    My partner just became our landlord. Do we need a 3rd party for the new lease & operators agreement?

    My business partner has more capital than myself and our 3rd partner and she just bought our building from our former landlord. Now we are in the process of drawing up a new lease. Has anyone else gone through a similar situation? We are on relatively good terms and I am really glad that she owns the building now because our rent will be capped, but I am afraid it could put us in an awkward spot when it comes times for necessary repairs and building maintenance. Is it worth hiring a mediator to advise the lease, or do we just draw up the terms based on common sense and sign?

    Additionally we now need to revise our operators agreement because she is gonna have a reduced role in the day-to-day operations of the business to make time for the property management.

    I don't have a law degree, but my academic background is in Logic, Writing, Rhetoric, and Communications. As a result, I typically have no problem with contracts, but this one has be nervous because the prejudice of "we're partners everything should be cool". If it makes a difference, we don't have much of any working capital right now due to the seasonal nature of our business, so it would be out of pocket to hire someone.

    Best online courses for learning how to run a business? (xpost: Entrepreneur)

    I have been running my own businesses (with partners), which have ~40 staff and gross 7 figures.

    Never took a single business class in school or got an MBA. But I've been interested in taking some classes online that could help me become a, for lack of a better word, "legitimate" businessman.

    Maybe online finance and accounting courses, things of that nature? How to do financial modeling or forecasting, maybe? Just things that make me feel less like a fraud in business meetings lol?

    I mean, I know I could just hire people to do a lot of this stuff (and I do), but I also want to know what they're talking about at a technical level.

    Taking over my dad's small business

    Hi guys.

    So quick context. My dad owns a small clothing store. We sell mens clothes (suits and the likes) to a smallish market. The company has about 30-40 years in business, and from what I understand sales are healthy and haven't really been decreasing over the recent years. The company makes about 60k in revenue each month, and operating expenses are low. The company employs around 20 people, not many specialized. Due to its longevity, the brand is well known and respected in the market, particularly by "regulars" or loyal customers, and one of the biggest challenges the company is now facing is renewing its brand to younger demographics.

    My dad has reached a point where he now wants to retire. I have noticed he no longer feels like going to the office, and his energy and motivation have decreased. I was never vetted to take over the company, but, as the only child I feel this is an interesting challenge, and I would like to take the company to the next level, so to speak.

    Thing is, I don't know where to even start. I feel I should first take some time to understand the company fully, understand its systems, its employees and their roles.

    After that I was thinking of understanding the numbers, how much they sell each month on average, the LTV of their customers, the average ticket value, how much margin do they have on each item, etc.

    Once that is done I was thinking of identifying projects I could carry that I think could affect the company positively. For example, a rewards system, and giving myself a budget over the project and carrying it on.

    All of this while learning the day to day operations of my dad and slowly phasing him out so he can enjoy his retirement.

    Does this sound like a good plan? Does anyone have any experience in such a project?

    Employee scheduling software

    I am the head of a medical office and I am looking for an online scheduling app. I've looked at many of the big ones and I find it's not suitable for our needs.

    The biggest one being that the employees should be able to enter their AVAILABILITY not when they are not available. The default should be unavailable and each nurse should go in and select days and times they ARE available.

    Also the ability to see the schedule in a month view with a strong messaging platform would be a nice bonus.

    I loved everything about deputy except we had to enter each day as unavailable or available for every month. We have done a trial of humanity, and the lack of ability to see schedules in a month view made this less desirable.

    Please let me know if you can recommend anything!

    Getting a small business loan for a new business 20k

    I've been selling on eBay and locally for over 10 years. About 6 months ago I registered a business and started parting out motorcycles from my house. It started off slow and now I have more than I can handle at my home. I'm looking to get a warehouse and take it too the next level. I found a property for sale that's already set up for what I need. I need to get a business loan, i have good credit but my business has only been established for 6 months. Any help is appreciated.

    I am currently a building maintenance professional for one company, and I do a lot of different stuff. Maintenance, repairing things, and whatnot. I also have managed several building and remodeling projects successfully from estimation to completion.

    I've always looked at going out on my own. In fact I've done impromptu contracting work where I've managed my own work crews. I'm not -bad- at what I do.

    So I'm looking at expanding my horizons a bit and striking out on my own. I have the time to do it. Now it's really just a matter of putting together the right business structure and getting the insurance.

    For people who have done it, how much did you end up paying for 1-2M general liability insurance? How did you structure your business?

    Managing 35 minimum wage staff. Feeling lost.

    (Appologies if this isn't the right sub for this, please advise).

    Im the floor manager with 35 staff under me. All of them are minimum wage and most are students. Im the only manager besides the 2 owners.

    Ive managed staff before but not this many and im having a very hard time. Many staff consistently show up late (only 5 to 10 min but its all the time). There are daily cleaning duties and its a big facility, and every day 2 or 3 just dont do them. Its hard to constantly run around and make sure they are getting done. I dont want to hound or micromanage the staff, but i still need jons to get done. As of now, productivity is low and ive had a few staff complain about me due to me getting frustrated.

    I went on the floor and found 10 staff huddled doing nothing and i got pissed. I was professional but stern, but the owners took the complaints as me being tottally in the wrong, but they didnt support my position or help with how to correct the situation.

    I dont feel supported, and since its a new business (open less than a year), there are no established procedures, training programs, or anything. Ive had to come up with it all and its not working.

    What do I need when opening a business bank account for my LLC?

    Hi all,

    I just called my credit union to open a business bank account for my brand new single-member LLC! The teller I talked to told me I needed to bring in a "dividend payee name record". I asked her if she could tell me what that was and she did not know. She just told me that I need it because the name of my business is different from my personal first and last name. I looked it up online and I am lost. I can't seem to figure out what it is. Some kind of proof of my business name? She also asked for my Articles of Organization, which in my mind, should suffice for proof of my business name. Does anyone know what "dividend payee name record" means? Thanks!

    Partner arrangement for small restaurant

    I am considering opening a small pizza restaurant to serve an expat community in a smallish city in China.

    There is another expat who is interested in partnering with me. He's an older man who is already retired.

    He wants to be partners (50/50) but will not be doing any work in the restaurant. His suggestion is that we both invest the same amount to start the business, but since I'm actually working the restaurant, ill be paid a salary (we have not yet discussed what the salary would be).

    Is this a typical partnership arrangement for two investors where one investor works and the other doesn't?

    Are there other arrangements I could consider?

    How to deal with an overpaid employee (that is vital to the company)

    So, a little back story. I inherited my mom mobile home park 3 years ago, it was not run properly and was basically ran into the ground. I have spent the last 3 years getting it going well again and we are about at max capacity and making the maximum amount of money we are going to make for the foreseeable future until we can expand. We are In desperate need of another employee and me (the owner) doesn't take a salary and I work a delivery driver job to pay the bills. I've known since the start that my mom's maintenance man/property manager way WAY overpaid but he's been with us through thick and thin and he is incredibly handy and can build/weld/do electric work and he's incredibly honest and has integrity as well. He makes $70k/yr plus I pay half of his health insurance, he works 3 days a week and is oncall the other days but maybe gets called in once every 2 months, 3 weeks of vacation, etc. Etc. I recently signed up with QuickBooks as I have been winging it for the last couple of years as far as finances go. After spending a couple of weeks doing the numbers, things dont look good. We only gross about $250k a year, my payroll is $150k, utilities are about $30k (I pay the water bill for the park), property taxes are $30k, that doesn't count general maintenance, tree trimming, and upkeep for the park which is probably another $20k/yr, that doesn't leave a whole lot of pie left over for improvements/another employee, me getting paid, etc. Here's the thing, my mom set up his work schedule and pay and I told him that I would honor that when I took over. He is my single biggest asset but also my single biggest expense, he runs the day to day operations (3 days a week) and knows the park inside and out but hes costing me do much money he's bleeding me dry. If he worked a 4th day I could maybe get by without another employee but anytime I bring anything about his schedule or pay up he automatically says "I don't care what happens as long as my pay and schedule don't change, I can make a lot more money being a welder but I stay here because I like my schedule". He's really got me over a barrel because I need him (at least until I learn the business a bit better but it's hard when half of my day is eaten up with my other job). I don't know, I'm just at a loss, I don't expect any real answers from anyone, I guess I just need to vent and maybe someone will be able to give me some good advice. Thanks in advance

    Automating Expense Reporting and Progress Updates... HELP!

Any thoughts on how to create a daily survey maybe or google doc that they can go to a link and fill one out daily and its stored in the data base?

    Using Personal Credit Card to Get Business Cash (UK)

    Hello, I hope everyone is well.

    I have run into some cash flow problems with my business, as we have had to take several unexpected costs all in one month and therefore do not have the cash to hand to pay for them as the business has been closed for several weeks so there has been no revenue. I need around £4000 to pay off the costs, which I cannot provide through my own savings or from friends and family loans. For other reasons, I am reluctant to get a business loan.

    I am confident that this is a short term issue, and the costs can easily be paid off within a few months of the business trading, however, the main issue is a lack of cash at this very moment. I have thought about applying for 0% credit card (which I am eligible for) and making a payment to the business using the card to pay for the costs (or a significant part of it, depending on the credit limit). However, I am concerned that this may have negative repercussions that I am not aware of, so I would like some advice on if I am missing something.

    To clarify how this would work, I would charge the credit card to the business online payment processor and when the funds have cleared into the business bank account, I would withdraw the cash to pay for the required services. Once the business is trading again, I will begin making immediate monthly payments to repay the credit card.

    For argument's sake, let's assume that I will be accepted for the credit card, the business costs will be paid, the card is repaid within the 0% time limit.

    Am I missing anything out?

    As a customer, what general content would intrigue you and capture your attention?

    I own a small local moving company and want to stay top of mind in my past customers during the rise of peak season (spring).

    The primary purpose would be for them to see my brand and to hopefully think of us should they hear of or know anyone who needs to move but to also promote our referral/bonus program.

    I'd like to do so via a single mailed newsletter this spring with the possibility of doing a mailing at most quarterly.

    My question is, what type of content/article/story would you think people would enjoy reading?

    No one obviously cares about the moving industry so anything about the industry or us in general would be a waste.

    I was thinking of including a good recipe of some sort but read somewhere that including that sort of content was pointless.

    I was also thinking of including some special deals I arranged with some other local service providers in the area as an exclusive discount for our customers.

    Any thoughts on content ideas you would like to read about from a moving company?

    Property Management company brainstorm

    Hello All,

    I am current operating a small property management company who has a growing portfolio of both short term and long term properties, in my industry I see a lot of Air B and Bs that we manage and wanted to hear some ideas that we could implement to improve processes or give a better owner experience.

    Our process is pretty simple clients give us their login information and we manage their short terms air b and bs and sent an invoice at the end of the month collecting our percentage, we keep a maintenance account with the client's approval to repair small things with the property (changing air filters, replacing light bulbs, etc). I'd like to see the process automated were we can directly debit from clients accounts. Owners normally sign our agreement via docusign. For guests we always go above and beyond with trusted companies that attend to landscaping, housekeeping and general appliance maintenance.

    Lead generation could some work too, inquires currently coming from SEO, Social media and thumb tack.

    Any suggestions?

    Recommendations for best (preferably free) referral program platform

    I'm looking to implement a referral program for an application I've developed, we're just operating with a limited budget, so free is preferred.

    Referral programs are an excellent way to market to a greater audience. By incentivizing referrals your user base grows while rewarding early adopters, it's a win-win.

    At one point we thought about developing our own referral layer, but we just don't have the bandwidth to knock this out in a cost-effective way.

    Personal Paypal account used for business and personal, how to separate and file taxes?

    Let's say a personal Paypal account was used to collect LLC business payments for services rendered. The money was then spent through the Paypal account, never being moved into the business account and then "properly" distributed. How should the actual income from the services be taxed? The Paypal funds spent were largely used to pay 1099 workers through Paypal itself. But some personal transactions and distributions happened as well since some of the income in the paypal account was from personal transactions with friends and family. The state is PA. I am aware now that this was not a great way to go about things, so please refrain from scolding me and instead share relevant advice. And yes I know this requires a CPA/lawyer. I just want to hear from the internet, okay? Thanks.

    Business Terminology Question

    Trying to get some help on a business term. When your business can bring in more sales/production but the cost to produce those sales doesn't affect (or barely does) your overhead. So we know over break even point each month and know that after we hit X in sales that other than the cost of goods expense, we can produce those goods without adding to employee, utilities, etc. cost. I know there is a word for this but for the life of me I can't recall it. Any help would be appreciated.

    Buying Family Business. Nuts and Bolts of Transition.

    Hello,

    I have been trying to google this as much as possible but whenever I "family business" is in the search all you get is articles on keeping peace and harmony in the family when you transition a business. That is all well in our case, lots of good communication there. What we don't have a lot of in our family is traditional business knowledge.

    What I am looking for is information on the exact process of transition. We have a valuation in progress, a working agreement of what that will mean in terms of the sale contract we will have drawn up with owner financing for the sale. What I am curious about is how do I set up for the transition date. The business is currently run as a sole proprietorship and I am assuming I want to run it as a LLC (could be way off here, just an assumption). Will I need to open all new accounts with credit card, bank, insurance, and workers comp insurance, or will those all be transferable?

    A lot going on so feel free to point me in the direction of quality resources to do my own reading. Thanks in advance!

    Fantasy Sports to Raise Funds??

    Does anyone know the legalities that would come into play if I were to get local sports teams/schools involved in fantasy sports as a fundraiser and take a cut of the $ for running and organizing the leagues? Would I need to speak to the platform the leagues are run on? I have an incredible passion for fantasy and sports as a whole and am a Sport Management grad so I have the passion and expertise going for myself to justify knowing more about this topic than most people who are looking into fundraising for their sports team/company, etc.

    ALSO: I would explore getting local businesses to come in and donate prizes, etc. so people aren't exactly winning $ at the end of leagues (the whole game of skill or luck debate)
