    So we have court 4/10 which is actually best case scenario as our house is now sold and we close early May. We passed this by our realtor whom we had supporting documentation of us moving back when we talked to her in May of 2018 stating we were going to move south. She is so awesome she wrote a letter stating we were moving prior to all this happening and got it notarized by the state.

    This should be a slam dunk and the judge will likely ask why are you wasting my time? Her reason for the requested visitation is "she loves her grand kids very much and deserves to be apart of their life" per the law she has no leg to stand on and this is not a valid reason she would be able to get visitation even if she does we are moving and i don't believe NY state can stop that. One last thing about this is the petition she filled out my sons birthday isn't even correct its off by 4 days.

    Court date is 4/10 will update once court is completed.

    Murder in the First Degree (

    November second my big sister was murdered by her husband in her sleep. He is being charged with pre meditated first degree murder I believe. Soon I have to write my victims impact statement. I need tips and a general how-to on it. Because I'm not really sure :( please help me

    (VA) Employer making me use ALL my vacay time to make up for Jury Duty

    So, I have been summoned for federal grand jury duty (lucky me) for the entire year. I have to report to court 3 days a month, every month for a whole year (36 days for the entire year). I work for a small inc. company, with about 12 other employees. My boss just told me that I have to use all my vacation time towards Jury Duty, and after my hours are all used up, I would have to work it out with them to make up those hours (weekends, evenings, holidays) for the 40 hour work week.

    I told them to not pay me while I go to Jury Duty (I have plans to visit my family at the end of the year in another country and I would like a vacation) but they made the point that it is not fair to the other employees because that would mean that I would be out the 36 days for jury duty plus my vacation. They told me that option is not possible.

    But they think it doesn't apply in this situation because I am doing FEDERAL grand jury, not VA jury duty. And since their business is very small they don't think it applies to them?

    I am very confused, but are they allowed to do this? What can I do? I would prefer not to get paid and keep my vacation hours. Just because I am not working for them those 3 days, doesn't mean I am not working.

    Locked in a Sam's Club store

    As the title says, earlier tonight I found myself locked inside a local Sam's Club when the employees left and I was trapped inside a small room in the receiving area.

    LOCATION: California

    I work for a company that does sales sometimes inside of Sam's. I do not in any way shape or form work for Sam's/Walmart.

    Anyway, the employees and floor manager were all aware that I was present and had been authorized to remain at the store after closing in order to prepare our unsold products for shipment.

    I began to move my company's products on pallets to the receiving area at around 6:50 PM. Shortly before this, the floor manager through another employee informed me on behalf of the manager (he didn't have the balls apparently) that if I did not leave by 7PM I was liable to be locked inside the store. I passed along the message that I had been delayed while trying to locate pallets and shrink wrap that the Sam's Club employees were supposed to provide but I would do my best to be out the door by/before 7.

    By about 7:02 PM I was hauling my last pallet to receiving and readying to leave, but I could not locate any employees by this time, it seemed to me that they had already left (I walked across the entire store and did not see anyone).

    By 7:11PM I had photoed my pallets and clocked out. I went out the rear exit, but to get to this door I had to walk through a small room called the "Trucker's Lounge" which is about 7x8 ft and contrary to the name, does not contain any chairs for lounging. There was a door from the receiving area into the "Lounge" and a 2nd door that lead to the outside. I reached the exiting door and found it deabolted, but a little too late I also found that the door that would lead me back into the receiving area immediately had shut, and locked automatically.

    So I found myself trapped in this small space. I called my manager immediately, they in turn tried reaching the store employees by calling the store's main number, obviously this was futile because the store had been closed over an hour. After about 20 minutes, seeing no other option, I called 911.

    After being in the room about 40 minutes, I realized a big problem, there was no real ventilation, other than a small opening in the plexiglass window that lead into the receiving office. I have climbed high mountains before, one almost 11,000 ft in elevation, so I know what oxygen deprivation feels like, and I began to feel it, and it began to get severe after about 45 minutes.

    Two policemen and a fire truck I was told were on the scene, but they first wanted to try and bring in the manager so they didn't have to literally break down the doors. Luckily, they were able to. In all, I was in the room about 1 hour, 7:11PM-8:11PM or so.

    All this time, I was using the flashing mode on my very bright tactical light, shining it through the windows towards the interior of the store. I also was using the back end of the light to hit the metal doors, quite hard in fact. The floor manager later claimed he had checked the store thoroughly and assumed I'd left, but I feel this could not have been the case given the racket I was making and the bright light I had been shining into the store.

    One of the officers has told me that can't press charges for negligence or something along those lines, that this would be a civil matter. Is this accurate? I am really curious to know what options I may have, I am not out to "sue the pants off of them" I simply want there to be a reckoning, an owning up to what happened.

    Doctor Won't Give Me Copy of Results

    In January, my doctor performed a test on me. He told me the results right away and diagnosed me. An order was made to get this medicine. My condition worsens. The insurance denies the medicine. I find out why. The copy of the report with numbers and graphs was not legible.

    I call them up and ask what is going on. They tell me that the printer ran out of ink, but they filled in everything with a pen.

    Finally, a copy of the report as is is sent to me by the place that would be administering the medicine. The report is illegible. Only one column of missing numbers were filled in. The rest are not filled in and the graphs are missing all lines between the x and y-axis.

    I call back. I ask, "Can't you just print a new copy?" The receptionist tells me, "Actually, the printer is broken."

    It's incredulous to me that a printer on a specialized testing machine could be broken for two months. How could a doctor's office be able to function without this?

    Meanwhile, my doctor did a one on one consult with a doctor at my insurance, which I was also informed of the details by my insurance company. My doctor said nothing to make a case for me.

    The insurance denied it again. Is this medical malpractice?

    USA- a couple months ago I drove under this bridge and an unknown object fell on my windshield, shattering it, i lost control of the vehicle and crashed into a barrier. Today, part of that bridge collapsed, due to fault in the bridge’s construction. How do i find out if it was part of the bridge?

    The police could never find the object that fell on my windshield. Which if it was some foreign object like something someone had thrown At my windshield, I think they would have seen it. However, if it was a part of the crumbling bridge, maybe they would have missed it because it just looked like a random piece of concrete.

    The accident totaled my car and sent me to the hospital. Then the state charged my insurance several thousand dollars for damage to the barrier.

    Do I have any way to find out if it was part of the bridge that caused my accident? It just seems way too coincidental that some random object fell on my vehicle in the exact same spot that the bridge just collapsed.

    Edit: the bot says i need more location info. Tennessee, USA.

    Also, to clarify, my car was older so I didn't have full coverage on it so I did lose the value of the vehicle out of pocket. But mostly I'm just really annoyed about the whole thing because a random object fell from the sky and it was absolutely terrifying and I've just wanted to know what happened.

    Employer using tips to balance out deposits at the end of the night and editing employee time

    Located in Florida. I am a manager at a franchised ice cream place. I report directly to my district manager. We have to report whenever our deposits at the end of the night are over or under x amount. When the deposits are significantly under she tells me to "take it from the tip". I am never comfortable doing this because it doesn't feel legal nor right. I have asked her if it is legal and she said "Of course they made a mistake so we take it from them!"

    Is this even legal and how else can I approach if it isn't? Also, me being the manager and actively taking the money from the tips to fix the deposits does it bring me into some legal trouble as well?

    As for the second question, I am also instructed to edit time of the employees, by 1-2 minutes if they leave late or don't take their break in time. I know this is not legal and brings me to the same question as to will I be in legal trouble if someone blows the whistle?

    (WI) landlord wants us to pay for their turnover time

    We just bought a house and are in the process of moving out of the apartment we had lived in. Our lease goes until 4/30, our landlord has asked us to be be out two weeks early (which we can do) but then has asked us to pay for the entire months rent and maintain liability for their two week turnover time so they can rent it out on 5/1. In my mind, if we are being asked to leave early on our lease, we should only the partial months rent and be released of liability, but this is not my area of expertise. Any help I can get would be awesome!

    Oregon. My sister was married to a woman. They split up. Before the divorce was finalized she got pregnant with her now boyfriend's baby.

    Her ex and her took awhile to get divorced and in the meantime my sister met a guy, they started dating, and she got pregnant.

    She recently had the baby and her boyfriend was filling out paperwork at the hospital and put down that my sister had been married when the baby had been conceived.

    The hospital wouldn't let my sister put her boyfriend down on the birth certificate because Oregon law says that if the wife becomes pregnant while still married the "husband" must be disestablished as the father before the actual father can be put on the birth certificate.

    She said she emailed someone in vital records about it and they sent her a link citing the law about adding or removing a father and that she has to hire an attorney to draft papers to petition the court.

    But this all seems ridiculous because her ex can't be the father of her baby as she's a women. Is she getting accurate information.

    Our tenants demanding 500$ a month rent deduction

    Hi, I am in Ontario Canada and our tenants are demanding a 500$ rent deduction due to a leak from the center of the living room Ceiling. It leaked once before they moved in. We thought it was from the unit above but then determined it was from cracks from the condo buildings foundation (determined by a third party engineer) The condo board and property management company are really giving us the run around to fix this issue since it will be quite costly to the building. My questions are.

    A) Do our tenants have any legal legs to stand on to demand such a rent cut, and withhold paying the current amount.

    B) what are my legal options with regards to getting things this problem taken care of faster with the condo/building management.

    C) Can I hold the condo liable for loss of rent from our tenants.

    Any insight is appreciated and if I am in the wrong spot. Please point me in the right direction. Thanks.

    Kicked out of an apartment

    Our apartment complex recently requested us to be out for some repairs for 7 days, but now they are extending the time frame for another week. They also changed the locks in our apartment complex and basically made us surrender our belongings in the apartment while they fix it. The roommate and I asked for prorated rent or some compensation while we've been gone but they responded us with this copy and paste from the lease:

    "page 2, section 15) the rent shall not be abated nor shall other compensation be claimed or allowed for inconveniences or discomfort arising from the non-operation of any equipment or utilities or from repairs or improvements made to any building equipment or appurtenances, nor for any space taken to comply with the law, ordinance or order of governmental authority. In respect to services herein expressly or implied to agreed to be furnished by Lessor to the Resident, there shall be no lessening of abatement of rent or any other compensation for interruption or curtailment of such services when interruption or curtailment shall be due to accident, acts of God, strikes, alteration or repairs, desirable or necessary to be made, or inability or difficulty in securing supplies or labor for the maintenance of such services or to any other cause."

    I should mention that we gave them probably more than 60 days to make these repairs, and we do have renters insurance.

    Just got a promotion to "manager" small raise, job duties have not changed, but now don't receive tips?

    Posting for a friend, on mobile, sorry in advance for typos!

    My friend recently received a "promotion" at his job that serves food to customers. His job was specifically tending the cash register, making the food, and delivering the food to customers. He and the other employees split the tip pool at the end of the week with those who worked. All of the employees were making full minimum wage, not "tipped" wage.

    His promotion gave him the title of "manager", small pay raise, but none of his job duties have changed. He still does the same thing but now does not receive tips. I was under the impression that if any employee worked a position where the customer tipped you for your service they would be entitled to those tips as well for those hours worked, but all of the documentation I can find list managers as not receiving tips because they "work in the back" or "are a representative of the employer".

    Is this legal? Or is he just as entitled to those tips as before? He now effectively makes less than before despite the pay raise (because of the lack of tips) while the other employees supposedly under him make more because he's not a part of the tip pool anymore.

    Neighbor's dogs broke into a fenced chicken yard and killed our chickens.

    Hey guys, I'm in a pretty furious mood currently so sorry if this is improperly using punctuation. About an hour ago Mom busted into my room crying and not able to say what was wrong. Now this is pretty rare except for very very bad occasions. From everything I've gathered my Dad went to our back yard to check on our dogs who were barking rather loudly. Now this isn't a rare occurrence considering we live next to a highway and they can hear the vehicles driving by and there are also "stray" not exactly stray but unattended dogs roaming around barking and howling. So dad went out back to check on them only to see three large dogs had broke into our chicken yard slaughtering our chickens. We know who's dogs these are and know that they aren't paid much attention to. One of which when Mom worked at the nearby store would always come onto the front porch covered in ticks, thorns, and matted all to hell. The owners of these dogs just let them roam around and really don't give a shit about them. Sorry about the cursing. Anyway Dad got out and was pulling out the dogs but by the time he got there it was too late. 5/6 chickens were dead and 1 had it's wings and 1 leg were torn to shreds so dad put it down. I understand that they are chickens but they've always been way more than that to us. It's a regular occurrence for either of my parents or I to be out there giving them more feed and having conversations with them and them "talking back" to us. What really hurts though is that they were Easter gifts from my grandparents to me a few years back. My grandmother has been gone for 2 years in this coming August. Mom is still really sensitive about Granny and anything that was given/discussed with her. She also was the one who named them. Anyway before I ramble on anymore is there any thing we could do legally to get the owners to actually take care of their own dogs like people should? We live in Washington State but the laws may be different due to us living on a Native American reservation. Any ideas would be appreciated. By the way this isn't a first offense on these dogs. These dogs also killed the owners grandmothers chickens a few years back.

    Sibling convinced parent to open loan under parents name. Refusing to pay back parent after a few months of payments. ~$100k -CA

    I have a brother who my family no longer talks to due to other issues, but I recently found out that my parents have been paying off a loan my brother convinced them to open under the promise of paying off the loan. Basically my brother had almost $100k racked up in credit debt and wanted to consolidate the debt via a loan my parents pulled out under their name since he kept getting turned down at banks. After 6 months of steady payments my brother has not made a payment to the loan since, and my parents have been stuck paying it off for the last couple/few years. Is there anything my parents can do to get that money back? Or at least have the remaining ~20k put under his name?

    Ex wife’s cop boyfriend won’t let me talk to my children.

    So, my divorce was finalized about two weeks ago. My wife works at a 911 call center and her boyfriend that she's been living with is keeping me from having any communication with my kids. He says that if I want to speak to them I have to email him and arrange the call through him. Also, any emails I send my ex about whatever are automatically forwarded to him. There is nothing in the divorce orders that keeps either of us from talking to the children at any time. He has just taken this upon himself to do. He has also emailed me an 8 page email with pics of me that he made into memes. Calling me a drunk and such. Not the case at all, but that is neither here nor there. Is there anything I can do to keep him from keeping me from my children?

    A friend agreed to pay for my flight using his credit card in exchange for cash. Later I cancelled the flight, airline agreed to reimburse via same credit card. Now airline claims that they have processed the claim, but friend claims that the money was never credited to their card.

(As in, are they legally obligated to pay me back whether or not the money was transferred back to their credit card successfully?) I have no way of knowing whether there was an error in the airline/credit card transaction or whether friend is lying and has received reimbursement.

    Question regarding apologizing to someone I 'victimized'

    I was arrested the other night. I was drunk and my Uber dropped me off at the wrong house, and I was trying to get into a house that was not mine. I live in a neighborhood of identical town homes, so it's not too ridiculous of a mistake to make. In my drunken stupor, I saw someone inside the house. Thinking it was my house, I freaked out and started threatening the person. I realized it was the wrong house and then went home. At my house, the cops came and arrested me. I am being charged with disorderly conduct.

    I really want to apologize to the people that I scared. It was an honest mistake and I really feel bad for freaking them out and ruining their night. Since I have not had my court date yet, would there be any legal reason you would advise me not to go and apologize to them?

    Neighbor might have just planted trees in my yard

    As a preface, the neighbor and I are cool as far as neighbor coolness can go. We have a drink every once in a while, and they were very responsive yesterday when I knocked on the door to gather details to decide just how much to care. No problems with moving things, beyond the ground being a pain to dig in

    The trees that were planted yesterday were 3 flame leaf sumacs, barely knee high sticks right now really. The spot they chose for them looks like it'd be great for those trees, pretty bare (otherwise unusable for anything but grass) and would compliment my own trees. So, I have 2 concerns right now. First is that it could potentially be on top of my water main. I know the pipe wasn't struck in planting the tree, but roots are a minor concern. I plan on calling out the utility companies to get that marked so at least I can make informed decisions on that.

    My other concern is that if the trees aren't on my property, they're within inches of the property line. Is there anything I should be doing from a CYA perspective so I don't encounter any problems when if/when I decide to sell? (from either a "it's fully in my yard", or "on top of the property line and half way hanging into my yard" perspective)

    Neighbors guest hit and run my vehicle

    I live in the state of Florida, I park my car in my neighborhood on the street. I've been parking in the same spot for nearly 6 years and never had an incident.

    Yesterday, 24 hours ago I was on my way to the car and realized someone had backed into it and left a huge dent and side mirror caved inward. Naturally I assumed my neighbor backed into it and went to look for a note or anything and saw nothing. But before I jump to conclusions I like to get all the facts straight before accusing anyone.

    I went to my other neighbor who has a camera facing the street to confirm my suspicions and saw a black SUV parked in the driveway (guest car) that reversed in a straight line into my car and proceeded to leave a few seconds later. At around 7 am that morning.

    Spoke to my neighbor and showed him the clip and was upset she'd just leave like that knowing she did some damage and it's illegal to just hit and run. He said he'd contact her and see what's going on. Rather than me calling the police and having her arrested I wanted to be a good neighbor and work something out because he's a buddy of mine.

    Well today 24 hours later he says she has been ignoring his calls and he's willing to take my car to a body shop and personally pay for any damages she had caused. Because she may or may not be driving with insurance...

    I'm a fair guy, I understand people go through some tough times. I appreciate honesty and if she had the courage to tell me what happened I'd understand her situation and have my company employee fix the car for a small fee. But, she decided to take the coward way out and lives roughly 3 hours north. And flee from her problems, I really don't want my neighbor to pay for the damages and for her to learn a lesson so she doesn't do this in the future to somebody else.

    What are my options and how can I go around with this, obviously she's not intending on calling back and my neighbor has been trying to protect her calling her a friend and won't give me personal details because he insists on fixing the car himself.

    Being Forced to Pay for Things My Parents Bought, "For Me"

    I don't want to sound like an ungrateful brat, so I'll keep this as simple as possible... I'm 17 years old, and my parents forced me to get braces, and now I have to pay for them. The payment is $132USD a month, and they are also making me pay for my dirtbike, which they bought on loan and are making me pay. The rate on the bike is around 1-2% which is nice but I pay $200 a month for it which isn't so nice.

    I don't want to have to sell the bike, it is the only way I get to spend quality time with my dad and also relieves stress, which I tend to build up a lot of and have huge breakdowns over, which I haven't told anyone about, until this post.

    We have a business in which we breed dogs, and that was the source of my income, until they suddenly started saying the money that was being placed in my account is not mine, and when I got low on money, which inevitably happens when you make hardly any money and pay $332 a month for things that you shouldn't have to pay for, they got upset, fired me, and then took my debit card away. The taking the debit card away kind of makes sense to me, but firing me and forcing me to get another job doesn't make sense.

    Here's my main issue. I am not allowed to work Sundays, and I do many many extracurricular activities. I am in marching band, in the fall, and jazz in the spring, and both of these take most of my time up. Jazz is about to end and I will have time afterwards, but currently I am confused on how to find a job and find the time to work where I can at least breakeven every month and not have to quit band, or stop going to church, or stop going to mutual, or the early morning seminary I attend.

    I just made really good friends, about a couple months ago after living in my area for seven years, and I am also worried that I won't be able to spend time with them... I had some friends before but never hung out frequently.

    I have a good work ethic and have over 2300 hours of exercising leadership positions in band, scouts, and my church, and would love to work a real job for once, but I don't know where to start with any of this.

    I understand that most of this isn't entirely legal help but anything anyone can offer would be greatly appreciated. I have also never posted here so I am sorry if I broke any rules, I've only occasionally read full posts here and this is the only place I can think of that may be able to help. (Sorry for the length too.)

    Were my parents legally allowed to give me money, and then force me to make payments on things they made me get, and then say it wasn't my money and fire me? I am pretty sure I worked for that money but I don't know anything about this stuff...

    Edit:

    They wouldn't let me get another job or my license at 16, or I wouldn't entirely be in the boat where I have no money saved or an unreliable job. I'm hopefully getting my license Tuesday, but I still won't have a job yet.

    I am now aware that I will still be doing what they had me doing with the dog business, but for some reason they are going to pay my brother instead, even though he does hardly any work at a horrificly terrible quality. (Thats just a rant note)

    My father is unresponsive and passing away. I’m 25 and the last living relative except for a girlfriend. She didn’t call me for two days while he was in the hospital, so that she was next of kin to talk to, and claims her 3 year old son is his. Unresponsive father can’t deny claim. How do I contest?

    Long story...well, long...my parents were never married but together 10 years, and my dad has been in and out of jail for drugs for my entire life. He inherited a ton from my grandfather, brother and mother are deceased. Has sold off everything and always kept bad company that hung around for money or the next hit and a place to sleep. Girlfriends son was conceived around the time my father was in jail and she was dating someone else. She named him after my father, but even my father wasn't sure about it being his. We coined him the "maybe baby." My dads girlfriend didn't contact me and was posting on Facebook about him. She's told my mother "don't let her sign dnr papers" or do "anything drastic" and she "is getting her power of attorney papers."

    My dad fell in his assisted living center because they put his prosthetic foot wrong incorrectly.

    Hey guys, so I'm going back in forth in my head if I should pursue legal action.

    My dad (75,MN) has lived in a senior living center in Minnesota for about 5 months. Just recently we moved him into assisted living to help him get out of of bed and to get in to bed. He was using a lot of energy getting dressed and putting his prosthetic on.

    This last Friday, he fell and broke his hip walking in his kitchen. He didn't know he broke it. When I went over, he wanted me too look at his leg. It was completely put on wrong and was loose. I did not take any pictures at the time because I did not think he was hurt, just sore. 9 did notify the main nurses that he fell because his prosthetic was out on wrong. They said that the physical therapist was the one who showed them how, but according to my dad, it was the physical therapist who put it on wrong that day.

    We had a physical already set that day for him, and he asked his doctor if he could take an xray. Sure enough, he had a fractured femur.

    He had surgery the nest morning and got a prosthetic hip.

    Is this grounds to sue? It seems like a he said/she said case and I'm not sure if it's worth pursuing. I'm not looking for him to cash in, just to pay the hospital bills. He has only Medicare.

    I punched my dad and I might get arrested.

    Long story short: my parents have been fighting for years. They were fighting. He grabbed her by the shoulders shaking her. I turned him around and punched him. Police in my house interviewing parents. What do I do I'm freaking out I don't know what to do

    Edit. I'm sorry thinks we're happening I didn't know what to post. I'm in New Jersey

    Update 1: police just left my house. I need to know what to do next Incase I need to in the future. I'll answer any questions I can.

    Edit: thank you all for the advice. I hope everything soon works itself out in the best way possible.
