's going to sue. If he does sue, is this on me? Or my pool company? Edit* Michigan

I've been summoned for Jury Duty during my wifes due date and they denied my excuse. Do I just miss the birth?

    Posted: 02 Oct 2019 02:42 PM PDT

U.S.A, VA - I felt like they would have had compassion over this. I actually do want to be on Jury Duty because it seems fun however I don't want to miss the birth of my child and considering I can't even take a phone in I may not even know it happened until I leave for the day.

I have always heard of people joking about "say something bad during the interview" or "act like you'll vote guilty regardless" during interviews to get out but is there anything I can do? I don't want to be a dick but I'm not trying to miss this birth and I'm going to be pissed if that happens.

Landlord refusing to kick out disruptive, lease violating neighbors.

    Posted: 03 Oct 2019 08:19 AM PDT

We have lived in our apartment for almost a year now, and our neighbors down below us moved in a month after us. Since this happened it has been nothing but problems leading up until my last straw when my daughter was born about 2 weeks ago. They constantly are breaking rules listed in our lease agreement like observing quiet hours 8pm-8am and the smoking rules for both cigarettes and marijuana. We call the police on them for noise complaints 1 or more times a week now several times a day. This also happens at obscene hours of the night. It has gotten to the point where my 2 week old is not able to sleep properly and my 2 year old is having anxiety about going to bed because they are fighting in the room below his. The woman is always screaming for help or about her man cheating on her (kinda traumatizing for a toddler IMO)and the police do nothing other than take her to a hospital and write up a report. Landlord is notified each time that we make a noise complaint/call the police but he is now claiming that the "money they bring in" is too good. He served them a 15 day notice as a warning but they have continued to be inconsiderate. She was caught running through the apartment's courtyard/playground naked on numerous occasions drunk as hell. She has also tried to break into their neighbors apartment.

The smoke smells of marijuana and cigarettes now flood my apartment each day, and we have confronted them personally and kindly to get the response of "I'll try to go outside" despite the smoking rules being posted everywhere in the building. In addition to this, they just got a dog that I believe they are neglecting due to it incessantly barking all day and the smell of urine in front of their apartment. We never see them take it out. When we got the baby home from the hospital they were about to walk the dog (the one and only time I saw them take it out) and they let it lunge at my newborn. I was furious. When the neighbor was asked what her issue was she claimed that she drank too much and is in liver failure and her meds don't work. IMO thats not an excuse to make other people's lives hell, but maybe i'm biased and being an ass hole, idk. We have dealt with this for so long my patience is running thin.

I know that we are not the only ones bothered and complaining about it because the people in the apartment next to them have a newborn just a week older than mine as well as an older child who also has to listen to the commotion and smell/be exposed to the second hand smoke. We have discussed trying to start a petition for them to be kicked out after all of this, but I fear that it would only be our two families complaining.

This is all taking place in Massachusetts, USA. What are our options?? I'm desperate for some peace, I miss being able to enjoy my home again and for my children to be able to sleep in peace. TIA.

EDIT: I have kept detailed records of each interaction with the landlord including text messages, emails and phone call records. I also have the police reports from each noise complaint/call that we have made incase I do have to take this to housing court. We are not locked into a lease.

    Threats to have me charged

    Posted: 03 Oct 2019 10:04 AM PDT

[NC] North Carolina. My ex-girlfriend who I have been living with as a roommate, has threatened to charge me with several offenses.

Due to her constant verbal abuse and controlling nature, I moved out this morning. She's now in full attack mode.

    1. She loaned me money, with the verbal promise I would pay the money back by the end of October. She now after is threatening to report it stolen to the police. I have the check, which she signed, with loan marked in the comments. She's demanding the money back in 24 hours or she'll report it to the police.
    2. She's threatening to charge me with stealing her car. We both have keys and we both have use of it, but were at an event where I moved the car without her knowing it, in order to pick her up at another location. Sadly I did not tell her I moved it an she came looking for it. She was livid that I took it "without her consent", but now says I can be charged with theft. I actually used it to pick her up, which I did. We even drove home IN the same car later that evening. At this moment she is in possession of the car.
    3. We had a fight earlier in January of this year where she tossed my bed (we don't sleep together), poured a bottle of wine on it, threw the bed clothes, and he contents of my dresser on the floor. Then,, she backed me in a corner screaming. I touched her to get out of the corner. Realizing that I had touched her and things were getting out of hand, I called the police for a safe exit out of the situation, so they could witness the state of things and she couldn't stage something and have me arrested. I called an uber, went to a hotel. She is now threatening to have me charged for hitting her.

Can she make these charges, how will the police deal with the situation, and what danger am I in legally? And what should I do in case the police come knocking?

I support the house by paying the rent, buying groceries, cooking, paying the utilities. She also works, makes money but due to past failed attempts to work together I have ended up being the financial support for the house.

    Any advice is appreciate.

[MA] Protecting myself and my patent from co-worker's jealousy

    Posted: 03 Oct 2019 09:55 AM PDT

    This is in MA, USA.

I'm a postdoctoral scientist who works at a large institution, been here about 18 months. I have an abrasive co-worker who I've clashed with multiple times. I've blocked her phone number because she berates me after hours via texts. I have mostly just tried to keep my distance from her because we are just too different in our work ethics.

We work on similar projects in the same department, and science is naturally competitive. Sometimes two people/teams within the same department could find themselves racing towards a similar goal. My boss recently discussed with me a patenting opportunity about some of my recent lab work. My co-worker went ape shit. I guess she was gunning for a similar thing. Today she openly accused me in front of others that I have faked my data, that I conned others into performing the work for me, that I barely show up for work (we're salaried, so some days I finish at 3pm and other times I'm here on a Saturday night, but this is still a damning accusation). She is actively spreading incredibly harmful rumors about me that would be very damaging to a scientist's career. I don't know how many people will listen to her since she has historically been a little nutty, but yeah, my career can be destroyed by these types of rumors.

I have emailed my direct supervisor and demanded some mediation. I don't know how else to protect myself now or in the future from this co-worker.

Do I have a chance in court against my landlord?

    Posted: 03 Oct 2019 07:48 AM PDT

I just moved out of my old apartment and mt landlord is charging me $800 for painting all the walls. Online it says that scuffs, smalls marks, normal "wear and tear" should not be charged back to the tenant. He is also charging $150 for cleaning (we cleaned the place extensively before leaving) and $660 to repair hardwood floors that were scuffed by furniture in our living room.

I understand that maybe the mgmt company would see the scuffs as our responsibility, but my question is, am I responsible for $800 worth of painting? I lived there for 6 years and it has faded in some spots, but for thr most part looks good.

For context, I took them to civil court in early 2018 because I lived on the top floor of thr building and they didn't fix a broken elevator for almost a year. During that time I tore my achilles and had a tough time going up stairs. At the end of mediation they gave me $200 if I signed an nda and told me "I dare you to take us to court because you won't win". I had a reasonable expectation of access to my elevator when I moved in and I didn't have access for almost a year. I thought I had a decent case but Idk.

Do I have any kind of case with the security deposit or am I being unreasonable?
