Posted: 15 Jun 2019 08:06 AM PDT TL;DR - things kind of managed to sort themselves out So I got a call while I was getting ready to head back to the apartment to meet the locksmith. It was Pete's brother. Apologies for the lack of details here but I don't know too much about exactly what went down, and a chunk of what I do know is sort of personal shit that the brother, who just did me an enormous favor, probably wouldn't want me sharing. Anyway, the gist of the phone call was that he went by and performed a third party constructive eviction with the back of his hand. So Pete's gone, as is most of his stuff. His brother is going to swing by next week to grab any odds and ends that they may have missed. I am planning on making him dinner and hitting him off with a bottle of good whiskey when he does so. As far as Pete goes, I'm thinking that I'll follow through with at least the early part of the eviction process just in case he tries anything cute. Gonna speak to my attorney about this first, but he's still in the wind. Turns out he's staying at a cabin his girlfriend's family owns and it's pretty much as close to being in the middle of nowhere as human-built structures get. His admin/paralegal... I dunno what she is specifically, but she said that yesterday was the one day he wasn't going into town for cell service. This gives us the opportunity to convince him that the situation is currently way worse than it ever was, and as much as I love this guy, he's really fun to fuck with so that's cool. After speaking with him I called the owner of the locksmith to let him know that the apartment was vacant, so his guy wouldn't need to show up with police. Turns out he was planning on coming by to handle this himself anyway, so that was easy enough. I met him over there, he had a handful of deadbolts for me to choose from, and he switched out the lock in about five minutes. We got to bullshitting about baseball because that's what you do in New York, and this led to him accepting my offer to buy him a beer so we could watch the White Sox smack our Yankees around. I got some backstory at the bar, and while this is secondhand information, the dude seems pretty reliable so I've got no reason not to believe him. The guy who came over yesterday morning was indeed an employee of his, but he wasn't on the clock and actually "borrowed" the deadbolt without mentioning anything. Turns out he is an old friend of Pete's, and had been fed a story about an insane landlord who had decided to move into the apartment Pete was renting. Brilliant. Anyway, my new locksmith buddy told me that this guy was officially unemployed as of that afternoon. I'd feel bad for the dude but I'm too busy not caring about what his motivation was due to the complete and total lack of any attempt to verify the story he'd been fed. This also explains the the non-answers I got when I called the shop - the person I spoke to was a manager who had absolutely no idea what I was talking about. He was basically trying to buy some time to speak with the owner and the guy who installed the deadbolt instead of just pulling an excuse out of his ass for me. I wish he'd told me that in the first place but I do appreciate the fact that he didn't just try to go into CYA mode for the company/his (now former) co-worker. All in all, I have a new preferred locksmith for when I need something done at any of my properties. So really the only legal shit left is the restraining order, and Pete very kindly sent my wife a few emails last night upon figuring out that she'd blocked his number. Not gonna go into detail but I'll just say that the contents should make the restraining order easy to get. So thank for all of the help and well wishes, but it seems like this is more or less a wrap, and a pretty amusing one too. My wife's gone from upset about the whole thing to uncharacteristically indignant, which she's admitted is kind of cathartic for her, so I don't even have a reason to feel guilty about laughing about what a moron Pete is! If we did so good and followed all their rules we would get a safety bonus. I'm in construction and actually feel that this is extremely important anyways so it was a win win for me. I was actually one of the highest marked for safety so my bonus is considerable, a little over $3000. I was told originally bonuses would be paid out around the end of the year. I figured it was something the safety guys would be handing you around Christmas time with a pat on the back and a "Good job". That came and went. So I asked again. Then I was told it would be paid out during our yearly review by the Operations Manager so it was in his hands and it would be completed by February. Annoying but whatever. February came and went, then I was told March they would be done. Then April. There was always a new excuse and also them saying "We're actually getting some done this week" and other lines of pure bs. I know this because I talk to the other foreman and nobody has gotten a bonus. Then around the middle of May, I notice on my check stub it actually says BONUS $3000. It's been added to my yearly gross income and I've even paid taxes on it. So I called the Operations Manager and asked him what was going on and he said "Yeah, that's the safety bonus you earned and we'll be handing you that check when we discuss the safety portion of your review, we're getting those done this week" Sounded awesome to me. Here we are at the middle of June and still no review, no check. I'm in Canada and not sure if this kind of issue varies province to province but if so I'm in Nova Scotia. I was going along in my pregnancy fairly normally, no issue, had seen the doctor, had an ultrasound where a healthy heartbeat was detected, and everything was great, save for a viral infection I contracted that passed fairly quickly. I work at a daycare and I figured I just got a minor flu or something else as there's always one bug or another going around. Shortly after the viral infection I started experiencing some minor bleeding which I had checked and was told there was no identifiable issue and sometimes this 'just happens'. Heartbeat was still fine. Baby was still fine. I then find out that the daycare had received notice that one of the children was infected with a virus that can cause miscarriage and the notice advised that the child should not have any contact with pregnant women. The area director sat on that notice and didn't tell anyone. No emails or notice went out to staff or parents, I only found out weeks later because she had mentioned it to some of the staff members; still no notice was sent out. The virus is extremely contagious, and the child was in my class. I was touching him, hugging him, and having regular contact with him every day for weeks before I found out about this virus. A couple weeks after the bleeding started, I suffered a miscarriage. I've spoken to my doctor and while she said a test might be possible to determine whether I had contracted the virus, it wouldn't be able to say exactly when. However, given my health, history, and how the pregnancy was progressing she believes that was the cause and is shocked the daycare didn't put out an announcement, as it's a very serious issue. A little more than week ago, a second woman who works in the daycare has also suffered a miscarriage. Two more are still pregnant. That is four pregnant women in the daycare, and the area director didn't seem to think this warranted more attention on her part. Now two of us have lost our babies. Unfortunately, there's no way to 100% prove that's what caused it. Is there anything I can do? Are they liable at all? I'm very upset, angry, feeling lost. I am a Certified Welding Inspector who just renewed my certificate for 3 more years. Who in their right mind would risk a job like this? So prior to entry of each plant we get pre -employment testing depending on the plant which tests they require. This one in particular required Hair follicle, urine and alcohol test. Submitted my samples on June 11, get a message from HR on June 13th to call the MRO from DISA. "Whaaat, no that's a mistake"! I said She then continued to ask if I had any surgeries recently, or sever nosebleeds. And I'm like No none of that. Long story short I'm not fired as of now with my company because they know who I am, and I would never do such a thing. They only recommend I proceed with the program that DISA has which is to see a Substance Abuse Professional pay out of pocket like $600 then they evaluate me to see if I'm an addict or not and clear me with DISA. It's a long process basically before I can get back to work. But WTF, how could I have gotten cocaine in my system or urine? Has anyone been in this same situation? Help!! And around 6 months ago my mother was diagnosed with a terminal illness, and as of tuesday doctors expect her to live maybe another 4-6 months. I have two younger siblings, my sister who is 21 and in college, and my brother (adopted) who is 14 and in high school. My relationahip has been rocky with my parents since I was around 13. My parents adopted my brother at the time, and told me that they were doing so because, and I quote, "We really fucked up raising you so we need a second chance to raise a deserving son." They also wrote me out of their will a few years ago. Now my brother has serious behavioral/mental issues that have not been diagnosed. I am not a medical doctor of any sort, but this is fairly damn obvious to most people who know him. He can get very violent and argumentative with almost no provocation. He is also larger - 5 foot 7 and over 200 pounds at 14. Numerous school psychologists have suggested, and even begged my parents to have him referred to psychologists and get some form of treatment, but my mother refuses as she believes most psychologists are quacks and are simply going to, "Pump him through with drugs." Now, I am very distent from my parents and most of my family except for my younger sister, who I basically raised as both my parents had very lucrative careers in national/local politics (Combined made over $1.5 mi. a year). I moved, on my own, to another city an hour and a half away when I turned 18 as it was a very toxic environment for me to be in. I won't go into detail, but basically I was the black sheep of the family and my parents made sure I knew it. Since then I have made a decent life for myself working in my city's restaurant business. I dont make tons, but can afford to support myself. Now here is the legal question: I have been completely cut out of their will (they have a considerable amount of money), to the point they hired a lawyer specifically to ensure there was no way, should they pass, I would have any claim on their money/house/possessions. I have no problem with this - their money will be equally split between my sister and a trust fund for my younger brother (not accessable until he is 21). I don't want their fucking money. Problem is, according to my mother, they also wrote the will in a manner where I will be given sole custody of my younger brother should my mother pass before he turns 18, so my sister (who is in college) can focus on her studies. I am not at all in a position to properly take care of a 14 year old, yet alone one who I believe has serious developmental issue that would require what I suspect to be intensive medical treatment, especially if I dont have access to money through their will. Plus, I'll be honest. I am 6 feet tall and only 140lbs, at this point my brother weighs over 60lbs more then me and with his issues and constent violent behavior I highly doubt I could effectively control him. So, can someone actually outline who takes in their child after their death in a legally binding manner? For the record, my sister is not in a situation to take care of him either - so should my mother pass on, what would be the best next step? Thursday afternoon I was riding my bike home, in the bike lane, when a young woman failed to signal or check her mirrors and turned right into me, striking the rear wheel of my bike. I was just about parallel with her passenger side door when she started the turn. I know she hadn't signaled because I made a point to check before feeling comfortable continuing forward and this was later corroborated by an eye witness, nevermind that all she had to do was turn her head or glance in her side view mirror to avoid the whole fiasco. The bike slipped out from underneath me and I, like Wile E. Coyote, went from riding a bike to being mid-air with nothing underneath me. I landed on my left hip hard, then slid on my back for several feet. I stood up almost immediately but realized that my left leg wouldn't support my weight, at which point I laid down and crawled out of the street and onto the sidewalk. Left elbow was torn up badly enough to need stitches, right elbow bleeding everywhere, and eventually I discovered that the crash fractured my pelvis. Fortunately I was wearing a helmet and didn't have any head, neck, or spinal injuries. I've been bike commuting for several years, this isn't my first rodeo. The driver stopped, said, "Oh my God I'm so sorry.... I know that doesn't help. Do you need me to call someone?" I asked her to call an ambulance while a good Samaritan who had witnessed the whole thing retrieved my bike from the street and placed it near me. The good Sam told the responding officer that the female driver was in the wrong and she provided the officer with her information. I was then bussed to a local hospital, but upon discovering the pelvic fracture they had me transferred to a trauma center an hour away in Salinas. I'm here until at least Monday while they determine if surgery is necessary. Living in an assisted rehab facility is in my future as I live alone in a house with stairs to both entrances. Fortunately I can do most of my job remotely but I expect to lose wages and there's going to be a lot of physical therapy and check ups down there road. I have a case file and the officer took a report from both the negligent motorist and the eye witness. I don't want to sue her into oblivion but I also expect her insurance to compensate me for the astronomical hospital bills I'm accruing, my lost wages, and the damage to the bicycle. We've talked with every tenant resource Oakland has to offer. We do not qualify for most free services which is why we're seeking legal counsel. Our idea was to send an email to both the landlord and owner that we would be willing to put the rent in escrow contingent on our lease hasn't been broken in any way. I do not know how we could not be evicted at this point. It's also worth noting that my original landlord is putting pressure on us to make the payment today and is being firm that we owe money. He then recommended another business out of state to fix the suit but out of my pocket. Now at no point have I singed anything or paid any money, just an email saying he will send me the final bill once suit is complete. Posted: 15 Jun 2019 11:06 AM PDT A year ago I took my 2014 Ford Fiesta ST in to a highly recommended shop to have a new 6 speed transmission put in it. It drove like brand new. The owner of the shop did the work himself on it. I drove it for a little over 2000 miles before cylinder 3 started to have misfires. I checked out the ignition coils and the spark plugs. It wasn't from them. Then I checked my oil catch can to check for coolant in my oil. it was clear full of coolant and little bit of oil; head gasket was blown. I let it sit all winter until this spring. Ford is putting a brand new 1.6 liter EcoBoost in my Fiesta ST under a head gasket recall. Ford found that the car repair shop that put in the new 6 speed transmission in my Fiesta ST put the clutch in backwards and actually started up my car with the clutch installed backwards. The rivets on the clutch are all ground down, the flywheel is scratched and scrorched, the expansion plate is scratched too. they also overfilled the transmission with tranny fluid and they forgot a bolt on the bell housing. Ford has everything documented. I talked to owner of the shop yesterday and he finally admitted to me that he did infact install it backwards and ran my car for 5 seconds with it in backwards. He never told me this fact last year when I paid him $2500 for the work. He just admitted to it when he was busted. How do I get him to pay $1100 bucks Ford is charging for a new clutch, flywheel, expansion plate and slave cylinder plus $200 bucks worth of labor? We do things like sell cookbooks, give presentations, and post on our blog about different food items and recipes. Our marketing department provides all the collateral, and it has concerned me that we do not use real pictures of our "diet" food for the images we display. For example, let's say one page of our cookbook contains a recipe for pancakes. The recipe outlines pancakes made from our protein powder and topped with sugar free syrup. But the picture next to the recipe is very clearly a picture of a large stack of normal pancakes covered in regular syrup, maybe with butter on top. You can imagine countless other ways that this can occur with various food items across various mediums. Is this practice misleading enough to have legal implications? I have always been curious. My job as a bartender and server pays 8.00 and hour which is very good for Pennsylvania but there are some issues with tipping. We pool tips which is fine but whatever manager is on at the time gets a percentage of our cash and credit card tips. I have a feeling this is not legal because he makes a good salary and has benefits while we have neither. The lost percentage of tips adds up because the percentage you get is directly related to how many hours you work total and a manager is on from open to close. I'm just curious if this is allowed. Even though, we used shared money for earnest money and will be paying the mortgage with both of our income. Posted: 15 Jun 2019 08:35 AM PDT Hello, so I posted awhile ago about how my landlord sent me an eviction letter because we failed to properly re-certify our housing. (Long story short, I submitted all the correct paperwork before my trip outside the country and upon returning, it turns out that more paperwork was needed and because I wasn't there to respond, they were going to evict me for it. I received multiple letters from a law firm telling me about this eviction status as well.) Ultimately, I got all that resolved with my landlord and the correct paperwork and everything has been received. The last I spoke with her, everything was on good terms and there was no hint of eviction at all. Concerning the law firm, the moment I saw those letters, I immediately called them and one of the attorney's told me that I should be all set if everything is resolved by the landlord. He specifically told me that he's going to call and double check and if he doesn't call back, that means that I am in the clear. Never heard back from him so I assumed I was good to go! Two months later, I receive a court date letter telling me that I have to appear before a judge because of "failure to vacate pursuant to a lawful Notice Terminating Tenancy" and the plaintiff is the same attorney!! I really do not have the money to afford a lawyer for this case; is there anyone who would be able to give me some advice for this? Would I be in the clear if I showed up to my court date and just explained my situation? Another note is that I do have evidence of the conversation that I had with that attorney because I use this back-up app on my phone that apparently also records calls. After digging through all my call logs, I did find a recording of our exact conversation. I live in the state of Massachusetts; would it be illegal to use this in court/would I be able to just use my voice and cut out his voice just so I have evidence that I did reach out? Difference is, I return their mail, whereas they have not. I don't have proof of them stealing my mail, I'm just assuming cause I usually get their mail. I know most of you will tell me that them opening and keeping my mail is a felony and that I should go make a police report; however I have no proof so I'm not going that route. She knew nothing about disability, etc. She shrugged her shoulders and did nothing. She waited until my last day May 17th to tell our regional manager I was having surgery. Disability told me to call and apply for fmla as well. (I called them prior to surgery to start the process) My manager then told me I'm not eligible for FMLA because we have less than 50 employees within 75 miles. So I didn't bother with calling. Disability approved me. I pay for my own disability offered through the company. I had to give my manager a rough estimate of time off before they made a decision. So yesterday I get paper work for leave of absence. I've been off work close to a month. It's due by the 18th, but my post op appointment is the 19th. My doctor needs to fill out parts of it. I return to work on the 24th. I also don't have a scanner, fax machine. Why am I just now getting this? What to do? Isn't this supposed to be filled out way before? My mom took him to court to get full custody and child support payments. He never showed up to court and my mom got full custody and he had to pay child support. 2 years go by and apparently he stopped paying any payments to my mom, so he got his licence revoked. My mom and I moved to the USA for 5 years and he still never paid. 13 years later he contacted me through facebook and I said hello, I was hoping he changed but, he instantly started talking trash about my mom so I blocked him. 7 years after that I am now married and have a baby, my mom is happily remarried and we have great lives! We really don't care about my bio dad and have moved on a LONG time ago. Just yesterday my mom got served. My bio dad owes 50k and doesn't want to pay. So he wants to take my mom to court saying I am not his daughter. After 25 years he now wants to claim that. In the papers he lies a ton, he says I contacted him and said he isn't my father, he said my whole family moved to the USA for 15 years when he tried to contact us, not true, we were there for 5 and it was just me and my mom living with my aunt . He said that my moms boyfriend who she dated when I was 10, is my real father, he's not, he was white and I am clearly fully black. He also said that he never did a test to see if I was his child long ago because paternity test didn't exist when I was born in 1991. (I was born in 1994, he clearly doesn't care lol) My mom and I both have no idea about law, all we know is Canada not as strict as the US on child support payments which sucks, and my mom feels like he should pay all the child support he owes. My mom struggled a lot financially when I was younger and it hurt to see and my bio dad was pretty well off. The payments he should of made would of helped us tremendously and she doesn't want him to get away with not paying, also I feel like It might be too late to get him to pay because I'm 25. Car got towed from my own apartment complex Posted: 15 Jun 2019 10:19 AM PDT Hi all. A few weeks ago I got in a fender bender, and I have been driving my moms car since my car is in the shop. I have been parking in my apartment complex' visitor spaces with no issue until now. The visitor spaces require you register your car on an app called Pass2ParkIt, which I have been doing successfully. Until last night the app was working fine. However, last night when I went to register the vehicle, I would input my information and hit submit and the app would crash and kick me back to my home screen. I tried several times to get it to work, but each time I was kicked out of the app. It was late and I figured it would be fine for one night, so I went to my apartment. This morning I come outside to go to work and my car is gone. I called the police and they said it has been towed. So my question is do I pursue my landlord to reimburse me for the $200 that I lost to get my car back since the app wasn't working? What should I do, because I don't feel like that's fair. The towing company said I have to pay no matter what to get my car back, and thank god I got paid yesterday. I really don't want to take the loss because I'm a college student and that $200 was for my utilities and groceries. Any advice would be appreciated, and I'm in Austin TX if that helps. USPS damaged freshly poured driveway [GA] Posted: 14 Jun 2019 04:17 PM PDT Just going to keep it short. We had our driveway completely dug up and re-poured. We taped off the entire driveway, put up a sign, and that didn't stop the mail lady from walking up a part of the freshly poured driveway and plopping a package right next to the garage door... The driveway was 5 or 6 hours into hardening. There is a noticable square where the package was left (the surfaced was brushed to look extra beautiful). The driveway was clearly wet, clearly labeled and taped off, and even sorta smelled wet if that counts. The USPS tracking number also says the package was delivered next to the garage. Urgent - Hair Salon Forcing Employees to Sign Contract Today Posted: 15 Jun 2019 09:44 AM PDT Somewhat urgent matter. I work for a hair salon in Roswell, GA. We came into work today and the owner is asking us all to sign a contract essentially stating that if we do not provide do not provide at least 10 days notice before quitting, we will be charged for the services that we were booked for. For example, if I was booked for three $100 perms - I would be charged $300. Everyone is freaking out, we think this is illegal, we've been informed that failure to sign the contract TODAY would lead to immediate termination. The contract is 7 pages long and I would like my dad to review before signing anything but they're being very difficult. Maybe i'm not reading this right but I just don't have time to review the contact. Please help, what should I do? I cannot afford to lose my job. [link] [comments] |
