Homeowners insurance cancelled me during litigation Posted: 28 Apr 2019 09:18 AM PDT So last year my neighbor filed suit against me for a dog bite incident. I made a claim with my home owners insurance and they were great about helping me out, hiring a local attorney to represent me etc. That lawsuit is still going as these things take time. Today my insurance company sent me a letter stating they were not going to renew my contract with them at the end of our yearly term which is June 2019. My question is, will me switching to another carrier going to affect the original companies obligation to continue to support me during this lawsuit? I can't seem to get a straight answer from the company anymore. They base their reason for the cancellation (after 20 years as a customer) on the fact I have a dog with a bite history when in fact I got rid of the dog about a week after the incident last year. They can't seem to look past that, they and insist on the cancel. I'd love to stay with them but seems I'm forced to find something else at this point, but I also am fearful doing this is a way for them to part ways with me during the lawsuit. Insurance company claiming excess amount for minor damage Posted: 29 Apr 2019 12:33 AM PDT I had an MV incident where I was at fault, however the damage caused was minor. The other party hit a curb with his front wheel at low speed. At the time, we agreed the damage was minor and he would contact me with the bill and I would fix him up. This was done on a handshake, so no photos or proof was taken. I was driving a rental with minimal insurance. I did not report it to the rental company because there was no damage to the rental, and the agreement with the guy that the damage was minimal, on a handshake. I have now received a bill from his insurance company for over $7K for a damaged wheel. He has claimed front and rear bumper damage and repairs to all 4 wheels. There is also almost $2K in towing fees, however he drove the car off with no issues. I called his insurer and was told that a professional assessor reviewed the damage in light of his and my version of the incident (which were identical) and this is the result. Does anyone have any advice on how to proceed? I have advised the rental company, however their excess is over $4k. UPDATE: Rental company has refused to entertain the issue as I did not report it when returning the car, even though I had a reasonable explanation why it wasn't reported. [link] [comments] |
Will homeowners cover a problem I created? Posted: 28 Apr 2019 03:34 PM PDT My house has a covered back porch. A few weeks ago I installed an aerial dog run using the column supporting the roof as one of the attachment points. This morning I put my dog on the run, she ran after a squirrel in the back yard, reached the end of the run, and the force pulled the roof structure away from the house. It is near collapsing on to the porch. My question is if homeowner's insurance would be expected to cover damage in this case? I installed something, it led to an accident. I had no reason to believe installing the aerial dog run would lead to the roof pulling away from the house. She is a 70 lb dog, good sized but not huge. Prior to this occurring the porch appeared in good shape, no lack of maintenance. Now that the roof is pulled away from the house it does not appear the roof was tied on to the house correctly. The porch was an addition done by a contractor hired by the previous owner. She kept records of all work done on the house and left them for us when we purchased it. So I guess that leads to my second question, even if they accept the claim based on me creating a chain of events that lead to the damage, could they deny it if they decide the structure was not built correctly to begin with? [TX] Insurance required for drivers test? Posted: 28 Apr 2019 01:12 PM PDT My girlfriends son will be taking his drivers test to obtain a drivers license for the first time. He is 20 years old. She has a car that she owns and she is named under on the policy. The idea is to let him use that car only for sake of the test so he can have his drivers license. There are no plans for him to be driving this car as a regular basis after the test. He is not currently named on any other policy for any other car either if that makes any difference. Does he need to be specifically added to the existing policy to cover him liability wise during the test? [link] [comments] |
Posted: 28 Apr 2019 10:26 PM PDT I have a question about insurance on a car. I am going to use fake numbers to make it easy. Let's say a person buys a 40k car. Let's say they only finance 20k of the car and put 20k of their own cash down. This person doesn't need gap insurance because the value of the car is greater than the 20k they have financed. So let's say this car is totaled on day one. Let's say insurance determined the value of the car was 30k and that is what they give this person. After paying off the loan this person only has 10k of his 20k back. Meaning this person just lost 10k. To repurchase the same car they would need to put an additional 10k on top of what the insurance company gave them. Is there some form of gap insurance that doesn't just protect the loan amount, but the actual amount the person paid? Basically they are not upside down in their loan but they are looking at losing a lot of their own cash in the event of a total loss. [link] [comments] |
Posted: 28 Apr 2019 06:20 PM PDT As I attempted to say in the title I go new leg braces with my Florida BCBS Medicare Advantage plan, I was told there was no copay/deductable and stupid me went "Whoa, theyre completely covered" forgetting I had 20% coinsurance. The final bill was $13,226. Copy of bill received here The way I read that the bill was 13,226. $314 was paid. The bill was discounted -$10,266 leaving the final bill of $2645 which I'm responsible for 20% which would be less than $550. Twenty percent of $13,226 is significantly higher. If you go on the BCBS website the bill is broken down entirely differently but they still come up with I owe $2,645. There it claims BCBS paid the $10,200. An adjustment makes it look like the brace maker agreed to give a steep discount or at least not charge an 500% markup. $550 dollars is a lot more affordable than a enough money for a downpayment on a car, that theyre asking. The guys insurance is with State Farm. Would I have a claim for DV? My car is only 60 days old. The damage is the rear driver quarter panel, bumper, and a scratch rim. I am buying a used Nissan Leaf to replace my 1986 Volvo 240 as my daily driver, but I would like to keep the Volvo as a back up. I would probably drive it less than 1200 miles a year. It doesn't seem like it would qualify for pay per mile, because it doesn't have an OBDII port and the odometer doesn't work. Would it qualify for some kind of classic car insurance? It is not exactly in pristine condition, but I would be able to keep it in a garage. The Leaf will be the first car I've had insurance on myself, up until now I've been on my parents multi car plan. Switching jobs(insurance) during wife’s pregnancy Posted: 28 Apr 2019 06:58 PM PDT So I'm thinking about switching jobs, I haven't gotten the particulars on the new insurance, although it doesn't kick in until after a month. My wife is due in July and the switch would probably take affect mid May. If the company does not offer spouse and family insurance, will I be able to get my wife on a plan even though she is pregnant. Does pregnancy count as a pre existing condition? Posted: 28 Apr 2019 02:46 PM PDT Labor day 2017 we were hit in our brand new car by a woman who apparently didn't see us when she launched out of the parking lot to cross the street. She hit our front passenger side by the wheel and front of door. Luckily no one was severely injured. Our car was totaled and that claim is wrapped up. The medical claim is still open... I suffered back pain for about a month. I had to stand up and walk around very often or I'd suffer back pain. On top of the physical pain I suffered from undiagnosed / minor PTSD for at least a couple months, my drinking got worse, I gained weight, and I still don't enjoy driving as I used to. Driving for myself (and my wife) has become a stressful experience, where before the accident it wasn't any problem and I actually found it to relieve stress. My son and his friend were in the back seat- they didn't have any effects from the accident, thankfully. My wife, on the other hand, has had shoulder pain ever since. She's had xrays and an MRI but didn't reveal any damage from the accident that needed anything other than physical therapy. She went through months and months of therapy- yet she still has pain when she uses that arm. If she takes it easy, the pain isn't present- but if she begins using it for lots of laundry, dishes, or needing to use her mouse a lot at work- it begins to hurt a lot. Out of pocket expenses for medical for her are about 3500 dollars. The actual amount billed to insurance / medical providers is probably near 8k-10k, it's been a while since we've added it all up. The imaging company never got paid and still has an outstanding balance of about 4 grand due from the insurance claim. Regardless- I don't know how to calculate pain and suffering. We will demand the insurance reimburse our out of pocket expenses, but I don't know how to calculate expenses relating to physical and mental suffering as a result of this accident. As I said we both still get extremely stressed from driving, where before it wasn't an issue. I already have an anxiety disorder and this incident just fanned the fire for me. It was a trigger that made things worse. My back pain lingered for a couple months but eased off and I think my accident-related pain is gone (I do have other pains that have surfaced after the accident but not sure if they are related). Wife still has limited use of her arm if she wants to avoid pain. It's been nearly 2 years and I feel it should be better by now. Sorry for the long post- but I feel each of these scenarios are different and need all facts to consider how to determine amount for pain and suffering. What do people think about this? I saw the pole, but it was dark and I did not see that the pole was on an island. I went up on the island and I sided the pole. My car is drivable, but the damage is something I cannot live with because I just got the car a year ago. Should I claim this with my insurance? I've never dealt with insurance before. I have an insurance that's cheaper that what my current one is offering but since I don't know when I'll be getting my car (I know it will be mid-late June), I'm not sure what to do regarding lapse in coverage. If I know on the day of me getting my car, can I call and cancel the policy and have the new one start the next day or even the same day? I will have everything set up and processed with my new insurance but they said I can adjust my start day as needed. After I decided to restart my policy Geico asks almost twice more premium for exactly same coverage $467 as opposed to $279 before.. Nothing was changed on my side. I've never filed or participated in any claims. Geico confirmed by phone that it is just insurance rates went up... I can understand $41 but 41% I can't... Car B saw car A, and was almost done making the left turn, thinking Car A was going to slow down. Car A didn't, hit the left side of Car B. Car B has minimal damage, left rim is shattered, minor scratches near wheel, while car A whole fromt left side is crushed, including healdlights. For your nonbiased perspective who is was at fault? Posted: 28 Apr 2019 10:48 AM PDT I recently had damage occur to a vehicle I have covered on my insurance with esurance, by a insured driver. The vehicle was taking a corner and ran into a concrete barrier, causing damage to the passenger side. Overall i'm wondering if it would just be better to pay out of pocket and not involve insurance. I don't have any previously reported accidents that were our fault and I don't want my rates to go up. I'm getting quotes for the damage personally through a few shops now, though I estimate damages to be around 3-5k. I have full comprehensive/collision on the vehicle with a 1k deductible on each. I hadn't bought travel insurance yet at the time and I know travel insurance doesn't cover pre-existing medical conditions. I am seeing a specialist in two weeks and wish to ask him if he thinks I should travel if I can walk on my injured leg by then (considering Vietnam is such a hazardous country to be in for not able-bodied people). At this stage I still intend on going to Vietnam, if I bought travel insurance now and then my doctor writes a letter advising me against travelling to Vietnam, will that make me covered or is it too late? Have you ever been paid out for a stolen vehicle if you left your keys in the car? Posted: 27 Apr 2019 11:30 PM PDT My car was stolen and recovered 24hr later. The copper I spoke to said it had damage to the front but he doesn't think it's a write off I am still in possession of the set of keys I use and to the best of my knowledge the car was locked at the time of theft. However I can't find the spare key and I'm afraid I may have left it in the car (I don't recall doing this but I'm preparing for all possibilities.) So worst case scenario would be I left the car unlocked the thieves got in, found my spare key in the car and stole it. I am located in Australia and am insured by Budget. My insurance conditions of cover state: "ensure you or the person in charge or control of the car, lock the car, activate any required security devices and remove all keys from within, on, or in the immediate vicinity of the car when it is left unattended for any period of time " " If you do not observe the conditions of cover, we may reduce or refuse to pay a claim, or cancel the contract. " Therefore I am aware that i the vehicle was found with keys in the ignition I may not be covered. However an acquaintance of mine said she got paid out even though her keys were in the car.
