Michigan; I have dash cam footage of my dealer abusing my car (racing it), they want to meet this week to discuss it.

    Posted: 03 Aug 2019 06:01 AM PDT

I have already made one post about this asking about if I should share my dash cam footage with the dealer in question, or if legally I was better of not doing so.

It seemed like there was no harm sharing the evidence, as long as it was unmodified (it was not modified).

The manger of the dealership has finished reviewing the footage and called me yesterday to set up a meeting to discuss the abuse to my car.

    To summarize everything that occurred;

    1) CPO Vehicle was damaged upon pickup, I foolishly agreed to let the dealer fix it rather than taking my Credit Union's check and leaving

    2) Repair work was less than average in quality, clear coat runs, body panel still was damaged (it was a fender and it was still bent on the inside). Found the passenger fog light is also damaged after the repair, dealer claims I bought the car like that, its a CPO and it should have been inspected (as per Manufactorer's inspection sheet).

    3) dealer agrees to fix it again, I drop the car off during my 2 week long vacation. Car sits at the lot, gets joy ridden back and fourth between the body shop (~75 miles round trip), Body shop wet sands clear coat, doesn't address additional damage, says "we stand by our work."

    4) Found footage, emailed dealership with clip of footage explaining I am upset and want compensation for the wear to my vehicle, unhappy with the body repairs that are still not done properly.

    5) ~1month to get a response, had to reach out to Corporate customer relations to get the dealer to respond after multiple phone calls/voice mails and no returned calls.

    6) Dealership manager reaches out, wants video footage of incidents, I dropped footage off

    7) setup meeting with manager this coming week to follow up and discuss.

The car was ran to redline multiple times, the driver seemed to not be very good at driving stick, so he/she frequently was riding the clutch during these jaunts to high RPM, he clutch dumped it once causing wheel hop/spinning tires. My trips to the dealer have added about 500 miles overall to the car just trying to get the body work addressed and now the excess wear to the vehicle from being driven hard, this has been going on since the end of March.

I am not sure what kind of compensation I should see to be acceptable (legally speaking). Initially I asked to have the dealer buy the car back from me so I could walk away from all of this, but I don't anticipate this to be given as an option. Realistically what should I expect given the circumstances, and what should I find to be acceptable?

[Update] Apartment Complex wants to turn private resident backyards into public common areas.

    Posted: 03 Aug 2019 08:01 AM PDT

    Original Thread: https://www.reddit.com/r/legaladvice/comments/c4gp7x/apartment_complex_wants_to_turn_private_resident/?utm_source=share&utm_medium=web2x

So an update on this. A few months ago it was just a rumor but yesterday residents received an email regarding the plan to renovate private backyards into a public common area. We've been given two weeks notice to get rid of all our outdoor furniture that we bought specifically for this private space (just over $1,000.) We have been given notice when the renovations will begin but not how long they will last. We have not been given any assistance regarding the moving or storage of our furniture. All of our 5 foot fences that give privacy to our apartment will be taken down and the entire space converted to a public amenity for residents. Aside from a 2 foot barrier around part of our unit, nothing is protecting our apartment from someone being able to walk right up to the sliding glass door.

Our lease agreement does not specifically mention that we have a private backyard, but there is language in the lease stating if you have one, what can and cannot be stored on it and how to maintain it. Also, when we moved in 3 months ago, we were verbally told this was our private backyard and there were only a few units like it on the property.

I guess my main question is what is and is not legal about this? Surely they can't expect us to just comply with this no questions asked?

    This is in Georgia, US.

Mom takes $150,000 from her kids because it’s ‘owed to her’. Can they sue?

    Posted: 03 Aug 2019 06:18 AM PDT

Just some background but basically my boyfriends dad died a long time ago and he had a life insurance policy that gave $75,000 to each of his kids if he were to die. The money was to be given to them once they turned 18 so they could have a good start in life. My boyfriend mom raised him telling him that was her money and that their dad wanted her to have it. Once he turned 18 the money was added onto her account and she used it to pay off her debt (which she has been known for accumulating a lot of). All the stories him and his mom and sister tell me about their past sound extremely abusive and just not safe. His mom constantly makes jokes about his sister throwing such violent fits that it left holes in the floors, walls, and doors. His sister is always talking about how their mom constantly makes fun of her weight or her singing or anything she can poke fun at. My boyfriend has tried to kill himself 3 times and all his mom had done was tell him to stop making a scene. My boyfriend and I have been dating for almost 2 years now. I'm his first girlfriend and since the very beginning his mom and sister haven't liked me. They both consistently taunted my boyfriend about how he was dating a whore and how i'm just a stupid immigrant. He has also told his mom multiple times how he doesn't feel loved or wanted in his house because his mom constantly belittles his achievements and amplifies his sisters. All she did when he told her this was tell him he's childish and just wants to start problems and argue and blame me for making him argue and being trashy. Yesterday she got mad over a fake pregnancy stick we bought at spencer's for a joke on instagram and it ended with her kicking him out (for the second time) and basically saying she disowned him. His mom has been planning on selling their 15 acre property for over a year now and has promised my boyfriend back the $75,000 when she does but is now saying he's not getting anything. Can my boyfriend sue her for the $75,000? Can he legally argue that it was for him and his mom manipulated him into giving it to her? We have a 40 minute audio recording of her being emotionally abusive pushing him so far over the edge he hurt his hand. Would we be able to use that as evidence that she's not stable and extremely toxic? We both discussed it and we don't actually want to sue her but he's scared he's going to lose his job and be homeless if his mom does this a third time.

tldr; my boyfriends mom is emotionally abusive and took $75,000 from him. what do?

    [FL] Grandparents forcing visitation rights?

    Posted: 03 Aug 2019 09:05 AM PDT

I am in Florida, my parents are in Texas.

    Situation

Seven years ago, I severed all contact with my parents. They disowned me because of my homosexuality and conversion to another religion.

I have since moved to Florida and married. I have a young stepdaughter - my wife's from a previous [heterosexual] marriage - whom I am very close to.

Two weeks ago I was accidentally put into contact with my parents again and my parents learned that I have a daughter. At the time, I made a post about this in relationships (https://old.reddit.com/r/relationships/comments/cgvkiq/i_31f_cut_contact_with_my_parents_sister_25f/)

I have maintained my complete silence with my family, except for one sister I'd been in discrete contact with and a brother who has decided to sever with our family over seeing how they're treating me and my daughter.

This morning, my sister informed me that my parents are seeking legal options for the court to force them to have access to my daughter via grandparents' rights.

My sister - and therefore my parents - do not know my daughter is not biologically mine and therefore not related to them. My wife and I are in a very stable middle class situation and are working on having another child.

As such, and because my parents are out of state and disowned me because of my sexuality and religion, I'm pretty sure this is a bluff but I thought I'd ask here.

Do I have anything I need to worry about legally?

tl;dr: severed from parents years ago, parents found out I have a child they don't know isn't biologically mine, parents are considering legal action to force visitation rights, want to know if I should be concerned

I think I got fired because of my severe eczema.

    Posted: 03 Aug 2019 08:49 AM PDT

    (NB, Canada)

I'm training for a truck driving position. I didn't put it down as a medical condition because I didn't think it qualifies as one.

Anyway, I had a decent flare up and my boss kept asking what's up about my skin and if I can work with it because we're constantly outside. It's been a very hot week 33+ feeling like 40 so I had to take a couple breaks.

A few days later he asked again an I actually showed him to which he scorned.

Then my trainer asked what my skin condition was called the following day.

The next day after a short shift I get a call from my boss saying they're releasing me from training for some made up bs reason.

Neighbor Shuts water off without cause

    Posted: 03 Aug 2019 08:38 AM PDT

    (Washington State)

So my Father and our neighbor have not gotten along for several years now, and unfortunately the well which supplies our water is on his property and under his control.

The well agreement dictates that we pay half of the cost to run and maintain the well, however whenever the neighbor demands money for this he refuses to provide the cost analysis for parts and labor and threatens to shut the water off until we pay.

This includes increases to the standard monthly electrical cost of running the pump.

We have talked to both the police and a lawyer but since it is a civil issue the police cant get involved and a lawyer only recommends having our own well drilled which is upwards of 11-13 thousand dollars and recouping the costs through a lawsuit.

But we cannot afford to have the well drilled at the moment and if we were to start a lawsuit we run the risk of him shutting the water off and would have to live without any water for as long as it takes to get the situation resolved.

    What can we do?

Can someone explain the public broadcast laws if I were to open a bar and feature retro video games, and specifically how it is different than opening a computer cafe where people can play games? (California)

I would be interested in opening either a computer cafe or a bar. I have a large collection of old and new video game consoles, as well as a number of gaming pc's I've built. What licensing should I be looking into?

My employer fired me for discussing my salary with one of my co-workers, off the clock, and off company premises.

    Posted: 02 Aug 2019 04:44 PM PDT

Apparently, the company has an (unwritten) policy that you're not allowed to discuss your compensation, benefits, bonuses, etc, etc with anyone else inside the company. After a year working there with no other issues at all, they simply brought me in the office and fired me today for that reason. I understand the concept of employment at will, but this just seems like a really shady practice. Can they fire me for that? Anything I can do?

Edit: Thank you all for the help! I will be in touch with the NLRB soon!

(NY) Temporary Office Space - Are these parameters legal?

    Posted: 03 Aug 2019 04:51 AM PDT

I work for a specific county in NYS on Long Island. We had an office, but the county and state (it is technically a state building we work in) are down sizing it due to needing room for something else.

For the time being, they've moved us all into a small room upstairs. The room, which I haven't measured officially, is probably 15 by 20 feet or so - quite small and cluttered. There's also only one door with no windows (egress issue?)

In total there are 3 people per team and two teams at a time with a minimum of 4 people on at the time of each shift. So far we've had 5 people at most (vacation time being taken, for example), so the room has been extremely packed. There's almost no room to walk, chairs strike one another, and the desk next to me (if you can even call it that) must be, at most, 6 inches from my work "desk."

Originally we were supposed to get two rooms to spread out more, but that was squashed last minute for some reason. We are unsure if there are any plans to give us another room. We are stuck here for another two months if all goes according to plan.

    Is this all legal?

Minnesotan summoned to small claims court for more after contractor took entire insurance settlement and didn't finish work. This is my story. What should I do?

    Posted: 03 Aug 2019 07:52 AM PDT

Sorry for the length, the narrative helps me get things straight.

In early June 2017 a big storm damaged my house and many nearby. An agent from a contracting company approached me after talking with the neighbors. I was grateful to get the ball rolling immediately on repairs since a hole had been punctured in the roof and rain water was creating a huge mess inside. At this time my mother was on home hospice care, stage 4 metastatic bladder cancer. I was her primary caregiver, so having this disaster addressed immediately was a big relief.

    _

The insurance adjuster and contractor foreman arrived sometime in july. (The first adjuster died of a heart attack or something and they sent another when I called asking for the status of the claim.)

The adjuster pointed out hail damage to the siding of the house, roof, all the repairs inside and out. They quoted a $17,000 insurance payment after deductable. Finally the check came in early August. I called the contractor, who came over and took the full insurance check, saying he would handle the details. This is my first time handling anything insurance related so I asked for receipts and documentation which he said would be provided, but never were. No invoice, just an initial contract with the repair details. I was worried the insurance company would take back the money if I couldn't prove I used it on the house. I don't know how any of this works.

    _

The crew finally showed up to repair the roof sometime in September. In November an entirely different crew showed up and replaced the siding of the house.

There was a storm door to the utility room that had been torn off as well, which was supposed to be replaced by a third and final crew who would also fix the interior ceilings. Two guys from that crew did show up to look at what all needed to be done inside, but that was it, they looked and never returned.

The interior of my home was never repaired. The work remains incomplete, water damaged ceilings and walls. Probably a lot of mold by now. I assumed they quit because the budget had run out after the other repairs. My brother installed a new storm door a month ago. These items are on the paperwork I have, and should have been repaired by the contractor. He is charging me for having repaired them.

    _

About a year later this contracting company started leaving messages on my answering machine saying I owned them an additional $5,900 for their work done. However in the messages left they were addressing them to my parents who neither one signed the original contract (but whose names are under the landline phone in public listings). I figured it was some scam that saw I had this company do work on the house and ignored it.

Today in the mail I received a notarized request to appear in conciliation court(Minnesota small claims) owing just under $7k, the $5,900 plus a bunch of fees. I never received any paperwork as far as receipts, notification of work completion, nothing. They just called a year later demanding six grand. They never sent a letter or invoice, no paper at all. They just called out of the blue, and now they served me with a summons to court.

    _

Reviewing the insurance paperwork today, I see i didn't file for the supplemental claim. My mom died between the storm and the deadline. It's roughly the amount the contractor is asking for. The contractor took the insurance check and said he would handle things. I really was not in good shape these months, taking care of my disabled father and dying mother. I just tried to put all the hurt behind me.

I receive disability for my anxiety. I tried working and I lost part of my healthcare, permanently, and then mom was diagnosed with cancer the first time. I have no clue how to assemble 7 thousand dollars. That seems impossible.

    What should I do?

TLDR: The contractor did half the job, never sent me any invoice or mail. They just called and left a few messages on my phone a year later. Today when I got a summons to court. I am broke and disabled. What do I do?

[Virginia] Sexual Consent and Removal of children by force

    Posted: 03 Aug 2019 12:45 PM PDT

My sister-in-law (Wife's Sister) has three daughters aged 21, 11, and 12. The eldest is developmentally delayed and cognitively impaired. She has an approximate IQ of 65 and has been on SSDI for life.

Despite the disability, nobody has filed guardianship paperwork on her. This makes her legally an independent adult as far as I know.

Recently, it was discovered that SIL's boyfriend had been molesting/raping her.

Due to her impairment, she has a hard time saying the doesn't like a situation and standing up to authoritarian figures.

Since the molestation/rape, SIL has married the boyfriend. SIL was aware of the molestation/rape at the time of the marriage. We found the marriage license with marriage date when doing a background check on him. Eldest niece has left the household to live with another relative. Husband now lives in the household. My wife and I fear for the safety of the two youngest children. Other than the molestation, he has no other criminal history. Because he has not been charged or convicted of the molestation/rape, he's perfectly safe to be around children. Despite pleas from my wife and I, SIL is unwilling to give up custody of the younger children. (We have the financial ability to care for the children.) CPS has already been contacted, but due to the lack of charges/conviction and due to the eldest's age and legal status, can not do anything.

    My questions are:

1.) Does not saying, "Yes, I want this" constitute lack of consent? Or would she have had to say, "No, I don't want this," to withdraw consent to any actions involving eldest?

2.) Can an advocate testify for eldest in court or would she have to testify? Would my wife or I count as an advocate or would it have to be someone of a professional capacity?

3.) Is there a legal avenue that I can take to declare SIL as an unfit mother and get custody of the two youngest children.

[AR] Franchisee is implementing policies that are nearly impossible to follow

    Posted: 03 Aug 2019 08:01 AM PDT

First, I'd like to mention that the franchisee seemed to have done some extensive research in order to provide the bare minimum for us employees.

However, a few concerns have risen that have caused issues for not only us, but the business itself.

A little backstory, we are a part of the service industry, and we mainly accept clients at an appointment 'encouraged' basis, meaning we still take walk-ins if the time allows it.

Breaks have been a major problem. We get an hour lunch break only one day in the week and it is reserved for the days we work 10 hour shifts. The rest of the week, however, we work 6 or 7 hours, but no break whatsoever. Not even 15 minutes. If we manage to argue needing a 15 minute window on any particular day, chances are we still don't get that break because we are either running behind with our appointments or that break gets taken away if we happen to have a walk-in. Breaks are not only taken as a joke, but are actually discouraged due to not having a designated breakroom, and demands have been made to not bring food/snacks, unless you are able to find the time to eat it.

There's also absolutely no respect for our time. Depending on what the client's appointment is for, some will need only 15 minutes and others could take up to 3 hours. The franchisee had chosen to implement the corporate policy that allows a 9 minute grace period for each client if they happen to be running late. Especially if that client is alotted only 15 minutes and they show up right at 9 minutes after their appointment, that leaves us 6 minutes to complete a 15 minute task. Don't even get me started on how frustrating it is when they're 9 minutes late, and still require a restroom break before the appointments which sets us employees back even further on time. They'll also reprimand us for either moving too quickly / working sloppily or moving too slowly / not allowing opportunities to make the bosses more money. Most of our clients don't appreciate that and we have no choice but to explain to them that we work under a particular time structure.

Days off have been a recent problem. We've been understaffed and although we had hired another employee for the help, I honestly believed we needed at least 3 more new employees to compensate for how busy we have been. Because of this, we still were requested to work on our days off, work double shifts, or we're even pressured to work regardless of how sick we are. A recent incident has happened where one of my coworkers needed a day off, but no one was able to cover her shift because everyone was already working, so she was pressured to show up anyways. This resulted in her collapsing just shortly after clocking in, and ambulance had to be called and she was required by the paramedics to go to the doctor.

Benefits are nonexistent. Mind you, we are scheduled at most 35 hours a week as full time, therefore we are not even offered health insurance. Lately, though, because we are understaffed, most of us have been working 40 or more hour weeks, and we dont even get any extra compensation unless overtime is approved.

These are just a few things off the top of my heads but I want to know if any of this is acceptable, because its starting to cause some real problems.

My name and mother's name on birth certificate are wrong

    Posted: 03 Aug 2019 10:41 AM PDT

    Hey everyone,

I'm a dual citizen American/Canadian who has just discovered a big issue.

Background: I was born in California originally and lived there until I was 10 years old until myself and my mother moved to Canada (where she is from) in 98'. I last visited the US (and my dad's side of the family) in 2004 and I'm pretty certain that at that time I still did not need a US passport to enter the United States.

Fast forward to today and I want to get my US passport to visit my grandmother who's getting up there in years and see my siblings and nieces and nephews.

I looked for my copy of my Birth Certificate (which I thought was an official copy but I've learned that it's not) and lo' and behold my name is spelled incorrectly and my mother's name is not my mother's legal name, but one of the assumed names she had taken on while living in the US illegally (that is a whole other story).

I'm not entirely certain what to do here. My Social Security card has my name spelled correctly and I do have records from the elementary school that I went to in California that has my name on them. Also, all of my Canadian legal documentation is my name spelled correctly (passport, driver's license, health card etc.)

I'm guessing I have to petition the courts in California to have the name of my mother changed to her actual name on my birth certificate and my name changed so that it's spelled properly but how can I do that if I can't even legally enter the United States with my Canadian passport?

Is it a matter of contacting a California family lawyer and corresponding only online/by phone?

Any help is massively appreciated since my head is swimming over the implications of a stupid decision my mother made in the past.

    TLDR;

My mother's name on my birth certificate is one of her alias's and not her legal name and my name is spelled incorrectly. I need to get my US passport but do not have any US documents aside from an unofficial copy of this birth certificate, some records from the elementary school I went to, and my Social Insurance card.

How do I navigate this mess and who should I be speaking with to get this all resolved.

A friend of mine m(16)’s mom is trying to take him back after the custody agreement was nullified(NC)

    Posted: 03 Aug 2019 07:26 AM PDT

Side note This post is being made for a friend of mine to help him out. For a backstory his parents had divorced years ago and they had a separation agreement where they alternated weeks at each parents house but his mom started doing drugs and had a mental break that when his father brought it to court the agreement was nullified under the terms of a a new one would be worked out with the mediator. But this morning he received this email (email) that basically said she has equal say in his life and saying that he will come and live with her for a few days and if he doesn't his dad will be in contempt of court. No new agreement has been mediated, does she have any legal grounds

My vehicle was towed from parking condominium parking lot even though I had correct parking pass. Condominium management claiming that they can't do anything about it and they refuse to reimburse me the cost of repossession.

    Posted: 03 Aug 2019 12:40 PM PDT

Palatine / Cook county / Illinois Last night I got home from work around midnight and parked my vehicle (Mercedes Sprinter) in the ONLY parking spot available (this condominium complex has huge issue with parking spots and it is always a hustle to find parking after 6pm) and since I park this vehicle here only one night per month, I didn't have resident parking pass on it, so I used guest parking pass (correctly marked for the date and time and also placed it on the correct spot in the vehicle). This morning I vent out in order to go to work, but my vehicle wasn't on the parking lot.

Called condominium management, but they don't work on weekends, so I called their emergency number. They instructed me to check with the towing company which I did later on and towing company said that my car is parked on the resident parking spot and they do not care about the general parking situation in the condominium complex.

Called again emergency number of condominium management and explained everything in details (when i got home, what type of vehicle, where and why I parked and that I had guest pass correctly filled and placed) on which their answer was that they "do not care about my issue since I parked on resident parking spot".

Is there anything that I can do to get them reimburse me (almost $600) since I can prove that I am a resident, they are aware of parking issue and parking pass was correctly filled and placed?

P.S. I am new in USA and I am experiencing this type of issue for the first time, so maybe they are all right and I am wrong, but any help would be appreciated.

P.S.2 If this is not r/legaladvice material, please suggest where else to post this.

    Thank you

Accused of playing with myself 3 times within a week, looking out my 3rd floor bedroom window, one of the days I was in with a friend and he accounts for my activities that day. Life in the balance. UK

    Posted: 03 Aug 2019 11:32 AM PDT

So the other day I (22M) was taken into Police Custody and interviewed because 2 female witnesses had "seen me masturbating at my window" on 3 occasions whilst they were stopped at a junction across the road, 3 floors below. On the 2nd occasion, Witness A had said they saw a poster hanging in my room, this was used as evidence at the time of my arrest. I've been down to the road and find it insane anyone could see into my room considering glare and angle, let alone make out a poster hanging 10ft behind my window, I'm not even sure the angle works for that without some form of magnification. On that occasion, my friend was over and he accounts I was barely alone for a minute or two and we went out around 17.20, the incident is cited to have occured between 17.00 and 18.00.

The junction is next to a shop where I know many members of staff and they know me and where I live/work. I find it crazy that I would do this in their direct line of sight. Both of my jobs require disclosure so I have a lot to lose, I also have a gf of 5 years who'm I'll have to tell soon. I've spoken to the friend who agrees my alibi, I'm just wondering how they can use 2 witness's to charge me of 3 seperate sexual offences. Do I have a leg to stand on as they have no hard proof?

Throwaway, but I genuinely need advice. Phoning a Solicitor first thing Monday.

Plaintiff asking for case to be dismissed?what does this mean?

    Posted: 03 Aug 2019 10:41 AM PDT

(Landlord-tenant matter)Hi guys. I just found yesterday i had a default civil judgement served against me by a court.my apartment complex filed a case against me for not paying a fine. My trial date was 2nd july which i missed because i was unaware of case against me.

Anyway as of today, i have paid the fine in full. I just got an email from their law firm saying that they will be asking the court to mark the default judgement marked as dismissed as i have satisfied the balance.

What does this mean? does this mean the judgement will go away/vacated from my record? will it still show up on my credit report or public records? If so will it affect my credit score?Thank you.

    The location is new jersey.

    Breast implants recalled by FDA

    Posted: 02 Aug 2019 08:14 PM PDT

I had my breasts augmented with textured implants in 2013 to fix asymmetry and tubular/constricted breasts.

My breast implants were recalled a few days ago by the FDA due to an increased risk of cancer. The textured shell causes lymphoma cancer cells to collect in between the breast implant and the scar tissue. In advanced stages, it can spread.

I want these agents of chaos out of my body, but can't afford it at the moment.

Right now, the company (Mentor) is only offering warranties if you already have cancer; and, I'm only seeing law suits being brought on behalf of people who have cancer.

Do I have any recourse? Would emotional stress with physical symptoms be a sufficient damage in a lawsuit? Etc.

Working as a Chaturbate webcam model in the U.S. while being a non-resident on an F1 student visa

    Posted: 03 Aug 2019 01:03 PM PDT

I'm currently going to school in the U.S. and I have an F1 student visa for that. I'm also working as a webcam model for Chaturbate, which sends me checks in U.S. dollars to my Canadian address. The amount I usually make is about $100 to $300 per month (which is not much, but still handy). My question is, if I deposit these checks at an American bank with whom I have an account, do I have to pay taxes to the U.S. government and is doing all of this even legal for someone here on an F1 visa?

    Thank you
