Former grad student, considering suing my university for $14k unpaid wages (Texas) Posted: 01 May 2019 06:29 AM PDT Long story short, I completed my graduate degree back in December and my graduate advisor still owes me $14,000 in unpaid wages for the work I did in their research lab during my last year of grad school. This professor paid me what they promised for the first few years, but then they stopped abruptly. The excuses for why I wasn't getting paid kept building up and changing over time, and as soon as I was on my way out the professor started stonewalling me, on multiple occasions literally just walking out of the room when I tried to talk to them. During the year where I wasn't getting paid, this professor also intentionally sabotaged my efforts to find work elsewhere. They lied about me in emails and over the phone with other professionals in our relatively small field of work. Multiple people in and out of the university contacted me and told me "Hey, I thought you should know this is what Dr. Professor said about you, and I know that's not true". I contacted the dean of my college, and they referred the matter to university legal affairs. I gave Legal copies of emails and written notes from face-to-face conversations where I was promised a salary, they asked me to come in and talk to them, I did, and then they did nothing. I informed them that this professor has done this to at least three other students over the course of at least five years. One of the other students had to drop out because, unlike me, they didn't have any external funding. I gave them piles of documentation, much of it taken from the university's own records, showing how the professor had falsified financial statements, employment records, grant proposals and reports, how the professor was paying students less than promised or nothing at all and using personnel money to buy equipment because they intentionally underestimated their equipment costs to make their grant proposal seem more competitive. University legal still did nothing. I contacted them again to ask if they needed any additional information from me, if they had planned or taken any corrective action, if they were planning on paying me my wages, no response of any kind. Granted, they have been busy the past few weeks with coaches taking bribes from celebrities, but I spoke to them months before that. As far as I know, at this point my only option is to just sue the university directly. They have a massive legal department and they've argued in front of SCOTUS multiple times in the past few years, so I have no idea if or how I should approach this, but the simple fact of the matter is that this professor owes me $14,000 in unpaid wages, I have written statements promising me that amount, they slandered me in professional settings, and they're lying to the university and the federal government about how they're using research funds. What are the odds of suing a top-tier public research university with a multi-billion-dollar endowment and coming out ahead? I'm in Texas if that's relevant. [link] [comments] |

Late last night, I was in the shower when my little brother called for me to pick him up from theatre. I declined the call, and used siri to text my mom "I can't pick <brother> up, I just got in the shower." However, siri picked up as "I can pick <brother> up". I was in the shower like I said, and I didn't have my glasses on so I couldn't see that the mistake had been made. Confusion ensued and my mom, mad at having to get put of bed to pick him up, told me fine. From here, it led to my mom's fiancé going to pick him up. The next morning, I wake up to the sound of him yelling at my mom. The next thing I know I hear him storming up the stairs. Instead of knocking on my door, he kicks it open, taking off the metal part of the frame and cracking the handle side of the doorframe down the middle, and denting in my door. He then rushed towards me and screamed at me, saying he was going to break my face, spitting on me, while I tried not to provoke him further (my fancy way of saying I cowered away). I couldn't say anything to him, or try to clear up the misunderstanding, because he would have likely really attacked me if I did. He then left, but came back up again to measure my door before leaving the house, saying that, yes, he is leaving, and it was her kids that fucked it up. This is happening after some time in the past, he was reacting to something we were using to clean our clothes and instead of going to the hospital to find out the cause, he blamed it on my other little brother and tried to choke him out. He has also ripped the first little brother's shirt off of him while he was wearing it, stretched out one of mine when he grabbed it, though I went along with where he pulled to avoid the shirt ripping. My mom blames this one on me, acting like I provoked a natural disaster, because of course any person would react that way to a misspelled text. I am 18 years old and my little siblings are 16. I am going to report all this finally to my school, because I'm done living in fear in my own house, especially with AP exams looming, and regular finals to follow them. My account didn't have that much money, but since it was put through as a tip the original charge of $30 which went through changed to $5,041.75, which put my account at negative a couple thousand. I went down to the police station, which is located right down the road, and explained my story to the cop so he can file a report. He said he's known the owner for years and was gonna go down there and sort it out. I get a call a couple hours later that he's willing to refund the $5000, but I said I still wanted to press charges. The officer said I literally can't "as long as the other party is willing to make good." So i'm wondering here that how the fuck can someone try to rob you of 5k but its totally cool that once he's caught that he's sorry and will give it back? I was refunded the 5k to my account, but now I have a shit load of overdraft fees because I use PayPal to pay for my recurring payments (phone, spotify, HBO, etc.) Every time PayPal attempts to charge me, my bank tacks on another $35 overdraft fee. I've already been to the bank and opened the fraud dispute, but I only received a letter saying it'll take 60 days. I do not drive and i'm dependent on uber/lyft to get to work and I can't use that with a negative balance and my phone is about to be shut off because of this. I have no legal experience and am going to school out of state so I've been dealing with this all on my own. The replacement fees are $1300 and she told me she would only pay for half because I'm half responsible because I left them on my nightstand and he jumped up on my nightstand and ate them when I was not home. Which is so ridiculous, the dog is not my responsibility. She signed a contract to keep the dog on campus saying she is "liable for all personal property damages" I brought this up to her and she said "I don't care what I signed" so I filed my small claims yesterday and she is being served tomorrow. I'm super nervous about the whole thing and it has been causing me so much stress. Any advice would help of what I should bring to court etc...I'm already bringing my ruined retainers, the contract she had to sign to keep the dog on property, and the treatment plan for my new retainers. They stated that they'd be taking roughly three feet off of the top. This made sense to me, as there are also power lines that run along the back of my property. I oblige because I know that whatever damage that is done to the line in the future is my responsibility if it involves my trees. Fast-forward to tree topping day. I return home after work and go to look at the job that had been done. The company that they had contracted cut the trees down to stumps. Four of the five 50+ year old Degroot's Spire Arborvitae. Gone. These trees had been here before my Mother purchased the property 31 years ago. She had 4 kids from previous partnerships, 3 girls and 1 male. The male started sexually abusing me not long after I moved in. I was 10, he was 14. The step mother walked in on it once, him holding my hands against my back as I was very obviously distraught and crying. She sent him upstairs and told me not to tell my father or I'd be sent back to live with my grandparents. So when it happened again, I went to her. She slapped me across the face and yelled at me to stop lying. I never told anyone else about it, ran away at 14. Never looked back. They broke up for unrelated reasons not long after, I rekindle the relationship with my father but never talked about it. No one in the family knows it happened but me and the mother. When I'm 18, I overhear my father and the step mothers eldest daughter talking on the balcony about how the son got slapped with statutory rape charges of two minors (14 & 15) but it got settled out of court. I'm now 23, he's once again been charged with aggravated assault, assault with a weapon and violation of a minor to the second degree. My father asked all the girls if he had ever done this to anyone, we all said no. I don't have the heart to tell him the truth. My question: is there anything I can do legally to make sure this case doesn't just fade like the last one? Can I testify against him? Start my own case against him? Anything? I know I fucked up by not reporting it sooner but I was scared, defenseless and alone. If I had known this was going to be an ongoing pattern, I would have done something sooner. So my insurance is going to sue the guy for the cost of the repair, my adjuster is not pleased with the situation. He met me at the auto shop a couple days after the accident, and he was just shaking his head all the while saying "this is so freaking stupid...a train horn?! REALLY!?" Right now I am looking at $7,400 worth of damage on my 2017 S60 T6 Volvo. I love this car and am so pissed that it has been in an accident! Tiny Dick Truck Douche actually had his car towed and impounded because he disabled the factory horn, therefore according to the police, his car was "lacking basic safety equipment required by California law" and was not "road worthy." Petty I know, but oh so satisfying! The main responding cop called me this AM to tell me all of this, and that I, along with the guy I hit (he did indeed hit car #3) will not be ticketed. They concluded that involuntary jerk of the wheel due to hearing a train horn next to our cars was what caused the accident. We will likely be summoned to court to testify against this guy in some kind of criminal trial. The cop went on to tell me that wrote him up for everything he possibly could. Cop gave me a brief rundown, I do not remember it all, but his exhaust was illegally modified, he did not have mudflaps, his tint was too dark...sounds like they went through his car with a fine toothed comb. They gave him a couple other tickets pertaining to being the cause of the accident, basically loud horn disturbed the peace, creating unsafe driving conditions, etc. So apparently this guy is "known" in the area. Calls have been made before about a dark colored, lifted truck making a loud horn noise, and the cops know all about him. This seems like it was their chance to finally nab him and his childish antics. Don't know what is going to happen to my insurance rate, but at least no points on my license! My 16 year old daughter is profoundly mentally ill - as in, under treatment since grade school, spent some time in residential treatment, Will very likely not graduate HS and most likely will qualify for disability all as a result of mental illness (although cognitively very smart). I suspect she may be attempting to get pregnant - there are a whole host of reasons I suspect this that I won't get into here. My question is, in the state of Indiana, can I force birth control on her? She currently takes the pill to regulate her period but it's not foolproof and as much as I try, I can't monitor her taking her meds every single day. I'd like to put her on the depo provera shot to ensure she can't get pregnant. Or even an IUD, maybe. Can I do this legally? Additionally, if she did get pregnant what are my options? Obviously I wouldn't compel her to terminate the pregnancy but she is not fit to raise a child and I don't want to. As a minor, could I force her to give the baby up for adoption? I know these are terrible questions. I feel sick even asking. But I'm really afraid of her putting herself and a child at risk because she's not capable of employing good decision making skills. I waited a while to gather my thoughts after receiving the gun and was able to have a true heart to heart with my mother a few weeks after all this transpired. She thankfully understood my point of view and cleared up some things for me. I figured my brother had conversed with her before buying me a gun, but turns out he didn't. My mom just had a very good suspicion that's what he was going to do. We went back and forth for a while about my brother's intentions and how he genuinely hurt me with this purchase, and she agreed he crossed a line. She said she would talk to him about it (I'm not sure if she actually did that or not) as she realized this went past him getting me a bad gift and got more into the "making someone uncomfortable for their own gain" territory. He has yet to apologize to me and since then we've maybe spoken face to face two or three times. I'm also happy to report that when my brother moved out, we didn't realize he left his (smaller) gun safe, so the pistol was able to be stored securely where I wouldn't have to worry about it. This has also really opened my eyes to gun laws in my state, which while that wasn't entirely the intent of my original post, I'm glad I at least learned that from this whole fiasco. Thank you to everyone who commented on my post months ago explaining the laws to me in an easy to understand way, some even going to lengths to explain how to go about selling the gun to a pawn shop as well. That really put me at ease over the whole situation. I also want to thank the kind people in the BoLA thread (finding that was a surprise!) who supported me. Having strangers rally around you when your own family doesn't agree with you really helped me feel like I wasn't alone. My mom decided to give me cash for the gun, which I spent on concert tickets to see a group I've wanted to see for years this weekend (an actual appropriate Christmas gift) and she will be giving my dad the gun for Father's Day. They both have concealed carry/have knowledge of guns and like to shoot when the weather is nice, so I'm glad at least someone will use it and appreciate it as a gift. And to be fair, the thought of my dad going shooting with a tiny light blue pistol is kind of funny. I was added as an authorized user to two credit cards, what should I do? Posted: 01 May 2019 08:56 AM PDT Apparently I have been added (without my permission) as an authorized user on 2 credit cards. their combined balances are over $10,000, in addition these accounts are delinquent and putting derogatory marks on my account. I called the corresponding banks who said there were no such accounts tied to my SSN - but they appear on Chase's Credit Journey report. They have multiple late payments / closed with balances. I am rather unhappy about it. There are three accounts which are currently being marked delinquent with 3 different banks - none of which are accounts I have control over, only two appeared via Chase's credit report journey with any tangible information (partial credit card number and balances). I contacted all three banks, they say there is no account associated with my name that is delinquent. The bank without an authorized user has marked me delinquent 3 times, transunion and the bank in question refuse to do anything about it. Before you suggest a different person is being reported on my account: I have a very unique name, possibly the only person in the States with my first name, definitely the only one with both. This seems intentional. The other two have finally been reported because they're finally appearing on my actual report with balances. I contacted transunion, filed a dispute, put up a freeze and fraud alert - but what can I do?

My girlfriend's 4 year old daughter is asking to take sexual pictures. Posted: 30 Apr 2019 06:44 PM PDT Over the last couple of months, my girlfriend's daughter has suggested to her mom and again to her grandma to "take pictures of [her] privates". I have also seen her spread her legs and say to take picture. When asked why she says these things she shuts up and doesn't answer. Last night she again said to take a picture of her privates and when my girlfriend asked her about it she mumbled something about her stepmom being mean. This was Sunday night after she had been at her dad's for the weekend. The only other places she only goes to daycare and to her father's house. Her father molested a 9yo girl when he was 15 and is an all around PoS (dodges child support, etc.). My girlfriend has contacted CPS before on the father, but her daughter is young and didn't talk with the counselors. The father is a loose cannon and we are honestly afraid of what he might do. Our worry is that if we go to CPS that her daughter won't speak with them and they won't be able to do anything. Our plan now is to get her into counseling so she can become comfortable with another adult and hopefully they can help her talk about what is going on. Is this enough evidence to go to the police? So there's nothing at the courthouse that would change the result. They haven't built any structure or driveway, planted any trees, etc, but they have been mowing across the line for the 4 years since we purchased the property. Do I need to be worried about adverse possession, or squatters rights, etc? They have twice come across the line in the woods at the back and put up new markers where they say the line should be, which I have torn down after taking pictures. The survey was completed about 4 months ago. The people that live there (the ones putting up the markers) are renting/under land contract, and the property owners are out of state. Posted: 01 May 2019 06:41 AM PDT Having applied for a job in my desired field in China (I am from the UK) and later getting offered the position, I am now at an impasse after receiving a visa invitation from the employer. The problem, as I see it, is that I have been given an invite for a business (M) visa, and not a work (Z) visa. The foreign office (UK government) website clearly states you cannot work in China without a Z visa. My prospective employer explained that I may not qualify for the Z visa, and as such has proceeded with the M visa invitation. I have been told that essentially I would be payed through work arounds which I'm also told are fairly common in China for foreigners. Teachers were cited as an example. I have no idea if this is the case. Another supplied option would be to work in China at this business, yet be employed by a foreign company. Similarly, I don't know how this would work, or entirely what is being suggested. The employer has openly used the term "grey area" which further heightens my concerns, and said I cannot officially be employed yet has given me a contract. I believe this may also affect my ability to make disputes with the employer, should I ever intend to do so. The job greatly appeals to me and would be an excellent step in my career that I don't believe is open to me at this stage in my own country. However, I have no intention whatsoever of getting on the wrong side of the Chinese government, or doing anything illegal. Whilst I do plan on continuing discussions on the matter with the employer, from my perspective, sadly, I think I will have to pass up on the opportunity. I would like to know if what is being suggested is illegal, and whether there are any compromises which remain within the law of China. I'm currently in the last month of a lease and my landlord had been showing my apartment with little to no notice. 3 times I have woken up to a leasing agent and a stranger in my bedroom checking out my apartment to be leased in the future. Granted it was within reasonable hours (9 AM), however there wasn't reasonable notice or expressed permissiononnmy part. One time only they had sent me a text saying someone will be there in 10-20 minutes and they were there in 5 minutes. Other than that I have woken up to them walking in and no notice prior at all. I do no believe this falls under reasonable notice, as the law states. My landlord claims they can walk in without notice if they want but they just give me a 10-20 minute heads up as a courtesy. Once thing I've noticed about my lease is it says "There have been no verbal agreements made. Any Any promises between both parties have been put into writing & I have received my copy of additional agreements" Of which I initialed. Does this mean the implied covenant of quiet enjoyment is modified or waived? Or is state law now waive-able in this situation. Once we broke up I decided to pay the remaining balance of my car to completely sever the ties I had with my ex then I found out that my loan provider had been charging me around $70-$100 a month for insurance on the vehicle for about 3 straight years because, according to them, they were never notified that I actually had insurance the whole time, so as long as I provided proof of insurance for those years they would refund me those charges, totalling about $3k, plus throughout the process I remember asking the representatives that they needed to make sure that the money had to be sent to me not the other person that was on the loan with me and they agreed. Except they didn't and now my crazy ex has a check worth 3k that belongs to me since he never paid a since cent for the vehicle but because he cosigned it he thinks he's entitled to at least half of that money. I have called the bank in hopes that they could cancel the check or something like that but they said that apparently they had designated my ex as the primary on the vehicle and that the money had to go to him so there's nothing they can do. I was awoken to a phone call from the front desk that my car had been severely vandalized and that the police were already there. They managed to catch on camera some chick smashing my cars front windshield and back window with a large rock. I told the police I don't even know her, or anyone here for that matter. They constantly insinuated that I had pissed someone off. Management let them into the room that the woman went back to, and while no one was there and they didn't feel comfortable searching the entire room, they took a cursory glance and found scales that they assumed were for weighing drugs. This turned into them insinuating that I was involved in some sort of drug dealing with them that had pissed someone off! I continued to deny all of it and even offered to go to the station to take tests to prove I was clean. I told them I wanted to press charges. They gave me a case number and told me they'd contact me if they caught her. A witness to the event got the woman's tag info. The man that was actually renting the room was evicted by hotel staff for his associate's behavior. A day after the incident He called back later to see if they had something he had forgotten and that's when he said his girlfriend was crazy and probably thought it was his car. I'm now over $1k in the hole to have my windows fixed, and that kind of money is really crushing to me. Insurance doesn't cover it, liability only. Hotel has "were not responsible for your car" signs on the outside that management says dissolve them but I haven't talked to the hotel insurance people yet. Do I have any legs to stand on, or am I stuck waiting for the cops to catch some crazy lady they likely won't even look for and who doesn't likely have that kind of money anyway? Everything was fine. The girl that hit us has Travelers insurance and they were acting super nice like they were afraid since I was pregnant. They paid our ER bill and damages to the car. A month later they emailed me a release form and said they'd give me $500 to sign it and agree I'd never sue them. I felt uncomfortable and insulted by the low price, considering if something was wrong with baby after birth it could cost tens of thousands. Plus, it's my baby. So I said that I couldn't sign until I knew my baby was healthy. But then last month we got a bill for the ultrasound. We sent it to the insurance company and they refused to pay it unless I signed the release. So, baby is now 1 month old and seems fine thankfully. Should I sign the release and take the 500? If I sign, and something is wrong with baby later, will I really not be able to hold them accountable? Is there any legal thing that says they are obligated to pay the bill since they were completely at fault? In addition, someone else called us to ask if the case was settled because the girl was trying to get points taken off her license through some program. We said no it is not settled yet and that was all we heard about that. Do we have any leverage there? Edit: This was in Atlanta, GA on 85. To clarify, I don't want to sue or profit. Ideally, none of this would've happened at all. I do want to get them to pay for the ultrasound and I thought insurance companies had to cover that stuff if they were at fault. I don't know if it would be worth it to spend money on an attorney. Oh yeah, if I sign the release, they will pay the ultrasound and give us $500. It just feels dirty though. How is this allowed? Posted: 01 May 2019 09:22 AM PDT I'm an adult now and this all came to light recently when I started to sign documents and put my address down, I was apparently suppose to list a different relatives home my mother claims she lives at even though we all live together at my dads address. My mother is disabled and got more money apparently by my father "missing" and I have been informed I can not do anything that implies I live with him or know him as he may need to pay back child support to the gov. Something else to note however is my dads name is on my bank account with me. So either they are not telling me something or well I don't know. I mean he still lives his life and his name is on my birth certificate so if the government wanted to find him it should be easy. My only concern at this point is how this could effect me. Am I in any legal trouble by being associated with this, should I make any changes, I'm not sure at all about the legality of this situation so any insight or advice is appreciated! Neighbor wants me to pay her because her grass is spreading into my yard? Posted: 01 May 2019 02:05 PM PDT A few years back (before I even bought my house) my next-door neighbor had a landscaping company put sod down in her yard. Whatever variety of grass it is, it's doing a damn good job of outcompeting the mixture of random grasses, clovers, and faux strawberries that make up the majority of my yard, and has spread maybe 3 feet inward across the property line. A few days ago, she casually mentions that my yard is looking better thanks to her and that maybe I should "kick in a little for the effort". I thought she was joking, but she doubled down saying that it wasn't fair that I should benefit from the money she spent, and that if I'd give her the cost of one of her sod pallets ($450) we could call it square. She said if I didn't then I was basically stealing from her. My two questions:

My sister abandoned her dog with me and now wants her back Posted: 01 May 2019 05:13 AM PDT Hello all, I started renting an apartment with my sister about 9 months ago to have some financial assistance going to college. Right around the end of December though she stopped coming home without any warning and left me with her dog. I have taken care of her (the dog) since then. Bought all food, treats, and groomings. Taken her for walks and made sure she was socialized and happy. But I'm moving out in a month, and my sister doesn't want me keeping the dog with me. I don't think that she'll get the care and love she deserves going to my sister and I definitely don't want to risk her being neglected again. Do I stand on any legal high ground here? Posted: 01 May 2019 10:26 AM PDT I'm located in Florida. I let my neighbor borrow my motorcycle about a year ago. I don't ride anymore so I decided to let him use it so it wouldn't rot away in my garage. I even let him keep it at his place... Well, now I'm moving to another state so I'd like to sell the thing and move on. I asked my neighbor to make me an offer and he wouldn't budge from $700. It's valued at $2,000 on KBB and I've seen my exact bike go for about that price on Craigslist, so obviously I politely declined and asked when I could come to pick it up. He refused to give me the bike and basically said that my only option was to accept the $700. Now here's the kicker. When he first picked up the bike he told me that he thought it might need some work done. So I told him to go for it. I said that he could make any changes that he wanted. Well, now he's claiming that he sunk almost $1,000 into it and that I owe him for that work if I want the bike back. On top of that, he's threatening to put a mechanic's lien on the bike, as well! I never agreed to any of the changes he made and his biggest argument is that the bike was unsafe to ride so he had to make the repairs. At this point, I'd like to get the police involved to help me get my property back, but I don't know where we stand on these repairs he made. Did I screw myself over my telling him he could make changes? I never signed or explicitly agreed to any change he made. What are my options here? How can I resolve this?
