Tropical Storm / Hurricane Dorian - Pre-Disaster Megathread Posted: 28 Aug 2019 09:00 AM PDT Tropical Storm Dorian is slated to hit Puerto Rico and the Virgin Islands today, probably as a Category 1 hurricane. There is also high risk that it will hit Florida on Monday, possibly as a Category 2 or 3 hurricane. We will be editing this post at least once daily as resources become available, and we'll be answering questions in the comments. What should I do now? A curfew has been established in USVI, and Puerto Rico has started moving people to shelter. If your property still has tarps on the roof from Hurricane Maria, reach out to local officials and seek shelter now. If you are reliant on electricity and/or medicines (such as insulin), you should also reach out now to local officials. If you are in Florida, you should begin paying attention to local evacuation orders, especially if you live in a low-lying area or are on the coast. In general, FEMA suggests: turning down the temperature of your refrigerator/freezer (so they last longer if power goes out), charging all devices and battery backups, stocking up on essentials, closing any storm shutters (or board up your windows) and stay away from unprotected windows, Whether you are planning to evacuate now or not, make sure to keep important documents with you, especially your passport, driver's license/ID, birth certificate, and Social Security Card. You will need these to establish your identity if anything goes wrong, such as needing to get a new job or apply for assistance. For insurance purposes, take pictures of every room and of important things you can't take with you, and make sure you have your insurance policy info (at the least, the contact info for your insurance companies). Even if you don't plan to leave, take those pictures and get them uploaded to the cloud (You can also use home inventory apps for this purpose). Here is Ready.gov's Hurricane prep site. You can follow emergency orders on Twitter by following @FEMA, @NHC_Atlantic in general, @NWSSanJuan, @NMEADpr, @fortalezapr in PR, @readyusvi in the USVI, and @FEMARegion4 and @FLSERT in Florida. Your protections (or lack thereof): If your employer threatens to fire you or fires you for not going to work in a state of emergency, you probably have no legal recourse (unless you have an employment contract). However, if you are missing work due to work as a volunteer emergency responder, you may have protections, depending on location. Price Gouging Laws, in USVI and Puerto Rico, do not appear to have any teeth. However, you can file complaints with the DLCA in USVI or the Department of Justice in PR. In Florida, the FL AG enforces Price Gouging laws, and a FAQ is provided here. Other Resources: As we have other resources, they will be added. What about my pet? If you have a pet, while FEMA is required to take animal owners into consideration, shelters and hotels are not required to accept pets, but service animals retain their normal ADA protections. Emotional Support Animals (ESAs), in this context, are equivalent to pets - fair housing does not apply. Petfriendly.com has a list of pet-friendly hotels - you should call ahead if you are evacuating to a hotel and need to take a pet with you. After the storm is over, what should I do? As storm related help is posted, we will post links to apply for emergency aid, get insurance help, or get disaster related legal help. If you find something out before it's posted here, please post it. Most importantly, do not return home until the area is declared safe, and follow all emergency management notifications, as entering areas that have been restricted can result in criminal charges. What kind of resources can I expect? Emergency SNAP (food aid) and TANF (cash aid), short term housing through FEMA, extended unemployment benefits, short-term forgiveness on student loans and mortgages. State and federal organizations will set up special processes to handle these in the coming days, and we'll add them here. Until other sites are online, keep an eye on www.disasterassistance.gov. Save your FEMA registration number once you sign up. Also, local legal aid resources will be available after landfall. Lawhelp.org will have some, but we'll link others as we find them. Trespassers called police on me for brandishing a firearm. Posted: 28 Aug 2019 03:32 AM PDT Yesterday around 530 AM I heard a tapping on my window. My window faces my fenced in backyard which has a wooded area behind me. At first I thought it was a lizard but it was more rhythmatic. I went to look outside and as soon as I opened the curtains I see a hand tapping on my window. I then turned on my light and started to tap the barrel of my shotgun against the window. The trespassers saw it and immediately darted away. I call the police and a few minutes later they show up and ask where is the person with the gun. I told them I have a gun and explained someone was trying to break in. They said they were called because someone was brandishing a weapon from inside their house, but I called and reported a break in, not on myself. Apparently the person I pointed the gun at, called the police. When I explained the situation, the officer kept trying to finish my story by saying "You were ABOUT to shoot him until he darted away" and they filed their report and left. When I spoke to my sister she explained that the police were trying to help me avoid a brandishing charge because if I can say I had intent to fire versus intimidate then I can't say I was brandishing. I had no intention of killing anyone. What should I do? I don't know if I am going to have to defend against a brandishing charge, what about the trespassers? Is it brandishing when I am in my own house? This is in Orange County, Florida. [link] [comments] |
I hit one of my patients tonight.... (Female,PA) Posted: 28 Aug 2019 03:37 AM PDT Tonight I assaulted a patient of mine. I'm a RN in Pennsylvania. I had to do care for a known violent pt who had attacked several nurses in the past. I had to draw his blood and change him because he was covered in urine. I brought a male nurse in with me. While drawing his blood the male nurse was holding him down and he was still punching and kicking and threatening us. I told the male nurse (my superior) that we needed to stop or get more help, but he refused and said we had to get him changed. We finally got the blood and were trying to take his clothes off and get a clean brief and gown on him. Then he grabbed at my arm so hard he left bruises and started kicking me and threatening to piss on my face. I panicked. Idk what else to say. But I hit him, in the nuts because it was the closest part to me. He let me go and we finished changing him. In my defense, I say it was self defense. And the male nurse with me said it was okay afterwards. He suggested I "take a walk and have a cigarette" then when I was outside, he called the supervisor who then called our director of nursing. As soon as I got back inside I was told I had to leave and was escorted from the building. I was told what I did was unacceptable and that there would be a hearing with HR. Can they seek legal actions against me? I don't even care at this point if they fire me. I just don't want to lose my license. If I lose my nursing license, I'm 50k in debt with student loans and have no way to provide for my family. I don't know what I should do next. [link] [comments] |
I was physically attacked by my condo security guard in the condo I live in Posted: 28 Aug 2019 01:33 AM PDT I was physically attacked by my condo security guard in the condo I live in late at night (around 3:45am) in Ottawa, Ontario Canada. I went down to take out the garbage late at night and upon entering back I realized I grabbed a deactivated key fob (from the previous owner) but I still had my unit keys with me. The thing you need to know about my unit is that you need to buzz yourself back in once you go outside or take out the garbage. I go to the front of the building to flag down the security guard to let me in but he would not allow it because I have a deactivated key fob. I have 2 other ones that work but I just happened to have grabbed the wrong one tonight. Despite the fact that he knew me, he said, "Yeah, I know you. I've seen you around." I've lived in this building for over 3 years and he has definitely seen me around and has interacted with me as well. I had no phone or wallet or anything on me other than my keys and an empty bag in hand so I would have absolutely nowhere to go but to sleep on the streets tonight. I tried to call my girlfriend who was sleeping in my unit, my own phone and my tenant by it all went to voicemail. I told him this and all he said was, "Those are the rules, I can't let you in!" I understand rules need to be followed, but this is really extreme since he knows I live here and would rather me sleep on the streets than to escort me up to my unit (or just frankly let me in). I'm not sure if he is just that way towards me as I have never done anything in the past to deserve this kind of treatment or if he is just discriminatory towards certain people (he is an old white guy and there are lots of Asians living here). I got in with someone who buzzed in with their fob and he stopped me in the lobby. I refused to leave the lobby and he said he'd call 911 (he never did) to which I said please do. He got really angry and shoved and violently tackled me into the door and kicked me out and then I had run over to someone on the street to get the police involved. After they came and I told them my story they escorted me into my condo which I showed them proof I lived here. There are cameras all over the front lobby so that is evidence if needed. I want to press charges against this guy but do I have any grounds? I live in Ottawa, Ontario Canada as mentioned. Any advice is welcomed. I have already sent an email to the condo management corp but I doubt they do anything. tl;dr - I couldn't get back into my building at night. The security guard who knows I live there wouldn't let me in despite having keys to my unit. He physically attacked me and I had to get the police involved to get back into my condo for the night. Edit - I emailed my property manager last night and he met with the director of operations of the security firm this afternoon and sided with us. What the security guard did was unexcusable and will be removed from our property forever. We've filed a complaint about him and what they decide to do regarding disaplinary actions is up to them. [CO] I turned down my CFO, now he’s trying to fire me. Posted: 28 Aug 2019 06:17 AM PDT My apologize for any errors I'm a first time poster and I'm on mobile. About three weeks ago my CFO of our small local company asked if I could give him a ride to a doctors appointment because he wouldn't be able to drive after, he didn't have anyone else to help him and he's losing his eyesight. His wife was on the phone with us and I chauffeur for my best friends clients on the side so I felt ok and said yes, of course. The entire car ride he talked about how much he loves strip clubs and how he planned on hiring a "muse" to sit naked in the woods with him at his cabin so he can see something "perfect" before he can't. He then took it further, after I didn't say anything about any of it, I was in shock honestly I'd don't know what was about to happen or why he was saying this. He told me he wasn't fully married, he was in an open relationship, he can do what he wants. He started asking me multiple times to go to a strip club with him and to get dinner with him. I kept denying and said I needed to get home, he then started telling me how I should be a muse and how much he loves brunettes, which I am. He invited me to his cabin multiple times and asked if I have any friends that would "get wild" I said no to everything. He asked a lot about my nipple rings which he heard I had, the whole time he was verbally pushing me to come hang out naked in the woods with him and he was trying to use his medical issues as an excuse, he seemed very upset when I declined all offers. I was off the clock, he is salaried but he did pay me $20 for driving him. When I got back to work the next day my boss (direct manager) asked how it went and I told him how scared I was and how uncomfortable it was for me I asked my boss not to say anything to my CFO. The next week our CFO came back from another surgery and claims he doesn't remember anything from the two weeks prior because of the medication, my ride was the Thursday before his Monday surgery, to me it sounds like a cover up. I think something similar might have happened to another girl in another shop because she also is a brunette and gave him a ride a few days after I did. Today, I got a text from my boss asking where I was. I told him he knew I was in class and I would be in around 4. He was the one who said that was ok because he scheduled me to come in at 2 but I couldn't because of class, my boss told me "it'll be fine you can come in at 5 if you come in earlier then cool." We are not a busy shop and regularly work full shifts alone so it's not a huge issues for people to come in late or leave early. That was three weeks prior to this when I told him he had scheduled me when I have class. My boss also told me we did not need to advise our home office of the changes Monday and Tuesday(today) and was very shady when he said multiple times for me not to contact the home office. When I got to work my CFO told my coworker, not me, my boss and my CFO took off out of the shop before I got there, that I missed my shift and if anything like that happens again I'll be fired. He wouldn't answer his phone or hear me out that my boss was the one who told me we didn't have to update him and that he knew full well I was in class. Our CFO is also refusing to follow up on the hostile work environment claim I have made twice now against my boss. My boss told me Sunday when I saw him "everyone knows you'll be in class". This isn't the first time my boss has tired to set me up like this, on a very regular basis my boss threatens my coworker and I about losing our jobs if we don't do everything thing he says. If we ask for time off we get threatened, if we call out even with a doctors note we are told we have to show up still and if not we will be fired. Every little thing that isn't my bosses way he threatens us, every single week my coworker and I compare the ways we were threatened that week. I also tired to talk to my CFO about the car ride and he's been going out of his was to avoid our shop while I work. I feel like I'm being set up because my CFO knows I was very uncomfortable that entire ride and my boss and him are close so I think he told him how scared I was. They protect each other at all costs, I don't know why or care what their up to, what I want to know is what can do to protect myself? I was clearly baited into that ride, my CFO knew that's why he asked me of all people, up until that ride he has never talked to me and I thought he hated me. I do not have documentation of the conversations, but i do have some of the prior threats in texts, and I plan to document everything from this moment on. I want stand my ground the best way I can. I know everyone's advice is to get a new job, I love my job, and I'm in school full time and they hired me under the agreement my school schedule would always be worked with, they even promoted me to the assistant manager with the agreement my school schedule would be worked with. If I lose my job it'll effect my entire semester and I cannot afford that. What is my best course of action? I appreciate any advice and your time. [link] [comments] |
[MA] Landlord let new tenant move into my vacant unit DURING my lease Posted: 27 Aug 2019 03:01 PM PDT EDIT: Thanks everyone for the sanity check. I was originally a bit annoyed but considering letting this slide along with the return of my entire deposit + my A/C unit, but now I think I may go for more. Contacted a couple firms in my area to see what the next steps are. tldr - I had overlapping leases and left my old unit vacant for a month but with a few items still there. I showed up today to do final cleaning and pick up my items and the unit was remodeled and the new tenants things were stored in the closets. My things were gone. What is my recourse? I have overlapping leases, one of them ends Aug 31st. I moved out of that unit last week of July. I was in contact with the new tenant moving in Sept 1st and he was unwilling to pay to move in early so I told him as a courtesy he could move in Aug 31 free of charge. I then left some cleaning supplies and an AC unit at my old unit, just using it as storage as I lived at my new place. I let my landlord know I was planning on moving out early and that I'd let them know when they could do a walk-through to assess the unit, and they said "okay, let us know." That was the last communication I had with them. I went to my old unit today to retrieve my things and they were all gone and the unit was remodeled. The new tenant had also stored his belongings in my closet. I paid full rent for August and they did all of this without my consent or notifying me at all. They kept the AC unit and have offered to deliver it to my new address but all my cleaning supplies ($50) are gone. I talked with the landlord and she claims the new tenant called once a day claiming I said they could move in early and the landlord eventually caved and let them. What is my recourse here? It seems insane they thought they could do all of this without my consent. I assume I am at least entitled to my full security deposit back as I was not here to confirm any damages, but what more could I hope for if I decided to take legal action? Last communication I had with landlord was on 8/13 where I said "I'll let you know in the next week or two when the unit is ready for a walk through, I have a couple things still there and have to finish cleaning." And she said that was fine. [link] [comments] |
Why is it legal to charge for a parking spot that doesn't exist? Posted: 28 Aug 2019 07:51 AM PDT My school charges $100 for a parking permit, and each permit has a designated lot to park in. My lot is always FULL, completely, so I paid $100 yet still get parking tickets. There is a sign by my lot that says "if Full park by the stadium and use [the bus]". The stadium is not close at all, and I don't see why I should pay for a bus when I already paid $100 for a parking spot. I'm sure this is in fact legal, but my question is why? Why are they allowed to do this? Edit/Location: PA [link] [comments] |
Posted: 28 Aug 2019 10:28 AM PDT This is in Denver, CO. I just got off work and was going to drive my coworkers to the bank. As I pulled out of the parking lot, my accelerator went crazy, the RPM on the car went into the red, and my engine rev'ed at full force. I pressed my brake but nothing happened. I then slammed my brakes repeatedly but the car never slowed down, just kept going. I somehow navigated out of the lot, into the street, into another parking lot across the street, hit the curb, flipped and totaled my car, and hit another car. No injures, and luckily my insurance handled everything for both vehicles. This was in a 2009 Ford Mustang. The cop that arrived on the scene basically said he was forced to write me a ticket for reckless driving, which is a 4 point infraction. My first court hearing the judge offered to reduce it to a 2 point, which I said no. My second hearing, after providing articles of sudden acceleration happening in Fords, and the fact that Ford did not start to install a brake override in their vehicles until 2010, I was offered to have it reduced to a 1 point infraction. I said no again, and now I must go to trial and apply for a public defender. The city attorney also added a 2 point infraction for operating a dangerous vehicle, so I am now facing a total of 6 points of infractions. I have a written statement from my coworker who was with me saying he believes I was not driving recklessly, and my pressing of the brakes did nothing. Is this worth fighting? Should I just take the 1 point infraction? Here and Here are my proof that this is an issue with the manufactures. I am innocent, but have never been involved in court or any issue likes this. Any and all advice is appreciated. [link] [comments] |
Who would be the best to contact about prostitution? Posted: 28 Aug 2019 04:56 AM PDT My gay roommate has been hiring prostitutes in west Virginia. Along with that he has been persuading other guys at the college and guys he has met to do sexual things with him for money. I have met 3 men now that has accused him of rape, however I doubt they'll ever seek legal action. Along with these things he is hiv+ and believes since he is on medication (that he misses doses of often do to no insurance) he doesn't need to inform anyone of his status or use condoms. I feel like he is causing a large amount of harm to other people at this point and I can't sit by and allow it to happen. Who would be the most appropriate to contact about this to make sure something is done? The police in my area aren't that great so I want to make sure I go to the best place first to make sure it is handled properly. [link] [comments] |
How long must an abandoned vehicle sit on your property before it can be legally owned/sold? Posted: 28 Aug 2019 07:19 AM PDT My mother lives a few states away from me, in GA, and called me saying that her ex (who she hasn't seen in three years) showed up out of the blue and forced his way into the house. Once inside, he acted like everything was fine between them, he was going to do some yardwork for her and stuff. When she tells me about this, I immediately call her town's police department and tell them a psycho stalker broke into my mother's house and wants to do her bodily harm (which maybe he doesn't want to today, but he always does eventually). They showed up and threw him in jail pretty fast. Mom is a little mad at me but didn't contradict me to the police. Now his car is sitting in her yard. At what point does it become abandoned property and effectively become hers? Is there a point in time where she legally owns and can sell it legitimately? Otherwise, how does she make a little money getting this thing out of here? [link] [comments] |
Posted: 28 Aug 2019 11:23 AM PDT Location- Winnipeg, MB My mother has been without a bath tub or shower in her home for over a year. I think her contractor is taking advantage of her. A little back story – this is my mothers first house that she bought by herself. She is 70 years old and has lived on the poverty line her whole life. The only way she could afford this place is by collecting her pension and continuing to work, also she got a deal on the house because the previous owner smoked inside for 1000 years and also died in it, and it's the in the worst area of Winnipeg. I think someone was also recently murdered outside her home, like on the corner of her street. My mom is hecking poor and hecking old and very easy to take advantage of. The contractor - he is a very charming man and my mom loves the work that he actually does, as they are both very gaudy – there are sconces and chandeliers everywhere - and he does other favours for my mom around the house including bringing her a washer and dryer from another one of his houses. He also brought her dog a few sweaters and a frog costume. The bathroom has many "beautiful" details that my mom loves and she gets along pretty well with the contractor, although my mom gets along with everybody, so. The contractor also uses my moms garage as a storage unit in exchange for mowing her lawn, which he has hardly done and my mom pays a neighbor to do it for the most part. The contractors excuse is that he has multiple projects that he working on and that's why it is taking so long to complete, and the bathroom has a lot of little intricate details that takes the contractor a long time to do. When he does come by, he just does tiny things, like putting in a single baseboard, or painting the tub legs. My mom has a plastic basin that she washes her hair in and takes sponge baths in, but her only water source is from her kitchen sink (and toilet, but she obvs cant wash herself in toilet water) My mom is afraid to nag him or to bother him too much because he gets really petty and charges her more for little things he "needs" for the bathroom and takes longer to give her invoices, but as far as I know she has most of all the invoices for the work he has done. She has already paid for the bathroom renovations but he constantly askes her for more money for little items, or for the tub to be refinished, so bigger items too. I think he was also doing some electrical work but I believe that has been completed. I looked him up and he has a criminal record for business fraud, he was a financial advisor and did some shady stuff. I full believe that people who has a criminal record should definitely be given second chances, but in this case if he is continuing to take advantage of people even after getting caught…I dunno. There are two other people in the neighborhood that have also had work done by him – one of them said their job was never completed and the other one said he worked too slow and they would never hire him again. I often text him to see how the work is coming along and he always give him a hopeful answer, like "it'll be done this weekend" or some garbage. I'm afraid that if I yell at him he won't come back and finish it, and my mom will have to hire another contractor. If that's the case, do you think she would be able to get her money back by suing him? Also how does one sue someone if they can't afford a lawyer? Any advice would be greatly appreciated, thank you very much! [link] [comments] |
Posted: 27 Aug 2019 10:20 PM PDT Is a defendant allowed to use the victim of a crime to pay for their legal fees like this? He had horrible credit, and couldn't take out a loan without a co-signer, so he put me down. He apparently applied for the loan online, with my SSN and "my" electronic signature—and of course, never paid the loan back. When I explained my situation to the bank, I was told that because we were legally married at the time, that he could indeed use me as a co-signer without my consent—that also didn't sound right to me. I never pursued it legally because honestly, the abuse I experienced while being with him was so horrifying that I don't want to rock the boat in anyway, it's just not worth it to me—especially now that I've been at peace for over 2 years. It's just something that's bothered me ever since and I'm wondering if there are any laws about this sort of thing. Edit: thank you for all of your responses! I decided to contact the DA on the DV case just to see if there was anything I could do in regards to filing charges in relation to this. The DV case is a few years old, but he is currently still on a deferred sentence (he's already gotten it revoked & reinstated once and is actually up for revocation again in October) so it may be too late to go back and look at the original case in regards to this, but we will see what happens. I haven't heard anything from the bank in over a year and a half (maybe even 2 years), but I'm still terrified that they are going to randomly pop up and want to take me to court someday... Landlord switched my room around even though I specifically signed my least for THAT specific room Posted: 28 Aug 2019 06:24 AM PDT Okay first post on Reddit!! I am moving into a student house for my second year of college. It is a three story townhouse with 5 rooms, each having their own bathroom. I have a friend who already lives in a unit there. Myself, along with 2 other friends are planning to move in September 1st (to my friend's unit who already lives there.) When I was signing my lease and figuring out payment, I specifically told the office I would like to take over room 2 (on the second floor, nicer view than the one across from it) I told them I would not be paying unless I had written conformation that I would be able to move into that room come September. I got the email stating I would be moving into THAT room on September 1st. Another girl, (my friends and I don't know) has also moved into our unit across from room 2. Apparently, she went and asked the office if someone had claimed room 2 and they said no. So now, this girl has switched over into room 2 leaving me with room 3. This is frustrating for me because room 3 doesn't have a bathtub and the view is terrible! (view basically right into another building) So is this even allowed? I have the written conformation that I would be moving into room 2. I plan to go to them today but they are very sneaky with everything they do! I am worried they are going to make up a lie to me about how they can't switch it now... Edit: From Canada [link] [comments] |
TV show producers want my social security number Posted: 28 Aug 2019 10:42 AM PDT So, here's the background. I work for a failing restaraunt due to the owners incompetence. He somehow found a way to save his skin by putting the restaraunt on a TV show on FOX that remodels and revamps bars/restaraunts. Initially they sent a assistant producer and tried to get us to trash talk each other and obtain as much drama as possible to send to producers for a final decision. They came to the concensus that they would put us on the show but now are asking everyone that they want on the show to provide their SSN, all recent court cases involving them, and our last ten years of residency; they refuse to go further without this info. Why do they need all this? [link] [comments] |
[NJ] Moved out of home, Parents threatening to call police Posted: 28 Aug 2019 09:16 AM PDT Hello, Yesterday I (19 years old) packed my bags and moved out of my parents home following an unpleasant fight. They are threatening to call the police to come and bring me back home. Does this have any merit? What can potentially come of this? [link] [comments] |
Posted: 28 Aug 2019 12:38 PM PDT So my car was towed overnight from my apartment complex in North Carolina. Wasn't exactly sure what had happened at first but got towing company info from front office and called to see if they had it, at this point I'm trying to rule out it being stolen. Front office confirms they didn't call a truck and know nothing about it. Tow company confirms they do indeed have it and that they towed it for being parked illegally. I was parked by side of curb in the parking lot due to their being zero available marked spots. I'm new to the complex and have seen cars parked their before and figured it wasn't a big deal. Lots gets super full at night. There's no signage indicating it's a no parking zone, I left plenty of room to navigate around, and I checked tenant handbook this morning and found nothing disallowing it. So I go to the tow yard to get it back. Which they've told me over phone will be 200 dollars but when I arrive I see the car sitting, no boot. So I get the bright idea to hop in and drive away, now getting a little paranoid about this decision. So that's why I'm here. Is this illegal, how illegal is it, and what should I do next. tl;dr: car got towed for illegal parking (very questionable imo) and I went to tow yard, hopped in and drove away. What if anything should I do. [link] [comments] |
Hands-Free "get out of jail free car" in Georgia Posted: 28 Aug 2019 05:47 AM PDT I have a court date tomorrow for the use of a mobile device while driving. While giving me the ticket, the officer told me that if I show up to court with proof or receipt of a hands-free device then the charge will be dropped and I will be proven not guilty. Sure enough I looked it up and it is indeed true. Having said that, how should I plead tomorrow? Do I plead guilty but show the proof on my hands-free device? Do I plead nolo contendre? Not guilty? Not sure what to do. Thanks in advance for the advice. [link] [comments] |
CA - how long does an employer have to guarantee a job after employee goes on maternity leave. Posted: 28 Aug 2019 11:16 AM PDT Hi. An employee leaves for maternity without communicating an intended return date. She then stays completely silent, until - 4.5 months later - she demands her job back, starting next week. This is an hourly, shift-based customer service job and at that time all shift are full and she refuses an alternate hourly assignment. She now sues for discrimination based on her pregnancy. For how long is the employee obligated to take the person back? It seems impossible to get a definitive answer to this question. Thanks! [link] [comments] |
Some couples get matching tattoos. We got matching restraining orders..... Posted: 27 Aug 2019 09:31 PM PDT Me and my now ex both have a mutual restraining order, (TPO) until out court hearing next month. The order forces us both to move out of the apartment. I've been following the terms of the order, but she refuses to move out. I've called the police out now several times and they say her restraining order is not in the CLETS system, therefore it's not valid. Even though I have all the paperwork including the proof of service. Is there something I'm missing here? This is in Los Angeles, CA [link] [comments] |
Landlord trying to bill me for month of rent that should be free [NYC] Posted: 28 Aug 2019 06:21 AM PDT Hello. My lease states "the rent is $x last month prepaid with 1 month free rent (last month of lease)". This upcoming month of September would be the last month of the original lease. I also am renewing my lease for another year at an increased rent. My landlord has tried to bill me the $x for September rent. But according to my lease (at least in my understanding) this month should be free. I emailed him saying I think the rent should be $0 since we agreed to the one free month. Additionally, I am not paying a prorated rent, I am paying the full rent. He didn't reply. Leasing was also unhelpful and not responsive. Questions for you 1) can I just refuse to pay the rent and if so, will the landlord have any way to try to evict me 2) should I actually be paying the rent since I renewed the lease and so the last month of the new lease is actually in a year, that would be the free month. Thanks for your help. I am in NYC. Edit: updated quote to show exact wording in lease. Edit 2: upon further reading, "last month prepaid" and "last month free" seems to be self contradictory. However it does clearly say "1 month free rent". So I think it's just poor wording. By the way, the original lease was a 13 month lease with the 13th month free if this helps anybody to understand the situation. Edit 3: edited to say I am NOT paying a prorated rent... so the only way to realize the "1 month free" would be if the rent for the last month is $0. [link] [comments] |
Posted: 28 Aug 2019 12:13 PM PDT I am currently leasing a condo in a property that has an HOA. My lease is ending in about a month and the condo management sent me letter asking to provide my new lease or to notify them of me moving out. Stated in this letter is that "month to month leases are a violation of the rules and regulations and are strictly prohibited". I was mainly interested in doing a month to month lease for flexibility and because of this I reached out to the property manager for my unit (not the HOA) and let him know that because doing a month to month lease is not an option I will not being renewing my lease. He replies back saying that we can do a separate addendum that the association (HOA) doesn't see that gives 30 day notice to vacate by either party. This was interesting to me but I asked him if this would cause any issues with the HOA and his response was that there would be no issues as an addendum always overrides the lease. I am wondering what kind of recourse the HOA would have if I do head down this path and what I could possible be held liable for? Edit: Location is FL [link] [comments] |
[MD] Neighbors laying claim to part of our yard Posted: 27 Aug 2019 08:42 PM PDT Howdy LA! We just moved into a newly purchased house. As part of the purchase, we arranged for a survey/plat/staking to be done. Worth noting for context: we are a military family, with 4 small kids, living on a busy street. We are making improvements to the property, and among those improvements will be a fence for the safety of the kids (especially the smaller ones). We have begun to make some of these improvements already. (There's a shed that's nearly done now, which I'll refer to later.) When it became clear to the neighbors to our left that we were thinking of putting up a fence, they sent us a rather threatening note suggesting that the bushes/shrubs/landscaping (and land underneath) along the border of our property are "theirs" and that they'll sue us if we put up a fence along the county-recognized border. Specifically, their note says:
Problems I see with this are:
I'd prefer to negotiate something (moving the shrubs, etc.) directly with them, but assuming that doesn't work out, my questions for LA are:
Thanks! --------------------- Update: Previous owner confirms the shrubs were present when he bought the house from the previous-previous owners. There was a wooden fence - well inside the boundaries, probably near where neighbor wants our fence to be - which previous owner removed. Previous owner then put in the "invisible fence" closer to the true boundaries. Does this change anything? Guessing not since the electric fence would still negate the idea of "exclusive" use. Debt collector asking me to pay $1100 for magazines I didn't buy Posted: 28 Aug 2019 07:52 AM PDT Hi guys I was hoping to get advice on my situation. Details and timeline might be a bit hazy since it started almost 2 years ago. On mobile so sorry for formatting. In maybe Dec 2017 or Jan of 2018, I had issues with my laptop so I tried calling the hq to get it fixed. After an hour of talking and switching lines, I ended up talking to someone about how as part of the company's program I was a "winner" of a gift card and they needed my credit card information. I was immediately suspicious but frankly I was just annoyed and tired of trying to get my laptop fixed and I wanted to move on and get back to speaking to someone who could help so I just gave my credit card number and my address (in hindsight I know this was stupid). A couple months later I noticed small payments for some magazine on my credit card and reported it to my bank that I didn't authorize those payments. They refunded me and sent me a new credit card. And then earlier this year I received a letter from a debt collecting agency stating the amount I owed. I called the agency explaining I never subscribed to any magazine subscription but they said they had a recording of me agreeing to it. So I assume that during the call about the gift card, they used parts of my voice to make it appear that I agreed to subscribe to the magazine and used my information to complete the subscription. Since then, and in general, I've always just ignored calls from phone numbers that I didn't recognize because of spam calls. So I just forgot about it and thought it would work out. But today I decided just to pick a call up for the heck of it and it turned out to be the debt collector asking me to pay the amount again. I explained that I did not subscribe to any magazine and had no intention of paying any money but they explained again that they had a recording of me agreeing to pay for the subscription. I asked them to not call me anymore and hung up. I understand that the debt collectors and the magazine company aren't the ones trying to scam me as the scammers are the ones who actually used my info to purchase the subscriptions. But I know I was stupid and I brought this on myself. Regardless, Im worried again and concerned about any type of legal consequences if I keep ignoring them. I live in Virginia, but the debt collector numbers location was Conneticut. What should my course of action be? Should I just keep ignoring them or even change my phone number? Can I legally be in more trouble if I continue to ignore them so should I consider getting an attorney? I'd really appreciate any advice!! [link] [comments] |
[CA] Any right to know accusations for basis of investigation? Posted: 28 Aug 2019 01:04 PM PDT I am currently being investigated for misconduct and have been assigned to home on paid status. The initial reassignment occurred in June and I still have not been told the accusations against me. This is an internal investigation (non-law enforcement). Do I have any recourse? Thanks!
